No to Julen case plea A COURT hearing the case against the owner of the well in which two-year-old Julen died has thrown out an attempt to make the boy’s father issue a joint statement with the defendant. The land owner, David Serrano, is accused of manslaughter by negligence and is currently facing trial at the Provincial Court of Malaga - the only one facing homicide charges. Julen Roselló died when he fell down a narrow shaft while out for a picnic with his parents on the land owned by family friend Serrano. Teams of miners worked for days to dig a parallel shaft to try and free Julen, but by the time they reached him it was too late. In latest developments Serrano’s defence team, Lawbird Legal Services, called for joint statements from the defendant and the boy’s father, José Roselló, blaming the people who drilled the narrow well for the tragedy. He also wanted Roselló to state that he had been warned about the existence of the newly drilled shaft. It was stated to be an attempt to clear the defendant’s name by tying together the two stories - that of the defendant and that of Roselló. However, the judge decided that such a joint statement was unnecessary and would make no difference to the outcome of the trial.
