Compromise served

Citing new evidence, state drops felony charges against Tampa BLM protesters.

J

amie Bullock steps out of an elevator into the lobby of the Hillsborough County Courthouse with her boyfriend Dante Perez and her lawyers. She’s heading home with a sense of relief, but she’s still trying to shake her frustration. Serious charges have been hanging over her head for more than a year and the situation has turned her life upside down.

But now, her court case for protesting for Black Lives last year is finally resolved. She’s ready to move on with her life. “I hope I never see any of you again,” she jokes to her lawyers, and the group breaks out into laughter that cuts through the silence of the courthouse lobby.

What started as a felony and two misdemeanor charges against Bullock that could have resulted in up to five years in prison were reduced to a misdemeanor intervention program, which includes 24 hours of community service and fees, during a hearing last Wednesday, Oct. 6.

As part of the intervention, the state also asked Bullock for a letter of apology, but she denied that. “I’m not going to apologize for protesting for the rights of Black people,” she told Creative Loafing Tampa Bay. Bullock’s co-defendant Chukwudi Uche, who was also protesting that day but was not involved with Bullock’s arrest, also took a pretrial intervention for a felony concealed firearm charge.

He will have to complete 50 hours of community service and write a letter of apology to the state, along with forfeiting his firearm. If these conditions are met by both Uche and Bullock, the Florida Justice Center will take steps to clear their records so that they will not have misdemeanors on their records.

“In every prosecution, our office evaluates the appropriateness of the charges from the beginning of the case until the end,” Grayson Kamm, Communications Officer for State Attorney Andrew Warren’s Office wrote in an email to CL. Kamm says that the state received new evidence in the past few days—including bodycam video and interviews with defense witnesses— that had a direct impact on the state’s ability to prove all the required elements of a battery on a law enforcement officer charge beyond and to the exclusion of a reasonable doubt at trial.

“Other charges remained against the defendants because public safety requires we hold people accountable for illegally carrying a weapon or putting their hands on an officer,” Kamm continued.

Defense attorneys for both Uche and Bullock stood firm in their stance that their

evidence of Bullock ever striking an officer, and that video shows that the water bottle the state claims Uche threw but has no evidence of, struck a cop’s tire, but did not hit a cop. The defense attorneys said the reduced charges were a decent offer, but that the charges should have been completely dismissed.

A jury panel was being selected for the trial of the two activists when the state and the defense teams made the deal. Of the 65 potential jurors who waited outside of courtroom one, only two were Black.

She says that even if it is alleged that her client was found with anything at all on him after the arrest, “You’re completely ignoring the fact that you unlawfully arrested him for nothing.”

Bullock and Uche’s case stemmed from an incident that occurred on Fourth of July, 2020. During the height of the George Floyd uprising, they peacefully marched down Dale Mabry Highway, until the cops arrived in a violent fashion. Police helicopter video shows four TPD bicycle officers pedaling down a side street straight into the crowd. Shortly after they arrived, a police officer is heard saying, “Try to get charges on someone if you can,” right around the time Bullock was being arrested.

“The police acted like monsters to the protesters that day,” Michelle Lambo, defense attorney for Bullock, told CL. Through a “Motion in Limine”, the state had tried to remove any talk of the constitutional right to free speech, the right to assemble and police behavior during the protest from the trial (among other things) but Judge Kiser shot down the key points of the Limine last week.

During that hearing, Judge Kiser also threw out the state’s unlawful assembly misdemeanor charge, because Florida state law says blocking a roadway should be a civil citation, not a misdemeanor.

For the entire case, Bullock, Uche and their attorneys have maintained their innocence about their most serious charge of battery on a law enforcement officer, saying there is no evidence of such a thing occurring. Now, after over a year of a case hanging over their heads and the use of taxpayer time and money to pursue charges, they are headed to diversion. They can finally move forward with their lives.

For Bullock, this ordeal that threw her entire existence into a tailspin has now resulted in a simple misdemeanor diversion. She feels that even that is a compromise for her, and that it shouldn’t have taken all this for her to be able to continue on with her life after protesting.

“I’m upset that the state put me through this experience for doing nothing other than expressing my first amendment rights,” Bullock told CL. “But I’m really happy and excited to be able to move forward and leave this case behind me.”

Judge Mark Kiser, who was presiding over the case, walked out of the courtroom to address the crowd. “We thank you for coming to court early in the morning, but the case has now been resolved,” Kiser said. The potential jurors took no time to get out of their seats and rushed to the elevators.

Man wrongfully imprisoned for 37 years sues TPD officers for falsifying evidence.

A

man who spent 37 years in prison after the Tampa Police Department falsified evidence against him is now suing four TPD officers and an “expert witness” for damages.

DuBoise was just 18 when he was arrested in 1983 and four TPD officers allegedly conspired to falsify evidence against him in order to wrongfully convict him of murder and rape.

From the day of his arrest until his release last year, Robert DuBoise consistently maintained his innocence. “The only physical evidence against him was faked ‘bite mark’ evidence that allegedly pointed to DuBoise as the culprit. The scientific validity of bite marks as evidence has been thoroughly discredited in recent years, and in DuBoise’s case, the bite marks on the victim turned out to not even be produced by a human,” says a press release sent out Oct. 4.

According to the statement, DuBoise and a team of lawyers from the Human Rights Defense Center and Loevy and Loevy Attorneys

at Law are suing the TPD officers and a witness from the trial.

DuBoise never gave up on gaining his freedom and reputation back. He filed his own legal motions and sent letters to advocates and attorneys around the country, asking them to take up his case. In 2018, The Innocence Project and its attorneys did just that.

In 2020, critical DNA evidence that was believed to have been lost was uncovered. DNA testing conclusively proved Mr. DuBoise’s innocence and identified the real killer(s)—people with no connection to DuBoise. As a result, he was released from Hardee Correctional Institution in Bowling Green, Florida on Aug. 27, 2020, a day after prosecutors dropped their case against him.

On Sept. 14, 2020 DuBoise was finally exonerated of the crimes.

At DuBoise’s trial in 1984, the sum total of evidence against him was the “bite mark”

identification and police informant testimony— which the press release from DuBoise’s lawyers says was fabricated by the state.

Knowing that the physical evidence was poor at best, the officers—now defendants themselves— allegedly then conspired to get two informants, including one suspect facing a long-term sentence for unrelated crimes, to lie. One of them falsely claimed that DuBoise confessed the murder to him, but his story changed significantly in various recountings. The press releases says these witnesses allegedly failed a polygraph test, but the polygraph result and other exculpatory evidence were suppressed by the TPD officers.

DuBoise is also suing dentist and self-proclaimed bite mark evidence expert Richard R. Souviron. He claimed that a gap in the teeth marks on the deceased matched DuBoise’s teeth, even though a contemporaneous police photo showed no such gap in DuBoise’s teeth. Even after dental records revealed this clear inconsistency, Souviron testified under oath to this phony match.

According to court records shared in the press release, before DuBoise’s trial, Souviron had already showed a pro-prosecution bias at an International Association of Chiefs of Police conference, saying, “If you [police] tell me that is the

guy that did it, I will go into Court and say that is the guy that did it,” and “If the detectives say he did it, I am going to go in there and say he did it.”

On March 7, 1985 a jury found DuBoise guilty and unanimously recommended life in prison, but a notoriously harsh judge, “Hangin’ Harry” Lee Coe sentenced him to death in the electric chair. While he avoided execution, DuBoise was falsely branded a rapist and murderer. During his decades of maximum security imprisonment—including three years on death row—he witnessed stabbings and killings of other inmates, and was himself the victim of violence, including an attempted murder.

The second youngest of five siblings, at the time of his 1983 arrest, DuBoise had dropped out of Tampa’s Plant High School to support his parents by working in an auto upholstery shop with the hope that he could eventually return to school and earn his diploma. During his long incarceration he lost his father and many aunts, uncles, nieces, and cousins. Today he works as a home renovator and repairer.

Protesters once again call for removal of Tampa’s Columbus statue.

ast Sunday afternoon, around 60 protesters gathered at Columbus Statue Park to once again protest Tampa’s monument to a genocidal maniac. The action came on the eve of Indigenous Peoples Day (which some localities still recognize as Columbus Day).

Members of the Florida Indigenous Alliance (FIA), who organized the event, offered prayers and songs to the victims of Christopher Columbus. They made statements full of rage toward Columbus and the deadly process of colonization that he represents.

Some pointed out that Columbus fed Indigenous babies in the Caribbean to dogs.

Others decried him for enslaving and raping young women and mutilating the genitals of Indigenous people. Emotional outcries against the statue and the city officials who keep it there were made as supporters watched on.

Some of the supporters carried red dresses on poles, which represented missing and murdered Indigenous women, an aspect of the ongoing genocide against Native people. A teddy bear with an orange shirt sat at the base of the statue, representing the remains of thousands of Indigenous children that have been found recently at Canada’s “residential schools” where Native children were tortured and killed. Meanwhile, The U.S. has yet to

fully begin to uncover all of the bodies that lie were lost because of this country’s “residential schools”.

Ally groups spoke as well. Members of the Party for Socialism and Liberation, the Uhuru Solidarity Movement, Dream Defenders, the Central Florida Popular Front and others discussed the ill effects of colonization and capitalism across the world. Tampa Natives spoke about their ongoing struggle to change the names of schools where their images are used as mascots—the Chamberlain High “chiefs” are one example.

Sheridan Murphy of FIA, who’s been protesting the Columbus statue since 1992, wrapped up the speeches and afterwards, attendees took turns putting handprints of fake blood on the statue. When everyone was finished, the statue was drenched in the fake blood, symbolizing Columbus’ killing spree. Last year, Tampa Police Department showed up to defend the statue when people put handprints on it, leading to a tense standoff between protesters and the police. But this year, no police showed up, and FIA and their supporters were able to conclude the ceremony without interruption.

The center cannot hold The decline and fall of American democracy is here.

To fix it, we must acknowledge its presence.

Billman These absurd proclamations have served as the impetus for a wave of restrictions to ballot access and may provide the justification for Republicans legislatures (or a Republican Congress) to reject Democratic electoral slates in 2024 and crown Trump (or another Republican) president.

As the political scientists Steven Levitsky and Daniel Ziblatt—authors of the seminal work of the Trump era, “How Democracies Die”—recently explained in The Atlantic: “When contemporary democracies die, they usually do so via constitutional hardball. Democracy’s primary assailants today are not generals or armed revolutionaries, but rather politicians … who eviscerate democracy’s substance behind a carefully crafted veneer of legality and constitutionality.”

In a more representative democracy, voters could punish Republicans for their anti-democratic scheming. But not here, they continued: “Countermajoritarian institutions [e.g., the U.S. Senate and the Electoral College] shield Republicans from genuine competition. By allowing Republicans to win power without national majorities, this constitutional welfare allows the GOP to pursue extremist strategies that threaten our democracy without suffering devastating electoral consequences.”

The fault for our democracy’s decline and fall doesn’t just lie with Trump and the constitutional anachronisms his party is exploiting, of course.

There’s plenty of blame to go around: Fox News, which has been “promoting lies, and then reporting their traction as national news” for 25 years, as Washington Post media critic Erik Wemple put it; and Facebook, the great misinformation trafficker, have poisoned the well of public discourse.

There’s also an economic approach that over a generation has shifted U.S. wealth from the middle class to the richest Americans, breeding the kind of anxiety that demagogues exploit. According to the Federal Reserve, as of June, the middle 60% of households owned 26.6% of national assets, while the top 1% owned 27%. That’s the first time the super-rich had more than the middle class.

The rich have gotten richer, while the middle class owned less and less. But even under Democratic control, Congress only nibbled at the edges of economic inequality, if that.

n North Carolina last week, three members of the conservative legislature’s ultraconservative freedom caucus announced an investigation into election fraud in the state. So we’re clear: Not only did Donald Trump win North Carolina, but the state’s Republicans improved their position in the legislature, won a U.S. Senate race, and swept nearly all of the statewide contests.

Even so, state Rep. Jeff McNeely said, there were reports of “machine tampering and votes being switched because of modems.” They drew from a hat a “random” location to begin: Durham County—coincidentally, the most Democratic spot in North Carolina.

The absurdity of this project was self-evident.

It’s illegal in North Carolina to connect voting machines to the internet, and most counties use paper ballots anyway. In addition, the state already audited a random sampling of 200 precincts and found discrepancies in just 13, each affecting three or fewer votes.

I’m not sure whether McNeely knew that and wanted the headlines, or whether he’s gone through the looking glass. But across the country, diehards have proclaimed their cultish fealty to former president Donald Trump by promulgating his Big Lie that Joe Biden wasn’t legitimately elected. Eleven months after Election Day—nine months after the insurrection that tried to overturn its results—a not-insignificant number of Republicans still pretend that there are serious questions about the last election.

And not all of them are backbenchers. (The leader of the North Carolina freedom caucus, Rep. Keith Kidwell, is the state House whip; he’s also reportedly a dues-paying Oath Keeper.)

Arizona’s Senate leader pushed through a debacle of a conspiracy-driven election “audit.” Republican leaders in Wisconsin and Pennsylvania have made similar moves. Some Florida Republicans want to audit that state’s election, too—or at least election machines in its big counties—despite Trump’s victory there.

On Saturday in Iowa—joined by Sen. Chuck Grassley, two congresswomen, and the state party chair—Trump spent nearly an entire rally complaining about the “election fraud of the 2020 presidential election.” On Sunday, Rep. Steve Scalise, the second-highest-ranking House Republican, refused to say on Fox News Sunday that the election wasn’t stolen.

GONE THROUGH THE LOOKING GLASS: Despite Trump’s win in his state, North Carolina Rep. Jeff McNeely wants an election investigation. this problem through improved health care access, child tax credits, free community college, and increased taxes on high earners. But it, too, has fallen victim to those countermajoritarian institutions.

Republican filibusters forced Democrats to pare down their infrastructure bill and combine their social and climate priorities into a massive reconciliation package. The composition of the Senate—an equal split, though Democrats represent 40 million more people than Republicans—then effectively gave two Democratic moderates vetoes, which they’ve used to make arbitrary demands that threaten both pieces of legislation.

Meanwhile, with Trump criticizing Minority Leader Mitch McConnell for not filibustering a bill to lift the debt ceiling—thereby averting a deep global recession—Senate Republicans say they won’t help out again when the debt ceiling comes back in December. Yet, despite the threat of economic havoc, Democratic Sen. Joe Manchin says he won’t tweak filibuster rules for the debt ceiling.

“The filibuster is the only thread we have in America to keep democracy alive and well,” he said.

I’m not sure whether Manchin knows how absurd that statement is, or whether he’s gone through the looking glass. The filibuster doesn’t extinguish the fire. It gives gasoline to the arsonists.

“Beyond the acute crisis facing American democracy, however, is a deeper problem: the radicalization of the Republican Party,” wrote Levitsky and Ziblatt. “Unless and until the GOP recommits itself to playing by democratic rules of the game, American democracy will remain at risk. Each national election will feel like a national emergency.”

I bang this drum not because there’s an easy answer, but because complacency guarantees failure. Our democratic crisis is here.

The first step to fixing it is acknowledging its presence.

For a while, the tacos—along with the vanilla and chocolate conchas from chef Korie LoVecchio—have only been available to order for delivery, pickup or in Bravo’s underground dining room. But now the public at large can have easy access to Bravo and LoVecchio’s wares (Korie also makes the horchata and jamaica) when the Te Invito food truck soft opens in St. Petersburg next Monday, Oct. 18 outside Lingr restaurant where Bravo is the sous chef (hours for the pop-up are forthcoming).

In his appreciation post for Bravo’s taco’s CL contributor Daniel Guess lauded the taco master grinding and nixtamalizing his own corn for tortillas. “The quesabirria tacos on offer here are a glutinous mashup of Oaxacan cheese and braised beef, huge flavors in tiny packets ready to be dipped in an oh so flavorful consomme. David Fischer’s new, Best of the Bay-winning Cocktail gay bar (stylized “COCKtail”) is getting a sister concept called The Wet Spot, and it’s looking like it’ll be a nice relief from all the stiff drinks Cocktail has been dishing out since May. Wet Spot features a swimming pool, three-sided bar, live music cabana and men’s and women’s restrooms, according to I Love the Burg. It’s also going to serve up lunch, dinner and light bites.

Specifics are still TBA, but the menu will “probably” feature American cuisine, Fischer told CL. Details on happy hour are TBA.

Truth hurts

Cuba documentary screening draws ire of ill-informed protesters.

By Justin Garcia In regard to the funding of the documentary, Darwin claimed that, “the Cuban dictatorship has financed this film” and that “this film is in favor of the Cuban dictatorship.”

Martinelli says these statements are completely false.

In “Frenemies,” several points of view are presented, with a range of opinions from its interviewees. From people who identify as “Fidelista” (those in favor of the Cuban government), to subjects who describe the Cuban political system as a dictatorship. Some Cubans living on the island testify to excessive economic control, as well as examples of how their freedom is curtailed in Cuba, for complex reasons.

his weekend, “Frenemies: Cuba and the U.S. Embargo,” a documentary about the effects of the embargo, will screen at Tampa Theatre. A group of people who seem to be confused about the origin and purpose of the film are planning to protest it.

The protesters are convinced that the documentary—which explores the effects of the embargo from both Cuban and American perspectives— was created by communists.

“The Tampa Theatre is planning on releasing a COMMUNIST film Frenemies: ‘Cuba and the U.S. Embargo’,” a post on the event page for the protest reads. “We cannot let these communists continue to poison our youth with lies about how great communism and socialism is.”

However, the documentary was not created or produced by communists. And, the documentary does not glorify socialism as they say, but instead focuses on the complex situation in Cuba, which the U.S. embargo plays a big role in.

“Frenemies’” seed money came from the “Ringling Towers Fund” in 2017, a competitive grant awarded by the Arts & Culture Alliance of Sarasota County for select projects. A small crowdfunding campaign via Indiegogo was run by the director of the film, Mirella Martinelli, a Brazilianborn, a U.S. citizen and a long-time Florida resident.

The Puffin Foundation, in addition to support from Moving Images and Long Distance Productions also financed the documentary.

“Frenemies aims to bring safe and healthy dialogue to the polarized issue of continuing to finance the longest running embargo, or ending it,” says Martinelli.

Set to the pulsating beats of Afro-Caribbean music, ”Frenemies” examines the fraught relationship between the island nation of Cuba and the U.S. The documentary blends 1950s archival footage with contemporary shots of Cuba’s economic struggles and vibrant culture. The film paints a vivid portrait of a nation fighting for survival against one of the world’s longestrunning embargos.

But the merits and balance of the film haven’t kept those opposed to its release from telling lies about it.

On Sept. 15, a Canadian-based YouTuber who calls himself Darwin, went on a rant about the film, with many inaccuracies, Martinelli says.

Pinellas is home to Tampa Bay’s two best neighborhood haunted attractions.

Tarpon Springs: House on the Hill Kathleen and Paul Barbiere’s House on the Hill is more than just a neighborhood yard display. It’s a haunted maze with a theme, homegrown props, and actual scareactors popping out at you.

The Tarpon Springs residents started transforming their yard into a haunted attraction around 25 years ago. At first it was a private affair. Then, about eight years ago, the Barbieres opened their haunted maze to the public as a fundraiser for Tarpon Springs High School Band, of which their daughter was a member.

Initially, there was no set admission fee or suggested donation.

“A lot of people came through for nothing,” Kathleen told CL. “We just put a bucket out and we were taking donations. I think we made maybe $300.”

In 2018, the Barbieres began marketing House of the Hill on social media and reached out to press. That’s when I found out about this great Halloween display less than

CL. “So real quietly I started working on it. It actually took me three months to make him, which for me is really ridiculous. But once he started coming across, I said to Paul, ‘We should really do a swamp theme.’”

The gator sits in the couple’s back yard in between the severed halves of a dead man’s canoe. “Actually it was my niece’s canoe, and she had cut it up to throw it away,” Kathleen told CL. The Barbieres used entirely handmade or recycled props in the maze this year. Kathleen even pulled up and dried some local grass-like weeds to lend their backyard a swamp-like appearance. It’s also worth noting that, thanks to a little pandemic remodeling, the trail is twice as long this year.

entral Florida is one of the best places in the world to celebrate Halloween. Where else can you trick or treat with Mickey Mouse or Elmo, ride a roller coaster with demons, or wait in line with a bunch of teenagers for over an hour to get into a haunted house?

There are tons of places in central Florida where you can drop buku dollars this Halloween.

You probably already know their names, which is why this article is different.

This one is about the little guys. I’m talking about the people quietly transforming foam sheets into front-yard Tombstones, the moms and dads dressing up just to scare the neighborhood kids, the teenagers making monsters in their parents’ garage, the people decorating their yards to benefit local charities. This is who I want to celebrate this Halloween.

If, like me, you want to spend Halloween close to home with your neighbors, you needn’t look any further than Pinellas County, where Kathleen Barbiere and Mike Long are forming a network of neighborhood haunts.

10 miles from my house. Both CL and The Beacon/Suncoast News introduced Tampa Bay to House on the Hill that year. Attendance rose from 700 to 2,500 people. As a result, the trail donated $3,600 to Shriners Hospitals for Children in 2018.

In 2019, the annual haunt became a way for local kids to earn Bright Futures volunteer credits. Kathleen now gives the kid that volunteers the most hours each year a $500 college scholarship “First of all, it gets them here. Once they come and see how much fun it is, then I can’t keep them away,” Kathleen says.

House on the Hill went on hiatus in 2020, citing pandemic concerns. But it’s thrilled to reopen in 2021 with a new theme and a mask requirement.

“We are so excited to be returning this year and unveiling our new haunt, Dead Man’s Swamp,” Kathleen Barbiere said in a press release. “We missed everyone last year and cannot wait to show off what we’ve worked on this year.”

This year’s theme came courtesy of Kathleen’s newest prop, Earl, a life-sized alligator made out of foam and Gorilla glue.

“I wanted to make something, and to be honest, I didn’t think I could do it,” Kathleen told

Palm Harbor: Andrew Long’s Haunt for HEP On the other side of Lake Tarpon, Palm Harbor resident Mike Long learned about House on the Hill in 2018 when he picked up a copy of the Beacon in his driveway. “My first thought

to step back and just let people go about their business…It’s truly a walk-through display that comes to life, because everything’s on passive infrared sensors.”

In 2018, Mike realized that Andrew’s haunted prop-making was becoming something more than just a hobby. That was when the Longs started using their yard display to raise money for the Homeless Empowerment Program (HEP) based in Clearwater. Doing the haunt for charity expanded the Longs’ community reach.

Now they’re able to give Bright Futures credits to volunteers, which has attracted a crop of East Lake High Theater students who perform as scareactors each year. They have about 15-20 scareactors participating this year. One of those scareactors is Mike’s 17-year-old daughter, who’s playing a zombie bride.

“The thought is, there’s a wedding, the bride went crazy and she’s murdered the groom,” Mike told CL. Naturally, Andrew built a 23-foothigh haunted church for the big event.

The Longs and the Barbieresfinally met after their haunts both made the news in 2018. This year, they partnered for the first time to expand their collective reach. And they’re looking to bring more people into the fold, starting with Mike Lowe’s Scarehouse Pinellas in Largo. The goal, Mike Long told CL, is to ensure that people know where to go for the best neighborhood haunts.

“It’s like Christmas,” Long told CL. “We all know, for the most part, [which] neighborhoods to hit that always have the lights.” Why not have the same thing for Halloween?

Meet stars of ‘The Conjuring 3’ when ‘Nightmare on Franklin Street’ returns to Tampa Theatre this weekend The historic and allegedly haunted Tampa Theatre brings back its popular “A Nightmare on Franklin Street” film series next month.

And this year, the Halloween series returns to in-person screenings.

For the series’ ninth year, the movie palace will host 16 nights of screenings running Oct. 16-31. That includes a free screening of “The Conjuring: The Devil Made Me Do It” and several afternoons of family-friendly Halloween movies.

The screening of the third “Conjuring” film is also part of Tampa Theatre’s series of community screenings to celebrate local actors and filmmakers. Saturday's free “Conjuring” screening also includes a post-show Q&A with stars Eugenie Bondurant and Paul Wilson.

Long told CL. He and his son Andrew Long got serious about their Halloween decorations around 2015, when Andrew was only 13 years old. The Longs’ neighbors erected a little graveyard on their property that year, and Andrew couldn’t take his eyes off of it.

“I always tell people that Christmas is pretty, but Halloween is addictive,” Mike told CL. What started as a small cemetery became a serious display after the father-son team visited Paul Duryea’s Mansion of the Macabre yard haunt (now retired) in Dunedin one fateful Halloween night in 2016.

“It was incredible; it really was,” Mike told CL. “Andrew saw that and he came home and started talking about it. I reached out to Paul just to get some ideas and talk about what he’s doing, and it really exploded from there.”

When Andrew saw Duryea’s haunted mansion with its professionally-built props, he saw what was possible in a home Halloween display. “That kick-started it right there,” said Mike. “Andrew started building things and he never stopped.”

As the son of an engineer and grandson of a contractor, Andrew learned to use power tools at a relatively young age. He designed and built theater sets his junior and senior years at East Lake High School. At home, he explored pneumatics (a branch of engineering that uses compressed air) to create unique Halloween displays that move as you walk through them.

This year, Andrew made a pneumatic weeping angel that rises to over eight feet when triggered. It’s the most complex pneumatic prop he’s made yet.

“The weeping angel is kind of a play on the monument that you see in a lot of graveyards and cemeteries, where they have a big pedestal with an angel or woman leaning over it, head down and crying,” Mike told CL. “We took that and said, ‘How do we make this really freaky?’

Andrew built the pedestal and the angel [that] sits over it…When triggered, this angel rises up.

The arms, the wings, the torso, everything moves because it’s got five pneumatic cylinders in it. It rises to over eight feet, and it’s got this terrible scream that it does, so it’s really startling…”

Andrew programs each of his props to scare on demand using what his father calls a “show controller.”

“It’s basically the brain that controls what this prop is going to do when it’s triggered. Is it just out and in? Raise an arm? Do a bunch of really intricate movements? Andrew writes the code for that based on whatever the show is going to be. That show not only consists of movement, it consists of lights, sound, foggers. We can do pretty much anything we want. That allows us

Bondurant and Wilson are both from the Tampa Bay area and star alongside Wilson’s brother, Patrick Wilson, who’s been the lead alongside Vera Farmiga in all three Conjuring films. St. Pete native Patrick Wilson has also starred in the “Insidious” franchise, “The Phantom of the Opera” and Aquaman.

As part of the Nightmare on Franklin series, Tampa Theatre also brings back SpiritsFest: “Backstage” for an in-person haunted tour of the movie palace. The tour features “tales of Tampa’s dead by Phantasmagoria’s skillful storytellers” paired with a Halloween-themed cocktail. Tickets are $100 ($90 to theater members) for the tour.

The classic Ghosts of Tampa Theatre Tour is also available throughout the film series for $15 (free for theater members).

The last night of the series, Halloween, features a matinee screening of classic silent horror film “Nosferatu” (1922). The screening includes live musical accompaniment by Tampa Theatre’s Steven Ball on the theater’s original Mighty Wurlitzer Theatre Organ.

Beyond “The Conjuring,” the series includes showings of “Ed Wood, “Alien,” “Hocus Pocus”, “Death Cast,” “Raw,” “THEM!,” “The Rocky Horror Picture Show,” “Psycho,” “The Nightmare Before Christmas,” “The Shining,” “A Tale of Two Sisters,” “Campfire Stories,” “Get Out,” “Us” and “Phantasmagoria XII: Dark Carnival.”

n July, members of Snarky Puppy played three gigs as part of Spain’s Canarias Jazz & Más festival, but when the fusion outfit hits Baycare Ballpark on Sunday it’ll mark the band’s first show back on a U.S. stage after a long, pandemicinduced, hiatus.

“That was the first time that the band had seen each other since the beginning of the pandemic, but the band is 18 people and we only play with 10 of those at every gig,” Michael League told Creative Loafing Tampa Bay. League—the band’s 37-year-old bassist and bandleader—spent much of his lockdown in the south of Spain at his girlfriend’s house where he finished a longdelayed solo album, So Many Me. “In Clearwater, I’ll be seeing people that I haven’t seen in two years, and they’ll see each other for the first time in two years so it’ll still feel like the first gig after the pandemic in a lot of ways,” he added.

Similarly, Snarky Puppy’s set closing down the 2021 Clearwater Jazz Holiday is going to feel like the first gig back for so many of the organizers behind the storied festival in its 42nd year.

Like everything else last year, the 2020 Jazz Holiday got the axe at the hands of coronavirus.

Instead of the usual four-day party that welcomed 35,000-40,000 people annually, organizers staged a series of small “Wanderlust” concerts which not only allowed the festival to keep paying local artists and backline crew, but also let it continue to support its nonprofit mission of boosting music education in local schools.

Headliners for 2021’s four-day festival include Snarky Puppy, Gloria Gaynor backed by a 13-piece band, Kool & the Gang and Big Bad Voodoo Daddy. Continuing the festival’s tradition of mixing Americana, funk and other genres into the jazz programming, the lineup also includes Dustbowl Revival, Lucy Woodward, plus Eric Marienthal Featuring The Silverman Brothers.

Saturday’s lineup brings a jam band element to the mix thanks to Lettuce, but Jazz Holiday also leans on the very things it was founded upon, jazz and community outreach. The Jazz Holiday and Ruth Eckerd Hall Youth Jazz Band will play on Saturday, and Friday’s lineup finds Jason Miles leading a jam-packed tribute to pioneering jazz-funk saxophonist Grover Washington Jr. who died in 1999 at age 56.

St. Pete Opera Co.: Mozart’s “Così fan tutte” St. Pete Opera Company’s 16th season starts this weekend with three performances of Mozart’s opera buffa happening Friday night, Sunday afternoon and Tuesday night.

And don’t worry, though the opera is sung in Italian, English subtitles are projected above the screen. After a holiday break, the company is back in February with another 3-show run of Handel’s “Semele.” The season wraps up with Gaetano Donizetti’s French comedy “La fille du régiment” in June. Currently, the Palladium follows St. Petersburg College’s lead requiring masks for all indoor performances, but as the pandemic changes so do protocols—best to check before you go. Rutterkin headlines on Friday with punk-rock, and St. Pete’s Broken Things clocks in with its more melodic and indie-tinged sound.

Friendly Fire brings an ‘80s indie/’90s punk flavor to the bill rounded out by Critical Hits which has the most straightforward take on rock and roll on this bill. The all-ages show claims “no jerks” allowed, which I’ll assume means wear a mask if you can’t socially distance and especially if you’re not vaccinated for some reason. The venue has a curfew of 10 p.m., so you’ll have plenty of time to get a good night’s sleep or hit another show if you’re energetic. If loud ain’t your thing, check out the store’s upcoming event “Air Plants and Astrology Workshop” on Wednesday, Oct. 20. (Wild Roots, St. Petersburg) C Selwyn Birchwood After a summer break, the folks at Safety Harbor Art and Music center are back with local favorite Selwyn Birchwood. Though from Tampa, Birchwood has gotten worldwide critical acclaim including winning the International Blues Challenge in 2013. Birchwood has been cranking out blues-rock tunes since he was 17, including his early 2021 release Living in a Burning House which is a lot more fun than the title portrays. The rain or shine concert will cost you $5 more if you wait until Friday to buy your ticket. And bring your mask because you’ll need it to go to the bathroom. Mind the gap Thirty-year-old trans woman here, Dan, and I have a question about what is surely one of your favorite subjects: the “age gap discourse.”

About four years ago, I had a sexual experience that I go back and forth on whether to label as sexual assault. When I was 26 years old, I met a 19-year-old on a dating site and drove to a neighboring state to hook up with them. I’ll spare you the details, but when we started doing things we had mutually agreed upon, one of them didn’t feel right in the moment, so I withdrew my consent. They respected my boundary for about 15 minutes, then tried it again. I said no again, they refrained for another 15 minutes, then tried it again.

The cycle continued until I just got worn down.

The night ended with me trying to fall asleep so I at least wouldn’t be conscious for what they were going to do. It didn’t work.

I’m friends with a lot of social-justice-focused millennials, and as such, discourse about age gaps in romantic and sexual relationships occasionally appear on my social media. The consensus, as I understand it, seems to be that there is a vast maturity gap between someone who is 19 and someone who is 26; therefore, someone in their mid-20s has an affirmative duty to make sure nothing sexual happens with someone who is 19. It is also suggested that someone like me is a creep and a predator for even thinking about hooking up with a 19-yearold. It’s hard to not apply my own experience to the discourse, and boy, is it a mind fuck. Hearing people go on about how vulnerable teenagers are or how I occupied a position of power not only dredges up painful memories, but also makes me feel like a creep.

Did I do something wrong? I’m leaning towards no. I didn’t have any institutional power over the other person, it wasn’t an ongoing relationship, nor is it a pattern of behavior. (Like hell am I going to trust a 19-year-old again.) I also tried to follow your campsite rule. Instead of ghosting them, I sent them a message explaining why I wasn’t going to play with them again—the boundary violations— in the hope that they would do better in the future.

I’m about 80% sure I have nothing to feel guilty about, but that other 20% just won’t shut up. Was I the bad guy here?—Am Getting Exasperated

feels the conversation is motivated by legitimate concerns about unequal power dynamics and their potential for abuse and exploitation, he worries the black-and-white nature of the age gap discourse can lull people into a false sense of security.

“People imagine that abuse is less likely to occur in relationships where both parties are the same age,” said Greig, “and in my experience, that’s not always the case.” Additionally, condemnations of relationships and/ or hook ups with significant age gaps—the kind of puritanical “discourse” that has left you feeling so isolated—often fails to acknowledge, much less grapple with factors besides age that can make a person vulnerable to abuse and exploitation.

“Being a trans woman in itself can make you more vulnerable,” said Greig. “But it could be just about anything: wealth, status, even just disposition or temperament—some people are more domineering or cruel than others.”

And some people don’t understand that only yes means yes, that no absolutely means no, and that withdrawal consent doesn’t mean, “Ask me again in five minutes.”

Sometimes a person guilty of the kind of consent/boundary/physical violation you endured isn’t acting maliciously and is capable of learning from their mistakes—here’s hoping that message you sent that 19-year-old had an impact—but some people know what they’re doing when they pressure a person to engage in (or submit to) unwanted sexual acts and don’t care. Those people can be 19 and those people can be 99, AGE, and their victims can be younger or older. And if their last name is Trump, those people can be POTUS. “Life is too complicated for one-size-fits-all prescriptions like ‘age gap relationships are bad’ to be of much use,” said Greig, “and that means we have to take these things on a case-by-case basis.”

And in your case, AGE, neither of us think you were the bad guy.

All that said, AGE, driving to a neighboring state to hook up with a teenager—yeah, the optics aren’t good, and a lot of people aren’t gonna be able to see past them. But just because some very online people (and some very offline people) will look at your respective ages at the time, do the math, and label you a predator, AGE, you aren’t obligated to slap that label on yourself. You were consenting adults until you withdrew your consent, at which point you were the victim of a sexual assault. You may have to be selective with who you confide in about this, AGE, but you don’t have to shame yourself. You lived, you learned, you’ve tried to do better. Here’s hoping the other person—now in their 20s themselves—learned something too and has also tried to do better.

No big stakes here, but I want your opinion.

Forty-something straight man here, and I like shaving. My wife, to whom I’ve been married 16 years, doesn’t. So, I shave myself, and she’s natural. She let me shave her once, she didn’t like the result, and we’ve never done it again. But last week while she was amusing herself down below, we were chatting (she’s talented, I tell you) and she noted that she’s not crazy about my shaved parts. She said it reminded her of prepubescent boys. She doesn’t like being shaved herself; similarly, she worries guys who like it are thinking of little girls. Also, the potential for nicks and cuts makes her queasy.

For my part, I like the way the skin feels, and it makes me look bigger. And so much porn is shaved these days that this is probably in the back of my mind. Writing you this letter has been good therapy, Dan. Rereading it just now I can see a workable solution: two months on (shaved), two months off (natural). Am I the first letter writer who solved his own problem?—Shaving Nuts Is Promising P.S. If you have anything to add, come right out and say it—no need to beat around the bush.

You’re not the first person who solved their own problem by the time they finished writing their letter—hell, half the questions I get are from people who already know what they need to do. They need to DTMFA or get into therapy or learn to tie knots—and they write in hoping I’ll give them a little push, SNIP, which I’m always happy to do.

P.S. I have one thing to add: Sexually active, fully-grown adult men and women have been

shaving off their pubes for decades now—we’re well into the third decade of the modern pubichair-shaving discourse—and I’m losing my patience with people who claim they dislike hairless crotches because they associate them with prepubescent children. Unless you’re currently parenting a prepubescent child or you’re a pediatrician, you are far likelier to see fully grown adult humans with hairless crotches than prepubescent children. Really, people. Think about the last hundred hairless crotches you saw—were those children’s crotches or were they the hairless crotches of adult sex partners and/ or porn stars? When I see an adult man with a hairless crotch in gay porn, I don’t think, “THAT MAN WITH THE ROCK HARD 8-INCH DICK LOOKS LIKE A WEE BOY!” I think, “That man looks like other adult men I’ve seen in porn and sometimes in real life.”

Look, it’s fine to prefer partners with pubes—neatly trimmed or full bush—but a person should be able to express a preference for pubes without insinuating that people who prefer shaved crotches are pedophiles. An adult man who shaves his face is not trying to look like a child and does not look like a child. A woman who shaves her pits is not trying to look like a child and does not look like a child. Same goes for adult men and women who shave their pubes. Sheesh.
