Steele Creek complex a $28M project

Permit applications were filed for the 300-unit Steele Creek apartments in Southside at 8599 A.C. Skinner Parkway. LandSouth Construction Co. of Ponte Vedra Beach is the contractor for the project, which is shown at a construction cost of $28 million. AC Packer West LLC, led by Joseph Eckstein, will develop Steele Creek on 14.76 acres next to The Loree apartments, which Eckstein’s group also is developing. AC Packer CFO Scott Gay said site work began last week and the

project should be completed in 18-20 months. The city approved site clearing in June. Gay described the architectural inspiration as a revival of influences of industrial Northern Florida and Southern Georgia from the 1950s through the 1970s. He said the project and its design team won the 2015 Design Excellence Award from the First Coast Chapter of the Florida Planning and Zoning Association. The project will include six four-story apartment buildings, seven parking garages, a clubhouse, maintenance building/car

wash, fitness center and pool. Gay said the four-story buildings will have elevators. Kimley-Horn and Associates Inc. is the design consultant and engineer while Charlan, Brock & Associates Inc. of Maitland is the architect. Dix.Hite + Partners Inc. of Longwood is the landscape architect.

Units comprise 171 one-bedroom, 111 two-bedroom and 18 three-bedroom apartments. Gay said the average unit size will be 1,000 square feet, ranging from 798 to 1,380 square feet. Rents have not been determined.

Ravella apartments apply for construction

The Strand at Town Center could soon see construction start on 263 units of the Ravella at Town Center apartment community. Permit applications were filed

last week for five four-story apartment structures totaling a construction cost of $22.1 million. No contractor is specified. Houston-based Stanmore Partners intends to buy about 6 acres at the northern end of The Strand to develop the 305-unit Ravella at Town Center apartments at 4674 Town Center Parkway. Stanmore previously applied for a permit to build a seventier parking garage for the apartments. A contractor was not specified for that $6.5 million project, either. Mathis continued on Page A-2

A new weapon in the sky

City may buy $800,000 used helicopter for mosquito fight By Max Marbut Staff Writer

By Karen Brune Mathis Managing Editor

Look up in the sky: It might be a bird, it might be a plane. Or, if City Council approves a proposed $800,000 purchase, it might be an addition to the war against mosquitoes in Duval County. A bill is being considered to approve the purchase of a helicopter to add more spraying capability. The Mosquito Control Division currently operates two piston-engine helicopters — one is 22 years old and the other is 42 years old — to kill mosquitoes in the 850-squaremile county. The city proposes using about $490,000 in funds designated by the Risk Management Department to purchase a preowned MD500 turbine helicopter to replace the older aircraft. The remaining funds — about $310,000 — would come from a non-departmental line item balance in the 2015-16 budget. According to a report prepared for the Mayor’s Budget Review Committee, in addition to purchasing the helicopter, a city pilot will be trained and certified to fly the turbine helicopter at an estimated cost of $10,000. He will train other pilots to fly the new aircraft. A pesticide-spraying system will be installed for about $54,500. In addition, about $48,000 for repair and maintenance supplies and $10,000 for fuel will bring the total cost of the new helicopter to about $922,000. The average annual maintenance and operations cost of the existing helicopters is about $37,000. The report recommended keeping the older helicopters to supplement inspection and spraying operations, thus

Randrr, which Gov. Rick Scott announced in June would create up to 200 software development jobs in Jacksonville by 2018, is preparing to expand its presence at Lakeside Two in Flagler Center. The company will move into about 13,000 square feet in November on the fourth floor and expand after that. Its interim office is on the first floor. “As we grow, we will take on more space to support our growth,” randrr CEO Terry Terhark said Monday. He said the company can accommodate up to 65 people in the initial space. “Assuming that we grow to 200 staff in the near term, we could see taking on significantly more space,” Terhark said. Scott said the randrr digital platform would add $9 million in capital investment. In June, the company employed 15 people and planned to add up to 50 employees by the end of this year at its interim offices in Flagler Center. Terhark said Monday the company has grown to about 30 Terhark technical employees and is steadily hiring, mostly technical staff such as software engineers, product professionals and big-data professionals. He said the company is having “great success” finding and hiring qualified employees. Terhark said the company was working with the professional community, universities, local government and economic development groups. He said the company will not seek taxpayer incentives. To prepare for the November move, Dav-Lin Interior Contractors Inc. will build-out 12,235 square feet for randrr at 12740 Gran Bay Parkway W., No. 400. The project cost is shown on a permit application at $184,068. Plans show open office areas, two large conference rooms, a collaboration area, two breakout rooms, a break and gathering area and other functions. Drawings indicate space for more than 50 employees in the open areas. Randrr continued on Page A-4

The city is considering purchasing a pre-owned MD500 turbine helicopter to add to the Mosquito Control Division squadron.

The Mosquito Control Division currently flies two of these Schweizer 300 helicopters to spray insecticide. One was purchased in 1974, the other in 1994. reducing time on the turbine helicopter’s components. It noted the city might choose to continue to operate only one of the current helicopters, reducing operations cost and allowing the oldest aircraft to be used for parts, since selling it would result in marginal one-time revenue. The city also maintains the Jacksonville Sheriff’s Office

Air Unit. It comprises six helicopters, ranging in age from 12-46 years. The unit is supported by eight pilots, three maintenance personnel and a unit commander, said spokeswoman Lauri-Ellen Smith. The police choppers are used for routine air patrol and to support activities on the ground, such as traffic management, searches and rescues.

The sheriff’s office has no plans to replace any of its helicopters, Smith said. The legislation for the mosquito control helicopter will be reviewed and scheduled for public hearings by the council Finance and Public Health & Safety committees. mmarbut@jaxdailyrecord.com (904) 356-2466

In November, the Downtown Investment Authority approved a resolution granting development rights for the project. Project manager Dan Ionescu said in November the $18.6 million apartment development had been approved for $15.8 million in tax credits from the Florida Housing Finance Corp. and a $115,000 local government contribution commitment from the Jacksonville Housing Authority. The state tax credit terms called for the project to be completed within 24 months.

Woodbridge sold, renamed Viera at Mandarin

Maxus Realty Trust Inc. of Missouri paid $17.6 million last week for the Woodbridge at the Lake apartment community and renamed it Viera at Mandarin. Now managed by Maxus Properties, Viera at Mandarin comprises 188 units at 4263 Losco Road. The property, built in 1984, sold for $93,617 a unit. Nashville-based Covenant Capital Group, through Woodbridge Multifamily Partners LLC, sold the property. It purchased it for $12.2 million in 2013. Maxus, which bought the property through Viera Acquisition LLC, is based in North Kansas City. It also owns Elements of Belle Rive Apartments in Jacksonville. The property comprises 17 buildings, property records show, and includes a 21-acre lake, resort-style pool, fitness center, conference room and coffee bar.

Linton buys Southside property for center

Lake City-based developer Micah Linton bought Southside Boulevard property Thursday to develop a retail shopping center next to the Larry’s Giant Subs headquarters. Through Rimrock Southside LLC, Linton bought the property, at 4490-4492 Southside Blvd., for $1.7 million. It was sold by Raikes Boys LLC, led by manager Laurence Raikes, the Larry of Larry’s Giant Subs. Ameris Bank issued a $3.41 million mortgage to Rimrock the same day. Linton already has filed plans

and applied for permits for the center, which is across from the Tinseltown area. In July, Rimrock Southside applied for a permit to build a 12,000-square-foot shell retail building on just over an acre at the address. No contractor is listed for the anticipated $1.5 million construction project. It would comprise 8,600 square feet of retail space and an endunit, 3,400-square-foot, 100-seat restaurant with inside and outdoor seating. Linton’s area projects include developing and selling a retail center in The Markets at Town Center, a student residential hall for Jacksonville University and Southpoint property for development of the Portiva apartments. Linton did not return a call for comment.

Elections supervisor has been on recruitment trail

By David Chapman Staff Writer

Some might call it a test run for November. Duval County Supervisor of Elections Mike Hogan refers to today’s primary as an opportunity for 400 of his office’s newest poll workers to get some experience for the general election. “You don’t want to use someone brand new in a presidential cycle,” said Hogan, who is overseeing his first countywide primary today. In 10 weeks, the pace will quicken. Turnout will be higher. More questions and issues will inevitably crop up, which is why “it’s really good to have one under your belt,” said Hogan. “I don’t get a do-over,” he said. Many of the new faces were brought on board through a dedicated recruitment effort since March. Hogan said when he took office last year, the register of poll workers listed about 7,800 people. Unfortunately, it was actually much smaller — the list included many people who had died or

moved away. After paring it down to about 3,000, it needed to be bolstered a little. In response, Hogan said his office since March has been on the recruitment trail and met with organizations and schools, specifically Jacksonville University and the University of North Florida. The response has been about 700 new additions, many of whom are younger and have experience with technology. That’s not to say the mainstays at the voting precincts aren’t valuable — Hogan calls them “excellent.” Yet, the need for able poll workers isn’t going away. Hogan said recruitment efforts will continue after the November election and there could be more organizations “adopting” a precinct. A local civic group is adopting a precinct in November, with the wages going toward a charitable cause. Election Day itself consists of a 14-hour day with slightly higher pay than early voting days, which are split into shifts. Duval County’s poll workers

make $10 an hour, with managers and information technology personnel making slightly more. The range is now comparable to other large counties in Florida, which can help recruitment efforts. Chris Chambless, Clay County supervisor of elections and chair of the state supervisors’ organization, said some years when the economy is down there are more people looking to be poll workers. Others simply want to be engaged in the civic process. He said Clay County has been fortunate and hasn’t had a great drain on poll workers. Recruitment has helped, with marketing materials available for most community events the office takes part in. Duval County, though, is bigger with more needs. In all, Hogan’s office will rely on close to 1,900 workers for 199 precincts across Duval County. “We’ve trained them well,” said Hogan. “The fate of the election is in their hands.” dchapman@jaxdailyrecord.com @writerchapman (904) 356-2466

Both sides urge Appeal court sides with state justices to resolve prisons in public records case credit card law By Jim Saunders, The News Service of Florida

By Jim Saunders The News Service of Florida

A group of Florida businesses agrees the U.S. Supreme Court should resolve questions about the constitutionality of a state law that has barred merchants from imposing surcharges on customers who pay with credit cards — but the answer might ultimately come in a case from New York. Attorney General Pam Bondi in June asked the Supreme Court to take up the dispute, after a federal appeals court ruled the law violated the First Amendment. The 11th U.S. Circuit Court of Appeals said the law allows businesses to offer discounts to customers who pay with cash but does not allow surcharges for credit card purchases — a situation the ruling likened to “distinctions in search of a difference.” Lawyers for four Florida businesses that challenged the law filed a document this month agreeing that the case is worthy of a Supreme Court decision. But they urged justices to resolve the issues through a New York case, which involves a similar law and was filed earlier. The 2nd U.S. Circuit Court of Appeals upheld a New York law blocking businesses from imposing surcharges for credit card purchases. That conflicts with the ruling by the 11th U.S. Circuit Court of Appeals in the Florida case — a conflict that could serve as potential grounds for the Supreme Court to decide to take up the case. “None of this is to say that this (Florida) case would be a poor vehicle. It would not be,’’ said the document filed this month in the Florida case. “But there is nothing to suggest that it would be a better vehicle than (the New York case). If anything, the robust record of enforcement in (the New York case) makes that case a superior vehicle. That record includes a criminal prosecution and numerous detailed and uncontested declarations from merchants targeted by the New York attorney general in recent years for violating the law.” A petition filed in May at the Supreme Court in the New York case said 10 states have laws regulating how businesses can communicate price differences when customers pay with credit cards or cash. Florida has allowed businesses

to offer discounts to customers who pay with cash but has not allowed price differences to be construed as surcharges for credit-card users. The challenge to the Florida law was filed in 2014 by businesses that had received “ceaseand-desist” letters from the state related to alleged violations of the credit-card surcharge law, according to court documents. The businesses were Dana’s Railroad Supply in Spring Hill, TM Jewelry LLC in Key West, Tallahassee Discount Furniture in Tallahassee and Cook’s Sportland in Venice. The law says violators can face second-degree misdemeanor charges. The businesses argued, and a majority of the 11th U.S. Circuit Court of Appeals agreed, the law violates free-speech rights. In the document filed this month at the Supreme Court, for example, the businesses’ lawyers wrote that Dana’s Railroad Supply wanted to “disclose the true cost of accepting credit cards” to customers of the model-railroad hobby shop. “They want to put their sign back up without fearing criminal prosecution,” the document, posted on the website SCOTUSblog said. “They would like to truthfully tell their customers — ‘both at the entrance to (the) store and at the register so that there will be no surprise’ — that the store ‘will add a small fee onto the sale if they choose to pay by credit card, and that there will be no fee if they choose to pay with cash or debit.’ The other respondents (businesses) want to say the same,” the blog said. But in the June petition to the Supreme Court, Bondi’s office argued the law deals with a “pricing practice” and is not a free-speech issue. “This (Supreme) Court’s intervention is necessary to correct the 11th Circuit’s contravention of a well-established axiom of First Amendment law: Regulations of economic conduct do not implicate the First Amendment,” the petition said. “The surcharge statute, by prohibiting a particular pricing practice, is just such a regulation. If allowed to remain, the 11th Circuit’s holding to the contrary will obscure the bright line that this (Supreme) Court has drawn between speech and economic conduct and … will cast a First Amendment cloud over a variety of economic regulations.”

An appeal court Monday said the Florida Department of Corrections did not violate the state’s public records law by refusing to provide specific explanations about why it would not disclose information sought by The Miami Herald. A three-judge panel of the 1st District Court of Appeal overturned the ruling of a Leon County circuit judge, who said the department was required to provide item-by-item legal explanations for its decisions to black out information on public records requested by the Herald — a process known as redacting the information. The ruling said the department provided “heavily redacted” records to the newspaper and a form that cited various legal exemptions that agency officials used in making the decisions. But the form did not detail which legal exemption was used to justify each redaction. The Herald sought a specific legal reason for each redaction, but the appeals court said Monday that wasn’t required by state law. “Here, appellees’ (the Herald and individual plaintiffs) complaint relied on a single statute, … which they claim requires DOC to ‘identify, for each redaction/black mark, the specific statutory basis for DOC’s claim that the information concealed by the black mark is exempt from the public records law.’ However, as DOC correctly argues, the plain language of this statute does not require the agency to state the basis of the exemption applicable to ‘each redaction,’” said the ruling, written by Judge T. Kent Wetherell and joined by judges Joseph Lewis and Stephanie Ray. “Instead, the statute simply requires the agency to ‘state the basis of the exemption that (the agency) contends is applicable to the record’ and to provide a statutory citation for the exemption. … Thus, (the law) plainly requires only record-by-record

— not redaction-by-redaction — identification of the exemptions authorizing the redactions in each record,” the ruling said. But Ray wrote a concurring opinion that indicated she would consider future challenges. She wrote the agency “produced voluminous documents, with hundreds of redactions, and only provided appellees with a cover form indicating the agency’s position that the documents, as a whole, contained information that was subject to one or more of five statutory exemptions.” “Given that the undisputed purpose of the public records act is to promote government transparency, appellees’ concern is significant,” Ray wrote. “However, this court’s opinion should not foreclose a future challenge to an agency’s method of identifying the basis of claimed exemptions in a public records response if it essentially renders the mandates of Florida’s public records act meaningless. The ruling, which overturned a decision by Leon County Circuit Judge George Reynolds, did not discuss the details of the underlying records sought by the Herald. But the newspaper has done extensive reporting about deaths and abuse of inmates and posted a story last year saying it had filed a lawsuit alleging the department had violated the public records law by withholding investigative information. “The Herald has requested copies of the agency’s investigations into some of those cases, only to find that reports were so heavily redacted that it is impossible to know what led to the inmate’s death,” the Sept. 1 story said. “In addition, other reports involving what appears to sexual harassment and abuse are also redacted so heavily that the nature of what happened is obscured.” The story said the department contended the blacked-out details pertained to medical information about inmates or would reveal information that could endanger officers or prison security.

Flagler Center, owned by Crocker Partners V Freedom LLC, is south of Old St. Augustine Road between Interstate 95 and Philips Highway. Scott said randrr chose to set up the app development offices in Florida over Silicon Valley, Ohio and New York because of the area’s workforce and focus on science, technology, engineering and math — or STEM — education. Terhark said then the team was working to create a platform “that will change the way people and companies connect.” The company says users can

research job opportunities, engage employers and be hired while keeping their privacy intact. “No more getting profiled by endless headhunters. No more resume black holes. No more wondering where you stand after you express interest in an opportunity. randrr helps people discover their career destiny,” it says. State corporate records show randrr has been based in Findlay, Ohio, although Terhark said Monday that Jacksonville is now the headquarters and also the technical center.

Jacksonville has proven “to be a community that is welcoming, full of opportunities, as well as very accommodating to a startup,” he said. CoStar Group reported in July that randrr leased 13,865 square feet in Lakeside Two to serve as its main headquarters. Jesse Shimp of JLL represented randrr, while Ross Carrier and Mark Montgomery of Avison Young represented the landlords, Investcorp and Crocker Partners. kmathis@jaxdailyrecord.com @MathisKb (904) 356-2466
