Why Labour Market Opinions Do Not Always Guarantee a Work Permit

oreign nationals who want to work in Canada or before becoming permanent residents can work in Canada with a work

permit. In most cases, an employer must first obtain permission from the government of Canada to hire a foreign national by proving that

In this case, Mr. Singh submitted letters from his previous employers that indicated he could understand English. However these letters did not state that he had the ability to speak or write English and the judge found that the officer was entitled to make the decision that Mr. Singh did not prove his English language ability.

With new changes to immigration laws requiring most permanent resident applicants to submit an English language test before becoming a permanent resident, the best solution when applying for a work permit is to complete a Citizenship and Immigration Canada approved language test before applying for

In most cases, individuals who receive Labour Market Opinions are granted work permits. However, obtaining a Labour Market Opinion is no guarantee that a work permit will be issued. It is still necessary for the foreign worker to establish that he or she meets the requirements of the job as set out in the Labour Market Opinion. For instance, the foreign worker must show documents that establish they have the work experience and education needed for the position.

Earlier this year, the federal court decided the case of Ranjit Singh. In this case Mr. Singh’s employer obtained a positive Labour Market Opinion allowing him to work in Canada as a cook. However,

I served as his live-in caregiver for almost three years, from my day one in Canada in 2003 to the end of his days. That had been a very prolific period for me as a poet; I was writing at least one poem a day for almost two years. Considering such challenging circumstances, one can imagine the contemplative and honest nature of many of the poems I produced. I remain proud of them.

Here’s one poem I wrote days after Grandfather died. It reflects my unsurprisingly antithetical feelings of sadness and happiness.

Grandfather’s death symbolized two major turning points in my life—freedom from a painstaking family task and the beginning of my independence in Canada.

And, for me, the eighth of July commemorates two important events—the death of a grandfather and the rebirth of a grandson.

Di ako dapat kabahan.

Sa panibagong pagsubok, Lalak'san ang kalooban.

At natapos ang prusisyón. 'haba ng aking nilakbay.

At muli akong babangon.

At Natapos ang Prusisyón

Kung may dilim, may liwanag.

Ganyan talaga ang buhay; Hindi dapat maging duwag.

At si Lolo'y pumanaw na...

The Last Leaf The poem is comprised by 12 stanzas, each of which consists of three lines, and each line of eight syllables (even the title is comprised by eight syllables). Every stanza consistently follows a rhyme scheme of a-b-a.

Take note of my having observed again proper punctuation—a poetic feature many poets tend to ignore for various reasons.

Councilor Mike Pagtakhan

T

hroughout the month of June, Councillor Pagtakhan attended numerous graduation ceremonies in the Point Douglas Ward to present the Point Douglas Community Service and Citizenship Awards. This included elementary, middle and high schools.

These awards are given to students who are not only active in their school, but within the larger community of Point Douglas. This includes being active in school activities, volunteer programs in various organizations, sports, cultural organizations and being active within a church.

Along with these school graduations, Councillor Pagtakhan

was was invited to be the guest speaker at the 46th Canadian Institute of Management Graduation Ceremony held last June 23, 2012 at the University of Manitoba.

Councillor Pagtakhan spoke to 50 graduates about constant change saying that, "in one's own life, you will have to adapt to a continuous changing economy. You may end up having more than one job, and more than one career over the course of your life. You will have to keep gaining new skills, possibly even new degrees, diplomas, or take various courses in continuing education and you will have to keep on taking risks as new opportunities arise."

Councillor Pagtakhan has also maintained a commitment to family and was recently bestowed the “Father of the Year Award� by the Filipinos Seniors Group of Winnipeg (FSGW) last June 30, 2012 for being a role model and citizen of the community.

Along with these recent activities, Councillor Pagtakhan continues to be a dedicated member of the following organizations: Lord Selkirk West Kildonan Community Committee; Standing Policy Committee on Property and Development; Citizen's Equity Committee-Chairperson; Winnipeg Housing Rehabilitation CorporationBoard Member; Deputy Speaker; Youth Ambassador; Fred Douglas Foundation-Chair; Exchange District Biz-Board member and Philippine Canadian Center of Manitoba-Board Member.

"IN ADAGIO" written and performed by Jess Salgueiro, premiers at the Fringe Theatre Festival

J

essica Salgueiro, the actor daughter of John and Lita Salgueiro, owner of JS FURNITUTE, has written and will be performing in "IN ADAGIO" which will be premiered on a 7-day presentation at the 25th Winnipeg Fringe Theatre Festival.

Salgueiro who is also a film actor has been involved in many film projects. For her newest project, "IN ADAGIO," Jessica will be performing in front of a live audience.

"IN ADAGIO", set in the 60's, tells the story of two singers

who are double billed to sing at the legendary Paris Opera. The audience is immediately introduced to the reigning Queen of Opera and the sensational new face of the Portuguese Fado. Due to the intense climate of the Algerian War, a bomb threat has been made on the theatre and the two performers are trapped.

The women discover a way to use their empty stage to showcase their distinct styles of music and the striking harmony of their own fears and obsessions.

The show will begin on July 19 at 9 p.m; July 20, 12 noon; July 22,

10:45 p.m.; July 23, 12 noon; July 25, 3:45 p.m,; July 27, 7:15 p.m. and July 28, at 11:30 p.m. The venue is: The Muriel Auditorium at the Winnipeg Art Gallery, 300 Memorial Blvd.

Palace has no final decision yet to request for US spy planes

S

ecretary Ramon Carandang of the Presidential Communications Development and Strategic Planning Office (PCDSPO) indicated that Malacañang has no final presidential decision yet whether the country will request the United States (US) to deploy spy planes over the West Philippine Sea. Carandang explained that the possible deployment of US planes is not a provocative act against China but the responsibility of the government in doing its function of monitoring its territorial waters.

President Aquino, in a recent interview with Reuters, confirmed that the government may ask the US to help the Philippines monitor the West Philippine Sea as the government has limited monitoring capabilities.

China’s media however accused the Philippines of orchestrating a plot to deliberately stir up tensions over the disputed South China Sea, and warned that Beijing’s patience should not be mistaken for weakness.

China, the Philippines, Taiwan, Brunei, Vietnam, and Malaysia all have competing claims in the South China Sea. The US has stressed its neutrality in the maritime dispute despite offering to help boost the Philippines’ military forces.

The man behind The Target A conversation with Cirque du Soleil’s Ardee Dionisio

irque du Soleil is coming back to Winnipeg with "Quidam" (pronounced “key-dahm”) this month at the RBC Theatre at MTS Centre. "Quidam" is a story of a young girl name Zoe living in an imaginary world of

Quidam to escape reality.

Philippine born, Ardee Dionisio hails from the Bicol region of the Philippines and is living his dream job as he plays the role of The Target in "Quidam." In an interview while he was touring

in St. Louis, Missouri and currently based in Austria, the Filipino Journal was able to speak to Ardee about his experience with Cirque du Soleil.

Discovered by chance by Cirque du Soleil talent scouts from online YouTube videos, Ardee was invited to audition for Cirque du Soleil two years ago. Having missed auditions in Vienna, he went to audition for Cirque do Soleil in Berlin and later learned he was offered a contract with world renowned performance company which began in 2010. He started in their South American tour included Chile, Peru and Columbia.

Ardee describes "Quidam" as one of Cirque du Soliel's darkest shows as the imagery, costumes are very dark and one of its most realistic. His character, Target accompanies the lead character Zoe through the imaginary world of Quidam as her guide, friend and happy-go-lucky companion.

His training and career began with Ballet Philippines in High School. After high school, Ardee moved to Hong Kong to eventually

graduate with distinction from the Hong Kong Academy of Performing Arts. As an artist, he's been inspired by many people along his career including his cousin, April Silot based in St. Louis. Inspiration also came from Rafael "Nonoy" Friolan, Premier Danseur with Ballet Philippines; the late Noordin Jumalon, former director of the Cultural Center of the Philippines (Ballet Philippines) Dance School; and as Ardee proclaimed, "the best choreographer in the Philippines" Agnes Locsin.

Currently on a short two-week break in their tour, Ardee Dionisio is back in Austria spending time with family before heading back on

their North American tour. We want to congratulate Ardee, his wife and family on being a new father to a baby daughter last month.

True to his Filipino roots, I also had to ask Ardee about his favourite Filipino foods. Sinigang na baboy was one of them and based on his Bicol family roots, he mentioned that adobo chino (or adobo tsino) was also on his favourite food lists.

Dolphy remains in ICU

omedy King Dolphy remains in the intensive care unit (ICU) .as doctors at the Makati Medical Center continue to monitor his health condition following another bout with pneumonia.

The latest medical bulletin issued by the hospital noted that this is the 12th time the comedian has been afflicted with said lung infection.

Dolphy’s heart rate, blood pressure and vital signs have reportedly improved over the last few days. Although he is still

The “KrisTV” host recently seek out the wise words of the good senator in an on-air, heartto-heart talk about maintaining friendly relations with an ex lover.

Escudero’s advice was apparently effective as it resulted in a pleasant meeting Kris recently had with ex-husband James Yap. The 41-year-old Presidential sister had previously bewailed on her show about having a misunderstanding with James when the latter commented about her wearing a duster at home.

Hours after her meeting with the senator, Kris posted on Twitter a photo of James with their son Bimby seemingly having a good time, and with a photo caption that reads she took the photo not wearing a duster.

The next day Kris proudly shared to the lawmaker that she actually took his advice to be nice towards her ex-husband. She also admitted that the pleasant meeting with James was a huge progress compared to their last encounter.

Big Fish Tales on the Red River

T

Moving to “secret fishing spots” along the Red River also proved to be unlucky. Even after our mid-morning snack bags provided by the Manitoba Wildlife Federation, I contemplated using the Goldfish Crackers as replacement bait. I ended up eating the crackers as we headed back to murky and turbulent waters by the Lockport Dam. I was casually reeling in my line thinking my bait was eaten by sneaky catfish, all of a sudden, BOOM! A fish! I had something! I think Jeff was more surprised than I was since it was so close to the boat. I reeled in a 26” freshwater drum. As Jeff said it, “Oh it’s a Master Angler and you killed it!” The minimum length of a freshwater drum Master Angler is 24”. Yay for me! My 2nd Master Angler!

According to Jeff, my CTV colleague, Jillian Taylor caught the heaviest catfish but unfortunately, was not long enough to qualify as a Master Angler. Not even a 2nd round of “Here fishy, fishy, fishy!” helped our cause in securing a third Master

he Travel Manitoba “Fish Tales” event was my fifth opportunity in my lifetime to go fishing and all five times, they’ve been in Manitoba waterways. The last time I went fishing was just under 10 years ago when I caught a 43” Northern Pike at Falcon Lake and I was awarded my first Master Angler.

The media “Fish Tales” challenge began at the crack of dawn in Selkirk, Manitoba as the launching off point as we headed down the Red River to cast our lines near the base of the Lockport Dam. In our boat was Ellen “Rodzilla” Pruden, with the Canola Council of Manitoba and Jillian “Jigmaster” Taylor from

CTV and our boat captain and fish guide, Jeff Geothals from Hooked Magazine.

Not less than five minutes into the morning fishing expedition, Ellen Pruden fought hard to reel in a 36” channel catfish while Jeff helped bring the big fish into the boat.

That was good enough to earn her first Master Angler. I followed up by reeling in a smaller 32” channel catfish, just 2” shy of my coveted 2nd Master Angler award. I was on a mission that morning and even shouted, “Here fishy, fishy, fishy!” in my best Ernie voice to tempt fish to jump into the boat. No such luck.

Angler for our boat. Yes, media challenges are all about bragging rights. During our shore lunch, Ellen “Rodzilla” Pruden walked away with the Best Fish Tale honours as she sang a cute and quirky fish song.

Our Dunedin experience starts from Port Chalmers inside the Otago Harbour, the gateway to Dunedin, which is located about eight miles from the city centre.

Travelling alongside quaint stone-walled farmlets the whole day guided bus tour that began early in the morning offered panoramic views down the Otago Harbour on one side and the Pacific Ocean on the other.

Continuing through the tranquil countryside and halfway down the Otago Peninsula we called into the grounds of the famous neo-Gothic Larnach Castle. Built for banker William Larnach and his first wife Eliza, the estate boasts lavish embellishments, rich appointments, beautiful gardens, and spectacular tower views overlooking the harbour.

Today the castle is home to the Barkers who have spent over 40 years restoring the 40,000 sq. ft. mansion, filling it with original New Zealand period furniture and antiques and gracing it

with a garden of international significance.

After a photo stop at Dunedin's landmark railway station that features an elaborate Victorian facade, extravagant tile floors and etched glasswork, we visited the Cadbury Chocolate Factory where we learned the history of chocolate at the informative visitor centre and see how Cadbury chocolates are made on a factory tour also featuring an amazing 5-story chocolate fall.

The Otago Museum is the place not to miss. For a $10

entrance fee you can have a guided tour of the various galleries, and its culture, nature and science centre.

For local cuisine that's distinctly New Zealand style we enjoyed the lamb, cervena (venison), Bluff oysters, paua (abalone), pipis and tuatua (both are types of New Zealand shellfish), kumara (sweet potato), and of course, the kiwi fruit and tamarillo and the national dessert, pavlova.

love vehicles that offer simple conveniences. In the newly redesigned 4th generation 2012 Honda CR-V, there’s one feature that I just love and that’s the onepull-one-motion cargo lever that folds the rear passenger seats down without having to move headrests or fold seats. Filipino Lawyer Dexter Lacanilao Admitted by the Law Society of Manitoba to Practice Law

T

he 69 law graduates who hurdled the 2011 – 2012 Manitoba Bar Admission Program officially became lawyers last June 21, 2012 after taking their oath before justices of the Manitoba Court of Appeal and Court of Queen’s Bench in this year’s mass Call to the Bar. They are now qualified to practice law as barristers and solicitors. The ceremony, which is a special sitting of the Court of Queen’s Bench, was held at the Manitoba Centennial Concert Hall.

Among those called to the bar is our kababayan, Attorney Dexter Lacanilao – a Filipino Lawyer who used to practice law in the Philippines.

He and his family moved to Canada in 2008. His wife, Mary Claire, who is likewise a lawyer in the Philippines, is currently a Deputy Registrar of the Court of Queen’s Bench in Winnipeg.

Dexter earned his Bachelor of Laws degree in the Philippines, has passed the Philippine Bar Examinations almost a decade ago, and is a member of the Philippine Bar. He has also finished studying the required law courses at the University of Manitoba. He has obtained the licences to practice law in Manitoba and the Philippines.

Dexter is a former Court Attorney of the Supreme Court of the Philippines (the highest court in the Philippines) and of the Philippine Court of Appeals. He likewise held other positions in the Philippine government as Legal Division Chief of a provincial office of the Department of Agrarian Reform and as Public Attorney in a district office of the Department of Justice’s Public Attorney’s Office.

He likewise practiced law at a law firm in Greenhills, San Juan and in Nueva Ecija, Philippines.

Aside from practicing law, Dexter has also taught courses in civil law and commercial law in the Philippines to paralegal students at the Arellano University in Manila and at the Institute of Continuing Legal Studies and Education in Greenhills, San Juan.

While studying law at the University of Manitoba, Dexter volunteered with the University of Manitoba Law Centre - Legal Aid Clinic and appeared for clients before the Provincial Courts of Manitoba. After studying law at the University of Manitoba, he worked as an Articling Student-atLaw in Winnipeg with the Agassiz Community Law Centre of Legal Aid Manitoba.

Starting this July, Dexter will join the law firm of Booth Dennehy LLP in Winnipeg. He is ready to serve the Filipino community in Manitoba.
