IN AN OUTRAGEOUS PROPOSAL reminiscent of Cleveland sportsfranchise owners, energy giant FirstEnergy wants to charge ratepayers surcharges worth $568 million per year over eight years to “compensate for the economic impact of having its headquarters in Akron,” Bloomberg reports.

In an interview with Bloomberg, a FirstEnergy VP used threatening language — the Sin Tax vibes are everywhere — to say that the the state’s public utilities commission (PUCO) should amend a plan to provide vastly more aid than initially proposed.

“They should weigh the value of keeping our nexus of operations in Akron,” Eileen Mikkelsen, the VP, told Bloomberg. “If the commission thinks that is important to the state, they should recognize that in their order.”

PUCO had suggested surcharges totaling $131 million over three years for the utility company that is supposedly struggling and yet boasted revenues of more than $15 billion in 2014 and 2015.

“FirstEnergy says it...can live with the structure of [PUCO’s] plan if the amounts pledged to the company are increased. Instead of a total of $393 million in aid, it should get $558 million a year for nearly eight years, or $4.5 billion. And on top of that, it wants compensation of as much as $568 million for the added impact of salaries, vendor purchases and local employee spending in Akron,” Bloomberg reports.

FirstEnergy employs 1,360 people at its Akron headquarters.

LOW-KEY POLICE INDICTMENT STEMMING FROM 2015 SHOOTING Cleveland police officer Alan Buford was indicted by a grand jury late last Friday afternoon on a negligent homicide charge stemming from the March 2015 shooting death of Brandon Jones.

After robbing an eastside grocery store, Jones ended up in a scuffle with Buford and another officer. Buford shot once, killing the 18-year-old man. Jones was unarmed.

“It was reasonable for the police to respond as they did to a 911 call of a break-in, reasonable to confront the suspect with guns drawn as he left the store with stolen merchandise and to order him to stop,” prosecutor Timothy McGinty said in a public statement. “It is not reasonable for a police officer to use deadly force if he or she does not believe a suspect poses a threat of death or serious bodily harm to the police or the public.”

“I think this is all a game and it’s all for show,” Tanya Brown, Jones’ mother, said following the announcement. During a brief meeting with attorneys and

reporters at the Justice Center, Brown expressed frustration with the process thus far. “You’re just taking my family and I through this loop of trial and grand jury indictment for this cop, Buford, to walk away with probation for killing my son, and I think it’s a joke.”

Just a bit earlier, Brown received the news of Buford’s indictment with joy. She and others didn’t realize at first what a softball charge Burford had been handed.

It’s a first-degree misdemeanor.

Pipeline in North Dakota. There, thousands of Native American protesters have been encamped to stand in solidarity with the Standing Rock Sioux tribe and to rally against the construction of the pipeline on sacred tribal land.

Dogs and handlers from Frost Kennels, based in Hartville, Ohio (down near Canton, close to Mount Union) became entangled with protesters on Saturday, September 3, after protesters broke through barriers and the Frost dogs became aggressive, barking at and biting several demonstrators.

Democracy Now’s Amy Goodman, reporting from the melee, confronted a Frost handler later identified as Ashley Nicole Welch (in the video above at ~3:10).

Welch’s personal information was subsequently released by the hacktavist collective Anonymous, spurring a deluge of hate mail directed at Welch and at Bob Frost, who owns and operates the kennel.

On September 14, Yelp.com began removing posts from the Frost Kennels page as part of a “clean-up process� due to posts “motivated more by news coverage than the reviewer’s personal consumer experience.�

Frost, who is 29, spoke to Scene after he and his team of 10 dogs and seven handlers returned from North Dakota. He said he’s been angered by the storm of negative coverage, and that people have misrepresented the nature of his work — he has repeatedly been characterized as a “mercenary,� for instance.

He wouldn’t disclose the terms of the contract with Dallas-based Energy Transfer Partners — or even whether or not other security companies were on site at the Dakota Access Pipeline — due to a confidentiality agreement, but he did say that he submitted an intentionally low quote for his company’s services in an attempt to secure the bid and get noticed on a larger stage, to gain experience and exposure for bigger security jobs. “If people knew what we charged for this, they’d say we were crazy for doing it that cheap,�

Frost told Scene.

He said that his kennel in Hartville does more than just security — everything from everyday on- and off-leash obedience to “full-blown dual purpose police dog� training — and that he works with an estimated 120 clients regularly. “I’m doing a Parkinson’s dog

He also said that three of his dogs were injured: Though they are fine now, he said, one was concussed, another had “a shoulder issue,� and another was hit in the head with a wooden object.

Frost said he was upset reading claims that he and his company were racist, particularly toward Native Americans. “You don’t know anything about me,� he said. “My wife’s half Native American. My father-in-law’s 100 percent. Kiss my ass... As far as the pipeline goes, I’m not for it or against it, but when I’m contracted to stand in a fenced-in area, patrol an area and protect equipment, using dogs as a visual deterrent, that’s what I’m going to do.�

Questions remain, however, about the legality of Frost Kennels’ work. In Ohio, private security ďŹ rms must be licensed by the state’s department of public safety.

CLEVELAND CYCLIST STRUCK IN MONTANA, IN CRITICAL CONDITION A local bike advocate was struck by a vehicle going 60 mph in Montana Sunday evening. Shelli Snyder, a co-founder and former board member of Bike Cleveland, was cycling from Cleveland to Seattle. She was relocating to Washington state and raising funds for Bike Cleveland by cycling cross country in the process.

Via Bike Cleveland, who posted the news to its Facebook page, Snyder suffered hip and leg injuries and a fractured skull.

Emergency medics arrived quickly on scene, and Snyder underwent surgery to repair her hip and leg and to relieve the swelling in her brain.

Around noon on Monday, an update was posted: Snyder remains in critical condition and physicians are concerned that her brain injuries may be life-threatening.

As of Tuesday morning, she remains unconscious.

OPINION OP-ED: FIRSTENERGY RATE INCREASE NECESSARY FOR ECONOMIC WELL-BEING OF AKRON, NORTHEAST OHIO

By Joseph L. Wagner NORTHEAST OHIOâ&#x20AC;&#x2122;S ECONOMY would take a $570 million-a-year hit if the FirstEnergy Corp. would leave Akron.

This is the sobering message contained in an economic impact report that FirstEnergy sent to the Ohio Public Utilities Commission of Ohio (PUCO) to bolster its case for a 6 percent rate increase.

The hike would enable FirstEnergy to strengthen its position on Wall Street at a time when its two-year-old rate case and related drama has caused jittery rating agencies to slash the ďŹ rmâ&#x20AC;&#x2122;s credit standing.

If FirstEnergy would lose its PUCO case, it is unlikely the company could maintain its

government, not the state, has the ďŹ nal say over any decision that affects the national energy market.

It ruled that any new revenue could not be used on the aged plants, a crushing blow to First Energyâ&#x20AC;&#x2122;s long-range game plan.

FirstEnergy resubmitted its previously approved application but PUCO then ruled that any new revenue could not be spent on the plants. It cut the transitional period from eight to three years, in a sharp reversal of its March decision.

The decision stunned FirstEnergy ofďŹ cials, especially since the new PUCO chairman, Asim Haque, who is on record saying he was convinced the earlier plan would, indeed, save customers money in the long run if used for the older plants.

Understandably, increasing utilities rates is a rocky road.

A skeptical public frowns on the prospect of higher bills. Politicians capitalize on the David vs. Goliath confrontation to further their careers.

It is also hard to defend coalďŹ red plants while President Barack Obama, and his wannabe successor Hillary Clinton, want to shut down the mines.

Little wonder that FERCâ&#x20AC;&#x201D;all Obama appointeesâ&#x20AC;&#x201D;overrode PUCOâ&#x20AC;&#x2122;s March decision to grant the rate increase.

There is also unrelenting pressure from investors, many of them elderly and on ďŹ xed incomes, and who depend on the quarterly dividend checks. The annual dividend was reduced from $2.20 per share to $1.44, costing stockholders over $300 million a year.

In the meantime, while FirstEnergy is twisting in regulatory winds, the complicated rate case moves on with no settlement in sight. The footdragging continues even as everyone seems to realize just how high the stakes are for Akron, Northeastern Ohio and even Ohio.

In its editorial titled â&#x20AC;&#x153;Will the commission (PUCO) keep its word to FirstEnergy?â&#x20AC;? the Akron Beacon-Journal warned the state agency: â&#x20AC;&#x153;Donâ&#x20AC;&#x2122;t back out of the deal.â&#x20AC;?

FirstEnergy says the rate increase would have bought the plants enough time to weather the natural gas price war and remain operational until generation costs matched or even exceeded coal and nuclear fuels.

The increase would likely have calmed jitters on Wall Street and not threatened the ďŹ rmâ&#x20AC;&#x2122;s ambitious construction program which requires borrowing.

Opposition groups have argued that FirstEnergy has exaggerated the consumer beneďŹ ts of the rate deal and has overly hyped its predictions about future natural gas prices.

The Ohio Manufacturers Association said the law of supply and demand, not customer subsidies, should prevail, though FirstEnergy says â&#x20AC;&#x153;federal (energy) markets are not working.â&#x20AC;?

(The OMA, however, does believe in public subsidies as they constantly hassle government for tax relief.)

Though rate hikes are seldom crowd-pleasers, FirstEnergy has particularly diverse allies. Backing the ďŹ rmâ&#x20AC;&#x2122;s case, for example, are the Teamsters and Cleveland Building Trades Council as well as the Council on Smaller Enterprises. Community groups are side-by-side with the NAACP and Greater Cleveland Clergy Coalition.

In fact, Rev. Caviness penned a letter to Gov. John Kasich actually requesting him to intervene on FirstEnergyâ&#x20AC;&#x2122;s behalf. â&#x20AC;&#x153;There may be some minor rate increases in the ďŹ rst few years,â&#x20AC;?

Caviness wrote. â&#x20AC;&#x153;But we believe FirstEnergyâ&#x20AC;&#x2122;s approach will beneďŹ t our communities in the long run, protect jobs and safeguard vulnerable customers from skyrocketing energy bills in the future.â&#x20AC;?

Caviness said in an interview that Kasich responded by mail expressing surprise that an antipoverty group was backing a corporate giant, and said he had forwarded Cavinessâ&#x20AC;&#x2122; concerns to the PUCO. PUCO granted FirstEnergy a rate hike in March, but the Federal Energy Regulatory Commission (FERC) voided it, saying the federal

THE LAW SCHOOL CRUNCH As the market struggles to recover, Midwest law schools and their students adapt to the new realities of the profession

By Lee Chilcote KATIE WEBER GRADUATED from Ohio University in 2010 with a Bachelor of Fine Arts in Acting.

She then worked for two years as a salesperson and high school drama coach before realizing one day while sitting in her cubicle that she was unhappy with her job prospects. So she decided to go to law school.

“I decided getting a J.D. would give me the most bang for my buck,” she says. “I knew that the legal job market was struggling, but I saw it as flexible and you can use it to go into business, policy work or politics.”

Weber was under no illusion that she’d be guaranteed a spot at a big law firm earning six figures after she finished her three-year degree. In fact, her base salary as a new lawyer would likely be around $50,000, a respectable wage but a distant cry from what some firstyear lawyers expect to make at small and midsize firms. On top of that, she’ll be paying off her law school debt for a couple decades.

“I knew it would allow me, with the student loan payment, to have the same standard of living I had previously, but I’d be happier with a more rewarding career,” she says.

This past May, Weber graduated from Cleveland State University’s Cleveland-Marshall College of Law and is now clerking at Moore Yourkvitch and Dibo, a small boutique firm started by fellow Marshall grads, while awaiting her bar results. She hopes to land a fulltime job there.

“I’m walking out of law school with $120,000 in debt, all federal,

which allows you to pay on an income-based repayment plan,” she says. “I believe my payment will be around $400 a month. I chalk it up to reality – it’s the tax you pay for not having a college fund.”

While the top 10 percent of this year’s class has landed full-time associate positions at big law firms, some of Weber’s friends have taken on temp work or teaching gigs to pay the bills while trying to find a full-time job. “We’re competing with people who have been laid off and have five to 10 years of experience,” she says.

Even as the economy improves, the entry-level job market remains tight for new law school grads.

According to a recent article in Bloomberg News by Kyle McEntee, director of the advocacy group Law School Transparency, 59.2 percent of 2015 graduates found long-term, full-time jobs as lawyers within 10 months of graduation, up from 58 percent a year ago. This figure has improved the last four years, creeping up about 1.35 percent a year.

Law schools are also admitting far fewer people now than during the recession, when young people applied in droves only to find out the job market still sucked when they graduated. Yet there are still more lawyers than full-time jobs.

There were 37,000 law grads in 2015 – way down from 52,000 in 2010 – yet there were only 23,687 long-term, full-time law jobs waiting for them, according to the American Bar Association. That’s a 6.8 percent decline from last year and just 14

more jobs than in 2011, the year considered the bottom of the market.

“The trend of fewer legal jobs should concern law school administrators,” writes McEntee.

“The evidence does not support plans at the vast majority of schools to increase enrollment to stave off deep financial trouble.”

Cleveland-Marshall professor emeritus David Barnhizer recently published a paper arguing one or more law schools will close in the coming years. With declining population, a shrinking legal services market and a limited pool of applicants, Midwestern law schools are particularly at risk, he argues. “Some law schools should – and will – close,” Barnhizer says. “But none have. It would be healthier for the market if they did.”

FINANCIAL DEATH SPIRAL Barnhizer’s paper, “Competitive Data Trends for Great Lakes and Midwest Law Schools, 20122015,” argues that law schools are still deeply troubled despite an improving legal services market.

They’re pumping up their numbers by admitting less-qualified students, he says – the very ones who rack up loans and may have trouble finding jobs when they graduate.

“The systematic pressures on law schools trying to survive … will create a sort of financial ‘death spiral’ in which law schools rely on greatly expanded financial aid packages in an effort to ‘buy’ students,” he writes. “This creates an incentive to admit marginal

students at the lower end of the scale who pay full tuition in order to fund the subsidies and scholarships given to more highly qualified applicants.”

As evidence, Barnhizer cites the fact that both Case and Akron law schools no longer have minimum GPA requirements for their scholarships. While Case has had this policy for a number of years, Akron changed theirs more recently.

Many law schools are also offering steep tuition discounts to woo students. For example, Case Western Reserve University is one of nine law schools in the country with tuition discounts in excess of 50 percent. Barnhizer says other law schools have become heavily dependent on foreign students paying full tuition to complete an LLM degree (equivalent to a master’s in law).

David Lat, founding editor of the legal news site Above the Law, says Barnhizer’s analysis is true of law schools generally. “There’s definitely been a trend in the direction of law schools admitting students with weaker credentials in order to keep their class sizes either the same or not shrinking as much as they otherwise would,” he says. “One manifestation of that is that LSAT passage rates have been going down.”

According to Law School Transparency, 2014 LSAT scores at 37 law schools were so low that half of incoming students were considered to be at high risk of failing the bar. In 2010, the | clevescene.com | September 21 - 27, 2016

FEATURE same could be said for only nine schools. “We’re not aware of a time when so many law schools had something like an open enrollment policy,” the study’s authors wrote, concluding that the percentage of graduates who pass the bar “will drop significantly over the next three years, leaving thousands deep in debt with few prospects for employment that will enable them to pay off their debts.” While it may serve as an exceptional example, Indiana Tech law school in Fort Wayne saw only one member of its inaugural graduating class pass the July bar exam.

Barnhizer says it’s not a matter of “if” but “when” law schools close. Great Lakes and Midwest law schools will shrink another 10 to 25 percent, he says, with regional schools like Marshall, University of Akron and University of Toledo at risk of further decline. Over the past five years, Ohio has seen a 40-percent decrease in students taking the LSAT, for example, and data shows a leveling of that number over the past three years.

Historically, law schools have been seen as the cash cows of the university system, and Barnhizer says deans milked that opportunity for all it was worth during the recession. Yet those days are over, and today schools like Ohio Northern and Akron are facing a major budget crunch. Of course, law schools are prestige operations and universities have a built-in incentive to keep them no matter how poorly they’re performing. Those most at risk are probably stand-alone schools not attached to a university.

“Many law schools in the region are in ‘survival of the fittest’ mode,” Barnhizer says. “Several are likely to simply wither away.”

Lat is not so sure any universityaffiliated law schools will close.

“The university may keep the law school afloat on the theory that in good times law schools are cash cows, and that if we can get through these tough times, it may end up paying off for us,” he says.

Law school deans refute Barnhizer’s argument, arguing that they’ve battled back from the brink by reducing class sizes while maintaining high standards.

Andy Strauss, dean of University of Dayton’s law school, says his 2016 class is 113 students, up from 90 in 2015. “At the same time, credentials are up – the median LSAT score

went up from 148 to 149,” he says.

“It had been at 148 for the previous three years. In terms of GPA, last year we were at 3.04 and this year we’re at 3.14.”

Strauss also takes issue with Barnhizer’s argument that law schools need to reduce operational costs by cutting faculty – Dayton already did this several years ago, he says.

Austen Parrish, dean of Indiana University’s Maurer School of Law, says it’s important for law schools to give opportunities to lower-scoring students. “Where I disagree or think it’s more nuanced is that there’s a big question of whether law schools should be elitist institutions,” he says. “No one argues you should close a bunch of colleges because English majors aren’t getting jobs.”

“There are tremendous unmet legal needs in our society,” adds Benjamin Barros, dean of University of Toledo’s law school. “A lot of ordinary people can’t really fi nd affordable legal services. There’s a good argument to be made that we need more lawyers in our society even right now.”

Moreover, after years of decline, enrollment and scores are trending up at many schools. Wayne State saw a 15 percent enrollment increase and higher LSAT scores in the past two years. University of Akron saw a two-point increase in its bottom quartile LSAT scores.

Scores stayed strong at Marshall despite enrollment dropping from 110 to 100 in the past year.

“We’re coming off of a bubble,” says Jeffrey Standen, dean of Northern Kentucky University’s law school. “It’s a little misleading to look at the last five or six years and point that trend line in the future and conclude that things are bleak.”

Not every school is seeing an uptick. Ohio Northern University’s first year law class is 59, down from 69 a year ago and down 51 percent from 2010’s 120. LSAT scores there have tumbled four to six points from 2010 to now.

Barnhizer’s argument that law schools will close is bogus, Barros says: “It hasn’t happened yet and we’re in year six of a pretty tough market for law schools. If anyone would have closed, I would have thought they would’ve by now.”

MAKING LAW SCHOOL RELEVANT AGAIN Even if enrollment isn’t declining at law schools, they certainly are changing. While law schools

traditionally placed students in large lecture hall classes until the third year, today’s law students receive more individual attention and are involved in clinics, externships and practical programs from the get-go.

“From day one, we think about when students get practical experience,” says CWRU law school co-dean Jessica Berg, citing the university’s capstone program where students spend 1-2 semesters practicing law. “We’ve pushed hard on increasing the number of credits for skills classes.”

Jocelyn Benson, dean of Wayne State law school, says her school prepares students for careers in business, government and the nonprofit sector as well as law.

“We’re not just having law firms come to our campus anymore,” she says. “Last year was the first year in a number of years that students had multiple job offers.”

One growing area is “JDadvantaged” fields where a law degree provides a leg up but is not a requirement. University of Akron has increased the number of clinics it offers while adding specialties like corporate compliance. Northern Kentucky offers courses in corporate risk management and multiple joint degree programs. Indiana has a niche in intellectual property and is part of the United States Patent and Trademark Office’s Law School Clinic Certification Pilot Program.

One of the most innovative programs in the region is at Cleveland-Marshall. The law school’s solo-practice incubator program offers affordable office space, conference rooms and a reception area for new grads. It also offers reduced-cost health and liability insurance. The incubator is the first of its kind in Ohio.

Marshall interim dean Lee Fisher says he believes the market for legal services in Northeast Ohio is coming back. “I don’t believe you can cut your way to survival,” he says. “The only way to be a sustainable organization is to invest in the organization and raise revenue. I’m cautiously optimistic, particularly about the Cleveland and Northeast Ohio market.”

The percentage of law graduates finding full-time jobs is also trending up at many schools.

Berg says CWRU posted a 90 percent employment rate for law graduates in the past two years after they’d been out of school for 10 months, while University of Akron law school assistant dean

Barbara Weinzierl says 93.5 percent of the school’s graduates found employment within nine months. Of course, not all of these graduates are finding work in their chosen fields. One law student, Anna Alaburda, even sued her university, Thomas Jefferson School of Law, for using misleading statistics to lure students to enroll. Eight years out of law school, Alaburda has yet to find a full-time job as a lawyer.

“These types of numbers often are concealing the fact that the jobs being attained by grads are not the jobs they went to law school to get,” says Lat. “The gold standard is a full time long term job requiring a law degree. You have stories of law grads working at Starbucks or a restaurant, and there are a lot of people like that out there.” Which is how school’s get to champion numbers like 90 percent employment while nationwide data shows only about half of that employment coming in the legal world.

Stephen Veltri, dean of Ohio Northern’s law school, says despite declines in enrollment and credentials his school is not going anywhere. “Our students come from county seat towns in Michigan, Ohio and Pennsylvania, and they return to those towns,” he says. “There are still crimes to be prosecuted, crimes to be defended, wills to be written. We’ve been at this for over 130 years.”

Some deans take it one step further and argue that law degrees are increasing in value. “I think JDs will become the all-purpose degree for executive employment,” says Northern Kentucky’s Standen.

“The MBA was created to be the all-purpose graduate degree for executive level employment, but the JD is coming alongside the MBA and perhaps might supplant it.”

Lat says this kind of thinking is what got law schools in trouble in the first place. “I’m a little skeptical of the argument that people should go to law school even if they don’t end up practicing as lawyers,” he says. “The issue is it’s three years and $200,000 and you’re giving up the income you’d be making during that time. The cost is too high these days for it to be a finishing school for liberal arts grads.”

THE NEW PARTNER TRACK Although law school deans paint an increasingly rosy picture of the legal job market, recent grads say they’ve had to adjust their expectations in order to find | clevescene.com | September 21 - 27, 2016

FEATURE full-time employment. Most of them did not have jobs when they graduated and were still sending out applications while studying for the bar.

Catherine Donnelly was one of the “lucky” ones. First in her class at Cleveland-Marshall, she graduated in 2010 with an associate-level position in the public finance practice at Squire Sanders (now Squire Patton Boggs), one of the top law firms in Cleveland. Nine months later, however, she was laid off in one of the worst job markets in 80 years.

Donnelly ultimately landed on her feet, working at a labor law firm for four years before accepting a position at Moore Yourkvitch and Debo, where Katie Weber also found work. She’s very happy with the move. Her billable hour target is two-thirds of what it was at Squire Sanders, plus she can dedicate more time for pro bono work and take vacation.

“The legal services market is broken,” she says. “The billable hour model does not work for lawyers and

it doesn’t work for clients. It creates unattainable expectations where the only way you can increase your bottom line is to increase the hours of employees or by raising rates, so you end up overworking people.”

Many recent grads have had to make do with part-time work. In his article “The Oversaturated Job Market for Lawyers Continues, and On-the-Side Legal Work Grows,” Joshua Davis writes: “Hiring has mostly been stagnant coming out of the recession … take away fulltime, salaried positions and the real growth in the lawyer job market has come from those working on the side in part-time arrangements.”

One encouraging aspect of this trend is the rise in entrepreneurial activity. Like most of his classmates at Marshall, Moore Yourkvitch and Debo founder David Moore didn’t find a job right away after graduating in 2010. Instead, he used his nonprofit community development clinic experience to start own practice out of the school’s incubator program.

“The economy was starting to rebound, and there was a demand for services but no way to pay for them,” he says. “There was an opportunity for us to come in

and fill the gap, and that meant really doing a lot of free and lowcost work. We’d essentially do the work for what they could pay us.

At the big firms, alternative fee arrangements were still just a theory. They were laying people off.”

Today, Moore has seven attorneys working for him, including several Marshall students. “It’s not just an alternate fee arrangement but an alternate business model,” he says.

“We just listened and tried to figure out what the clients wanted.”

Community developer Anthony Trzaska graduated from the University of Dayton law school in 2009 and is now working parttime as a “craft counselor” helping Cleveland Bagel, Cleveland Flea and other startups negotiate leases and other business documents.

Eventually, he hopes to scale up his development business on Fleet Avenue, where his family also owns a funeral home.

Sam O’Leary graduated from Marshall in 2013 and bounced around for several years before finally landing a full-time position at Matty, Henrikson and Greve.

He also serves as president of Lakewood City Council. He says going to law school is still a good

value proposition, but you have to know what you’re getting into.

“I definitely feel like my legal education helped afford me the opportunity to get elected to city council,” he says.

Marshall class of ’16 grad Brooke Hamilton recently started an associate-level position at Gallagher and Sharp, one of the few people in her class to land a job at a big firm.

“I’ve noticed that even if you don’t go to one of the top 10 or top 15 firms in the city, the other midsize firms are still looking for people who have had some kind of work or clerking experience during law school,” she says.

Donnelly says it’s a myth that there are too many lawyers. Instead, she argues, the cost of legal services needs to come down across the board so that more people can afford them.

Her advice to new grads? “Go to law school because you want to help people,” she says. “Keep your debt low. If you aim for the market above legal aid eligibility but below the $250 per hour mark, you probably will be able to make a living.”

Cleveland Stories Dinner Parties Earlier this year, Music Box Supper Club launched Cleveland Stories Dinner Party, a weekly series that paired fine food with storytelling. MOVIES NOT QUITE MAGNIFICENT, BUT STILL A BLAST The Magnificent Seven is balm for weak summer season

By Sam Allard DENZEL WASHINGTON AND CHRIS Pratt lead a septet of cowboys and gunslingers in Antoine Fuqua’s The Magnificent Seven, a remake of the 1960 classic of the same name starring Yul Brynner and Steve McQueen. The premise here is identical, except it’s a western mining town, not a Mexican peasant village, that needs protecting from villains and thieves.

The chief villain here is generic evil industrialist Bartholomew Pogue (Peter Sarsgaard), one of the movie’s many fantastic names – hats off to True Detective’s Nic Pizzolato, who cowrote the script, on that score.

After Pogue kills the sturdiest of the able-bodied men in Rose Creek and informs the rest of the earnest homesteaders that they’ve got to pack up their things and skedaddle, on pain of death, spirited widow Emma Cullen (Hayley Bennett, from Music & Lyrics!) tracks down bounty hunter Sam Chisolm (Denzel Washington) to come to their rescue. Chisolm, persuaded for personal reasons that don’t become clear until later, enlists the gambler Josh Faraday (Pratt); the Civil War sharp shooter Goodnight Robicheaux (Ethan Hawke); Goodnight’s knifeslinging sidekick from the Orient,

Billy Rocks (Byung-hun Lee); a gruff tracker (Vincent D’Onfrio, singsonging in weird Winnie-the-Pooh falsetto); a Mexican criminal (Manuel Garcia-Rulfo); and a Comanche named Red Harvest, marching to the beat of his own drum (Martin Sensmeier).

The squad is assembled with economy and levity -- “I do believe that bear is wearing people’s clothes,” quips Pratt, as Faraday, when D’Onfrio’s tracker initially declines the offer to join ranks – but the action takes off once they’ve come together in Rose Creek. An initial gunfight and an enormous final showdown pitting the town against Pogue and his re-enforcements constitute most of the movie’s second half, and both

are hugely successful, entertaining sequences. It’s much more coherently choreographed and considerably more impactful than, say, the scenes of chaotic destruction that can be counted upon to mark the climaxes of most Hollywood superhero movies these days.

Two quick notes. 1) The Magnificent Seven straddles the summer season and the awards season, but should be viewed favorably as an entry in the former, not tepidly as an entry in the latter. This one’s plain fun. Fuqua nails the ingredients of a classic Western – your one-liners, your duels, your WANTED posters -- without dampening the mood with dead-serious solemnity and moralizing.

And 2): The diverse cast of characters is both welcome and odd.

The Seven are led by a black man, in 1879, whom no one seems to mind (or notice) is black. An Asian, a Mexican and a Native American are all on hand, and though they remain less-developed than Faraday and Robicheax – no monologues for the minorities (or even for brave Emma Cullen, come to think of it) – their presence paints a more colorful picture of the American West, particularly as viewed from the armchairs of 2016 America.

SPOTLIGHT: MY BLIND BROTHER When Tyler Davidson, a locally based producer who’s been involved with movies such as Swedish Auto, Take Shelter, Compliance and The Land, came across director Sophie Goodhart’s script for her new dark comedy My Blind Brother, he noticed a lake figured in the story.

The tale of a blind swimmer who swam from Nantucket to Martha’s Vineyard inspired the basic plotline. A proponent of Northeast Ohio as a setting, Davidson tried to talk Goodhart into shooting here.

Initially, convincing Goodhart wasn’t easy, especially since he brought her here during the winter.

“What I love about making movies here is trying to play this area for this area,” says Davidson one afternoon from the Rising Star coffee shop in Little Italy that’s down the street from the apartment where he lives. “So many movies come and they’re Cleveland for New York.

When we first scouted, it was the dead of winter, and you couldn’t even see that there was a lake. It was a frozen tundra. She was a little bit panicked.

I was trying to tell her that in three months it

would not only be a lake but a lake that you can put people in. She was pretty happy when that came true.”

The movie centers on Bill (Nick Kroll) and his blind brother Robbie (Adam Scott), a self-centered prick who has Bill tag along and guide him as he trains for marathons and swimming competitions.

When the two both fall for Rose (Jenny Slate), trouble ensues, and Rose finds herself caught in the middle of their many squabbles.

The film’s final scene at Lakeview Park in Lorain includes an extensive shot on the lake as Rose and Bill try to guide Robbie in his attempt to swim the entire lake. Davidson says it wasn’t an easy scene to shoot.

“I was on set and having many panic attacks during that scene,” he says. “It was a fairly choppy night on the lake. Sophie was in a boat seven months pregnant. We had our $100,000 cameras.

I was on shore. I was listening on headset. The signal kept dropping out as they got further onto the lake. I remember Adam Scott saying something off camera to the effect that he thought this was something that felt genuinely dangerous.

When you go for it like that, it adds so much drama and texture to the scene. That was the high point of the whole shoot for me. When we got that scene and I saw it on the monitor, it turned out great.”

The film made its debut earlier this year at the South by Southwest film festival, and it screened at the Cleveland International Film Festival. It opens on Friday at the Cedar Lee Theatre and goes to video on demand that day too.

“I think it will play great,” says Davidson, who will be on hand for question and answer sessions following the 4:30 and 7:10 p.m. showings on Sept.

23 and 24. “The trailer has gotten a huge number of views. It’s a simple, accessible story. What I love about it and what I loved about the script is that it takes these complex dark themes of resentment and jealousy and self-loathing and sibling rivalry and packages that in a simple story. The ability to ride the line and carry that tone is the strongest aspect of the film. ART SEASONAL SHIFT MOCA opens fall season with wall-to-wall visuals

23. New exhibitions include Wall to Wall: Carpets by Artists and Anders Ruhwald’s Unit 1: 3583 Dubois. Free and open to the public, Friday’s opening night event begins with a conversation between Wall to Wall curator Cornelia Lauf and participating artist and catalog essayist Kenneth Lum. Following the gallery talk, Detroit-based singer, songwriter and guitarist Britney Stone will perform live outside on Toby Plaza.

“Art, design, and craft are seen as provocative contemporary bedfellows in MOCA’s new fall shows,” says Jill Snyder, MOCA’s Donna + Stewart Kohl executive director. “Together, the exhibitions focus on crossovers and relationships between artists, media, processes, concepts, and disciplines.”

Spanning throughout the Mueller Family Gallery, Rosalie + Morton Cohen Family Gallery and Donna + Stewart Kohl Atrium, Wall to Wall: Carpets by Artists features work by more than two dozen artists whose work challenges the traditional definitions of art, craft and design, while examining shifts in process and raising questions about the complex geopolitics of the production industry and the art market. Through this ancient yet still relevant medium, Wall to Wall explores how and why artists are advancing traditional and contemporary processes and materials.

Simultaneously, Anders Ruhwald’s Unit 1: 3583 Dubois recreates several life-size rooms and corridors based on a permanent installation Ruhwald is creating in an apartment he purchased inside the dilapidated building from which the exhibition draws its name. 3583 Dubois Street no longer exists in Detroit. Though the 7,000 sq. ft. brick apartment building still stands, it has been reassigned a new address: 2170 Mack Ave. Using materials from the building and

neighborhood as well as his signature ceramic works, Ruhwald creates abstracted spaces in an effort to “retell (and thus reclaim) the past, animate the present and suggest a shifted future.” Unit 1: 3583 is organized by MOCA Cleveland’s Deputy Director Megan Lykins Reich in the Toby Devan Lewis Gallery.

Currently living and working in Michigan as artist-in-residence and head of the Ceramics Department at Cranbrook Academy of Art, Ruhland was born in Randers, Denmark, in 1974. The three-day festival promises innovative and engaging performances, art, installations, live music and random acts of creativity.

The event’s highly anticipated installations and exhibitions include Neighborhood Awakenings, a festival village dedicated to Cleveland’s neighborhoods. It features informative displays, such as Life as We See INGENUITYFEST 5401 Hamilton Ave., ingenuityfest.com

It: St. Herman’s Homeless Shelter Photojournalism Project, which showcases about 30 photos selected from over 1,000 images captured by six individuals served by the shelter who were provided with digital cameras.

As usual, organizers present a full lineup of live music throughout the weekend. A collaborative effort between Cleveland Music City’s James Carol, Joanna Ericta and Scene’s own Rachel Hunt, the roster includes notable locals such as Mourning [A] BLKstar, Beach Stav and Goldmines, who will be officially releasing their new album at IngenuityFest on Saturday, as well as emerging bands from throughout Ohio, Chicago and Brooklyn.

“There has been so much energy around Ingenuity’s new model, and we’re so excited to expand that into our music programming this year,” says Emily Appelbaum, Ingenuity’s program director. “The energy from Cleveland Music City has been wonderful – they’re thinking about the project in a whole new way!”

Additionally, this year includes a “Creative Corridor” event on Saturday. At East. 53rd and Hamilton Ave., guests will be able to view artist-driven projects and displays, participate in an interactive creation station and attend a panel discussion on “creative strategies to promote inclusion, artistry, entrepreneurship and quality of life in the East. 105th to 93rd corridor.”

Transportation to the Creative Corridor is provided through a partnership with Westside Shuffle at Cleveland Public Library’s Union Branch (3463 E. 93rd St.) and Bethany Baptist Church (1211 E. 105 St.).

Shuttles will pick guests up from the library at 1:30 p.m., and the church at 2:15 p.m. Returning shuttles will leave IngenuityFest at 5 and 7 p.m. for both locations.

After 12 years of suggested donations, organizers are now charging admission for entry. Tickets are $5 per day or $10 for a weekend pass. Children 12 and under are free.

STAGE RUTHLESS! LEAVES YOU BREATHLESS… WITH LAUGHTER The Beck Center show is a triumph of campy, outrageous fun.

By Christine Howey SADLY, THERE HAS NEVER been any certified research on the funny bone, exactly where it is and how one can go about tickling it. But when researchers do this study, they may find the musical Ruthless! sitting nearby spouting a smart-ass remark. Ruthless! is now on the boards at the Beck Center and it hit virtually every square centimeter of my funny bone.

This over-the-top exercise, featuring book and lyrics by Joel Paley and music by Marvin Laird, happily slaps together references from iconic shows ranging from Mame to All About Eve, and never stops for a moment to catch its breath. And thanks to beautifully controlled performances by the entire cast under the direction of William Roudebush, it all works with the tight precision of a welloiled laugh machine.

Since I’m about to gush, please be prepared. (I’d advise spreading a plastic drop cloth, this could get messy.) This campy send-up of Broadway and film begins with the premise that a maniacal lust for success in showbiz is ingrained early on. In this case, it’s a third grader named Tina who is certain that she is destined for stardom.

And her nicely domesticated mom, Judy, is just happy to answer the phone for her popular little girl as the adorable tyke dances and sings around the house.

That lasts for about thirty seconds, until Sylvia St. Croix knocks on the front door. Played in true camp style by a man (Matthew Wright), St. Croix vamps into their lives and immediately starts planning Tina’s career as a star. And when it’s revealed that the school musical about Pippi Longstocking is coming up, Tina is ready to do anything to get the lead role. As the little diva elucidates, “If I sound desperate, it’s because/All I want—No!—all I NEED is applause!”

So off Tina goes to the audition, but she’s beat out by a taller, awkward girl named Louise (whose

parents apparently bribed the drama teacher). Crushed, Tina returns home to bathe her sorrows.

But Sylvia begs the drama teacher Miss “No, I’m Not a Lesbian” Thorn (a hilarious Kate Leigh Michalski) to let Tina be the understudy.

Now, Tina’s only a heartbeat away from the role should, ahem, anything happen to lead actress.

This situation is deftly resolved when Louise (Brittni Shambaugh Addison) is reportedly found hanging by the neck from a jump rope attached to a catwalk high above the stage.

Along the way, Judy’s mother shows up to encourage Tina on her trek to stardom, and Carla Petroski nails the show-stopping number “I Hate Musicals,” which is

highlighted by lines such as, “My gorge starts to rise when a nun starts to tap/And wouldn’t you just love to slap Maria Von Trapp?”

This is just the beginning of the comic mayhem that infuses this rollicking musical with giggles and gore. It is gloriously unrepentant about how it steals themes, characters and lines from past entertainments, and that makes it a treasure trove for those (you know who you are) who glory in identifying such references.

Of course, this could all collapse in a heap of overly cute machinations if it weren’t performed with style and discipline. And the Beck cast delivers in all cases. As Sylvia, Wright is pure delight as he

embellishes his lines with a deep baritone growl to emphasize this woman’s serious intent. Sashaying about in a variety of dynamic dresses designed by costumer Aimee Kluiber, Wright serves as narrator to hold the proceedings together.

As Tina’s mother Judy, Lindsey Mitchell hits the perfect note as she begins the show with a vapid emptiness, declaring her delight in being “Tina’s Mother.” But Judy later undergoes a transformation when her parentage is revealed and she learns she is actually the daughter of the famed performer Ruth Del Marco. In the second act, Judy takes on a whole new persona, in a completely redecorated home, as the arrogant, Tony-winning star Ginger Del Marco.

This enables the writers to introduce Ginger’s aide Eve, a notat-all hidden reference to the cagey assistant in the flick All About Eve. Addison fashions a creepy turn as Eve as she tries to inhabit Ginger’s life. Meanwhile, Tina has been found guilty of murder and is put away in the Daisy Clover School for Psychopathic Ingenues.

In the role of Tina, Calista Zajac is enormously entertaining without ever getting on your nerves as child actors are wont to do. She can sing and even belt, and she has some dandy comic timing.

Indeed, every aspect of this production is spot-on, with the three keyboards under the direction of Larry Goodpaster providing all the accompaniment that is required. In fact, this show is so amusing I will personally refund the ticket price for anyone who is not totally satisfied with this show*.

Ruthless! definitely earns its exclamation point! (*No, I won’t.)

For authentic tacos and Guatemalan, two Northeast Ohio shops worth your time

By Douglas Trattner I WENT TO EL RINCONCITO CHAPIN in search of pupusas, but left a newly minted fan of garnachas.

About eight months ago, Engel Godinez left his job in the kitchens of the Hard Rock Rocksino to open his own restaurant, a small place on Pearl Road in Old Brooklyn. I had heard that El Rinconcito served authentic foods from Godinez’s home country of Guatemala. Given that I would travel to Central American just to eat pupusas, lunch was planned.

Set inside a tidy little awninged storefront, the Latin eatery has only a handful of tables, which is a good thing given how slowly dishes can come out of the kitchen. But that appears to be because Godinez is a bit of a perfectionist, unwilling to pluck the dobladitas ($5) from the hot oil until they are perfectly crisp. These tasty little turnovers are filled with shredded chicken, topped with cabbage slaw and served with housemade salsa. Likewise, Godinez doesn’t slide the corny pupusas ($2) off the griddle until there’s nice coloring on the exterior. Filling choices include melty cheese and beans or pork.

Other street food-style starters include chuchitos ($1.50), Guatemalan tamales steamed and served in dried corn husks. These moist and fragrant bundles contain a small amount of chicken filling and are paired with a thin tomato-based sauce. I say skip the tacos that utilize commercial corn

tortillas and head straight for those amazing garnachas ($8). An order nets you a half dozen stacks, each built atop a small, dense and sturdy tortilla base that can be picked up and eaten out of hand. On top of each is a dollop of bright salsa, spoonful of seasoned ground beef, raw red onion and a sprinkling of salty cheese.

In addition to the ubiquitous platters of grilled steak or fried tilapia with rice and beans, El Rinconcito offers some interesting larger plates that are worth exploring. Jocon ($11.50) is a chicken-based dish where the meat is stewed in a green mole-like sauce made with cilantro, tomatillos, pumpkin and sesame seeds; pepian ($10.50) is chicken cooked in a spicy tomato sauce; and arroz a la cazuela ($9) is like a Guatemalan version of paella with rice, shrimp and vegetables.

for the incomparable satisfaction that comes from excellent Mexican street food, so the notion of traveling to Bedford Heights for lunch is NBD. Las Americas is not new, but newish ownership appears to have propelled this shadowy treasure into the mainstream.

Las Americas is anything but conventional – in terms of layout, service and setting. In the front portion of the cramped shop, which is located in an unexceptional strip mall, is the open kitchen and counter, where one places his or her order.

The main draws here seem to be the tacos, burritos and quesadillas, which are the ideal marriage of flavor, freshness and value. Burritos ($6) are stuffed to the breaking point with chicken, steak or al pastor (pork), rice,

beans, cheese and onions. Quesadillas ($5.50) are filled with the same choices, griddled on a flattop until hot and melted, and served with rice, sour cream and salsa. The tacos here, though, are where it’s at. Fresh, hot and steamy corn tortillas are doubled up, overloaded with al pastor, carnitas, chicken or steak, diced white onion and fresh cilantro. They’re $1.89 each and come with a side of the most amazing salsa – a smoky, blisteringly spicy red sauce that improves everything it graces.

Entrees are equally generous in size and value. An order of arroz con pollo ($8.99) contained about a half pound of seasoned and sautéed white meat chicken, a heaping mound of fluffy rice, a side salad with tomato and ripe avocado, and a fat stack of warm tortillas. Others large dishes include sautéed shrimp in a spicy tomato-based sauce, whole deep-fried fish, and grilled steak and shrimp with bell peppers. Mains range from $9 to $12.

Know going in that Las Americas is a cash-only operation and that the joint can get pretty congested at peak lunch hours. Place your order, browse the shelves, grab a seat in the dining room, and you’ll be living large in no time.

PREPARE YOURSELF TO BOLDLY go where few Cleveland cheese connoisseurs have gone before. Owner Michael Januska isn’t reinventing the cheese wheel, but he’ll be providing a much different experience at Old Brooklyn Cheese Company (4138 Pearl Rd., 440-670-0762, www. facebook.com/obcheese) than most Midwesterners are used to.

Old Brooklyn Cheese Co. not only will be selling upwards of 100 varieties of local and international cheeses, including area favorites Lake Erie Creamery and Yellow House Cheese, but the shop also will be making its own products in a state-of-the-art production kitchen and aging others on site in one of three cheese caves.

Januska has partnered with Hartzler Family Dairy in Wooster to supply its grass-fed, non-GMO, raw milk produced within 50 miles from where it will be transformed into cheese.

“That’s one of the appealing aspects of making the cheese here under my brand is that it’s one ingredient and you can makes thousands of variations,” Januska explains.

He’ll launch with a 60-day aged Gouda and an English cheddar, made with bacon fat-dipped cloth for a slightly smoky and sweet taste. He hopes that Clevelanders will grow familiar with the concept of eating cheese seasonally and, like fine wine, even come to differentiate the regions from where individual varieties originate.

Unlike going to your local grocer or taking a number at a delicatessen for machine-cut slices, these cheeses will be aged up until the moment that they are sold. “One of the things I’ve found out since being back is the difference in chain of ownership of cheese and what happens once it’s gone from the cheesemaker. Once it’s in distribution and sent to the shops, there isn’t any care; it’s just something for sale,” Januska says in disbelief.

“They just forget that it’s still alive.”

Originally from the west side of town, Januska spent years working internationally in London-area restaurants before buying a home in the Old Brooklyn neighborhood. “[Back in London] it was almost a hobby, because there was only so much

time between running a business or working at a busy restaurant,” he says. But over time, Januska was able to mine his favorite shops like Neal’s Yard Dairy in Covent Garden for information on aging and curating cheese.

Electing to not take on a business partner, Januska has funded much of his production kitchen for Old Brooklyn Cheese Co. through contributions on Kickstarter, which surpassed its $7,000 goal this week. Januska has been patiently waiting for the time when his own raw milk cheeses have aged past the regulated amount of time required for such products to be sold. In the meantime, the newly minted shopkeeper has had plenty to do, working long days with the help of his fiancée and family to ready the interior of the large 1,200-squarefoot space for a late-October opening.

He recently participated in a “Farm 2 Table” dinner in the Ben Franklin Community Gardens of Old Brooklyn, collaborating with Toast and Goldhorn Brewery. It was there that diners got to taste some of the very first cheeses that Januska has created.

Even though Januska knows it’s been awhile since he’s been back to his hometown, he’s ready to work hard to gain the brand recognition needed to supply area restaurants, wine bars and breweries while also keeping the community up to its collective noses in cheese.

EAT bites EL PUENTE VIEJO MEXICAN EATERY TO JOIN THE DOWNTOWN TACO FIESTA

By Douglas Trattner IF YOU WERE OF THE BELIEF that downtown Cleveland could use a new taco restaurant, today is your lucky day. That’s because today is the day you learned about El Puente Viejo (1220 Huron Rd.), a new “taco and tequila bar” scheduled to open in the Creswell, a high-end residential building in Playhouse Square.

Owner Rogelio Hernandez was born and raised in Central Mexico, but he’s owned Mexican restaurants in the States for years. He recently added a splashy new Si Señor (25048 Sperry Dr., 440-250-0882) in Westlake to his portfolio, which also includes spots in Kamm’s Corners, Seven Hills and North Ridgeville.

Like his Westlake operation, Puente Viejo will feature a handmade tortilla station, guacamole bar, and refrigerated fresh toppings bar for diners to customize their dishes.

The 2,800-square-foot space will

seat 100 guests inside and another 40 on a Huron-facing patio. Partner Dave Wittshen describes the look and feel of the restaurant as “urban modern,” with a feature wall mural of the puente viejo, or “old bridge.”

“It refers to the old bridge in Central Mexico that separated Rogelio’s hometown from the city,” Wittshen explains. “All the kids would have to cross the old bridge to get to the city, which is where all the old school taco carts would be.”

Wittshen says that barring any unforeseen developments, the restaurant should be open before the end of October. As for the purported downtown taco glut, the owner says he and his partner have zero concerns.

If you’ve been checking in on this project over the years, the news last month that Hansa was nearing the finish line was glorious.

Better news as of last week: Hansa’s now open. Boris Music quietly opened the doors this month before an official grand opening party went down on Sept. 9.

Six beers are on tap with Hansa’s Oktoberfest rounding out the bill.

Music made big news when he broke ground in April 2013 on his multi-million dollar construction project that would transform the corner of Lorain and West 28th into a shiny new brewery, restaurant and retail shop. While much of the construction has been completed for months, Music still needed to jump that final and most important hurdle: obtaining all applicable local, state and federal permits.

With all that done, Hansa becomes the sixth brewery to set up shop in Ohio City (number eight if you count nearby Forest City and Brick and Barrel). Hansa joins Great Lakes, Market Garden, Market Garden production facility, Nano Brew and Platform Beer.

Music and his specialty foods shop Hansa Import House have been fixtures in the Ohio City neighborhood for 40 years, longer even than Great Lakes Brewing.

So it was welcome news when he announced his plans to construct a 15-barrel brewery and restaurant while improving his long-running specialty foods shop. That shop, long popular with Eastern European immigrants, carries a huge inventory of imported cheeses, meats, breads and beers.

Music originally had planned to be the first American outpost for Laško, a Slovenian brewery that dates back to 1825. But that

relationship dissolved when the brewery was purchased by Heineken last year.

CAFÉ FALAFEL, THE POPULAR MIDDLE EASTERN SHOP IN KAMM’S CORNERS, HAS CLOSED BUT OWNER PROMISES A RETURN Café Falafel, the popular threeyear-old Middle Eastern eatery by Fairview Hospital, has closed. Its last day of service was Sept. 7. The small mostly carry-out spot did amazing things with hummus, baba ganoush, tabbouleh, shish tawook and falafel, which remains one of my favorite versions of the dish.

On Facebook, owner Ehab Enaia offered his fans short notice and a concise goodbye without elaborating on his decision. Reaching him by phone last week, Enaia had a moment to elaborate about the closure and his future plans.

“With two young kids and a baby on the way, it’s too much,” he says. “It’s like I bought myself a big present and locked myself inside it day and night for three years. At the end of the day, nothing compares to family.”

While dreams of a future fullservice Middle Eastern restaurant closer to the heart of town exist, Enaia says that a more realistic and appealing option might be a food truck that can do catering, private parties, corporate lunches and seasonal events.

One silver lining is the amount of business his and Scene’s announcement of the impending closure generated on his last day.

“We got hit like a tornado,” he said. “Honestly, I never thought for one second that there was all this love and support from people. It was insane.”

MUSIC MOCK THE VOTE Shock rocker Alice Cooper satirizes the presidential campaign

By Jeff Niesel “I’M YOUR CHOICE” SHOCK rocker Alice Cooper snarls in his 1972 hit “Elected,” a song that satirizes the political system with Who-like guitars and a spoken word segment.

Every four years, Cooper brings the song back out, and this year is no exception.

Cooper even staged a fake presidential campaign earlier this year to go along with the reissue of “Elected.” His slogan: “I can do nothing as well as they can do nothing.” His ten-point platform includes getting singer Brian Johnson back in AC/DC and adding Motorhead’s Lemmy to Mt. Rushmore.

We recently got him on the phone to talk about the tour and the fake campaign as well as ask his opinion about the Trump and Clinton tickets.

Did you anticipate that this presidential nomination process would become such a circus?

Oh yes. I saw this one coming.

When I realized how wacky the two final candidates were, I figured there would probably be comedians coming out of retirement because it’s so easy to satirize this election.

Take me back to the beginnings of “Elected.” What’s the story behind the original version of the song?

The funny thing about that song is that when we wrote that song, we wanted to do a song that was very Who oriented with the big power chords and all that. That was the whole idea. We thought that would be the subject. We didn’t realize it would become an anthem. It ended up being John Lennon’s favorite song. I’m so not political so it’s funny that I wrote the song that was one of the most political songs, and I was not trying to be political I was just having fun with it. The most absurd thing in the world in 1972 would Alice Cooper being president. It would be like if you said that Mr. Rogers is now going to sing for the Rolling Stones.

It was on that level of absurdity. But it works for every single election.

Alice is always put up for election every four years and this one just happens to be even funnier. But please don’t vote for me. I couldn’t handle the pay cut.

The music video is great. Where did you find such a friendly chimp?

The funny thing is that we did pre-video. We did that on film. In 1972, there was no MTV. We just did the film, and we figured they would play it on Midnight Special or [Don Kirshner’s ] Rock Concert.

When we finished it, we didn’t know what to do with it. It wasn’t out on video. There was no place to play it.

It would resurface every three years.

We were doing everything by the seat of our pants at that point, and that’s what made it fun.

What did you set out to do with the new version of the song?

It’s just a remix. We remixed and re-mastered it. There’s no new version. We made it more of a power rock song. We didn’t do anything that changed lyrically. When you’re writing a song like that, you have to stay very open. It’s like “I’m Eighteen” or “School’s Out.” You have to make sure that 50 years from now, those lyrics still work because you haven’t been so specific that you’ve dated it. When Alice says, “I’m your top prime cut of meat, I’m your choice/I wanna be elected/I’m your yankee doodle dandy in a gold Rolls Royce” — wow does that sound like Trump. That was written in 1972.

There was no Trump even thought about then. Back then, politicians had to be bigger than life. They had to be perfect. They had to be gigantic stars and that’s who this guy says he is.

How much thought did you put behind your decision to throw your hat in the ring as a presidential candidate?

I really only came up with one or two things that meant something to me. One is that I can do nothing as well as they can do nothing.

cards Obama got dealt. Obama got dealt the same cards that Bush got dealt. Really, the president doesn’t have that much say or that much power. It gets to the point about which face do you want to look at and who do you want representing you for the next four years. A president can’t declare war. They don’t have the power. People have all the wrong fears about this thing.

Your platform includes getting Brian Johnson back in AC/DC.

What do you have against Axl Rose?

Axl is the only single guy that could have taken Brian’s place. I like Axl. People think I’m anti-Axl but I like Axl. When I heard that he would fill in for Brian, I said that he’s the perfect choice. He has a range like that and can appreciate those songs.

He’s the one who can do justice to those songs. I think everybody wants Brian Johnson to get better and be back in AC/DC. Axl needs to be in Guns N’ Roses. They’re doing | clevescene.com | September 21 - 27, 2016

great. Guns N’ Roses are having a great tour. There’s no infighting. I think they got past that. From what I understand, their concerts have been really good.

You chose Tom Hanks as your running mate. Why? Well, if I did get elected, the first thing I would do would be to abdicate. I would say, “Ok, I don’t want this job. My Vice President is really the perfect choice.” Who wouldn’t vote for Tom Hanks. Think about it. Does he not look like a president? I would vote for him in a second. And maybe Morgan Freeman. Those are the guys who really should be running for president.

What kind of running mate would Marilyn Manson make?

Marilyn would be interesting. If you were going to do a rock ’n’ roll cabinet, you would put Ted Nugent in the department of defense. He knows more about that than anybody else. Paul McCartney would be the Prime Minister of England. You can’t get much better than him.

Everyone would fit into a certain thing. Alice Cooper would not fit in at all —being so non-political he would not fit in. Bruce Springsteen would be Secretary of State. Those are the right guys for that. I would

I think if you’re in a shooting war, you’re there to win it. You’re not there to break even or back out of it. That’s why I chose Bush. From then on, everyone goes he’s a Republican. And because I’m a Christian, people think that. I’m much more moderate than that.

How has Alice changed with the times?

Certain characters don’t need to change with the times. That man doesn’t need to change. When you’re talking about really theatrical characters, they don’t need to have an age or a time period. I look at him as being a character who’s timeless. If I were a kid looking at Alice Cooper for the first time, I wouldn’t know how old he is. He could be 20. He could be 40. He could be 80. It depends on the song. To me, I don’t think Alice needs to change with the times. He’s pure entertainment out there, and I try to keep it so that it never gets to a point where you can say that it’s 1980s Alice or 1960s Alice or 2020s Alice.

It’s like rock vaudeville. It doesn’t have an expiration date.

You describe Alice as “a troubled man for troubled times.”

But you might actually be the least troubled person out of all the candidates.

QUALITY TIME At home in the world of artistic freedom with the Chris Robinson Brotherhood

By Eric Sandy HERE’S HOW CHRIS ROBINSON’S days began while laying down the new album with his band: Wake up at 7 a.m., take his daughter to school, brew some tea, listen to some music. It’s sort of like most other days for the lifelong songwriter, because, now, Robinson is more at home than ever with the latest twist in his career.

Arguably, this record, Any Way You Love, We Know How You Feel, is the Chris Robinson Brotherhood’s most comfortable album yet -- one that finds the musicians totally in the zone and looking forward with relaxed eyes and ears.

The CRB finds itself wholly in its element now, a few years after frontman Robinson’s alma mater, the Black Crowes, called it quits for good.

(Robinson’s adamant about the finality, and he’s pleased that it’s in the history books.)

Robinson’s tenure with the Black Crowes is well documented, particularly his anxiety with the limiting expectations placed on him and that band. The Crowes’ final tour in 2013 revealed even more clearly to Robinson how dysfunctional the band had become. With a real rock ‘n’ roll legacy enveloping the band across more than 20 years, he found himself trapped in the confines of the same old material and caught up in long-standing financial disputes among bandmates and the label. Not conducive to creative growth.

And so, to snap back to the present era, Robinson’s new band hit the studio and dropped Phosphorescent Harvest

in 2014 (their third album) and, soon after, ran off to wooded northern California to prepare the music that would appear on their latest album, this year’s Anyway You Love, We Know How You Feel.

The CRB encamped in a quirky house about 12 miles from San Francisco. “It’s kind of remote, you know? There’s only two roads in and out.” Above them, Mount Tamalpais loomed. The cool Pacific air flowed inland, welcoming and refreshing, each morning.

With eight songs, most of them a hearty five minutes or longer, the album feels like a glimpse into openended jam sessions. Each musician shines here and there, dishing interesting solos (check the keys on “Oak Apple Day,” for instance), but more often than not this is ensembletype stuff: The band, featuring a few newer members, clearly gels.

Lumped somewhat into the national jam band scene, the CRB certainly

Like “Give Us Back Our Eleven Days”: drummer Tony Leone and keys man Adam MacDougall were playing the main riff, and Robinson recorded it on his phone. It drifted into the recesses for a while, but when the band hit the studio those memories returned to the musicians. “I just pulled out my phone, like, ‘Does anyone remember this?’” Robinson says.

It’s a free-flowing instrumental, clocking in at a shade under three minutes -- a nice segue in an album otherwise filled with more expansive tracks. (There’s another instrumental, featuring Indian flute, coming on the next album in November, which will include five tracks that complement this material.)

“Making records is cool,” Robinson says. “The rest of the world can say they don’t mean anything, but that’s just like listening to politicians.” That’s what these guys are in it for; there’s no thought toward releasing a single.

does tend toward the improvisational side of music. That’s how most of their studio stuff is born. “If we play three hours a night, our soundchecks are easily two-and-a-half hours, sometime three, too,” Robinson says. Soundchecks afford the band a great platform to road-test the early fragments of new tunes.

says. “It’s kinda the thing that you’re never supposed to do -- especially, you know what I mean, when you come from something successful like the Black Crowes that have memorable hit songs.”

Of course, it’s working pretty well.

It’s not for nothing that the word “obsessive” follows Robinson through

the world of music journalism. He’s aware of that aspect of his creative character -- something that led to his distaste for the staid direction of the Crowes -- and he sees it as a virtue for a certain contingent of the American consumer base.

“It’s funny,” Robinson says, “in Vermont and shit, this craft beer — and I don’t even drink beer anymore — but this craft beer movement and stuff, I was interested in that because I like the idea of connoisseur culture. You know? I realized I’m not good at the tourist thing; I never was. I don’t do it as a traveler for the past 30 years and I don’t do it as an artist. I dig it if people are casual, and I understand there’s a surface involvement with anything.

“But just like you can buy a case of Bud Light and have a blast with your friends and listen to whatever — or, you know, like people here in California will wait in line to buy two bottles of Pliny The Elder that cost more than the other beers and you can only get two until another six weeks, and then they walk away and they’re the happiest people you’ve ever seen. I understand that. Your favorite Italian restaurant might be on a side street in Rome, while other people might go to Olive Garden. It’s totally fine, you know what I mean? I’m just saying there’s a difference in experience and a difference in what we’re trying to get out of it.”

SIGNS OF THE TIMES Post-hardcore act Thrice address current affairs on its latest album

By Jeff Niesel THRICE SINGER-GUITARIST Dustin Kensrue admits that Orange County, a conservative bastion in Southern California, gets a bad rap.

Speaking via phone from his home there, he says he’s learned to love the place.

“I really like it even though I resented it while growing up,” says Kensrue, who brings the posthardcore band to the Agora on Sept.

25 as it tours in support of its new album, To Be Everywhere Is to Be Nowhere. “I had kids and realized it was a really rad city to live in. The cool thing about it now is that it was a bit more homogeneous when I was a kid. Now, it’s super diverse, and it’s a cool melting pot. People really care about the community.”

While growing up there, Kensrue says he mostly listened to classic rock before discovering punk rock.

“Punk rock was formational in that I loved the energy and honesty and there was a rawness to it that was compelling,” he says. “Through the years, even though Thrice has been all over the map with music, the punk rock ethos has stayed with us in how we approach our art.”

Thrice, which formed in 1998, didn’t exactly have much in common with the other OC acts.

“There was hardcore stuff and poppy punk stuff,” Kensrue says.

“We didn’t fit into any of that completely, but we’d play all those shows and be the oddball. We weren’t hard enough for the hardcore show and too hard for the ska show. We

never felt like we part of a scene. We felt on the outskirts.”

After 14 years, the band had built up a strong fanbase on the posthardcore/alternative rock circuit. But Kensrue says the relentless schedule eventually took its toll.

“We had been going non-stop,” he says when asked about why the band took a hiatus in 2012. “We would write, record and tour. It got to be a grind. We were still doing great work and the fans were still there but it just felt like we needed a break. There were just a variety of reasons. I think it was super helpful in the long term even though it was hard for everyone in various ways in the moment. Coming back, everyone agreed it was necessary and helpful. We’ve been able to reset and re-prioritize how we do things.

We only tour three weeks at a time now, which is way more sustainable.

the Sand,” and “Wake Up” includes a spoken word segment that makes it come off as something like U2’s “Bullet the Blue Sky.” “I think there is a lot of variety [to the songs], but I also think it’s our most cohesive work as an album,” says Kensrue. “I think we always strive for the diversity and some kind of cohesion but for whatever reason, [this album is different] possibly because we were coming back and not having something to react to from our previous record.

We’re usually reactive and think, ‘We already did this, so let’s do this.’ This album ended up having a sound that incorporates everything we’ve done.”

The eclectic album closes with “Salt and Shadow,” a song that features cooing vocals and layers of electronic blips and bleeps.

After reconvening in 2015 to play a few festival dates, the band started working on new material.

The resulting album, To Be Everywhere Is to Be Nowhere, came out earlier this year. Album opener “Hurricane” features parched vocals and heavy guitars. Gang-style vocals distinguish the cascading “Blood on

Kensrue. “I think we had a demo of it where it was going really heavy with big rock choruses, and it felt like it was a bit much and seemed overwrought. I went back and built a rough structure of what’s there now. We took it to the studio, and we fleshed it out a bit. A lot of what sounds like organ is me playing guitar through a HOG 2 pedal. If you played a chord, it makes a bunch

of octaves.”

Like other Thrice albums, To Be Everywhere Is to Be Nowhere finds the band writing about political and social issues. “Whistleblower” makes allusions to Daniel Snowden, the former CIA agent who leaked classified documents, and “Death From Above” makes references to drone warfare.

“It’s definitely just the climate of 2015 when I was writing a lot of it,” says Kensrue when asked about the album’s themes. “In the process of writing it, I’m always a bit more aware or deeply looking into the things going on in the world around us because I do research if I’m writing about something that can be looked into. I like that aspect of writing where it forces me to engage more than I normally would. It’s a combination of a lot of heavy stuff going on in the world, and the music we write is generally kind of heavy.”

He says the songs aren’t meant to be left-leaning. Rather, he aims to provide “an honest look” at issues.

“It’s hard to not swing one way or another and see something under every rock,” he says. “It’s easier to say that everything is fine and think the best about our government. I used to be a bit more in that camp, but it’s a naïve position to hold.

Democracy only works if we keep things in check.”

VINYL SOLUTION Lake Street Dive found magic while trolling the dollar bins

By Jeff Niesel IN THE MIDDLE OF RECORDING Lake Street Dive’s latest album, Side Pony, producer Dave Cobb (Sturgill Simpson, Chris Stapleton, the Secret Sisters) asked the R&B/pop/’60s-era rock/soul band to hit the local record stores and browse the dollar bins to find the wildest and wackiest albums they could.

“He brought a turntable into the studio,” says guitarist and trumpeter Michael “McDuck” Olson via phone from Nashville as the band was about to perform at the historic Ryman Auditorium. “He wanted us to find the cheapest record with the most hilarious cover art. He said, ‘We’ll just drop the needle and see where that gets us.’ We did that for a couple of days.”

They wound up using a sample from a Major Lance tune for “Can’t Stop,” a song that sounds like a soul record from a different decade thanks to its funky bass riff and soulful vocals.

“The sample we used came off a record that was really warped,” says Olson. “Part of what made the sample so interesting was the inconsistencies in the record. It changed the time feel from the original recordings. That was really inspiring.”

Initially, band members met in 2004 as students at Boston’s New England Conservatory of Music.

Singer Rachael Price, bassist Bridget Kearney and drummer Michael Calabrese round out the group’s lineup.

“We got together to play one day

and things clicked,” says Olson.

“Obviously, that’s the simplified version, but it’s as straightforward as that. We didn’t get together planning on a 13-year run as working band. As jazz students, when you get together to listen to records, it’s mostly just jazz records. When the four of us were together, we listened to the Beatles, Paul Simon and the Beach Boys and Michael Jackson and Motown records and Muscle Shoals records. It was funny how long it took us that that was the musical direction we wanted to go in. We played music that was far more than just jazz-influenced early on.”

In 2012, the band benefited from the fact that its YouTube video of an acoustic rendition of the Jackson Five’s “I Want You Back” went viral.

We didn’t slow it down to set us apart or garner us fans. It was an example of us messing around. That is a hallmark of our jazz background and jazz training. You want to take a song and mess around with it and make it your own. The day we recorded that video, it was a throwaway. We were trying to capture performances of other songs as well.”

Their friend shooting the video said they needed to loosen up, so he asked them to play the track.

“That was the song that ended up having that magic,” says Olson.

“We’re eternally grateful to him for that.”

Olson says the band has evolved since 2014’s Bad Self Portraits. After recording Side Pony for two weeks,

Olson says the band has played covers since the start because “cover songs provided a gateway drug for new fans.” He says he can’t remember exactly why the band chose “I Want You Back” but that the group intended to use it as a way to get into the groove for a taping session.

“The bass line to ‘I Want You Back’ is iconic,” he says. “It’s one of the most recognizable bass lines in pop music.

That translated to well to our bass and trumpet incarnation. The slowing it

band members thought the album was done. But Cobb asked them to return to the studio to cut some more tracks.

“Dave said he wanted us to stretch ourselves out and write songs that are really simple and songs that are based on a sample and write together in real time instead of everyone squirreling away and then coming to the studio,” he says. “The song ‘Side Pony’ came out of that second half and ‘Hell Yeah’ came

out of that second session. I know that ‘Can’t Stop’ came out of that, but that’s one where we played around with a sample. ‘Call Off Your Dogs’ was also part of the second session.

Definitive songs came out of that second session. If there was a change between the two albums, it was that we had the gift of that second session where we could stretch and expand our minds and think about music in a different way because we knew we already had a product.”

Olson says the band will take the same approach on the next album.

“Because we had such a great experience on that second half of the Side Pony sessions, we talked about approaching the entire follow up album in the same way that we approached the second half of Side Pony,” he says. “We’re doing collaborative writing and looking for inspiration in different types of music. We’re getting together more on tour to listen to music together.

When we were in the passenger van, we could listen to music together all the time. Now, we spend less time consuming music. We want to know what each other are into. We started doing that in a more concrete way [for Side Pony]. We don’t know where or who we’ll record the next album with, but the musical preparation we’re involved in right now is setting the ball in motion that’s for sure.”

Ghost: The Popestar Tour/Zombi: Ghost isn’t your typical Swedish death metal band. For each album, a “summoning” is held at an undisclosed location in Lincopia, Otrogathia, and the group of anonymous Swedish musicians tweaks the lineup and decides what direction it will take things.

For its latest album, Meliora, the band anointed Papa Emeritus III to assume lead vocal duties. The lead single, “Cirice,” even won the 2016 Grammy Award for Best Metal Performance. Meliora is the Latin word for “better” (and it also means “the eternal pursuit for something better”). As a result, the songs on Meliora strike a balance between metal and prog and feature the mellow, more nuanced side of the band’s music. (Jeff Niesel), 8 p.m., $35.35-$45.25. Masonic Auditorium.

Freedom Rocks: Supporting the Ohio Innocence Mission with Faith & Whiskey/The No Name Band/The Exoneree Band: Wrongly convicted in 1981, guitarist, keyboardist and bassist Raymond Towler spent 29 years in jail before he was exonerated on May, 5, 2010. Shortly after his release, he put together the Exoneree

Band with bassist Ted Bradford, drummer Thomas Gruscinski, singer-drummer Antoine Day, singer William Michael Dillon and singerguitarist Eddie Lowery, all of whom have been wrongfully convicted.

The group came together in September of 2010 for an Innocence Project benefit in Cincinnati. The organizers thought exonerees would have something to say and helped assemble the band. They did shows in Salt Lake and Portland. At one big show in New York, the group really came into its own. Expect to hear a mix of originals and covers at tonight’s benefit concert. Hiroya Tsukamoto: A solo performer who uses a tool that can record his voice and, guitar in real time creating layers, so it sounds like one-man, orchestra, New Yorkbased Japanese guitarist Hiroya Tsukamoto makes music that’s been described as “cinematic guitar poetry.” At tonight’s show, expect to hear some originals as well as some Japanese folk, music. Tacocat: Seattle surf-punk band Tacocat is known for shining a spotlight on women’s issues.

On their 2014 release, NVM, the band parades the subjects of menstruation and harassment through the streets in a punk rock rainbow jubilee of bright chords and flagrant sing-songy vocals. On their newest release, Lost Time, the group strikes up the band once again in the name of every-Millennial annoyances, from anonymity-cloaked cyberbullies (“The Internet”) to white collar aristocrats turned obnoxious frat boys when work is over (“I Hate the Weekend”).

But amidst the ra-ra’s of rebellion against modern vulgarities, the title Lost Time (an X-Files reference) suggests that the band wishes it didn’t have to waste its youthful energy combatting the bad behavior of so-called adults.

Time suck or not, Tacocat makes a rave of the riot, bringing crowds a heavy dose of tambourine -topped party pop. (Bethany Kaufman), 9 p.m., $8. Mahall’s 20 Lanes.

By Jeff Niesel MEET THE BAND: Will Toledo (vocals, guitars, organ, piano, mellotron), Andrew Katz (drums, mixed percussion, mellotron), Ethan Ives (bass, vocals, guitars, vibrato switch on organ), Seth Dalby (guitar) PART OF A MUSICAL FAMILY: Toledo, who grew up in Virginia, says he grew up in a musical family — his dad played the piano — and started writing songs “as far back as I can remember.” “Before I knew how to write music, I would write lyrics and song titles,” he says. “That was what I enjoyed doing. As I moved on and started to play instruments, it became more real.” He says he mostly listened to “older stuff” while growing up and cites the Beatles as an influence.

Later, in high school, he became a fan of “Nirvana and Green Day and all that.”

FILTERED SOUNDS: Initially, he started recording in his parents’ car where he cut his first couple of independently released albums. “I recorded the vocals in their car and the rest of the music in my bedroom,” he explains.

“Back then, I didn’t put much consideration into acoustics,” he says.

“It was mainly something that would be mixed on my headphones and I put filters on it and everything. I think that’s more normal nowadays. The recording environment matters less because of what you can do with it after it’s recorded.”

THE GREAT NORTHWEST: A few years back, he moved to the Seattle area and put a band together. He now lives in Northern Seattle but says he doesn’t like being too close to the city. “I don’t like the city life,” he says. “I prefer

to be in a more suburban area.” Katz came to the band via Craigslist and Toledo met Ives at a show. Dalby was an old college buddy who joined up for touring purposes. “When it comes to live performance, I prefer working with the band though I’ve kept the creative process to myself,” he says.

“Playing with a group makes the concerts more dynamic.”

WHY YOU SHOULD HEAR THEM: Toledo re-recorded a number of his older tunes for his latest offering, Teens of Style, an album of ramshackle indie rock tunes that shows off his brittle vocals and “I was never satisfied with the original recordings,” he says.

“It was just what I was able to do. I always had the idea that I would go back to them and take a different approach. For the Matador Records release, it seemed like a good time to do that. I pitched that to them and they were interested in it. I don’t know if they were expecting it to be self-produced, but I wanted to do it by myself again just to show myself the improvement I have made in the past couple of years.” The group has recently recorded a few songs for the next album, which Toledo says is still in its early stages.
