t’s hard to believe 2018 is coming to an end.

This year has seemed to fly by, with so much going on from different angles – from an extremely busy legislative session, including the success of the D-RiSC Coalition, to an unprecedented year-round fire season, if we can still call what we’ve witnessed as a State a “season.” So many of you and your respective agencies have pushed the envelope this year, continuing to do unselfishly what you do best – helping those in need.

STEVE HALL FDAC President As I write this letter, an update just posted on the Camp Fire and the Woolsey Fire, and the numbers keep climbing. Many of our District’s personnel responded to these horrific events – the pictures of death and destruction will be etched into their minds forever. I ask that when your responders get back home, reach out to each of them; make sure they’re alright – physically, mentally, and emotionally.

The amount of loss endured over this past year, over this past month – human, animal, structural, and economic – is beyond belief. As we head into the holiday season, please take time to give thanks for what we have, but don’t forget about those that have lost – some everything – including numerous brothers and sisters who fought to save lives and protect others property, while losing their own.

A

Landmark Year for the Fire Service

It has been an unprecedented legislative session for fire districts in California. In the aftermath of the most destructive wildfires in our State’s history in late 2017, FDAC took a decisive role in creating a coalition of stakeholders dedicated to modernizing the Master Mutual Aid System. The group, which came to be known as “D-RiSC” (Disaster Readiness for SAFER Communities), developed a legislative program to expand funding for the prepositioning of local fire resources ahead of climate-driven events.

FDAC leaders Steve Hall, Steve Kovacs and Rich Pearce came to the State Capitol on a regular basis to raise the visibility of the fire service at public rallies, lobby legislators, testify at policy committee hearings and meet with Administration officials to promote vital legislation. And, after the $25 Million State Budget augmentation language included in Senate Bill 8561 proved to be too restrictive, FDAC leaders met with Governor Brown to secure his active support for the “Budget Fix” language that was ultimately amended into Senate Bill 901 (Dodd)2 and signed by the Governor in September.

In addition to including the crucial funding for pre-positioning of local fire resources, SB 901 was the most important wildfire measure enacted this year. The bill takes bold steps to improve vegetation management activities, including imposing strict requirements on utilities to invest in fire prevention, risk mitigation, and to collaborate with local fire departments on fire safety and suppression.

Two significant disaster-related alert and warning bills were enacted this session. Senate Bill 833 (McGuire)3 will require OES to develop guidelines and training standards to implement a statewide emergency management alert and warning system, and Senate Bill 821 (Jackson)4 will provide for the creation of an opt-out warning system.

Other Legislative Activities Beyond wildfire legislation, the Joint Legislative Task Force tracked over 250 pieces of legislation this session and we had major accomplishments in several policy areas. We successfully avoided a major shift in local tax policy by preventing

the placement of an Initiative on the November 2018 General Election Ballot, which would have required a ⅔rds vote on all local government tax measures that are submitted to the voters. Instead a legislative compromise was reached, placing a moratorium on local governments taxing sugared beverages for a period of 13 years [Assembly Bill 1838 (Committee on Budget)]5 in exchange for dropping the Tax Initiative6.

Affordable housing remained a major legislative concern this session and we were active in many building permit and inspection measures. We supported Senate Bill 1205 (Hill)7, which was signed by the Governor, to provide for an annual report on compliance with existing inspection requirements to enforce building codes with the local government governing board at the same time their budget is under review. We also obtained amendments to narrow the scope of Senate Bill 1415 (McGuire)8, a bill related to the Ghost Ship Building Fire Task Force, designed to require mandatory inspections of warehouses which are used as

residences. SB 1415 was vetoed

by Governor Brown on the grounds that local government should have discretion to inspect buildings needing to be inspected in their community.

We were actively engaged in over 30 EMS-related bills. We sponsored Assembly Bill 2118 (Cooley)9 to remove public agencies from the Quality Assurance Fee statute enacted last year [Senate Bill 523 (Hernandez)]10. After AB 2118 moved to the Senate, we received updated data that indicated the vast majority of public agencies would be net winners; accordingly, we held our bill and took no further legislative action for the remainder of the session. We remain in discussions with the Department of Health Care Services exploring the establishment of a managed care program for public transport providers in the next session.

The Joint Legislative Task Force supported Assembly Bill 2961 (O’Donnell)11, a bill signed by the Governor, establishing an ambulance patient off-load time study to provide recommendations for legislation to reduce wall time.

The bill, sponsored by the California Professional Firefighters, is viewed as a prelude to stronger legislation down the road.

Legislative Issues to Return in 2019 Two measure that were vetoed

by Governor Brown and will be on the legislative agenda for reintroduction next year include Assembly Bill 1116 (Grayson)12 establishing a peer support and crisis referral service for firefighters and Assembly Bill 3115 (Gipson)13 creating a statewide community paramedicine program to devise guidelines for the triage and alternate destination for patients 8

needing mental health or substance abuse-related services.

Several other legislative issues will be re-introduced for consideration and possible resolution in 2019.

Assembly Bill 1836 (Committee on Budget)14 to fund the SETNA 911 System failed by one vote on the last night of 2017-18 Legislative Session. Since the measure required a ⅔rds “super majority” vote, it needed one favorable Republican vote and no one broke ranks to support this “tax” measure. With the recently concluded 2018 General Election resulting in the Democrats having a significant “super majority” in both Houses of the California Legislature, this measure is expected to receive a high priority by legislative leadership when they reconvene in January 2019.

Senate Bill 794 (Stern)15, the bill to establish a Fireworks Stewardship Program pertaining to the seizure, storage, and disposal of illegal fireworks, ran into trouble in the Assembly policy committee and was deferred to January 2019.

Looking Ahead to 2019-20 Legislative Session As the Joint Legislative Task Force prepares its agenda for the new 2019-20 Session, what will we encounter when the Legislature convenes in January 2019?

Governor-elect Gavin Newson has begun to shape his staff by naming Ann O’Leary, a former advisor to Hillary Clinton, as his Chief of Staff. He has also named Ana Matosantos, a well-known and experienced former Director of Finance, to be his Cabinet Secretary. The Transition Team for the Democrat Governor-elect is in full swing. We can expect the new Administration to hit the ground running as the new Governor must submit his first State Budget

proposal by January 10, 2019, and he’ll begin to work with a Legislature under the firm control of his party.

The recent election in November reconfirmed the degree California has become a one-party state.

The Democrats won nearly every contested seat and have control of all statewide offices and a ⅔rds super majority control of both Houses of the California Legislature.

Based on current projections (many provisional ballots are still being counted), the Democrats will have 29-of-40 seats (73%) in the Senate and 60-of-80 seats (75%) in the Assembly. Theoretically, the Democrats will be able to control all tax policy and urgency measures without needing to obtain a single Republican vote.

The 2019-20 Session will also commence, like last year, immediately following the worst wildfire in California history. The Camp Fire has devastated 90% of the Town of Paradise and, to date, 77 people have lost their lives and more than 12,000 buildings have been destroyed. President Trump joined Governor Brown and Governor-elect Newsom on Saturday, November 17, 2018, on a ground tour to assess the damage in Paradise. All praised the “incredible courage” of firefighters and first responders and pledged to work together to promote fire safety and healthy, resilient forests.

With the significant groundwork undertaken and strong political foundation built in 2018, we strongly believe that FDAC and the Joint Legislative Task Force are well positioned to engage in and meet the challenges of the new session.

THE OTHER SIDE OF THE ACADEMY

An Exhibitor’s Perspective

he inaugural Fire Districts Association of California (FDAC) Fire Leadership Academy kicked off their two-day event in a room of approximately 60 fire service personnel whose primary focus was to gain insight and education into leadership, fire district governance and develop a network of peers.

As a long-standing partner and advocate of the FDAC, the Fire Agencies Self Insurance System (FASIS), is honored when we are asked to support FDAC events.

This support typically affords us the opportunity to participate as an exhibitor, providing us with exposure to fire service personnel from throughout the State.

The Leadership Academy proved to be particularly advantageous to FASIS, as many of the attendees did not possess first-hand, working knowledge of the program. As we learned, for some of the fire service “up and comers”, exposure to FASIS may not always fall within their respective professional domains.

Serving as an Academy exhibitor, allowed us the opportunity to share important program information and speak with representatives from districts such as Tiburon, Mammoth Lakes and several others. Conversely, as observers, we gained valuable insight in to what it takes to serve as a leader within the fire service. Discussion topics included succession planning;

the multi-generational workforce; legislative advocacy; and the labor/ management relationship. The procurement of this base knowledge helps to forge a productive working relationship between FASIS staff and the Member Districts.

Expanding our fire service base knowledge was an added bonus to what was already pre-determined to be a beneficial event. Thank you, FDAC!

Governor, Lawmakers Respond to “New Normal” of Climate-Driven Disasters in 2018 Fire and Local Government Coalition Acknowledges Progress Made and Remaining Work Ahead

SACRAMENTO, Calif. – With the conclusion of the signing period for 2018 legislation on September 30, the Disaster Readiness for Safer Communities (D-RiSC) coalition today acknowledged the progress made

by Governor Brown and state lawmakers in 2018 to combat the “new normal” of climate-driven disasters, expand wildfire prevention activities and enhance the deployment of local government fire and rescue resources through the Mutual Aid System.

“So far in 2018, we have confirmed that the deadly and destructive wildfires of last year were not an aberration, but the ‘new normal’ for California,” said Jeff Meston, president of the California Fire Chiefs Association. “We thank the governor and state lawmakers for recognizing the fact that we can’t prevent or effectively fight these worsening disasters without additional resources, more modern strategies and better collaboration so that first responders can continue to protect our communities.”

In total, Governor Brown signed nearly 30 bills from state lawmakers to strengthen California’s wildfire prevention, response and recovery through enhancements to: • forest management and fuels reduction • hazardous materials mitigation • disaster response and emergency communications • coordination with electrical utilities and private fire contractors • community alert notification systems • disaster recovery programs D-RiSC called out the following specific accomplishments from the 2018 State Budget and legislative session: • Enactment of SB 901 (Dodd), a comprehensive package of wildfire prevention and safety measures • Enactment of SB 833 (McGuire) to implement a consistent statewide protocol for emergency alert notifications and SB 821 (Jackson) to create an opt-out alert system • $25 million General Fund appropriation for Cal OES to reimburse the local governments when they pre-position resources during high-risk weather events to speed response to wildfires and other disasters through the Mutual Aid System • $25 million appropriation from the Greenhouse Gas Reduction Fund for Cal OES to purchase additional Type 3 engines for mutual aid response, to be staffed by local government personnel • State Budget funding to increase staffing within Cal OES’ Regional Response and Readiness Branch and training for local agencies in the use of the Situational Awareness and Collaboration Tool

Page 2 “Whether it’s catastrophic fire or other disasters, we know that getting mutual aid resources in place ahead of time can save lives and property,” said Brian Rice, president of California Professional Firefighters. “The funding for pre-positioning and other fire and emergency preparations start us down the road, but we can’t be complacent. California needs to commit to a modern disaster response system to meet the changing threat we face.”

“The funding and policy changes approved in 2018 will strengthen the capability of firefighters at the state and local level to respond quickly and with adequate force to wildfires, floods and other disasters,” said Steve Hall, president of Fire Districts Association of California. “Still, change is happening at a rapid pace and we cannot afford to rest. More work needs to be done to ensure funding is spent, as intended, and we are maximizing the benefit of these new laws. We look forward to working with the next administration and lawmakers in 2019 to continue to make our communities safer and more resilient to disaster.”

Currently, D-RiSC is working with Cal OES to refine the pre-positioning program to ensure local agencies can deploy in advance of Red Flag Warnings and other high-risk events, particularly during anticipated high-wind events in Southern California during the fall. To date, local crews have pre-positioned 22 times. ###

Strategically Developing Employee Performance

T

he identification, management, and strategic development of employee performance is a critical ability for supervisors; this article will provide you with a basic approach to accomplish that.

The graphic to the right represents five general categories you can use to sort your inventory of employee performance: self-sufficient excellence, induced excellence, mid-range, corrective discipline, and punitive discipline.

For those few employees that perform excellently, seemingly on their own, little more is initially required than giving clear direction, and providing lesson-based mentoring. Induced excellence requires some coaching – these people have accessible potential, but are not plug-and-play, you’ll need some close proximity in their initial development. Coaching in “induced excellence” is focused on improving existing positive abilities.

Most of our people are not in these first two categories, they’re in the mid-range. At the upper end of that range the group is generally motivated to progress professionally.

What separates them from the excellent is largely the source of motivation. For the mid-range people, at the very upper end, professional competence can be the primary motivator (arguably placing them in the excellent neighborhood), but most are motivated by pay, rank, or other external benefits.

These are not bad motivations, but 14

they are not actually as “motivating” as many might think. For a short, informative, and entertaining treatment of motivation, watch the animated TED Talk by Dan Pink.

At the other end of the mid-range are the unmotivated, those that do not want to progress. These are not necessarily bad employees.

Indeed, people that are good at what they do, but no more, and are also stable, provide a very accurate and consistent level of capacity that’s valuable for supervisors as they project the time and resources needed to accomplish tasks. However, if your purpose is to develop employees (i.e., succession planning) then “dead in the water” and meeting “minimum acceptable performance” is not what you’re hoping to accomplish.

More importantly, most of the people residing in this zip code of the mid-range category are frequently candidates for discipline founded on poor performance (usually excessive absence, inappropriate behavior, or technical incompetence). The mid-range is the

most effective employee category for a properly applied performance evaluation. For those at the upper end of the mid-range, an evaluation that focuses on the next steps/ strategies for excellence enables a “shift” from mid-range to excellent.

For those at the lower end of the mid-range, an evaluation offers the last non-disciplinary venue to arrest their fall into the disciplinary abyss.

There are two primary reasons it is more difficult to get positive development in the bottom two performance categories than it is in the upper two categories. First, psychologically, the same effort given in positive reinforcement (what to do) is far more effective then the same level of effort given in negative reinforcement (what not to do). This is likely the basis for the saying that, “We spend 90% of our time on 10% of our people.”

Second, when employee discipline progresses from a corrective focus of action to a punitive focus, your flexibility on how to manage the employee narrows markedly.

be built around what will be the most effective with consideration for the individual (i.e., how they communicate/learn, their individual starting point, their employment history, etc.). Once you enter a punitive focus of action the process is built around consideration for the organization (i.e., is it following a legally defendable path, how does it exchange an ineffective employee for an effective one, does it remove line supervisors from the process and turn it over entirely to HR/legal, etc.).

The take-aways: • Mentally assess how the inventory of your personnel are distributed among self-sufficient excellence, induced excellence, mid-range, corrective discipline, and punitive discipline.

• For those in the first two categories, • Mentoring is focused on employees recognizing their present success is based on KSA’s exceeding current level of task difficulty, future success will require future growth.

• Coaching is focused on improving existing positive abilities.

• Mid-range (most of our people) is the most effective place for the properly used performance evaluation.

• It’s much harder to shift people toward excellence from the “disciplinary” categories than from the mid-range.

• You have very little flexibility to consider the individual once you have entered a punitive focus of action.

appy Holidays from Zone 3! As your FDAC Zone Representative and Treasurer, I wish nothing but the best for you and your fire districts in the coming new year.

Wow, 2018 was packed with business and fire responses for the agencies within our zone. As a zone that had members that were active with D-RiSC at the grassroots level and with Districts that prepositioned, FDAC is grateful to all that helped with bringing this concept to reality. Within Zone 3, we are lucky and privileged to serve with the California Fire Chiefs Association Fire Chief of the Year, Chief Jeff Carmen of Contra Costa County Fire District. Chief Carmen was one of the Zone 3 Fire Chiefs that was instrumental with the success of the D-RiSC initiative and has contributed in many ways to the fire service; Chief Carmen exemplifies excellence in leadership on a routine basis.

As I write this article, many Zone 3 districts, including my own, still have personnel deployed to the Camp Incident in Paradise, California -- the deadliest incident in decades and the most destructive fire in the history of California. This fire burned at a rate and intensity that unfortunately seems to be becoming the norm; just over a year ago, the fires in Sonoma and surrounding areas brought the same type of destruction and loss of life to the citizens of California. I know the response from our districts using the Mutual Aid System is reducing the loss of life and property and aiding in the recovery efforts to those that live within our State.

We must continue to work together to find ways to reduce the risk and damage caused by these catastrophic incidents. We are incredibly proud of our districts
