Instructor provides tips to real estate agents that can keep them out of legal trouble. If real estate agents are hoping to keep their jobs and keep money in their wallets, they may want to listen to Chuck Bonamer. A group of Northeast Florida Realtors discovered tips at an ethics course that could affect their income and profession. Every licensed Realtor is required to take the course every two years. Bonamer, their instructor, mentioned a rule that shocked many of the agents. He shared a scenario of a customer seeking a new Realtor after not liking the first one but still purchasing a home shown by the first agent. Bonamer said the commission needed to be handed over to the first Realtor, despite the fact the second agent took over and completed the paperwork.

A few agents attending the three-hour continuing education course said the rule didn't seem fair. Bonamer, a Venice-based author of a real estate management series, said the policy may not seem just, but his goal is to help agents avoid legal pitfalls that can end up costing them money or even their jobs. “If you look at the money first, that's not the right thing to do,” he said. “You have an obligation to be honest with all parties at all times. Otherwise, you could be liable,” said Bonamer. For example, he told a story about a Realtor who was asked by a prospective buyer about the condition of a home's roof. The agent responded that it “looked like it was in good shape.” After the person bought the house and discovered the roof was in terrible shape, the agent had to pay for the repairs. Instead of giving an opinion on a property's condition, Bonamer used humor to make his point. “You have to say it appears to be a roof,” he said. “Tell them you don't want a Realtor's opinion, but a contractor's (opinion).” Bonamer said Realtors need to be cautious not only about what they tell customers, but also what they put in writing. He said he had to buy a new riding lawn mower for a customer because he listed that one was included with the house. When the seller moved and took the mower, leaving an old one, Bonamer legally was bound to

pay for a new one. In addition to teaching dozens of real estate courses every year, Bonamer is the president of TransEquity Inc., a brokerage firm that provides litigation support and lecture services to the brokerage and legal industries, according to the company's website. He is a past president of the Florida Real Estate Education Association, chaired the Professional Standards Committee and won the Top Instructor Award from the National Association of

Realtors. “I'm not an attorney, I only train them,” Bonamer said. “I want to make sure you're protecting yourself.” Another topic was that Realtors should not alter photographs taken of properties they sell because “warts” that are hidden by fixing an image in Photoshop can result in a loss of income or career if an owner decides to sue. Bonamer said all items inside a property should be invento-

ried and documented if they are included with the sale. It might be time-consuming to count every piece of silverware inside a drawer, but not doing so could lead to that agent paying for a full set. It didn’t take long for the manager of the Jacksonville division of a national construction materials company to impress the leaders of the Northeast Florida Builders Association. Jamie Warrington made such an impact since moving to the area two years ago to lead Building Materials and Construction Solutions that NEFBA presented the 43-year-old with the 2019 Fred King Associate of the Year Award at the group’s annual installation of officers and awards banquet Jan. 18. The ceremony at the Jacksonville Marriott on Salisbury Road included other awards, including the Builder of the Year, presented to Chris Dostie of Dostie Homes. Dostie, the immediate past president of NEFBA, shared why the organization chose Warrington for the associate award. “This individual made their presence felt in the industry and at the association, joining our board and he quickly understood what we were all about,” Dostie said. Dostie added that Warrington signed up 19 new affiliate NEFBA members, all employees and sales people at his company’s Jackson-

commitment and leadership within his company to make it happen,” Dostie said. Warrington moved to Jacksonville recently but he’s been working in the building materials industry since he was a young man. At age 21, he began managing an 84 Lumber location.

The local BMC division is providing lumber, windows and other materials and services to local and national homebuilders. The market is so busy that the BMC location on Lane Avenue is running out of storage space for materials to help Northeast Florida construction companies keep up with the demand for new housing. One of the company’s most popular and innovative products is its Ready Frame brand, which is a set of pre-cut and labeled wood that comes with detailed instructions

to build roof and floor trusses. The system allows builders to save money and time because laborers don’t need to measure and cut lumber at a job site, eliminating spare wood pieces that go to waste. J

ust because construction is in the family’s blood doesn't mean Chris Dostie was destined to take over the company his grandfather started more than 60 years ago. The 37-year-old married father of three attended Auburn University to study political science, graduating with a bachelor’s degree in 2003. “I didn't go to college with the intent on being a homebuilder,” he said. But that is what happened.

Dostie, the president of Dostie Homes, was named the Northeast Florida Builders Association 2018 Builder of the Year at the organization’s awards ceremony Jan. 18. “(The award) was a fantastic way to cap off a great year,” Dostie said from the company's offices on Old Kings Road South, adding that the honor is a testament to the company's more than 20 team members. Dostie and his brother, Rick, are the third generation to lead Dostie Homes. They followed their father, Richard, and grandfather, J. Rene.

BUILDER OF THE YEAR The family has long had a relationship with NEFBA. Last year, Chris Dostie became the first second-generation president of NEFBA's executive committee, serving in the same role as his father, who was president in 1988. It’s also the second time Dostie Homes was named the Builder of the Year, winning previously in 1987. NEFBA Executive Officer Bill Garrison said Chris Dostie's “calm demeanor and level-headedness” came at a perfect time for the organization as it was dealing with completing its new headquarters at the end of 2018. “He is wise beyond his years,” Garrison said, adding that Chris Dostie was instrumental in helping him find his way as the new executive officer of NEFBA. Although Chris Dostie didn't realize he would one day lead the company, he grew up surrounded by the industry. One of the photos in his office shows a young Chris sitting in the driver's seat of a heavy equipment vehicle at a job site in 1985. His grandfather, J. Rene Dostie, started Dostie Homes in 1958, moving his family from Ontario, Canada. He saw an opportunity to leave the harsh winters and was encouraged to move by family living in the Jacksonville area. In 1974, his oldest son, Richard, took over the homebuilding business, eventually starting the Richard R. Dostie New Home Collection. After Chris Dostie graduated from Auburn, he wasn't sure what

he wanted to do so he returned to work with his father. But instead of homebuilding, he worked on an office complex project and learned about the commercial side of construction. Then followed the industry upheaval of the housing market crash, and Richard Dostie sold the company to Toll Brothers. In 2010, Chris Dostie said he and his brother took the opportunity to return to the industry. Now the company builds homes in Nocatee, Palencia, Pablo Creek Reserve and other Northeast Florida neighborhoods. Dostie Homes was selected as one of the three homebuilders in the Wildlight community in Nassau County. Last year, Dostie Homes built about 40 homes at an average price of $600,000. This year, Chris Dostie expects to sell more, but possibly at lower price points because the Wildlight homes are townhouses. He said he and his brother's motto is “smart growth,” adding that they are not trying to beat the large national homebuilding chains by building hundreds of homes each year. Instead, he said Dostie Homes is focused on providing a custom experience that clients can't get elsewhere. “The homes we build are the homes our team dreams up,” he said. “That is one of the things that differentiates us.” JAYS@JAXDAILYRECORD.COM @JAY_SCHLICHTER (904) 356-2466

A Jacksonville developer plans to transform 198 acres in Nassau County into a multiuse project that eventually could include 800 residential units, a community park, retail space and offices developed with a “vintage Florida railroad” theme. The project, called Nassau Crossing, is planned in multiple phases on vacant land in Yulee, east of Harts Road, south of Florida A1A and on the north and south sides of William Burgess Boulevard. The developer, Greg Matovina of Patriot Ridge LLP, has been working with the Nassau County Department of Planning and Economic Opportunity. The project is part of a larger plan called the William Burgess Overlay District adopted by the county in December 2017. The Nassau Crossing planned unit development plans call for the 800 residential units to be divided among 350 single-family

homes and 450 multifamily units. The PUD documents say 67 percent of the multifamily units must be affordable or workforce housing. Matovina In addition to the residential units, the north side of William Burgess Boulevard will include 150,000 square feet of retail space and 150,000 square feet of offices. The south side of the street shows the community park, soccer fields, walking trails, fitness stations, a tot lot, a gazebo, a pond, picnic benches and more. Matovina said the project’s first phase will include 230 single-family homes to be built by D.R. Horton. It also will include 120 townhomes, but no builder has been contracted. He said prices should range from $195,000 to $275,000 for the single-family homes and $150,000 to $180,000 for the townhomes. “Our goal is to bring a project that helps with the affordable housing problem,” Matovina said. He hopes to break ground and start building the single-family homes in March, with the other parts of the project to come later. The project engineer is listed as James

Lucas, president of J. Lucas & Associates Inc. of Jacksonville. Matovina submitted an environmental resource permit request Jan. 2 to the St. Johns River Water Management District. The request calls the project a “residential, commercial/mixed use and regional recreational development.” The Nassau Crossing plans and Nassau County’s overlay district documents say the intent of both projects is to move away from the “unsustainable automobile oriented development pattern that has been prominent in Nassau County over the preceding decades.” “It is the intent of this PUD to create a sense of place in the form of a compact mixed-use walkable community, designed at a pedestrian scale, that promotes strong social ties and the cultivation of ‘community’ in the inter-personal sense,” the documents state. The railroad theme was chosen because of Yulee’s history as a town that was created when the Florida Railroad intersected the area, then known as Hart’s Road Station, for trains passing from St. Marys, Georgia, to Jacksonville in the late 19th and early 20th centuries. National homebuilder D.R. Horton is proposing to develop a 188-unit townhouse community on 33 acres of undeveloped land next to Epic Theaters of St. Augustine. Plans for Epic Village Townhomes were submitted to the St. Johns River Water Management District and St. Johns County for environmental permitting and rezoning requests, which are under review. The property is south of the movie theater, which owns the land through its subsidiary, St. Augustine Multi Holdings LLC. The theater is on the southeast corner of Rolling Hills Drive and Florida 207. The 188 units would be split between 25 buildings and connected by an access road off Rolling Hills Drive. Jacksonville-based Chance Partners proposes to rezone 9.4 acres in Oceanway near River City Marketplace to develop a residential and commercial project. The project, called the Main Street North PUD, would comprise up to 238 multifamily units and more than 39,000 square feet of commercial space at northeast North Main Street and Drury Lane. Those plans are included in a rezoning request filed with the Jacksonville Planning and Development Department. Chance Partners asks the city to rezone the vacant lot from community general commercial to a planned unit development to allow for “a mix of residential uses while retaining the commercial uses on the portion fronting on Main Street.” “This change will allow a transition of commercial uses, to medium density residential to existing low density residential to the east of the property,” the request says. The low density residential refers to the single-family community that starts at Drury Lane and Gillespie Avenue. A site plan submitted with the request shows the multifamily units would be

split between three four-story buildings. Two are U-shaped and face each other, with a pool, barbecue grill and fire pit in the center. The third would be north of the other two buildings. The community would comprise 119 one-bedroom, 95 two-bedroom and 24 three-bedroom units. The project requires and would provide 440 parking spaces. The site plan shows a 0.9-acre lot on the northwest end of the property would be allocated for up to 39,315 square feet of commercial space. Behind that is a retention area of 25,283 square feet. The developer is listed as CLD-CP I LLC, a subsidiary of Chance Partners, which has three Jacksonville projects: San Marco Promenade and San Marco Crossing on Kings Avenue in the San Marco area and RiverVue on St. Johns Avenue in Avondale. CLD-CP I lists Jacksonville developer Corner Lot Development Group as an assistant manager. The project architect is Humphreys & Partners Architects of Dallas, and the engineer is Kimley-Horn and Associates Inc. of Jacksonville. The owners are listed as North Main Associates and Main Drury Associates, both led by John C. Kern as a general partner.

Toll Brothers began sales in January for its new single-family home community in Shearwater, a master-planned residential development on County Road 210 in northern St. Johns County. Plans are for 66 two-story single-family homes priced from the low $400,000s. Home buyers can select from five home designs: Anastasia Elite; Anna Maria; Captiva Elite; Julington; and San Tropez. Construction is underway on the community’s model home, a two-story, 3,075square-foot Anna Maria, which is scheduled to open this spring. The community will be in The Falls area of Shearwater, which includes a 4-acre park, the Falls loop trail that enhances the community’s trail network, Shearwater’s first dog park, which includes one fenced area for large dogs and one for smaller dogs, and a community garden for residents to plant flowers, herbs and vegetables year-round. Shearwater residents also have the Kayak Club amenity center, a Fitness Lodge, Har-Tru tennis courts, resort-style lagoon and lap pool, the Perch Water Tower, Northeast Florida’s longest lazy river and 13 miles of trails.

LGI Homes planning to build a 149-home subdivision A Texas-based homebuilder submitted plans to build a single-family subdivision with 149 home lots in rural southwestern Duval County. The Florida division of LGI Homes filed an application

with the St. Johns River Water Management District on Dec. 10 for the project, called Treeline Trails. The plans show that the 149 homes would be built on 30 acres of forest land at McClelland Road and Forest Trail Boulevard, slightly north of the border of Duval and Clay counties and south of Florida 228.

Jacksonville Beach public housing being torn down

The Jacksonville Housing Authority and TVC Development Inc. are teaming up to tear down more than two dozen 1960s-era apartment buildings in Jacksonville Beach and build The Waves, a 127-unit affordable housing project. Plans call for the demolition of 26 affordable apartment buildings owned by the public housing agency on eight separate residential blocks east of Jacksonville Beach’s golf club and elementary school. They will be replaced with 16 two-story buildings, which also will be owned by the Jacksonville Housing Authority. Each building will house eight apartments and have 32 parking spaces. There will be 128 units, but one will be used as a “common area” unit. The project is broken up into eight plans, since the buildings

are on eight separate city blocks. They were submitted separately to the St. Johns River Water Management District for review. The eight sites are along Seventh, Eighth, Ninth and 10th Streets South, First Avenue South and Fifth Avenue South, with a few adjacent to each other. TVC Development President Ryan Hoover said the old buildings aren’t in poor condition, but they couldn’t be easily renovated or upgraded. TVC Development is the affordable housing division and subsidiary of The Vestcor Companies, a Jacksonville-based developer. “To bring them up to today’s standards, there was no way to do it except to tear them down,” he said, adding that the new buildings will be “much better looking” that could help increase property values in the area. Before the old buildings are demolished, Hoover said the Jacksonville Housing Authority will relocate the residents to other public housing. They will be given first chance to move into the new buildings. The apartments are in The Hill neighborhood and will be named The Waves at Jacksonville Beach. Amenities planned for the community include a clubhouse, playground, dog walk area and a library.

Government advocacy update ST. JOHNS

DUVAL  NEFBA’s Government Affairs Commit-

tee meeting is 8:30 a.m. Feb. 28, at the NEFBA offices on Southpoint Parkway.  Duval elections: Several candidates for races in the upcoming city of Jacksonville elections won their seats unopposed. Current Council President Aaron Bowman, council member Danny Becton and Supervisor of Elections Mike Hogan were unopposed and will be serving for another four years. Along with the three sitting elected

officials, two nonincumbents, LeAnna Cumber and Rory Diamond, also ran unopposed. Cumber will represent the San Marco area (District 5) while Diamond will represent the Beaches (District 13). There are 15 council races to be decided in the spring, along with races for mayor, sheriff, property appraiser and tax collector. Duval County’s unitary election is March 19 and, if needed, the runoff is May 14.

CLAY  Orange Park historic homes: The city

of Orange Park has approved the creation of a Historic Preservation Board. The push for the new board came from a group of homeowners looking to preserve a collection of midcentury modern homes along

with preserving Orange Park’s oldest homes, some of which date to the 1870s. The council has not made any recommendations on rules and regulations, but it has expressed a desire to see a mix of voluntary and mandatory rules.

 LDC changes: St. Johns County staff is completing its review of proposed land development code changes offered by the Northeast Florida Builders Association and Citizens for a New Tree Ordinance. The goal of the changes is to provide more relaxed standards for construction while also preserving a natural habitat for wildlife protection. Proposed changes include revisions to the definition of specimen trees; double credits for preservation of

larger trees, allowing up to 20 percent of palm clusters to count toward canopy tree requirements; increased fines on nonapproved tree removal; reduced inch requirements in residential and commercial infrastructure areas; and a $10 increase per inch in tree bank fund payments. The county will host one more workshop in early 2019 before sending the proposal to the county commission.

NASSAU  County manager: After a monthlong search, Interim County Manager and County Attorney Mike Mullin has been hired as county manager. Mullin has been serving as interim manager since the departure of Shanea Jones in July 2018. The county continues to search for a new building official and director of Public Works.

 Fernandina Beach building official: Fernandina Beach is looking for a building official after the Jan. 2 death of recently hired James “Jud” Allen. Allen was hired in September 2018, having previously worked in Leon County.

For the seventh consecutive year, real estate professionals gathered in Jacksonville to help each other learn industry tips and tricks. The Jan. 11 event, ReBarCamp Jax, was an opportunity that one of its co-founders called a “one-day safe zone to share all your secrets.” But it was more than that. The function gave Realtors the opportunity to discuss topics of interest and interact with their peers in a workshop setting with sessions that aren’t decided in advance. As they arrived at the University of North Florida Adam W. Herbert University Center, attendees were given sticky notes to write down what they wanted to learn. Those ideas were posted on a large board and the event’s facilitators, who volunteered their time, taught classes based on those suggestions. The topics ranged from “how to deal with multiple listings”

The Northeast Florida Builders Association installed its leaders for 2019 while honoring many of the people and companies the

organization represents with the announcement of several awards. The group hosted its annual installation and awards ceremony Jan. 18 at the Jacksonville Marriott, which kicked off with Mayor Lenny Curry leading the Pledge of Allegiance and thanking NEFBA for endorsing his mayoral campaign. Chet Skinner, of Skinner Bros. Realty and NEFBA's 2016 president, served as the event's master of ceremonies.

association is prohibited from restricting a service-animal owner from buying or renting a place, DeLuca said. Unfortunately, DeLuca said, the law has been abused, as has been seen in media reports with some people paying for and printing fake certificates from disreputable websites and attempting to take their pets almost everywhere. Many of the real estate professionals in attendance expressed concern that a pet owner can lie and claim that the pet is a service animal, but DeLuca said nothing can be done other than asking the two questions allowed by law. For example, DeLuca said Miami is dealing with a problem related to the city's ordinance that prohibits pit bulls. After the city passed the law, people who owned pit bulls rapidly applied and obtained certification that their pets are service animals, even though they are not. In response to the laws and requests of animal owners, many companies are adopting new rules that allow only certain animals, like Southwest Airlines, which has stated that only dogs and cats will be allowed with their owners on their planes.

In an age when someone tried to bring a peacock onto a commercial flight, determining what is and isn't a service animal isn't as simple as one might think. In fact, the federal, state and local laws that either allow or prohibit the specially trained animals can be confusing for those who have to assist the owners. That is why the Northeast Florida Association of Realtors offers a class to its thousands of members to help the region's real estate professionals understand how to deal with people who want to buy or rent a residence and bring Fido or Fifi along, whether that animal is allowed or not. On Jan. 16, Cynthia DeLuca taught a group of about 50 real estate agents, brokers and property managers about the differences between the various laws, differences between service animals and emotional support animals, how the laws apply to the real estate industry and the only questions they are allowed to ask an animal's owner. “In situations where it is not obvious that the dog is a service animal, staff may ask only two specific questions: One, is the dog a service animal required because of a disability? And two, what work or task has the dog been trained to perform?” said DeLuca, a certified real estate instructor from DeLand. However, DeLuca said real estate professionals are not allowed to request documentation, require the animal to demonstrate its task or inquire about the person's disability. All of those rules, including that dogs are the only animals allowed to be classified as service animals, was established in 1990 as part of the Americans with Disabilities Act. The law requires the dog to be trained and provide a task that the disabled owner cannot accomplish. For example, a dog that reminds its owner to take medication or protects its owner during a seizure is a service animal, but a dog that helps an owner with depression would not qualify. The federal law also overrides almost every other law and rule that may be enacted, because inferior entities are allowed to enhance and add onto an existing federal law, but not take away rights. Therefore, a state, city or homeowners

Morgan’s Cove project back again New owner from St. Simons Island, Georgia, proposes to develop 279 acres into a single-family community. BY JAY SCHLICHTER ASSOCIATE EDITOR

A strip of undeveloped land in central St. Johns County that has been proposed for residential, mixed-use and assisting living projects called Morgan's Cove since at least 2006 is back for consideration. The 279-acre property, which starts at County Road 214 and runs north along the eastern edge of Interstate 95, changed hands in December, with the latest owner attempting to give development another shot. According to Army Corps of Engineers and St. Johns County documents, the land has had multiple owners, all of whom had different ideas on what to build there. Morgan's Cove Ventures LLC bought the property Dec. 4 and proposes to construct a single-family residential community. The company, run by a manager named John Byrnes in St. Simons Island, Georgia, paid $2 million for the land. It bought it from DI-FL No. 1 LLC, a subsidiary of Texas Banc Financial Corp. and Doss Investments in Fort Worth, Texas. That bank foreclosed on the land in 2016 after the previous owner, Morgan's Cove LLC, failed to pay its $6 million mortgage, according to St. Johns County court documents. Morgan's Cove LLC was managed by Baron L. Bartlett, a Ponte Vedra Beach real estate attorney. Byrnes, Bartlett and Corps officials did not respond to requests for comment.

In August 2018, Byrnes submitted a permit application and site plans with the Corps. The agency's report says the project would impact almost 1 acre of wetlands and could affect wood storks and Eastern indigo snake populations. The report also said the Corps previously approved a mixed-use development with residential and commercial spaces on the property. “In consideration of current market trends, the applicant revised the project design, reduced the area of work affecting wetlands, and eliminated the commercial development adjacent to County Road 214,” the Corps report said. “The revised project would only provide moderate to lower cost residential housing for this region of St. Johns County (no commercial component). The applicant expressed an opinion that the work proposed is the minimum necessary to successfully establish a residential subdivision at the site.” On Dec. 4, the St. Johns County Commission approved a request by Byrnes to transfer the project's impact fee credits of $779,142 paid by the previous owner to Morgan's Cove Ventures. In March 2012, The St. Augustine Record reported that Bartlett proposed to develop the property into space for 266 houses and a 200-bed assisted living facility that would bring an estimated 133 new jobs to St. Johns County. That was a reduction of a previous plan to build 283 homes, the article said. The maps included with the latest development proposal submitted to the Corps in August do not show specific details of how many single-family homes would be built on the land. D.R. Horton proposes to build an additional 577 single-family homes and an amenity center as part of the second phase of the Cross Creek subdivision in Clay County. In the first phase, the homebuilder is constructing 421 homes, which are slated to be available for sale this month. The additional sites boost Cross Creek to 998 lots. Cross Creek is on 970 acres next to Russell Baptist Church in Green Cove Springs, west of the intersection of Sandridge and Russell roads. The company submitted its second phase and amenity center plans in December to the St. Johns River Water Management District. D.R. Horton received approval in October 2016 to build the first phase, which comprises 421 homes on 246 acres. The second phase proposes to place 577 lots on 340 acres to the southeast of the first phase. The 998 homes offer four widths:

103 40-foot lots; 500 50-foot lots; 205 60-foot lots; and 190 70-foot lots. Amenity center plans show a 3,400-square-foot pool with zero entry, a separate splash pad, a 2,400-squarefoot clubhouse, a tot lot, two shade structures, a volleyball court and two pickleball courts. Marissa Awtry, the media relations manager for D.R. Horton, said homes are expected to start around $190,000 but pricing has not been finalized. Documents released as part of the Cross Creek North Community Development District show that infrastructure costs are estimated at $29.8 million, which is charged to homeowners via a master special assessment. Each property owner would pay an estimated $29,935, according to the community development district documents. Awtry said D.R.
