TAX RULES ON DIVORCE
A
divorce can be difficult enough without paying unnecessary tax because you are unaware of the rules in this area. Graham Doubtfire, Tax Partner at Scrutton Bland, explains some of the financial legislation which may affect your settlement. Capital gains tax (CGT) When a couple are married and living together, any transfer of assets between them will take place at ‘no gain/no loss’ (NG/NL) meaning that no CGT will be payable. However this marital tax benefit ceases at the end of the tax year following separation and not on the Decree Absolute. Since the tax year runs from 6 April to the following 5 April, the closer a couple separates to 5 April, the less time they will have to transfer any assets if they wish to make use of the NG/NL rule. Following the tax year of permanent separation, but before the Decree Absolute, spouses and civil partners are still classed as ‘connected persons’ for CGT purposes. is means any transfer of assets will be deemed to have taken place at market value, regardless of whether any actual proceeds were received. erefore CGT will be due on the market value less the cost of the asset. If the asset has appreciated significantly since acquisition, there could be a large amount of CGT due. Private Residence Relief (PRR) One of the largest assets is often the matrimonial home. is may end up being sold to a third party, or one person in the marriage transferring all or part

of their share to the other as part of the settlement. Generally, if a person has lived in the matrimonial home since they bought it, then the whole of their gain on the property will be covered by PRR. However, if there have been periods where the property was not lived in, or another property was elected to be the main residence, the relief could be restricted. CGT charges can also arise where one party moves out of the matrimonial home and the time to agree a settlement and effect transfers exceeds 18 months. However there are special rules on divorce which allow the relief to be extended if all of these conditions are met: one partner stops living in the family home because they have separated; the partner that moved out hasn’t notified HMRC that another house is to be their main residence; that partner later transfers their interest in the family home to their ex; the ex keeps living in the family home as their main residence; the transfer is made as part of the divorce settlement. is special rule does therefore not apply if the home is sold to a third party. e spouse giving up the ownership of the family home also needs to take care if they have acquired a new residence, because generally only one property can qualify for PRR. A divorce is often complex. It is important to review all matrimonial assets and seek professional advice to ensure settlements are structured efficiently and no one is unintentionally left with an unwelcome tax charge. n

and ditches throughout the Forest. Wild garlic has a distinctively strong smell and may be found growing en masse in especially damp areas. Finally, the primrose is an unmistakable, low growing flower which can be found across the woodland any time between December to May. e Lower Forest, between Epping and ornwood, is however a stronghold for this sturdy little plant. his is the time of year when the ancient woodland of Epping Forest wakes up from the slumber of winter and bursts into colour. e green shades of the new life emerging from the trees are perhaps never quite so vivid as at this time of the year, making a visit to the Forest just now so very worthwhile. However if you look around you, other cheery colours can be found in the form of flora brightening up the landscapes once again. Following the harsh frosts and snow we’ve experienced this winter, the first spring flowers are boldly popping up ready to put on their fine, long-awaited display. A classic spring flower is the bluebell and Epping Forest is one of the greatest places to experience the haze of blue on the woodland floor which can be found towards the end of April and beginning of May, depending on the weather. Chalet Wood in Wanstead Park is a popular spot for such an experience. You can check the Epping Forest website www.cityoflondon.gov.uk/eppingforest to find out when the bluebells are at their best this year, to plan your visit. Please ensure that you keep to the paths and do not pick or trample the bluebells. Please enjoy them but leave them where they belong for all to enjoy and to ensure that the glorious display continues to be an annual feature for generations to come. ere are of course, other ephemeral and cheery spring blooms to look out for. e common dog violet is an exquisite little flower in regal colours which can be found throughout the Forest. e Cowslip, which prefers more grassy areas, can be commonly found on the Forest’s Buffer Land. e Cuckoo flower, with a name that evokes the atmosphere of spring, which can sadly be found with greater ease than its now unfortunately rare name-sake. The Willingale Treasure A medieval gold ring has been found in the parish of Willingale and we need you to help us keep it in the district, before the item goes on sale on the open market. It is the first medieval gem set ring to be found in the district, and the first known finger-ring to be discovered in Willingale. e decoration is of an extremely high standard and, to the best of our knowledge, unique.

its reserves leaving £3,000 to be raised. If the target is reached, the ring will go on public display in the museum’s newly renovated core gallery. If the funding is not raised, the ring may be sold and possibly leave the UK permanently.
Other treasures at the museum Currently on display is a selection of items acquired by the museum through the national Portable Antiquities Scheme, which recently celebrated 20 years of recording treasure finds. On display are items found from all across the Epping Forest district. e oldest are a bronze axe and small gold bead, which are some 3,500 years old, also displayed are medieval Noble coins of Edward III found near Abridge and a fine silver gilt medieval crucifix discovered near North Weald. With such treasures found with our local areas, it would be such a shame if they were to be moved outside. Let’s keep our treasures in Essex…n

easons Art Class is throwing open its doors this month to new students who are interested in teasing out their creative skills. Tutor Adelaine Frank has established a new concept in weekly adult part-time creative art courses for 14 weeks, run throughout the year. Classes start again on Tuesday 24th April at Chingford’s Arts Commune plus an Evening Class there that also features life drawing and portraiture. On Wednesday 25th April students are welcome to the morning class at LifeWorks at the back of Loughton Methodist Church. Designed for absolute beginners or improvers
the courses offer an easy step-by-step guide to draw, paint and create. It’s ‘hands on’ with lots of support and demonstrations while learning new skills. e class has the added benefit of tutor Jim Jack, a sculptor and local artist. Both tutors provide one-to-one advice and all the help needed to develop individual artistic skills. Joining the team is Kelly Frank, Adelaine’s talented daughter who brings a new edge and challenge to those wanting to take their art to a new level and a change of pace. Kelly competed in this year’s Sky Arts TV series Portrait Painter of the Year competition with the final last month. In her heat Kelly’s had to paint actress Michaela Coel. She said “It was an exciting and challenging experience. e competition tests your ability to work under pressure. I had to make decisions quickly and being timed was a first for me. I learnt a lot and it was also great to be surrounded by other budding artists and watch other methods of painting unfold.” n

WHAT TO DO IF YOUR CHILD DOES NOT GET INTO THE SCHOOL THAT YOU WANT?

housands of parents have recently found out, or are still anxiously awaiting to hear from the appeals process, whether their child has been given a place at their chosen state school. Admissions days are anxious times for parents, and often with good reason as local trends for the percentages of families awarded first choices are decreasing. Not every child is successful and to avoid some of the stress, here is a guide of to what to do next and answers to frequently asked questions. Why hasn't my child got a place? e council's admission authority is in charge of offering school places. If there are more applications than the number of children the school admits, the council will offer places to children according to a list of rules. e rules are known as ‘oversubscription criteria’ and they may include how close you live to the school; if a sibling already attends or compelling medical or social reasons for a child to attend a specific school. Will my child go on a waiting list? Any child who is not allocated a place will be added to a waiting list. Sometimes a place will become available in early September, if children move schools. Try not to panic - Remember that your child is not starting school until September so there is still quite a lot

of time for your situation to change. Look at your other options - More and more families are choosing private education instead of going with the state. One of the most important factors that parents consider is the size of the school. Smaller, nurturing environments can offer a more personalised service. WRITING FICTION AN INTERVIEW WITH FISH MEDIA COLUMNIST AND LOCAL WRITER –
MICHELLE B. HARRIS
M
ichelle Harris has been writing for the Essex series of Fish Media Group for many years. As a regular columnist she receives a lot of emails from the readership with requests for her to write and publish fiction. Michelle: I’ve always written fiction. Running my business, Star Copywriting, will always be my priority but fiction is another angle to my writing. It’s fantasy and I can unleash my creativity into a literary format. Is there a clash? Michelle: Not at all. All forms of writing merit creativity, insight and structure. If anything, writing fiction helps the copywriting because it opens boundaries and helps me to explore new realms. It keeps my work fresh. I suppose you could call it a writing ‘work out’. What inspires the fiction? So much. My travels, people, their comments and lives and then sometimes a

chance remark can inspire an idea, a theme for a short story or book. People are intrinsically complicated, understanding the decisions they make and based upon their own life’s experiences is endlessly fascinating. Always at the back of my mind is - what if? And then I turn into a story. Psychology is also very important with copywriting, I always need to consider why people (target audience) would make the decision to buy my clients’ products and services and how they would benefit as a result. e next step is the emotive and strategic language in simplified format to support the analysis. When do you have time to write fiction? I know you’re busy with other work. I always keep notebooks in my bags and on my desk. I jot down a thought, an idea, a comment. Or if I’m on a train, plane or even sitting in a park in London, I relax and just let the ideas flow. I will then allocate the necessary time to develop a theme or character. Explore it, get to know the characters, walk around with them in my head and try to see the world from their eyes. ere are months of contemplation before a single word is written. So when you’re not writing - you’re writing. Absolutely. I can’t help myself. Writing defines me – I suppose you could call it an addiction. But a good one… n

Established 36 years ago as a classical music charity event, Henley Festival continues to be run on a not for profit basis supporting charitable projects at both a national and local level. This year proceeds from the festival will go to two charities. Dedicated to supporting young people with depression, and encouraging discussions around mental health, the Charlie Waller Memorial Trust was set up in memory of a young man who took his own life whilst suffering from depression. The Teenage Wilderness Trust supports students who find it difficult to engage with mainstream education by offering reengagement courses using bush craft, wilderness learning techniques and practical life skills to encourage students to get back into learning.

A recent challenge was to put together a multi-centre tour of Japan over three weeks for two people. Phil called on his considerable expertise and looked at several round-trip tours taking in highlights like Tokyo, Hakone & Mount Fuji, Kyoto and Hiroshima. However, as with most land-based tours the cost was in excess of £4,000 per person, way over budget. Although hotels and transportation in Japan can be incredibly expensive, cruising can get you where you need to be while providing luxury accommodation; incredible culinary experiences, all at the fraction of the price. As luck would have it Princess Cruises offered two back to back cruises, one of seven nights followed by another of nine nights, on board their Diamond Princess. is would give just over two weeks visiting not only Japan as the itinerary also included South Korea and Taiwan. Adding a few nights in Tokyo pre-cruise plus another three nights in Kyoto at the end made this the trip of a lifetime. It was much more than the clients had dreamed of and inside their budget. e cruise on Diamond Princess in Japan is

As well as a full day tour of Tokyo the itinerary included a visit to Hakone National Park and on to explore Mount Fuji, returning to Tokyo on the bullet train. e itinerary for both cruises took in highlights of this vibrant and diverse area offering the perfect blend of intoxicating culture and world-class cuisine. From Eighties-tastic onesies to uber-cool kidswear, LAUREN TAYLOR delves into the archives to check out their slope-style highlights.
T
he ability to ski is pretty much a rite of passage for members of the royal family, who are famously fond of their annual trips to some of the world’s most exclusive resorts. Favourites through the years have been Lech in Austria, and Klosters in Switzerland, both traditional and very upmarket, with some of the most expensive chalets going. Princes William and Harry have been hitting the slopes since they were nippers - and a browse back through the royals’ winter holiday snaps shows just how much ski fashion has changed over the years! Here’s a look at how the royal family absolutely owned Eighties and Nineties skiwear...
Late-Eighties The world will never be able to top Eighties ski fashion, when those dazzling all-in-one suits were introduced. Of course, Diana sported the most chic outfit of this royal party - a black onesie with a florescent green and pink pattern. Two years after William was born, Charles and Diana had a skiing break on the slopes of Liechtenstein. Helmets were never the norm in ski resorts at this time - but bulky mittens certainly were. The royals would have had to wear quite a few layers under their all-in-ones to keep warm, because clothing technology wasn’t as advanced as it is today.
Early-Nineties As the Nineties came around, everyone wanted to sport an ultra bright colour against the white snow. Diana’s strange woolly hat/neck-warmer get-up doesn’t look like it did either job particularly well... Kids’ skiwear became very cool in the Nineties - featuring a lot of clashing colourful panels and 2 46 6 AAPPRRI ILL/ M2 A 0 1Y8 2 0 1 8
geometric patterns. And of course, young Harry and William were ahead of the game. Puffer jackets took off in the Nineties too. Many featured a belted waist, but Princess Diana made sure she stayed warm in this bright red oversized puffer. It’s worth noting that goggles weren’t seen as necessary ski attire at this time, and many people, like the royals, only wore sunglasses on the slopes. In 1994, William and Harry reached peak Nineties ski fashion - complete with patterned bandanas and reflective shades. Dad Charles even sported a neckerchief, but appears to have a favourite sturdy grey all-in-one which he’s worn on many, many ski trips.

Mid to Late-Nineties The Duchess of York and her daughters Beatrice and Eugenie (now newly engaged, of course) have spent many winters skiing. We particularly love Fergie’s loud, patterned onesie with clashing green necktie. On the other hand, Eugenie made a very stylish four-year-old on the slopes, with coordinating belt, helmet and boots. And is that a bum-bag we can see? Snowboarding became fashionable in the Nineties and Harry, being the trendier Prince, tried it out. Both brothers upgraded from onesies to twopieces in much more subdued colours by the time they were in their teens, when salopettes became the go-to style. Although Charles still wouldn’t let that grey all-in-one go.
The Noughties The early-Noughties saw many skiers mixing and matching different coloured ski jackets with trousers, but generally styles were more subdued than in the Eighties and Nineties. Although William did make a bold choice with his purple Patagonia
jacket... Prince Charles and William took a father-and-son trip to Klosters in 2004, and although Charles mixed it up this time with a navy all-in-one, he made a questionable fashion choice with this night cap. The Duke and Duchess of Cambridge have continued the tradition of royal skiing holidays, but instead they take their family to France. In 2016, they dressed George and Charlotte in very cute onesies (and much more modern than any of the outfits William sported as a child!) for their trip to Courchevel. Kate is wearing the practical-yet-fashionable Sorel snow boots and a stylish fitted jacket with a faux fur trim. Next thing you have a device thrust in your mouth and then you start to gag. or a lot of households, there comes a time when your home becomes a bit of a squeeze. Maybe you have had more children, or have embarked on working from home. So should you move somewhere bigger, or extend your house to make it large enough for you and your family’s needs? An extension can radically improve a property. Bigger, better space and extra rooms can add value, and make a house more attractive to buyers. Your location, and the level of demand for your type of home, could make a big difference to the financial implications of extending versus moving. In highvalue areas in London it can be more worthwhile digging under the house to add a basement conversion. The reality is that if you are able to extend, it is often sensible to do so from a financial point of view. The cost of buying a new house would far outweigh the cost of building. The old dining room can become an office, playroom, or an extra sitting room. Kitchen extensions also provide the opportunity to extend upwards - an additional bedroom can be built on top at the same time.

moved or replanted, so it may take a year or two for them to settle in before flowering. If you are transplanting existing plants, do it in early autumn or spring, keeping the rootball as intact as possible.

That largely depends on the weather. Vast bowls of petals emerge from thick stalks above the pretty foliage in late spring and early summer, which will need supporting with a stake or frame to stop them falling over in the wind. The flowers of herbaceous peonies are shortlived, lasting little more than a week or two, and if it rains they won’t last that long, as wet weather tends to make them flop, particularly the heavy, double flowered forms.

undits have been predicting that peonies may feature in Meghan Markle’s wedding bouquet, so enamoured is she with these saucer-sized romantic blooms. In the early days of dating Prince Harry, she posted a picture of a beautiful pink and white spray of peonies on Instagram, with the caption: ‘Swooning Over These. #London #peonies #spoiledrotten. You too could have peonies flowering in your garden come early summer, and some will be at their best around the time of the royal wedding in May. Their blousy blooms, in shades from deep red to white and everything in-between, add a touch of glamour to borders and, if you can bear it, you can cut them and bring them indoors.
How easy are they to grow? Pretty easy, in the right conditions. The pot-grown peonies you find in garden centres can be planted at any time of year, while bare-rooted types are ideally planted in October. They prefer heavier soil in a sunny or slightly shaded spot, and add plenty of organic matter to the planting hole before you start. Don’t let them get waterlogged, though. Add horticultural grit if the soil is extremely heavy. Don’t plant them too deeply - the soil should just cover the topmost tuberous roots. Mulch them lightly in February or March with potash-rich wood ash to increase flower production. If you want huge flowers (but less of them), debud the sideshoots in April or May with a sharp knife.
How long will the flowers last?
Any recommended varieties? If you want huge pink fragrant double flowers, try Paeonia lactiflora ‘Sarah Bernhardt’, which is favoured by commercial cut flower producers. Familiar favourites include P. officinalis ‘Rubra Plena’, a deep red, frilly double cottage variety, or if you want a larger tree peony, growing up to 2.5m, consider P. ludlowii, which bears zingy yellow saucer-shaped flowers. For a longer flowering period go for ‘Bowl Of Beauty’, a Japanese type which flowers for almost twice as long as the others and has a fantastic fragrance, growing to around 90cm, so it will need staking.
Any rules for cutting? Don’t cut stems in their first year of planting. Leave the plant to strengthen a bit and you’ll have more blooms to cut the following year. Always leave at least a third of the stems on each plant, which will help it gather strength and feed the root through summer and early autumn.
Indoor tips Acclaimed floral designer Judith Blacklock, founder of The Judith Blacklock Flower School (judithblacklock.com) in London, explains: “You must cut peonies in bud but there must be some colour showing in the bud or it won’t open.” She recommends pairing peonies in arrangements with astrantia and Alchemilla mollis. Peonies are thirsty cut flowers, so fill up your vase every day with fresh water and they should last about a week. Snip off the base of the stems every couple of days to help them last a little longer. “Remove the lower foliage but don’t discard it as you can mass the leaves together and they will look gorgeous,” Blacklock adds. “The cooler the atmosphere inside, the longer the flowers will last.”
