Faye Howard, a tax director at Scrutton Bland looks at the way recent and forthcoming changes to tax legislation may affect anyone owning a buy-to-let property.

B

y now all landlords should be very aware of the changes to the way in which tax relief is given on mortgage and other interest associated with property rentals, however there are further changes planned for April next year to some other reliefs which could potentially have a bigger effect. Many landlords have properties which have at some point been their only or main residence, and this provides them with an important tax relief when the property comes to be sold called Principal Private Residence (PPR) Relief. Currently, PPR Relief is available to exempt any gains relating to any periods of actual occupation of the property, any periods of ‘deemed occupation’, and the final 18 months of ownership. This final 18 months of ownership has already been reduced from 36 months for property disposals after 6 April 2014, but from 6 April 2020, it will be reduced further to just 9 months. Whilst the reduction in the final period of PPR Relief is likely to be a relatively minor annoyance to most landlords, the proposed removal of Lettings Relief from 6 April 2020 is possibly rather more of an issue. Lettings Relief is available where a property is sold which has been let, but which also at some point during the vendor’s period of ownership was their Principal Private Residence. This provision was initially intended to give tax relief on the sale of a property which had been shared with tenants throughout periods of ownership, but it evolved to exempt potentially significant portions of gains

where the whole property was let. Whilst there are restrictions on the amount of Lettings Relief that can be claimed on a disposal, the maximum claim can exempt up to £40,000 of gains per person, or £80,000 per couple where the property is in joint ownership. Assuming a maximum Lettings Relief claim, this Relief is worth £22,400 of Capital Gains Tax. With the withdrawal of this relief just around the corner, any landlords who might qualify for Lettings Relief would be well advised to quantify the value of this relief and the effect its withdrawal may have. This is an exercise we have undertaken for a number of clients, with some surprising results. One way to trigger this relief is to sell a property before 6 April 2020, however this may not be desirable, or even possible for many landlords. There are other options however which will crystallise the gain and trigger the relief, although options may be more limited where the property is mortgaged. We are however happy to advise on these situations, and help you come to a decision as to the best way forward for you. Should it not be possible to crystallise the gain and bank the relief, there are investment options which allow deferral of capital gains, but on the other hand, landlords looking to sell may benefit from some advice on alternative investment strategies, and this is something our IFA colleagues can assist with. Should you wish to discuss how our joined-up investment and tax advice might be helpful in your situation, please don’t hesitate to contact us.

OAK-TREE SKI TRIP TO AUSTRIA

There have been so many highlights this year, but the joint Ski trip to Innsbruck in Austria in February for nearly fifty of the older Braeside and Normanhurst pupils was certainly one to remember! Most of the children who went on the trip had very little experience of skiing, but that didn’t stop them from having a fantastic time. The skiing conditions were excellent and the ski school instructors were pleased with the children’s progress as they made it onto the blue and red slopes within days. Parents of Oak-Tree children don’t have to miss out on the fun either! In May, the four Parents’ Associations came together to organise an extremely successful joint Summer Ball for hundreds of parents, staff and friends of the schools. With a James Bond ‘Casino Royale’ theme, this elegant black tie event was held in a large marquee in the grounds of Chigwell Hall and was an excellent opportunity to come together to raise funds for additional resources whilst enjoying a fun evening. There was a Champagne Reception, live music from a Jazz Quartet, cocktail bar serving a variety of Bond-themed Martinis, magicians performing close up magic, several casino tables and live DJ entertainment. Group Managing Principal Matthew Hagger said, “This was a fantastic way to celebrate the year and I was pleased with the opportunity to bring together staff and parents from all four schools. The evening was enjoyed by all guests and was an excellent way to start the summer’s ‘Ball Season’.”

FRIENDSHIPS FOR LIFE Wanstead Golf Club is set in beautiful parkland bordered by Wanstead Park and the lower reaches of Epping Forest, yet only a few miles from Docklands and the City of London.

T

he club was formed as Wanstead Park Golf Club with the opening ceremony held on the 25th November 1893 in the newly refurbished clubhouse, which was originally the stables of the 18th century Wanstead House. We are proud to say that 126 years later we are still in the same clubhouse, now grade 2 listed and although there have been refurbishments over the years it still retains that atmosphere of historical significance. We are a community amateur sports club and our facilities are open to all, whether you are an elite golfer, a novice, junior or older, or you are looking to join as a social member when perhaps you are content to while away an afternoon with a drink on our patio overlooking the putting green and Bowls green. New members are always welcome at our club and are made to feel a special part of the Wanstead Golf Club family. There are competitions throughout the year for men, women and juniors and of course there’s plenty opportunity for those who simply prefer social golf, with the prize at the end of the round being a well-earned drink in our comfortable subsidised bar. The Club is also the home of the Armitage Cup, an Essex scratch competition which has been played since 1901 and the club will this year host the Essex Seniors Championship. It is said “you have many friends, some of which you are yet to meet”, certainly it is the case many “friendships for life” are formed at Wanstead Golf Club. Membership is available to suit all life styles and unlike some other Golf Clubs there is no joining fee and no formal interview process, we pride ourselves on our diverse and all-inclusive open membership; joining Wanstead Golf Club could not be easier.

Eskies bring their unique brand of gipsy jazz in a swaggering stage spectacular. June and July is packed with entertainment for all ages. With open air cinema and theatre, big screen summer sports, live comedy and music performances, fun family days, fitness classes and a host of events to let your hair down on a Friday, Summer by the River will be the ultimate London experience this summer. During August, London’s Free Open-Air Theatre will return to celebrate its 16th summer residency at The Scoop. This year, a new family production of “The Sea Queenâ€? will introduce families to the magic of theatre as they follow the swashbuckling tale of pirate and Irish queen of the seas, Grainne O’Malley. As the sun sets over the Thames, Shakespeare’s classic romantic comedy “Twelfth Nightâ€? will grace the stage. Each production will run between 7th August and 1st September, all of which are free to attend. No festival would be complete without flavourful food and this year Summer by the River is teaming up with popup guru Jimmy Garcia to fuel the riverside celebrations. Perfect Concealer every time Make-up artists offer Katie Wright their pro tips for perfect application every time

F

or its ability to cover up even the nastiest acne breakouts, and to make us look wide awake when we feel like death, concealer is a true make-up marvel. But when it goes wrong? It can go really wrong. Anna Vakili, a contestant on this year’s Love Island, has taken a bit of a hammering on social media, thanks to her choice of under-eye make-up products. “Anna, babe, blend out your under-eye concealer... and for the love of all make-up gods do not use that much ever again,” was one of many comments on Twitter. “Concealer can be our best friend,” says make-up artist Frey-ja Barker. “However, if applied badly, it will not do us any favours.” So, whether you’re a reality TV star or not, we’ve got the pro tips you need, from prepping your skin and choosing the right shade, to expert application. Here are common concealer fails and how to fix them...

Not prepping your skin properly “There are two elements that help concealer last longer throughout the day - primer and powder,” says Marc Reagan, Hourglass global director of education, artistry and events. Apply a light layer all over the face, or on areas where you typically find breakdown of make-up during the day. Laura Hogsden, senior trend team make-up artist at Benefit, says eye cream is essential: “Using an under-eye cream before make-up will plump the skin surface, helping to iron out fine lines and giving your under-eyes an even smoother and more radiant finish.”

“As the skin under the eye is much thinner, opt for a cream concealer that is light in texture and highly pigmented, to hide dark circles whilst giving a smooth finish,” Hogsden says. “Using an overly textured concealer will appear cakey and only enhance fine lines. Choosing the wrong formula Your choice of concealer should depend on your skin concerns, Barker says: “Concealers for breakouts tend to be a thicker consistency and I would advise looking for more of a matte finish, as you do not want to draw attention to it. Concerned about spots and dark circles? “I think you cannot go too wrong with the famous Nars Creamy Radiant Concealer. Us make-up artists love it!” says Barker. Nars Radiant Creamy Concealer, £24

Using a shade that’s too light under the eyes “One of the biggest mistakes I see is people applying a much, much lighter colour than their natural skin tone. This can run the risk of looking grey or cloudy, especially in photographs,” Barker says. “To avoid this, try a colour corrector in a peachy tone for dark circles, followed by a lightreflecting concealer such as Charlotte Tilbury Magic Away Concealer.” Charlotte Tilbury Magic Away Concealer, £24

Not using a brush For precise application, a flat brush is best, Reagan says: “When applying concealer, try to use a concealer brush, like our No. 8 brush, for the most even coverage, and focus only on where you need it. Using too much concealer When faced with purplish-black patches under your eyes, it can be tempting to slather on lots of product, but that’s not a good idea. “My advice is to always start with small amounts of product, because you can always layer more,” Reagan advises. “You want people to compliment you on your skin, not your concealer.” Barker says that, used sparingly, concealer can provide all the coverage you need, especially in summer when you don’t want to wear a lot of foundation. “Concentrate swiping in a cross formation through the face - a little in the centre of the forehead, down

the nose, the apples of the cheek and chin, then blend,” she says. “A great concealer that is long-wearing in the summer months would be Tom Ford Emotionproof.” Tom Ford Emotionproof Concealer, £42

Blending too much Conversely, if you’re too heavy-handed you can end up wiping away the coverage altogether. “Avoid blending or rubbing, or you’ll only end up revealing the problem area again,” Hogsden says. “Patting the concealer will hold the coverage and pigment, and to ensure a seamless blend into our foundation, you can use the warmth of your fingers to emulsify the concealer.”

Not setting your concealer “Once the concealer is blended, it needs a powder to lock it in place,” Reagan says. “Gently stipple or press Hourglass Veil Setting Powder on top of the concealer, which will ensure the concealer stays in place and remains bright and radiant over the course of the entire day.”

Anywhere and everywhere - I love people watching and have been known to run after strangers to secretly take a photo of their bag! What made you want to be a plastic surgeon? I was fascinated with the broad range of techniques used by plastic surgeons and the ability to operate all over the body and treat a variety of conditions. Being able to carry out a complex reconstructive procedure and to make it look aesthetically pleasing is extremely satisfying. What do you enjoy most about your job? There are so many things! I find it incredibly rewarding making a positive change to people’s lives and I enjoy the technical challenges of surgery. I’m fortunate enough to be able to work both in the NHS and also to have my own private clinic. Each setting enables me to meet a wide range of people with very different issues. What are the most common cosmetic procedures? The most common procedures I carry out are breast enlargement, breast reduction and tummytuck surgery. I’m frequently surprised by how little people have researched me before their initial consultation. If someone is considering cosmetic surgery then at the very least they should make sure that their surgeon is on the specialist register for plastic surgery which is held by the General Medical Council (GMC). In the UK, full members of BAPRAS have all had full specialist training (British Association of Plastic, Reconstructive & Aesthetic Surgery). What do you think about the idea of going overseas for cosmetic surgery? Generally speaking, it’s a bad idea. There are some very well-trained plastic surgeons outside the UK but it can difficult to check. Other countries have different standards and systems which makes it difficult to find out if a surgeon overseas is fully trained. No procedure is free from risk and complications can occur whether your surgery is carried out in the UK or abroad. However, if you choose to have your surgery in the UK , the consultant plastic surgeon who undertook the surgery will provide you with any necessary aftercare. or a lot of households, there comes a time when your home becomes a bit of a squeeze. Maybe you have had more children, or have embarked on working from home. So should you move somewhere bigger, or extend your house to make it large enough for you and your family’s needs? An extension can radically improve a property. Bigger, better space and extra rooms can add value, and make a house more attractive to buyers. Your location, and the level of demand for your type of home, could make a big difference to the financial implications of extending versus moving. In high-value affluent areas in London it can be more worthwhile digging under the house to add a basement conversion, go up a level or even extend sideways. The reality is that if you are able to extend, it is often sensible to do so from a financial point of view. The cost of buying a new house would far outweigh the cost of building. If you want to make structural changes with the purpose of adding value, you should first find out the current market price of your property, as well as its potential value once the changes have been made. Otherwise, your hard work and cash may not reap rewards. Also be area aware - before you plan that extravagant extension or costly conversion, it’s crucial to talk to a local estate agent to find out what renovations are popular in your area. Every street has a ceiling value so don’t over develop if you want to see a good return on your investment. However, this is a major project and shouldn’t be undertaken lightly: • Call in professionals to get the job done properly, as there are important planning restrictions and regulations which need to be followed. • Ask friends if they can recommend an architect and builders. It is really important that you locate the specialists as a botched extension can devalue a property. • The National Federation of Builders (NFB) can provide you with a list of registered builders in

A builder that belongs to a respected trade organisation will have to comply with membership standards. • The Royal Institute of British Architects (RIBA) provides a list of registered architects. • Although a modern extension can look good on an old house, when it comes to selling on it is important to appeal to the average buyer’s taste. Therefore it is advisable for an extension to match the architectural style of the existing house. • Be strategic: Extra bathrooms and large kitchens are usually good investments in family-sized homes, and a garage in a busy, urban area will also add value. The room that usually benefits the most from enlarging is the kitchen. Adding a kitchen/ diner creates the farmhouse kitchen most people want and provides extra space. The old dining room can become an office, playroom, or an extra sitting room. Kitchen extensions also provide the opportunity to extend upwards - an additional bedroom can be built on top at the same time.

At Gerard’s Property Services we always support our landlords, minimising the overwhelm to ensure that you and your property are doing everything right. If the maze of dos and don’ts confuses you, we have put together four law-breaking mistakes that landlords keep making.

1. Gas Safety You may be under the impression that if you have a Gas Safety certificate for your boiler then your property is covered – this is not the case. The Gas Safety regulations require you to have a certificate for each gas appliance within your property, and these must also be available inside the property.

2. Right to rent In 2016 it became a legal requirement for English landlords to check the immigration status of each prospective tenant to make sure that they legally have a right to rent. If the correct checks are not completed the penalty is an unlimited fine and up to five years in prison.

3. Deposit protection We have come across a misunderstanding by selfmanaging landlords who believe that they can still hold unregistered or unprotected deposits – this is prevented under the 2004 Housing Act. If the tenancy is an assured shorthold tenancy (AST), then your tenant’s deposit must be held within a governmentapproved deposit protection scheme.

4. Energy Performance Certificate (EPC) Last year it became unlawful to let a property that has an EPC below an E. Even though this change has been in place for over 12 months it seems to have passed some landlords by without notice. Failing to comply could see you receiving a penalty up to £4,000. We continue to advise our landlords to future-proof their properties, as this EPC minimum is expected to rise again soon.
