Southeast LLC, $32,125,687 The city opened the bids Jan. 15. The project calls for removing part of the Hart Bridge ramp at Liberty Street between Gator Bowl and A. Philip Randolph boulevards, bringing a portion of the expressway to street level and aligning the new roadway. Construction of a signalized intersection at Gator Bowl Boulevard is part of the project. The city Procurement Division will analyze the bids for 30 days. City, state and federal money is funding the $38.9 million project. Work is anticipated to begin early this year and be completed by the end of 2021. The city said in a legislative summary the project’s purpose is to promote development of the Shipyards properties and Lot J mixed-use development and the city’s Metropolitan Park. Her goal is to create a market beyond the daytime demand from the estimated 50,000 urban core employees and work toward a Downtown residential population of 10,000 to 12,000 people. “Providing this urban lifestyle environment where people have places to go for breakfast and coffee and places to go after work for tacos or places to go for dinner is part of that,” she said.

Federal officials to take over probe of utility State Attorney Melissa Nelson is handing her investigation of JEA to federal officials. Nelson confirmed in an emailed statement Jan. 13 that federal agencies would be taking over the investigation into the city’s energy and water utility. “After thorough review, the State Attorney’s Office has determined that the appropriate venue to continue this investigation is the federal justice system. We have referred our investigation to our federal partners, who will take the lead moving forward and have the full support of this office,” Nelson said. DEVELOPMENT The District developers seek time to find financing The Downtown Investment Authority is giving developers of The District on Downtown’s Southbank a 90-day extension to obtain financing. In a Jan. 10 letter to developer Elements of Jacksonville LLC Managing Partner Peter Rummell, DIA CEO Lori Boyer agreed to grant the proposed $600 million, mixed-use project an extension on its full performance schedule. Boyer’s letter was in response to a written request from Rummell dated Jan. 9 for a six-month extension from

the DIA. Rummell told Boyer that Elements would miss the Jan. 13 deadline to secure $31.1 million in Community Development District bonds and bond insurance needed to pay for public infrastructure that will support the development. “It’s not like anybody has been sitting around. There has been a ton of work done to move the project forward,” Boyer said. “It’s a delay but I wouldn’t interpret it as a major setback. It’s moving forward, just at a slower pace.”

Moody said Mason had not been involved in the active

Looking for a history book about a Jacksonville legend? Raymond K. Mason, who died Jan. 2 at the age of 92, co-authored a biography of his mentor, Jacksonvillebased financier Ed Ball. It was published in 1976 and titled with Ball’s toast: “Confusion to the Enemy.” Ball died in 1981 at the age of 93. Ball’s interests included Florida National Bank, Florida East Coast Railway, St. Joe Paper Co., shares of General Motors and real estate. A bronze plaque hangs on the second-floor of the city-owned Downtown Edward Ball Building, which previously served as headquarters for the bank. “He has fought unions, the federal government, and anyone else he felt was trying ‘to poke their heads into where they don’t belong.’ Most of the time he emerged victorious,” says the book jacket. Adkinson Engineering is the civil engineer. Oklahoma City-based Love’s Travel Stops plans a convenience store, restaurants and fuel services for cars and tractor-trailers on about 16 acres.

Raymond K. Mason’s remaining operations are winding down. Days after the legendary businessman died Jan. 2, a company he led sold its San Marco office building to the owners of adjacent property. “We are closing down the operations, basically within six months. We will be done by June 1,” said Marcy Mason Moody, Mason’s daughter. The property sale provides the buyer control over several properties along Hendricks Avenue, south of Atlantic Boulevard at the edge of the historic San Marco Square shopMason ping district. Buyer Keith Kimball, a San Marco property investor since the 1970s, said the Mason group will continue to lease the building for now. Kimball said Jan. 11 that he didn’t have a plan for the property. He said the office use might change and more likely will be retail. “I think property in San Marco is good, so I like to buy it whenever it is available,” Kimball said. Rebuilding Service Inc., also known as Rebuilding Services Inc., sold 2022 Hendricks Ave. on Jan. 7 to Five and Ten Partners LLC for $750,000. The 4,952-square-foot one-story San Marco building, developed in 1945, later served as Mason’s office. Moody said Mason bought the building in 1998. THE SOURCE OF THE MONEY The DIA’s $3.7 million Northbank Retail Enhancement, Economic Development and Facade Grant money would fund the initiative. RESTAURANT ELIGIBILITY n Restaurants must open for breakfast by 7 a.m. or stay open until 9 p.m. or later at least five days a week. Those days must include Fridays and Saturdays. n The restaurant must be a ground-floor, second-floor or rooftop establishment with ground-level access and visiblity from the street.

CONSTRUCTION, RENOVATION INCENTIVES Restaurants could receive an incentive of up to $350,000 in a five-year, forgivable loan after construction is completed. n Fine dining and contemporary-casual restaurants can receive $75 per square foot with a $350,000 cap. n Fast-casual and breakfast restaurants can

receive $50 per square foot with a $150,000 cap. n Less capital-intensive projects, like a coffee shop, juice bar or taproom could apply for a $40 per square foot incentive with an $80,000 cap. n Restaurants renovating a historic structure could gain an additional $15 per square foot. The total cap would remain the same.

FAÇADE IMPROVEMENTS Restaurants can be paid a dollar-fordollar match of up to $25,000 for façade improvements.

SIDEWALK CAFES

n The program would pay 80% of the cost

of creating a sidewalk cafe up to $15,000. Restaurants must be open until 9 p.m., five days a week. n A $5,000 grant would be available for cafes

with fewer hours.

OTHER PROJECTS The DIA would cover up to 50% of a project depending on the type of business. DIA board member Oliver Barakat said he would like to see the DIA’s 50% limited to capital improvements and not for furniture and fixtures. LANDLORDS Building owners who receive incentives would be required to fix the base rent for the first year and agree to cap increases over the life of the loan. The DIA has not determined the caps. LABOR n The plan proposes partnering with the University of North Florida and Florida State College at Jacksonville to offer bonuses to students who work at Downtown restaurants. PARKING Free parking for diners would be offered in the Yates Garage at 200 E. Adams St. and the Ed Ball Garage at 238 W. Monroe St. SECURITY The plan would temporarily increase the Jacksonville Sheriff’s Office presence Downtown.

special committee after teasing the plan in October. She hopes the first restaurants will open under the program by March 2021. The program needs approval by the full DIA board, which could vote as soon as February. Boyer’s proposals include citybacked incentives, forgivable loans that could offer up to $85 per square foot with a $350,000 cap to entice restaurant owners Downtown. The award amount depends on the style of restaurant. The DIA will fund up to 50% of the cost of a build-out with the incentive. Board member Oliver Barakat said he wants DIA dollars used for capital improvements, not furniture and fixtures. Barakat sees benefits to DIA helping with the costs of code compliance and upgrading mechanical and power systems and other improvements that extend the property beyond the life of the lease. “That’s going to help Downtown, many folks, many owners, many tenants over the years,” he said. Boyer proposes eligibility limits for businesses to participate in the program, including the hours and days of operation and the visibility of the business from the street. DIA board members Todd Froats and Ron Moody said they’d like to see the market dictate the number of restaurant types helped by the incentives. The DIA plans to issue targeted surveys to Downtown residents and restaurant owners to determine what services are in demand. “I wouldn’t want 20 ice cream

shops to come in and get these incentives because you don’t need 20 ice cream shops in Downtown,” Boyer said. “But if you had two or three ice cream shops in each district, fine. When No. 4 comes in, you say you qualify for the regular (retail enhancement grant) but not the targeted incentive.” Froats said it could be difficult to set a limit or target. CHARACTER CORRIDORS

The DIA identified 55 storefronts that will qualify for the incentives. In the Hogan/Laura Street Corridor, 16 are vacant. DIA maps show another nine properties in The Elbow. To give the corridors visual appeal, Boyer suggests streetscape and public infrastructure improvements similar to those in Downtown Buffalo, New York and other U.S. cities. The corridor will incorporate a two-way bicycle track already planned for Hogan Street — part of the Emerald Trail project.

MARKET CHALLENGES

Boyer consulted with existing restaurant owners and real estate brokers while drafting the program. The Bearded Pig owner Michael Schmidt said what the proposal gets right is buy-in from the landlord and the restaurant owner. In an interview, Schmidt said the program needs multiple restaurants to open simultaneously, creating competition and mutual support in attracting customers. “I feel you need it where two or three that can open at the same time. You can’t have that standalone guy who’s going into the wild frontier,” Schmidt said. He said staffing is a barrier for

Boyer proposes partnering with the University of North Florida and Florida State College at Jacksonville to offer a bonus to graduates who work in Downtown restaurants. Schmidt said college culinary programs can produce the kitchen team, but it’s difficult to attract servers and hosts. Boyer hopes that offering free evening parking in city-owned garages will address a concern of many restaurant owners — the lack of nearby parking. She sees concerns about Downtown safety as more perception than reality. But when the program launches, Boyer proposes temporarily increasing the Jacksonville Sheriff’s Office presence Downtown. She said it would remove a barrier to bringing people to the core at night. “We have to tell our story better about the reality of safety Downtown,” she said. Boyer wants to use DIA market-

ing money to buy media time and advertisements to promote the increased security measures and Downtown safety as a whole. “So that we are not just addressing it from a marketing standpoint, but we’re also addressing it from a reality standpoint,” she said. “You’re seeing more safety and security around you until we get enough critical mass of people where they don’t feel that that’s an issue,” she said.

Moves means little change to investors, but it’s a blow to the company’s prestige. With its stock continuing to trade below $1, Stein Mart Inc.’s listing was moved to a lower tier in the Nasdaq market. The Jacksonville-based fashion retailer moved Jan. 8 from the Nasdaq Global Select Market to the Nasdaq Capital Market. It continues to trade under the ticker symbol “SMRT.” The move means little change for investors but a lower tier means lower prestige for a stock. Stein Mart actually dropped two tiers. The Global Select Market is Nasdaq’s highest of three tiers and the Capital Market is the lowest, with the Nasdaq Global Market in the middle. Nasdaq notified Stein Mart in July that it could be delisted by Jan. 6 if its stock price didn’t recover. The company last week said when Nasdaq approved its move to the lower tier, it also gave it an additional 180 days until July 6 to regain compliance with minimum price rules. “As part of its transfer application, the Company notified Nasdaq that if the stock price does not recover sufficiently during the additional grace period, it intends to take actions to regain compliance with the minimum bid price requirement, including by effecting a reverse stock split, if necessary,” Stein Mart said in a news release. For the first nine months of fiscal 2019, Stein Mart reported a 3.7% drop in total sales and a 1.9% decline in comparablestore sales, or sales at stores open for more than one year. The company launched several initiatives in the fall that it expects to boost sales, but

its stock price hasn’t moved as Wall Street waits for results showing improvement in the sales trends. Stein Mart’s stock has not closed above $1 since May.

Tegna getting political ad gains Tegna Inc. last week said it expects fourth-quarter revenue of $688 million to $693 million, up 7% to 8% from last year. The operator of 62 television stations, including NBC affiliate WTLV TV-12 and ABC affiliate WJXX TV-25 in Jacksonville, had been projecting mid-single digit percentage growth. However, Tegna said it benefited from “2020 political advertising spending beginning in earnest earlier than anticipated.” The company also is benefiting from growth in fees paid by cable and satellite television providers to carry its stations, and a recent acquisition of 13 television stations also is lifting revenue. Tegna is projecting its political ad revenue will be more than $300 million this year, which would just about double the $155 million it had in the last presidential election year in 2016. The company operated 46 stations in 2016, but its projections suggest the average station in its portfolio will take in an average of about $1.5 million more in political ad revenue this year than four years ago.

In an off year for elections, Tegna reported political ad revenue of just $14 million in the first nine months of 2019. Tegna said revenue excluding political advertising will be up 14% to 15% for all of 2019.

Analyst upgrades CSX to ‘positive’ In advance of CSX Corp.’s year-end earnings report, Susquehanna Financial Group analyst Bascome Majors upgraded the Jacksonvillebased railroad from “neutral” to “positive.” “We’re upgrading CSX to Positive into 2020 and now see it as the top value play in rails over the next 12 months on a mix of sour near-term sentiment driven by coal, 2019 underperformance, and low valuation (absolute and relative), including a particularly attractive free cash flow yield among rails that has proven durable in recent years,” Majors said in his report last week. “Our sense is buy-side sentiment is largely there, with CSX management front-footed with cautious messaging on coal for several months now, and shares underperforming and de-rating more than any other Class I since our downgrade to Neutral last April,” he said. Majors said overall he is “constructive” on the railroad industry, despite expectations of lower freight volume through the first half of this year and into the third quarter.

“Several of the prominent soft spots for rail can be explained by reasons beyond an incremental U.S. macro downshift, particularly coal (falling international prices for exports, natgas near multiyear lows for domestic utility), intermodal (oversupplied truckload market, carriers cutting rates and gaining share), and grain (tariffs, delayed harvest),” he said. “In short, we don’t see the mid-2020 volume recovery driven enthusiasm for rails as wrong … just a few months early.” CSX is scheduled to report its fourth-quarter earnings after the stock market closes Thursday afternoon. The company has been forecasting final 2019 revenue will be slightly lower than 2018 and as the first major railroad to report yearned results, Wall Street will be looking for signals on the outlook for 2020. Majors doesn’t expect the earnings report to move the stock. “To be clear, we are not suggesting investors absolutely must buy ahead of the quarter,” with expectations of “a characteristically conservative 2019 outlook from management to kick off rail earnings season,” he said. “We just see the upside potential of holding CSX into 2021 as far greater than the downside risk of holding shares into (the report), given already cautious sentiment and discounted valuation.”

What once was Drone Aviation now based in Dallas

After merging with Jacksonville-based Drone Aviation Holding Corp., ComSovereign Holding Corp. now is headquartered in Dallas, according to a Securities and Exchange Commission filing last week. Before the merger in December, ComSovereign’s address was listed in Tucson, Arizona, and the companies did not say where the merged company’s headquarters office would be. The company began trading Jan. 13 under a new ticker symbol, “COMS,” in the OTC market. The stock had continued to trade under Drone Aviation’s “DRNE” symbol for the past month while it waited for approval of a new symbol. Drone Aviation produced tethered aerial monitoring and

communications platforms. ComSovereign, a holding company for several businesses before the merger, describes itself as a “pure-play communications provider able to provide LTE Advanced and 5G-NR telecom solutions to network operators and enterprises world-wide.” Drone Aviation technically was the surviving company in the merger, but the owners of privately held ComSovereign ended up with 69% of the company’s shares in the deal and the merged company took on the ComSovereign name.

Shoreline Equity Partners raises $300 million

Jacksonville-based Shoreline Equity Partners last week said it has raised $300 million for its inaugural private equity fund. Shoreline, which describes itself as “a purpose-driven lower middle market private equity firm,” was launched and began raising capital in March 2019. The firm was founded by Michael Hand, who previously ran a private equity affiliate of PNC Financial Services Group, and Peter Franz, former comanaging partner of Florida Capital Partners. Shoreline is targeting businesses with enterprise value between $25 million and $250 million, and will seek to make equity investments of up to $100 million per transaction.

Regency, CSX make Newsweek’s ‘responsible’ list

Two Jacksonville-based companies made Newsweek magazine’s list of “America’s Most Responsible Companies.” Regency Centers Corp. ranked 165th on Newsweek’s list of 300 companies and CSX ranked 169th. The magazine looked at the 2,000 largest U.S. companies by revenue and evaluated each on environmental, social and corporate governance responsibility to come up with its ranking. The rankings were based on publicly available performance indicators and a survey on the public perception of the companies.

Jacksonville attorneys selected for pro bono awards

The Florida Bar recognizes Belkis Plata and Michael Lockamy. Two Jacksonville attorneys will be recognized by The Florida Bar on Jan. 30 for their volunteer service to improve access to justice for people who cannot afford to hire an attorney. Belkis Plata, founding partner with Plata Schott Attorneys & Counselors at Law, will receive The Florida Bar Young Lawyers Division Pro Bono Service Award. The annual statewide award recognizes public service and legal aid performed by an attorney who is age 35 or younger or who has not practiced for more than five years. Plata last year provided more than 204 hours of legal service by representing clients who could not afford to retain an attorney. She also provided 19 hours of pro bono service participating in symposiums and at Jacksonville Area Legal Aid Ask-A-Lawyer events and has

given more than 56 hours to nonprofit organizations that serve at-risk youth. Plata works with Take Stock in Children, where she mentors, provides legal advice to juveniles who may be facing adult criminal prosecution and speaks on behalf of the programs offered by the nonprofit. In addition, she is a volunteer attorney ad litem to children in foster care and volunteers with Year Up, a nonprofit established to provide urban young adults with skills that help them reach their potential through higher education. A public defender for nearly four years in Jacksonville after being admitted to the Bar in 2010, she opened her law firm

in 2014. Plata is the second Jacksonville attorney to receive the award since it was established in 1993, joining Allison Stocker, the recipient in 2018. Michael Lockamy, an attorney at the Bedell Firm, will receive The Florida Bar President’s Pro Bono Service Award for the 4th Judicial Circuit. The 4th Circuit comprises Clay, Duval and Nassau counties. Lockamy provided more than 100 hours of pro bono services, volunteering in the JALA Guardian Advocate program and in the federal courts trying a prisoner civil rights case. After the U.S. Supreme Court held that juveniles charged and sentenced as

adults could not be sentenced to life in prison without meaningful review, Lockamy volunteered to help represent some of the 55 defendants entitled to be resentenced in Florida. A graduate of the University of Florida Levin College of Law, Lockamy joined the Bedell Firm when he was admitted to the Bar in 2009. He practices business litigation professional malpractice law, personal injury, employment discrimination and family law. Lockamy is a representative from the 4th Circuit on the Florida Bar Young Lawyers Division’s board of governors and serves as a board member of the Jacksonville Bar Association Young Lawyers Section. The award ceremony is scheduled at 3:30 p.m. Jan. 30 at the Supreme Court of Florida in Tallahassee.
