Lease renewal negotiation for Harbour Holdings Limited

We were tasked with negotiating the renewal of a telecoms lease to secure the highest possible rent and limit the operator’s rights. Appointed in April 2024, we served a Paragraph 33 notice under the Electronic Communications Code on 10th July 2024, expiring on 25th January 2025. We advised our client to delay agreeing terms until after the rent payment date of 11th December to ensure full rental payment under the existing lease.

Our valuation, informed by key case law, aimed to maximise rental income and agree on Heads of Terms. The site, located at The Harbour Group, Borers Arms Road, Copthorne, Crawley, is near Gatwick Airport. We assessed comparable car parking sites and assessed the sites value at between £3,750 - £4,100 per annum. The operator initially offered £1,800, revised to £3,090, and we ultimately agreed on £3,500 per annum, plus a £4,000 completion payment.

Additional terms included a three-yearly inflationlinked rent review, a redevelopment break clause, and restrictions on the operator’s rights outside the redline demise. The lease was completed consensually on 29th May 2025, with no rental apportionment, allowing the client to benefit from an additional year’s rental income.
