egotiators for Jacksonville Jaguars owner Shad Khan and the city have not drafted a final deal for his $450 million to $500 million Lot J development, but team leadership already is looking ahead to a possible Phase II. Jaguars President Mark Lamping outlined the Phase II concept during an interview Jan. 21 to include two high-rise towers and a connecting parking garage that he said could be nearly $200 million on top of the investment in the first phase. “Our hope was that Lot J would be a catalyst for other development. In fact, we’re already talking about the next phase of Lot J which would bring the total to around $700 million,” Lamping said. One tower would be residential and the

Jaguars President Mark Lamping said Phase II of the Lot J development would include two high-rise towers and a parking garage. It would rise on the site of the parking area shown on a map, below, of the Lot J development from the State of the Jaguars presentation in April. A naming rights agreement between Jacksonville Jumbo Shrimp and 121 Financial Credit Union could rename the Baseball Grounds of Jacksonville as 121 Financial Ballpark. Jumbo Shrimp owner Ken Babby announced the 13-year agreement at a news conference Jan. 22 in the ballpark clubhouse with 121 Financial Credit Union interim CEO David Marovich and Mayor Lenny Curry. Babby and Marovich would not disclose the value of the agreement. Another 15-year naming rights agreement for the city-owned VyStar Veterans Memorial Arena directly west of the baseball grounds was secured in February 2019 for $9.76 million with VyStar Credit Union. The Baseball Grounds is owned by the city and the naming rights deal must cleared by City Council. CSX Corp.’s revenue fell in 2019 as economic growth cooled, and the Jacksonville-based railroad isn’t expecting a recovery early in 2020. “We expect underlying economic demand to remain relatively consistent with current levels,” CEO Jim Foote said Jan. 16 in the company’s quarterly conference call with analysts. “It took industrial activity a while to cool off and it will take a while to heat back up,” he said. CSX reported fourth-quarter earn-

ings of 99 cents a share, 2 cents lower than the fourth quarter of 2018. Revenue dropped 8% to $2.885 billion. The company projected lower revenue, but the results still were below the $2.918 billion consensus forecast from analysts surveyed by Zacks Investment Research. The company is projecting this year’s revenue will be flat to possibly 2% lower than 2019 revenue of $11.937 billion.

Rayonier ‘logical acquirer’ of Pope Resources

The headquarters of Rayonier in Wildlight in Yulee.

After announcing a deal last week to buy Pope Resources, Rayonier Inc. CEO David Nunes said his company is the “logical acquirer” of the Northwest timber company. “Based on my knowledge of Pope Resources where I spent 17 years, the final 12 of which serving as the CEO, I believe this is a great fit for both companies,” Nunes said in a conference call with analysts. Nunes was recruited from Pope in 2014 to run Rayonier when the timber and real estate development company split with performance fibers firm Rayonier Advanced Materials Inc. into separate public companies. “Our cultures are very compatible and knowing many of the people from both organizations, I believe that there are areas of expertise within each company where we can learn from each other and make the union of our two companies greater than the sum of its parts,” he said. Rayonier, headquartered in Wildlight in Nassau County, owns or manages 2.6 million acres of timberland in the Southeast and Northwest U.S. and in New Zealand. Poulsbo, Washington-based Pope adds 141,000 acres of timber in the Northwest to Rayonier’s portfolio. Rayonier agreed to buy Pope, a publicly traded limited partnership, for $554 million in cash and stock. Pope unit-holders can choose to take cash or Rayonier securities, with the companies expecting 30% to choose the cash option. Nunes said the structure of the deal allows Rayonier to maintain its investment grade

credit rating. Ratings agency Moody’s Investors Services said in a news release the deal is actually “credit positive for Rayonier because Pope’s mature, highquality timberland will slightly increase Rayonier’s scale (acreage increases 5%) and diversify Rayonier’s business with high quality Douglas fir logs that can be sold to various markets.” Pope is a historic company in the Northwest that announced last year it was looking Nunes for possible buyers. “At the risk of oversimplifying the situation, the history of the Pacific Northwest is largely intertwined with the history of Pope Resources and its predecessor firm Pope & Talbot, which was literally established to supply timbers to the California Gold Rush in 1849,” D.A. Davidson analyst Steven Chercover said in a research report. “More recently, some Pope unit-holders have agitated for change, which prompted management to formally explore strategic options in November of 2019,” he said. Chercover thinks the deal is a “win-win” for both companies. “We believe the deeper the Street digs into the Pope deal, the more they will appreciate it, and we are therefore sticking with our Buy recommendation” on Rayonier’s stock, he said. Vertical Research Partners analyst Chip Dillon is more

cautious, maintaining a “hold” rating on Rayonier. “While this is not a home run given the full price paid, we see the transaction marginally positive based on (1) its strategic fit within Rayonier’s portfolio and (2) the modest expected per-share earnings accretion,” Dillon said in his report on the deal.

Hedge fund to wage proxy fight against Tegna A hedge fund disappointed that Tegna Inc. did not pursue a buyout offer last year is launching a proxy fight against the television station owner. Standard General L.P. last week said it is nominating Managing Partner Soohyung Kim and three other representatives for election to Tegna’s 11-member board. Standard General said it owns about 9.7% of Tegna’s stock. Tegna owns 62 television stations, including NBC affiliate WTLV TV-12 and ABC affiliate WJXX TV-25 in Jacksonville. In a letter to Tegna shareholders last week, Kim said Tegna’s shares have underperformed the market and the company’s management and board refused his request for board representation. “In our view this refusal reflects a continued pattern of passivity by the Tegna board in the face of persistent underperformance, a questionable M&A strategy, excessive leverage and, recently, the apparent rebuff of an acquisition proposal at a premium valuation from a credible buyer,”

Regency Centers upgraded to ‘buy’ As Wall Street continues to assess the impact of retailer bankruptcies on shopping center operators like Jacksonvillebased Regency Centers Corp., one analyst upgraded her rating on the stock last week. Jefferies analyst Linda Tsai upgraded Regency and Federal Realty Investment Trust from “hold” to “buy” as part of an overall look at the industry. “Following consecutive years of stock under performance, blue chips FRT & Regency continue to generate solid cashflow and raise dividends sustainably; both are inexpensive relative to history,” Tsai wrote in her report. “While 2020 is a transition year with lower NOI contribution from redevelopments and store closures, these companies have already guided 2020 preliminarily, limiting risk,” she wrote. Regency has said it expects growth of net operating income, or NOI, to be slow this year. This year began with management changes as Lisa Palmer took over as CEO, succeeding Hap Stein, who became executive chairman. Mike Mas was promoted to

Black Knight downgraded after big market runup

After a big runup in Black Knight Inc.’s stock, Susquehanna Financial Group analyst Jack Micenko last week downgraded the Jacksonville-based mortgage technology company from “positive” to “neutral.” “Black Knight shares are up about 47% since our initiation of coverage in November 2018 (vs. 20% for the S&P 500 over the same time period) and now just a ‘gimme putt’ from our $67 fair value price target,” Micenko said in a research note. Black Knight is a “very high quality business” with a “near monopoly” in its business of providing mortgage processing software, he said. But he doesn’t see big gains coming in earnings or revenue. “While there are several longer term catalysts that remain, we think it is unlikely they impact 2020 guidance in a meaningful way,” Micenko said.

Analyst upgrades Landstar System

Before Landstar System Inc. reports its year-end earnings next week, Susquehanna analyst Bascome Majors upgraded the Jacksonville-based trucking company from “neutral” to “positive.” Majors upgraded Landstar and several other trucking companies that use networks of brokers to arrange freight transport, saying he expects a favorable environment this year for the rates they charge. “With the economy and truckload volumes growing, supply expected to shrink, and seasonal-plus patterns returning to volatile real-time rates, we see the risk of a ‘melt-up’ in spot rates in 2020 as far greater than a meltdown,” Majors said in his report.

Kim said. “As a result, we are compelled to take the step of nominating our own candidates for election to the Tegna board,” he said. The acquisition offer came from Apollo Global Management Inc. Apollo already was acquiring a group of 14 television stations and 54 radio stations from Cox Enterprises Inc. That deal, completed in December, included six Jacksonville radio stations and Fox network affiliate WFOX TV-30. Apollo also took over management of CBS affiliate WJAX TV-47, which operates with WFOX under a shared services agreement Tegna responded to Kim’s letter with a statement saying it is “patently false” to say the company “stonewalled” Kim. “Mr. Kim has not suggested any transactions to us, and our Board and management team have a track record that demonstrates their openness to all paths to create value for all of Tegna’s shareholders,” the company said.

Beeline relocating HQ within Flagler Center

Software company is building out 32,000 square feet of space at a cost of $1.84 million. Jacksonville-based Beeline. com, which develops staffing software, is relocating its headquarters in Flagler Center from 12724 Gran Bay Parkway W. to 12735 Gran Bay Parkway W. next door. Beeline has 195 employees and anticipates growth, said Jessica Ashcraft, head of marketing. Ashcraft said Beeline will occupy the office in April. The relocation into a modern space “will further enable our mission.” “As a Jacksonville-based technology company for more than 20 years, we’ve been helping large enterprises all over the world find the best talent for their workforce,” Ashcraft said. Beeline will move from 29,000 square feet into 32,000 square feet, she said. It will move into space vacated years ago by Bombardier Capital Inc. and joins other tenants in the almost 110,000-square-foot, single-story building that includes the Firehouse Subs headquarters and Siemens Corp. described as 60 to 300 pounds. Rick Wilson & Associates Inc. of Altamonte Springs is the contractor for the $1.4 million renovation of 11,520 square feet of space. Plans show the project “consists of an online retailer moving into an existing space with no change of use or occupancy.” “Operations consist of workers off-loading from larger trucks and loading onto smaller box trucks,” plans say. HJX1 appears to be a location identifier for Jacksonville. Records show the city has issued four permits since Dec. 3 for Amazon at the building for electrical, plumbing and mechanical work totaling $120,500. The Lloyd Road truck terminal has 33 dock-high loading posi-

tions. The site fronts Interstate 295. Records show Ringsby Terminals Inc. of Denver owns the property. Amazon operates four centers in Jacksonville and submitted plans Dec. 11 for a fifth. That would be an e-commerce delivery center in the former Kmart at 4645 Blanding Blvd. in Westside. The 107,000-square-foot discount department store closed seven years ago. Plans show 111,718 square feet total of nonresidential floor area for the Amazon project. The online retailer employs thousands of workers in Jacksonville.

other would be corporate office space, according to Lamping. The three structures would sit at the site of the retention pond on the west end of Lot J near TIAA Bank Field. Phase II was not part of the Lot J announcement during the Jaguars’ State of the Franchise event in April. A site plan displayed in Lamping’s presentation shows a surface parking lot at the site of the retention pond. The city released a term sheet July 31 detailing Lot J’s proposed citybacked incentive package that planned Lamping for a surface lot with 700 parking spaces. Lamping said Phase II and its additional capital investment in the Sports Complex would likely bring a second round of talks with the city for incentives separate from the Lot J proposal that is being negotiated. He said Jan. 21 that Khan’s negotiators have not discussed with the city a public contribution for a second phase. “We need to sit down with the city and determine what would be the appropriate level of participation from the city for that particular part of the development,” he said. “I certainly would expect that if there was another $200 million of development, that there would be a discussion with the city, and it would be for the city to determine whether

they believe that they should participate or not.” The proposed first phase of Lot J comprises a 300-unit residential tower, 200-room hotel, 120,000-square-foot Class A office tower and a Live! Entertainment District. Jacksonville I-C Parcel One Holding Company LLC, a joint venture of Jaguars subsidiary Gecko Investments LLC and the Baltimore, Maryland-based The Cordish Companies, is the project developer. The Jaguars have not announced tenants or operators at Lot J, but Lamping said interest has come from local, regional and national companies. CITY FINANCING ‘CLOSER’

Lamping said city and Jaguars negotiators are “closer than they’ve been” on reaching a deal for city financing. Mayor Lenny Curry’s administration has proposed $233.3 million in total investment for the city. That includes $208 million toward the development cost for the Live! Entertainment District, infrastructure improvements and a development grant. The deal also would offer a $25 million Recaptured Enhanced Value grant, which is a partial property tax rebate. Lamping calls the terms released in July an initial framework for a final deal. The development agreement with the city must be approved by the Downtown Investment Authority and City Council. Lamping said he has not had substantive discussions with any Council member about the Lot J incentive proposal. “I occasionally run into members of the City Council, princi-

pally around the Jaguars games, and the topic of discussion usually finds its way toward what’s happening with Lot J. And every response I’ve heard from members of City Council is that they’re very interested in seeing the details,” Lamping said. ENVIRONMENTAL TESTING AND RESILIENCE

Lamping said the Jaguars and its developers have spent more than $1 million on Lot J as of Jan. 21 for project planning and environmental testing. Project planners will take into account storm surge resilience when designing Lot J structures and the site plan, Lamping said.

Developers also have been reviewing St. Johns River water level reports and measures like analyzing the elevation of the Lot J site and placement of building mechanical systems, he said. The DIA granted Jacksonville I-C Parcel One a 60-day limited license in October to access the city-owned property for environmental testing. Lamping said preliminary reports on the subsurface conditions and possible soil contamination are complete. Lamping said Nov. 15 that developers expected to find a slurry wall — a reinforced concrete wall used to stabilize soft earth near high water tables — and gantries buried at the site.

A public records request for those preliminary reports was not completed by Jan. 22. Lamping said it’s not clear how environmental remediation will impact Lot J’s development cost, but he believes the environmental work can be dealt with “very effectively.” “We’re comfortable that we can deal with all the necessary remediation within the structure of the agreement between ourselves and the city,” Lamping said. April 1 allows the team to keep the revenue from the naming rights agreement with Council’s approval. The legislation does not state the amount of money the Jumbo Shrimp will gain from the deal. In an interview after the announcement, Curry said the revenue from the deal would be used at the ballpark. “These naming rights will allow dollars to come in that will be reinvested back into the facility to make sure it is not only maintained, but continues to be enhanced,” Curry said. Babby’s company, Fast Forwards Sports Group LLC, says it has invested nearly $3 million in the stadium since buying the team in September 2015. Babby said revenue from the naming rights agreement will help keep ticket and concession prices affordable and the proceeds will be invested in the facility and team. No projects were announced Jan. 22. The agreement expires in 2033 and coincides with the end of the team’s lease agreement with the city. Babby said the Jumbo Shrimp intends to pursue a stadium lease renewal. Babby and Marovich said they hope to see an extension of the naming rights agreement. “We have no intention of going anywhere. We’re here to stay,” Babby said after the announcement. “This partnership is very indicative of that and as soon as we have the

Babby said the Jumbo Shrimp will present a signage plan to the Downtown Development Review Board for approval concurrently with the agreement’s Council legislation. “We’ll follow the blueprint set by the arena across the street that went through this process earlier last year,” Babby said. “We’ve been fortunate to have a great partnership with the (Jacksonville) Jaguars and share our plans and ideas with them. As I’ve joked, it’s a good place to be in the neighborhood.” He hopes to have the naming rights and ballpark branding ready for opening day April 15.

Babby said talks between the Jumbo Shrimp and 121 Financial began in July or August and the deal was finalized Dec. 31. The Jacksonville-based credit union has been a marketing partner with the baseball club for several years, before former Jacksonville Suns team owner Peter “Pedro” Bragan Jr. sold the team to Fast Forward Sports. Babby said Jan. 22 that he contacted the Bragan family before the announcement. The agreement, Babby said, will ensure 2012 Council legislation that named the playing surface Bragan Field remains unchanged. MMENDENHALL@ JAXDAILYRECORD.COM @MIMENDENHALL (904) 356-2466

Myrick sees ‘vibrant future’ for Cathedral District

KATIE GARWOOD STAFF WRITER

Entering her third year in the role, Myrick is seeking a “catalytic project” for the neighborhood. Ginny Myrick was president of her government relations firm when a priest at St. John’s Cathedral, where Myrick has been a member for 35 years, asked for help. Dean Kate Moorehead came to Myrick to discuss how they could revitalize the Cathedral District, the Downtown Jacksonville neighborhood in which their historic church, along with four others, is located. For five years, Myrick, Moorehead and several others, including an architect and city planner, met to discuss ways to turn the neighborhood around. Those meetings culminated with a study by Urban Land Institute North Florida, which gave the group a road map for how to proceed. One of the suggestions was to form a nonprofit, and hire someone to run it. Myrick became that person in January 2018 and is entering her third year as president and CEO of Cathedral District-Jax Inc. “I ultimately left my firm, closed it down and started working on this because the dean said to me ‘this is your calling,’” Myrick said. “When your priest says to you, ‘this is your calling,’ you really pay attention to it.” Since she started in 2018, about $41 million has been invested into the 36-block district bounded by Main, Adams and State streets and the Commodore Point Expressway. There are 303 apartments planned or under construction, and 60 trees will be planted in the first quarter of 2020. Vestcor purchased 1.52 acres in the district for $1.4 million

in September to develop workforce housing. Myrick called that a “catalytic project,” the kind ULI said would be needed to develop the neighborhood. Myrick said she’s looking for the next catalytic project. She wants to see a nonprofit, K-8 charter school in the area, and she’s working on finding one. She said the board of directors also is working on a public art project that would designate the entry points for the neighborhood. Her main focus is creating more housing. Myrick said she thinks it’s possible to turn the district back into a “vibrant neighborhood again.” She’s hopeful that with Shad Khan’s Lot J project, along with efforts to bring more people into Downtown Jacksonville, that can happen. “Back in the 1900s, it was a residential neighborhood for people who worked Downtown,” she said. “That’s our goal, to make it that way again, but there’s no product. No houses for people to live in. If we put the product out there,

we think the people who work Downtown will want to live there.” In December, Cathedral District-Jax hosted its first event: Christmas in the Cathedral District. All five of the neighborhood’s historic churches opened their doors to visitors, vendors sold food, drinks and crafts, and choirs performed Christmas songs. Myrick said about 1,000 people attended and 400 volunteered for the event. “What really happened for the very first time was all five churches met regularly in concert with each other to produce that event,” she said. “So they are invested in the district. They know what’s happening, they know this a good thing for their neighborhood.” Myrick said the nonprofit would put on the event annually after seeing its success. She’s also received requests from someone who wants to host a farmers market in the district, as well as a plant market. In the spring, Myrick said a bicycle race may be held in the

Cathedral District. But putting on events along with running a nonprofit can be difficult, she said. Myrick plans on adding a third full-time staff member in the next few weeks, an administrative assistant to help with the workload. In her time in Jacksonville, Myrick has been a City Council member, event planner, and in government relations and public policy. All that experi-

ence, she said, has prepared her for her position with the Cathedral District. “It’s quite amazing when you think about it, how it all came together at this juncture right now to do this particular project with the Cathedral District,” she said. KGARWOOD@ JAXDAILYRECORD.COM (904) 356-2466

The receiving water body is Unnamed Ditch. A person whose substantial interests are or may be affected has the right to request an administrative hearing by filing a written petition with the St. Johns River Water Management District (District). Pursuant to Chapter 28-106 and Rule 40C-1.1007, Florida Administrative Code (F.A.C.), the petition must be filed (received) either by delivery at the office of the District Clerk at District Headquarters, P.O. Box 1429, Palatka FL 32178-1429 (4049 Reid St, Palatka, FL 32177) or by e-mail with the District Clerk at Clerk@sjrwmd.com, within twenty-one (21) days of newspaper publication of the notice of District decision (for those persons to whom the District does not mail or email actual notice). A petition must comply with Sections 120.54(5)(b)4. and 120.569(2)(c), Florida Statutes (F.S.), and Chapter 28-106, F.A.C. The District will not accept a petition sent by facsimile (fax). Mediation pursuant to Section 120.573, F.S., may be available and choosing mediation does not affect your right to an administrative hearing. The District’s regular business hours are 8 a.m. – 5 p.m., excluding weekends and Dis-

trict holidays. Petitions received by the District Clerk after the District’s regular business hours shall be deemed filed as of 8 a.m. on the District’s next regular business day. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means the District’s final action may be different from the position taken by it in this notice. FIRST INSERTION PUBLIC NOTICE OF INTENT TO ISSUE AIR PERMIT Florida Department of Environmental Protection Northeast District Office Draft/proposed Permit No. 0310179-039-AV Blanchard Terminal Company, LLC, Jacksonville Terminal Duval County, Florida Applicant: The applicant for this project is Blanchard Terminal Company, LLC. The applicant’s responsible official and mailing address are: Ms. Angela Brown, Vice President, Blanchard Terminal Company, LLC, Jacksonville Terminal, 539 South Main Street, Findlay, Ohio 45840. Project: The applicant applied on December 31, 2019 to the Department for a Title V air operation permit revision to incorporate Air Construction No. 0310179-037-AC for the Tank 110 replacement of a welded internal floating roof (IFR) with a bolted IFR. This is a revision of Title V Air Operation Permit No. 0310179-034-AV. The existing facility consists of Petroleum Storage Tanks, Terminala A and B Tank Truck Loading System and Denatured Ethanol Loading System, Petroleum/Denatured Ethanol Storage Tanks, Fixed Roof Petroleum Storage Tanks, Marine Petroleum Loading System, Railcar Tanker Loading System. The terminal receives light petroleum products (i.e., gasoline, diesel fuel, kerosene, and jet fuel) and denatured ethanol. Volatile Organic Compounds (VOC) and Hazardous Air Pollutants (HAP) emissions displaced during tank truck loading operations are captured and routed to a vapor recovery unit (VRU). A vapor combustor unit (VCU) may also be used to control tank truck loading rack vapors. Permitting Authority: Applications for Title V air operation permits are subject to review in accordance with the provisions of Chapter 403, Florida Statutes (F.S.) and Chapters 62-4, 62-210, and 62-213, of the Florida Administrative Code (F.A.C.). The proposed project is not exempt from air permitting requirements and a Title V air operation permit is required to operate the facility. The Northeast District Office is the Permitting Authority responsible for making a permit determination for this project. The Permitting Authority’s physical address is: 8800 Baymeadows Way West, Suite 100, Jacksonville, Florida 32256. The complete project file includes the draft/proposed permit, the Statement of Basis, the application, and the information submitted by the applicant, exclusive of confidential records under Section 403.111, F.S. Interested persons may view the draft permit by visiting the following website: https://fldep.dep.state.fl.us/ air/emission/apds/default.asp and entering the permit number shown above. Interested persons may contact the Permitting Authority’s project review engineer for additional information at the address or phone number listed above. Notice of Intent to Issue Permit: The Permitting Authority gives notice of its intent to issue a revised Title V air operation permit to the applicant for the project described above. The applicant has provided reasonable assurance that continued operation of the existing equipment will not adversely impact air quality and that the project will comply with all appropriate provisions of Chapters 62-4, 62-204, 62-210, 62-212, 62-213, 62-296 and 62-297, F.A.C. The Permitting Authority will issue a subsequent final permit in accordance with the conditions of the draft/ proposed permit unless a response received in accordance with the following procedures results in a different decision or a significant change of terms or conditions. Comments: The Permitting Authority will accept written comments concerning the draft/proposed Title V air operation permit for a period of 30 days from the

date of publication of the Public Notice. Because this permitting project is a revision to the existing Title V air operation permit, the revisions detailed in the Statement of Basis are the only portions of the permit that are open for public comment or challenge. Comments received related to the remainder of the permit will not be addressed during this permitting action. Written comments must be received by the close of business (5:00 p.m.), on or before the end of this 30-day period by the Permitting Authority at the above address. As part of his or her comments, any person may also request that the Permitting Authority hold a public meeting on this permitting action. If the Permitting Authority determines there is sufficient interest for a public meeting, it will publish notice of the time, date, and location in the Florida Administrative Register (FAR). If a public meeting is requested within the 30-day comment period and conducted by the Permitting Authority, any oral and written comments received during the public meeting will also be considered by the Permitting Authority. If timely received written comments or comments received at a public meeting result in a significant change to the draft permit, the Permitting Authority shall issue a revised draft/proposed permit and require, if applicable, another Public Notice. All comments filed will be made available for public inspection. For additional information, contact the Permitting Authority at the above address or phone number. Petitions: A person whose substantial interests are affected by the proposed permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57, F.S. Petitions filed by any persons other than those entitled to written notice under Section 120.60(3), F.S., must be filed within 14 days of publication of the Public Notice or receipt of a written notice, whichever occurs first. Under Section 120.60(3), F.S., however, any person who asked the Permitting Authority for notice of agency action may file a petition within 14 days of receipt of that notice, regardless of the date of publication. A petitioner shall mail a copy of the petition to the applicant at the address indicated above, at the time of filing. A petition for administrative hearing must contain the information set forth below and must be filed (received) with the Agency Clerk in the Office of General Counsel, 3900 Commonwealth Boulevard, MS 35, Tallahassee, Florida 323993000, Agency_Clerk@dep.state. fl.us, before the deadline. The failure of any person to file a petition within the appropriate time period shall constitute a waiver of that person’s right to request an administrative determination (hearing) under Sections 120.569 and 120.57, F.S., or to intervene in this proceeding and participate as a party to it. Any subsequent intervention (in a proceeding initiated by another party) will be only at the approval of the presiding officer upon the filing of a motion in compliance with Rule 28-106.205, F.A.C. A petition that disputes the material facts on which the Permitting Authority’s action is based must contain the following information: (a) The name and address of each agency affected and each agency’s file or identification number, if known; (b) The name, address, any email address, telephone number and any facsimile number of the petitioner; the name, address, any email address, telephone number, and any facsimile number of the petitioner’s representative, if any, which shall be the address for service purposes during the course of the proceeding; and an explanation of how the petitioner’s substantial interests will be affected by the agency determination; (c) A statement of when and how each petitioner received notice of the agency action or proposed decision; (d) A statement of all disputed issues of material fact. If there are none, the petition must so indicate; (e) A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends warrant reversal or modification of the agency’s proposed action; (f) A statement of the specific rules or statutes the petitioner contends require reversal or modification of the agency’s proposed action including an explanation of how the alleged facts relate to the specific rules or statutes; and, (g) A

FIRST INSERTION statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the agency to take with respect to the agency’s proposed action. A petition that does not dispute the material facts upon which the Permitting Authority’s action is based shall state that no such facts are in dispute and otherwise shall contain the same information as set forth above, as required by Rule 28-106.301, F.A.C. Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the Permitting Authority’s final action may be different from the position taken by it in this written notice of Intent to Issue Air Permit. Persons whose substantial interests will be affected by any such final decision of the Permitting Authority on the application have the right to petition to become a party to the proceeding, in accordance with the requirements set forth above. Extension of Time: Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department’s action may also request an extension of time to file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time. Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at Agency_Clerk@ dep.state.fl.us, before the deadline for filing a petition for an administrative hearing. A timely request for extension of time shall toll the running of the time period for filing a petition until the request is acted upon. Mediation: Mediation is not available in this proceeding. EPA Review: EPA has agreed to treat the draft/proposed Title V air operation permit as a proposed Title V air operation permit and to perform its 45-day review provided by the law and regulations concurrently with the public comment period, provided that the applicant also transmits an electronic copy of the required proof of publication directly to EPA at the following email addresses: R4TitleVFL@epa.gov. Although EPA’s 45-day review period will be performed concurrently with the public comment period, the deadline for submitting a citizen petition to object to the EPA Administrator will be determined as if EPA’s 45-day review period is performed after the public comment period has ended. The final Title V air operation permit will be issued after the conclusion of the 45-day EPA review period so long as no adverse comments are received that result in a different decision or significant change of terms or conditions. The status regarding EPA’s 45–day review of this project and the deadline for submitting a citizen petition can be found at the following website address: http://www2.epa.gov/ caa-permitting/florida-proposedtitle-v-permits. Objections: Finally, pursuant to 42 United States Code (U.S.C.) Section 7661d(b)(2), any person may petition the Administrator of the EPA within 60 days of the expiration of the Administrator’s 45-day review period as established at 42 U.S.C. Section 7661d(b)(1), to object to the issuance of any Title V air operation permit. Any petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day public comment period provided in the Public Notice, unless the petitioner demonstrates to the Administrator of the EPA that it was impracticable to raise such objections within the comment period or unless the grounds for such objection arose after the comment period. Filing of a petition with the Administrator of the EPA does not stay the effective date of any permit properly issued pursuant to the provisions of Chapter 62-213, F.A.C. Petitions filed with the Administrator of EPA must meet the requirements of 42 U.S.C. Section 7661d(b)(2) and must be filed with the Administrator of the EPA at: U.S. Environmental Protection Agency, Office of the Administrator, 1200 Pennsylvania Avenue, N.W., Mail Code: 1101A, Washington, DC 20460.
