PubLisher FROM THE
May is all about Mums. It's a bittersweet time for a lot of people, for sure. mum is the heart of the home; mums are what make a house a home, and, by extension, what make an estate a community. There is an invisible thread mums weave between neighbours, school runs, shared braais, and kids playing in the street safely. “It takes a village to raise a child.” We must try to see that, in this different type of living, the estate is the village. For parents, there is nothing more important than the joy of raising kids in a safe, connected environment where other mums have your back. This is the month to acknowledge everything mums do quietly and consistently, the estate lifestyle as the ultimate gift a parent gives their family – safety, space, nature, community.
In this edition, we have an update on the stormwater Dam Project, an infrastructure strategy to improve stormwater management. It is going well, and the team is preparing for the next stage.
Management reminded us about a few important things: hosting private functions in your seaward home – all the do’s and don’ts. We also get information regarding levies, and we get to understand more about the board's approach to maintaining the estate's financial stability. Finally, regarding ‘The Essential Guidelines’ for Furry Companions, residents are reminded of the rules for having a pet on the estate.
But back to being a mum, and maybe this month really hone in: start with quiet reflective mornings, coffee on the patio, watch the kids riding bikes, enjoy listening to the birds, remember this is the life you chose, so live it intentionally.

Stormwater Dam Project
We are pleased to share a positive update on this important project’s progress.
This project forms a key part of our long-term infrastructure strategy, aimed at improving stormwater management, protecting road surfaces, and enhancing the overall resilience of the Estate during periods of heavy rainfall.
Progress update
Work on the Alex Park Dam is advancing well, with earthworks actively underway. The team has made strong progress in shaping the dam structure and preparing the site for the next phases of construction.
During excavation, groundwater was encountered at a shallower depth than initially anticipated. While this required a design adjustment, it has been addressed proactively by introducing additional sub-surface drainage measures. These improvements will ensure the long-term stability and effectiveness
of the dam, and ultimately strengthen the overall system.
The san Terena Park Dam is currently in a holding phase while additional environmental processes are being finalised. This ensures that all work is undertaken responsibly and in line with the necessary environmental
requirements before construction proceeds.
environmental rehabilitation
A key focus of this project is not only infrastructure, but also environmental enhancement.
We are pleased to have Dr Jonathan Foley and Richard McKibbin involved in
guiding the rehabilitation and replanting of the dam areas once construction is complete. The approach will focus on restoring the sites with appropriate indigenous vegetation, improving biodiversity and integrating these spaces naturally into the surrounding environment.
The clearing of invasive vegetation in these areas is already contributing positively, and the outcome will significantly enhance these green spaces within the Estate.
What’s next
Work at Alex Park Dam will continue
over the coming weeks, focusing on drainage implementation and final shaping of the dam.
Further updates on the san Terena Park Dam will follow once the environmental processes have been concluded and timelines are confirmed.
temporary disruption
Residents may notice ongoing construction activity in certain areas, including the movement of trucks and equipment. We appreciate your patience during this period, as these works are essential to delivering a high-quality and longlasting infrastructure solution.
Long-term value
Once completed, the stormwater dam system will:
• Improve stormwater flow management across the Estate
• Reduce pressure on road infrastructure
• Minimise erosion and water-related damage
• Enhance environmental areas within the Estate
• Contribute to the longterm sustainability and value of seaward Estate
We will continue to keep residents updated as the project progresses.
Thank you for your continued support as we invest in the future of seaward Estate.

Estate Financial Update: levies & debt Recovery
The Board continues to take a firm and consistent approach to levy collection to protect the financial stability of seaward Estate.
Recently, the Estate came within minutes of a property being sold in execution due to prolonged non-payment of levies. While this outcome was ultimately avoided through a
last-minute settlement, it highlights the seriousness of continued non-compliance and the lengths to which the Estate needs to go to recover outstanding amounts legitimately due for services rendered.
Currently, the Estate’s debtors’ book exceeds r3.2 million, with 84% in long-term arrears nineteen owners account for the majority
of this debt – that is, a mere 2.4% of owners effectively placing an unfair burden on the balance of owners who meet their obligations consistently.
Levy payments are essential to fund security, maintenance, and services that protect property values, ensure the smooth running of the Estate and provide cash flow. Non-payment shifts
this responsibility onto compliant residents, which is neither fair nor sustainable, and the Estate carries all legal costs associated with the debt collection process until the owner settles the outstanding levy.
Owners are reminded that disputes do not justify withholding levy payments. All accounts must remain current while concerns are addressed through the appropriate channels.
The Board remains open to reasonable payment arrangements where residents engage proactively. However, where there is continued non-payment and lack of engagement, legal recovery processes, including sale in execution, will be pursued!
The Estate cannot operate as a credit facility, and a small minority will not be permitted to compromise the financial wellbeing of the broader community.
note
• Ballito Estates charges for arrear levy collection, which will
be in accordance with the approved charges as per the Debt Collectors Act, it being confirmed that Ballito Estates are members of the Debt Collectors Council.
• All legal fees charged by both Ballito Estates and the Attorney are fully recoverable from the arrear debtor, including attorney-client costs.
• As the budget is based on annual income, even though levies are payable monthly by agreement of the Trustees, if a monthly levy falls into arrears and is handed over, the full year’s levy will be claimed. Compound interest will be charged on arrear levies monthly at 2% per month.
rePayment
Owners in arrears are urged to engage with Management without delay. The Estate’s current policy allows the following repayment plan:
• 50% of the arrear amount paid up front
• The balance to be settled over three months
• The debtor is to sign an Acknowledgement of Debt (AOD) with the Estate’s Attorneys
• The owner will be liable for ALL legal and interest charges
should an owner wish to enter into an alternative payment arrangement, they would need to show affordability by providing the following information so that the Board of Trustees can decide on the proposed payment plan:
1. A balance sheet
2. Proof of income
3. Income and expenses schedule
4. Bank statements for the past 3-6 months
5. Credit check (this can be done by our offices with your consent)
6. A full list of debts, repayment terms and amounts
7. Details of any other creditors
It should be noted that there is no legal requirement for any notice to be given to the debtor that the debt is being handed over to an attorney prior to the issue of a summons. The fact that a demand letter was not received by the debtor is not a defence to legal action being taken.

Essential guidelines for furry companions Pet Enclosures
Living harmoniously on a residential Estate delivers many benefits, and achieving this goal requires a delicate balance of living your lifestyle as an individual family while respecting your neighbours. Residents at seaward Estate are fortunate to live in a pet-friendly environment. sEMHOA understands that pets are an integral part of some families and has strived to create a space for domestic animals while managing the risks associated with this practice and ensuring the safety and comfort of all involved.
Pet owners should know that all pets require an
application to be approved prior to bringing any pets onto the Estate.
An important requirement to acquire before acquiring a pet is an outdoor enclosure. Pet enclosures on residential estates are important for many reasons, such as:
• Keeping pets safe from exterior hazards and dangers such as traffic, potential predators and theft.
• Preventing pets from becoming a nuisance to neighbours, by roaming into other gardens, making excessive noise and messing in communal areas.
• Preventing pets from damaging common
property, gardens or landscaping, which also helps residents comply with Estate Rules.
• Providing pets with a dedicated “safe haven” for resting, hiding and security, reducing stress and anxiety caused by the demands of household activities.
• Compliance with Estate regulations.
sEMHOA requires that the height of fences must suit the size of the pet being enclosed to prevent jumping, with no gaps for escape, as well as sufficient space for movement and exercise. The fence material and design selected must comply with our architectural guidelines. Gates should be lockable, with pet-proof latches.
Pet-friendly Estates that allow pets whilst still enforcing rules often see a higher demand and faster property sales. Working together, we can make pet ownership a pleasant experience for all residents and enjoy the rewards of living a more enriched lifestyle alongside our animal companions.
