They won’t be sworn in until June 25, but Wednesday the members of Jacksonville’s 2015-19 City Council recorded their attendance at City Hall. The first of three days of orientation and training began at 8 a.m. in the Lynwood Roberts Room with a welcome from council Vice President Greg Anderson. Then the 11 new council members moved to the Don Davis Room across the atrium to enroll in the city’s health plan and sign up for parking passes and city identification badges. Shortly before noon, new members cast their first ballots as the council unanimously elected Anderson council president and Lori Boyer as vice president for 2015-16. Art Casey was on the job for less than a day when he made his first changes. Casey is a food and beverage consultant with the new Lexington Hotel & Conference Jacksonville Riverwalk’s management company. One of his first steps this week when he arrived at the property, the former Wyndham Jacksonville Riverwalk hotel, was to check the flags out front. They were worn and tattered. An anchor, pedestal and stack, a tribute to the area’s maritime history, also were painted the wrong color. “If you go out there today you’ll find a new American flag, Florida flag and Navy flag,” Bernie Moyle, COO and CFO of Vantage Hospitality Group Inc. said Wednesday afternoon. Casey, a recently retired Navy master chief, bought them himself. He also offered to paint the anchor, pedestal and stack the correct Moyle colors. Late Wednesday, he found another set of flagpoles and another painting job. That’s on his list for today. Those moves are among many that Moyle and his team intend to take to restore the 34-year-old property to its historically nautical theme in recognition of the St. Johns River and U.S. Navy. “We plan to pay homage with art, décor, and monuments throughout the property,” Moyle said. Coral Springs-based Vantage Hospitality Group paid $9 million Monday for the Wyndham, along the Downtown Southbank at 1515 Prudential Drive. thoughts on the deal. It was there that John Keane, the fund’s administrator, said he was willing to concede a point that personally affects him. He and a couple of others are in a senior staff pension plan, which the city’s former general counsel deemed unauthorized. Language rectifying the situation was included in the bill Keane and Mayor Alvin Brown negotiated last summer. Yet, the latest version spearheaded by council member Bill Gulliford left it out. Gulliford

wants another opinion on the issue. Keane has wanted it back in, leading to one of few sticking points in this version. But Wednesday, he told the board he was willing to sacrifice on the subject. “I can’t let one issue which impacted me directly stand in the way of comprehensive pension reform,” Keane later said. It also looks like the length of the deal might be OK for both sides. The board in the past has been adamant about keeping it 10

years — a concession from the 15 years left on the deal currently in place. Nat Glover, former sheriff and current Edward Waters College president, was among the board members who felt that way. Wednesday but did voice other concerns. Schmitt talked about the need for police salary cuts being restored to equal the additional payments personnel would make toward their retirements. And Tuten expressed hesitancy that future city leaders would stick with the plan to pay down the plan’s more than $1.6 billion in unfunded liability. “Nothing in here guarantees the new administration does anything to live up to their end,” Tuten said. “It worries me.” Keane responded that leaders ignoring the long-discussed need would lead to facing the “wrath” of the citizens, JAX Chamber and others who have pushed so strongly for reform. Gulliford told the group he’s talked the plan over with Mayorelect Lenny Curry, who didn’t

object. And the council members who will be around another four years feel strongly about reform, too. Currently, the financial part of the deal is structured to have the city and fund board pay $5 million in the coming year, $10 million the year after and $15 million in the third year toward that liability. After that, the city’s payment would boost to $32 million, while the fund’s would dip to $8 million. That would be for 13 to 14 years or until the plan hits the 80 percent funding mark. No funding source has been identified, but that would be the first priority once this part is accomplished, Gulliford said. Despite the momentum, there is a potential tripping point. The Concerned Taxpayers of Duval County filed for an injunc-

tion Tuesday, seeking to prevent the council from voting on the reform package. Their rationale is the deal violates Circuit Judge Tom Beverly’s decision that voided the 30-year deal and states that council nor Keane and the fund are the appropriate parties to negotiate pension deals. Additionally, the group says anything longer than three years violates state law — a position several council members also have held fast. “It’s just something else we have to work with,” Keane said. Lexingtonhotels.com describes the Jacksonville property as a 323-room hotel with 23 meeting rooms totaling 35,000 square feet of meeting space. That includes a 10,000-square-foot ballroom that can accommodate up to 800 people for a banquet. It also has a rooftop ballroom with a veranda. The Lexington features the casual St. Johns Café and the Currents Lounge. Moyle said the process of purchasing the hotel started about seven months ago. Vantage considered it a good investment because Jacksonville is in the top 50 markets in the country for hotels and the city is putting

effort into revitalizing the riverfront. Another 10.38 acres surrounding the hotel are separately owned and remain for sale. Moyle said Vantage was not especially considering that property because it was more than the hotel would need. Moyle said Vantage was able to make adequate parking accommodations because of “good relations” with the other property owner and the city has been cooperative for Vantage to use the nearby King Street parking garage. Moyle said the sales staff has begun contacting companies, churches and hotels to make connections. Moyle expects to return to Jacksonville next week to meet with tourism and convention officials, among others. He said he is very involved in similar groups in Broward County and “likewise, we want to be very involved in the restaurant and hospitality business” in Jacksonville. He said his investment redevelopment team would be meeting with Downtown Investment Authority representatives. “We are looking forward to being a part of your community,” he said.

Lexington to buy the 323-room Wyndham. Pacific Coach Inc. of Arizona issued a $7.5 million mortgage. The 5.8-acre hotel property carries a market value of $7.05 million, according to the Duval County Property Appraiser. The five-story hotel was built in 1981 as a Sheraton. It also has operated as a Radisson. Lexington intends to launch an extensive, 18-month renovation, while remaining open during the work. The lobby will be reconfigured and a covered outdoor extension with a fireplace and water features will be added. Guestrooms and restrooms will be remodeled and meeting areas will be redecorated. The roof and windows will be replaced, while the entry drive and porte-cochere will be improved. New landscaping and an updated pool area also are planned. Moyle said renovations will take place “going one wing at a time, from the roof on down.” He declined to estimate the investment. “I told the employees that without disrespecting the Navy, I hope they allow us to refer to the hotel as the USS Lexington. We have to give that property back its personality,” he said. Moyle said he met with the hotel’s approximate 115 employees. He said all are on a 90-day probation while Vantage assesses its needs, including adding some staff, such as housekeepers. Victor Morgenroth was hired as the new general manager to replace Ron Congdon, who Moyle said is under contract with the former management company out of Boca Raton. “I’m very impressed with the fortitude of the employees,” Moyle said, referring to the recession and ownership changes. “I am really, really impressed with them.” The property was sold by GECMC 2007-C1 Prudential Drive LLC in care of Torchlight Loan Services LLC of Miami. The property had been foreclosed and was bank-owned. The sale was brokered by Brown Nester Hospitality Services, representing the buyer, and the hotel will be managed by Cal-Vegas Ltd., both affiliates of

One of the first orders of business for new council members was applying for city badges and parking permits. They also enrolled for health insurance and received their coj.net email addresses. The presentation was led by city Ethics Officer Carla Miller, who was joined by State Attorney Angela Corey and members of the Office of General Counsel. The session would fulfill the council members’ state-mandated annual requirement for ethics training, Miller said. “It’s a lot to take in, but it’s a road map to help you transition,” said council President Clay Yarborough, who will complete two terms June 30. Miller covered the history of ethics in Jacksonville government, beginning in 1966 when 11 public officials were indicted on 142 counts of larceny and corruption. She said that experience was one of the reasons voters approved consolidation of city and county governments in 1968. In 1992, the Ethics Commission was established and in 1999, Jacksonville became the first city in Florida to provide ethics training to elected officials, she said. Corey gave the new members a bit of advice. “I beg you to pay attention,” she said. “We want to prevent problems. I hope I only see you all at events like this.” Miller stressed the importance of not only following the law to the letter, but making sure the public’s perception of the conduct of the people they selected to lead the city remains untarnished. “The No. 1 goal is to keep you out of trouble,” said Miller. “Not to keep you out of court, but to keep you off the front page of the newspaper.” The orientation continues Thursday with presentations from the Council Auditor’s Office and Mayor’s Office and a mock meeting in the council chamber at City Hall. Jail officers cleared in inmate suicide

A federal appeals court Wednesday found that seven Marion County jail officers cannot be held liable in the 2007 suicide of an inmate who hanged himself with a bed sheet. Vivian Jackson, the mother of inmate Darius Johnell James, filed the lawsuit alleging that 10 officers violated James’ constitutional due-process rights by failing to prevent his death. Previously, a U.S. district judge had ruled three of the officers

were shielded by what is known as “qualified immunity” but allowed the lawsuit to proceed against the other seven. James, 22, was arrested in 2007 on robbery and home-invasion robbery charges and was assigned to a suicide-prevention section before being moved to another area of the jail, according to the ruling by the 11th U.S. Circuit Court of Appeals. The 24-page ruling detailed a series of incidents involving James at the jail but found that the lawsuit failed to prove that the officers showed “deliberate

indifference” to the risk that he would commit suicide. “This case is troubling,’’ said the ruling, written by appealscourt Judge Beverly Martin and joined by judges Robin Rosenbaum and L. Scott Coogler. “The Marion County Jail tragically failed to keep Mr. James safe while he was incarcerated. Under our precedent, however, an officer is liable … for the suicide of an inmate only if he had subjective knowledge of a serious risk that the inmate would commit suicide and he disregarded that known risk.”

Senate approves health plan, Scott vetoes bills though it’s unlikely to matter on stores, Citizens By Jim Turner The News Service of Floirda

In what could end up being little more than an act of political theater, the Senate overwhelmingly voted Wednesday to approve the latest version of its plan to use federal Medicaid expansion funds to help lowerincome Floridians purchase private health insurance. Despite the 33-3 vote in favor of the bill (SB 2-A), which would create the Florida Health Insurance Affordability Exchange, or FHIX, program, the odds of the measure becoming law still seem incredibly long. Gov. Rick Scott and House Republican leaders staunchly oppose the legislation, which helped grind budget negotiations to a halt earlier this year and spark a special session currently underway. Senators tried to open an avenue for negotiations over FHIX, suggesting that some of the reforms House leaders have pushed could be added to the bill and approved by the Senate. The House is looking to revamp insurance coverage for state workers and overhaul some longstanding health-industry regulations. “We have been very, very clear that we welcome the debate,” said Senate President Andy Gardiner, an Orlando Republican who has spearheaded the push for FHIX. “We really do. ... I think from our standpoint, it’s like, send them over and let’s start having the debate and the discussion. But we’re open to it.” But that will likely not be enough to sway most House Republicans, who blast the plan on a variety of grounds. In a sign of the weak support the plan has in the GOP caucus, the Senate proposal is expected to be presented to the House today by Democratic Rep. Mia Jones of Jacksonville. A vote could come Friday. Perhaps with that in mind, supporters of the bill spent much of Wednesday’s debate in the Senate countering the House’s talking points. In response to one of the House’s chief reasons for resisting the Senate’s plan — that the federal government is an unreli-

Rick Scott vetoed bills Tuesday that were intended to increase convenience-store security and to give policyholders more options as the state seeks to move them out of Citizens Property Insurance Corp. Scott said one measure (HB 755) would force convenience stores to add “potentially costly security.” The second bill (HB 1087), he said, “undermines progress” in shifting policies into the private insurance market from the state-backed Citizens. Lawmakers approved both bills without opposition during this spring’s regular session. Scott expressed concern in a letter to Secretary of State Ken Detzner about the state adding “overbroad, state-mandated” regulations by requiring a variety of security measures at convenience stores. “Mandating compliance with the security standards in the bill would place a significant new financial burden on these small businesses, which is unnecessary,” he wrote. “I believe family owned small businesses, working with their landlords, can better decide the appropriate security infrastructure for their businesses.” The legislation, sponsored by Rep. Charlie Stone, R-Ocala, would have required convenience stores to have security camera systems, drop safes for restricted access to cash receipts, policies to limit cash after 11 p.m. and height

Don Gaetz noted that the House’s budget proposal includes $16.4 billion in health-care funding and $24.4 billion overall from federal sources. “Those who say that they don’t want federal money or don’t want to take federal money — that train has left the station a long time ago,” said Gaetz, R-Niceville. “They’ve lost their virginity on that issue.” Some senators have also voiced concerns about the plan. Sen. Alan Hays, R-Umatilla, questioned how easy it would be for the hundreds of thousands of Floridians in the program to receive care if providers were not reimbursed at more-generous rates than in traditional Medicaid. “Let’s face reality,” Hays said. “The No. 1 objection to Medicaid patients today by the health-care community is the reimbursement rates are so low. ... Not one wise businessman anywhere, no matter what business they’re in, is going to go out and welcome more losing business.” “Sen. Hays, actually, hospitals do it every day,” Gardiner, a hospital vice president, said in a rare response from the rostrum where he presides over Senate business. though work requirements likely mean that only 400,000 to 500,000 people would actually be eligible. Under the legislation, FHIX would expire on July 1, 2018, unless it gets renewed by the Legislature. Senators amended the proposal Wednesday to try to counter concerns from the Florida Agency for Health Care Administration that the Senate exchange could enter a “death spiral,” caused when mostly sick patients sign up for a plan and cause premiums to rise. That could actually leave fewer Floridians with health insurance, according to state Medicaid director Justin Senior. The changes came one day after Senior was excoriated by a Senate committee for voicing those concerns. But in a statement after the Senate vote, AHCA Secretary Liz Dudek said the agency wasn’t completely satisfied with the new bill. “Although we have recommended changes to the FHIX plan that alleviate our concerns with the ‘death spiral,’ we still have many concerns with other areas of the bill, which would make it uncertain whether the FHIX plan will be able to provide more Floridians with health coverage,” Dudek said. An agency spokeswoman said AHCA, which answers to Scott, is officially neutral on the legislation.

In a separate letter to Detzner, Scott expressed concerns about a provision in the Citizens-backed bill (HB 1087) that would have allowed policyholders to choose to get no more than one “takeout” offer every six months. Scott’s second issue with the legislation, sponsored by Rep. Michael Bileca, R-Miami, was a provision that would have allowed policyholders to return to Citizens after being insured by private carriers. The legislation would have allowed consumers to retain eligibility for Citizens insurance through its clearinghouse if private insurers increase initial premiums by more than 10 percent within 36 months after policyholders are moved out of Citizens. The vetoes came as Scott signed 17 other bills into law, including a measure (HB 779) that will require tenants to receive 30 days’ notice before they can be evicted from a foreclosed homes and a bill (HB 239) that will impose a maximum fine of $10,000 or the amount of the purse, whichever is greater, if prohibited medications are found in a racing horse or greyhound.
