The Jacksonville-based developer will renovate the Promenade Shopping Center and sell some acreage for apartments.

Jacksonville Mayor Lenny Curry proposes a $1.34 billion fiscal year 2020-21 general fund budget with no tax increases and an emphasis on infrastructure projects for Northwest Jacksonville and sea level rise resiliency. Curry offered a plan with a 5.6% increase in spending over the $1.267 billion budget approved in 2019, despite tax impacts by COVID-19. The mayor told members of City Council during his annual budget address July 15 that spending and projects in a proposed $239 million capital improvement program were drafted through the lens of the global pandemic’s impact. “We need to recognize what a difference a year can make,” Curry said. “When I presented a budget to you last year, every projection indicated we would continue to have record levels of economic growth ahead of us. Now, with the impact of COVID-19, we face a different set of challenges and opportunities.” Curry administration officials offset a $14.408 million, or 7.9%,

BUDGET HIGHLIGHTS

$1.34 billion budget a 5.6% increase Jacksonville Mayor Lenny Curry’s proposed $1.34 billion fiscal year 2020-21 budget is a 5.6% increase in spending over the $1.267 billion budget approved in 2019. The city expects a $14.408 million, or 7.9%, drop in shared state sales tax from 2019, largely due to the impact of COVID-19. After the mayor’s budget address, City Council member Aaron Bowman said “ad valorem (tax revenue) is what saved us this

year,” after the budget documents indicate a $50.66 million increase in ad valorem property tax revenue for 2020-21. Curry’s budget asks the Council to authorize $176 million in debt to pay for the proposed $239 million capital improvement program. The budget states $29.7 million will be funded by “pay-go,” or cash on hand, and the remaining $33.3 million would come from city funds and sources.

$100 million Northwest Jacksonville projects The budget calls for $100 million in proposed multiyear infrastructure projects targeting Council districts 7, 8, 9 and 10 in Northwest Jacksonville. Curry called the infrastructure investment during his July

15 speech an effort to close historical racial inequities demanded during recent protests and work toward the “unfulfilled promises” of consolidation in Duval County.

$47 million for hydrology and resiliency Curry’s budget offers $47 million in hydrology and resiliency projects, as the Council Special Committee on Resiliency works toward establishing policies to

mitigate the impacts of sea level rise on city infrastructure, private development and the St. Johns River and its tributaries.

Hakimian Holdings Inc. intends to start upgrading the Promenade Shopping Center in the fourth quarter for full conversion into the Gates of the Promenade, add more retail space and sell some of the property for apartments. Jacksonville-based Hakimian Holdings estimates those projects represent a $36 million investment at the almost 3 0 - ye a r - o l d property at 8595 Beach Blvd., west of Southside Hakimian Boulevard. Hakimian Holdings intends to invest $2 million to upgrade the 115,835-square-foot center and $3 million to build about 20,000 square feet of additional speculative retail space, according to Blake Hakimian, Hakimian senior vice president of leasing. Hakimian Holdings intends to sell 11 acres to a developer for an estimated $31 million project of 240 high-end apartments. Hakimian said the apartment site will become the residential component of the mixed-use development. “We intend to transform the Southside – Beach Blvd. corridor into a beautiful and convenient place for families to live, play, and shop,” Hakimian said by email. RESTAURANT NOTES Sugarfire to Atlantic: The city is reviewing a permit application for Sugarfire Smoke House to replace kitchen equipment in the former Panera Bread location at 12959 Atlantic Blvd. at a cost of $150,000. The permit includes other interior work, including painting and refurbishing dining areas and the serving line in the 4,560-square-foot space. Wareh Contracting Corp. of Jacksonville is the contractor. The barbecue chain is based in St. Louis. Shy Patel, one of four members of the franchise ownership group, said April 3 the state’s first Sugarfire Smoke House could open within three months of permitting. The city also is reviewing a permit for minor interior demolition to remove the servery counter, booth and other seating, carpet tiles and other items.

Culver’s to Collins Town Center: Harmony Farms of Jacksonville L.L.C. sold 1.04 acres at 7923 Parramore Road to GPZ Solutions LLC for $1.055 milllion. GPZ Solutions is led by Petar Stamov, the franchisee for the proposed 3,546-square-foot Culver’s restaurant at the site in Collins Town Center in southwest Jacksonville. The sale was executed June 25. The city issued a permit April 27 at a construction cost of $1.45 million. Another Broken Egg Cafe to Atlantic North: The city is reviewing a permit for Advanced Building Specialties of Mississippi to build-out 3,300 square feet of space at 11949 Atlantic Blvd. in Atlantic North at a cost of $459,000 for the Another Broken Egg Cafe. The name — Another Broken Egg Cafe — was the identity the chain took when it opened its second restaurant and began to expand. The Broken Egg Cafe opened in 1996 in Old

Mandeville, Louisiana. The Another Broken Egg Cafe opened in 1998 in Destin. Subsequent restaurants and franchises kept that name. Damaged Bono’s in Town Center: The city is reviewing a permit for Realco Recycling Co. Inc. to demolish the fire-damaged Bono’s Pit Bar-B-Q restaurant at 10065 Skinner Lake Drive at a cost of $10,000. Bono’s Pit BarB-Q was damaged in a fire in March.

RETAIL NOTES Atlantic North fill-in shops: The city is reviewing plans to add more than 68,000 square feet of infill retail development in the Atlantic North shopping center at 11901 Atlantic Blvd. at northwest Kernan and Atlantic boulevards. A site plan shows two “future build areas,” with 22,000- and 25,000-square-foot stores between Belk and Earth Fare and five spaces between Academy and LA Fitness.

TRADEPORT

RM Domus of Miami filed civil plans with the city July 8 for a 45,434-square-foot warehouse on 3.91 acres at Vantage Way South and International Airport Boulevard. Of those five, the largest are 19,000, 10,000 and 8,500 square feet. Sleiman Enterprises is the developer. No tenants were identified. President Toney Sleiman said previously that he is working with Best Buy, but did not confirm it would be in Atlantic North. NorthPoint Village: England-Thims & Miller Inc. filed civil engineering plans with the city for the Northpoint Village Shopping Center at northeast New Berlin and Yellow Bluff roads in North Jacksonville. It will be anchored by a 48,387-square-foot Publix Super Markets Inc. store. Plans show more than 66,000 square feet of space, some on each side of the Publix, along with five outparcels of 0.89 to 1.53 acres on about 16.5 acres. International Management Co. LLC announced in a news release April 22 that it signed a lease with Publix to anchor the center. IMC expects to complete it in summer 2022.

Estate filed civil plans with the city July 7 for the proposed 314,900-square-foot Building 7 at 3397 Port Jacksonville Parkway in Pattillo’s NorthPoint Industrial Park. Development is estimated at $16 million. Pattillo Vice President Peter Anderson said the company is permitting for speculative construction. There are no prospects at this time. Pattillo hopes to start construction by year-end pending leasing over the next three months at existing structures. Plans show parking for trucks on two sides of the proposed distribution warehouse. Houston Engineering Inc. of Conyers, Georgia, is the civil engineer. NorthPoint Industrial Park is east of Interstate 95 and between Faye, Alta and New Berlin roads in North Jacksonville.

THE BASCH REPORT

Second-quarter earnings hard to assess sion filing, Wainscott is not replacing Carter. The filing said Wainscott’s appointment resulted from a search started months ago to replace another unnamed director who is contemplating retirement before next year’s annual shareholders meeting. CSX still is searching for a replacement for Carter on its 11-member board, it said.

CoreLogic rejects Cannae-led $7 billion offer

Economist tells NAIOP that the metrics are “turned upside down.” Second-quarter earnings reports begin coming in this week from major corporations, and it will be more difficult than ever to interpret the numbers. “Q2 will be the first full quarter we have the COVID virus with us,” K.C. Conway, chief economist for the CCIM Institute said last week. Businesses started feeling the full impact of the pandemic in the last half of March, which for most companies was only the last two weeks of the first quarter. The second-quarter numbers obviously will be affected more by the pandemic. But it might be tough to assess what the data tells us, Conway said during a webinar for the NAIOP Commercial Real Estate Development Association Northeast Florida Chapter. “All the metrics we have been using our whole career have all been turned upside down,” he said. As an example, he pointed to the big increase in jobs nationally in June as people came back to work after pandemicrelated business closures. “The June jobs report was the best number we had since God created the world,” Conway said. Yet, new claims for unemployment insurance were still at more than 1.5 million per week last month. “These numbers don’t make any sense,” he said. Some people are hoping for a “V-shaped” recovery, with the economic numbers shooting back up after falling sharply a couple of months ago. Conway expects it to be more choppy. “I’m in the camp we’re going to be in a ‘W’ recession, not a

‘V,’ ” he said.” Conway’s presentation was supposed to be made to a NAIOP-CCIM quarterly luncheon, but it was changed to an internet presentation because of the pandemic.

Worst quarter in 12 years expected for the S&P 500

First-quarter earnings among S&P 500 companies fell 12.8%, according to data firm Refinitiv’s Institutional Brokers Estimate System, and the second quarter is expected to be much worse. Refinitiv said the estimates project S&P 500 earnings to drop by 44.2% from the second quarter of 2019, which would be the worst performance since earnings fell by 67% in the fourth quarter of 2008. The firm said revenue is projected to fall by 11.4%, after falling by 1.4% in the first quarter. As the 2007-08 recession ended, S&P 500 companies rebounded sharply. Fourthquarter 2009 earnings tripled from the low levels a year earlier, according to Refinitiv. The firm said earnings are expected to pick up again from the current recession in 2021, with second-quarter 2021 profits expected to rise by 71.2%.

CSX, Landstar report next week Earnings season for Jacksonville-based companies kicks off next week when CSX Corp. and Landstar System Inc. report their second-quarter numbers after the market closes July 22.

In a preview on transportation company earnings last week, Morgan Stanley analyst Ravi Shanker projected CSX’s revenue to be down about 26% for the quarter. That obviously will hurt earnings for the railroad company. “While cost actions have been significant, we do not see them fully offsetting the revenue declines,” Shanker wrote in his report. He projects trucking company Landstar’s revenue to be down by nearly 30% and said its exposure to “cyclical flatbed markets” could hurt its earnings. Like Conway, Shanker said it may be difficult to analyze the companies’ performance because of the pandemic. “Given the extreme macro disruption we saw in 2Q with COVID-related shutdowns, it is clear that this could be the worst earnings quarter in years, if not decades,” he said. “We will bring our noise cancelling headphones and hope we can hear anything at all.”

CSX adds retired CEO to its board CSX last week said James Wainscott, retired CEO of AK Steel Holding Corp., was appointed to its board of directors. Pamela Carter retired as a director in May after Wainscott 10 years on the board but according to a Securities and Exchange Commis-

CoreLogic Inc.’s board of directors last week rejected an unsolicited $7 billion buyout offer from Cannae Holdings Inc. and Senator Investment Group. The housing market data firm’s board of directors evaluated the offer and determined it “undervalues the Company, raises serious regulatory concerns, and is not in the best interests of its shareholders,” CoreLogic said in a news release. The proposal “fails to address the serious regulatory concerns raised by significant overlaps between CoreLogic and the network of companies associated with Cannae’s Chairman, including Black Knight and Fidelity National,” CoreLogic board Chairman Paul Folino said in a news release. Cannae Chairman Bill Foley also is chairman of Jacksonville-based title insurance company Fidelity National Financial Inc. and mortgage technology firm Black Knight Inc. Investment company Cannae and Black Knight both were spun off from Fidelity. After their offer was rejected, Cannae and Senator issued a news release saying CoreLogic’s board has rejected requests for a meeting to discuss it. “If CoreLogic elects to ignore its shareholders and instead continues with its current course of action, we will call a Special Meeting to replace the Board as early as July 28th,” they said. “As for ‘regulatory’ concerns and ‘business overlaps’, we thoroughly reviewed all potential regulatory and antitrust matters prior to making our proposal and determined that there are no material hurdles to our consummating a transaction,” the two firms said.

Cannae and Senator offered to buy CoreLogic for $65 a share, with the stock trading at $52.93 before the offer was announced June 26. The stock has continued to trade above $65 since the offer was announced, indicating Wall Street anticipates a higher offer from Cannae and Senator or another bidder.

Stein Mart sets annual meeting Stein Mart Inc. last week filed a proxy statement to hold its annual shareholders meeting Sept. 1. The Jacksonville-based fashion retailer normally holds its annual meeting in June but because of the COVID-19 pandemic, it filed its annual report and proxy statement later than usual. Stein Mart is planning to hold the meeting in its Jacksonville headquarters office. Most companies who held annual meetings in the spring turned to online virtual meetings instead because of COVID-19 concerns, but Stein Mart is hoping to be able to host an in-person meeting. Stein Mart in January agreed to a buyout by affiliates of Kingswood Capital Management L.P. and had filed a proxy for a special shareholders meeting to vote on the deal. But with the uncertainty of the pandemic, the buyout deal was terminated in April.

Former mCig merges with Bitcoin firm Bots Inc., formerly known as mCig Inc., said July 13 it acquired the majority of the assets of digital currency firm First Bitcoin Capital Corp. After an exchange of stock, First Bitcoin became the largest shareholder of Bots. Bots was based in Jacksonville and was focused on cannabis products, but now it describes itself as a blockchain solutions and robotics company. In addition to changing its name, the company moved its headquarters to San Juan, Puerto Rico. Bots last week began trading under a new ticker symbol, “BTZI.” It previously traded under “MCIG.” MBASCH@ JAXDAILYRECORD.COM

Hakimian Holdings Inc. intends to invest $5 million into the Promenade Shopping Center it bought in October by upgrading and expanding it as the Gates of the Promenade.

“We are long-term holders of our properties and we’re inspired by the opportunity to be a part of the enormous growth story that is Jacksonville, Florida,” he said. Hakimian said the upgrades and addition to the center will start in the fourth quarter for completion in the third quarter of 2021. No contractor has been announced, he said. He anticipates the apartment development will be completed in two years. The retail space will be added on the west end of the site at Beach and Grove Park boulevards. The apartments are planned on undeveloped land behind the retail center to the north. Through Gates of The Promenade LLC, Hakimian paid $11.95 million Oct.15 to buy the center from Phillip Edison & Co. Inc., a Cincinnati-based real estate investment trust.

The purchase boosted Hakimian’s retail space owned to more than 1 million square feet. It was the company’s 26th purchase and its largest retail acquisition to date. Hakimian said in October that it will upgrade the façade, lift the tree canopy, improve the parking lot and reposition the tenant mix to focus on more servicedriven businesses. The Promenade is anchored by Rowe’s IGA Supermarkets, Planet Fitness and the Armed Forces Career Center. The Promenade was built in 1991, property records show. Hakimian said the shopping center remains at 94% occupancy, the same “as when we bought it, but we have had a lot of interest since we enhanced lighting and the landscaping. “After the modernization of the shopping center, we plan to attract national brands that are favorites of the community and are family-friendly,” he said. Jacksonville Mayor Lenny Curry delivers his annual budget address to City Council on July 15. The speech was virtual because of the COVID-19 pandemic.

drop in shared state sales tax from 2019, because of the impact of COVID-19, with a $50.66 million increase in ad valorem property tax revenue and $35 million more in borrowed money, according to a revenue breakdown in the budget. The drop in sales tax was not as high as the $30 million estimated drop Curry’s CFO Patrick “Joey” Grieve told Council to expect during a Finance Committee meeting in April. The CIP includes $100 million in infrastructure spending targeting Council districts 7, 8, 9 and 10 in Northwest Jacksonville, which Curry said is an effort to help close historical racial inequities demanded by protesters in late May and early June. “I’ve also heard the righteous demands from our community to address social justice and the economic disparities in our community,” Curry said. “That includes infrastructure promises made long ago when our city was consolidated that have yet to be fully realized.” The 2020-21 CIP includes 121 projects, according to budget documents, with $47 million in spending on hydrology and resiliency infrastructure. Curry said the money spent on drainage and smaller waterway improvements will complement the Council Special Committee on Resiliency’s work toward establishing long-term policies to mitigate the impacts of sea level rise on city infrastructure, private development and the St. Johns River and its tributaries.

Under the 2020-21 budget proposal, the city’s millage rate would stay flat at $11.4419 per every $1,000 of taxable property value. The Council could change that as it reviews and amends the spending plan during August budget hearings. After Curry’s speech, Council Finance Committee Chair Matt Carlucci and Council President Tommy Hazouri left open the possibility of a property tax increase, which Carlucci said could allow individual Council members to add funding for their own budget priorities. “If we keep it like it is, we’re going to have to work within the budget that’s been passed to us by the mayor, and that very well may be the case. But if we want a little cushion, then there might be an increase in the millage that would give us the wiggle room to refine some of that,” Carlucci said. The Council has a July 28 deadline to set the rate. City Chief Administrative Officer Brian Hughes told Council members that the mayor would not automatically veto a budget approved with a millage increase. “I’ll say it this way: The mayor charged me with a balanced budget with no tax or fee increases. If the Council proceeds and makes a case … I suppose he’d consider it. I’ve not had that conversation,” Hughes said. Council members Al Ferraro and Rory Diamond said they likely would not vote in favor of a budget that includes a tax increase. MMENDENHALL@ JAXDAILYRECORD.COM @MIMENDENHALL (904) 356-2466

THE MARBUT REPORT

Candidates for clerk of courts on Aug. 18 ballot Jackson

MAX MARBUT ASSOCIATE EDITOR

The Republican primary election and two Duval County judicial seats will be decided by voters. If you’re not registered to vote, you have until July 20 to do so and then be able to cast a ballot in the Aug. 18 primary election. One constitutional office, contested by three Republicans, along with two seats on the nonpartisan Duval County Court will be on the ballot. There will be a new Duval County clerk of the circuit and county courts in January because incumbent Ronnie Fussell is term-limited after two four-year terms. There are three Republican candidates in the primary election, each with experience working in the clerk’s office. Leon Jackson began his career in the clerk’s office at age 18 as a part-time helper. He later was promoted to manager and in 2018, to senior manager.

Phillips

Jody Phillips, the current clerk’s office chief operating officer, is a former highway construction executive who has been with the office for nine years. Scott Wilson is in his second term on City Council and was its 2019-20 president. Wilson went to work in the clerk’s office in 1994 as a court record clerk. Wilson He left in 2007 as court operations supervisor, the highest-ranking civil service position in the office, to become the executive assistant for Council member Don Redman, succeeded in 2015 by Wilson. The candidate receiving the most votes will be on the ballot with Democratic Party clerk candidate and civil rights attorney Jimmy Midyette in the Nov. 3 general election. In the nonpartisan judicial elections, incumbent Duval County Judge Erin Perry will face attorney Rhonda PeoplesWaters. A former assistant state attorney, Perry was appointed

to the bench in January 2019. Peoples-Waters, a private practice attorney, also was a candidate for Duval County judge in 2012. The other judicial contest includes Duval County Judge Scott Mitchell, who was appointed to the bench in 2012 and reelected unopposed in 2014. He’s being challenged by Isaac East, an attorney, mediator and arbitrator and owner of East Law of Florida. Visit duvalelections.com to register to vote or for a sample ballot.

Attorneys call for removal of Baker courthouse mural

The Florida Association of Criminal Defense Lawyers is calling for the removal of the mural in the lobby of the Baker County Courthouse in Macclenny because it depicts horseback riders in Ku Klux Klan robes. “We call upon the chief judge of the Eighth Judicial Circuit to immediately order removal of this shocking and offensive depiction of the worst part of American history,” the association said in a statement July 9. “The Chief Judge should act immediately to rectify this situation,” it said. Jacksonville attorney Mitch Stone, founder of Mitchell A. Stone P.A., is president of the association. “We consulted our mem-

bers and agreed across the board that we don’t believe it’s appropriate for that mural to exist in a courthouse,” Stone said. “When they walk into a courthouse, people need to know they’ll be treated fairly with equal justice. That’s not what the KKK did. It existed to remove power from people who had just been freed. That’s the antithesis of justice,” he said. The association advocates for removal of the mural and its placement at another site, such as in a museum. “We don’t want to erase history. We need to remember people who have done terrible things, but that’s not a part of history you need to show in a courthouse,” Stone said.

Judicial Nominating Commission is seeking applicants The Florida Bar is seeking applicants for the state Supreme Court Judicial Nominating Commission. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means the District’s final action may be different from the position taken by it in this notice. Failure to file a petition for an administrative hearing within the requisite time frame shall constitute a waiver of the right to an administrative hearing. (Rule 28-106.111, F.A.C.). If you wish to do so, please visit http://www.sjrwmd.com/nor_dec/ to read the complete Notice of Rights to determine any legal rights you may have concerning the District’s decision(s) on the permit application(s) described above.
