COMMISSION APPROVES MORATORIUM, AND MORE LOCAL NEWS

A controversial data center is not allowed at Athena Studios under the property’s current zoning, Athens- Clarke County Manager Bob Cowell told the mayor and commission last week, before a vote on temporarily banning data center construction in Athens.

The county’s 25- year-old zoning code does not specifically address the relatively new phenomenon of data centers, which are sprouting up everywhere to meet the demands of computing power for artificial intelligence. The property off Athena Drive is zoned employment-industrial, but Cowell said that county planners believe data centers belong in an industrial zone, a category for more intensive uses.

“The Athena Studios property is not zoned in that manner, therefore our conclusion is it cannot go there under the current zoning,” he said.

Athena Studios owner Reynolds Capital and local firm W&A Engineering submitted plans for the 1.3 million square foot data center under the impression that it would be permitted in an E-I zone. The submittal went through plans review, a routine meeting between an applicant and planners, on Dec. 2.

runoff in what she termed “a box” underground. Other residents made the usual complaints about traffic and density, but it was primarily Little’s critique that caught the ear of Commissioner Melissa Link.

“What’s really getting me right now is, I don’t have a full understanding of the sewer issue,” Link said. “I don’t want to see a whole lot of new density approved for this area and have the public saddled with a need, a desperate need, for sewer improvements in the future.”

Cowell said the stormwater tank is a new concept, “but as I understand it, it’s the only opportunity for the property to be redeveloped, given the constraints in the area.” It would be privately maintained and inspected by ACC Public Utilities, he said.

“ Our conclusion is it cannot go there under the current zoning.

The commission voted unanimously to approve the data center moratorium. It is in effect through Mar. 6, although it could be extended. Officials will use that time to craft new regulations for data centers. The ACC Planning Commission is scheduled to discuss such regulations at its Dec. 11 meeting.

HOMEWOOD VILLAGE: The commission voted 7–3 to put off a vote on a partial redevelopment at the Homewood Village shopping center that would replace the back portion of the aging strip mall with apartment buildings and eight townhouses.

Although about a dozen of his constituents from Homewood Hills and other nearby subdivisions spoke against the plan, Commissioner Dexter Fisher was in favor of it. He said that the plan is not perfect, but it’s better than what’s there now, and that passing up this opportunity could mean allowing Homewood Village to continue to deteriorate because some businesses have leases years into the future.

“If we don’t do anything and vote to fail, I truly believe it will sit for at least another five years, maybe longer,” said Fisher, a candidate for mayor. “And then what do we have there—a really, really eyesore. If we’re going to have an eyesore, I’d rather have an eyesore that looks like something than a bad eyesore.”

The shopping center is located in a hole below Jefferson Road, which makes it challenging both from a standpoint of leasing commercial space due to lack of visibility and handling stormwater. During the public comment period, Elizabeth Little, a retired UGA plant professor and former environmental activist, raised concerns about development firm Carter’s plan to store

Link’s motion to table the zoning request until January won the support of commissioners Patrick Davenport, Tiffany Taylor, Allison Wright, Stephanie Johnson, Carol Myers and Ovita Thornton. Fisher and commissioners John Culpepper (who also spoke in favor of approval) and Mike Hamby opposed it.

Johnson said she came into the meeting ready to vote yes, but after listening to public input, she wanted to vote no on the development and would not vote to delay a decision.

“I do not support apartment complexes everywhere, in every corner,” Johnson said. “To dim the lights of an established subdivision—I do think there’s a place for apartments, but I don’t think it’s everyplace,” she said. Johnson visibly hesitated when her name was called, then voted in favor of Link’s motion to table.

BIKE LANES AND SIDEWALKS: The commission voted to move forward with a bike path on Barber Street between Boulevard and the Chase Street/Newton Bridge Road intersection, but will hold off on the portion between Boulevard and Prince Avenue. There is only enough money in the budget to build two out of four phases of the project. And for the southern part of the street, there are several constraints, like trees, retaining walls, utility poles and on- street parking. That stretch of the project, in the works since 2018, will go through another round of public input. The commission also approved plans for a sidewalk on Vincent Drive and a multiuse path on Jefferson River Road.

SHORT-TERM RENTALS: The commission voted 7–1 to ban commercially operated short- term rentals (properties listed on websites like Airbnb) in multifamily zones. Previously they had been allowed there, but are now restricted to commercial areas. As in single- family zones, property owners or tenants can continue to lease out their home, rooms or an accessory dwelling as long as they are living in the home. But properties that are exclusively STRs, which often cause noise and parking problems, are

not allowed in R-M or R- S zones. Wright, who owns an STR, abstained, and Taylor voted no. [Blake Aued]

Collins Aide Investigated

A top aide to congressman Mike Collins—a Republican who represents Athens and is among the contenders to face Democratic Sen. Jon Ossoff—is being investigated by the House Ethics Committee.

The committee did not disclose why Collins’ chief of staff, Brandon Phillips, is under investigation. The Atlanta JournalConstitution quoted Joan Curtis, an Athens retiree and member of the progressive group Indivisible GA 10, as saying Collins “needs to tell us what’s going on.”

Earlier this year, a former Collins staffer accused Phillips, 39, of hiring his 26- year-old girlfriend as an intern. He was previously fired from Donald Trump’s 2016 campaign after news emerged that he had pleaded guilty to criminal trespass and battery in 2008. Just before being hired as Collins’s chief of staff in 2022, Phillips was charged with kicking a dog.

In other news, Collins will be an “honored guest” at a New York Young Republican Club gala featuring a far-right German politician. Politico reported that the Dec. 13 event will honor Markus Frohnmaier, a high-ranking member of Alternative for Germany, a nationalist party linked to Nazi ideology. Germany’s version of the FBI has labeled AFD an “extremist group.” Collins’ press office did not respond to a request for comment. [BA]

Plan Released for West Broad School

After decades of neglect, the West Broad Street School campus will soon have public school students and teachers in its classrooms once again. The Clarke County School District revealed Tuesday, Dec. 2 that the buildings on Minor Street and Campbell Lane will house a new construction pathway—part of the Athens Community Career Academy’s offerings—strongly supported by local industries.

The West Broad Street School was one of several attended by African American children before desegregation in the 1960s. Officials bought the property on which the school sits in 1891. In 1922, it became one of the few Black schools in Georgia to be accredited. In 1938 the Minor Street building was constructed. After integration it became Rutland Academy, a facility for children with severe emotional and behavioral issues. Rutland was relocated to Oglethorpe Avenue in 2007 and has since closed. In 2012 the Athens Land Trust developed West Broad Street School’s former playground into a community garden for residents living near the school. For years, there was a Saturday morning market for local vendors selling food, teas, jewelry and other items. Former superintendent Demond Means ended the school district’s contract with the land trust in 2019 and floated a plan to turn the complex into an early learning center, which the school board later abandoned due to the small parcel’s constraints and disagreement over whether the Campbell Street building could be saved. The facility has since continued to fall into disrepair, becoming a haven for squatters.

Current plans are to rehabilitate the 1938 façade on the Minor Street building, then to renovate its 11,000 square feet of space, including four classrooms, two meeting rooms, a heritage room and flexible work space. Campbell Lane will have 10,000 square feet of labs, including ones for welding that include 3,000 square feet of indoor space and a 1,000 square foot patio. ESPLOST monies will fund the transformation. District leaders have completed an RFP for structural engineering services for the Campbell Lane Building and hope to have a contract for the board to approve early next year.

Interim Superintendent Jennifer Scott said the goals are to focus on academic programming, rehabilitate the historic building, incorporate displays from those connected to the site, create multi-use rooms and a community park and provide the public with regular updates. The school board wants a West Broad Street campus that “honors our past and inspires our future.” [Rebecca McCarthy] f

Athens Pride Wins Lawsuit

ATHE GROUP CLAIMING SHE WAS ‘CANCELED’

thens Pride and Queer Collective, an LGBTQ+ advocacy and support group, has successfully defended itself in court from a lawsuit filed by Julie Mauck, real estate agent and Oconee County chair of the far-right group Moms for Liberty.

In 2023, Mauck filed a lawsuit against Danielle Bonanno, then president of Athens Pride, alleging that Bonanno had broken the law by informing Mauck’s employer of the anti-LGBTQ+ comments she made at a July 2023 meeting of the Oconee County Library Board. At that time, the Oconee County Library was considering whether to move the graphic novel Flamer from the young adult to the adult section of the library as some residents were requesting. Mauck caused an uproar during the library board meeting when she accused the LGBTQ+ community of sheltering pedophiles.

“LGBTQ is an acronym for sexual affiliations. Lesbian, gay, bisexual, transgender and queer, and the plus is there to be all-inclusive down to pedophiles,” she said, pausing as order in the room was restored.

“LGBTQ+ is not for children. Any of it. None of it… Why would a small town library be participating in the gender ideology movement and recruiting our children?”

Mauck seemed to be making the discredited homophobic claim that LGBTQ+ people, usually gay men or trans women, are more likely to sexually abuse children than their straight or cis-gendered counterparts.

Soon after these comments, Bonanno wrote to Bob Allen, the owner and licensed broker of Greater Athens Properties, asking him to take action against Mauck, his employee.

Association of Realtors. In the complaint, Bell stated that Mauck had “made a public display of calling the entire LGBTQ community ‘pedophiles,’ along with calling for censorship of LGBTQ-related material.” Bell argued that this behavior was contrary to the National Association of Realtors’ code of ethics, which prohibits harassing speech, hate speech or slurs against people based on their sexual orientation or gender identity.

The Georgia Association of Realtors originally agreed with Bell that Mauck’s speech violated their code of ethics, but sided with Mauck upon appeal.

Mauck alleged in her lawsuit that Bell defamed her by filing the ethics complaint and had interfered in her business relationships. Mauck claimed that she didn’t call the entire LGBTQ+ community pedophiles, and that she didn’t advocate for the censorship of LGBTQ+-related material. Instead, she said that her speech at the Oconee County Library Board meeting was about protecting children from age-inappropriate books.

Stephens ruled that Mauck is a “person in the public eye” in part due to her position as the chair of the Oconee County Moms for Liberty chapter, her frequent radio and press interviews (including one she gave about this very incident) and because of her previous run for the Oconee County Board of Education. As a public figure, criticism of her beliefs or actions is protected under the First Amendment. However, the public nature of Mauck’s speech at the Oconee County Library Board itself would also be sufficient to establish First Amendment protection for critics, even if she was not so frequently in the public eye, according to Stephens.

As a result of this determination, Mauck’s lawyer was forced to show that she had a high probability of success on the rest of her case. According to Stephens, she did not.

“In many cases, Mauck’s purported falsities are not falsities at all, but are simply dissatisfaction with the fact that [Bonanno and Bell] relayed the substance of her own comments to others,” Stephens wrote. “Bell’s characterization of her comments at the Oconee County Library substantially aligns with her actual comments. In common parlance: that’s what she said.

“Mauck…does not hold a monopoly on how her own comments are received and interpreted by others,” Stephens continued. “An actionable falsity does not exist simply because Defendant Bell interpreted Mauck’s comments differently from how Mauck prefers that they be interpreted.”

“[I]t has come to our attention that Julie Mauck, one of your newer employees, has a history of being an anti-LGBTQ+ extremist, being vocal about her discriminatory views and engaging in harassment towards our community, including queer children and families,” Bonanno wrote. “I kindly request that you conduct a thorough investigation into this matter and take appropriate action to address Julie Mauck’s behavior.”

The next day, Allen agreed to terminate Mauck’s employment. In her lawsuit, Mauck argued through her lawyer Jonathan Vogel that Bonanno’s comments were false. She said that she does not discriminate against LGBTQ+ people and that she does not hold anti-LGBTQ+ views. Mauck and Vogel argued that Bonanno’s comments to Mauck’s employer could be considered a violation of Georgia’s Uniform Deceptive Trade Practices Act.

Soon after Bonanno sent her letter, Athens resident Felix Bell filed an ethics complaint against Mauck with the Georgia

The Coalition for Liberty, a conservative nonprofit opposed to what they call “cancel culture,” assisted Mauck in her lawsuit by paying her legal fees, according to the Daily Signal

“If somebody is knowingly and intentionally lying about you to try to silence your voice, that’s the essence of cancel culture,” Coalition for Liberty President Doug Turpin told the Daily Signal. “Our mission is to stop people on the left from trying to suppress and silence other people’s voices.”

Bryan Cave Leighton Paisner, an international law firm based in Missouri, agreed to represent Bonanno and Bell pro bono throughout their lengthy court battle.

Western Circuit Superior Court Judge Lawton Stephens made the initial ruling on this case, issuing a 52-page ruling on Nov. 18, 2024.

Mauck needed to show that Bell’s speech was not protected by the Constitution or, even if it was, that she would be highly likely to succeed on the other claims of her case anyway. For example, she needed to show a probability that Bell deliberately made false statements to the Georgia

Stephens dismissed Mauck’s accusations against Bonanno using similar language, writing that Mauck’s request of the court was “antithetical to both federal and state constitutional protections for free speech.”

Mauck appealed Stephen’s decision, and the case stretched on for another full year. On Nov. 3, a three- judge panel of the Georgia Appeals Court unanimously affirmed Stephens’ 2024 ruling, with Judge Jeffrey Davis authoring the decision.

“We conclude, as did the trial court, that public statements in a public forum alleging that a group is ‘inclusive of pedophiles’ are matters of public interest and public concern,” Davis wrote. Later in the ruling, he emphasized that “Mauck cannot demonstrate that Athens Pride or Bonanno made a false or misleading statement,” while “Bell’s statements were simply based upon facts that were disclosed [in his ethics complaint] and merely reflected his own interpretation of Mauck’s statements, which is not actionable.”

Mauck has appealed yet again—this time to the Georgia Supreme Court, which has yet to decide whether to take up the case. For now, Mauck and the Coalition for Liberty are on the hook for hundreds of thousands of dollars of legal expenses for both their own legal team and for that of the defense. Given that an appeal is pending, Bell and Mauck have both declined to comment on this story. Bonanno did not decline, but has yet to comment. f

SEVENTY YEARS AGO, SHE SPARKED THE CIVIL RIGHTS MOVEMENT

She took a stand by sitting down in a segregated bus in Montgomery, AL on Dec. 1, 1955. She was arrested and jailed but didn’t surrender. Today, 70 years later, Rosa Parks is hailed as “the mother of the movement” that brought the eyes of the world to the heart of Dixie, and catapulted a young Baptist minister named Martin Luther King Jr. into the forefront of the campaign against racial injustice in the Jim Crow South and nationwide.

An individual act of courage by a Black woman named Rosa Parks would lead to a freedom movement eventually involving millions of Americans of every race and region united in a campaign for this nation to live up to its pledge of “liberty and justice for all.”

City buses had long been racially segregated in Montgomery, and scattered protests against the system happened as early as the 1940s, but it was Rosa Parks who brought organized activism to Alabama’s capital city in 1955 with the historic Montgomery Bus Boycott that began just days after Parks was arrested for not giving up her bus seat to a white man. “I knew someone had to take the first step, so I made up my mind not to move,” she recalled. By not moving, Parks sparked a citywide bus boycott in Montgomery’s

death in 2005 at the age of 92. In 1943, while Americans fought fascism overseas, Parks defied authoritarianism in Alabama by attempting to vote. She was turned down. That same year Parks was forced off a city bus for not entering through the back door of the conveyance. In 1945, as World War II ended, Parks finally received her voting certificate, but millions of other Black Americans, including many who had served in the war, were still disenfranchised. Parks worked to end that injustice through her service with the NAACP and other civil rights organizations.

“ I knew someone had to take the first step, so I made up my mind not to move.

Parks decried “discrimination and acts of violence against Blacks, such as lynchings, rapes and unsolved murders” like the murder of a 14- year-old African American named Emmett Till in Mississippi just four months before she was arrested in Alabama in 1955, a crime detailed in a 2024 book The Barn: The Secret History of a Murder in Mississippi by Wright Thompson. The Till case and Alabama’s ingrown injustice drove Parks to action 70 years ago. “I felt like I could no longer sit passively by and accept the Jim Crow laws,” she said. “A better day had to come.”

In 1957 Parks moved to Detroit, and it was there that her long life took a frightening turn in 1994, when she was 81 years old and still earning worldwide accolades for her decades of activism.

Black community that lasted for over a year and led to a decisive victory over the city’s segregated transit system.

Parks worked as a seamstress, and she was heading home from her job when she was arrested, but her political activity started long before that fateful December night in Montgomery. Born in Alabama in 1913, when lynchings and beatings of African Americans were common punishments meted out by white supremacists in the state, by the time she was 30 Parks had embarked on a career of activism that would span more than 60 years until her

While alone in her apartment, Parks was robbed and beaten by a 28- year-old man named Joseph Skipper. Public reaction in Detroit was furious, and even the criminal’s own mother said jail would be a fitting place for her son.

The Detroit Free Press editorialized about the “cruel irony” of the crime and asked, “How could a woman credited with sparking the nation’s civil rights movement to obtain equality for black people be assaulted by a black man?”

Skipper was caught and convicted, and subsequent imprisonments for similar crimes have him incarcerated in Michigan until at least 2030 and possibly until 2045. Billionaire businessman Mike Ilitch of the Little Caesars pizza chain, meanwhile, moved Parks into a safer residence and paid her rent until her death in 2005, so the story had a happy ending for the woman who was celebrated in song by the Neville Brothers: “You started our freedom movement. Thank you, Sister Rosa Parks.” f

Local promoter Shadebeast is putting on a show featuring three heavy rock bands. Music Hates You is a rock band infused with the energy of stoner metal and hardcore, originally formed by Noah Ray, Zackery M. Hembree, Forest Hetland and Greg Carlson. The band debuted with Drugs in 2001, an entirely self-made album with only a few physical copies in existence, and since then has become known for its live performances, which it describes as “a hurricane of sweat, blood, spit, whiskey and shattered equipment.” Marses, a heavy rock band, will be playing the show to celebrate its album release. Marses currently has two singles out on Bandcamp called “I eat a Pony” and “shitknife.” Finally, heavy weirdo rock band Volt will round out the bill. [MB]

Nuçi’s Space Celebrates Milestone

Ifyou ask any musician in Athens about Nuçi’s Space, the odds are very high that they have a connection of some sort to the nonprofit—it could be as simple as renting gear and rehearsal space, or as meaningful as getting their start playing music as a kid through Camp Amped and getting mental health care during their lowest point in life. On the corner of Oconee and Williams streets just outside of downtown, Nuçi’s Space has been bolstering the local music community and saving lives for 25 years.

When the health and resource center for musicians opened, CEO Bob Sleppy says that there was only one similar organization in the country—the SIMS Foundation in Austin, TX— but now there are hundreds. For a nonprofit whose vision is to end suicide, this brings exciting new possibilities in establishing a safety net for musicians.

“I feel like there’s an opportunity for us to look outside of Athens, not necessarily to franchise, but to figure out, how do we build relationships with outside organizations and learn from what they’ve done, and also teach what we’ve learned? And so we can build a stronger network for musicians, like if they’re on tour,” says Sleppy. “Building a stronger network of organizations and people that are willing to help, not only their local music scenes, but more national.”

With 25 years of experience and knowledge to share with fledgling organizations, Sleppy is also eager to learn how others are building on the concept and making it even better. Sleppy says that nonprofits are often so strapped for resources and cash that they don’t often get to work together. One of the biggest changes at Nuçi’s Space, taken to prepare for this future of possibilities, was Sleppy taking a sidestep as CEO to make room for Debbie Watson as executive director. This decision was made, he says, to help the team concentrate on developing relationships with these outside organizations.

Organic relationships are made through building trust and encouraging people to take the steps they need or try something different.

“Our values and motives are pretty simplistic, but I think they’re powerful when they’re compounded by the entire community, because we wouldn’t have lasted this long without that support. What I’m hoping [the anniversary concert] next Friday is, is everybody coming together and realizing we all did a pretty amazing thing, and it couldn’t have been done without everybody involved. That’s what I really want to celebrate,” says Sleppy.

However, in everything that Nuçi’s Space does, it is essential to Sleppy that its employees and the community not forget the vision and values of the late founder Linda Phillips. The space was opened after Linda’s son Nuçi Phillips, a musician with a long battle with depression, committed suicide, in hopes of preventing other families from dealing with similar situations.

“To tie back to Linda’s legacy of being bold enough and creative enough to do something that hadn’t been done before, there wasn’t a model for us to copy from when we first started. We just knew there was a need, and we tried to fill it.”

A handful of years ago singersongwriter Ryne Meadow released a now-unavailable single named “I Love The Rain,” which was supposed to be the lead off his upcoming album Baptisms. Just recently, though, he released the single “Eden,” which is now the album’s lead single. This new one is a slower-paced, reflective tune that is carried by an electronic undercurrent that compliments the more traditional instrumentation here. NIGHTSIDE ECLIPSE: With his new album, Ixian (née J. Anderssen) goes as hard into his black metal tendencies as he likely ever has. The album, Eyes Upon The Horror, is a taut and economical six tracks, albeit the last one (“Zero Gravity”) is almost half an hour long. Absolutely shredding guitar soaks everything here and, when mixed with ample electronic manipulations and insertions, the whole record just beats you upside the head. However, in the same way your eyes will eventually begin to discern patterns—even if imagined—in a darkened room so will your ears find melody, bridges,

Now that the band let it slip out online, this collection—Happy Covid New Year (8Track Demo)—should be heard. This is like having a front row for your best friend’s punk band when you’re both still figuring out what that means. It takes about 30 seconds for the first song, “Emotional Train-Wreck Blues,” to get going, but once it does it’s a Dead Milkmenesque celebration of cowpunk styles with clever lyrics. The band keeps things steady with “Edge Of Rescue” and its “oh, I remember this from late-night college radio” vibes. It slows things down for the comparative marathon of six-minute “Bulletproof,” which manages to be a meeting of jangle pop and The Who. Totally unexpected and quite refreshing.
