WHICH PIP COVERAGE APPLIES UNDER FLORIDA RIDESHARE INSURANCE LAW?

The use of rideshare services, like Uber and Lyft, have become a regular part of Americans’ lives. Whether on vacation, a night out drinking, a ride to the grocery store, or even having patients/customers transported to your business, rideshare services are being used for all different kinds of reasons. While they simplify our transportation needs, things can get complicated when an accident occurs. Depending on the facts of the ride, insurance coverage may rest on the driver’s personal auto insurer, the driver’s rideshare insurance purchased from the rideshare company (or through their own personal auto insurer), the rideshare company’s insurer, or the at-fault driver’s policy if there is a third-party at fault.

In Florida, rideshare companies, or transportation network companies (TNCs) as the Florida legislature has coined them, are governed by Florida Statute 627.748. This statute requires minimum insurance levels of $50,000 for death and bodily injury per person, $100,000 for death and bodily injury per incident, and $25,000 for property damage, when a TNC driver is logged on to the digital network but is not engaged in a prearranged ride. When a driver is engaged in a prearranged ride, primary automobile liability coverage of at least $1 million for death, bodily injury, and property damage is required in addition to personal injury protection benefits of at least $10,000, and uninsured/ underinsured vehicle coverage.

When a driver is not on the app or engaged in a ride, the driver’s own auto insurance policy would apply. This means a TNC driver will need $10,000 of personal injury protection (PIP) coverage and $10,000 of property damage liability coverage to meet Florida’s auto

insurance requirements. This also means that a driver’s personal auto insurer can deny coverage during the time that driver’s rideshare app is on, unless the driver purchased rideshare insurance through their personal auto insurer, if offered/available. A driver’s personal auto insurer can also deny coverage if the driver fails to disclose on the insurance application that the insured vehicle is being used as a rideshare vehicle (or for hire), as such would be considered a material misrepresentation and would allow the insurer to void or cancel the policy. So, which policy applies in the event of an accident? Generally, there are 4 possibilities when a driver purchases a rideshare insurance policy or adds a rideshare endorsement to their personal auto insurance policy:

1. When a driver is using the vehicle for personal use while the rideshare app is off, the driver’s personal auto insurance provides coverage.

arrow-square-right
Due to the complex nature of rideshare insurance policies, consulting a lawyer about your specific questions is highly recommended.
Florida PI Magazine — JANUARY-MARCH 2022 6

2. When the rideshare app is on and the driver is not engaged in a prearranged ride (meaning the driver is waiting to be connected with a passenger), the driver’s purchased rideshare policy would provide coverage. There may also be a limited amount of liability coverage provided by the TNC.

3. When a TNC driver has been connected with a passenger and is on their way to pick up the person, the TNC’s policy would apply.

4. Once the passenger is in the TNC vehicle, the TNC’s policy would provide coverage. When the passenger is dropped off, possibility (2) above would apply.

Under Florida law, there should always be coverage before, during, and after a ride. As discussed, depending on the facts, there may be different policies that may provide coverage. However, if a TNC driver fails to disclose to their personal auto insurer that they are a rideshare driver, the personal auto insurer is likely to cancel the policy for material misrepresentation, whether the failure to disclose was intentional or

mistake, and may render driver and/or the injured party without coverage. Due to the complex nature of rideshare insurance policies, consulting a lawyer about your specific questions is highly recommended. ■

5 TIPS TO CLEAN UP YOUR AR AND INCREASE YOUR PI REVENUE IN 2022

Days go by fast, and we forget about all those pending claims that simply fall through the cracks over time. But taking a little bit of time aside to take a look at your Accounts Receivables (AR) could make a big difference in the amount of checks coming in the mail every day. Consider these simple tips to get your business on a path to maximizing your revenue this year:

1. Stay current with claims knowledge: Medical billing and insurance rules constantly change. By keeping current, you can swiftly implement internal changes to ensure your practice is not making unnecessary errors or missing out on critical data needed to receive insurance claims payouts successfully. Stay abreast of the latest issues by following industry expert social media profiles, many of which might offer free webinars or live sessions to discuss hot topics.

2. Understand your Claims life cycle: It is important to review your claims life cycle to consider which factors are impacting your revenue negatively. For example, consider how long is it taking from the moment a service is provided to a client for the billing and documentation is entered in the system? Then, review the information entered for accuracy, ensuring all billing codes are entered properly and documentation is sufficient for payment. Also, how long is it taking for claims to be submitted to the carriers, whether electronically or by paper? All these processes, if not done efficiently, can further delay your claim filing, and cause denials that could be easily avoidable by more closely monitoring each process.

3. Keep up with your PIP suits: in South Florida, one thing we do not lack is great PIP attorneys. Make sure that your practice is regularly reviewing all files for PIP suit eligibility, preferably by a knowledgeable law firm that can either come to your office or remotely access your billing records (on which they can go back up to a little over 5 years to dispute!). Once a file is taken for PIP suit process, keep track of its status either in your billing software or on a separate list, and periodically ask for status reports by the PIP firms who are handling your files. This will ensure you have a constant stream of incoming PIP suit checks for which your staff has little or no involvement at all.

4. Review your pending LOP cases: keep track of all your pending PI cases settlement status, whether it is through your billing software, or by keeping a list in an Excel or a similar worksheet. Assign a staff member to regularly review the status of all pending cases, and contact the respective law firms for updates. Sometimes a simple phone call to the handling case manager can go a long way in expediting settlement checks being issued to your office.

5. Outsource your claims processes: Billing and receivables can be a task and massive undertaking, especially if your practice is struggling with staffing challenges. Consider outsourcing the AR function to a reputable agency that can dedicate the time and resources to identifying and strategically tackling your outstanding receivables and some of the hidden administrative errors that could be costing you money. Make sure to do your due diligence to ensure the agency’s experience in your specific industry, their reputation and don’t be shy to ask for references of current or past clients so you can get a more real idea on how they operate. ■

COULD AN ACUTE TRAUMATIC SCHMORL’S NODE BE AT FAULT?

Never heard of a Schmorl’s node? Then this may be of interest to you. Think a Schmorl’s node is a normal variant seen on x-ray or MRI? Then this may be of interest to you too.

Back Pain – Car Accident & The Hidden Fracture Herniation

Yep, it’s happened again. Putting a doctor’s name on some condition and making it sound totally benign! It’s too bad, but more and more research is proving my theory true. About 12 years ago, I had a patient who kept on returning with complaints of lower back pain, yet nothing positive on the lumbar MRI. It puzzled me and then I re-read the MRI report and that’s when it hit me. Schmorl’s nodes!!! I checked several classic radiology texts, Yochum & Rowe, Paul & Juhl and there it was, on the bottom of each list, ‘trauma’ as the last possible cause for a Schmorl’s node.

Often in life we get so use to calling things by the casual names we assign them, forgetting what they really are. Especially when the names are not descriptive. For example, a soldier or a politician will talk about “Collateral Damage” when they mean innocent civilians have been killed, or they’ve blown up the wrong building. The term “co-lateral damage” sounds much less severe than what had actually taken place. Unfortunately, collateral damage happens. In the world of medicine, doctors and scientists often assign their own names to discoveries they make. This has been a common practice for over one-hundred years. Some nice doctors will honor their patient by naming a newly discovered disease or condition after the patient who presented with the disease. These names tend to make

the diseases, conditions and tests more palatable for the general public. And for good reason., some of the actual medical/scientific names are so long that they are just too difficult for many to comprehend. So, we give them simple benign names. Hence the term “Schmorl’s Nodes”.

Since I last wrote about them, I had a conversation with a neuroradiologist about the phenomenon of acute-traumatic Schmorl’s nodes. I explained to him that if there is enough pressure and the outer fibers of the disc are in great-healthy shape, the force must go somewhere? In this case (I theorized) up through and into the vertebral body. We discussed it a bit further and told me that if I could find it in the American Journal of Neuroradiology, then you’ve got something. So, I researched it and found the reference I was looking for, and here it is:

AJNR Am J Neuroradiol 2000 Feb;21(2):276-81; Relationship ofSchmorl’s nodes to vertebral body endplate fractures and acute endplate disk extrusions. Wagner AL, Murtagh FR, Arrington JA, Stallworth D. University of South Florida College of Medicine, Department of Radiology, Tampa, USA.

Classically, radiologists and clinical physicians shrugged off Schmorl’s nodes as an incidental finding as part of another condition and having nothing to do with acute trauma. However, the more and more I read, the more I find out that these “incidental findings” were actually caused by prior traumatic events and were (again) shrugged off because doctors succumbed to convention and didn’t think outside the box.

Simply put, a Schmorl’s Node is a disc that has herniated up through the bony vertebral endplate and into the body of the vertebrae. It is a herniation that fractured through the bottom or top of the vertebrae. Even more simple, it’s a fracture-herniation! In the pictures, you’ll notice that the Schmorl’s nodes are visible on arrow-square-right

It is a herniation that fractured through the bottom or top of the vertebrae. Even more simple, it’s a fracture-herniation!
Florida PI Magazine — JANUARY-MARCH 2022 11
MRI scan showing multiple Schmorl's nodes indenting the vertebral body.

CONTINUATION

Could An Acute Traumatic Schmorl’s Node Be At Fault?

X-rays and MRI scans. And although not picture, they can be seen on a CT scan as well. If you’re not familiar with them, the Schmorl’s node is the indentation that you see on the top and or bottom of the body of the vertebra in the pictures.

So now it’s out in the open. There has been enough research to prove it and from more recent casual browsing of on-line research reports, there’s more support since the 2000 publication of the reference above.

The next time a physician says the MRI or X-ray report is negative, the patient is still in pain and there was an acute trauma as the cause for the patient’s pain…go back and read that radiology report again and see if there are any Schmorl’s nodes. Ruling out the other causes of a Schmorl’s node could leave the not-so-obvious fracture-herniation as the only diagnosis left standing.

Now that you know about Schmorl’s nodes, before you shrug off a client’s injuries as only “soft tissue”, give their imaging another look and if you find a Schmorl’s node, call me and I’ll tell you the best way to present it.

Feel free to contact me if you have any questions. ■

“HOW DO WE PREPARE TO PASS THE BATON?”

Law firm mentoring leading to successful succession planning

After investing over three decades working in the legal industry, a person learns a thing or two. What works, what doesn’t! I’d like to think I learned everything I needed to know in kindergarten*, like… share everything, play fair, say you’re SORRY when you HURT somebody, live a balanced life - learn some and drink some and draw some and paint some and sing and dance and play and work every day some. Sounds simple and it should be. As adults, we overthink and complicate our world.

When I think back to my success, I recall my mentors. At a young age, my mom and grandparents played a tremendous role in my early formation of thoughts and creativity. As a working adult, the managing partner of my first firm, where I thrived for 20+ years, helped to form my thought leadership and business mind. You ask, where is this going?

In my early tenure at the firm, I implemented a mentoring program for the new associates. As the executive director of the firm, I personally would spend 3 months with each associate, developing their business etiquette, time and billing habits, training on systems/ programs, understanding of goal setting, assignments, research and lastly business development. This proved to be an efficient and effective use of my time. Laying the foundation to develop excellent associates and our next best partners.

Not every associate will make the cut. Identifying who has it and who doesn’t, saved our firm a tremendous amount of time, money, and client satisfaction. I recall one associate gave notice before the 90 days and thanked us for putting him through the associate program. He had learned so much especially that he didn’t want to be a lawyer, at least not in private practice. Did I mention he worked at the State Attorney’s office prior for 8 years?

Finding the right associate who will rise to the occasion starts during the hiring process. Many firms are not thinking about this especially when recruiting a newly graduating attorney or a 1-3-year attorney with little to no experience. This is the time to find your next best partner. When I coach attorneys, who are looking to build a book of business, make partner, or hang their own shingle out, they will suggest that there are no documents or processes in place which spells out what is expected of them to achieve partnership in their firm. If a firm does not have this information available, it sends a message to your associates that you “don’t have a plan” and the process is “subjective.” Not a good way to attract talent.

Now for some nuggets you can use right now. When hiring a new associate (or any new hire) here are some questions to ask:

1. “What one thing do you believe is important to do every day?”

2. “What has been the most courageous thing you have done in your adult life?”

3. “What concerns you most in today’s world?”

4. “Right now, what do you think your greatest contribution would be to this firm?”

I am sure you are wondering what’s the correct answer. The only way you’ll know that, is if your firm has a clear concise direction to where they are going for the next 7-10 years. In addition, what are the current goals the firm is trying to achieve.

* All I Really Need to Know I Learned in Kindergarten, Book by Robert Fulghum

Direction is important. A GPS is only as good as the address you’ve entered. It cannot bring you to your destination if you don’t have the correct information.

If your firm, regardless of size, doesn’t have written goals, a vision or mission statement, how do you know where you will end up each year? Success is not measured by revenue alone! What about sustainability, employee turn-over, client satisfaction and work/life balance? Direction is important. A GPS is only as good as the address you’ve entered. It cannot bring you to your destination if you don’t have the correct information. This is the same for business or personal needs to be met. For those of you that do have a vision, mission statement or set goals, check to see that the dynamics of your firm have not changed. Have the client’s needs, the environment, the economics, or structure of your firm changed? What has the pandemic done to your firm structure? Certainly, it is not the same. Knowing where you’re going and how you’re going to get there is the key to any successful business. ■

3 TELECOMMUNICATION FEATURES TO IMPROVE YOUR CUSTOMER RELATIONS

Thanks to recent advances, cloud-based computing systems have significantly reduced the cost and implementation timeframes, as well asbrought about a suite of new features designed to help an organization automate and optimize their Customer Relationship Management (CRM).

Most companies rarely utilize all the features that are sold, and understandably so - the truth is that setting up some of the features is not an intuitive process; it requires multiple steps, and rarely any one person in the office is designated as the single point of contact to learn and manage the platforms.

Here are three features that 98% of our customers that use it not only love it but can’t imagine living without it - we call it the smartphone-like features, easy to implement (set it and forget it), easy to use, and can be a game-changer when it comes to managing your business.

FEATURE 1 TEXT TO EMAIL

HOW IT WORKS: If you’re a busy business owner, you need to be in communication with your employees and clients throughout the day. But, if you’re away from your computer, it can be difficult to stay in the loop, and it’s not always possible or appropriate to send a text when an email is the best way to get your message to a recipient. Or, perhaps you keep a to-do list or send a quick reminder.

This is one of the simplest yet most powerful features available in order to not only maximize communication channels with your customers but also for centralizing all the communications.

Your customer will send you a text message to your business phone number and the platform will send it both to your business mobile phone and an email address of your designation.

HOW OTHER BUSINESSES USE IT

• Get appointment requests from customers, a customer can send you a request from anywhere without having to log into complicated systems or even have access to a computer

• Get customer feedback immediately

• Centralize communications and keep a record of them

Add it to your web site, business cards and promotional material as part of the Contact Us call-to-action.

FEATURE 2 CALL RECORDING

HOW IT WORKS: Record any phone call you want and choose which calls you want to save. You can pre-set which calls are recorded and which are ignored. You can later listen to the recording, add notes and share it. Integration with Google Drive™ and Dropbox allows calls to be saved and synchronized to the cloud as well.

You can set up call recording automatically for each user and all calls. The recordings will be stored in the user's Call History within the User Portal and can be played back on the fly or downloaded.

• Enable automatic recordings for one or multiple users with just a few clicks

• Set up automatic recording of calls for inbound calls to certain departments

• Quickly select incoming and/or outgoing calls to record

• Be more responsive and professional, improving your customer’s experience

Keep in mind that it is very important that you advise customers that the call is being recorded. The easiest way to do it is to create a pre-recorded message that states something like " This call may be monitored and recorded for quality purposes". You may want to consult with your legal team for specific wording that may be more relevant to your line of business; however, that is pretty standard wording across all industries.

HOW OTHER BUSINESSES USE IT

• Great coaching tool for customer services, sales staff, and even your company’s receptionist

• Great tool for reviewing customer requests over the phone in the event of any disputes.

• Keep records of critical conversations regarding projects and share them with the team to support post-conference call notes.

arrow-square-right

Florida PI Magazine — JANUARY-MARCH 2022 16

• Monitoring of call center agents that handles numerous calls per day

FEATURE 3 AUTO ATTENDANTS

Auto-attendant refers to a telephone service wherein a voice menu system answers incoming calls and transfers callers to the appropriate extension without the help of a live operator or receptionist. Other terms for auto-attendant include automated attendant, digital receptionist, and interactive voice response (IVR).

How Does an Auto-Attendant Work?

The automated attendant can be understood as an automated call answering system that helps transfer incoming calls while providing callers with general information about the company and its services. But the main point of an auto-attendant is to manage incoming calls effectively, so callers are not left confused or arrive at the wrong agent or department.

HOW OTHER BUSINESSES USE IT

• Create custom messages with general information about your business, such as hours of operation and locations.

• Greeting messages
