Make your wishes known Lasting Powers of Attorney
T
he recent change to the law that presumes you wish to donate your organs unless you have opted out, is a timely reminder that everyone should make their wishes known in the event of death, or incapacity. The obvious method of recording wishes in the event of death is in a Will, but what happens when people become incapable of managing their own affairs through physical illness, or mental incapacity. Discussing these issues within a family can be awkward, because no-one wants to predict the worst, or become a burden, but effective communication is essential should tragedy strike and clearly expressed intentions help prevent confusion and heartache. A good way to make sure intentions are met is to create Lasting Powers of Attorney (“LPAs”) that empower trusted family and friends to manage a person’s financial affairs and safeguard their health and welfare. An LPA is a legal document in which the ‘donor’ appoints one or more ‘attorneys’ to help make decisions, or take proxy decisions. Although the donor may no longer be able to manage their own affairs, the LPA gives control over what happens to them if they suffer an accident, or illness, and can no longer make their own decisions (‘lack mental capacity’). The donor must be 18 or over and still be capable of making their own decisions at the time when the LPA is created. There are 2 types of LPA and a donor can make one, or both: • property and financial affairs;

• health and welfare. An LPA for managing property and financial affairs gives an attorney the power to make decisions about money and property, such as: • managing a bank or building society account • paying bills • collecting benefits or a pension • selling property This can be used as soon as it is registered, with the donor’s permission. An LPA for managing health and welfare gives an attorney the power to make decisions about things like: • daily routine, for example washing, dressing, eating • medical care • moving into a care home • life-sustaining treatment It can only be used when the donor is unable to make their own decisions. Making an LPA is straightforward. Firstly, the donor needs to chose one, or more, attorneys who agree to act. Then the donor should download (or complete online) the forms published by the Office of Public Guardian, with whom the donor can register the completed LPA on payment of a fee of £82.00 (there are fee exemptions for some people). LPA’s can be cancelled, or varied, at any time. The rise of probate disputes T
he number of probate disputes in the High Court has been increasing steadily in recent years. Many people assume that when someone makes a will it is final and beneficiaries and family members are stuck with it. However, more and more people are now beginning to challenge wills. What are the grounds for challenging a will? There are many different grounds to challenge a will. The first step is to establish that you or the person challenging the will has a legal right to do so. Valid reasons to contest a will include: • Lack of due execution – that the will did not comply with the formalities of a valid will. • Revocation – that the will has been revoked or in some way rendered invalid. • Lack of testamentary capacity – the person making the will must have had mental capacity when making the will. • Lack of knowledge and approval – the person making the will must know and approve of its contents. • Undue influence – the person making the will was coerced into making a will that they did not intend. What if the will is valid but does not give reasonable financial provision for me? Even if the will is valid, certain relatives and dependents can challenge the division of the estate by claiming under the Inheritance (Provision for Family and Dependants) Act 1975 that it does not make “reasonable financial provision” for them. There are certain statutory criteria that the court must take into account when considering a claim for reasonable financial provision and these are: • The financial needs and resources of the beneficiaries and applicant(s). • Any obligations and responsibilities the deceased had towards any applicant or beneficiary. • The size and nature of the estate. • Any disability (physical or mental) of any applicant or beneficiary. • Any other matter, including the conduct of the parties. Why are probate disputes increasing? There are several factors which explain why the number of cases is increasing: • Increasing life expectancy means that wills are more often changed later in life, causing concerns of capacity. • Increasing property prices have considerably increased estate values and with more money “in the pot”; people are more willing to challenge the terms. • Family structures are increasingly diverse and complex e.g. second spouses and children from first marriages are all likely to expect to benefit from a will. • DIY wills have also been identified as a factor.

Whilst they are legal and initially a cheap option, drafting errors can cause confusion and result in costly applications to the court to clarify the terms of the will. What can I do to prevent a future claim against my estate? It is always best to use a professional to draft your will to ensure it is valid and correctly reflects your wishes. London’s most iconic private members club, TRAMP is celebrating 50 years at the pinnacle of the nightlife industry

pened in December 1969, the Jermyn Street club has welcomed a who’s who of A-list celebrities through its unassuming doors and into the 300-capacity basement of bacchanalia, below. Original members included Sir Mick Jagger, Sir Roger Moore, Sir Michael Caine and sisters Joan and Jackie Collins, but the club quickly became a magnet for movie stars, musicians and even royalty, and before long, Tramp became a byword for sophisticated debauchery. During the 1970s it wasn’t uncommon to see George Best on the dance floor while Sir Matt Busby frantically called the club’s front desk, trying to locate his absent star player; Marlon Brando holding court in the restaurant over a glass of scotch and Amaretto; and Frank Sinatra relaxing on his favourite seat in the lounge area, where guests would fall over themselves at the sight of Ol’ Blue Eyes as they emerged from the adjacent women’s toilets. Sir Rod Stewart once said of the club: “I remember coming out of Tramp when I used to play Sunday morning football and I’d get home at about four or five in the morning and I’d get up about three hours later for an 11 o’clock kick off smelling of booze!” The club’s original decor has been lovingly preserved, with beautiful, 17th Century oak panelling throughout and chandeliers from the Rothschild Palace hanging from the ceilings - save for one, memorable absence, where legendary The Who drummer, Keith Moon leapt from his table and brought the chandelier crashing to the floor before being escorted from the club screaming: “You can’t ban me from Tramp! Where else will I go?”

He was welcomed back 24 hours later, after apologising profusely and paying for the damage. But while celebrity anecdotes undoubtedly helped to build interest in this mysteriously secretive club on the border of St. James’s and Mayfair, it has flourished through five decades thanks to its core principles: To offer luxurious service and fine dining in a relaxed and sociable environment; and to treat every member as a VIP. General Manager, David Fleming, says: “Tramp is more than just a members club. It is an intimate space with a limited membership and we pride ourselves on being able to welcome each and every guest by name, remember their favourite drink and where they like to sit in the restaurant or bar. “The club was built on quiet word-of-mouth, with our details being passed on by members on film sets, in business meetings and between bands, and over the years it has almost become a ‘password’ around the world; members frequently tell me how they’ve been to a far flung place and been given the best table in a restaurant because the owner is also a member of Tramp. “We talk about our membership as a family and in many cases, they really are - we have original members whose children and even grandchildren have grown up and joined the club and three generations can use it together. “If these walls could talk, they’d have a lot of stories to tell; but of course, they wouldn’t say a thing - because that’s the Tramp way.” The club launched its 50th anniversary celebrations with a star-studded party in May, attended by Sir Rod Stewart, Sir Michael Caine, Dame Joan Collins, Bill Wyman, Nathalie Dormer, Mark Ronson and many more, and members will enjoy further special events throughout the rest of the year. Civil Partnerships
are they the way of the future? A Civil Partnership is a legally recognised relationship between two people and offers many of the same benefits as a conventional marriage. Civil Partnerships were introduced in 2004 by the Labour government under the Civil Partnership Act, applying to same sex couples over the age of 16. At that time, same sex marriage was not yet legal in the UK. This came into effect in 2014. In response to an outcry from mixed sex couples wishing to enter into Civil Partnerships in England and Wales, former Prime Minister Teresa May announced that the law would be changed to allow mixed sex couples to enter into a Civil Partnership. The Government stated that it would address the “imbalance” that allowed same sex couples to choose between having Civil Partnership and getting married, a choice mixed sex couples did not have. The new law came into force on the 2 December 2019 and is likely to herald a major change for 2020. The Government estimate that around 84,000 mixed sex couples could enter into a Civil Partnership in 2020. What’s the difference? Those in a Civil Partnership enjoy the same rights and benefits as those in a conventional marriage in terms of tax benefits, pensions and inheritance. The major difference and it may be argued, “the attraction of ” the Civil Partnership is that unlike a conventional marriage there are no religious implications attached to Civil Partnerships which make them highly desirable for those that wish to legally recognise their relationship, whilst not 30 FEBRUARY 2020
wishing to align themselves with any particular religion. The civil ceremony takes place in front of a Registrar as opposed to a Vicar or Rabbi and importantly, the ceremony does not involve the parties exchanging vows. The Civil Partnership becomes valid after the Civil Partnership Document is signed. The parties do not refer to one another as “husband” and “wife” but rather as “civil partners”. In the event that a partnership breaks down and requires dissolution, the process is similar to a conventional divorce however the exception is that adultery cannot be relied on as a basis for dissolution. It remains to be seen whether Civil Partnerships become the favoured option particularly as the legal protection afforded to Civil Partnerships is essentially the same as those afforded in conventional marriages but it is easy to see how in an ever changing world that marriage is viewed by many as outdated, steeped in patriarchal tradition with the bride being given away by their father and the promise to ‘obey’ their husband. Many couples who cohabit are not afforded the same protection under the law, despite popular belief and whilst for reasons of their own, they do not wish to marry, a Civil Partnership may well prove to be an attractive alternative. ischief Theatre, the Olivier awardwinning company behind The Play That Goes Wrong, has announced the full cast for Magic Goes Wrong, created with magic legends Penn & Teller. This will be the second production as part of Mischief Theatre’s residency at the Vaudeville Theatre, which opened with their new comedy Groan Ups in September 2019. In the next ‘Goes Wrong’ comedy to hit the West End, the original Mischief company play a hapless gang of magicians trying to raise money at a charity event. As the accidents spiral out of control, so does their fundraising goal. JJ Abrams is amongst the show’s West End producers. The Star Wars director is a self-confessed fan of Mischief, having produced the company’s Broadway transfer of The Play That Goes Wrong. n the leafy grounds of Bromley High School, a beautiful new junior school building is emerging. Motivating boys to achieve their potential B oys are being outperformed academically by girls from nursery to university and the gap is set to widen. In England, young women are now 36 per cent more likely to apply to degree courses than young men, official Ucas data reveals. Oak Frame Extension, East Sussex Historic building, conservation and restoration specialist, A.T. Palmer Ltd
A
T. Palmer Ltd is a well-established family business of three generations founded in 1949. Palmer Ltd ranks amongst Kent’s most respected historic building, conservation and restoration specialist contractors. We have an employed, highly skilled workforce covering all trades. Whatever the size or scale of the project our attention to detail is matched only by our determination to deliver a quality service. Traditional oak timber framing is an excellent way of extending a house. A. T. Palmer Ltd’s highlyskilled carpenters can construct an oak frame in the workshop, which can then be dismantled so that it can be transported to site to be re-constructed. The building is a Grade II listed detached property constructed out of brickwork with a timber frame, tile hanging and clay roof tiles. It retains a large amount of its original features and this was an important part of the client’s remit. As with many houses of this period the existing kitchen space was quite diminutive in relation to the size of the property. Our clients instructed Stephen Langer Architects to work up a design that would offer an open space kitchen that is perfect for 76 FEBRUARY 2020
modern day living but would also complement the existing structure. The site conditions and topography dictated that the timber-frame extension would require significant groundworks and retaining walls built to enable the extension to be positioned to maintain subservience to the main house. Although in generally good order, the existing house was looking a little tired and the bathrooms were a little dated. A complete overhaul including plumbing and electrical rewiring had been specified, all of which had to be carried out in a sympathetic and systematic manner. Our journey with this project started after being selected from a tender list of three by the clients. The works were scheduled into three phases: extension groundworks and brickwork; extension oak-framed roof; and existing house refurbishment. The final items of the refurbishment were timed to correspond with the completion of the main structure of the extension to maintain continuity of the project. The position of the extension required significant excavations and spoil removal and the proposed rear elevation external wall would in time become a tanked retaining wall as well. Once the brick walls had been built our carpenters came to site and carried out a detailed survey to enable them to construct the oak roof at our workshop in Smarden. From our experience we have discovered that this method of working is very beneficial for several reasons. Firstly, and very importantly, it is far safer to manoeuvre large, heavy sections of oak using our forklift within our workshop than it would be on site. Secondly, it is far easier to set out the timbers at ground level and on a flat concrete work area. Lastly, we are guaranteed not to lose any working days due to bad weather, this is important to us with deadlines to meet. Once the roof had been constructed, it was labelled and carefully dismantled and taken to site. Once on site a team of four carpenters and a machine operator erected the oak roof within a couple of days with only a few minor tweaks here and there required. The finished kitchen extension sits seamlessly next to the existing house, blending in as though it has always been there.

f your spider plant has lost its lustre, you’re done with your devil’s ivy and have lost your appetite for your Swiss cheese plant, it’s time to seek out some more unusual houseplants. You could go for a tropical look with parrot-shaped flowers, or something architecturally onpoint, or even a plant that grows coffee beans. So, what’s out there that you probably haven’t tried?
The parrot plant, also known as the Congo cockatoo (but officially Impatiens niamniamensis), is a striking plant which produces unusual red and yellow flattened tubular flowers with a green hooded mouth, dangling below leaves to provide an eye-catching display. Originally a stalwart in the African rainforest, it prefers a humid environment and is ideal in a heated greenhouse or frost-free room but keep it away from central heating because it needs moist air. Go Hawaiian tropical It may be rare, but the Hawaiian palm can bring a dash of the exotic into your home with its rich green leaves and sweet-scented jasmine-like flowers which bloom in October. This succulent, which doesn’t need much watering, makes its main growth in the winter months and is easy to grow indoors. Give it a light position inside in winter and a sheltered position in the house or garden in the summer, when it is dormant. Leaf through spots Variegated leaves are nothing new in the plant world - but what about spots? There’s a begonia out there

to give you spots before your eyes. The Begonia maculata ‘Wightii’ has a white dotted upper leaf and deep red underbelly and will do well in bright light but not direct sunlight. Keep the soil moist, watering once the top two inches of soil have dried out, but don’t let the plant dry out completely, and give the plant good humidity. Go batty The bat flower (Tacca chantrieri), so called because it mimics a bat in flight, is a striking houseplant whose large, rich leaves surround an almost black bloom with long ‘whiskers’ during summer. Plant it in well-drained soil, positioned in a shady spot with high humidity, so place the pot in a tray of wet gravel to keep the air around it humid. It will need repotting annually as it doesn’t like to be potbound. It’s a great alternative to an orchid. If you’re growing it from seed, soak the seeds for 24 hours before sowing. Astrologer Jane Struthers offers an introduction to lunar gardening, and tips to help you tune into the cycles of nature.
Are you a gardener who follows astrology? If so, you may be interested to know your garden could perform better if you plan your gardening schedule according to the path of the moon, through the zodiac each month. So says astrologer Jane Struthers, whose latest book Moonpower offers an introduction to lunar gardening. Here, she explains the basics...
So, how does it work? The basic principal is that the moon has a pulling effect on all water. This includes the sap in plants, which rises during the ascending moon and falls towards the roots when it descends. When the sap rises, it’s a good time to sow seeds; when it descends, it’s time to do work that involves the plant’s root system, such as planting seedlings, thinning them out and propagating by division or layering. Lunar gardening tracks the 27.3-day sidereal path of the moon, which is its journey around the zodiac in relation to the constellations, not the path which consists of one complete cycle of the moon’s phases, such as from one new moon to the next. How do you work out which phase you’re in? The easiest way for newcomers to lunar gardening is to download an app such as Moon & Garden (iPhone and Android), which gives details of the lunar calendar and shows you what you should be planting and the jobs you should be doing at any particular time. Where do signs of the zodiac come in? Each sign of the zodiac belongs to a particular element - Air, Earth, Fire or Water. The theory behind lunar gardening is that as the moon moves through each sign, it transmits the energy of that element to the earth. Whether you’re digging the soil, sowing seeds, transplanting seedlings, weeding, hoeing or pruning, always do it when the moon is in the appropriate element for the type of plant you’re tending. Fire plants (Aries, Leo, Sagittarius) These are plants grown for their fruits or seeds, including soft fruits such as strawberries, stone fruits like apricots and top fruits such as apples and pears, as well as tomatoes, cucumbers, chillies, peppers and beans.

Earth plants (Taurus, Virgo, Capricorn) These are grown for their roots and include carrots, parsnips, potatoes and onions. Air plants (Gemini, Libra, Aquarius) These are plants grown for their flowers, such as geraniums, violets and roses, as well as flowering bulbs and rhizomes. In the vegetable garden air plants include broccoli and artichokes, because their heads are flower buds. Water plants (Cancer, Scorpio, Pisces) These are all grown for their leaves. Lettuces, cabbages, leeks and leafy herbs are in this category. The idea is to only work on plants that belong to a particular element, or the soil in which the plants will be grown, when the moon is in that element. So, if you’re just tidying up your greenhouse to prepare to plant out tomato seedlings, do it on a Fire day. When should I harvest? Harvest Fire element plants on Fire days, preferably when the moon is ascending, but not on Air days. Harvest root plants on Earth days but not on Water days. Air element plants should be harvested on Air days but not on Fire days, and Water plants are best harvested on Fire or Air days. The moon’s influence regulates the amount of moisture in the plants, so storing them at the wrong time can mean they will be either too dry when you eat them, or too wet when you store them. Make sure you check on the correct lunar phase for the best result. Are there any times I should avoid gardening? Don’t do any gardening at least six hours either side of a new or full moon, and at least 12 hours either side of an eclipse, because the moon’s energy is too strong and may adversely affect the plants and the soil. Overview
Ambiance A bright, stylish and open restaurant, with a long bar and open kitchens showing the Chefs hard at work. We visited on a Friday evening with groups of friends and couples enjoying cocktails and dinner.
Service From the moment we walked through the door we were warmly welcomed and taken care of. Recommendations were made on the food and drink menu, with stories and knowledge shared against every item.
Food A blend of Argentinian and Italian dishes don the menu, giving a nod to the Italian influence and population found in Argentina. To start, we shared a tower of aubergine escalopes topped with creamy goats cheese and sweet caramelised onion. Grilled melty Provolone cheese was luxurious and topped with oregano and roasted peppers. And our favourite, traditional Argentinian Empanadas in a soft, moreish shell filled with beef, chicken and chorizo. For main we were recommended the La Maroma - four Argentinian steaks, each weighing in at 160g and served with a light garden salad and French fries. The fillet was melt in the mouth and perfectly cooked, and it’s a great way to try all four different cuts of steak (fillet, rump, sirloin and ribeye) together. For dessert our favourite was the pancake filled with dulce de leche and strawberries, topped with a creamy vanilla ice cream. 88 FEBRUARY 2020

Vault & Vine opens in Petts Wood “I t all started off as an idea of wanting a place for our family and locals to enjoy a quality drink in comfortable surroundings. We spent two years looking for the right area and when these premises on Petts Wood Square came up we felt it was the right location. It took a further eight months to obtain the required permissions and a further five months of refurbishing to get to where we are now. A lot of hard work and thought went into the design and layout of Vault & Vine by all members of my family to get the feeling we now have which is an upmarket, relaxed atmosphere during the week where customers can enjoy a taste of our premium wines, champagnes and cocktails whilst relaxing in either our sumptuous booths or cozy swivel chairs. At the weekends we wanted a busier, more fun vibe where our guests can unwind after a hard week’s work whilst still keeping in with our ethos of being a quality high end bar which provides waiter service from our smart, efficient and friendly staff to help keep our customers happy. We listened to what our guests want and have introduced afternoon teas and food platters and we are very pleased and excited at the feedback we are getting.
