Claim Case Study: Building Regulations Remedial works required Background
Challenge
The insured was contacted by the Local Authority in relation to an unsupported chimney breast which breached building regulations. They threatened enforcement action unless remedial works were taken to regularise the chimney breast.
The insured, therefore, brought the claim against the policy for the cost of the remedial work to the chimney breast that was required in order to make the chimney safe.
First Title’s Building Regulations policy provides cover for the loss sustained that arises out of the enforcement action. This will include paying for remedial work to comply with Building Regulations, or the cost of defending the enforcement action, or the cost of applying to the Local Authority for a retrospective Completion Certificate and / or compensating the insured for their losses. In this case the insured was unable to produce the required Completion Certificate from Building Control to show that previous work to the property complied with Buildings Regulations.
Solution Two building quotes were obtained for the work required in order to support the chimney breast and make the property safe for the insured. First Title paid the full cost incurred and the work was completed. The insured then applied for retrospective consent from the Local Authority and was subsequently issued with a Compliance Certificate confirming that the chimney breast now complied with Building Regulations. First Title dealt with the claim swiftly preventing the insured being served with enforcement action by the Local Authority and allowing the insured to reside safely in their home.
