A few agents attending the three-hour continuing education course said the rule didn't seem fair.

Bonamer, a Venice-based author of a real estate management series, said the policy may not seem just, but his goal is to help agents avoid legal pitfalls that can end up costing them money or even their jobs.

“If you look at the money first, that's not the right thing to do,” he said. “You have an obligation to be honest with all parties at all times. Otherwise, you could be liable,” said Bonamer.

For example, he told a story about a Realtor who was asked by a prospective buyer about the condition of a home's roof. The agent responded that it “looked like it was in good shape.”

After the person bought the house and discovered the roof was in terrible shape, the agent had to pay for the repairs.

Instead of giving an opinion on a property's condition, Bonamer used humor to make his point.

“You have to say it appears to be a roof,” he said. “Tell them you don't want a Realtor's opinion, but a contractor's (opinion).”

Bonamer said Realtors need to be cautious not only about what they tell customers, but also what they put in writing.

He said he had to buy a new riding lawn mower for a customer because he listed that one was included with the house.

Instructor provides tips to real estate agents that can keep them out of legal trouble.

If real estate agents are hoping to keep their jobs and keep money in their wallets, they may want to listen to Chuck Bonamer.

A group of Northeast Florida Realtors recently discovered some tips at an ethics course that could affect their income and profession.

Every licensed Realtor is required to take the course every two years.

Bonamer, their instructor, mentioned a rule that shocked many of the agents.

He shared a scenario of a customer seeking a new Realtor after not liking the first one but still purchasing a home shown by the first agent.

Bonamer said the commission needed to be handed over to the first Realtor, despite the fact the second agent took over and com-

Bonamer legally was bound to pay for a new one.

In addition to teaching dozens of real estate courses every year, Bonamer is the president of Trans-Equity Inc., a brokerage firm that provides litigation support and lecture services to the brokerage and legal industries, according to the company's website.

He is a past president of the Florida Real Estate Education Association, chaired the Professional Standards Committee and won the Top Instructor Award

from the National Association of Realtors.

“I'm not an attorney, I only train them,” Bonamer said. “I want to make sure you're protecting yourself.”

Another topic was that Realtors should not alter photographs taken of properties they sell because “warts” that are hidden by fixing an image in Photoshop also can result in a loss of income or career if an owner decides to sue.

Bonamer said all items inside a property should be invento-

ried and documented if they are included with the sale. It might be time-consuming to count every piece of silverware inside a drawer, but not doing so could lead to that agent paying for a full set.

While the information may have surprised some agents, it could be the difference in remaining employed or not.

NEFBA: SEAN JUNKER President wants to boost organization’s charitable projects, grow membership and boost the Apprenticeship Program.

Now that the Northeast Florida Builders Association is in its new headquarters, the organization's 2019 president wants to thank those who made its construction possible by giving back to the community.

Sean Junker, 47, said he would like to help more people by expanding NEFBA's charitable projects like Builders Care, which provides free housing repair services for needy residents in the region.

Several weeks ago, for example, the group and a few dozen volunteers built a wheelchair ramp and painted the house of a Korean War veteran who suffered a stroke.

Southpoint, where he has worked since 2001 and served as president since 2006.

Junker also would like to expand the organization's membership and see more people enroll in the Apprenticeship Program to com-

bat the regional labor shortage.

As the leader of a local homebuilding company, Junker has witnessed firsthand the toll of a lack of qualified trades workers, which he said often results in project delays.

Many years before he moved to Jacksonville, a college professor convinced Junker that he should study building construction.

Before that, his initial desire was to become an architect, even though no one in Junker's family was remotely tied to the industry.

In fact, both his grandfather and father were church pastors.

However, Junker said he was intrigued with the construction business when his father took the family to help build Habitat for Humanity homes. Soon, Junker worked during the summer while in high school as a roofer, framer and truss builder.

He and his family moved several times, living in Minnesota, Maine and several parts of Florida.

After high school, Junker earned an associate degree at Indian River State College and then transferred to the University of Florida, where he obtained his bachelor's and master's degrees.

As part of his master's studies, he spent nearly a year in Australia.

Junker said most of his classmates went into commercial construction but that he was interested in the residential side. His first job at the age of 24 was as an assistant construction superintendent in New Jersey.

In 1998, he transferred to Jacksonville. He worked with Taylor Morrison, which was called Taylor Woodrow before it merged with Morrison Homes.

In 2001, the owner of Providence Homes, Bill Cellar, hired

Junker as vice president of operations.

He was promoted to president five years later, right before the housing market crashed. Junker said he learned more during that “tough” experience than he could in any classroom.

“The most difficult times is when you grow as a person the most,” he said.

Junker, who has been on NEFBA's executive board since 2007, said he is honored to take on the role of president.

He said the “heavy lifting” already has been done. The group's new building was recently completed and he said the “amazing” staff and leadership at NEFBA are doing a great job.

NEFAR: JEANNE DENTON-SCHECK Increasing Realtor involvement in organization, especially among its younger members, is president’s top goal.

As the incoming president of the Northeast Florida Association of Realtors, Jeanne DentonScheck has one main goal. The longtime real estate agent wants to involve more of her fellow Realtors with the organization.

“We offer so much in education, that is free if you’re a member,” she said. “We also need to attract younger people who want to be on the board.”

Along with taking the role of NEFAR president, Denton-Scheck also was on the board of the Women’s Council of Realtors, where she served as a district vice president.

Denton-Scheck, who grew up in Goodland, Kansas, and married a rancher, moved to Jacksonville in 1990, living near the Jacksonville University campus.

She became a Realtor and spent her first 18 years as an agent with Watson Realty. About two years

ago, she joined Davidson Realty and now works out of the agency’s offices at World Golf Village in St. Johns County.

Denton-Scheck previously used the elementary education degree she earned at Fort Hays State University in Kansas to help teach exceptional education students.

She also drove a school bus and worked at Dillard’s.

Even though she has been a Realtor for two decades, DentonScheck said she continues to learn every day.

“I don’t think you ever fully know real estate because every deal, you can find something you don’t know about,” she said, adding that she tells customers she will find answers to the questions she doesn’t know.

She said she always tries to do the “right thing,” something she learned from living in a small town of about 6,000 people.

“If I did something wrong, by the time I got home, my mom knew,” she said with a smile.

Denton-Scheck is taking on the role of president from Charles “Ben” Bates, a Coldwell Banker broker in Palatka. She calls it a “big honor” and hopes people come to her for help because she is “very approachable.”

HOME SALES ARE SLOWING, BUT THAT’S NOT ALL BAD

Real estate and homebuilding industry leaders say that prices and inventory levels will adjust.

Many experts believe the Northeast Florida housing market is rebalancing, and they don't consider that to be a bad thing.

Data shows that the region is experiencing a slight dip in home sales, but area industry leaders from real estate brokers to homebuilders say the slowdown could help bring prices and inventory levels back to more manageable levels.

According to the Northeast Florida Association of Realtors November report, home sales were down 2.9 percent from a year ago, while prices continued to increase with the average home price at $258,803, or 3.4 percent more than November 2017.

“Affordability concerns are causing a slowdown in homeprice growth in some markets, while price reductions are becoming more common,” the NEFAR report says.

“Builders are showing caution by breaking ground on fewer single-family home construction projects in the face of rising mortgage rates and fewer showings.”

The report also showed that median prices are up 7.8 percent year to date, while inventory still is around 3½ months, significantly below the five- or six-month level that is considered balanced.

However, industry leaders said they did not think the market, nationally or regionally, will crash like it did a decade ago.

In fact, they believe demand will remain high as the region's population continues to climb since unemployment is at a low rate and wages are increasing.

Ann King, vice president of brokerage for Berkshire Hathaway HomeServices Florida Network Realty, said Jacksonville's warm weather and available jobs will continue to draw additional people wanting to purchase a home.

“Buyers are shocked when they hear how low our property taxes are here,” she said.

Plus, they said homebuyers are getting deals compared to the much higher interest rates in the past.

“We're trying to work with our builder partners on what their needs are, on their product choices and on how they purchase land to make it affordable for them,” he said.

er than home prices are rising, so some developers and builders likely will offer more incentives and amenities to attract buyers.

Pete Dalton, the owner and broker of Coldwell Banker Vanguard Realty, said real estate is like politics in that some media outlets report that sales are down while not analyzing the statistics or showing that the market is slowing nationally but not in all regions in the country.

For example, he said certain parts of Jacksonville are doing well while other areas are suffering a significant sales decline.

“The luxury market at the beach is really hot. Multimillion stuff is selling really well,” Dalton said.

Kevin Waugaman, the vice president of core services at Berkshire Hathaway HomeServices, also believes prices will stabilize and the market will “normalize.”

He said one major benefit will be the return of low home inventory to normal levels. That will give buyers more choices,

he said.

Dalton said people are nervous because the economy is undergoing serious fluctuations, but that the Jacksonville housing market at least is not “overheated” like Dallas and San Francisco, where he said it's “out of control.”

He said it will be a few months into 2019 before the impact is known since he said the local housing market is seasonal as most sales take place in the spring and summer.

TerraWise to develop single-family ‘green’ homes Bradley Pond in North Jacksonville will have 102 environmentally friendly homes.

The husband-and-wife team behind TerraWise Homes plans to build a community called Bradley Pond with 102 single-family environmentally friendly homes in North Jacksonville.

David and Melody Shacter, founders of the Springfield-based homebuilding company and Sustainable Jax LLC, submitted site plans Oct. 8 to the St. Johns River Water Management District to develop the neighborhood on 34 acres off Cedar Point Road, near Pumpkin Hill Creek Preserve State Park.

Like TerraWise's other projects, the houses are designed to be built with energy-efficient materials and construction techniques like spray foam walls and attics, “low-e” double-pane windows and heat pump water heaters.

Buyers will have the option to purchase solar panels to turn the houses into “net-zero energy” homes.

David Shacter said every house TerraWise builds gets a Home Energy Rating System score, which is a measurement system developed by the Residential Energy Services Network to determine a home's energy performance.

A score of zero, which is what TerraWise seeks with its solar-powered houses, means low to no energy costs for the homeowner.

The U.S. Department of Energy has determined that a typical resale home scores 130 on the HERS Index while a home built to the 2004 International Energy Conservation Code is awarded a rating of 100, the HERS website states.

The homes TerraWise builds without solar paneling typically score around 55, David Shacter said, which still provides a homeowner with reduced energy bills.

The Bradley Pond homes will offer buyers the same options. TerraWise has not set prices for those homes, but its similar projects range from $258,800 for a four-bedroom unit with 1,928 square feet of space to $349,900 for a four-bedroom house with 2,661 square feet.

The community will feature midcentury-style modern homes with front porches looking onto open recreational spaces, some with back alleys connected to rear-facing garages, David Shacter said.

He added that the project is planned to look more like a traditional neighborhood instead of a subdivision with denser housing.

Before starting TerraWise in 2013, the couple founded Harmony Homes in 1994 before selling the business to Drees Homes in 2005. They decided to start TerraWise after discovering it was difficult to renovate their home to be more energy efficient.

Instead of retrofitting old homes, which often can cost more than building from scratch, David Shacter said they prefer to construct new homes and build them to be “green” at the start.

Man who provided area contractors with workers sentenced to prison ASSOCIATE EDITOR

According to court documents, Rodriguez-Cruz engaged in a scheme through which construction contractors engaged the services of people who were living and working in the U.S. illegally.

A man who set up a shell company to provide construction labor to contractors in Northeast Florida was sentenced in December to more than two years in federal prison for conspiracy, fraud and failure to submit workers’ federal income taxes.

In Jacksonville, U.S. District Judge Timothy Corrigan sentenced Oscar Arnelson Rodriguez-Cruz, 41, to 27 months in federal prison for conspiracy to commit wire fraud and conspiracy to defraud the IRS of federal payroll taxes.

The court also ordered RodriguezCruz to forfeit $626,817, the proceeds obtained as a result of the wire fraud offense, to forfeit $105,461 in proceeds from the employment scheme and to pay restitution to the IRS for a tax loss of $3,436,008.

Rodriguez-Cruz is a Honduran citizen who was found to be unlawfully present in the United States. He pleaded guilty to the offenses with the knowledge he likely will be deported based on his pleading guilty to the charges.

According to court documents, Rodriguez-Cruz engaged in a scheme through which construction contractors engaged the services of people who were living and working in the U.S. illegally.

Rodriguez-Cruz formed a shell company, Gedeon Multiservices Inc., that entered into agreements with the contractors to provide construction workers.

By obtaining and paying the workers through the shell companies, the contractors disclaimed responsibility for ensuring that the workers were legally authorized to work in the U.S., that payroll taxes were paid and that adequate workers’ compensation insurance was provided.

After creating the shell company, Rodriguez-Cruz applied for a workers’ compensation insurance policy that covered a one-year period.

In the application, Rodriguez-Cruz represented that the policy would cover five employees and an estimated annual payroll of $121,000. NorGUARD Insurance Co., a division of Berkshire Hathaway GUARD Insurance Companies, issued the policy, charging a premium of $20,473.

Although the workers’ compensation premium was paid based on Gedeon having five employees with the stated annual payroll, Rodriguez-Cruz provided Gedeon’s Certificate of Liability to contractors and subcontractors in Bradford, Clay, Duval, Flagler and St. Johns counties.

He provided the documents to the contractors and subcontractors to help carry out the scheme to defraud by falsely representing that Gedeon had sufficient workers’ compensation insurance as required by state law.

wrote payroll checks to the shell company. Rodriguez-Cruz then cashed the checks at check-cashing services and at a federally insured financial institution and then distributed the cash to crew leaders, who paid the workers in cash.

No employees’ or employers’ payroll taxes, including for Medicare and Social Security, were deducted from payroll checks or paid to the government.

Rodriguez-Cruz kept about 4 percent of the amount of each payroll check as a fee.

During the scheme, he cashed payroll checks for hundreds of workers totaling nearly $15.7 million with his fee totaling $626,817.

The annual premium for a workers’ compensation insurance policy covering that payroll amount would have totaled approximately $2.5 million. Had the total payroll been properly reported to the government, the payroll taxes due would have been approximately $3.4 million.

This case was investigated by U.S. Immigration and Customs Enforcement’s Homeland Security Investigations and the Internal Revenue Service – Criminal Investigation. It was prosecuted by Assistant U.S. Attorney Arnold Corsmeier.

A Virginia-based developer that has built large subdivisions in Clay County is planning to add 162 single-family home lots to the Eagle Landing neighborhood in OakLeaf Plantation.

Roger Arrowsmith, president of the Florida division of East West Partners, said the additional homes will be built in two phases, starting with about 70 homes.

The developer submitted site plans for the first phase to the St. Johns River Water Management District, which shows the homes and two ponds will be built on 72 acres.

The project will require East West Partners, based in Midlothian, Virginia, to build a new road, called Tynes Boulevard.

Arrowsmith said the Eagle Landing community will have about 1,500 homes with the additional 162 homes.

Home prices in the community range from $200,000 to more than $1 million, according to an East West Partners website.

The community includes an 18-hole golf course, parks, playgrounds, hiking trails, a heated pool and a waterslide.

It borders the 24,000-acre Jennings State Forest.

East West Partners also built Eagle Harbor on Fleming Island, a 2,950-acre planned community with 3,259 homes, according to the company website.

Kirsten Sabia is the Vice President of Integrated Communications, with The PGA and the Players, overseeing special projects and all facets of employee communications.

As part of this cross-functional role, Sabia leads a team responsible for implementation of TOUR messaging across an internal audience, which also includes remote and international offices.

Her team also creates programs to celebrate success/motivate constituents, lead the development, theme, agenda and talking points for company meetings and perpetuate the TOUR’s five pillars (People, Players, Partners, Planet and Public Perception) to showcase the diversity of the TOUR. Sabia, who joined the PGA TOUR in 1999, has held multiple positions within the organization. Prior to her current role, she served as the Vice President of Marketing Services, where she managed a team that

oversaw 18 owned and operated TOUR events, including THE PLAYERS Championship and the biennial Presidents Cup. As Director of Brand Marketing, she oversaw all branding and marketing efforts for the PGA TOUR’s inaugural season-long points race system, the FedExCup, led the TOUR’s “Drive to a Billion” (in charitable dollars) campaign and was a team member in the renovation of TPC Sawgrass and the re branding of THE PLAYERS. During her long tenure with the TOUR, she also worked in New Media, TOUR Media Sales and International Television.

Prior to joining the TOUR, she served as the Membership Director for Selva Marina County Club in Atlantic Beach, FL, and for five years, worked in development and alumni relations for The Taft School in Watertown, CT and The Maret School in Washington DC.

A 30-YEAR TRADITION OF DONATING CONTINUES Clay Builders Council, Food Pantry of Green Cove Springs and others provide 100 meals to needy families.

A red Chevy van rolled up to the curb outside St. Mary’s Church in Green Cove Springs as Santa Claus waved and shouted cheerfully in the drizzling rain, “Merry Christmas!”

“I need a box for number 42,” said Suman Tran, a Food Pantry of Green Cove Springs coordinator at a Dec. 15 event to help families with donated holiday dinners.

In response, two volunteers lifted a heavy box of food and carried it to the van as Santa passed out candy canes to children in the back seat.

For 29 years, the Clay Builders Council of the Northeast Florida Builders Association has partnered with the Food Pantry and other agencies to provide needy families with a traditional Christmas dinner. This year, they were joined by Clay Humane and Boy Scout Troop 424.

“It’s a blessing,” said one of the food basket recipients, Green Cove Springs resident Riley Ikner.

“It means a lot to us. We don’t have the food we need.”

“May God bless all of you,” he said, waving out of the passenger window as the car drove off.

Earlier, in assembly-line style inside the church, a dozen volunteers packed 100 food boxes. It took them only 45 minutes to load the boxes with bread, vegetables, boxes and cans.

“We’ve been doing it for a while; we know what we’re doing,” quipped Northeast Florida Builders Association Executive Officer Bill Garrison.

The food baskets are given to families selected by the Food Pantry. Some of the baskets are designated for Clay Habitat for Humanity homeowners.

On Dec. 15, the families drove to the church on St. Johns Avenue.

They received a big box of nonperishables, pet food and a $25 gift card to buy a turkey, ham or roast.

Recipients who couldn't drive to the church had the food basket delivered to their home.

“We try to spread the love with it,” said Jessie Spradley, NEFBA government affairs director. “It’s a great project that I enjoy.”

The holiday tradition started nearly three decades ago when members of the Clay Builders Council built shelves and a reception area for the food pantry. Wanting to contribute more, they began giving away food baskets the next year.

But the council’s participation in the holiday basket giveaway may be coming to an end, Spradley said.

The Northeast Florida chapter of the NAIOP commercial real estate trade association hosted its annual holiday party Dec. 13 and installed its 2019 officers at Epping Forest Yacht & Country Club.

The 2018 president, Julie Bohn Howard, a director at Cushman & Wakefield, handed over the duties to Nelson Bradshaw, the Northeast Florida CEO of BBVA

The group named Trey Wilson, a partner at Driver, McAfee, Hawthorne & Diebenow, as president-elect.

Board members are David Smith, vice president of public affairs; Laura Gonzales, treasurer; David Hillegas, developing leader. The two director-past presidents are Howard and Teresa Durand-Stuebben.

The four director-at large members are Josh Edwards, Dan Tatsch, Bill Spinner and Vince McCormack.

The committee chairs are Julie Hargrove, Katie Kirchner, Pauline Gerry, Philip Elson, Vince McCormack, Rose Chafin and Christian Harden.

Realtor Judy Hicks has been helping to collect Christmas toys for children receiving help at Daniel Kids in Jacksonville for the past 24 years.

This year, she was happy to report that nearly 400 items were donated, thanks to the people involved with the Northeast Florida Builders Association.

At the organization's Sales and Marketing Council holiday party Dec. 14, Hicks and several others helped Daniel Kids staff members load vehicles with the gifts that were brought by real estate and homebuilding professionals.

Julia Kalinski, resource development director at Daniel Kids, said children enrolled in the nonprofit organization's residential treatment program requested specific gifts for Christmas.

Along with NEFBA and SMC members fulfilling many of those requests, Hicks said they also put pajamas in every gift bag for the children.

As SMC chair 24 years ago, Hicks developed its partnership with Daniel Kids. She said said about 100 companies and individuals bought the gifts this year.

"This is my most favorite thing to do," she said, adding that when she visited the children housed temporarily at Daniel Kids, she was moved to help. "These kids don't have anything."

Kalinski, who was at the party to collect the gifts, said the four- to sixmonth psychiatric inpatient program helps at-risk children ages 5 to 17 who pose a risk to themselves or others.

In addition to the toys, SMC members also brought stuffed teddy bears for the Jacksonville Sheriff's Office "Bears on Patrol" program. They were collected

by Assistant Chief Lakesha Burton and three JSO officers for law enforcement officers to keep in their patrol cars to give to children dealing with a traumatic situation.

The holiday party included a silent auction to raise money for NEFBA's Builders Care program, which provides free housing repair services for needy residents.

Where are the hottest and hippest neighborhoods in Northeast Florida right now?

Of course, Nocatee continues to top the list of one of the best master-planned communities in the country and St. Johns County communities are still thriving.

We are starting to see more growth on the north side of Jacksonville and in Nassau County. Wildlight is a unique community with a convenient location near Amelia Island and the (Jacksonville) airport that is sure to see rapid growth within the next two years. Springfield and Jacksonville Beaches are great areas for millennials with new home opportunities localized within infill areas among already hip neighborhoods.

On the Northeast Florida Builders Association side, Record serves as chair for the Sales and Marketing Council.

“SMC has experienced a tremendous growth in our membership over the last year, and I look forward to seeing that continue in 2019,” she said. “In addition to our local SMC, I also serve as vice chair for the Florida Sales and Marketing Council. With NEFBA’s SMC being the largest SMC in the state, I am proud to represent our local membership to ensure we continue to see value on a state level and also assist with growing, and in some cases starting, other local SMCs within homebuilders associations across the state.”

She is married to Jeff. They have a 3-year-old daughter, Brielle. In her spare time, Record enjoys yoga and binge watching shows on Netflix like “Gilmore Girls.”

“One thing people may not know about me: I am a former Zumba instructor (pre-daughter). Although I no longer have time to teach, I still enjoy dancing whenever I can,” she said.

As the incoming NEFBA Sales and Marketing Council chair, what are your goals for the group?

SMC is all about building relationships, networking and education. My goal is to continue to grow our membership within the Realtor and builder site agent community and continue to grow the education opportunities available within SMC.

What is your strategy for success in being part of a family-run homebuilding business?

It is imperative to have a digital marketing strategy that makes sense for our neighborhood locations, buyer demographics and sales team. That said, I analyze my strategy on a regular basis to ensure that the budget is being utilized in the best possible way for the overall business. In this day and age, sales and marketing have a huge overlap, so it’s always my goal to stay in constant communication with our sales team and maintain knowledge about who and what is going on around us.
