The Governor’s April 3 proclamation, as extended by the May 8 proclamation, grants temporary relief from the enforcement of residential evictions and foreclosures to prevent the displacement of any person from their residence during the state of emergency. [2] [5] However, the eviction and foreclosure moratorium has expired. [6] Hardest Hit Alabama, a federally funded foreclosure prevention program, has reopened to provide shortterm mortgage payment assistance to those who have lost employment or income due to COVID-19. The Public Service Commission’s March 17 statement announces that the Commission has collaborated with Alabama Power and Spire to ensure that customers whose income has been affected by the COVID-19 pandemic do not face electricity or gas utility service interruption. The Governor’s March 20 announcement provides that people receiving rental assistance from the Alaska Housing Finance Corporation are protected from eviction for 60 days and directs the Alaska Housing Finance Corporation to suspend foreclosure and evictions immediately. [1] [2] The Governor’s April 10 signing of SB 241 temporarily suspends any statute that would give a cause of action for evictions or foreclosures as applied to a person experiencing financial hardship due to COVID-19 until the earlier of June 30, 2020 or the end of the state of emergency. [3] The legislation does not prevent evictions for misconduct, violations of law, or non-monetary contractual breaches. [3] The eviction and foreclosure moratorium has expired.

The Alaska Judiciary’s April 24 administrative order provides that telephonic eviction hearings may be held so long as doing so is consistent with the CARES Act and the grounds for eviction are not suspended by SB 241. [4] The administrative order also states that trial judges may find good cause to stay those outstanding eviction orders not covered

by SB 241 due to the current public health emergency. [4] Additionally, if a tenant is subject to a quarantine order or is selfquarantined pursuant to public health guidelines or a doctor’s recommendation, the eviction should be stayed. [3] Furthermore, public utilities must grant protected persons deferral agreements, as described by the law, and may not charge late fees or interest. YES. The Governor’s April 6 executive order encourages—but does not require—that commercial landlords adjust or defer rent payments for commercial tenants affected by the COVID-19 pandemic. [5] The Arizona Department of Housing has established the COVID-19 Rental Eviction Prevention Assistance Program, with an initial budget of $5 million. [9] Arizona renter households who have suffered a substantial loss of income resulting from COVID-19 (including job loss, reduction in compensated hours of work, or other loss of income related to COVID-19), and do not have financial resources to cover their rent may be eligible to receive assistance with rent due on a primary residence in Arizona. [9] The program has several requirements for eligibility. [9] Has the State taken any action to provide mortgage relief?

OTHER. The Governor’s April 6 executive order encourages—but does not require—that lenders provide commercial real estate borrowers an opportunity for forbearance if the commercial real estate borrower has suspended eviction actions against its tenants as required under this order. [5] The Governor’s March 28 signing of SB 1690 creates a $50 million Crisis Contingency and Safety Net Fund that may be used during a state of emergency to provide housing assistance, including payments to prevent foreclosure. [4] The “Save our Home AZ” program is a foreclosure assistance program for underemployed and unemployed Arizonans offering Principal Reduction Assistance, Monthly Mortgage Subsidy Assistance and Second Lien Elimination Assistance to qualified homeowners. The Arizona Bankers Association’s March 27 letter to the Governor provides that banks and mortgage servicers have suspended single-family mortgage foreclosures for a period of at least 60 days. [3] The Governor’s April 6 executive order extends some eviction protections to small business commercial tenants who would be eligible for the federal Paycheck Protection Program. [5] Until May 31, commercial eviction actions are suspended for tenants unable to pay rent due to COVID-19 related financial hardship. [5] Commercial landlords are also advised to consider other actions, such as rent deferment and waiver of late fees. [5] Has the State taken any action to provide utility services relief?

OTHER. The Governor’s March 25 announcement describes the creation of the Electric Utility Relief Package, a cooperative agreement with the state’s largest electric utilities. [2] The participating organizations agree that: (1) no customer will have power to their home shut off during the remainder of the crisis for inability to pay; (2) no penalties, late fees or interest will be assessed during this time, and (3) the utility companies will work with their customers to provide flexible options for payment, as well as guidance and choice of rate and payment plans. [2] The Corporation Commission’s April 20 announcement urges utility customers to contact their service providers in order to learn about resources and options available for persons affected by the COVID-19 pandemic. [6] The Corporation Commission’s May 14 news release announces the availability of $16 million of emergency federal Low-Income Home Energy Assistance Program (LIHEAP) funds for households throughout Arizona in need of energy assistance and approximately $1 million of energy assistance funding for tribes and tribal members. [7] The funding was made available as part of the federal CARES Act and the Corporation Commission urges struggling costumers to contact local Community Action Programs. [7]

The Supreme Court’s March 17 order, as extended by the April 3 and April 23 orders, suspends all in-person court proceedings until after May 15, 2020, which operates as a partial moratorium on evictions and foreclosures. [1] [2] [4] These opinions, however, urge judges to utilize video conferencing, teleconferencing, and other technology in order to continue to conduct matters that do not require in-person proceedings, which might permit some eviction and foreclosures proceedings to move forward. [1] [2] [4] The Supreme Court’s May 8 order confirms that, beginning on May 18, 2020, all courts shall resume hearings (though courts must take certain measures to combat the spread of COVID-19). [7] The Supreme Court’s April 28 opinion requires that all eviction complaints and failure-to-vacate charges filed with the courts must affirmatively plead that the property at issue is not covered by the CARES Act’s provision temporarily prohibiting the foreclosure on federally-backed mortgages. YES. The Public Service Commission’s April 10 order directs electric, gas, and water public utilities within the Commission’s jurisdiction to suspend utility shut-offs during the pendency of the Governor’s emergency declaration, or until the Commission rescinds the directive. [3] The order also suspends any rules that prevent or place conditions on utility re-connections and encourages utility providers to offer reasonable payment arrangements after the prohibition on disconnections is lifted. AB-2501 is pending in the legislature, and the bill would enact the COVID-19 Homeowner, Tenant, and Consumer Relief Law of 2020. [13] Among its many provisions, the bill authorizes residential mortgage borrowers experiencing COVID-19 related financial hardship to seek mortgage forbearance. [13] The bill requires mortgage services to provide the forbearance requested for 180 days and to extend the timeframe if the borrower affirms that they continue to experience hardship. [13] A-2501 is pending in the legislature, and would include various mortgage borrower protections, including the ability for mortgage holders to request forbearance under certain circumstances. [18] Has the State instituted any moratoria on evictions or foreclosures?

YES. The Governor’s March 16 executive order, as extended by the May 29 and June 30 executive orders, removes statutory barriers that would prevent local governments from limiting certain COVID-19 related residential or commercial evictions until September 30, 2020. [1] [7] [8] The Governor’s March 27 executive order takes further protective action, and extends for 60 days the time for a tenant to respond to a complaint that seeks to evict the tenant, if the tenant needs to delay rent payments for certain COVID-19 related reasons. [4] Furthermore, no eviction writs may be enforced. [4] These provisions are in effect unit May 31, 2020. [4] Additionally, the Judicial Council’s April 6 emergency rules stay all foreclosure actions. [6] Similarly, courts may not issue a summons on a complaint for unlawful detainer, may not enter a default for failure to appear in such an action, and any trial set in an unlawful detainer proceeding as of April 6 must be continued at least 60 days. [6] Both rules are in effect until 90 days after the Governor declares that the state of emergency is lifted, or until the rule is amended by the Judicial Council. [6] AB-828 is pending in the legislature, and the bill would institute temporary moratorium on foreclosures and unlawful detainer actions until 15 days after the state of emergency has ended and would allow courts to set up repayment plans for tenants. [12] As discussed above, AB-2501 is pending in the legislature, and the bill would enact the COVID-19 Homeowner, Tenant, and Consumer Relief Law of 2020. [13] Among its many provisions, the bill prevents foreclosure actions during the COVID-19 emergency and for 180-days thereafter. [13] Borrowers with multifamily mortgage loans would also be able to request forbearance, but they must provide rent relief to tenants living in the property and would prohibit them from evicting tenants for nonpayment. [13] SB-939 is pending in the legislature, and the bill would make it unlawful to evict a commercial tenant during the COVID-19 state of emergency. [15] The bill would also provide additional protections to commercial tenants, such as the ability to renegotiate or cancel a lease under certain conditions. [15] SB-915 is pending in the legislature, and the bill would prohibit the management of a mobile home park from terminating or attempting to terminate the tenancy of a homeowner or resident who is impacted by the COVID19 pandemic for up to 120-days after the state of emergency or is terminated, unless necessary to protect the public health and safety. [14] The bill would also prohibit, during this timeframe, the management of a mobile home park from issuing notices relating to rent increases, termination of tenancy, or refusal to renew tenancy. [14] A-1436 is pending in the legislature, and would provide various tenant protection, such as specifying that a covered tenant who does not pay rent for up to 90 days after the state of emergency expires is not in default and is not guilty of unlawful detainer. [17] A-2501 is pending in the legislature, and would include various mortgage borrower protections, including the ability for mortgage holders to request forbearance under certain circumstances. YES. The Public Utilities Commission’s Executive Director determined on March 17 that energy, water, sewer, and communications companies under the Commission’s jurisdiction should cease customer disconnections for non-payment. [2] The Commission maintains a list of consumer protection provisions covering both investor owned utilities (which are regulated by the Commission) and publically owned utilities. [10] The Governor’s April 2 executive order suspends residential water disconnections, mandates that residential water be reconnected if it was discontinued for nonpayment since March 4, and suspends water disconnections to certain small businesses within the critical infrastructure sectors as designated by the State Public Health Officer. [2] [3] [5] [7] In this series of orders, the Governor also directed DOLA, the Department of Labor and Employment (“CDLE”), and the Department of Regulatory Agencies (“DORA”) to work with property owners and landlords to exempt tenants and mobile home owners from fees or penalties for untimely payment of rent until June 13, 2020. [2] [3] [5] [7] The Governor’s June 13 executive order directs DOLA to work with landlords to implement rent repayment agreements created by DOLA. [9] The April 30 executive order, as extended by the May 29 executive order, also prohibits the charging of any late fees or penalties due to untimely rent payments until June 13, 2020. YES. The Governor’s March 20 executive order, as extended and modified by the April 6 and April 30, and May 29 executive orders, directs DORA to work with State-chartered financial institutions to identify practices and policies to combat the threat of residential and commercial foreclosure to individuals and small businesses. [2] [3] [5] [7] The Governor also encourages other financial institutions to halt foreclosures and related evictions when there has been a substantial decrease in household or business income due to the COVID-19 pandemic. [2] [3] [5] [7] These financial institutions are encouraged to provide a ninety-day deferment of payment for all consumer loans, including

YES. The Supreme Court’s March 16 order, as extended by the April 16 order, designates certain actions as essential and stated they may not be stayed. [1] [4] Actions for eviction or foreclosure are not designated as essential. However, the Supreme Court stated that the Chief Judges of the various districts retain the discretion to determine whether non-essential matters are necessary to “prevent a substantial risk of imminent financial hardship or imminent risk to the health, safety or welfare of any individual or the community at large.” [1] [4] The Supreme Court’s May 5 order confirmed that courts should continue to operate on an emergency basis, and that no jury may be summoned before July 6, 2020. [6] The Supreme Court’s June 15 order precludes the summoning of people for jury service for any time prior to August 3, 2020. [10] The Governor’s March 20 executive order, as extended and modified by the April 6, April 30, and May 29 executive orders, directed DOLA, CDLE, and DORA to work with property owners and landlords to identify any lawful measures to avoid removing or executing eviction procedures against tenants or mobile home owners without cause or as a result of late or nonpayment of rent or minor tenancy violations until June 13, 2020. [2] [3] [5] [7] Additionally, the Governor’s March 20, April 6, April 30, and May 29 executive orders authorized the Public Trustees of the State of Colorado to suspend certain provisions concerning the foreclosure process, including, for example, provisions affecting deadlines for tendering funds to cure and to tender redemption funds. [2] [3] [5] [7] These deadlines have been extended to June 13, 2020.[3] [5] [7] The Governor’s April 30 executive order, as extended by the May 29 executive order, prohibited the filing of new eviction actions, the removal of tenants from a premises, and the execution of eviction [5] [7] These protections expired on June 13, 2020. The Governor’s March 20 executive order, as extended by the April 6, April 30, and May 29 orders, directs the Public Utilities Commission (“PUC”) to work with all public utilities to suspend service disconnections for delayed or missed payments from residential and small business consumers related to the impacts of COVID-19.

The Governor’s May 14 executive order superseded the April 17 executive order and extended substantially identical eviction protections against residential evictions until after June 11, 2020. [1] [2] [3] [7] [8] [9] However, to the extent that an eviction or foreclosure hearing could be conducted remotely and both parties consent to a remote proceeding, this series of orders allowed those proceedings to move forward prior to May 30. [1] [2] [3] [7] [8] [9] The Governor’s March 31 executive order provided that the Supreme Court orders referenced above should be construed as prohibiting eviction proceedings until after the judicial emergency orders lapse. [6] This executive order also requested—but did not require—that the issuance and execution of writs of possession be delayed until regular court operations resume. [6] The Governor’s May 30 executive order prohibited many residential and commercial evictions until after June 20, 2020. [12] For residential evictions, landlords could not initiate or take any action in furtherance of eviction for non-payment until after June 20, 2020. [12] As with residential tenancies, commercial landlords could not assess interest or late fees for non-payment and must provide their tenants with at least 6 months to pay off past due rent. [12] This order was not extended and has now lapsed.

The Supreme Court’s May 30 order reinforced the Governor’s May 30 executive order and provided that all evictions are stayed until after June 20, 2020. [13] The order also requires that plaintiffs in foreclosure or eviction proceedings must file an affidavit prior to securing a writ of possession stating that the property at issue is not covered by the CARES Act. [13] The Supreme Court’s June 29 order failed to extend the moratorium on evictions, which has now lapsed.

Accordingly, eviction proceedings have resumed. [14] The order does mandate that all new eviction filings must include the CARES Act disclaimer affidavit provided for in the May 30 order. [14] Has the State taken any action to provide utility services relief?

YES. The Governor’s June 29 announcement unveiled the Virginia Rent and Mortgage Relief Program. [13] This program provides rent relief to qualifying residential tenants. [13] [14]

Has the State taken any action to provide mortgage relief?

YES. The Housing Development Authority (VHDA) has extended forbearance options for borrowers with VHDA mortgages who have been financially impacted by the COVID-19 pandemic. [15] The Governor’s June 29 announcement unveiled the Virginia Rent and Mortgage Relief Program.

This program provides mortgage relief to qualifying residential borrowers. [13] [14]

Has the State instituted any moratoria on evictions or foreclosures?

NO. The Supreme Court’s March 16 Judicial Emergency Order, as extended by the March 27 and April 22 orders, suspended all non-emergency eviction and foreclosure proceedings until May 17, 2020. [2] [3] [5] This order was allowed to expire.

The April 22 enactment of Chapter 1202 (House Bill 340) provides a 60-day continuance for eviction actions against residential tenants affected by the COVID-19 pandemic. [5] The law also provides a 30-day continuance for foreclosure actions against residential borrowers affected by the COVID-19 pandemic. [5] Finally, the law provides a 30-day continuance for foreclosure actions against residential borrowers who rent the property to a tenant unable to make payments as a result of the COVID-19 pandemic. [5] These protections have now expired.

The Supreme Court’s May 6 and May 12 orders permitted courts to resume in-person, non-emergency proceedings starting May 18, 2020, albeit with a preference for using videoconference or teleconference technologies. [7] [8] Accordingly, eviction and foreclosure actions resumed May 18, 2020. [7] [8] The Supreme Court’s June 8 modification of the Fifth Judicial Emergency Order provided a temporary suspension of residential eviction proceedings requested by the Governor to allow sufficient time for the implementation of the Virginia Rent and Mortgage Relief Program. [9] This order halted residential evictions until June 29, 2020. [9] The Supreme Court’s June 22 modification of the Fifth Judicial Emergency Order clarified that the June 8 order did not suspect residential evictions unrelated to the failure to pay rent. OTHER. The Department of Financial Institutions March 20 letter provides guidance to Washington regulated and exempt residential mortgage loan servicers. [3] The letter urges services to take actions such as mortgage payment forbearance for 90 days, refraining from reporting late payments to credit report agencies, waiving late payment fees, and postponing foreclosures for 90 days, etc. [3] Has the State instituted any moratoria on evictions or foreclosures?

YES. The Governor's March 18 proclamation, as extended by the April 16 and June 2 proclamations, severely restricts residential landlords’ and property managers’ ability to initiate, continue, or enforce any notice to vacate or eviction until August 1, 2020. [1] [4] [9] The April 16 and June 2 proclamations also prohibit landlords from assessing late fees, increasing rent rates, or attempting to collect rent for a property rendered inaccessible due to the COVID-19 pandemic until August 1, 2020. [4] [9] Lastly, the April 16 and June 2 proclamations also bar landlords of commercial properties from increasing or threatening to increase rent rates for tenants impacted by the COVID-19 pandemic during the same time period. The State Department of Commerce established the “Working Washington Small Business Emergency Grant Program” that provided rent or mortgage payments relief, but the program’s funding has been extinguished, and the program has closed. [6] Has the State taken any action to provide utility services relief?

YES. The Governor's March 18 proclamation encouraged—but did not require—utility service providers to suspend utility shut-offs, waive late fees for untimely payments, and create payment plans for customers in arrears.

The Governor's April 17 proclamation, as extended by the May 5 and May 29 proclamations, prohibits residential energy, telecommunications, or water utility providers from disconnecting service due to non-payment until July 28, 2020. Has the State instituted any moratoria on evictions or foreclosures?

NO. The Governor's March 27 emergency order prohibited the initiation or continuation of eviction and foreclosure proceedings arising from non-payment of rent or mortgage payments, including the execution of eviction or foreclosure orders, until May 26, 2020. [3] This order was allowed to expire and evictions and foreclosures have resumed.

Has the State taken any action to provide utility services relief?

YES. The Public Service Commission’s March 13 announcement directed water, electric, and natural gas utility providers cease residential service shut-offs for nonpayment until the state of emergency expires. [1] Additionally, the announcement required that utility providers must make reasonable attempts to reconnect service to an occupied dwelling that has been previously disconnected. [1] The Public Service Commission’s March 24 order provided that for the duration of the emergency, public utilities must suspend disconnections for any customer, must offer deferred payment agreements, and may not assess late payment fees or charges, among other things. The HEROES Act, which is pending in the legislature, contains various provisions for rental relief, mortgage relief, and eviction and foreclosure protections. [14] Similarly, the Emergency Housing Protections and Relief Act, which is also pending in the legislature, contains a number of rent relief, mortgage relief, and eviction/foreclosure protections. [15] Neither bill is expected to pass the Senate.

Has the Federal Government taken any action to provide mortgage relief?

YES. The CARES Act provides that individuals with federally-backed mortgage loans can receive up to 12 months of forbearance. [2] Landlords with federally-backed mortgage loans can receive up to 90 days of forbearance in exchange for giving up eviction rights against delinquent tenants. [2] The Federal Housing Agency’s (“FHFA”) May 13 announcement provides that borrowers with FHFA enterprise mortgages that are in forbearance under the CARES Act may opt to defer the missed mortgage payments

until the home is sold, the loan is refinanced, or at the end of the loan term. [3] FHFA’s May 19 announcement clarifies that borrowers in forbearance are eligible to refinance or buy a new home under certain conditions. [9] Freddie Mac’s May 13, 2020 bulletin announces the COVID-19 Payment Deferral, under which an eligible borrower will be brought current by deferring delinquent amounts to create a non-interest bearing balance that will become due at the earlier of the Mortgage maturity date, payoff date, or upon transfer or sale of the Mortgaged Premises. [4] Servicers must begin evaluating eligible Borrowers for a COVID-19 Payment Deferral on and after July 1, 2020. [4] Fannie Mae’s May 13, 2020 press release unveils its COVID-19 Payment Deferral option, which also begins on July 1, 2020. [5] The Department of Veterans Affairs' May 14 circular extended the foreclosure moratorium provided for in the CARES Act for VA-back loans until June 30, 2020. [7] This moratorium has expired.
