s Darrin Mueller passed through the Bacardi Bottling Corp. plant Sept. 24, he greeted employees as thousands of bottles raced around the facility. They start as empty glass containers, then are filled with Bacardi rum, capped and boxed into cases. Mueller, 44, a five-year Bacardi employee, started in the plant’s top position in June. He

calls it his dream job, something he’s wanted since starting in the industry more than 20 years ago. He is responsible for the bottling and distribution of about 8.6 million cases of Bacardi rum a year, along with leading 200 employees at the company’s 12200 N. Amazon.com Inc. continues its Jacksonville expansion with a 477,946-square-foot package delivery hub in North Jacksonville that is being built-out for $15 million. It is the Seattle-based online retailer’s ninth identified facility in Northeast Florida. The city issued a permit Oct. 13 for Threecore LLC in Sarasota to build-out the interior of a new warehouse at 250 Busch Drive E. in Imeson International Industrial Park. Baker Barrios Architects Inc. of Orlando is the architect. Plans show the project is an Amazon.com package delivery service with employees in two shifts – days and evenings – and a possible third seasonal shift. No job count was stated. It is labeled DJX3, an Amazon code. Packages arriving at the facility will be labeled for shipping within local neighborhoods and surrounding areas by vans. The city approved construction of the shell building in May 2019 for Webb Southeast Construction Corp. to build the distribution center on 30.69 acres at a construction cost of almost $13.7 million. The developer was Orlando-based Industrial Park Investments Inc. JEA and city Planning Department documents show the property will have 102 loading bays, 337 parking spaces and 133 spaces for trailer parking.

Repairs planned for Downtown Central Fire Station Micheladas to West Jacksonville: Tenant renovations are in review for Micheladas Restaurant at 5353 Firestone Road. Rescue Roofing & Construction LLC is shown as the contractor for the 1,796-square-foot buildout at a cost of $30,000.

KAREN BRUNE MATHIS EDITOR

Paul and Farley Grainger are beginning to prepare the 117-year-old Central Fire Station building Downtown for tenants. “We just wanted to start the process,” said Paul Grainger, a partner with his father, Farley Grainger, in Iconic Real Estate Investments LLC. They submitted documents to the city for a certificate of appropriateness for exterior repairs. Robbins Design Studio is the applicant and agent for the project. The Jacksonville Planning and Development Department staff approved the certificate with conditions. The 10,000-square-foot building is designated historic. The former fire station is at 39 E. Adams St. at northwest Adams and Ocean streets. The exterior repairs will include replacement of the rollup doors, new exterior personnel doors, stucco and structural repairs, window replacement, new exterior decorative lighting fixtures and new roofing. The interior scope will provide an interior lift for accessibility and new secondary egress stairs for a future tenant. The interior will be turned into shell space for future tenants. On Oct. 9, Paul Grainger cited new incentives from the Downtown Investment Authority as an opportunity to contribute to the city’s historic inventory. He said he will meet with DIA to make sure his group is interpreting the rules for historic work. Grainger said the top floor

has potential for creative office use and he has been talking with potential tenants. He said the building could be leased to a single tenant or to single users on each floor. The rollup door on the first floor would be conducive for a coffee shop or cafe, he said. Grainger said exterior work probably will start in a few months. He did not have an investment estimate, saying he was receiving updated costs. After 5½ years of owning the Central Fire Station building, John VanPelt sold the historic Downtown property in June 2019 for $700,000 to Iconic Real Estate Investments. VanPelt paid $600,000 for it in January 2014 and lived there with his teenage son. The fire station, built in 1903, was one of the first new structures after the 1901 fire that destroyed Downtown. The building is at the corner of two major Downtown thoroughfares, at the end of a block anchored by the Burrito Gallery and Indochine restaurants. Across Adams Street sits the former Haydon Burns Public Library that was renovated into the Jessie Ball duPont Center for nonprofits. The Graingers said when they bought it that they were talking to tenants but the structure has deferred maintenance.

The fire station’s first floor is about 5,000 square feet of garage space, while the second floor, with views of Downtown, is about the same size and has been used as living quarters. Grainger said upon buying the building that his group would talk to the city’s historic planners about preservation and facade improvements. Iconic has been active Downtown. On Sept. 30, Iconic Real Estate Investments sold the George Doro Fixture Co. property at 102 A Philip Randolph Blvd. to Rise: A Real Estate Company, for $5.2 million. Rise, based in Valdosta, Georgia, plans apartments.

Permits in review for Lane Industrial Park Lane Industrial Park is taking shape in northwest Jacksonville. Foresight Construction Group Inc. of Jacksonville is the contractor for the proposed $15.71 million construction project at 2282 Lane Ave. N. Kasper Architects is the architect for the two industrial buildings that total 322,670 square feet of warehouse space. The city is reviewing building permit applications. Building 100 comprises 161,335 square feet with office space totaling $9.16 million. Building 200 also is shown at 161,335 square feet at a cost of $6.55 million. Colliers International Executive Director Guy Preston and Senior Associate Seda Preston said in July they expect groundbreaking in October.

HEALTH & BUSINESS

Telescope Health CEO: ‘Telemedicine is here to stay’

KATIE GARWOOD STAFF WRITER

As health systems add more telehealth capabilities, CEO Matthew Rill says the hospital environment could change forever. The longer the pandemic continues, the more likely it is that telemedicine permanently will impact emergency room volumes and how hospitals operate, said Telescope Health CEO and co-founder Matthew Rill. For two months following the start of COVID-19 shutdowns, Rill said Telescope Health, a Jacksonville-based telemedicine provider, grew from seeing about 15 patients a day to 300 a day. Its volume has remained higher than usual, and now, Rill said Telescope Health is seeing a higher percentage of non-COVID patients. Telescope began partnering with the city of Jacksonville in March to provide COVID-19 testing.

Special to the Daily Record

Telescope Health CEO and co-founder Matthew Rill says many conditions can be treated via telemedicine, and the system can treat more patients with fewer resources.

“People were fearful during the spring and not coming into traditional brick-and-mortar spots,” he said. “I think that the hospitals have done a great job of responding to the threat, so people are returning back to brick-and-mortar spaces. But at the same time, I think there’s been a lot of folks who have enjoyed this new access to

health care.” At UF Health Jacksonville, ER volumes hit their lowest points in May. The Downtown hospital’s ER volume was down 28% from May 2019 and UF Health North’s was down about the same at 27%. Around 20% of visits at local health systems still are via telemedicine, Rill said. He

doesn’t expect hospitals to stop providing it, but rather expand their virtual offerings. “I think all health systems will be looking for ways to expand their network via telemedicine,” he said. Rill started Telescope Health in May 2019 from Emergency Resources Group, a Jacksonville-based company that provides emergency room services for Baptist Health and Flagler Hospital. Rill is an emergency physician. The goal was to provide a more accessible and affordable health care option. “We were looking at the future of medicine and could see that the landscape for emergency medicine was changing, and we knew that it would be important to not only care for people in the hospital but provide services outside the hospital,” Rill said. Most conditions can be treated in some way through telemedicine, he said. For ailments that would typically require an ER visit, telemedicine can speed up the process once the patient arrives at the hospital or eliminate the need for a trip. Rill said Telescope Health treats stroke and heart attack patients by helping them call 911 and then coordinating with the ER team to increase efficiency. With fewer in-person visits at ERs, health systems would need less physical space for hospitals and ERs in the future. “So many conditions can

be started or managed via telemedicine and we use the brick-and-mortar space for important physical exams that need to be done in person or testing that needs to be done in person,” Rill said. Telehealth visits also can reduce chronically ill patients’ hospital visits. A doctor can prescribe a medication virtually, and schedule more frequent virtual follow-up appointments to make adjustments to a patient’s care plan. When health systems expand their telehealth usage, they’re able to treat more patients with fewer resources. “Now you can make microadjustments to improve their health with very little increased cost to anyone,” he said. The average cost of ER visits in 2017 was $1,389, according to the Health Cost Institute. Telescope Health charges $69 a visit. The only issue is that some insurance companies don’t cover telehealth visits, but Rill said he does not think that’s far away. “It will only work longterm if the reimbursement structures catch up to support it,” he said. “It’s better for the patient, it’s better for the health system, it’s better for the insurance companies.” “I think telemedicine is here to stay,” he said. Cases of Barcardi rum are moved along the conveyor system. The plant is on pace to ship more than 9 million cases in 2020. Don Facundo Bacardi Masso founded Bacardi in 1862 in Cuba. The company says the founder’s wife, Dona Amalia, noticed a colony of fruit bats hanging in the rafters of the distillery and suggested adopting the bat as the symbol of Bacardi rum. The rum is now distilled in Puerto Rico and bottled in Jacksonville.

managers that is something that I wanted to do,” he said. “How I was going to get there was always a mystery.” He started as a summer employee at Anheuser-Bush in Colorado, working part-time while in college at the University of Northern Colorado. He took on more hours, eventually becoming an intern. While he was studying mass communication, Mueller said his work in the beverage industry intrigued him. “I thought, wow, this is a lot of fun,” he said. “It’s very competitive, it’s a product that millions of people enjoy, and it’s just something grandiose to be a part of. And so, I wanted to be a part of it.” After graduating, he moved to Jacksonville with his wife and started a job at Anheuser-Busch in Jacksonville. He held manufacturing roles at Metal Container Corp. in Jacksonville and Georgia-Pacific in Palatka. Metal Container Corp. manufactures aluminum cans and bottles for Anheuser-Busch. He left Metal Container Corp. several years after InBev acquired AnheuserBusch in 2008. In 2015, he joined Bacardi as a senior bottling operations manager. A year later, he was promoted to manufacturing director. Now, as director of the operations center, his responsibilities at the plant

He oversees the shipment of 6 million gallons of rum from Puerto Rico to the site each week, leads meetings with staff to streamline operations and sets growth strategies for the plant. Mueller said no matter where you buy a bottle of Bacardi rum, it came from the Jacksonville bottling facility. Although the company owns other brands, such as Grey Goose vodka and Patrón tequila, only Bacardi products are bottled in Jacksonville. Bacardi calls its employees “primos,”

Since Mueller took the lead role at Bacardi in June, the plant has been busy, he said. Although COVID-19 had an adverse effect on most industries, Bacardi’s U.S. sales have been on the rise. The Jacksonville Bacardi plant ships out more than 8.6 million cases of rum each year. Mueller said they are on track to exceed that by almost 1 million cases in 2020. Of that, 95% is shipped domestically. “What we’re seeing is a vast shift in our forecasts, and that’s really where a lot of our efforts have been focused,” he said. “One of the things that we don’t want to have happen is to not be able to supply our customers and our consumers.” To respond to the increase in demand, and to reduce costs and increase safety, the plant is installing a $6 million upgrade to its packing equipment. The first phase began in July. The second phase is set to begin in December and be completed in March. Before the installation of the machine, it took five pieces of equipment to build a box, pack the bottles and complete the case. Now, that can be done with one machine, Mueller said. There also were issues with bottles breaking in transit to the retailers. Mueller said that the boxes made from the new system are much stronger and can prevent breakage. Mueller said he also is seeing a slight change in the popularity of Bacardi’s products. The ready-to-drink category is growing in the U.S. and Canada. Bacardi sells its lime and soda, limon and lemonade and rum punch in cans. About 80% of what the Jacksonville plant bottles is Bacardi Superior rum, which comes in white, gold, black and spiced varieties. About 15% of its vol-

THE MARBUT REPORT

Pro bono hours slump amid pandemic File image

MAX MARBUT ASSOCIATE EDITOR

The cancellation of clinics and other events is impacting local legal aid providers. In a year when legal practices are limited because of COVID-19, slightly more lawyers reported providing pro bono services in 2019-20 than the previous year, although the amount of assistance declined, reports The Florida Bar. According to figures provided to the Pro Bono Legal Services Committee on Oct. 7 during the Bar’s fall meeting, 40,344 lawyers reported individually donating 1.293 million hours of pro bono work in the 2019-20 Bar year. Another 643 provided 19,531 hours through law firm pro bono plans. That compares with 40,002 lawyers who did 1.6 million hours of individual pro bono work and 577 who did 24,149 hours through law firm plans in 2018-19. Another 24,368 attorneys

Missy Davenport, pro bono director at Jacksonville Area Legal Aid, said financial contributions to the organization are lower than last year as events promoting donations have been canceled.

reported donating almost $6.4 million to legal aid programs in 2019-20, compared with 22,228 lawyers who donated $6.2 million the previous year. Local legal aid providers say the state statistics mirror what’s happening in Northeast Florida from consequences of COVID-19 shutdowns and social distancing. “Our numbers are lower because so many of our events have been canceled,” said Missy Davenport, pro bono director at Jacksonville Area Legal Aid. Before COVID-19, JALA hosted weekly in-person legal clinics at its office Downtown and at senior centers and other facilities, connecting volunteer attorneys with people who need help. With the office closed to the public and JALA attorneys mostly working remotely, only a few in-person appointments are available each week, Dav-

enport said. “We’re making the transition to virtual with telephone consultations and Zoom clinics,” she said. Financial contributions to JALA are lower than last year because events promoting donations have been canceled, Davenport said. The loss of personal contact hasn’t reduced the public’s demand for civil legal aid, however. “We have seen an increased need for bankruptcy, foreclosure and eviction defense. This makes sense because the Florida eviction moratorium is lifted, people have been out of work, temporary furloughs are becoming permanent layoffs and people have been unable to pay bills for several months,” said Sarah Sullivan, pro bono director at Three Rivers Legal Services in Jacksonville. “Our pro bono attorneys have been especially engaged, knowing all of the legal turmoil after several months of decline due to the pandemic. They have reached out and raised their hands to help, but we always need more volunteers,” Sullivan said. Visit jaxlegalaid.org or trls. org for more information or to donate.

or 20 years, attorney Sean Cronin has helped clients in Florida with injuries and deaths caused by medical malpractice. As attorneys who are also veterans, our military experience helps us serve medical

malpractice victims and their families throughout Northeast Florida. Our attorneys handle both civilian and military medical malpractice claims.

Practice Areas “We are lucky that Barrett is willing to answer the call to serve as a Supreme Court justice.” As someone who recently lost a parent and a grandparent, when news broke that U.S. Supreme Court Associate Justice Ruth Bader Ginsburg died, my thoughts went to feeling sympathy for her family as they grieved for their matriarch. After processing the monumental loss that Justice Ginsburg is to our country and specifically, the judicial branch of government, my thoughts shifted to my friend and former law professor, U.S. Court of Appeals Judge Amy Coney Barrett. After being considered a finalist for the nomination that Associate Justice Brett Kavanaugh received in July 2018, would this be her time? I met then-professor Amy Barrett in January 2003 on the first day of Civil Procedure class in my first year at Notre Dame Law School. My classmates and I didn’t know that our new professor would be nominated 17 years later by President Donald Trump for confirmation by the Senate to serve for life on the Supreme Court. Those of us who traditionally matriculated from our undergraduate studies to law school were 23 years old at the time. Our professor, in the first year of her career as a full-time faculty member, was about 30 years old. Even though she was significantly younger than our other professors and could easily be mistaken for a second- or third-year law student, it did not take us long to realize we were in the presence of a brilliant legal mind. How could we help but be impressed that our professor graduated at the top of her class at Notre Dame Law School just six years before and clerked for U.S. Court of Appeals Judge Laurence Silberman in the D.C. Circuit and also for the late Associate Justice Antonin Scalia at the Supreme Court? She immediately had our attention. Notwithstanding her sterling resume, it was her consistently warm demeanor and intellect that endeared her to our class. During the rare time when a student was unprepared to answer questions about the assigned reading, Barrett never embarrassed the student, but kindly reminded them to not come to class unprepared again. Near the end of our third and final year, we were asked to vote for our favorite professor. The professor with the most votes was “Professor of the Year” and would give our class’s faculty commencement address. Barrett was selected by my class, the first of three times she would be so honored during her 15-year full-time teaching career. I stayed in touch with her and got to know her outside of the classroom. While I was serving as president of our local Notre Dame Alumni Club, Barrett agreed to come to Jacksonville in November 2016 to give a continuing

education lecture to our alumni and friends at Jacksonville University. Her lecture was on the Thursday before the 2016 presidential election. Barrett discussed different judicial philosophies and the candidates who might be appointed to the federal courts under a Hillary Clinton administration. She also touched on who might be appointed should Trump, the underdog Republican nominee, somehow prevail. It is inconceivable to me – and probably to Barrett – that just a few months after that lecture at JU and Trump’s election she would be nominated and confirmed by the Senate to serve as a judge on the federal 7th Circuit Court of Appeals. After her confirmation, Trump amended his list of candidates he would consider appointing to the Supreme Court to include Barrett. He considered her as a finalist for the highest court in 2018 when Associate Justice Anthony Kennedy retired. I am proud of my former professor and I think we are lucky that Barrett is willing to answer the call to serve as a Supreme Court justice. She will faithfully adhere to her oath and objectively apply the law. Her self-described judicial philosophy is of the originalist and textualist origin. While U.S. Sen. Charles Schumer and others are vilifying her for being “bad” for health care, women’s rights, LGBTQ rights, etc., I believe Barrett views her limited role as a judge to exclude policymaking. Her decisions will be based on where the law takes her without regard for whether she personally agrees or disagrees with the result. Many of us feel strongly about controversial issues. Barrett has a threeyear record on the federal appellate court, demonstrating that she objectively adjudicates the issues presented to her. Barrett should be given the same benefit of the doubt that Justice Ginsburg was given in 1993 during her confirmation hearings. Assuming she is confirmed by the Senate, I have no doubt historians will look at Barrett’s time on the court with as much acclaim as they do Justice Ginsburg’s. THE BASCH REPORT

Johnson & Johnson Vision sales still down

MARK BASCH CONTRIBUTING WRITER

U.S. contact lens sales are strong but pandemic delays hurt sales of its vision surgery products. Johnson & Johnson said sales at its Jacksonville-based Vision Care unit dropped in the third quarter, with sales gains in U.S. contact lenses offset by declines in international sales and vision surgeries. Total Vision Care sales fell 9.4% in the quarter to $1.08 billion. That was mainly caused by a 16.3% drop in sales of vision surgery products. Johnson & Johnson said deferral of surgeries because of the COVID-19 pandemic is causing sales declines throughout its medical device business, which fell by an adjusted 3.3%. U.S. sales of Acuvue contact lenses made in Jacksonville jumped 10.9% to $375 million in the quarter, but with a big drop in international sales, total contact lens sales fell 7.1% to $830 million. Chris DelOrefice, vice president of investor relations, said in Johnson & Johnson’s quarterly conference call the U.S. sales gain resulted from restocking in the quarter. The company expects

stocks of contact lenses to return to more normalized levels in the fourth quarter. DelOrefice said the company is optimistic about new products as business returns to normal. “We continue to advance our contact lens pipeline with the world’s first and only drug-releasing contact lens for patients with allergic eye itch having received approval from Health Canada,” he said. DelOrefice also said the company expects better results throughout the medical device segment as surgical procedures resume. “Overall, we saw more stable results in total across each month this quarter,” he said. New Jersey-based Johnson & Johnson said total global sales rose 1.7% in the quarter to $21.1 billion. Adjusted earnings of $2.20 a share were 8 DelOrefice cents higher than the third quarter of 2019, and were 21 cents higher than the consensus forecast of analysts, according to Zacks Investment Research. Despite the earnings beating forecasts, Johnson & Johnson’s stock fell $2.84 to $149 when the market opened Oct. 13 after the earnings report. Before releasing its earnings, Johnson & Johnson said it had to pause clinical trials of its COVID-19 vaccine because of illness in a trial participant.

have long-term benefits for supermarkets. In an interview with industry magazine Winsight Grocery Business, Hucker said the parent company of Winn-Dixie is retaining customers it gained during pandemic-related shutdowns. “More than 80% of the customers acquired during COVID-19 continue to shop with us and nearly half of these customers are engaging digitally,” he told the magazine. Jacksonville-based Southeastern Grocers two weeks ago filed a confidential registration statement with the Securities and Exchange Commission for an initial public offering. Supermarkets have reported big sales gains in the first half of this year as consumers eat more meals at home during the pandemic. Albertsons Companies Inc. in June brought its IPO to the market after waiting for five years. Some analysts credit optimism about post-pandemic sales for helping that supermarket operator to finally go public. Privately owned Southeastern Grocers has not publicly reported any sales data since it called off a previous attempt at an IPO in 2014. The company would have to file a public registration statement with the SEC before going ahead with a stock sale. Winsight said it interviewed Hucker by email Oct. 2, which was after the confidential IPO filing. The story did not address the stock sale. The SEC mandates a quiet period for executives when their companies register for stock sales. Southeastern Grocers operates about 550 supermarkets in seven states under the Winn-Dixie, Bi-Lo, Harveys and Fresco y Mas banners. However, the company in June announced plans to sell 62 stores and discontinue the Bi-Lo brand. Hucker told Winsight the company’s Bi-Lo stores had incremental improvements from new programs. “Unfortunately, the performance within the Carolina markets didn’t keep pace to sustain our long-term growth goals,” he said.

Cracker Barrel upgraded despite big sales drop

Cracker Barrel Old Country Store Inc. reported a big drop in sales for its fourth quarter ended July 31, as the company slowly reopened its restaurants after COVID-19 shutdowns. However, C.L. King analyst Todd Brooks upgraded his rating Oct. 12 on the company from “neutral” to “buy,” saying Cracker Barrel did a good job weathering the pandemic. “The recovery that Cracker Barrel has seen in its restaurant and retail operations same-store sales during 4Q20 (ended July) — which has continued to accelerate in September — is a testament to the Cracker Barrel team taking a more aggressive approach to managing the business during the pandemic,” King said in a research note after hosting virtual meetings with management.

“The successful rollout of curbside delivery and Front Porch outdoor dining, as well as the aggressive repositioning of the retail offering to support current nesting trends, whereby consumers are spending on decorating their homes during the pandemic, are all examples of the aggressive actions taken to help the Cracker Barrel brand weather the current environment,” he wrote. Brooks is optimistic about the company’s Maple Street Biscuit Company subsidiary. Cracker Barrel acquired the restaurant chain founded in Jacksonville a year ago. “Cracker Barrel’s second brand, Maple Street Biscuit Company, has performed admirably during the pandemic, and is positioned to become the next growth vehicle for the company,” he said. “The existing base of 35 units was tracking at $1 million-plus average unit volumes and greater than 17% restaurant-level operating margins prepandemic.” Cracker Barrel intends to open 15 new Maple Street restaurants in this fiscal year. “The openings will be focused on infill locations where the brand enjoys existing awareness with consumers,” Brooks said.

FIS promotes Gileadi to chief operating officer Fidelity National Information Services Inc., or FIS, said in an SEC filing last week that Ido Gileadi was promoted to chief operating officer. Gileadi joined Jacksonville-based FIS as chief information officer in 2014. Before that, he was a senior partner at The Capital Markets Company, or Capco, which was acquired by FIS and became a subsidiary of the company in 2010.

CSX adds new director CSX Corp. last week said retired U.S. Army Lt. Gen. Thomas Bostick has been appointed to its board of directors. Bostick fills an opening created when Pamela Carter retired in May for personal reasons after 10 years on the board. The Jacksonvillebased railroad company added former AK Steel Holding Corp. CEO James Wainscott to its board in July, but said that appointBostick ment filled a potential vacancy of an unnamed director who is contemplating retirement next year. Bostick’s appointment gives CSX 12 directors. Bostick spent 38 years in the Army and served as the Chief of Engineers and Commanding General of the U.S. Army Corps of Engineers. After retiring from the military, Bostick became chief operating officer of Intrexon Corp. in 2017. He left Intrexon in February after that company restructured into a new company called Precigen Inc.

Eqip acquired by Swedish company Stockholm-based Mentice AB said last week it agreed to buy the assets of Jacksonville-based Eqip Inc., a health care IT company. Mentice, which is publicly traded on the Nasdaq Stockholm exchange, provides software and hardware simulation solutions for cardiovascular therapies. Eqip offers a product that allows doctors to record intervention procedure data, Mentice said. The acquisition expands the company’s portfolio of cloud solutions, it said. Terms of the deal were not announced. MBASCH@JAXDAILYRECORD.COM

The applicant has provided reasonable assurance that operation of proposed equipment will not adversely impact air quality and that the project will comply with all appropriate provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-296 and 62-297, F.A.C. The Permitting Authority will issue a Final Permit in accordance with the conditions of the proposed Draft Permit unless a timely petition for an administrative hearing is filed under Sections 120.569 and 120.57, F.S. or unless public comment received in accordance with this notice results in a different decision or a significant change of terms or conditions. Comments: The Permitting Authority will accept written comments concerning the proposed Draft Permit for a period of 14 days from the date of publication of the Public Notice. Written comments must be received by the Permitting Authority by close of business (5:00 p.m.) on or before the end of this 14-day period. If written comments received result in a significant change to the Draft Permit, the Permitting Authority shall revise the Draft Permit and require, if applicable, another Public Notice. All comments filed will be made available for public inspection. Petitions: A person whose substantial interests are affected by

the proposed permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57, F.S. Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the Public Notice or receipt of a written notice, whichever occurs first. Under Section 120.60(3), F.S., however, any person who asked the Permitting Authority for notice of agency action may file a petition within 14 days of receipt of that notice, regardless of the date of publication. A petitioner shall mail a copy of the petition to the applicant at the address indicated above, at the time of filing. A petition for administrative hearing must contain the information set forth below and must be filed (received) with the Agency Clerk in the Office of General Counsel, 3900 Commonwealth Boulevard, MS 35, Tallahassee, Florida 323993000, Agency_Clerk@dep.state. fl.us, before the deadline. The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will be only at the approval of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C. A petition that disputes the material facts on which the Permitting Authority’s action is based must contain the following information: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, any email address, telephone number and any facsimile number of the petitioner; the name, address any email address, telephone number, and any facsimile number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the agency determination; (c) A statement of when and how each petitioner received notice of the agency action or proposed decision; (d) A statement of all dis-

puted issues of material fact. If there are none, the petition must so state; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the agency’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the agency’s proposed action including an explanation of how the alleged facts relate to the specific rules or statutes; and, (g) A statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the agency to take with respect to the agency’s proposed action. A petition that does not dispute the material facts upon which the Permitting Authority’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, F.A.C. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Permitting Authority’s final action may be different from the position taken by it in this Public Notice of Intent to Issue Air Permit. Persons whose substantial interests will be affected by any such final decision of the Permitting Authority on the application have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above. Extension of Time: Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@ dep.state.fl.us, before the deadline for filing a petition for an administrative hearing. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon. Mediation: Mediation is not available in this proceeding. IN THE JUVENILE COURT FOR THE COUNTY OF CAMDEN STATE OF GEORGIA Case#2000134 In the Interest of: P.J.A. Sex: Male DOB: 11/01/17 A Child Under 18 Years of Age NOTICE OF SUMMONS TO: David Keller, and any other person claiming paternity of the above-named child. You are hereby notified that the above-styled action, which seeks the termination of parental rights was filed against you in said Juvenile Court in Camden County, Georgia on the 29th day of September, 2020. The petition alleges that the above-named children are dependent children and that it would be in the children’s best interest that the parents’ parental rights be terminated. A copy of the petition may be obtained from the Clerk of Camden County Juvenile Court. The children are currently in the temporary custody of the Camden County Department of Family and Children Services. THEREFORE, YOU ARE COMMANDED AND REQUIRED to appear before the Juvenile Court of Camden County, Woodbine, Georgia on the 22d day of December, 2020 at 9:00 o’clock a.m. The effect of the termination order requested shall be to terminate the parental rights and obligations of the parents with respect to the above-named children, including rights of inheritance. READ CAREFULLY NOTICE OF EFFECT OF TERMINATION JUDGMENT Georgia law provides that you can permanently lose your rights as a parent. A petition to terminate parental rights has been filed requesting the court to terminate your parental rights to your child. A copy of the petition to terminate parental rights is attached to this

notice. A court hearing of your case has been scheduled for the 22d day of December, 2020 at 9:30 a.m. at the Juvenile Court of Camden County. If you fail to appear, the court can terminate your parental rights in your absence. If the court at the trial finds that the facts set out in the petition to terminate parental rights are true and that termination of your rights will serve the best interests of your child, the court can enter a judgment ending your rights to your child. If the judgment terminates your parental rights, you will no longer have any rights to your child. This means that you will not have the right to visit, contact, or have custody of your child or make any decisions affecting your child or your child’s earnings or property. Your child will be legally freed to be adopted by someone else. Even if your parental rights are terminated: (1) You will be responsible for providing financial support (child support payments) for your child’s care unless and until your child is adopted; and (2) Your child can still inherit from you unless and until your child is adopted. This is a very serious matter. You should contact an attorney immediately so that you can be prepared for the court hearing.
