Surveyors acting for the local church – the legal owners of the area of land in question – approached the insured. They proposed a licence for the insured’s use of the land as garden / amenity land, nevertheless acknowledging the insured’s right to pass and repass with or without vehicles.
Challenge A valuation report revealed that the area of garden land added approximately £40,000 to the value of the insured’s property. First Title considered entering a claim for adverse possession but, following negotiations, the local church offered to sell the land to the insured for a sum of £10,000.
