Foot Locker and Champs Sports, two of the remaining national retail tenants at Regency Square Mall, are making plans to open stores across the street in a strip shopping center. A spokeswoman for New York-based specialty athletic retailer Foot Locker Inc., which owns Champs, did not respond to emails. Regency Square’s general manager said he could not com-
ment. The city is reviewing building permit applications for tenant improvements for both stores at 9428 Arlington Expressway in the Regency Pointe Shopping Center. Build-out for the two tenants totals $176,000, according to a permit appli-
Harbour Retail Partners bought land last week for development of Tamaya Market, to be anchored by Sprouts Farmers Market, and intends to start site work in January and construction in April for the roughly 75,000-square-foot shopping center. Randy Kelley, Harbour Retail Partners manager and developer, said Monday the more than $20 million project could be completed near the end of 2019. Phoenix-based Sprouts wants to open in the first half of 2020, which is driving the timing of the project. Kelley said Harbour Retail Partners paid about $6 million for 11.2 acres at northwest Beach and Tamaya boulevards, east of Kernan Boulevard. The deed was not recorded as of Monday afternoon. Harbour Retail Partners, based in Wilmington, North Carolina, bought the land from the ICI Homes group, the Tamaya developer. The shopping center will be anchored by the roughly 30,000-square-foot Sprouts, which is new to the market. Another 23,000 to 24,000 square feet of space will be developed among the inline retail shops on either side of the grocery store and 22,000 to 25,000 square feet will be developed among the three outparcels, Kelley said. Kelley said there are no plans to sell the outparcels. They will be offered for build-to-suit or ground-lease.

The man in charge of finding investors for Dream Finders Homes believes the housing market is headed for a slowdown because of the steady increase of home prices, but he doesn’t think it will be a sharp decline. Chris Butler, the managing partner of DF Capital Management LLC, a subsidiary of Dream Finders, shared his opinions at an Economic Roundtable of Jacksonville meeting Nov. 27 at the Omni Jacksonville Hotel. Instead of selecting the most expensive homes, Butler said many prospective homebuyers today are choosing smaller and cheaper properties. He said Dream Finders is targeting those clients by building entry-level homes while trying to keep up with the demand. “Supply has never been lower,” Butler said, referring to statistics in his presentation that show Florida has 1.2 million homes available for purchase compared with more than 2.3 million in 2011. He said inventory of new construction homes is at 1.9 months and all available homes is at 3.6 months. A six-month supply of homes is considered normal. Butler said Florida will continue to see tremendous population growth because of people leaving other states that have increasing taxes. Because of that and low supply, Butler said homebuilders need to pick up the pace. Despite the current labor shortage and rising costs for some homebuilding materials, Butler said national and regional homebuilding companies still are making a decent profit. “They’re still getting the 20 percent margins they were a couple of years ago,” he said. Butler said rising interest rates likely won’t affect the market since they are increasing slowly. “If rates are going up, it’s because the

economy is getting better,” he said, adding that purchasing a home still is less expensive than renting. Daniel Gilham, president of the Economic Roundtable of Jacksonville, asked Butler what innovative solutions would help developers build homes cheaper and faster. “It’s going to take that cutting-edge company to do it first and force others to follow,” Butler said, adding that it may take a person like Elon Musk to streamline the process. While the site plan could be revised, Kelley expects the base design will stay the same. He said the group will be taking bids from contractors to build the project. He said the uses would be retail, not mixed-use. There won’t be a gas station because Kelley said that was not allowed by Tamaya’s approved planned unit development. Kelley said he is talking to multiple tenants and expects most of the space will be leased over the next four to six months. Kelley said the location at Beach and Kernan boulevards “has a lot of appeal, great traffic counts and lots of visibility.” He said Tamaya is planned for 2,000 homes and 1,000 are built. “We see the opportunity to serve those 2,000 homes over the next five years as they continue to build out and develop,” he said, as well as to serve the rest of the area. Kelley said the trade area was 365 degrees and a 10- to 15-minute drive. “There are customers in every direction,” he said. “We are not blocked by the ocean or a psychographic barrier,” which is a perceived border that customers might resist crossing. Colliers International will handle leasing, led by Nancy Sumner and Katy Figg, vice presidents of retail services.
The site plan for Tamaya Market shows the Sprouts Farmer’s Market grocery store and two smaller retail buildings. Three outparcels also are available.

Executives of Sandor Development, through Thunder Phoenix LLC, bought Regency Pointe shopping center in June 2016 for $4.2 million. Occupancy was 40 percent. Plans show that Champs Sports will lease two units that total 6,350 square feet at the north end of the center. Foot Locker will lease 3,700 square feet next to Champs. Justin Eller, portfolio manager of Sand Capital and Sandor Development Co., declined to comment on the potential leases until they are completed. FIRST INSERTION STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF INTENT TO ISSUE PERMIT REVISION The Department of Environmental Protection gives notice of its intent to issue a permit revision to JEA, 21 West Church Street, T-8, Jacksonville, FL 32202, for the operation of Arlington East Wastewater Facility (WWTF). The permit revision includes a modification of the existing mixing zone for copper in the effluent discharged through the existing Outfall D – 001 to St. Johns River pursuant to the Florida Administrative Code Rule 62-4.244. The proposed mixing zone will be an area of 250 m2, centered over the end-of-pipe of the Outfall D-001 which is a square (15.8 m x 15.8 m) located at the end of pipe. The maximum concentration limit for copper (total recoverable) at the end-of-pipe is 11.6 µg/L for the permitted capacity of 25.0 MGD AADF. The discharge shall meet the water quality criterion of 3.7 µg/L for copper at the edge of the mixing area. The facility is located at latitude 30° 20’49” N, longitude 81° 32’33” W at 1555 Millcoe Road, Jacksonville, Florida 32225 in Duval County. The Department has assigned this project number as: FL0026441 – 024 – DW1P. The intent to issue and application file are available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department’s Northeast District Office, 8800 Baymeadows Way West, Suite 100, Jacksonville, Florida 32256, at phone number (904) 256-1700. The Department will issue the permit with the attached conditions unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57, Florida Statutes, within fourteen days of receipt of notice. The procedures for petitioning for a hearing are set forth below. A person whose substantial interests are affected by the Department’s proposed permitting decision may petition for an administrative proceeding (hearing) under Sections 120.569 and 120.57, Florida Statutes. The petition must contain the information set forth below and must be filed (received by the Clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000. Under Rule 62-110.106(4), Florida Administrative Code, a person may request an extension of the time for filing a petition for an administrative hearing. The request must be filed (received by the Clerk) in the Office of General Counsel before the end of the time
period for filing a petition for an administrative hearing. Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), Florida Statutes, must be filed within fourteen days of publication of the notice or within fourteen days of receipt of the written notice, whichever occurs first. Section 120.60(3), Florida Statutes, however, also allows that any person who has asked the Department for notice of agency action may file a petition within fourteen days of receipt of such notice, regardless of the date of publication. The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The failure of any person to file a petition or request for an extension of time within fourteen days of receipt of notice shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, Florida Statutes. Any subsequent intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, Florida Administrative Code. A petition that disputes the material facts on which the Department’s action is based must contain the following information, as indicated in Rule 28-106.201, Florida Administrative Code: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the determination; (c) A statement of when and how the petitioner received notice of the Department’s decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the Department’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the Department’s proposed action; and (g) A statement of the relief sought by the petitioner, stating precisely the action petitioner wishes the Department to take
with respect to the Department’s proposed action. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Department’s final action may be different from the position taken by it in this notice. Persons whose substantial interests will be affected by any such final decision of the Department have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above. In addition to requesting an administrative hearing, any petitioner may elect to pursue mediation. The election may be accomplished by filing with the Department a mediation agreement with all parties to the proceeding (i.e., the applicant, the Department, and any person who has filed a timely and sufficient petition for a hearing). The agreement must contain all the information required by Rule 28-106.404, Florida Administrative Code. The agreement must be received by the Clerk in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, within ten days after the deadline for filing a petition, as set forth above. Choosing mediation will not adversely affect the right to a hearing if mediation does not result in a settlement. As provided in Section 120.573, Florida Statutes, the timely agreement of all parties to mediate will toll the time limitations imposed by Sections 120.569 and 120.57, Florida Statutes, for holding an administrative hearing and issuing a final order. Unless otherwise agreed by the parties, the mediation must be concluded within sixty days of the execution of the agreement. If mediation results in settlement of the administrative dispute, the Department must enter a final order incorporating the agreement of the parties. Persons seeking to protect their substantial interests that would be affected by such a modified final decision must file their petitions within fourteen days of receipt of this notice, or they shall be deemed to have waived their right to a proceeding under Sections 120.569 and 120.57, Florida Statutes. If mediation terminates without settlement of the dispute, the Department shall notify all parties in writing that the administrative hearing processes under Sections 120.569 and 120.57, Florida Statutes, remain available for disposition of the dispute, and the notice will specify the deadlines that then will apply for challenging the agency action and electing remedies under those two statutes. Dec. 4 00 (18-09432D)
