here’s more than one goal for the Jacksonville Armada FC’s quest to build a new stadium near the Downtown Sports Complex. The club’s proposed deal could bring along a corporate building for some of team owner and Florida entrepreneur Robert Palmer’s businesses. Palmer is the founder of Maitland-based RP Funding Direct Mortgage Lender, HomeValue.com, Listing Power Tools and other business ventures based in Lake Mary. RP Funding opened in Baymeadows in 2016 and leases 26,500 square feet of office space at 8381 Dix Ellis Trail in Prominence office park. It has 175 employees. Armada President and General Manager Nathan Walter said in an interview Friday that Palmer hopes to relocate Robert Palmer Companies operations from Baymeadows to the new stadium complex. Joyce Development Group LLC will bring a 120-room SpringHill Suites by Marriott, a Starbucks Coffee Co. shop and First Watch, The Daytime Cafe, to its $30 million Baymeadows Park project at the site of the former Baymeadows Golf Club. The group and District 11 City Council member Danny Becton broke ground on the mixeduse center Wednesday at 7981 Baymeadows Road, east of Interstate 95. “The project will be transformative for the area and improve the quality of life,” Becton said. Becton considers the site a center of revitalization for all of Baymeadows. John Joyce, managing member of Joyce Development, said Starbucks should open in August followed by First Watch in September. Construction is expected to start on the five-story hotel in March and be completed by November 2021. Along with the hotel, Baymeadows Park will include 22,000 square feet of commercial, retail and restaurant uses among four buildings. Starbucks and First Watch will anchor the ends of the project. Joyce said 17,000 square feet of the commercial space is committed, leaving 5,000 square feet available for lease. Eric Yi and Austin Kay with NAI Hallmark are the commercial real estate leasing brokers for the tenant space. The project architect is RDL Architects Inc. of Shaker Heights, Ohio.

Plan would remake Reddi-Arts property Jacksonville-based Chase Properties Inc. is finalizing an agreement to purchase Reddi-Arts at 1037 Hendricks Ave. in San Marco and redevelop the property into two restaurants. Chase Properties President Mike Balanky said the development will be called Southbank Crossing. Plans include splitting the ReddiArts building into two spaces — a 6,000-square-foot south building and a 4,600-square-foot north site. Both restaurants will have patio seating.

“There is some intrinsic value in that building. We want to get as much adaptive reuse out of it as possible,” Balanky said. The developer also plans a 54-space surface parking lot. Balanky estimates construction will take about four months, once the purchase is final. The property is bounded by Hendricks and Kings avenues. The project would add vehicle access from both thoroughfares.

THE MENDENDHALL REPORT

City working to end food deserts

MIKE MENDENHALL STAFF WRITER

City sends Southeastern Grocers the same terms it offered Rowe’s to fill the Gateway Town Center space being vacated by Publix. Office of Economic Development representatives are moving to put more taxpayer dollars toward stopping the spread of food deserts in Northwest Jacksonville. As Publix prepares to move out of the anchor space at Gateway Town Center by Dec. 28, city officials have found themselves trying to keep another food desert from forming. District 7 City Council member Reggie Gaffney, who represents the area, said Monday that Southeastern Grocers’ legal team is examining lease terms from Gateway Town Center LLC to fill the Publix space with its

Winn-Dixie banner. Lakeland-based Publix Super Markets Inc. announced in October it would not renew its lease for the 28,120-square-foot space at 5210 Norwood Ave. The city sent Southeastern Grocers the terms it offered to Rowe’s IGA Supermarkets for city-backed incentives to lease the space. Rowe’s IGA owner Rob Rowe said Nov. 10 he decided against leasing the space after he tried to negotiate terms with the landlord. Gaffney said Southeastern Grocers is using the term sheet as a template to understand how the city program operates. “The reason we did that is so they (Southeastern Grocers) know the city is willing to support this project and have a Winn-Dixie in Gateway,” he said Thursday. Gaffney said previously the city could offer the next tenant for the Publix space $500,000 to $700,000 from the Northwest Jacksonville Economic Development Fund, but he said he wouldn’t propose a specific amount Monday for the WinnDixie deal. “But it’s going to be up to Winn-Dixie to determine what they need to get the building up to code to meet their standards,” Gaffney said. If the Gateway area is left without a grocery store, it would create a food desert for

JaxDailyRecord.com

the neighborhood’s residents. The city’s economic development office considers an area without a grocery store located within a mile a food desert. INCENTIVES AND PILOT PROGRAMS

Publix’s departure is not the first grocery store to leave Northwest Jacksonville in recent years, and City Hall wants to put taxpayer dollars toward the problem. The Council Finance and Neighborhoods, Community Services, Public Health and Safety committees unanimously advanced a bill this week to approve a $750,000 grant to partially finance renovations and reopen a shuttered Harvey’s grocery store in Northwest Jacksonville as a Rowe’s IGA. Ordinance 2019-0767 would issue the grant to Commonwealth Shopping Center landlord Saglo Development Corp. of Miami that plans a $3.5 million renovation of the 49,000-square-foot store at 1020 Edgewood Ave. N. with Rowe’s. Saglo and Rowe’s must obtain a certificate of occupancy from the city before the grant is issued. The development agreement will include a clawback provision of $150,000 per year over five years to ensure the project operates as a grocery store. A second bill, Ordinance 2019-768, includes four pilot programs that go beyond subsidizing retail. A $200,000 mobile markets program will partner the city with the nonprofit Feeding Northeast Florida to deploy refrigerated fresh food trailers

into food deserts throughout the area. The nonprofit was founded in 2014. Among other programs, it distributes more than 22,000 pounds of fresh food and produce to partners including the City Rescue Mission, Trinity Rescue Mission, Beaches Emergency Assistance Ministry, The Salvation Army and the Sulzbacher. The city will purchase one trailer and a truck at no more than $200,000 while Feeding Northeast purchases the second trailer. The remaining $100,000 will pay for the Jacksonville Transportation Authority to provide residents within the modified ReadiRide boundary with discounted transportation from their homes to a grocery store within the boundary and back. Two additional programs in the bill do not include immediate city funding. One would provide a subsidy to food delivery companies that ship to locations within the Interstate 295 loop within the Northwest Jacksonville boundary. The second program would provide a one-time $5,000 grant to existing retail businesses not offering fresh foods, vegetables or meats to purchase “open air” refrigeration units, which are those used in grocery stores to display those products. Both bills would be paid for with about $3 million earmarked in 2018 from the Northwest Jacksonville Economic Development Fund to make healthy food available and affordable in food deserts. According to a memo provided to the Mayor’s Budget Review Committee from the economic development office,

the food desert program budget will have $1.84 million remaining after Council approves the bills and they are signed by Mayor Lenny Curry. Feeding Northeast Florida President and CEO Susan King says the programs are a good first step by the city to address food deserts and food insecurity in Northwest Jacksonville. According to U.S. Department of Agriculture data, there are 29 areas in Duval County that fit the federal government food desert definition. King said of the 253,000 people in Northeast Florida who are considered food insecure, 170,900 live in Duval County — 19% of the population, or about 1 in 5 people. The mobile market trailers are custom-built. The nonprofit will design a trailer as “mini-grocery stores,” King said. It also will have a cart with a cooking station and microwave for educational programming. Office of Economic Development Executive Director Kirk Wendland told Council members Monday the trailer purchased using city resources will be deployed only in the city’s northwest quadrant because the money would be appropriated from the Northwest economic fund. The trailer bought by Feeding Northeast Florida will be used throughout its service area. Council is expected to take a final vote on both bills at its meeting at 5 p.m. Tuesday at City Hall, 117 W. CEO shares growth road map for Mayo Clinic

Jacksonville campus adding buildings, powerful MRI machine and getting its own Butler Boulevard ramp. Hours after announcing that carbon ion therapy would be coming to the Jacksonville campus, Mayo Clinic Florida CEO Kent Thielen shared more plans Tuesday about the hospital system’s plans for the next 10 years. In addition to the planned $233 million integrated oncology facility, which will open by 2022, Thielen told World Affairs Council of Jacksonville members and guests the Jacksonville campus is expanding significantly. In 2021, Mayo North will complete a five-floor, 120,000-square-foot building with space for eight operating rooms and procedural space for cardiology, gastroenterology and hepatology. The Mayo South build-

from the inside better than other major organizations and other corporate entities outside of health care,” Thielen said. “We have the people, the experience, the expertise, the resources to be able to do this.” Earlier Tuesday, Mayo announced it was partnering with Hitachi to add carbon ion therapy into its cancer treatment offerings. Carbon ion therapy is used to treat cancers that may be resistant to proton beam therapy. The treatment is working its way toward Food and Drug Administration approval and is expected to be available after 2025.

Memorial Hospital adds 18-room cardiovascular ICU

Memorial Hospital opened its cardiovascular intensive care unit last week. The CVICU has 18 rooms with six critical care beds and 12 progressive care beds for cardiovascular surgery patients. It is focused on cardiovascular and thoracic postoperative recovery. Memorial, at 3625 University Blvd. S., said opening the unit is in response to increased volume and complexity in cardiovascular and thoracic surgery patients. “Our patient population preexisting conditions have gotten more complex in general compared to other facilities,” said CVICU Medical Director Dale Mueller.

The Memorial Hospital cardiovascular intensive care unit has 18 rooms — six critical care and 12 progressive care beds — for cardiovascular surgery patients.

“The amount of emphysema, amount of diabetes, the amount of vascular disease, previous stroke has made those patients much more complex to handle postoperatively,” he said. Mueller, a Memorial Hospital cardiologist, Mueller was appointed medical director. Critical Care Director Angelo Podes, who’s been at the hospital for 19 years, will serve as the unit’s nurse leader. The unit replaced Memorial Hospital’s pediatrics ward, which Podes said “didn’t work out as well as we’d liked.”

ing opened earlier this year, Thielen said. It houses molecular imaging, cardiovascular services and rehabilitation services. The Discovery and Innovation Building opened in August, housing lung restoration, cell therapy and the Life Sciences Incubator. To accommodate the growth, a 1,000-space parking garage is being built along with an entrance and exit ramp from Butler Boulevard directly to the campus. Thielen said Mayo would continue its Thielen work with United Therapeutics, its lung restoration facility partner. Those efforts include printing 3D organs that are made with stem cells, or using genetically modified organs from other animals, such as pigs, to transplant into humans. He also said one of the strongest MRI scanners in the country will be coming to the Jacksonville campus. Rather than a 1.5-Tesla or 3-Tesla scanner, which most MRIs are, it will be a 7-Tesla machine. It’s approved for use in the knee and brain and can uncover abnormalities that a 1.5 or 3-Tesla scanner can’t. A Tesla measures the strength of the magnetic field the MRI scanner generates. “We can impact health care

Because the CVICU has critical care and progressive care beds within the same unit, patients can move from surgery to critical care into progressive care beds and then be discharged. Patients typically stay in the unit for five to six days. “It means a lot for continuity of care that they’re in the same unit the whole time during their stay,” Podes said. “Once they’re admitted to that unit, they never leave the unit until they’re discharged.” To run the CVICU, 45 staff members will be hired. year, but he could not confirm which companies will expand or how many jobs will be created. “Robert has three or four companies in what we would call expansion mode right now. Part of this deal would be to bring those companies into that facility as well,” Walter said. “We have some nationally expanding facilities right now. Robert will be making those announcements here shortly. The idea is to host them there at the stadium office,” he said. City Chief Administrative Officer Brian Hughes said Nov. 12 that Palmer is “developing new lines of business” that “may either expand here or move here.” Palmer seems on board. He posted renderings to social media last week showing the RP Funding logo on the office building attached to the proposed stadium. EASTSIDE INVESTMENT

The Armada deal could result in a $10 million capital investment in the city’s Eastside neighborhood, an area targeted by city and community leaders for reinvestment to provide jobs and services. That’s another Armada goal. Walter said choosing the site in the urban area near the Downtown Sports Complex was deliberate. “We want to be an advocate for the community,” Walter said. As well, officials in Mayor Lenny Curry’s administration want to be able to say Downtown prosperity is moving into the adjacent neighborhoods. “It’s something that we were

very interested in from a community standpoint and location,” Walter said. The proposed Armada site is at a distance from TIAA Bank Field that creates separation as well as opportunity. “We want to be part of the Sports Complex. That allows us to be part of the sports family but not be too deep into all the stuff that’s going to be happening at Lot J,” Walter said. Just as Jacksonville Jaguars owner Shad Khan expects his proposed $450 million Lot J development at the stadium to be an economic catalyst for the city and Downtown, Walter said he hopes the soccer stadium can do the same for the Eastside and rejuvenate that area. As a company, Walter said Jacksonville Armada FC would base 40 to 50 full-time employees at the complex to include players, general staff and coaching staff. It also will bring more events to the area. “We’ll be looking to host different sports. We have an academy affiliate. We want to host top academy affiliate games in the stadium,” Walter said.

JaxDailyRecord.com

Jacksonville Armada FC has been searching for a permanent home field since Palmer bought the soccer club from National American Soccer League in July 2017. The property agreement includes 29 parcels bounded by A. Philip Randolph Boulevard and Grant, Albert and Georgia streets to build a stadium with up to 10,000 seats and 175,000 square feet of commercial office space and other buildings for soccer and “other related ancillary” events. A proposed option agreement between the city and Palmer company RP Sports Investments LLC made public Nov. 5 would reserve 5 acres of city-owned property northeast of the Downtown Sports Complex for the Armada to build a soccer stadium, breaking ground by January 2024. A summary of the development terms provided by the city states that the stadium must be a minimum of 2,500 seats. The complex also would provide 100 to 200 parking spaces. RP Sports would be required to begin construction on the facility and parking by Jan. 31, 2024, and be substantially completed by July 31, 2025. If the company fails to meet the completion deadline, it will pay the city fair market value for the property. There are procedural benchmarks before the stadium can break ground, including approval by City Council. The Mayor’s Budget Review Committee approved a request Nov. 12 from the city’s Office of Economic Development to file legislation by Nov. 26 asking Council to approve the agreement. The 5 acres is zoned for public buildings and facilities and needs to be rezoned for commercial use

before the stadium can be built. The city also will have to obtain consent from the University Athletic Association Inc. in Gainesville and the University of Georgia Athletic Association Inc. to exclude the property as available parking for the annual FloridaGeorgia game. Walter said the agreement will give the Armada time to conduct environmental site testing as well as draft a project proposal. “The agreement allows us to do those things and make sure we do it right. But if things move forward with comfort and ease and there are not major concerns, we’ll be putting it (the stadium) in,” Walter said. RP Sports will make a $5,000 payment to the city within three days of executing the agreement. After 30 days, the city would enter a purchase agreement for the property with RP Sports for $1. The option would expire Jan. 31, 2023, if no action is taken. If RP Sports hasn’t closed on the property by Jan. 1, 2024, it will revert to the city. CLUB STABILITY

The land option would mean stability for the Jacksonville soccer club, a mandatory bargaining chip as the Armada prepares a bid to join a top-tier professional U.S. soccer league. The Armada is a U-23 soccer team, which is a club for players ages 15 to 24, in the National Premier Soccer League, but Palmer wants to grow. The team was formed by the Sunshine Soccer Group in 2013 and joined the NASL. The league took control of the Armada in February 2017 until Palmer bought the franchise. The NASL then folded after the 2017 season. “We made an announcement

two years ago that we’re pulling the professional team out of the market until the stadium is built,” Walter said. He said when the Armada starts conversations with a league will depend on having a stadium site ready to develop. The Premier League is the fourth tier in the U.S. professional soccer hierarchy. The Armada wants to move into one of the three leagues governed by the United States Soccer Federation — USL League One, the USL Championship or Major League Soccer. Walter said that $10 millionplus is the starting price for a majority of the soccer stadiums being built in the U.S. The proposed Jacksonville stadium will be comparable to the home pitches of the Charleston Battery and Pittsburgh Riverhounds SC, said Jacksonville Armada FC spokesperson Morgan Purvis. Highmark Stadium in Pittsburgh is a 5,000-seat complex completed in April 2013 for $10.2 million. MUSC Health Stadium in Charleston, South Carolina, was sold in June for $6.48 million, according to the Charleston Regional Business Journal. The sale included the surrounding land, practice field and offices. The 5,100-seat stadium was built in 1999 as Blackbaud Stadium. “Before you choose a league you have to have a stadium site,” Walter said. “This allows us to have a stadium site and go to a league and say, ‘Look, here’s our project. Here’s where we are. This is the opportunity here that we’ve got, is it of interest?’ That’s what it allows us to do.” MMENDENHALL@ JAXDAILYRECORD.COM (904) 356-2466

Reports said Kraft Heinz Co. was trying to sell the coffee brand that is produced in Downtown Jacksonville. Months after financial news reports that Kraft Heinz Co. was considering a sale of its Maxwell House coffee brand, the struggling food retailer hasn’t commented on the possibility. However, one analyst last week said Kraft Heinz is still evaluating several business units for a possible sale. “KHC continues to execute a deep assessment of its brands and the segments it competes in as part of its longer-term strategy,” Goldman Sachs analyst Jason English said in a report as he downgraded Kraft Heinz’s stock from “neutral” to “sell.” English Several reports last winter and spring said Kraft Heinz was trying to sell its Maxwell House coffee brand but was unable to find a buyer. The company’s iconic Downtown Jacksonville facility at 735 E. Bay St., which employs about 200 people, is the last remaining Maxwell House plant in the U.S. The plant has been operating at that location since 1924. English said he is taking no position on divestitures. But at a meeting in September, “management acknowledged that some brands and segments could be too expensive to turn around, and expressed some willingness to dispose of such businesses if it determines that any parts of its portfolio fall into this bucket.” During Kraft Heinz’s thirdquarter conference call with investors last month, management “highlighted that it is

exploring areas of its products or categories that could fit better with a different company,” English said. English projects the company’s coffee business, which includes the Gevalia brand, will produce $1 billion in sales in 2020, or 5.2% of total Kraft Heinz sales. Downtown Investment Authority CEO Lori Boyer confirmed in a phone call Nov. 7 that she had a teleconference with Kraft Heinz representatives in October, but she declined to comment about the subject of the meeting.

SunTrust-BB&T merger impact on city still unclear Before their planned merger, SunTrust Banks Inc. and BB&T Corp. resolved antitrust concerns by agreeing to divest 30 branches in Georgia, Virginia and North Carolina. However, the two banks have still not decided on possible office closings in the Jacksonville market related to the merger, which is expected to be completed Dec. 6. Atlanta-based SunTrust and Winston-Salem, North Carolina-based BB&T are merging into a new company called Truist Financial Corp., which will be headquartered in Charlotte, North Carolina. The U.S. Department of Justice announced Nov. 8 the two banks agreed to sell 28 branches, which it said is the largest divestiture in a bank merger in the past decade. As it turned out, the two banks announced a deal to sell 30 SunTrust branches with $2.4 billion in deposits to First Horizon National Corp. The nearest branch to Jacksonville in that deal is in Jesup, Georgia. The two banks combined have 33 branches in the North-

east Florida market, according to the latest Federal Deposit Insurance Corp. data, and both have offices in Downtown Jacksonville. A SunTrust spokesman said last week the companies have made no decisions on what will happen to Jacksonville area offices after the merger, and any future branch closings would not be related to the agreement with the Justice Department. The merger was approved Tuesday by the FDIC and the Federal Reserve Board.

CSX downgraded on coal outlook Deutsche Bank analyst Amit Mehrotra last week downgraded his rating on CSX Corp., saying the continuing decline in coal shipments will impact the Jacksonville-based railroad company’s earnings. Coal shipments have historically been CSX’s biggest business but lower demand has significantly cut its coal volume in the past decade. Despite “superhuman” efforts to improve profit margins with cost cutting and efficiency initiatives, Mehrotra said the continued drop in coal will make it difficult for CSX to improve earnings, so he downgraded the stock from “buy” to “hold.” “We’d characterize this downgrade as specific to the Eastern rails given exposure to export-coal markets,” Mehrotra said in a research note. “And while we’ve been cautious on Norfolk Southern Corp. for some time, we are now turning neutral on CSX after significant outperformance over a several year period, and near-term risks related to above-mentioned coal headwinds,” he said. Beyond the coal business, Mehrotra thinks the railroad industry has a strong outlook. “To be sure, we remain

Project delays affect Duos Technologies

Drone Aviation Holding Corp. recorded third-quarter earnings of $574,296, or 2 cents a share. Revenue for the Jacksonville-based company, which produces tethered aerial monitoring and communications platforms, jumped from $84,815 in the third quarter of 2018 to $2.7 million this year. Drone Aviation said the improvement reflects delivery of new systems to customers including the U.S. Army and additional deliveries in support of the U.S. Border Patrol.

Jacksonville-based Duos Technologies Group Inc. last week reported a net loss of $1.1 million, or 4 cents a share, for the third quarter, with revenue dropping 57% to $2.2 million. The company said the decrease in revenue was caused by shifts in the timing of projects, because of customer construction delays. However, the provider of analytical technology solutions said those delays will not affect results for the full year. Duos Technologies is still expecting full-year revenue of $13.5 million to $14 million, up from $12 million in 2018, and is forecasting revenue to grow to $20 million in 2020.

Revenue jumps at Drone Aviation

Jacksonville-based ParkerVision Inc. last week reported a third-quarter loss of $2.1 million, or 7 cents a share, with minimal revenue. The developer of wireless technology is no longer pursuing development of products and is focused instead on several pending lawsuits against major communications manufacturers. ParkerVision alleges those companies have infringed on the company’s patents in their products. “We are fortunate to have received tens of millions of dollars in support from thirdparty funders, our litigators and our shareholders to defend our patents,” CEO Jeff Parker said in a news release. “Our goal continues to be the recovery of fair compensation from those who are benefiting from our discoveries,” he said.

Cannae Holdings Inc., the investment company spun off from Fidelity National Financial Inc., announced a plan last week for a health care joint venture. The joint venture, which includes an affiliate of The Carlyle Group, seeks to acquire “synergistic health care services companies in the provider and payer space,” Cannae said in a news release. Cannae will be a minority shareholder in the joint venture. The company will contribute its T-System business, which provides health care documentation services, as part of the joint venture. Cannae has investments in a diverse array of companies including business data firm Dun & Bradstreet Corp. and several restaurant chains. Sooner or later, many people need legal counsel related to divorce, legal separation, marital asset valuation, child custody, timesharing or modification or enforcement of a court order. That’s why Jacksonville’s Bedell Firm, founded in 1865 and the oldest continuously operating law firm in Florida, established a family law practice about three years ago. “We got a lot of calls from our existing business and criminal law clients for referrals to a family law attorney. The directors asked if anyone would be willing to start that practice. I thought it would be great to start something new,” said Ashley Wells Cox, Bedell’s senior counsel in the firm’s Family Law Division. It wasn’t the first time Cox has shifted careers. Patricia Abraham, the opportunity to join Bedell. “The timing worked out. We had the nugget of a family law practice,” Cox said. Bedell Firm Managing Director David Barksdale said the initial plan was for Cox to practice family law about half the time while maintaining her criminal defense practice, but that’s not what happened. “Our family law practice has doubled each year for the past three years,” Barksdale said. Changing her practice focus hasn’t made Cox a stranger at the Duval County Courthouse, but the interaction with the justice system has changed. “I find going to court interesting and challenging. The judges want the family to succeed even in the difficult situation,” Cox said. “In criminal cases, the prosecutor represents the state

against the defendant. In family law, everybody is working toward a different good,” she said. Not all of her clients end up in court. Cox said if someone comes to her considering divorce, she’ll discuss counseling options to see if there’s a way for both parties to be happy and avoid dissolving their marriage. “That’s the goal. It doesn’t always work out that way, but we try to come to agreement on our own through mediation. Going to court is the last resort,” Cox said. The law tends to evolve, and there have been some substantial changes in family law in the past few years, such as tax regulations related to alimony. Previously, alimony was taxed as income for the person receiving it and deductible as an expense for the person paying it. “Now, alimony isn’t deduct-

ible from taxes and it’s no longer income for the person receiving it. That can affect the amount,” Cox said. In addition, the state Legislature is anticipated to consider in its 2020 session whether to amend to law to make calculating alimony more formulabased, similar to the current child support law, Cox said. Another trend Cox is seeing is “a significant number of longterm marriages in divorce” as people are waiting until their children are grown to seek dissolution. The firm expects its family law practice will continue to grow. “Ashley has done an outstanding job and people are hearing about it,” Barksdale said. MMARBUT@ JAXDAILYRECORD.COM (904) 356-2466

A petition that disputes the material facts on which the Department’s action is based must contain the following information, as indicated in Rule 28-106.201, Florida Administrative Code: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, and telephone number of the petitioner; the name, address, and telephone number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the determination; (c) A statement of when and how the petitioner received notice of the Department’s decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the Department’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the Department’s proposed action; and (g) A statement of the relief sought by the petitioner, stating precisely the action petitioner wishes the Department to take with respect to the Department’s proposed action. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Department’s final action may be different from the position taken by it in this notice. Persons whose substantial interests will be affected by any such final decision of the Department, have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above. In addition to requesting an administrative hearing, any petitioner may elect to pursue mediation. The election may be accomplished by filing with the Department a mediation agreement with all parties to the proceeding (i.e., the applicant, the Department, and any person who has filed a timely and sufficient petition for a hearing). The agreement must contain all the information required by Rule 28-106.404, Florida Administrative Code. The agreement must be received by the Clerk in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, within ten days after the deadline for filing a petition, as set forth above. Choosing mediation will not adversely affect the right to a hearing if mediation does not result in a settlement. As provided in Section 120.573, Florida Statutes, the timely agreement of all parties to mediate will toll the time limitations imposed by Sections 120.569 and 120.57, Florida Statutes, for holding an administrative hearing and issuing a final order. Unless otherwise agreed by the parties, the mediation must be concluded within sixty days of the execution of the agreement. If mediation results in settlement of the administrative dispute, the Department must enter a final order incorporating the agreement of the parties. Persons seeking to protect their substantial interests that would be affected by such a modified final decision must file their petitions within fourteen days of receipt of this notice, or they shall be deemed to have waived their right to a proceeding under Sections 120.569 and 120.57, Florida Statutes. If mediation terminates without settlement of the dispute, the Department shall notify all parties in writing that the administrative hearing processes under Sections 120.569 and 120.57, Florida Statutes, remain available for disposition of the dispute, and the notice will specify the deadlines that then will apply for challenging the agency action and electing remedies under those two statutes.
