Solution
The insured obtained a Personal Search Report prior to the property purchase which revealed the installation of a new boiler, which the insured presumed would still be covered by a warranty and would not pose any problems. The insured relied upon the information provided by the Personal Search Report. The policy provided cover for loss relating to an adverse entry that was not revealed in the Personal Search Report that should have been, as it would have been revealed if the insured had purchased a full Local Authority Search.
First Title investigated the records of the Local Authority and it revealed an error whereby the boiler installation related to a completely different property and had been registered incorrectly against the insured’s address.
Challenge
First Title made payment to the insured for the cost of installing a new boiler in the property.

Upon completion, the insured had the boiler checked by a Gas Safe engineer who condemned the boiler as unsafe and notified them that the boiler was older than three years and that replacement parts were now obsolete. The boiler clearly needed to be replaced so the insured raised a claim against the policy as the personal search had revealed an incorrect entry registered against his property.
