Getting Your Personal Affairs in Order

Ensuring your affairs are in order is a crucial step in safeguarding your future and providing peace of mind for you and your family. Two key components of this process are creating a will and establishing lasting powers of attorney (LPA).

Wills

A will is a legal document that outlines your wishes regarding the distribution of your assets and the care of any minor children after your death. The intestacy rules are very antiquated and do not protect or provide for modern family structures. They also do not provide any protection in the event that a beneficiary is not capable of managing their inheritance after age 18. Relying on these rules is, in short, a recipe for disaster.

Having a Will is crucial for all business owners to ensure their business (and personal) assets are managed according to their wishes after their deaths. A well-drafted Will can help prevent potential conflicts among heirs, ensure the business is passed on to a capable successor, and provide financial

security for loved ones.

Getting a Will in place is the first step but it is important to then review and update your will regularly, especially after major life events such as marriage, divorce, the birth of a child or significant changes in your financial situation or the financial and personal situation of your beneficiaries. Regular updates ensure that your will remains accurate and reflects your current wishes.

Wills can be very simple and set out in black and white who gets what and when. However, for many individuals, a slightly more flexible structure is appropriate in order to provide greater protection for the family in the long run. For example, what if one of your beneficiaries is mid-divorce at the time of your death? Their inheritance might pass quickly through their hands and into the hands of a soon-to-be exspouse.

It is also important to think about possible protection on the first death. What if your partner remarries or enters into a new relationship following your death? If you have left

everything to them, those assets may not end up with your shared children and might instead pass to the new family.

Lasting Powers of Attorney (LPA)

A lasting power of attorney is a legal document that allows you to appoint someone to make decisions on your behalf if you become unable to do so. There are two types of LPA:

• Health and Welfare LPA: This allows your appointed attorney(s) to make decisions about your medical care, living arrangements and other personal welfare matters.

• Property and Financial Affairs LPA: This allows your appointed attorney(s) to manage your finances, including paying bills, managing bank accounts and selling property.

Common Misconceptions about LPAs

“I’m not old enough to need an LPA.”

If only I had a pound for every time someone said this to me. Incapacity is not only caused by age-related diseases such as Alzheimer’s or dementia though. It could be as a result of an accident, illness, stroke or heart attack to name but a few examples. Incapacity might also be temporary as we saw during the pandemic when some patients were put on ventilators for extended period of time.

“I Have a Will, So I Don’t Need an LPA”

Your Will appoints people to deal with your affairs after your death. Until that time, your chosen executors have no powers and your beneficiaries have no rights. A Lasting Power of Attorney appoints people to act for you during your lifetime in the event that you no longer have physical or mental capacity to do so.

“Everything is held jointly so I don’t need an LPA”

This is a common myth and one that can cause families a huge amount of stress and significant cashflow issues. Regardless of whether or not your joint owner is a spouse, banks will usually freeze a joint account as soon as they become aware that one party has lost mental capacity. An application to the Court of Protection is likely to take at least 9 months and cost a significant amount of money at a time when the family are already looking at increased costs and an urgent change in circumstances.

Having both types of LPA in place is crucial and protects not only you but also your family. An LPA:

• Ensures Your Wishes Are Respected: An LPA ensures that decisions made on your behalf align with your preferences.

• Prevents Legal Complications: Without an LPA, your loved ones may need to go through a lengthy and costly court process to gain the authority to make decisions for you.

• Peace of Mind: Knowing that someone you trust will manage your affairs if you become incapacitated provides peace of mind.

Just like a will, it’s important to review your LPAs regularly.

Changes in your personal circumstances or relationships may necessitate updates to your LPAs to ensure they remain relevant and effective.

Conclusion

Getting your personal affairs in order is a vital step in planning for the future. These documents provide clarity, ensure your wishes are respected, and offer peace of mind to you and your loved ones.

To Caveat, or not to Caveat?

How can the use of a caveat assist where there is a dispute over a loved one’s estate?

When a person dies (“the deceased”) their estate is administered by

(a) The executor appointed under their Will or (b) A person entitled to administer the deceased’s estate where there is no Will or

(c) An individual directed by the Court to administer the deceased’s will.

In all 3 circumstances a Grant of Probate / Grant of Letters of Administration (a ‘Grant’) are issued to that individual which entitles them to deal with the deceased’s assets by collecting them in, discharging any liabilities and distributing the assets for benefit of the beneficiaries of the estate.

Unfortunately, there are certain disputes which can arise in relation to the deceased’s estate, and in those

circumstances, it is possible that you might want to prevent a Grant being made to carry out further investigations.

This is where a “caveat” might be helpful. A caveat prevents the Grant being taken out which allows a person to investigate the circumstances under which a Will was prepared, assert rights under another will or alternatively, assert the right to take out a Grant themselves.

To enter a caveat, a person (the caveator) must:

• Have an interest in the deceased’s estate that is different to that of the person who is applying for a Grant.

• Be 18 years old or over.

• Be the sole caveator. It is not possible to enter a caveat jointly with someone else.

Once lodged, a caveat will remain in place for six months from the date of entry and may be renewed every six months until it is removed.

There are three reasons that you are able to enter a caveat:

1. Where you dispute the validity of a person’s will.

2. Where you think that a person had another will and that it needs to be located to administer the estate (rather than proceedings under the intestacy rules where it is believed that there is no will).

3. Where you dispute the identity of the proposed executor/ personal representative seeking to take a Grant.

This means that a caveat will be helpful where you are proposing to bring a claim that a will is invalid or, where it requires some form of amendment. Claims to substitute or remove a personal representative or executor will also benefit from a caveat being taken out to prevent the person to be removed from obtaining a Grant and entitlement to deal with the Deceased person’s estate.

The effect of a caveat is that it alerts all the probate registries in England and Wales not to issue a Grant until the caveat is removed. This allows the caveator time to make investigations and gather evidence to support their position and obtain legal advice.

Warning to Caveat

A person who is seeking to obtain a Grant may decide to issue a “warning” in response to the caveat. This is a notice to you to explain the basis of your reason for entering a caveat and this will require the person who lodged a caveat to confirm this in the form of an “appearance.” If accepted by the Probate Registry, that appearance will

have the impact of locking the caveat into place until such time as the caveat is withdrawn by agreement or by order of the court.

It is not appropriate to lodge a caveat:

(a) If you are a credit seeking to have a debt repaid.

(b) If you are seeking to make a claim for greater provision from a person’s estate under the Inheritance (Provision for Family and Dependants) Act 1975 (‘1975 Act’)

How Can We Help You?

We can advise clients on the caveat process, whether in their capacity as caveators or, executors/administrators seeking to obtain a Grant. This advice will be highly dependent on the facts of each case. We can also advise on other options that may be open to you to carry out investigations around a deceased’s last Will. For example, we may advise you to make a “Larke -v- Nugus” request which involves raising queries of a solicitor who drafted the will of the deceased which is being disputed and investigating the circumstances under which a Will was prepared.

We can also advise you in relation to the removal of executors / administrators where it is believed that they are not acting in the interest of the estate and beneficiaries or are otherwise unsuitable to take on this role.

Other contentious probate claims which might not benefit from a caveat are claims under the Inheritance (Provision for Family and Dependants) Act 1975. Under this legislation, parties seek to argue that insufficient provision was made for them by the deceased and such claims can be made even in circumstances where the deceased has a valid will. It is important to note that only certain categories of individual are able to bring such claims. Are you a victim of domestic violence, harassment or stalking?

It is not uncommon for people who have been the victims of domestic violence, harassment or stalking, to find that having reported one of these crimes to the police, they receive notification that their matter will not be progressed any further. B P Collins’ criminal team explores what can be done to reverse this decision where possible.

Being the victim of these type of offences is often emotionally and sometimes physically traumatic. A lack of proper engagement from some police teams can add to the sense of injustice. When a challenge to the initial police decision is made it can become quickly apparent that in some cases the police have either failed to understand the law or have not undertaken reasonable lines of enquiry in terms of the investigation itself and so they cannot have made an informed decision to taking ‘no further action’ on the case.

The police may also respond to say that an offence, such as common assault, is time barred, without understanding the law holistically and failing to see the assault offence as part of a wider course of conduct where time limits are generally not an issue such as when it is controlling and coercive behaviour.

Very often, further digging into a ‘no further action’ outcome demonstrates that the decision may not be fair and in certain cases, it is possible to go through an escalation process in order to seek a redetermination and reopen the case.

In dealing with these types of cases, victims should understand that a conviction in court can lead to a restraining order. Should a court grant such an order, then terms can be set for an offender such as ‘noncontact’. It is worth noting that such an order can even be imposed upon an acquittal. Failure to respect the terms of the order amounts to an imprisonable offence, which can offer long term solace to a victim.

The recent emphasis and policies by the police on protecting women and girls are to be commended but that policy must be supported by proper and effective investigations to achieve its full potential.

Living together vs. marriage: What’s

the difference?

As wedding season approaches, many couples are considering their next steps. Whether planning a wedding or living together, it’s crucial to understand the legal differences between marriage and cohabitation.

Cohabitation

Cohabitation, or living together without marriage, is becoming more common, allowing couples to share a life without the formal

commitment of marriage. However, it offers fewer legal protections.

In the UK, there is no ‘common law marriage’, meaning living together doesn’t grant the same rights as marriage. If a cohabiting couple separates, neither party automatically has rights to property or assets unless specified in an agreement, such as a cohabitation contract. Disputes over property can be complicated and may require legal help.

Cohabiting couples also lack automatic inheritance rights. If one partner dies without a Will, the other may not inherit anything, unlike married couples who automatically inherit each other’s estates.

Marriage

Marriage, on the other hand, offers a higher level of legal protection and clarity, especially when it comes to separation or divorce. Married couples in the UK are granted a range of legal rights that cohabiting couples do not have, including shared ownership of property, pension rights, and access to joint benefits.

When a married couple separates, both parties have the right to seek a fair division of assets and property. In the case of divorce, the courts consider the contributions of both parties, including financial and non-financial contributions (such as child care) to ensure a just distribution of assets. Spousal maintenance may also be awarded, particularly if one spouse has been financially dependent on the other.

Marriage also provides protection if one partner becomes ill or passes away. Married couples automatically inherit each other’s property (in the absence of a will), and spouses can make medical decisions for one another if one is unable to do so. These rights do not automatically apply to couples who are just living together.

What’s best for you?

The decision of whether to live together unmarried or to marry ultimately depends on your personal circumstances and preferences. For some couples, the idea of marriage offers peace of mind and legal security, especially if children are involved or if there are significant shared assets. For others, living together without marriage feels more suitable, especially if both parties are financially independent and prefer a more flexible arrangement.

However, it’s crucial for couples living together to be aware of the limitations of cohabitation and consider putting agreements in place to protect their interests. For example, a cohabitation agreement and/ or declaration of trust can clarify property ownership,

finances, and other arrangements in case of separation, ensuring both parties are on the same page.

For married couples, a post-nuptial agreement or a prenuptial agreement for couples contemplating marriage can also be an option to address similar concerns, offering clarity on financial matters and asset division if the relationship faces difficulties.

Understanding the Divorce Timeline

Divorce can be a difficult and emotional journey but understanding the process can help ease some of the uncertainty. Since the introduction of no-fault divorce on 6 April 2022, the legal framework in England and Wales has changed, making it easier for couples to separate without assigning blame. Understanding the timeline and factors influencing the duration of a divorce can help individuals navigate this challenging process more effectively.

How Long Does a Divorce Take?

Under the current system, the minimum time required to finalise a divorce is approximately six months (26 weeks). This includes:

• A 20-week reflection period between the initial application and the conditional order (formerly decree nisi).

• A six-week waiting period after the conditional order before the final order (formerly decree absolute) is granted.

This structure allows both parties a meaningful period of reflection and the opportunity to reconsider their decision divorce is finalised.

What Can Delay the Process?

While the minimum timeframe is six months, several factors can cause delays:

• Financial Settlements: Negotiating the division of assets, pensions, and property can be complex. Disagreements may lead to lengthy legal discussions or court proceedings.

• Child Arrangements: If there are children involved, reaching an agreement on custody and living arrangements can extend the process, especially if disputes arise.

• Disputes and Non-Cooperation: If one party is uncooperative or contests aspects of the divorce, additional legal steps may be required, potentially extending the standard timescale.

• Court Delays: Backlogs in the court system can slow things down, particularly in more complex cases.

Moving Forward

While the no-fault divorce law has simplified the process, each case is unique, and the timeline can vary depending on individual circumstances. Seeking professional legal advice and maintaining open communication can help navigate the process more smoothly.

Word of Advice

There is a common misconception about financial protection after divorce, even if parties have agreed the division of the matrimonial finances. It is therefore imperative that upon divorcing that parties seek advice in relation to a financial consent order for the best possible protection against future claims from their former spouse.

Formerly the Assisted Conception Unit, The Fertility Centre is a longstanding centre of excellence for fertility treatment and care at Chelsea and Westminster Hospital. It depicts a striking forest scene, complete with fast-flowing stream, that offers an escape from reality. Its canopy of leaves and branches weave a natural ceiling and envelopes homeowners in a fantasy woodland adventure.

Richard Haley, Creative Director of By Haleys, said: “With Arbour, we wanted to create a mural that showed both the opulence and majesty of the natural world in a very theatrical way.

“Botanical and nature-inspired wallcoverings can be quite subtle, but we wanted to create something that was bold and brooding.

“Colour is key, and we carefully curated a palette that transitions seamlessly from fiery warmth to cool serenity, creating a dynamic tapestry that

The wall mural was brought to life by Design Director Geoff Haley, an artist with more than 40 years’ experience in the interiors’ industry.
