In the midst of the Covid-19 pandemic, many families have found themselves unexpectedly dealing with the administration of a loved one’s estate. Unfortunately, this process is not always straightforward.

Wills and dependants – what’s the law?

D

espite the deceased having made a Will, this does not prevent a claimant from bringing a claim to challenge the Will. There are a number of reasons the validity of a Will may be challenged. At a basic level, it is crucial that the procedure for signing and witnessing a Will is adhered to, otherwise the document will not be valid. Challenges may also be made for other reasons, including lack of testamentary capacity, lack of knowledge or approval, undue Influence and fraud or forgery. But what if you are a dependant and have not been included in the Will or do not fall within the Intestacy laws? Certain classes of dependants can make a claim for financial provision from the estate under the Inheritance (Provision for Family and Dependants) Act 1975 (‘the Act’) from the date of commencement provided that the deceased died domiciled in England and Wales.

Who are the classes of dependants that can make a claim? The Act provides that the deceased’s surviving spouse; a former spouse who has not remarried, a co-habitee who had lived with the deceased for a period of at least two years prior to the deceased’s death as husband and wife or civil partner, a child of the deceased or a child (not biological) of the family and any other qualifying person treated by the deceased as a dependant and who immediately before the death was 24 SEPTEMBER 2020

being maintained wholly or partly by the deceased, can potentially bring a claim under the Act for financial provision from the estate. Subject to the claimant qualifying as a one of the above classes of dependant, the court has wide discretion to exercise its powers under the Act to make reasonable provision for the claimant. This might be an order for payment of a lump sum or a right to live in a property. The court’s powers can be far reaching. The claimant will need to produce evidence to demonstrate how the deceased had contributed to their maintenance and their continued need for support. The court will take all evidence into account when deciding whether to make an order for financial provision from the deceased’s estate. Time limit The Act provides that the claimant must bring their claim before the end of the period of six months from the date of the first grant of representation. Claimants wishing to bring a claim after this period will need to make an application to the court to bring the claim out of time. Although there is case law that resulted in a widow being granted the right to pursue a claim for financial provision from her husband’s estate 26 years out of time, this decision is rare. The court will consider various factors to determine whether to grant permission to bring the claim out of time. Each case will be decided on its own facts. If you think you have a potential claim against an estate, you should seek legal advice urgently.

Actually no. Without a valid Will the rules of intestacy apply and they state that only the first ÂŁ270,000 (including property) of the estate plus your personal possessions pass automatically to your spouse or civil partner. The remaining value of your estate is split, with your spouse or civil partner getting just half of the remainder. The other half is divided equally between the surviving children and if a son or daughter has already died, their children will inherit in their place. In practical terms this could mean that your partner may have less income than you planned and the home may need to be sold to pay the beneficiaries. There are many reasons for getting a Will arranged, but maybe the most important is simply to ensure that your estate goes to the people you most want to benefit. ondon’s black taxis or ‘a black cab’ or affectionately the ‘London Cabbie’ have and always will be part of what makes our capital so special to residents, commuters and tourists alike. They were already equipped to deal with Covid 19 having a glass partition separating the driver from passengers. And the cabbies expert ‘Knowledge’ of London’s roads and little back streets holds no bounds. For something different, Uber is launching a London commuter boat service in partnership with Thames Clippers. Rebranded Uber Boat, the 20-strong fleet will cover trips up and down the River Thames from Putney to Woolwich from 23 piers across London. The service will allow Uber users to book a river journey through the app and board using a QR code on their phone. Uber Boat will be following all possible hygiene and social distancing rules, including reduced capacity and that passengers must wear face masks in line with Transport for London (TfL) guidance. The San Francisco company has also confirmed that it will be charging passengers the same price for booking a boat as it does for their cabs. Uber has already got bikes and food deliveries covered although their taxis are grounded as they await a London licence to be re-issued. Last year it added London Tube and bus

updates to the app. Uber could be on a mission to be the one-stop app for all your transport needs? Uber’s regional general manager for northern and eastern Europe – Jamie Heywood, said in a statemen: “Many Londoners are looking for new ways to travel around the city, particularly when they start commuting back to work. Later this summer we will launch the Uber Boat by Thames Clippers in London as a means for people to arrange travel on the river and road, all through the Uber app.” Delighted by the partnership, Thames Clipper’s co-founder and CEO Sean Collins further remarked, “The new partnership sees Thames Clippers and Uber, who both pride themselves on safety, reliability, and comfort, come together. It will allow us to link the two travel modes of river and road, providing Londoners and visitors with even more options to commute, visit, explore and enjoy our city by river.” Thames Clippers tickets will still be available to buy elsewhere and the boats remain part of the Oyster network. Over 4.3 million people use the River Thames for commuting and travelling each year, and over 40 per cent of passengers have said they will increase their use of Thames Clippers in the future as an alternative means of getting around the city.

How to choose the perfect pre-loved wedding dress

rincess Beatrice has married Edoardo Mapelli Mozzi in a surprise ceremony, but what’s more unexpected was her choice of wedding dress. Instead of enlisting a top designer to make a gown from scratch like so many royal brides before her, Beatrice opted for a customised vintage dress. For her big day, she dipped into the Queen’s archives and found a Peau De Soie ivory taffeta dress by Norman Hartnell, trimmed with duchess satin and encrusted with diamantes. The Queen wore the gown to the premier of Lawrence Of Arabia at the Odeon Leicester Square in December 1962, and again to the State Opening of Parliament in 1966. Beatrice had the Queen’s senior dresser Angela Kelly and designer Stewart Parvin remodel the dress to make it appropriate for her wedding day, adding delicate capped sleeves. She topped off the outfit with another loan from the Queen – the Queen Mary diamond fringe tiara, which Elizabeth II also wore on her wedding day in 1947. Over the last decade we’ve seen royals get married in pieces by top designers from Alexander McQueen to Givenchy, so Beatrice’s vintage choice is quite unique. The outfit was well received on social media, with one Twitter user writing: “Adorable couple and could not have picked a more perfect wedding dress for her than that elegant/whimsical, yet very vintage, sentimental ensemble she wore.” Beatrice has also been praised for choosing a more sustainable option for her big day. Not only is re or upcycling an existing dress eco-friendly, but people often turn to pre-loved wedding dresses as they can offer something a little different to more modern designs. “Princess Beatrice’s choice of wedding dress marks a point in the royal family’s iconic fashion choices, taking steps towards mindful consumption even on such an important day,” says Victoria Prew from rental platform HURR

Be open-minded and set aside plenty of time You might have your heart set on a particular designer from a certain era, but Prew warns against this. “Try not to be too focused on the designer; there are incredible options out there without the labels,” she says. Be targeted in your search “Try and find the best vintage sellers online, starting with Etsy or 1stdibs,” advises Prew. To make life a bit easier for yourself, Grant says: “If you’re looking for a particular cut, style or era, be specific in your search. Naming brands or eras that are associated with the style you’re looking to emulate will help you narrow down the search to the most relevant items.”

Plan in advance Vintage wedding dresses tend to be one-of-a-kind, so it’s unlikely you’ll find a dress that fits you like a glove. This doesn’t mean you can’t wear it on your big day, but you’ll have to be a bit smart with planning. “Make sure there’s enough time to have your perfect piece altered,” says Prew. “Get the dress, then get it altered to perfection.” Grant also says you should be flexible with sizing: “As it’s pre-loved, it might have also been altered at the time of buying to fit the owner, so you may have to size up or down to get the fit that works for you. Always get in touch with the seller to check the specific measurements.” As well as tailoring the outfit to fit, Grant recommends shortening hemlines or streamlining waists to give your vintage look a modern touch.

Search for accessories You might not have the Queen’s tiara handy for your wedding, that doesn’t mean you can’t take inspiration from Beatrice and hunt for vintage accessories to go with your dress. “Vintage is also great for crowns and earrings,” says Prew. “Going vintage means you can guarantee your choice will be ‘timeless’ rather than ‘trendy’ – it’s your day, so make a statement.”

Consider its condition “While a few buttons or sequins missing shouldn’t put you off investing in a great quality, pre-owned wedding dress, more significant signs of wear and tear require further thought,” Grant says. “Don’t risk your money on items that are fraying, holed and stained as, chances are, trying to repair a gown and get a good colour match will be trickier to get away with. ishop Challoner has much to celebrate this year with 95 percent of students achieving grade 9-4 in five or more subjects, with 92.3 percent gaining at least five GCSEs including mathematics and English Language. 100 percent 9-4 grades were achieved in art, biology, chemistry, computing, design technology, drama French, Latin, music, physical education, physics and Spanish. In addition, at least half of all grades in biology, chemistry, computing, Latin and music were grades 9–7. Headteacher Paula Anderson said, ‘The students have faced many challenges this year during an uncertain period of time and we are very proud indeed of their achievements. The digital divide between the state and private school sector has been more evident during lockdown and smaller class sizes have made it easier to provide online learning. Education is about much more than achieving the right grades. Nick Creed, Deputy Head of Co-curricular at Hurst College explains why as much value is placed on what goes on outside of the classroom as inside.

Why does Hurst use the term co-curricular rather than extra-curricular? We regard co-curricular activities as being key to the all-round education of every individual student, and use the term co-curricular because we believe that activities should run alongside the academic curriculum as part of the weekly timetable. Skills that are learnt through cocurricular activities can be transferred to the classroom. Sport and games are compulsory throughout the week and the service afternoon is compulsory for students in years 10/11, whilst the majority of Sixth Formers continue to be part of the service programme. Dance and drama are compulsory for Year 9s and have protected slots as part of the weekly timetable; music activities such as choir and orchestra also have protected slots. Specialist sports during games sessions include archery, climbing, rowing, sailing and mountain-biking. Through these activities students will not only develop a range of qualities and gain certain skills but they might also be introduced to a pastime or hobby which they can enjoy throughout their lives. Why are co-curricular opportunities so important in a child’s education? The range of activities provide many opportunities for students to try new ventures, confront risks and learn from experience – all crucial aspects in developing skills for life. The aim of the programme is to equip students with the skills and experience to make a success of their lives

Which co-curricular events are most popular? We encourage students to engage in as much of the programme as possible – as members of dance companies or sports teams, performing in drama or music productions or taking part in the Duke of Edinburgh award. There are highly qualified staff to deliver the activities and to bring out the best in each student. Some discover talents they didn’t realise they had first team rugby players have also taken lead roles in the Dance Showcase. By the time students leave us, the majority will have performed in a sports team, on the stage, as well as having marched with the CCF and been involved with an environmental activity. Do you actively encourage girls to take part in activities traditionally favoured by boys and vice versa? The programme is not focused on gender and therefore activities are not gender-specific. Boys are equally involved in dance as girls; and in sport, some teams consist of boys and girls – particularly cricket and hockey. How did you deal with co-curricular activities during remote learning? One of the most interesting challenges was to redesign the school day to adapt to the new way of learning. Some creative timetabling allowed for an earlier finish each day without losing any of the co-curricular provision. This last point proved critical: by continuing to offer a programme of assemblies, sports sessions, choir and orchestra practices, drama rehearsals, activities sessions and CCF, the regular rhythms of school life continued – and the students stayed fit, healthy and active. hppc.co.uk

‘Giraffe Girls’ How can we support children to thrive in light of the recent changes to schooling? Victoria Goodson, Head of Prep, Sydenham High School tells us more

S

ince March 2020, we have all experienced unprecedented changes to our daily lives. Education transitioned from the classroom to the home and children had to adapt quickly to their new learning environments, in the most part working in isolation, with many children requiring new levels of independence, and adapting to new ways of engaging with their teachers and classmates. At Sydenham High Prep School, pupils regularly referred to themselves as ‘Giraffe Girls’; standing tall, not being afraid to try new things. They talked about their ‘Growth Mindsets’; not giving up when things became difficult. In addition to this, the creativity and ingenuity shown by pupils was astonishing and confidence and progress in online learning rose. In June and July, as children started to return to school, they continued to show these new levels of independence and resilience, adapting again to new practices and routines designed to keep them safe, including new classroom environments, new ways of learning and new hygiene procedures. Certainly, these changes have brought some limitations. Children may not be able to handle

shared books at school as frequently as before, however, there are lots of other ways to support children with their reading. Books are only some of the valuable resources we use when teaching children to read. Comics, magazines, webpages, signs, recipes and instructions are all useful reading materials. In considering how to best support children with the recent and potentially ongoing changes to school life, we can look back at how brilliantly children have already adapted. By continuing to support children to be creative and innovative in their approaches to new challenges, we can help them to become fantastic problem-solvers and to develop a sense of ownership for their own learning. By continuing to encourage children, especially when things don’t go as planned, we can support them to be fearless and resilient. By continuing to model kindness and patience, we encourage children to do the same. In supporting children to develop all of these qualities, we are supporting them to be confident and adaptable learners, developing some of the most valuable skills and attitudes they will need to be happy and successful both in school and beyond.

o mark the release of her new album Folklore and first single Cardigan, Taylor Swift took the unusual step of selling an actual cardigan alongside more traditional merchandise, like hoodies and T-shirts. A replica of the one Swift wears in her Cardigan video – a thick cable knit V-neck sweater in cream with black stripe edging, that has three stars on each sleeve – has already sold out on the singer’s online store. Famous fans including actor Jesse Tyler Ferguson and Kobe Bryant’s daughter Natalia have

posted photos on Instagram wearing the cardigans, they’d been gifted by the singer. It’s surprising to see such a wintry garment gaining popularity in summer, but the cardigan has a way of popping back into fashion just when it seems to have gone for good. From its earliest origins to the present day, here some of the faces who have helped make the cardigan famous…

It is thought to have been trimmed in fur. After the war, the practical knitwear item reportedly became rather popular outside the military, and cardigans began to be widely produced.

CoCo Chanel Credited with popularising cardigans for women in the 1920s, it’s said that French fashion designer Gabrielle ‘Coco’ Chanel preferred a button-down sweater because she didn’t like the way traditional pullovers messed up her hair when she put them on. Inspired by the legendary designer’s early work, cardigans and knitted jackets are still seen on the Chanel catwalk and in boutiques today.

At the other end of the style spectrum, rock icon Kurt Cobain introduced a whole new generation to the cardigan in the Nineties. The Nirvana frontman took an item of clothing usually seen on grannies and grandpas and made it cool, wearing moth-eaten chunky knits with band T-shirts and battered jeans. One of the singer’s most famous cardigans, worn for the band’s 1993 MTV Unplugged gig, sold at auction for $334,000 (£260,000).

Preppy, fine-knit cardigans from brands like J. Crew were a mainstay in Michelle Obama’s wardrobe as First Lady, reportedly leading to a spike in sales as fans sought to emulate her elegant style. On the night Barack Obama was elected as President in 2008, the First Lady wore a black cardigan over her red and black Narciso Rodriguez dress.

waiting patiently for access to our hospital services during the pandemic. “The agreement between the independent sector and the NHS allows our hospital to offer access to more of our hospital services including outpatient services, diagnostics, oncology treatments, day case and inpatient surgery including orthopaedics, general, bariatric, gynaecology and urology surgery to people with health insurance or who are paying themselves, as we did before the pandemic. We are also continuing to care for NHS patients, working closely with the fantastic teams at Maidstone and Tunbridge Wells NHS Trust to reduce waiting times and free up capacity within the NHS. “Our experienced infection prevention team are ensuring that everyone that comes into our hospital receives high quality care in a safe environment. For example, we are taking people’s temperatures upon arrival, wearing PPE, and implementing new zones to help maintain social distancing. We are also offering remote consultations for patients and our end-to-end connected services make us stand out in our care for people of all ages, from fitness and wellbeing to treatment and recovery.”

Bespoke Elegance Dominic Walmsley started his jewellery career as an apprentice goldsmith in London in 1983. Taking inspiration from his travels and historical styles he established his jewellery company in London in 1991 and is a regular exhibitor at the prestigious Goldsmiths’ Fair.

Dominic believes that to have a successful business it is vital to provide impeccable customer service, quality in design and craftmanship and an environment in which one feels friendly and relaxed With his workshop on-site he is able to undertake regular jewellery services such as valuations and repairs, also one of Dominic’s specialities, re-designing existing, out of fashion jewellery and transforming it into fabulous new pieces. Dominic’s latest creations have become his passion after being inspired by the French post-impressionist painters of the pointillism movement. Their technique of painting was to use tiny dots of various pure colours which became blended in the viewer’s eye. After admiring many of the paintings of post-impressionist artists such as Georges Seurat and Paul Signac, Dominic creates ‘one of a kind’ pieces of jewellery using gemstones as his palette, combining complimentary colours mounted in gold or platinum which depict a season, part of a picture or a blend of colours that remind the wearer of a special holiday memory, making each piece totally unique. Since lock-down, Dominic says he has noticed an increasing desire even from younger customers, for quality pieces that hold a higher personal and emotional value, locally bought, rather than from faceless brands made in the Far East. He says, “I am passionate about buying local or buying British, especially when the quality of our goods is so high”.
