Seven Hills stomps on democratic process; city councilmen ready tummies for venison varietals

THIS WEEK

IN A LEGISLATIVE MANEUVER virtually unprecedented in the state of Ohio, the Seven Hills City Council passed an ordinance Monday night that effectively circumvented a referendum that would have asked residents to vote on the legality of bowhunting in the city.

This is the latest salvo in a raging controversy in Cleveland’s southwestern suburbs between (in broad and by no means universally accurate strokes) animal rights activists on one side and heavily armed, cantankerous gardeners on the other.

Voters in six southern suburbs voted to allow bowhunting in their communities in the March primaries.

Seven Hills joined the pro-camouflage majorities of North Royalton, Broadview Heights, Parma, Parma Heights and Strongsville.

After voters signaled their approval, Seven Hills formed an ad

hoc committee to study the deer issue and prepare specific legislation. An ordinance was then passed on August 8, “authorizing a nuisance abatement initiative for both the short term and long term control and reduction of the white-tailed deer population.”

Monday’s new ordinance, though, with the same language as the August 8 version, was passed as an emergency measure -- “a non-disclosed, nonspecific emergency,” in the words of one distressed public commenter -- and was positioned by Council President Matthew Trafis as necessary for residents’ safety. (An irony, in the view of opponents, as what it now permits is something much more objectively dangerous: arrows nocked and loosed upon the streets of a built-up suburb.)

The legislative maneuver was interpreted by the Ohio Deer Defenders in attendance as a “low, sneaky, dirty” tactic by the lawmakers to get around having the issue on November’s ballot.

“I understand that the issues in front of us today can be very emotional, no matter which side of the aisle you’re on” Trafis told a crowd of nearly 75 at the Seven Hills Municipal Complex, in opening remarks Monday.

He said that though necessary petition signatures had been approved and a referendum on the deer ordinance was technically required, “our law department advised us in previous meetings that Ohio law allows for council to place on the agenda for a vote within 30 days of the petition being submitted, a vote to overturn our own ordinance and pass a new ordinance as an emergency measure to protect the health and safety of our residents, and that is not subject to referendum.

Case law confirms that this process is legal.”

Trafis said that over the past several years, residents have asked for legislation aimed at culling deer. Residents’ concerns have been primarily safety-related: safety while driving, safety from “charging deer,” and safety for children and pets who alternately eat and roll around in backyard scat. The backyards of Seven Hills were described as veritable mountain ranges of deer poop.

At any rate, the ordinance was passed without any discussion from council, but not without spirited public comment.

The anti-culling crowd, aligned along familiar anti-animal-brutality themes, brought their t-shirts and their statistics.

the tip of Seven Hills’ Deer-Defending spear, spoke first. She argued that that the fear mongering about deer as a public safety threat was absurd.

In the past five years, she said, speaking from data she’d obtained through public records requests, there have been no human fatalities or even injuries (reported) in all six southwestern suburbs considering bowhunting.

McKernan said that their were 66 reported deer-vehicle collisions (DVCs) between September 2015 and September 2016 in Seven Hills, but only 28, in her view, were legitimate, as many of the reports (10-15 percent) were duplicates, others were reported late at the police station, and in other reports no deer or vehicle was found at the scene.

The most cogent argument against the ordinance was presented by a 50-year resident named Joe Linway who warned that this would represent a headache for local police -- a single officer will be assigned to the bowhunting beat -- whose tasks, according to Trafis, at this point seem to be little more than “making sure the [hunting] stands are in the appropriate places.”

The ordinance allows for residents and non-residents to hunt deer (one buck and up to four does) so long as a property owner of 2.25 acres, or contiguous property owners with total acreage of more than 2.25, give them “permission.”

The pro-culling crowd offered personal testimony about their violent encounters with deer. Their experiences corroborated Trafis’s review of resident complaints. Their gardens had been ravaged by deer, they said. Their morning jogs had been interrupted by charging deer, they said; their pets had been besmirched and bacterially infected with the scat of deer, they said.

“I pay a lot of money to live where I live,” said one pro-culler, who identified as a local educator. “These animals must be stopped.”

The loudest talking point on the pro-culling side, though, was related to the referendum petition itself.

Many felt that they’d been tricked into signing something they didn’t understand.

Laughter and derision were the order of the day, on both sides.

One of the only times when public commenters weren’t subjected to heckling from opponents was when

57-year resident Tom Jaros (a 2015 Seven Hills Mayoral candidate) spoke.

He said he signed Lucy McKernan’s petition because he respected her constitutional right to collect it, but that he disagreed with her views. He got choked up talking about his elderly mother’s inability to watch her great grandchildren play in the yard due to the abundance of deer and scat.

“This is screwed up,” Jaros said.

“This political horseshit needs to stop.”

And it did, abruptly. Council adjourned to an executive session to briefly discuss “potential litigation” and then came back to unanimously repeal the August 8 ordinance and pass the new ordinance as an emergency measure. Councilman Tom Kraynak was the only council member who spoke, reading a letter from one of his constituents about an alleged near-death deer-vehiclecollision, but which mostly attacked Lucy McKernan, into the record.

(McKernan said no such crash was ever reported.)

“It’s not over,” McKernan told one of her Deer-Defender cohort in the post-meeting mingling, wearing an arrow hat. She said they’d be pursuing further legal recourse. She emailed Scene after the meeting to insist that she never lied to residents when obtaining signatures and said she felt abused and beat up in the aftermath of the meeting. She suspected the pro-culling crowd only attended at the personal behest of council.

“They had never been to any of the previous meetings,” McKernan wrote. “[Council] needed to create this circus to justify their decision.”

Lane Ferrante, a Twinsburg resident and one of the state organizers for Ohio Deer Defenders, said they’re mobilizing neighborhood watches to track the success of the bowhunting ordinances.

But for the pro-culling crowd, it was a victorious night. With Mayor Richard Della’Quilla’s signature, the ordinance would go into effect Tuesday, and permitting could begin immediately.

“Kill them all,” a pro-culler named Sharon Dickey howled into the night as she walked to her car, “Kill them all!”

CAPITOL IMPROVEMENTS: THEATRE ENTHUSIASTS FACE GRIM REALITIES WITH COURAGE AND GRACE Representatives from the DetroitShoreway Community Development Organization (DSCDO) and Cleveland Cinemas assembled a multigenerational bushel of Capitol Theatre

enthusiasts last week to discuss the west side movie theater’s financial challenges and explore options for enhanced marketing and publicity.

Last month, Cleveland City Council voted to restructure a loan made by the city to Detroit-Shoreway for the Capitol’s extensive renovations in 2009. The theater, which is owned by DSCDO and operated by Cleveland Cinemas, now has two more years of breathing room before they must begin making payments on the principal of the $1.5 million loan.

Until September, 2018, the theater will only be required to make monthly “good will” payments of $100.

But the city is also asking that the theater develop concrete marketing plans to increase its business.

Currently, the Capitol attracts 50,000 visitors per year. That’s less by half than initial projections, based on community surveys.

Jenny Spencer, DSCDO’s Managing Director, who led last week’s gatherin, said that 50,000 visitors per year is enough to “keep the lights on,” but certainly not enough to pay back the loan, and not enough to make capital improvements which are becoming necessary, even though the theater is only seven years old. Pricey new digital

projection equipment, spot treatment for the theater’s old plaster, and cosmetic updates like new carpeting are all on the wish list, (in that order).

On the fundraising front, Spencer announced an inaugural benefit event, a gala-type big-ticket shindig scheduled for April 21, 2017, about which there are as yet few public details.

On the customer-attraction front, DSCDO is enlisting the neighbors.

The meeting Tuesday, with gratis popcorn and veggie plates on the Capitol’s second-floor mezzanine, was positioned as a re-establishment of the “Friends of the Capitol Theatre” group. Given that movie theaters attract the highest percentage of their customers from the immediate neighborhood — the Cedar Lee being the region’s notable exception, due to its unique programming — DetroitShoreway wants community members to be the theater’s biggest champions.

And they are. The meeting’s attendees told stories of their personal outreach and marketing among social networks. Many of them said they forward Capitol emails to contacts who they think might enjoy certain films, for instance. Others said they regularly organize “dinner and a movie” outings with friends.

But those efforts aren’t quite enough, in the long-term — at least not without a critical mass of such efforts — and Cleveland Cinemas’ wider publicity tactics have been frustratingly hit-or-miss, said Dave Huffman, the local theater chain’s director of marketing.

Though special events continue to do very well — the upcoming Seventh annual 12 Hours of Terror all-night movie marathon (October 15-16) is expected to be the biggest yet, collecting in a single night what most movies collect in a full one-month run, Huffman said — other efforts have fallen far short.

Films in the summer “Capitol Selects” series, for instance, were largely very poorly attended. And attempts to market the Capitol to Spanish-speaking audiences have failed dramatically.

“We’ve talked to every Spanishspeaking organization in town, and they all are incredibly enthusiastic,” Huffman said, “but people aren’t showing up for the movies.”

After pleading with a studio to get the mainstream Spanish-language film No Manches Frida, Huffman said, the Capitol posted the secondlowest gross in the country for that film. Box-office performances like that jeopardize the theater’s ability to

get additional titles from the studio.

Therein lies the biggest challenge and Catch-22 for the Capitol, said Huffman. The theater hasn’t attracted enough business to convince studios to grant them certain films — they wanted to show Snowden at the Capitol, for example, but the studio said no — but they can’t attract the business they’d like without titles that people are interested in.

That said, marketing efforts continue apace. Screened at the Tuesday meeting was a new 30-second clip that will soon precede all films at the Capitol, a trailer explaining the Capitol’s renovations and its importance in the community.

Additionally, the Capitol on Tuesday began its fall documentary series, and October will be saturated with cult horror classics in honor of the season.

Also encouraging are the neighborhood advocates — young professionals, mid-career types, seniors, and even a high-schooler, attending with his dad — who helped brainstorm additional special events and grassroots strategies long after the meeting had officially run its course.

TIME AND PUNISHMENT The inside story of the East Cleveland 3, free again, 20 years after being wrongfully convicted of murder

“After what was done to me, I kinda lost that thrill,” he says of the game.

What was done to Johnson was also done to his friends, Derrick Wheatt and Laurese Glover.

Friends for decades, they’re joined forever as a single entity: the East Cleveland 3. They’ve returned to Strathmore today, rewinding their lives back to February 1995. Since their release from prison last year, they say, each of them has avoided this place, the intersection of Strathmore and Manhattan. They didn’t shoot that guy; they should have never been caught up in that whole mess.

“This is where the nightmare begins,” Johnson says, while cars breeze toward the stop sign under the bridge. As the three of them point out the precise location of the shooting, they can’t help but comment on how much the street has changed since then. Wheatt, half-joking in a quiet voice, compares the neighborhood to what you might see on The Walking Dead, a post-apocalyptic “after” picture of what happens to a place when everything falls apart.

A lot of things fell apart in East Cleveland over the years, as gun violence became a motif in a city struggling with drugs and poverty and a declining population. The sound of gunfire on a Friday night back then could be anything: a gang dispute, a crack deal gone south, the sort of high-wattage domestic disturbance that might explode behind the walls of any

home in this country.

But why was a man named Clifton Hudson shot and killed here on Feb. 10, 1995? It’s difficult to say. Long-hidden evidence flashes scant light on potential leads; the investigation into his murder stopped short of the truth.

Rather, three teenagers were arrested and later convicted. A story was crafted on the word of a nerve-wracked 14-year-old walking home from school that day, and the records behind the investigation were kept from the public view for many years. Those teenagers became the East Cleveland 3 and, many years later, when the East Cleveland 3 were men, once everything got sorted out, their journey became a symbol for the rot within our criminal justice system.

“It was crazy how it happened,” Glover says now. “Throughout the years, I always said it was written.

It was meant to happen to us.”

“We was just some carefree kids growing up in the inner-city,” Wheatt says.

“Wrong place, wrong time,” Johnson adds, shaking his head.

The sun was setting early on the evening of Feb. 10, 1995, and Glover was cruising with his friends. He had just bought a ’79 Blazer, a honking beast of American metal. In the mid-90s, you couldn’t pull out of your driveway without seeing one rolling through the East Cleveland

neighborhood. Glover was happy.

Being all of 16 at the time, a sophomore at Shaw High School out with his buddies, what else was there to do besides joyride? “People were jumping in and out all day,” Wheatt recalls.

“At the end of the day, it ended up just being us three,” Glover adds, motioning to Wheatt and Johnson. Those two had been friends forever. Grew up a few houses from each other over on Ardenall. Glover rounded out the trio as they careened into their teenage years.

Here’s what’s happening: Wheatt’s riding shotgun, and Johnson’s in the back of the two-door Blazer. They’re trucking north along Strathmore.

Home is just around the corner.

Clifton Hudson, 19, is walking on the sidewalk. He’d been through a hell of a week so far. Just the day before, in fact, he was telling his brother Derek that some guys had pulled a gun on him. Derek told him that guys always think they’re tough when they’ve got a gun on their side.

And he’d know. Earlier that week, according to police records, some other guys had pulled a gun on Derek, shooting several times from within a gray Chevy Cavalier near East 128th. He fled to a nearby convenience store, safe but concerned. Something was up.

On Feb. 10, as evening slid into view, Hudson had just gotten to the neighborhood after cashing a check nearby. According to witnesses, he looked like he was waiting for someone on Strathmore. Glover and

his friends are driving up the street.

Another man is walking out of the parking lot of the East Cleveland Post Office, a ragged glut of asphalt that spills onto Strathmore.

Like every other time, Glover stopped at the stop sign attached to the railroad bridge overhead, just short of the intersection with Manhattan Avenue.

And then: gunshots, abrupt and rapid.

Glover hit the gas and took a hard right onto Manhattan. The weird thing about this intersection, you see, is that the stop sign on Strathmore is set way back from Manhattan; you’ve pretty much got to stop again once you pass under the bridge. Glover didn’t even bother. (“I almost hit a car and everything,” he says.) He was frightened, and he tore off into the night with his friends, leaving a few bewildered observers with the vision of a black Chevy Blazer fleeing the scene of a shooting.

Back on Strathmore, Hudson lay dying in front of a blue house after a few bullets pierced his left arm and chest. A man was seen rifling through Hudson’s pockets before running off and dashing up the hill onto the railroad tracks. (Cash amounting to $166.51 was found in Hudson’s jacket later on.)

Hudson was declared dead at 6:28 p.m. Within hours, police officers arrested three suspects.

attorneys would later call this a classic case of tunnel vision.

East Cleveland detectives pounded the pavement in the days after the murder, gathering witness reports from about a dozen people of all ages. Some of them saw the shooter, some didn’t, but all offered worthwhile perspectives.

Everyone involved was confident that this thing would be wrapped up soon: The three kids figured they’d be home in no time — they had never even heard of this guy Clifton Hudson, after all. For their part, the cops knew that they had people in custody for a murder on their streets. Done deal.

Looking back, Glover says, “If a dude would have come in with a gun and told them, ‘I did it,’ they probably would have been like, ‘Nah, we got three people.’”

The framing of the events surrounding the murder began an hour after Hudson died, when a 14-year-old girl named Tamika Harris was brought down to the East Cleveland Police Department to answer questions about what happened. Officers had encountered her at the scene, where she explained that she was walking home from school — down Manhattan, toward Strathmore — when she heard gunshots. Her first statement sets the stage for the next 20 years.

“I had just come near the bridge, and we heard three (3) gunshots.

Both of us ran to the bridge. [My friend, Monique,] turned and ran away. I looked around the bridge and saw this guy get out of a black 4 x 4 with tinted windows. He pulled the gun from his pants and shot three (3) more times. I saw

this guy standing on the street and he fell to the ground. The guy that he was shooting at was in front of the blue house where he was found on the ground. After the last shots, I heard the guy yell for help. After the guy finished shooting he looked around he had this black gun in his hands and while he was running he took the gun and tucked it under his jacket.

When he got to Manhattan he was still looking around, I saw him and hid flat against the bridge.

Before the guy ran towards the bridge whoever was driving the 4 x 4 pulled off and turned right onto Manhattan. He almost crashed into another car coming off Manhattan.

They drove fast towards Shaw and stopped, the guy that did the shooting ran to the 4 x 4 got inside and it turned left on Shaw headed towards Hayden.”

When asked if she could identify the man who fired the gun, Harris replied, “No. I didn’t see his face that clear.”

Overnight, police searched and soon found a black Chevy Blazer parked at the bottom of Glover’s driveway. After waiting around to make contact with the owner, police saw Glover and Wheatt get into the car. They arrested the two immediately. Johnson was arrested at his home; his mother joined him en route to the police station.

The 14-year-old girl was seated opposite detectives once again the next day, being urged to recount what would become the prevailing narrative of the crime. In short order, she identified Johnson as the shooter. Presented with photos of three men – Johnson, Glover, Wheatt, all in custody by then –

The die was cast.

Between that point and the January 1996 trial, detectives continued to build supplemental reports, interviewing multiple neighbors whose words would not be heard publicly until almost 20 years later. Defense attorneys themselves weren’t made aware of the extent of the investigation, limited as it was, and so they presented only two witnesses who did indeed insist that the shooter was not one of the three men facing charges. They never had a shot at mounting a full-bodied defense, though.

The county prosecutor ran with Harris’ storyline, using gunshot residue found on Wheatt’s hands and on a glove inside Johnson’s jacket as the basis for a “twoshooter theory.” Assistant County Prosecutor Michael Horn painted a picture of Wheatt shooting from the front passenger seat before handing the gun back to Johnson, who exited the vehicle to approach and kill Hudson (and then chased the Blazer onto Manhattan and jumped back in).

As the trial wore on over a few days, however, Harris changed her story again and testified that she never saw the shooter emerge from the vehicle. Rather, she saw a man walk around the back of the vehicle — from the post office parking lot — and confront the victim before pulling a gun and shooting him.

“I remember like it was yesterday,” Glover says. “Tamika testified on a Friday. And I remember going home that Friday, and for everybody that wasn’t there at trial I’m telling them we got this. We’ve beaten it. Because that’s their only witness — and all the stuff she was up there saying, like, ‘I made a mistake. I corrected it.’

It was just too much. It was bad.

I just knew there was no way we could get convicted after that.”

The following week they were each convicted on murder charges.

They declined to plead guilty for lesser sentences. As their trial attorneys urged a plea deal, the reality of how deep this hole might go was only just beginning to settle in.

“I started getting a little scared then,” Glover says. “Like, I’m 17, going away for murder — for life.”

Glover was sentenced to 15 years to life in prison. Johnson and

Wheatt picked up 18 years to life.

As part of the sentence, Johnson, the one who allegedly finished the murder, was ordered to be placed in solitary confinement every year on Feb. 10, the day Clifton Hudson died.

Time marched on, hand in hand with the sedate pacing of the appeals process. The East Cleveland 3 kept busy with paperwork and legal study.

In 1998, then-Mayor Emmanuel Onunwor of East Cleveland was raising vocal doubts about the convictions of Johnson, Wheatt and Glover. He pushed the police department and rooted around for information that might fill some of the obvious gaps in the crime narrative. There had to be more than seven pages in the case.

That’s when the county tossed its weight back into the arena, the reputation of its prosecuting attorneys hinging on a dubious case that was still stirring protest in the neighborhood.

First, Assistant County Prosecutor Carmen Marino (later to serve as county prosecutor) sent a letter to Sgt. Terrence Dunn of the East Cleveland Police Department in June 1998.

“It has come to our attention that the City of East Cleveland intends to release the police file of the investigation of the above captioned case. It is our position that said police file and its contents are not public record, thus any release could constitute a willful violation of the law.

“You are hereby directed to turn over to the Cuyahoga County Prosecutor’s Office Investigator presenting this letter the entire department file concerning the above captioned matter, including, but not limited to, all items of the file contained within the Detective Bureau as well as any and all copies which exist elsewhere, including, but not limited to, the Records Room of East Cleveland.

Said file and all contents are to be handed over to Cuyahoga County Prosecutor’s Office Investigators forthwith.”

What happened in the wake of that letter is hazy, as most — if not all — of the documents contained within the police report did remain in East Cleveland over the years. Had the police department

complied, the documents might have been buried in the back room of the prosecutor’s office. The truth might have been shredded immediately.

Still, pressure was exerted, and the police report disappeared.

But people in the neighborhood continued to talk, and by the time the Ohio Innocence Project came onboard the case in 2006, a wave of engaged legal expertise was coming down on the East Cleveland Police Department. There had to be more to the story, after all these years.

Carrie Wood, a former staff attorney for the Ohio Innocence Project, who helped shepherd this case to fruition, says that whatever investigation did take place in 1995 was marked with “tunnel vision,” a common trait in cases of wrongful conviction. “You jump to a conclusion about Eugene, Laurese and Derrick, and you ignore the evidence that doesn’t fit with your theory of the case,” she says. “When you ignore evidence of who the true perpetrator was and you ignore evidence of what happened to that victim, you do a disservice to the victim as well as to the people you wrongfully convicted.”

There were holes in the case, of course; the guys never stopped proclaiming their innocence, and evidence existed somewhere to back them up. The truth was missing from the official story.

Johnson remembers the Innocence Project attorneys telling him, look, if you’ve got a murder with three convictions on the table, there’s going to be more than seven pages in that report. As litigation continued over the legitimacy of the state’s gunshot residue testing protocol — a process later deemed unreliable — the defense of the East Cleveland 3 turned toward the void, that gulf between the prosecution’s story and what really went down on Strathmore Avenue on Feb. 10, 1995.

“We all knew, once that came in, that’s when I knew it was over with,” Johnson says. “It could have been resolved 20 years ago.”

— Eugene Johnson transcripts and appeals records, the documents they’ve brought today include a trove of witness statements and facts from early 1995. They’ve only been out of prison for a year at this point, and the papers they have in their possession today could have stopped this nightmare before it began. It’s an alarming notion.

“The first few pages was the only thing I had ever seen before – like the first five or six pages on top,” Glover says, describing the portion of the police report that the guys had access to for most of their time in prison.

After continuous public records requests via the Ohio Innocence Project — including particular pressure applied by appearing in-person at the East Cleveland Police Department — the full police report was delivered to the attorneys and their clients. Just like that, after all those years, the paperwork was discovered.

Contained within the nearly 70-page report were additional witnesses with alternate suspect theories and information that could support a specific motive for the murder of Clifton Hudson.

“It didn’t have to go this far,” Johnson says. “They took our story and deliberately put us in that situation, planted evidence to make it seem like we done the crime. They hid the truth for 20 years that brought all the pieces together. It didn’t have to go this far. It could have been resolved 20 years ago. We got apprehended, arrested, questioned, and, even when we was going on trial, I believe that they knew.” Of course, he and his friends and family were certain of that during the first trial. But now, equipped with raw evidence, his deep voice sometimes gives way to astonishment.

On Feb. 12, 1995, two days after the murder, Monica Salters, a resident of Strathmore Avenue, called the East Cleveland Police Department. She said her sons, Dante and Gary Petty, saw the shooting go down. Dante was 10.

Gary was 8.

She told detectives — and the children later explained themselves — that Dante was walking north on Strathmore, coming toward the scene of the crime from the opposite direction that Tamika Harris had been walking. Dante

was behind the black Blazer. He saw a man walk out of the post office parking lot, approach Clifton Hudson and shoot him.

At the same time, Wheatt’s father was working the neighborhood in an attempt to bring more witnesses into the open. He was showing up at the department almost daily, insisting to the chief that there was more to the story. In the police report, he appears frequently in most conversations with other witnesses and neighbors, piecing together an investigation of his own. Wheatt’s father insisted that the real shooter had fled up the hill and onto the railroad tracks nearby.

Several witnesses who spoke with police mentioned seeing a man run in that direction; the visual is repeated in multiple interviews with detectives.

In the weeks and months that unfolded, Wheatt’s father had rounded up additional witnesses who backed up the Petty boy’s claims about the shooter’s approach. He had identified an alternate suspect, whom detectives didn’t interview until May. (The other suspect, a post office employee and neighbor, denied any involvement in the murder.)

Wheatt’s father died in 2008.

Through everything, though, police relied on the young girl they met first at the crime scene: Tamika Harris.

In 2004, she recanted her testimony and insisted she believed in Johnson’s innocence.

“I was 14 years old. I told the police what they wanted to hear,” she said in a hearing that temporarily freed Johnson and granted him a new trial. It was a revelatory moment. “I am older now and realize that I was mistaken.”

Glover and Wheatt remained in prison during this time from 2004 to 2005. (“I used to think all along that Tamika was never there,” Glover says.) Wheatt remembers watching Johnson’s court appearance on the news, eyes gripping the screen in disbelief and hope.

FEATURE June 2005. This was before the Innocence Project had joined forces with the men. He had been out for nine months — slowly readjusting to life in the real world, much like he and his friends have been doing now this past year — before his name landed on an arrest warrant.

The recantation wasn’t enough, the court ruled; there was still the matter of the gunshot residue found on a glove in his jacket pocket.

“That messed me up,” Johnson says. “I ended up in a mental hospital in 2005. To get a taste of freedom and get it snatched away ... I think it took me like four years to just come mentally — come to grips back to myself.”

Once again, the journey restarted for him. He reunited via the postal service with Wheatt and Glover in separate penitentiaries.

The journey brought the Ohio Innocence Project to their cause in 2006 and, later, the journey forced those long-lost documents into the light.

Trudging along at a glacial

pace, with nary a moment for disillusion, the East Cleveland 3 found themselves in Russo’s courtroom again in 2015, when she overturned the original convictions of all three men, this time with the compelling information from the police reports on the record.

From there, it took another court struggle to garner a new trial one year later — a necessary step in completely clearing their names.

(The men remained out of prison during that last year, essentially on house arrest.)

As recently as January 2016, County Prosecutor Timothy McGinty’s office was pushing back against the idea of a new trial, opposing the idea and asserting that gunshot residue was still a slam dunk. Never mind Harris’ recantation, the state argued, there was physical evidence to confront.

As Innocence Project attorney Brian Howe pointed out during a January 2016 hearing for a new trial, “The state can’t put a time stamp on the gunshot residue. Doesn’t know if it was

four months old or if it came from contamination at the police department.”

Aug. 15, 2016, was the first day of the new trial for the three men. They’d waited eons for this opportunity, and the moment whizzed by almost as soon as it arrived. Under McGinty, the state dismissed the murder charges against Johnson, Wheatt and Glover. It was all over.

The new trial flew by in a flurry of emotions. The men entered quiet and reserved and soon flashed brilliant smiles before the press scrum, arms wrapped around friends and family. They were each wearing gold necklaces emblazoned with their likenesses and the name that will never leave: East Cleveland 3. (Johnson’s was tucked beneath a checkered olivegreen suit.) Their lives resumed, all at once.

“This isn’t about one side or another winning, this is about the Constitution winning, this is about justice winning,” Russo said. “You are free to go.”

(To date, the East Cleveland Police Department has not identified another suspect in the murder of Clifton Hudon. No one else has been charged. The police department did not respond to requests for comment.)

The profundity of the moment recalls Ricky Jackson and Wiley Bridgeman’s release from prison two years ago in Cuyahoga County.

Jackson lays claim to the longest case of wrongful incarceration in U.S. history. He was in prison for 39 years for a 1975 murder.

“He’s one of my heroes,” Johnson says. “He’s real humble.”

Johnson and his friends have spoken here and there to the press and to law students at Case Western Reserve University. They say that that’s sort of a standard question: whether or not they’re bitter about what happened. The East Cleveland 3 say that you can’t be. They’re looking forward to what’s next.

FEATURE that follows exoneration been a topic of mainstream reporting and conversation. The East Cleveland 3 claim the 1,864th, 1,865th, and 1,866th names in the National Registry of Exonerations, a long list of men and women who’ve endured a brutal and unnecessary spin through the cogs of a criminal justice system.

“Now that the case is over with, that still hasn’t sunk in that we’re free,” Glover says. “But at the same time it still feels like parole because the whole job search and all of that; it feels like we’re on parole. I was always hearing before we got out that it was hard for people to get jobs — especially like for people who went to school, it’s still hard for them to get a job. But this is just — I just always thought when this day came, once we get free and get our name cleared, I just knew it would be more opportunity for me than what it is.

It ain’t like that. It’s a struggle. It’s a struggle.

“I’d rather struggle out here than go through that again.”

They’re working to land jobs, massaging helpful connections via their attorneys. But no dice so far. Someone in the mayor’s office suggested Glover attend one of those community meetings for people seeking help with their resume. “A resume for what?” he asks rhetorically.

In late September, Johnson, Wheatt and Glover met with a job services rep at the East Cleveland Public Library to discuss possible employment opportunities in the area. The meeting was arranged by Russo, in fact. Glover said they’ll hear back soon on the next steps in that process.

They set up a GoFundMe page — though it floundered — and they and their families have toyed with various avenues for outreach, hoping to get their story in the spotlight. There are lessons to be learned. They’ve even considered setting up a Facebook page. (“That social media is so big now,” Glover says. “Like, everybody — most likely when you see them looking at their phone, that’s what they’re

looking at.”)

Furthermore, it’s unclear what governmental compensation may be coming their way. Ricky Jackson, for instance, received $1 million in 2015 for his 39 years behind bars. The state has not conceded that the East Cleveland 3 were wrongfully convicted and incarcerated. Charges have been dropped, yes, but the state has yet to pave the way for recognition and compensation by declaring them exonerated.

“It’s painful for them for the state to continue in that tunnel vision and not to say, listen we screwed up,” says Carrie Wood, who has since moved on to the state’s public defender office from the Ohio Innocence Project. “We stole your life from you and we apologize for that. It’s amazing the denial of that to someone and what it does to them and the impact that it has. And then all of the things that flow — the job and the financial compensation and all the things that help a person start to heal. The denial of that, which

stems from the state’s inability to say that it made a mistake, is truly huge.”

In other news, there’s plenty to celebrate. Wheatt got married.

Johnson is crafting a book, culled from hundreds of pages he wrote during his time in prison. His goal to is tell his story, his friends’ story, and to explain to the public how things like this happen to people.

This case, a disarmingly thorough house of cards, was not a mistake; regardless, it certainly never should have happened. But here they are.

“To get wrongfully convicted together, to go through the nightmare together, and to get released together,” Johnson says.

“That’s the beautiful thing in this whole picture: that strength, that’s what the East Cleveland 3 represents. That faith.”

Release Party An ambient/drone artist who relocated to Cleveland two years ago from Chicago, Sean Kase has released digital material since the fall of 2013. He’s just issued his first vinyl release, Unblurred Variants, limited to 100 copies.

Darius Steward Talk and Demo Throughout the summer, local artist Darius Steward was busy working on a new series of prints as one of Zygote Press’ artists in residence. With an MFA from the University of Delaware and a BFA from the Cleveland Institute of Art, Steward has exhibited his work at the Cleveland Clinic, Maria Neil Art Project, the former William Busta Gallery and others. At Zygote Press, Steward transferred his process of depicting socially conscious subject matter from paintings to printmaking. He will discuss his new work today during

Doomed: The Untold Story of Roger Corman’s The Fantastic Four Every Tuesday evening from now through Nov. 22, Cleveland Cinemas offers movie fans a chance to see a new documentary feature at its Capitol Theatre, where the films will screen for a one-night-only engagement.

The series arrives on the heels of the Capitol Selects series, which began this summer and devoted one screen at the theater in Gordon Square to week-long engagements of foreign, classic and documentary films.

ART MONSTERS, MEANING AND MARRIAGE Laura and Gary Dunn tackle environmental issues through art

By Josh Usmani LIFELONG RESIDENTS OF Cleveland, artists Laura and Gary Dumm have been married for more than 40 years. Gary, an illustrator, and Laura, a painter, also have been collaborating for many years.

Their latest joint effort, a collection of new paintings, opens with a reception this Friday, Oct. 7, from 7 to 9 p.m. in BAYarts’ Diane Boldman Education Gallery.

The exhibition, Here There Be Monsters, takes its title from ancient maps. During the Middle Ages, cartographers imprinted words of warning on unexplored areas of the map, like “Here there be monsters; dragons be here.” The title also refers to the exhibition’s juxtaposition of classic Hollywood monster movie characters with current environmental issues.

“Iconic movie monsters, who were often the by-products of corporate greed and human egotism manipulating nature to spawn our own annihilation, are used to present the consequences of pollution, climate change, genetic engineering, for-profit destruction of animal habitats and extinctions,” the artists explain in a catalog for the event. “We are mutating into the monsters devouring our world.”

The Dumms designed the show to be engaging for viewers of all ages. “Young children can relate to them not just because of the monsters, but because they know about the environment and they care about these issues,” Laura says. “Adults are drawn to them because they remember the monsters from their childhood and are concerned about what kind of future their children will have on Mother Earth.”

Together, Gary and Laura create work that captures the best of each one’s individual talents, combining elements of Pop Art and Surrealism.

Both Gary and Laura have had active careers in commercial art — Gary illustrating comics and Laura working as a graphic designer.

Although both have been active in the local art community, these gallery exhibitions are relatively new for the couple.

Gary has been drawing (mainly

comics) for about half a century. His mother introduced him to comics to help him learn to read, and he still loves the juxtaposition of words and pictures. In 1976, Gary met legendary local comics writer Harvey Pekar, and the two collaborated for 30 years on projects like American Splendor.

Dumm also created promotional material for the 2003 film of the same name.

Laura became a freelance graphic artist/illustrator in 1986, after working for various publications.

She also works as a colorist on Gary’s cartoon and comics projects. STAGE THREE’S (AWKWARD) COMPANY A Jewish master and his two emancipated slaves confront their new identities in The Whipping Man IF YOU ASK MOST PEOPLE WHO the first African-American of the Jewish faith was, they might say uber-entertainer Sammy Davis Jr. And while “The Candyman” did indeed convert to Judaism in the late 1950s, he probably was preceded in that category by many others.

This thought, and many others, are triggered by The Whipping Man

by Matthew Lopez, now at None Too Fragile Theater. The fact that a gay Hispanic man has written a play about two recently emancipated black slaves and their Jewish master is remarkable enough. But the fact that the script touches on issues that are in the headlines at this very moment — such as how well AfricanAmericans have merged into society 150 years later — is extraordinary.

With young black men and women being shot and otherwise killed by police in seemingly indefensible situations, one wonders how far we’ve actually come in that process of emancipation.

Set in Richmond, Virginia, in 1865, the play begins with an injured Confederate soldier collapsing on his home’s front porch. At first the rebel is accosted by Simon, the old family slave who has been left to guard the property. But then Simon recognizes the soldier as Caleb DeLeon, the son of the homestead’s owners who have fled the chaos and carnage of the war. Trouble is, Caleb has a festering wound in his leg that needs to be attended to very soon.

As Caleb and Simon review their less than attractive options (cut off the leg or die soon in misery), another household slave, John, shows up with booty he’s filched from nearby abandoned houses. Turns out the 20-something John had been raised side-by-side with Caleb from childhood, one as an owner and one as property. And after some convincing, John agrees to assist in the amputation, which is conducted with just enough verisimilitude before a blackout to give everyone in the audience the shivering fits.

That’s a powerful opening for a play, and it sets a high bar which Lopez’ somewhat convoluted script

never quite surmounts. Instead, we gradually learn that Simon and John were brought into the Jewish faith by the DeLeon family, and they each have a different but strong connection to being Jewish. Caleb seems much less interested in the trappings of the religion, since the horrors of war have burned his hope down to a small bit of gristle.

The fascinating aspect of The Whipping Man is how these three men have been thrown into an entirely different world, and none knows exactly how and where they fit. As Caleb slowly recovers from the

brutal operation, lying on a mattress on the floor, he often reverts back to ordering Simon and John around until they remind him they are now free men. In one instance, Caleb is startled to see John next to him, not recognizing him in his delirium of pain even when John says who he is.

It isn’t until John says, “It’s Nigger John” that Caleb finally remembers and relaxes.

In his best portrayal yet at None Too Fragile, Brian Kenneth Armour crafts an interesting character as John, relishing his newfound freedom and using it to improve his wardrobe and possessions through burglary, while still paying homage to the rituals of his religion.

suffers with excruciating style and makes clear the confusion that now floods this man’s mind. And his flashback scene at the start of the second act, reading a compassionate love note he sent to his beloved Sarah from the battlefield, is compelling. And it includes some of the poetic language that often lifts the work onto a different level as he remembers “… the last night we spent together, willing the night to fight back the day.”

Playwright Lopez places this trio in a volatile time, when President Lincoln has just been assassinated and also at the time of Passover, when the story of the passage from slavery to freedom is told. And indeed, John and Simon cobble together a Passover Seder in the second act, complete with hardtack for matzo and horsemeat from Caleb’s dead steed.

By drawing the similarities between the ex-slaves and the wealthy Jewish family that owned them, the play opens an interesting door on race relations.

MOVIES TROUBLED TIMES Birth of a Nation depicts slavery’s cruelty in graphic detail

By Jeff Niesel AT THE CONCLUSION OF BIRTH of a Nation, the riveting new drama about Nat Turner, an AfricanAmerican slave who met a tragic end after he led an 1831 slave rebellion, we learn that Turner’s body was flayed, beheaded and quartered in the wake of his hanging. His enemies believed that by physically destroying Nat’s body beyond recognition, his act of rebellion would be erased from history.

That certainly didn’t happen.

Now part of the curriculum in history classes at most American schools, Turner’s story has been anything but forgotten. In his Sundance hit, director Nate Parker captures the drama of not only the violent uprising but also its horrific aftermath, which left numerous people dead and created a fear that more uprisings would follow. The movie opens areawide on Friday.

Parker tells Nat’s story from the beginning. We see his birth as well as the visions he had. In many of the visions, he imagines communicating with African ancestors. When young Nat (Tony Espinosa) learns to read at an early age, his owner’s God-loving wife (Penelope Ann Miller) promises to teach him how to read the Bible, which she refers to as the greatest book on earth.

Soon, Nat has memorized entire passages and starts giving inspiring readings. His ability to read turns him into a regional sensation.

Eventually, his owner Sam Turner

(Armie Hammer) realizes he can charge fellow slaver owners a fee and bring Nat to preach to them with the intention of making the slaves more complacent. Desperate to keep his plantation from fiscal ruin, he takes Nat from plantation to plantation and starts cashing in.

The ruse initially works but soon Nat becomes so disturbed by the horrific living conditions and treatment of the slaves that he starts reciting some of the Bible’s more revolutionary passages and begins plotting a rebellion with the help of some fellow slaves.

Throughout the movie, we see slaves being abused both verbally and physically. In one scene, a group of men led by thuggish slave hunter Raymond Cobb (Jackie Earle Haley)

rape Nat’s wife Cherry (Aja Naomi King). In another, an owner chips out a slave’s teeth with an anvil when he refuses to eat, putting a funnel to his mouth and pouring some kind of slop into his mouth once the teeth are removed. Not for the faint of heart, the film doesn’t shy away from the grisly details of life on the plantations in the 19th century.

After the movie made a big splash at Sundance, Fox Searchlight spent a record amount of money to acquire its rights and began a big Oscar push when details surfaced regarding Parker’s trial for a rape he allegedly committed some 15 years ago. Needless to say, the scandal has potentially derailed the film’s Oscar chances and complicated the movie, with its rape scene, as well. Some

groups have protested its release and called for a boycott.

Real-life scandal aside, the movie features some compelling performances. Parker plays Nat as the complex man he was — someone who preached peace but brought violent retribution to his owner and many other white owners as he led the rebellion. And King gives a breakout performance as Cherry, a woman who’s been so badly abused that she barely speaks when she arrives on Nat’s plantation.

While some of the movie’s artier impulses regarding Nat’s visions seem rather forced, they do coincide with the fact that Nat reportedly often thought God spoke to him and took things such as a solar eclipse as messages from God.

SPOTLIGHT: CHAGRIN DOCUMENTARY FILM FESTIVAL NOW IN ITS SEVENTH YEAR, THE CHAGRIN Documentary Film Festival will screen 76 films from 24 countries during the annual event that takes place Oct. 5 to 9 at venues in and around Chagrin Falls.

On Wednesday, Oct. 5, the festival launches with a full day of screenings that culminate with the 7 p.m. screening of Chasing the Wind, a documentary about Carl O’Callaghan, a oncehomeless man who became a horseracing icon after winning the Dubai World Cup. It screens at the Chagrin Valley Little Theatre. Full days of screenings follow on Oct. 6, 7 and 8.

The festival then closes at 6:30 p.m. on Sunday, Oct. 9, at the Chagrin Valley Little Theatre with

a screening of Presenting Princess Shaw, a film about Samantha Montgomery, a woman who cares for the elderly in one of New Orleans’ toughest neighborhoods by day, and by night writes and sings her own songs as Princess Shaw on her YouTube channel. An awards ceremony follows the screening.

Festival organizers have grouped the movies in various categories, including one devoted to emerging filmmakers. “[The emerging filmmaker] category reflects our commitment to giving a voice to the firsttime filmmaker,” says festival director Mary Ann Ponce, who founded the festival in 2010 to honor her son, David. “It has been our founding mission

to empower talented filmmakers. We are proud to share their stories with our enthusiastic and engaged audience.”

Other categories include Environmental Films, Feature Documentaries, Human Spirit, the International Documentary, Social Awareness Documentaries, Local Interest, Student Films, Special Presentations and Short Documentaries.

Fevered Dreams Productions, a non- profit organization dedicated to “empowering filmmakers to tell their stories,” organizes the festival and will give out cash awards totaling $15,000 to the winning directors.

EAT Woodstock joins the Northeast Ohio barbecue parade with mixed results

By Douglas Trattner THE RECENT ARRIVAL OF places like Mabel’s BBQ and Proper Pig has provided Cleveland diners not only with the boundless delights of expertly smoked meats; it has also served as a sort of master class in the art and craft of barbecue itself. For many of us who grew up eating — and enjoying — grilled and sauced ribs, chicken and the like, those first tastes of peppery brisket, meaty dryrubbed pork ribs and snappy sausage were honest to goodness revelations.

Now that we know how it can and should be done, we are better equipped to evaluate newcomers like Woodstock BBQ. Based on these standards, the new Lakewood joint has some growing to do. While we love almost everything about this casual eatery, the barbecue is a bit of a roller coaster ride, punctuated by highs, lows and so-sos.

Let’s start high, shall we? Our group almost skipped the chicken wings ($9), what with a dance card quickly filling up with meaty mains, not to mention cold beer. Wings are

pickles and onions.

Woodstock’s brisket also approaches greatness, but falls slightly short of the mark. Thicksliced and sporting a nice dark bark, the meat looks promising from the jump (save for the unwelcome drizzle of sauce across the top). Soft and supple in the hand, with a jiggly little cap of fat, the beef has the feel of competition barbecue. A nice peppery rub gives way to deeply flavorful, tender, smoky meat. Overcooking, however, has wrung too much moisture from the brisket. Get it in a sandwich ($8) or on a platter ($11) with cornbread, pickles and onions.

When our order of spareribs ($11 half, $20 whole) lands on the table, we instantly know that something is very wrong. The rectangle of meat is perfectly flat across the top, with no indication that bones even exist underneath. A dull, pasty rub covers the entire surface. Predictably, the pork is mushy not tender, grey, dry and bland, as though it was pre-baked or reheated. I’m hopeful that on my

everywhere, we grumbled. But then they came out, all copper-colored and glistening with a spice-speckled rub. Smoked, not fried, the wings are unencumbered by a mantle of breading. In its place is skin and meat, smoky, juicy, habit-forming meat. Though great on their own, they benefit from an occasional dunk in one of the three house sauces.

Those sauces include a thick, sweet, tomato-based Kansas City-style, a thinner, spicier, more multipurpose tonic, and an unconventional but interesting jerk-style sauce.

Woodstock’s pulled pork is better than most in that it is pork that is smoked, pulled and served largely unadorned so that diners can savor the smoky, porky goodness. It’s on the lean side, approaching dry, but it’s tender and flavorful, garnished with only a drizzle of sauce. This is not sad, sullen crock-pot pulled pork. Get it in a sandwich ($6) or on a platter ($9) with cornbread,

next visit I’ll get to sample them straight out of the smoker.

Unlike many BBQ joints, this one does not sell a combination platter, a handy vehicle for diners eager to sample more than one smoked meat product. I’d also love to see the promised turkey breast and sausages begin to make appearances on the menu.

If you come with a crowd, order the loaded nachos ($9), a hubcapsized platter layered with chips, cheese sauce, pulled pork, olives, tomatoes, jalapenos, and barbecue sauce. Woodstock also prepares an admirable version of stuffed jalapenos ($5), affectionately called Atomic Buffalo Turds within the barbecue community. Cream cheesefilled peppers are topped with bacon and smoked until they take on the pleasant whiff of campfire.

Also on the small, lined, handwritten (but photocopied) menu is a Brunswick stew ($5), a great

way to utilize leftover barbecue.

Like everything on the roster at Woodstock, sides such as cornbread muffins, baked beans, collard greens and mac and cheese are more than reasonably priced at $1 to $3.

Owner Robert Togliatti purchased the 100-year-old building, formerly Trio’s Bar, and poured a ton of his time, money and passion into the renovation project. What came out the other end is an attractive, casual and welcoming neighborhood saloon with cheerful service. Diners enjoy a great draft beer list, wonderful bourbons and even a cocktail list. A bright and roomy barroom connects

with a rustic dining room, complete with the requisite reclaimed wood paneling, skull and antlers, and cigar store Indian. A facade of accordionstyle windows opens up and folds away, uniting the sidewalk patio to the interior.

If diners approach Woodstock more as a bar serving barbecue and less as a barbecue restaurant with a bar, I think expectations will fully, and satisfactorily, align with experiences.

STRANGELY ENOUGH, CLEVELAND just might be the clambake capital of the world. What we take for granted as an autumnal rite is pretty much neglected in other Midwestern cities.

SOMETIME IN OCTOBER, Mohamed Sadek finally will unveil Urban Kitchen (9751 Chester Ave., 216-264-0124, urban-kitchen. letseat.at) in the quickly developing Upper Chester neighborhood. This restaurant is on the ground floor of the Innova complex, a six-story, 175-unit mixed use building with residential and retail. He’s been in the planning and building phase for about a year.

The health-focused restaurant will serve breakfast, lunch and dinner. In the morning, diners can order items like a spinach, feta and sun-dried tomato omelet, corned beef hash and eggs, or huevos rancheros topped with two eggs and salsa verde. At lunch, grilled Angus burgers join corned beef and sauerkraut-filled Reubens and Phillys with steak, peppers, mushrooms and onions.

The dinner menu is populated with items like grilled wild salmon with rice and vegetables, and grilled Certified Angus beef strip steaks with garlic mashed potatoes and seasonal vegetables.

Those American-style comfort food dishes will be supplemented by healthy Mediterranean items like hummus, baba, tabbouleh and fatoosh salad.

All items are moderately priced, Sadek says.

“About what you would spend at a place of lesser quality.”

The location, in the heart of the Cleveland Clinic campus, is what attracted Sadek to the venture.

“It’s a health corridor and it’s really nice to be able to join the Cleveland Clinic where there’s a lot of potential growth,” he says. “It’s a growing area. There is housing above and more planned. I would say it’s the next University Circle/ Case area.”

The building will be populated by residents, students, doctors and fellows, all of whom have the option to “come down, have a coffee, have a meal, and get some work done.”

The 1,000-square-foot, 60-seat eatery will have a modern decor when it opens before the end of this month.

RE:BAR ON EAST 9TH GETS A NEW START UNDER BAR VET JEFF ALLISON Re:bar opened this past spring, but you wouldn’t know it by asking around. The sleek little lounge in the Gateway District has barely registered with potential clientele, so ownership decided to bring in some new blood.

“It’s not even a reboot because it’s like it never even happened!” he says, animated as ever. “Because at the end of the day, nobody really knew the place ever existed.”

That’s a shame, because the overlooked lounge looks great.

The owners pillaged an industrial salvage yard to outfit the space, formerly Mr. Bill’s. Terrifyingly weighty steel drums serve as pendant lights over the bar (and customers’ heads). Other overhead fixtures are fabricated from giant metal mesh bins. The front windows are constructed from beefy steel columns and are raised and lowered via overhead rope winches. And then there’s the namesake rebar, in this case 3-inch-thick foot rails that ring the bar.

Allison says that his plan is to create a bar that is “of the industry, for the industry” — a place of quality that does not try to overcomplicate anything. Located in the heart of downtown, surrounded by office buildings, hotels and parking garages, Re:bar has access to a large number of people going this way and that.

“All those people who work downtown. Also four hotels within walking distance. Down here there’s mostly restaurants and sports bars.

This is not a sports bar environment, so they won’t feel out of place in their workplace attire. This is not a

cocktail bar, but a cool place to enjoy a cocktail in a nice atmosphere with good music where you don’t feel like an old person.”

THE LITERARY CAFE IN TREMONT SOLD TO OWNER OF D’AGNESE’S Ross Valenti, who you might know from D’Agnese’s and Cantine, has bought the Literary Cafe, which went up for sale earlier this year.

Plans are in the early stages so far, but Valenti tells the PD that he hopes to keep the spirit of the Tremont staple while adding some new touches. Those will include a new name — the Literary Tavern — a kitchen, and a patio in the future.

While he hasn’t decided what type of food that kitchen will serve, Valenti wants to keep the prices affordable to ensure that the new version of the Lit remains a neighborhood hangout. (Valenti also lives in Tremont.)

“I really want to have a cool neighborhood hangout I would want to go to, like the pre-gentrification Tremont, like the Hi and Dry. I have plans, but I’m sure it will take on a life of its own,” Valenti told the paper.

Work will begin in the coming weeks and Valenti hopes to have the joint open around Christmas.

FABLES OF THE DECONSTRUCTION Prog rockers Coheed and Cambria revisit their most recent album, The Color Before the Sun

By Jeff Niesel WHEN COHEED AND CAMBRIA came through town in 2014 to play a sold-out show at House of Blues in support of the reissue of 2003’s In Keeping Secrets of Silent Earth: 3, the band put on a helluva show.

The group assembled such an array of lights and sound equipment on the club’s relatively small stage, it looked like they were ready to play an arena. One of life’s greatest pleasures is witnessing an arena rock act in a small club: It’s the equivalent of watching your favorite Major League Baseball team play a spring training game. In that respect, Coheed didn’t disappoint; the two-hour show had an epic quality as the band played their album in its entirety and then returned for three encores.

The current tour, which includes an Oct. 9 date at the Agora, comes in the wake of the reissue of 2015’s The Color Before The Sun: Deconstructed. Even though the band won’t play that album in its entirety, the concert promises to be another epic affair.

The new 30-track reissue features the original album’s 10 songs both in the studio and in their early acoustic demo form, as well as two bonus demos that were never recorded in the studio.

The band dubbed the demos “Big Beige/4th St.” after singer Claudio Sanchez’s home, “The Big Beige” in upstate New York as well as his old apartment in Brooklyn, “4th St.” He wrote and documented the demos, which had previously been made available only to fans who purchased the band’s limited edition deluxe box set, which featured a 76page physical book, at each location.

“We’ve always been fans of hearing songs in their infant state, and we wanted to share that with the fans,” says guitarist Trevor Stever via phone from an Austin tour stop. “I’ve always looked into the other versions of songs from artists that I liked and sometimes even liked those versions better.

It’s like buying a copy of Fleetwood Mac’s Tusk that has different versions of the songs. Some are

slightly different and some are really different. Even bands from the early 2000s, I remember buying the deluxe versions that come out years later. We figured that we had the stuff, so why wait.”

The band didn’t start recording the album with the concept of ultimately releasing the demos. But in the wake of the album’s release, Stever says it made sense to revisit the sessions.

“We don’t know ahead of time that we’d release the sessions,” Stever says. “It just happens.

Sometimes, we just throw guitar parts back and forth. There have been acoustic demo that we’ve released. This album had a demo for every song. A lot of them had my guitar parts on them. They were sent before they had that, and we added stuff from a distance. That was sending back and forth with ideas. Those demos are what they ended up being.”

The album also includes seven live “bootleg” tracks pulled straight from the soundboard from various

dates on their recent U.S. headline tour, that expose a very raw look at the band.

“There’s a board mix of some of the songs from the first half of the tour,” says Stever. “We’re doing some other songs on this tour and mixing it up. People get an experience of that first leg, even if they didn’t catch it.”

The album represents the band’s first non-conceptual album, putting The Armory Wars, a seven-album science fiction saga that also resulted in a comic book empire, on hiatus.

“I think that was more of the way [singer-guitarist] Claudio [Sanchez] was writing,” says Stever.

“All of Coheed’s songs have personal messages and are about life experiences and they get combined or dictated first or second by the concept. There’s this combination, and Claudio was more comfortable having them be personal. MUSIC sleeve. Musically, it’s not a far stretch. It explores more of a pop side, but that pop side has always been there for sure. There are some of our longer and more intricate songs on it, but it leans on the pop side. That’s a part of the band too and who knows what the next album will be like, though I’m pretty positive The Armory Wars will come through again.”

Led by Sanchez, a guy who leads a double life as a graphic novelist, Coheed formed in Nyack, New York, in 1995. At that time, the band’s style of progressive metal was an underground novelty. But by the time of 2003’s In Keeping Secrets of Silent Earth: 3, the band’s heady concept album about a battle that takes place in outer space, progressive metal had become more popular, and Coheed’s album was a hit.

“It’s hard to explain [how In Keeping became popular],” says Stever. “There was a lot of work involved. Is there a bit of a ‘luck of the draw’ when it comes to people responding to your music? I think so. I think the band had something that was very different at the time.

Somehow, the stars aligned and people started to respond. They started to respond with [2002’s] The Second Stage Turbine Blade, but with In Keeping, they really started to come through and, as a band, we started to move toward what we would become. With [2005’s] Good Apollo, I’m Burning Star IV, Volume One: From Fear Through the Eyes

moody songs such as the title track and jittery, dynamic tunes like “Cuts Marked in the March of Men,” a song that sounds like a cross between Rush and the Mars Volta.

Applehead studio owners/operators Michael Birnbaum and Chris Bittner share production credits; they helped the band hone its distinctive sound. The band also recorded Good Apollo, I’m Burning Star IV, Volume One: From Fear Through the Eyes of Madness at the studio.

“Good Apollo has a lot of challenges, and I’m excited to go out and play that in its entirety at some point,” says Stever.

Compared to the conceptual and much more aggressive albums in its back catalog, The Color Before the Sun comes off as a departure.

“It’s a whole other side of the band,” Stever says the album. “And I think the band is as strong as it’s ever been. Each member brings an important element to the band.

We’ve been filming everything on the road, and we have a good friend with us doing filmography and videography. It really comes through that we’re so excited to be playing.”

He says the fact that members now have families makes it difficult to be on the road for long stretches.

“We all miss our families,” he says. “I have a 2-and-a-half-year-old and a baby on the way. It’s different eras on these children’s lives, but we still want to be with them. To be out here and gone for five weeks straight, it’s nice to be together and have each others’ backs. It can be tough. That’s why I think we’re the strongest ever. Musically, that comes through in the show. We play

of Madness, you can hear the band come into its own. But one thing that stuck out about In Keeping was that our record label had heard the demos and wrote us to say that they were blown away because they thought it was perfect for where we were going. They couldn’t wait to release it.”

In the wake of the album’s release, Columbia Records bought the rights to it and reissued it with wider distribution.

Recorded at Applehead Recording in Woodstock, New York, the album showcases the band’s musical prowess as it alternates between

a mixed batch of material and we play for a really long time. It’s nice.”

The band’s fervent fanbase helps sustain it too.

“We’ve been blessed with having great fans,” he says. “They get so involved full throttle. We’re lucky.

Coheed has been truly lucky to have those people who hang on every word and love everything. They’re just extreme and dive in. They make it a family experience too.”

LAGNIAPPE Water Seed taps into New Orleans heritage in sprawling new funk album

By Eric Sandy WATER SEED TYPICALLY KICKS out an album every six months or so; that didn’t happen with this latest album, We Are Stars, due out in the spring.

“We initially set out, ‘We just want to make a funk album. Nothing else,’” guitarist and bandleader Lou Hill says. They certainly landed on that result, but what took place between the beginning and the end was one of the most involved journeys in this band’s history. “With We Are Stars we wanted to figure out how to really capture the communication between the instruments. We wanted to really go old-school with it, and just perform.”

Based on the audio we’ve heard so far, it sounds like they’ve achieved that and then some. The past and the future merge here. This is a pretty hefty album, one comprising 14 cuts of 100-percent New Orleans funk. And after a stint in Atlanta — almost an “exile,” as others have described it — Hill and the band clearly wanted to get back to their NOLA roots.

“If you live in the city of New Orleans, you can’t escape music,” Hill says. “It gets on you, in you, and that

kind of thing. New Orleans is great because it has its own kind of sound.”

See, musicians in New Orleans tend to start young, and they get involved with a certain strand of DNA in the city’s music genome. Hill, for instance, started off with the sax around age 7.

By 12, he switched over to the drums (“I decided late, for a lot of people,” he says.) That’s when Hill began considering an eventual career.

The idea in New Orleans is to find

be all in, too.

Artistically, in a similar sense, there’s no isolation in style. Versatility is a virtue in the city, and the musicians who succeed know that — they understand how the lineage of their program and their city works.

Nor is there isolation in community; you really can’t be a loner and make it big as a musician in New Orleans. But that’s part of what makes the scene so rich.

And that’s the scene that Water Seed returns to after leaving town in the disastrous wake of Hurricane Katrina.

the program that jibes with your style — and then integrate your world into those teachings and that history.

“New Orleans musicians give you everything, you know,” Hill says.

“They give you every bit of who they are when they teach you. They don’t hold back.” With that comes a huge responsibility for the student.

one, it’s pretty clear that Hill and the band created an excellent addition to the New Orleans canon. There’s plenty of traditional funk slathered across this record, but there’s also a hint at something completely different, a sound that reels in disco grooves and jazz-futurist motifs. The songs here work well for both the headphone listener on the morning commute and the nimble-toed couple trying to get

down on the dance floor in Cleveland.

The album opens with a onetwo punch in “Open Sesame” and “Bollywood,” the latter following a simple funk riff that weaves through Eastern synths and percussion during the chorus. The album bears out the flow that Hill was talking about, with the songs being different enough in their shared traits that the experience comes off as a listening experience.

“When I talk to people, I say, ‘Look, it may not be our Purple Rain. But it needs to be our 1999,’” Hill says, referring to albums released by the late Prince. Hill and the band are huge fans, and that hybridization of rock ’n’ roll that Prince so famously molded is certainly on display throughout Water Seed’s stuff.

Additionally, realize that 1999 was sort of Prince’s breakout album, both the commercial leap forward and the point in his career where his voice became an entity that listeners and critics could point to. (“Everything changed after that album,” Hill says} Here’s Water Seed: New Orleans taught them, and now they’re running with everything they’ve learned. The point is to stay true to themselves.

“And that may be contrary to the state of music right now,” Hill says.

“But we’re rolling the dice.”

MUSIC DISSATISFACTION GUARANTEED Personal tragedy fueled All Dinosaurs’ latest album

ALL DINOSAURS SINGER-GUITARIST Bo Bowersmith and singer-guitarist Dave Gibian first became friends in high school and started playing music together. Looking back on it, they admit they didn’t really know what they were doing.

“We played in really crappy bands in high school and then after high school,” says Bowersmith one recent evening at Funhouse, the Cleveland bar that houses an upstairs practice space that the band uses.

Gibian, along with singer-bassist Gheramy Demery and drummer Mike Burrows, has crammed into a booth with Bowersmith to talk about the band’s new album, Total Dissatisfaction, which comes out on vinyl through Wax Mage Records and on cassette through Tape Haus. Locals John G and Jake Kelly provided the artwork.

After playing together when they were teens, Bowersmith and Gibian went their separate ways.

“After high school, I joined [the now defunct local punk band] the Vacancies, and [Gibian] joined [the now defunct local rock band] Boatzz,” says Bowersmith.

When those bands fizzled out, they started playing together once again in 2009, christening their band All Dinosaurs while jamming in Bowersmith’s basement.

“We played crappy acoustic songs, but we were determined,” says Bowersmith.

Seven years on, that determination has finally started to pay off.

Dissatisfaction, features abrasive guitar riffs and parched vocals as the songs straddle the line between hardcore and metal, placing the band in a category that defies categorization even if members admit that punk bands like the Bronx and Refused are big influences.

“We were always into punk music and the mid-2000s era when it was a little heavier,” says Bowersmith.

“It was like we’d want to play our songs faster and then once we played them faster, we’d want to play them even faster and we became this weird metal band.”

And yet, the band doesn’t quite fit the “metal” mold.

“It’s the whole Metallica thing,” says Gibian. “We’ll be the weird punk band on a metal show and the weird metal band on a punk show. We feel more like a punk band. But we want to play faster and be heavier.

Without it, we wouldn’t be doing this.

We had one song that we still play. It’s a great song but, juxtaposed to what we play now, it’s so different.”

The new album suggests a real maturation as the band addresses personal tragedies in many of the songs.

“We lost a few really good friends recently,” says Gibian. “I joke about it, but the themes do stem from those crushing losses and feelings of absolute hopelessness and helplessness.”

“We were in our early 20s when we wrote the first two records,” says Bowersmith. “Now, we’re in our 30s and reality starts sinking in. You add that to the deaths and you get the songs on the album. There are a lot of shitty feelings on the album. That stuff will knock you out.”

The band released its first single in 2010 and then followed it with two full-lengths.

“You can say we were ‘totally dissatisfied,’” says Gibian. “The first one was kids learning to play songs together. I don’t think it’s something

at Brainchild Recording Studios with Noah Buchanan, the singer in the metal band Solipsist.

“He lets us be a little loose,” says Bowersmith. “He knows we’re not the typical metal band. It doesn’t have to be regimented. He let us breathe and let some flubs in, so it was a more authentic sound.”

The song titles suggest the band’s unique approach. One track

dubbed “Mexican Grizzly” is about “passionate self-hatred.”

“It was an idea that I thought was interesting,” says Gibian. “In my head, I made some connections.

They’re just song titles, and they don’t have to mean too much. I thought I could relate it enough even though the title isn’t in the song’s lyrics.”

“One of us will come to the table with most of a song, and someone else might just have riffs,” adds Bowersmith. “Everything gets thrown in the pot and stirred up.

We might think we have a completed song but then other songs won’t have a home, and we’ll deconstruct what we thought was finished and turn it into something else.”

As a result, each song went through several versions before the final version.

Gibian says the band hopes to play out of town as much as possible. But since band members all have day jobs, they don’t intend to do any heavy touring.

“We’ve evolved from where we were when the band started,” he says. “It’s our third full-length album and still no one can tell us what we sound like.

That’s something I really like. It may have been a detriment, but in other ways, we can lay our head down on that at night. We work hard to create something that most people haven’t quite heard.”

Joan of Arc/Obnox/Soft Copy: After indie icon Cap’n Jazz split in the mid-90s, singer Tom Kinsella took part of the band and formed Joan of Arc. With excellent textural use of electronics, Joan of Arc has always deftly crafted unique tunes. Kinsella is a gifted songwriter — and a humorous writer, too — and Joan of Arc’s stuff tends to be pretty heartfelt. While it’s fairly introspective music at times, which works well for headphones in the bedroom, etc., the band also succeeds onstage, where the more physical side of their craft comes into play. By Jeff Niesel MEET THE BAND: AJ Haynes (vocals), Connor Davis (guitar), Adam Davis (bass), Jesse Gabriel (drums) STRAIGHT OUTTA SHREVEPORT: Haynes describes Shreveport as a “very big small town” where there’s not a lot for teenagers to do. “That’s why we did our own thing,” she says in reference to her bandmates, most of whom she’s known for the past decade. “We put on house shows and tried to have fun but to not get arrested.

We have a tightknit community of artists there. There are some really talented people I’m happy to call friends and family.” Haynes says she grew up listening to ’60s rock ’n’ roll. And she dabbled in other genres as well. “One of my favorite songs was the Byrds’ ‘Turn, Turn, Turn,’” she says. “I grew up singing in church so gospel music has a place in my heart. I then got into jazz when I was in high school. My first record was an Otis Redding and Jimi Hendrix split.”

She says she likes punk bands like Dead Kennedys and Black Flag.

She estimates that her bandmates played in about 10 different bands before starting up the Seratones in 2013. “This is the one band that stuck,” she says.

NO OVERDUBS ALLOWED: The band recorded its debut album, Get Gone, at Dial Back Sound in Mississippi with Bronson Tew, whom Haynes describes as “a brother from another mother.”

the tracks live. “We recorded everything live; even the vocals that ended up on the record were scratch vocals,” Haynes says. “I thought they were scratch vocals.

For every song we did overdubs, and they didn’t have the same vibe so we didn’t use them.”

WHY YOU SHOULD HEAR THEM: Haynes refers to the ballad “Tide” as a tune that’s a “little tricky.”

“It’s about the ebb and flow of desire and how you feel it rising and falling when you have a crush on someone,” Haynes says. “It starts slow and then has this heavy chorus, but it’s straight gangsta.

We’re trying to channel our inner Snoop Dogg with it.” The band wrote the snarling “Choking on Your Spit,” a song that sounds like a cross between Jerry Lee Lewis and the Ramones, in less than a day after Davis literally choked on his spit. “It’s the ultimate shit talking kind of karmic reality thrash song,” says Haynes. “We liked starting our sets off with a burst of aggression too. I always get excited when performing and it hasn’t worn off yet.”

Dear Dan, A question on your favorite topic, Dan. Just kidding, it’s a question about my vagina. I’m having a problem with the microbiome of my vulva and vagina. I’ve been going to my gyno for the last six months for recurrent bacterial vaginosis and yeast infections. She shrugs, gives me a script, the symptoms go away for a week or so, then they come back. I understand the infections are likely due to an imbalance in my vaginal pH, but I don’t know what to do to fix this. I’ve used probiotic suppositories to boost the amount of lactobacillus and these help more than anything else, but the problem remains. I also wear cotton, loosefitting undies and practice good hygiene and never douche or use anything scented. The problem started when I stopped using condoms with my partner, but it’s not an STI. We’ve both been tested.

There’s tons of sites online talking about this problem, but no one has a solution that I’ve found. How the hell can women with this problem fix their pH?! Thanks a ton if you read this far, and thanks a million tons if you or one of your experts has any ideas to help.

The vagina, aka “the muscular tube,” runs from the vulva to the uterus. (Fun fact: Vagina is Latin for the sheath of a sword.) People tend to use “vagina” when referring to a woman’s junk generally, and while meaning follows use and I’m inclined to give it a pass, saying “vagina” when you mean

“vulva” makes scientists like Dr. Herbenick rather teste. (Sad fact: Teste is not the singular form of testes.) Now back to your vulva and vagina, VULVA …

Dr. Herbenick recommends seeing a “true vulvovaginal health expert” (TVHE) about your problem, VULVA, and your gynecologist presumably qualifies as a TVHE … right?

“Not necessarily,” said Dr. Herbenick. “Gynecologists know far more about vaginal and vulvar health issues than most health care providers, but many gynecologists haven’t received deep-dive (pun not intended) specialized training in difficult-to-treat vulvovaginal health conditions. And if they have, it was likely when they were in med school — so years ago. They might not be up to date in the latest research, since not all doctors go to vulvovaginal-specific conferences.”

Is there a fix for that problem?

“Yes! “There are many different forms of bacterial vaginosis (BV) and different kinds of yeast infections,” said Dr. Herbenick. “These different kinds respond well to different kinds of treatment, which is one reason home yeast meds don’t work well for many women. And all too often, health care providers don’t have sufficient training to make finetuned diagnoses and end up treating the wrong thing. But if VULVA’s recurrences are frequent, I think it’s a wise idea for her to see a true specialist.”

A TVHE is likelier to pinpoint the problem. Even so, Dr. Herbenick warns that it may take more than one visit with a TVHE to solve the problem.
