UPFRONT OHIOANS CLAMOR FOR KASICH TO RECALL STATE HIGHWAY PATROL FROM NORTH DAKOTA WE REPORTED LAST WEEK THAT the Ohio State Highway Patrol sent 37 troopers to North Dakota after authorities there put out a call for aid in their ongoing clash with protesters over the Dakota Access Pipeline.

Shortly after that news broke, Ohioans signaled their displeasure to Gov. John Kasich in several ways. On Friday, protesters from Dayton and Athens traveled to Columbus to deliver a petition to the governor, calling on him to bring the troopers home. (As of Tuesday morning, a Change.org petition had garnered more than 45,000 signatures.)

State Rep. Nickie Antonio, who represents Lakewood and Cleveland’s west side, issued a strongly worded statement as well, suggesting that using state resources for the North Dakota dispute was a grave misunderstanding of priorities.

“If the governor wants to truly be responsive to an emergency,” Antonio wrote, “he need not look beyond his home state.

in desperate need of additional resources to combat the growing opioid crisis that has already claimed an (sic) historic number of Ohio lives.”

Cincinnati’s city council certified their opposition in a letter to Kasich, admonishing him for sending the troopers.

to gain control over their land and their resources.”

Cleveland city council has not addressed this latest development in the DAPL saga, though they did pass a resolution in September standing in opposition to the pipeline.

“We are bound to protect water,” the resolution read. “Just as the shores of Lake Erie are center to life here in Cleveland, so too the Standing Rock Sioux recognize and understand that without water, there is no life.”

Ohio State Highway Patrol Lt. Robert Sellers told Scene that the 37 troopers were volunteers from around the state and that there would be no impact on regular operations. For the Columbus Dispatch, Sellers likened Ohio’s involvement to other states sending police officers to Cleveland for the RNC. Sellers wrote Scene in an email Tuesday that Ohio would be reimbursed for its costs by the state of North Dakota, but that the total costs could not be projected until the “support mission” has been completed. He did say that the 37 troopers drove to North Dakota and are now lodged in a hotel.

He confirmed that the length of support mission is still “yet to be determined.”

The troopers, though, have certainly been active.

Three days after they departed from Dayton, members of the Ohio contingent appeared in a photo on the front lines, aiming guns (presumably with rubber bullets) and hosing protesters with fire extinguishers.

“Appears they jumped right in,” said local activist Rachelle Smith, on Twitter, noting that the picture was taken on Nov. 2, shortly after the troopers would have arrived.

(Scene wonders whether the use of an unequivocally racist symbol on team gear may have affected the league’s thinking process this year.)

When pressed on the issue of Western donations destabilizing local clothing industries, Bourne demurred, saying that he “wouldn’t attribute it to that.”

Let’s take a detour, even though the league won’t: In 2014, Kenya, Uganda, Tanzania, Burundi and Rwanda (the East African Community) collectively received more than $300 million worth of secondhand clothing from counties like the U.S. It was another bustling year for the secondhand textile market, which flows through free-trade agreements with ease and results in mountains of clothing dumped through the developing world. One effect: Local clothing producers and merchants can’t compete. The cycle of dependence on the crumbs of developed nations continues.

It’s a narrative that’s worth knowing and understanding, even though the MLB officially isn’t citing any of that. Maybe, on this broad scale, it’s best for the league to pursue different paths for the merchandise that won’t be sold.

(Local charities in the city of the losing team?)

At the end of the day, though, the league seems solely concerned with “protecting the team,” after all. Watch closely to see how the league treats the 2017 World Series aftermath, especially if a team other than the Indians ends up losing the October Classic.

It’s unclear how the MLB will “destroy” the merchandise.

OHIO SEEING MORE CARFENTANIL THAN ANYWHERE ELSE IN U.S. A new Associated Press report informs us that law enforcement has seized various amounts of carfentanil 407 times in the U.S. since July, when an overwhelming wave of opiate overdoses first crashed across wide swaths of the country. The drug is 100 times more powerful that fentanyl, which itself is 80 times more powerful than heroin. To be clear, all it takes is a snowďŹ&#x201A;ake-sized amount to kill a human, even through seemingly benign skin contact. Unwitting addicts have been shooting this stuff into their bloodstream and dying in droves.

Ohio is ground zero for this latest wave; here, the logic goes, a growing demand has spurred a new movement of dealers cutting their product with synthetic and high-powered pharmaceutical drugs like carfentanil. People are dying, yes, and still more people are seeking this stuff out.

In fact, Ohio alone accounts for 343 of those 407 carfentanil seizures.

We learned back in August that carfentanil was being cut into the heroin supply in Cuyahoga County, but the opioid ďŹ rst came to public prominence when Akron Police Chief James Nice announced in

COUNTY CORRECTIONS OFFICER CHARGED IN DOMESTIC VIOLENCE INCIDENT In news that might have slipped under your radar during the hectic World Series week, the Cuyahoga County corrections unit was dealt another round of bad PR. Nineteen-year veteran corrections ofďŹ cer Kenneth Hairston was charged with felonious assault and released from county jail on Oct. 31. The charge stems from an incident between him and his estranged wife that occurred on Oct. 21.

According to the victim, she came to his house to talk with him.

She had received an eviction notice from her landlord. As the two argued, according to her account, he stepped outside the door and grabbed her by the shirt and choked her with it.

July that it was cited as a cause in some of his cityâ&#x20AC;&#x2122;s overdose deaths.

In fact, in July 2016, alone, Akron saw more than 230 fatal overdoses â&#x20AC;&#x201D; all attributed to some blend of heroin, fentanyl, carfentanil or other opioids.

Hairston, for his part, told police that his estranged wife has harassed him and â&#x20AC;&#x153;threatened to get him ďŹ red from his job.â&#x20AC;?

A neighbor who spoke to police said they didnâ&#x20AC;&#x2122;t witness any physical violence between the two that night.

For now, Hairston has been put on unpaid leave by the county.

The ongoing situation is another notch in the disciplinary history of the corrections department.

Recall that earlier this year, Sgt. Mark Thevenin, who has spent more than two decades employed by the county with the sheriffâ&#x20AC;&#x2122;s department and at the county jail, was disciplined after failing to review and report on two excessive use of force cases involving Cpl. Brendan Johnson. That discipline involved a written reprimand and removal from the county jailâ&#x20AC;&#x2122;s special response team.

Johnson was ďŹ red earlier this year after two incidents that occurred in three days in May in which he pepper sprayed female inmates without provocation. In one incident, Johnson swept the legs from beneath a female inmate.

In the other, after deploying

pepper foam to an inmateâ&#x20AC;&#x2122;s face, he reportedly told her, â&#x20AC;&#x153;I told you Iâ&#x20AC;&#x2122;d get you.â&#x20AC;? Johnson had previously been suspended three days in 2015 after video caught him â&#x20AC;&#x153;taking hold of an inmate by his shirt, pulling him from his chair, and dragging him across the ďŹ&#x201A;oor out of view of camera.â&#x20AC;?

Both of the 2016 incidents were captured on video. Sgt. Thevenin failed to view the videos, as is mandated by jail policy and procedures when knowledge of use of force exists. In pre-disciplinary hearings, Thevenin said that while he was aware of what happened, he believed Johnsonâ&#x20AC;&#x2122;s explanations of the events in question and, further, he was too busy on those shifts to review the video. Thevenin also failed to compile the proper reports on the incidents involving Johnson.

In an interview with investigators in late May, Thevenin said he believed he could defend Johnsonâ&#x20AC;&#x2122;s actions in one but not both of the incidents.

FEATURE MIKE O’MALLEY’S BALANCING ACT Cuyahoga County’s incoming prosecutor talks about rebuilding confidence in the office, addressing the area’s ever-growing drug problem, investigating wrongful conviction claims, and how he ousted Tim McGinty

MIKE O’MALLEY FORMALLY WON THE PROSECUTOR’S OFFICE RACE this week, but with no opponent on the ballot, he really won it earlier this year when he beat sitting prosecutor Tim McGinty in the Democratic primary. He’ll be returning to an office he worked at for eight years, including as first assistant under prosecutor Bill Mason. A few days before the November election, he sat down with Scene to talk about how he plans to improve community relations, address a budget that he described as very poor, and advocate for the fair application of criminal justice in Cuyahoga County, come 2017.

What have you been doing to prepare for January? What can you do ahead of time before getting in the door?

I’m meeting with people who will be on my staff. I only left the office a year and a half ago, so I’m quite familiar with the operations of the office. I have a huge advantage as opposed to an individual who had never been part of that the Prosecutor’s Office before. So I’m meeting with community groups, continuing to do that, and really at this point monitoring the office budget and trying to keep the current prosecutor doing the right things when it comes to his actions and expenditures in office.

What groups are you specifically meeting with and why?

For instance, I met with the Greater Cleveland Congregations group, which had the big event at Fairmount Temple. A bunch of groups. It was part of my campaign platform, of being a prosecutor who is accessible and out in the community, who understands what’s happening around the county. I think it’s important that that continues, that they can see me, have dialog with me. I think when I ran I expressed a viewpoint that some of the issues the current prosecutor was having was that the community didn’t have confidence in him. Building those relationships allows the community to have some confidence, that I

understand what’s happening and that I’m someone who will fairly handle the issues that affect them.

Becoming familiar with individuals and groups around the county is how I have to do that.

Did you hear from groups as you’ve talked to them that communication or access to dialogs with the current prosecutor was lacking?

I don’t want to armchair quarterback — you can sit around and think about what Prosecutor McGinty did wrong, and different people have different viewpoints — but I would say that when I was out in the community, my personal viewpoint is that he wasn’t out there enough building confidence in his leadership and decision making.

I know there were certain groups in the county that had called him looking for meetings, and he did not set up those meetings. People who just wanted to be heard. One of his weaknesses was that he wasn’t available to them.

How do you continue that line of communication and assure different parts of our county that this is something that’s important to you once you take office?

Certainly just getting out there.

When I was in office before as Region 2 Supervisor, I was at the monthly second district commanders’ meeting. I think it’s important for

the prosecutor to hit those meetings, maybe not every month — there are a ton of meetings — but making the rounds and being available and having speaking engagements across the county. The foremost job of the prosecutor is to seek justice, but I think that part of that is building confidence. And not just in Cuyahoga County, but around the country. People have questions about how the criminal justice system handles cases and whether it fairly and impartially represents all people.

Part of my task in this era is to get out there and restore that confidence.

We’ll get to Tamir Rice and certain other cases in a second.

That has to do with that confidence, or lack thereof, in the office. And those are monumental cases, but they represent a small fraction of the cases that the Prosecutor’s Office handles. What other concerns in the application of fair justice have you heard since your campaign started and after your primary victory?

For instance, I’ve heard from community groups concerned about the handling of drug cases. They feel that low-level drug cases are unfairly impacting abilities of individuals both white and black to secure future employment that would allow them to become productive members of society. They think there’s been too much emphasis on convicting the individual for low-level drug offenses

instead of rehabilitation and recovery and attempting to get them back into society without the stigma of a felony on their records that might prevent future employment.

What options are at your disposal to address that?

It’s how we handle them. When I was in the Prosecutor’s Office previously, Cleveland used to send crackpipe cases to the Prosecutor’s Office. Then Mayor Jackson made a decision working with his team that they weren’t going to send crackpipe cases back to the county Prosecutor’s Office. So that decision was made, an individual who was caught for the first or second time with a crackpipe wouldn’t get sent downtown for a felony. I would like to assist community groups and local police agencies in putting an emphasis on assisting people into recovery. I’d like to expand the opportunities for drug court, for example.

I was going to ask about that.

I think it’s great. The problem with drug court right now — and it’s doing a great job — is for people who are eligible, it’s a very good program.

But we can’t have the eligibility criteria so restrictive that people who may have a more significant crime on their record are not afforded the tools of getting recovery. And I think an argument could be made that it should be a good option for everyone | clevescene.com | November 9 - 15, 2016

who has an addiction. So much crime in our community is driven by drugs.

FEATURE We’d included a detail on that from Lorain in a recent drug story.

That something like 85 percent of all investigations in Lorain County are tied to drugs in some fashion.

Absolutely. I don’t know the numbers, but when you talk about theft, robbery, burglaries, I wouldn’t be surprised if three-fourths of the crimes being committed aren’t driven by drugs.

And we’re talking mainly about heroin and opiates now.

Absolutely. Those are the things that lead to burglaries and robberies, those are the things that lead to theft from cars, like here in Parma, where people just rummage through unlocked vehicles. It’s the stuff that destroys the quality of life whether it’s in Shaker or Parma or wherever.

People want to know that when they close their doors at night, they are going to be safe in their homes and their possessions are going to be safe in their driveways and garages. It’s the drug cycle that drives much of what’s occurring.

So, back to drug court. It’s very restrictive. If you have any history of violent crime, and that could be a previous robbery from 15 years ago, you’re ineligible. So when I meet with the GCC, their biggest complaint is that drug court is not inclusive of everyone in the county. I think the stats show that it’s something like 85-percent white. And we know not 85 percent of crime is being committed by Caucasians. It would be good to be less restrictive. To give many individuals the opportunity to get on the road to recovery. I think you can make an argument that it’s a great option for everyone, that it’s great to get someone on the road to recovery who had a significant felony in his or her past. It’s common sense.

Now, I’m not talking about the guy with five pounds of fentanyl. I’m not talking about drug cases like that.

I’m talking about addicts who are using drugs and maybe selling an insignificant amount to a friend or neighbor to feed their own addiction.

I’m not talking about people bringing two pounds of this or that into our community. Those people need to be prosecuted and prosecuted very sternly. I’m talking about the people whose lives are dependent on their addiction and whose whole focus is that addiction. We need to reach out

to them and get them help, help them be productive members of society, work with them and assist in doing that.

Talking to some people who work in the office now, they know there will be leadership changes and such, but there are also questions about recent hires and promotions and what happens when you walk in the door.

I’ll say this: The county prosecutor budget is in extremely poor condition.

I’ve met with Prosecutor McGinty and I’ve urged him to cease hiring and cease promotions because the budget is not in the shape that it needs to be. I would have liked to have had attrition drop the numbers. I think he’s 50 over where he was four years ago, 50 bodies. We can’t sustain that.

The number of indictments are down but the employee size has grown. And what he did was balance this year and next year’s budget — the county is on a two-year budget cycle — by giving away delinquent tax money funding to the county in a swap. So, essentially, he used one-time funds to balance his budget. Now I’m coming in and that fund is down to zero.

What’s delinquent tax money funding?

The focus of that money is supposed to be to hire staff to bring down the amount of delinquent taxes within the county. So all these parcels that are due, to file actions on them to get taxpayer dollars back into the system, whether that’s for schools or for municipalities. So the amount of delinquent tax due in the county has gone up, up, up, and he should have been using that money to address that. Now, a lot of that has to do with the foreclosure crisis. But when you talk about delinquent taxes, you’re looking at endangering your county’s bond rating. It shows the health of the county. And so you need to keep that number at a manageable level.

Otherwise, it makes it hard to borrow money.

The problem is that he gave it away. That should have been used for staffing to bring that number down.

My problem for the budget years 2018-2019, is that I don’t have that giveaway anymore. It was like $3 million. How much is $3 million in employees? Probably 30 or so.

Additionally, all of these various law enforcement funds, forfeiture

funds, whether it’s the $1 million they got from a guy with illegal gambling machines or whatever, those monies are split between local law enforcement agencies. He’s spent every one of them down to zero. That money can be used for a variety of things to assist in the furtherance of justice. Whether it’s hiring an employee to focus on a particular need or assisting law enforcement in buying a piece of equipment. He’s spent it all. For instance, currently he has the last of that money, about $500,000, earmarked for the city of Cleveland for dash cameras. My understanding was that at a recent supervisors’ meeting, the staff was told no more travel, only emergency usage. So, as Cleveland decides whether or not they want the money, he’s said if they don’t take it he’ll give it to someone else. Which is fine if you have millions in these funds, but we don’t. Which certainly makes you question his motives at this point when he’s already been voted out of office. You just want what’s in the best interest of the county and taxpayers going forward.

So, I was going to ask about the

budget at large next.

Yes. So, back to employees. So my concern coming in is that I’m going to bring a leadership team, about a half dozen people. That’s what happens when any mayor or governor or prosecutor comes in. When he brought his team in, there were spots left available so he could do that. He hasn’t done that now. He continues to hire and promote. When I do come in, I’ve got a budget that’s blown and a leadership team that currently there’s no space on the budget for.

The Prosecutor’s Office Conviction Integrity Unit was among the first formal units on a county level across the country, but also has produced among the fewest exonerations or dismissals of any Conviction Integrity Unit.

Exonerations are up nationwide: 149 defendants were exonerated in 2015 alone. Seventeen defendants were exonerated in Cuyahoga County courtrooms between 1994 and early 2016. That includes Ricky Jackson, Kwame Ajamu and Wiley Bridgeman, who spent nearly 40 years in jail after a wrongful conviction. That number doesn’t even include the East Cleveland 3, who were finally freed recently. In two years, the Cuyahoga County

Conviction Integrity Unit had received almost 100 requests for review with only one being recommended by the office for dismissal. How can that unit improve and how can you ensure that justice handed out before you even walked in the door was in fact justice?

I think the dilemma that unit has faced is that they have a supervisor who has been handed multiple tasks.

The conviction integrity work needs to be their focus. If you’re going to have a unit and publicly promote that unit doing good work and seeking justice, that needs to be their task.

You can’t hand them 12 other things to do and expect them to accomplish what you need. I think those reviews need to be addressed promptly. If those are all handled, then maybe you assign other duties, but that’s the task at hand first.

Because Ricky and Kwame and Wiley are not alone. The East Cleveland 3 are not alone. We’re not talking about huge numbers, but it happens. And there are people like Ru-El Sailor waiting for that unit to address cases.

Absolutely. It’s been promoted heavily as an accomplishment of the office, but it has to be more than a

press release. It has to be something that actually functions. The chips will fall where they fall. It’s a good day when you get a conviction. It’s also a good or better day if there’s someone who’s been sitting in prison unfairly and you find that out.

There seems to be a reticence from the prosecutor’s office sometimes to admit they got it wrong.

I can tell you I don’t have that issue.

What made you want to do this?

Why did you run and when did you decide?

I have to be honest. I could have run four years ago. It’s funny. It was approximately a year ago this time that I decided. Four years ago, I was willing to let Jim McDonald or Subodh Chandra or whoever was going to win to win. And then Tim won. I knew Tim a bit, but never had him as a supervisor. When he came in, I just questioned his ability to manage people and manage the office and how he was pursuing justice. I thought at some point last year, “If not me, who?” and “If not now, then when?” I suggested the idea to a couple of colleagues and for the most part they thought I was nuts.

To take on a sitting Democratic prosecutor in a Democratic county.

I thought to myself, I’ve been in elected office, I thought I was a good councilman, that during my tenure I made good progress in my ward. I had a track record, I had relationships with people. And they know who you are and how you handle people. I thought with my background and knowledge and experience in that office, that I made a credible challenger. I had been there, after all. I was first assistant and had 300 people under me who could say what kind of boss I was.

I thought with my experience of 30 years in public life, if not me, then who? But people thought I was nuts.

I remember getting a call about this time last year and the person said you were running. It was kind of a shock. No one was talking about someone taking on McGinty.

I had told some friends and they said the first thing you have to do if you’re serious is put out a poll to see if you have a chance. So we did that, and it revealed that of the various names against McGinty, I ran the best. And it also revealed that he had serious issues within the county and with his record. We saw those numbers and the naysayers said,

The primary vote was certainly a referendum on McGinty’s resume as a whole, but specifically it felt like a referendum on how he handled the Tamir Rice case.

I would say this: Maybe. But I would also say that part of it was that he had a record of close to 30 years as a public servant, whether as prosecutor or as a judge, and I think that while the public as a whole maybe became more aware of him once he was prosecutor, there was a whole segment of the community who knew him very well already and those are the people who deal with the criminal justice system on a daily basis.

Was Bill Mason one of the people you talked to at first?

He really wasn’t involved in my campaign, no. I felt like I had to stand on my own.

I ask because every time your record and resume are mentioned, it’s because you’ve been in the office before and people can see your experience, but also because it was during the old era of Cuyahoga County politics, the era where people ended up in jail and on the front page of the paper. Should there be any concern about those ties and relationships?

Absolutely not.

It wasn’t a race that seemed to catch the attention of the media before that primary night. I don’t know how many people actually thought you had a chance, let alone a chance to beat him by the margin you did. McGinty only won one ward, and that was the one he lives in. Did you have polling that indicated that, or at least a feeling?

I only did one poll prior to the election. In the course of the campaign, I felt the response growing and growing. We worked really hard. I was always cautiously optimistic. That night, when I saw the first absentee ballots come in and I was only down a point or two, that was a victory for me. I felt good knowing those people had voted early in the election cycle and I was optimistic that, as the individuals who had voted that day, who had heard both campaigns, that more would come in my direction.

You’ve avoided saying whether

you would have recommended charges in the Tamir Rice case. Is that something you’d address once you take office and have a chance to review more?

Well, I’ve said that I’m going to advocate for the law to be changed in use of deadly force cases. We need an independent investigation and prosecution. What I intend to do is search for an independent prosecutor or help from the Ohio Attorney General’s office in such instances.

Second, I have pledged to the NAACP that I would support their motion seeking the release of the grand jury transcript in this case. The case was handled in such an unusual manner, outside the bounds of how cases are handled by grand juries.

I’d support the release of the transcript.

I think it’s important for the public. Until your paper broke the news on how the vote was handled —Mike — voting for justified or not, not voting on charges — I think the whole county and whole country was under the impression there’d been a vote on specific charges, whether to indict or not. It was an earthquake.

A blue ribbon panel says, quite frankly, that for a prosecutor of a county who works with those officers on a daily basis, there’s a perception that there’s a relationship that develops that should preclude them from reviewing cases those same officers are involved in. Which is what I said. Which is what the community has said. There’s a perception of conflict. We sit next to them, they’re our witnesses, they’re our partners in seeking justice. The communities throughout the county have the same view. The appearance of conflict needs to be reviewed.

The way to do that is to step aside and have an independent investigation and independent review. I’ll also tell you that in my discussions with law enforcement, they welcome that approach.

I’m hopeful given that report that there will be a change in state law that requires it.

them making decisions and there is no way for our citizens to hold them accountable. At least if you had the Attorney General, that’s someone who our voters can hold accountable in an election. It bodes well with our principles of democracy that we should be able to vote on our decision makers.

We’ve talked a lot about confidence in the office. You’re not in the same department, obviously, but you work with the police all the time in the office. Is it hard to rebuild and keep confidence in the criminal justice system when you have someone like the police union president being openly antagonistic about the Black Lives Matter movement? The same guy who openly disagrees with the federal consent decree yet sits on the Community Police Commission.

A variety of groups representing minorities and immigrants have asked that he be removed from that position, incidentally.

He has a responsibility to represent his men and I understand that. I think sometimes you have to balance that against what’s best for the community. You can be an aggressive advocate for your members — and all union heads are and they should be — but there’s a way do to it that’s less combustible.

In addition to grand jury reform, there’s been a lot of talk about bail/ bond reform. In that vein, sort of tangentially connected, you’ve talked about how courtrooms throughout the county can be more consistent and how we can make sure that similar cases in different municipalities are charged the same.

Yes. When we had a meeting with the Greater Cleveland Congregations, I talked about convening a meeting of the prosecutors so that cases are handled consistently throughout.

Give me an example.

The crackpipe case. If Cleveland has a “three strikes and you’re out,” that doesn’t mean it’s the same in Euclid or Shaker. So you could be on one side of 185th and charged, but be on the other side and not. You have to bring some consistency to these types of cases, the minor issues, but you have to balance that against other concerns. I’ve told groups, listen, it may be a win if a low-level drug

case isn’t handled as a felony. You may think that’s a win. But is it a win if it’s handled as a felony and they are afforded services at a county level that they wouldn’t on a municipal level and eventually those charges are dropped? You have to be careful what you wish for. Municipal courts don’t have the services that the common pleas courts do. So my goal, as we seek justice, is to try and help these people with addictions overcome and recover and end the cycle of crime in the community. So if someone who maybe faces a misdemeanor and that’s a win, we have to make sure those people are afforded the same type of help that someone with a felony might receive in common pleas court. How do we allocate services to the muni court level? How do we make sure people with low-level felony convictions aren’t stigmatized by that in the future? And how do you end the cycle?

During my tenure as Region 2 Supervisor, I saw issues of burglaries in Tremont or Ohio City. When people’s heirlooms are stolen or they’re held up at gunpoint, that’s a scar that never fully heals. It’s what makes people question whether they’re safe. It’s what destroys communities, especially when you’re talking about areas you want to

revitalize, especially when you’re talking about having residents who, once they have children, want to stay and not bolt.

professionals who can de-escalate the situation. There’s a significant population in jails that have mental health issues. It’s a critical component.

Besides the restrictions on drug court and advocating for a consistency in charges throughout the county, how else can you address treatment once you take office?

Well, I can say that one of the initiatives we’re looking at is to hopefully have a component to work with law enforcement officers and county agencies to create a response team for mental health patients that are having a crisis moment.

One of the things you agree with Prosecutor McGinty on is the limited application of the death penalty. What’s your thinking behind that?

I want to make it clear: There are some cases where the death penalty is appropriate and almost necessary. But I think you have to look at the entire situation and certainly get input from the victim or the victim’s family. I will say there are certain instances where there is no other option, and we’ve seen those cases in our community. I think it’s an appropriate policy in the worst examples.

Instead of having cops be the first responders?

Yes. The appearance of a blackand-white might heighten anxiety in those situations. Can we work toward a mental health crisis team instead of having a black-and-white go out that may end in a tragedy like we’ve seen in our own community? There are no boundaries to the problem. We just saw it in North Royalton, where a guy undergoing a mental issue stabbed an officer in the head and then got shot and killed.

And establishing a facility so you’re not taking them to an incarceration facility. A place that has mental health

In those worst cases, like Anthony Sowell, there is at least a certainty that there isn’t in others.

Which is to say that Ricky Jackson was once on Death Row and he’s innocent. And the idea that there is anyone on Death Row who is innocent is something to consider.

Yes, the level of certainty in those cases is an example. But also those examples are crimes so heinous that there is no other option. You know, just as many people think justice is

someone sitting in prison for the rest of their life. Many victims’ families feel that way too.

How soon can you start making decisions about how the office will function going forward? Basically, what sort of transition effort is underway?

Well, we tried to transition. Lisa Williamson is going to be my first assistant. I tried to work out a deal so she could come in several months early and begin to evaluate, so we could get a running start. I’ll just say that gesture was kind of shot down. Having said that, Tim is one individual. I’m having daily conversations with people below him who are assisting me in crafting our team going forward. So I guess you can say it’s being done in spite of him.

Anything you haven’t had a chance to say during the campaign or now?

I’m just looking forward to coming in and serving the public and building confidence in that office, and working with the great team that’s already in that office.

Cleveland Stories Dinner Party Earlier this year, Music Box Supper Club launched Cleveland Stories Dinner Party, a weekly series that pairs fi ne food with storytelling. The series aims to help raise awareness of the mission of the Western Reserve Historical Society’s new Cleveland History Center. The club’s owners consider the Cleveland History Center to be “one of the most interesting museums in Cleveland” and “an unknown gem that Clevelanders should know more about and support.” The goal of the Cleveland Stories Dinner Party is to “bring to life some of the fun, interesting stories about Cleveland’s past — from sports, to rock ’n’ roll, to Millionaires’ Row.” Each week features a guest speaker and a custom prix fixe menu — a full three-course meal for only $20. Henry Rollins If you happened to have seen Black Flag back in the days when the group performed with Henry Rollins as its frontman, you know just how intense the burly dude can be. Often shirtless, Rollins would scream his goddamn lungs out while madly stomping. He’d have a microphone cord wrapped around his arm like it was some kind of leash designed to keep him from attacking the audience. These days, Rollins has simmered down, though he channels his frustration into books, columns and spoken word shows. Cheech & Chong Comedians Richard “Cheech” Marin and Tommy Chong were stoners before it was cool to be stoners.

They got their start in the ’60s, making fun of free love and hippie culture, while speaking in a slow, slightly dazed and confused manner. The duo made a number of movies throughout the ’80s and ’90s and never left the comedy circuit. The current tour includes a handful of dates at casinos. Tiempo Fragmentado This weekend, the Cleveland Print Room (CPR) debuts Tiempo Fragmentado, an exhibition of work created by Creative Fusion artist Loreto Greve during her residence in Cleveland. The exhibition includes both photography and ink drawings on paper. CPR will also be presenting work from Walton & Scranton School, where Greve has been working with students in preparation for their exhibition at Cleveland Print Room as part of a CAC/MetroHealth Transformations Grant. ART BACK TO THE FUTURE Celebrate 20 years of the Artists Archives of the Western Reserve with an exciting exhibition

By Josh Usmani TWENTY YEARS AGO, NINE artists established what is now known as the Artists Archives of the Western Reserve (AAWR).

Along with founder David E. Davis, these eight artists each donated works, ephemera and money to help establish the organization. Today the Archives includes 75 artists and approximately 5,000 works, as well as a lively exhibition schedule and educational programming. This Friday, the organization celebrates the 20th anniversary of earning its

TOASTING TO CERAMICS TOAST WINE BAR HOSTS A SPECIAL EVENING FEATURING ORIGINAL, handmade ceramic tableware by Cleveland-based ceramicist Billy Ritter, on Wednesday, Nov. 9, from 6 to 10 p.m.

“We are super excited to team up with Billy Ritter,” says the management of Toast Wine Bar. “When we have handcrafted plates that are made with our style of food as the focus, it creates a more satisfying experience for our guests. It allows them to eat with eyes as well as their mouths.”

“I’m a fan of Toast,” Ritter says. “I’m a fan of the neighborhood of Gordon Square. It has a great vibe and there is a cultural and intellectual dynamic of good feels that are cross-pollinating and growing into something better each day. The inspiration point for me was that it simply is a match. I like the company they keep at Toast: the staff, the atmosphere, and most importantly their food! The collaboration with Jillian Davis and Chef Joe Horvath of Toast was totally organic. During a holiday sale last year Jillian approached me and we discussed the idea and began bricking up the details by June of this year.”

New and returning guests are invited to Toast to dine on more than 300 plates and bowls specially designed by Ritter in cooperation with Davis and Horvath. Ritter’s ToastCERAMICIST BILLY RITTER inspired wares include two Toast Wine Bar 1365 West 65th St., 216-862-8974, porcelains, a gray stoneware toastcleveland.com, billyritter77.com and a black midrange stoneware. All of them are vitrified, food- and microwave-safe, and though the artist encourages hand washing, they are dishwasher safe as well.

“This series of wares was tailored exclusively from a collaboration with Chef Joe. Several months ago I had him visit the studio and I asked for his input and listened to his thoughts and concerns. My intention was to craft wares that would create a harmony with the food being plated. Other points of consideration were aesthetics, photogenic attributes, general visual appeal, and practicality. In the end, Joe and I decided on three forms: a dinner ‘big plate,’ a larger shallow bowl for pasta and soups, and a side plate for apps and charcuterie.”

Ritter’s art education began in a graphic arts program at a vocational technical school during high school. He earned his bachelor’s of fine arts in painting from Slipper Rock University in Pennsylvania and his master’s degree in ceramics from Kent State University in 2010. During his time at Kent State, Ritter studied with legendary local ceramicists Kirk Mangus and Craig Lucas. In January, Ritter joined NewBridge Cleveland as their Teaching Artist of Ceramics.

“As I assembled my selections for this exhibition, I was struck again by the individualism of each of these founding artists,” says AAWR executive director Mindy Tousley.

“Each of their voices is unique — as a group they are held together by the strength and quality of their works, rather than a shared conceptual vision.”

Meanwhile, the Sculpture Center debuts two new exhibitions that showcase creative collaboration, not just between the artists, but local arts organizations as well.

Przemyslaw Jasielski and Rainer Prohaska’s Apparat: Retrogression through Technological Progress is a collaborative effort by two of the Cleveland Foundation’s Creative Fusion resident artists. Jasielski (of Poznan, Poland) first exhibited at the Sculpture Center during his Creative

“To work with such highly innovative contemporary artists whose practices fall at the intersection of art and technology, one of the most forward thinking art forms today, and to strengthen the contemporary art scene of Northeast Ohio with collaborations with Spaces and the Transformer Station represents the very core of the Sculpture Center’s goal of supporting innovation and experimentation in sculpture,” says Ann Albano, executive director and chief curator at the Sculpture Center.

The campus-wide 20th anniversary celebration kicks off from 5 to 8 p.m. this Friday, with remarks from the

Fusion residency in 2013. Prohaska (of Vienna, Austria) is currently in town as a Creative Fusion artist at Transformer Station. The exhibition is their latest iteration of “Nonsense Technology” exhibitions that are being shown across Europe.

Simultaneously, The Hum features the work of Felix Kalmenson (born in St. Petersburg, Russia; living in Toronto). The Hum is a Spaces R&D exhibition being exhibited at the Sculpture Center, in conjunction with the David E. Davis Foundation.

Sculpture Center’s exhibiting artists and Mindy Tousley beginning at 6:15 p.m. At 2 p.m. on Saturday, the Sculpture Center hosts Art Confronts and Considers Technology, a panel discussion with Jasielski, Prohaska, and Kalmenson.

The 20th Anniversary Founder’s Exhibition remains on view through Jan. 14, but the exhibitions at the Sculpture Center end Dec. 17.

A SHOW THAT DIDN’T GROW UP The author of Peter Pan is at the center of the spectacular yet banal Finding Neverland at Playhouse Square

By Christine Howey WE ALL SEEM TO BE CONTINUALLY and obsessively interested in the story of Peter Pan, that little boy who just won’t grow up. And perhaps this explains the fascination this past election cycle with “Peter Pan from Hell,” Donald Trump.

Since this review is being written two days before the election results are in, we’ll assume, just for grins, that governmental Armageddon in the form of a looming Trump administration is not upon us, and we can move on to the show at hand.

It’s called Finding Neverland, now at Playhouse Square, and it is about that boy who flies — not the one who just flies off the handle.

This is the 2012 Peter Pan musical, based on the Johnny Depp film of the same name, that joined the ranks of all the other stage shows on the subject, including Peter and the Starcatcher (opening soon at Dobama Theater), Peter and Wendy, a raft of different scripts all titled Peter Pan (some with music, some without), and even a Peter Pan opera. Like I said, we’re obsessed.

In this Broadway touring production, the focus is on the man who started the PP mania, J.M. Barrie, the author of the original work. And it is told with all the theatrical horsepower they can load onto a collection of 18-wheelers and haul around the country. There are

cutaways to the Peter Pan story involving impressive sets, propulsive visual delights and pounding sound effects. But all the staging frou-frou can’t cover up the fact that the story being told feels awfully saccharine and, yes, a tad juvenile. That’s fine for any youngsters who occupy the seats, but it might be a bit less entrancing for those who drove them downtown.

As the tale is told, Barrie is an unhappily married playwright being urged to come up with a hit by his producer Charles Frohman. And Barrie has no ideas until he meets a gaggle of five young brothers while walking his pooch in a London park.

word and every sentence/Doesn’t seem to make a difference/Nothing can explain just what you mean to me.”

No kidding. And there are some weak attempts at humor. In one, it’s turning Wendy Darling’s family surname into a lame “who’s on first?”-style ripoff (“Who, Darling?” “Yes Darling!” and so on). In another, it’s plying a tired riff on real “fairies” in the theater world.

The story of Barrie, Peter and the whole family could have been fascinating if the creators had acquired the cojones to peer into the rather tragic reality of those people. The real Peter — Peter Llewelyn Davies — really did grow up, and not so happily: He committed suicide at age 63 after being

Llewelyn Davies, inspire Barrie — particularly a shy and intelligent lad, Peter, whom the fictional character is ultimately named after. Of course Barrie also meets the boys’ widowed mom, Sylvia, and that relationship factors into the mix.

Trouble is, the book by James Graham and the music and lyrics by Gary Barlow and Eliot Kennedy turn out to be mostly bland and forgettable.

A ditty in the second act features these unintentionally revealing lines: “Every

tormented for years by his “fame” as the inspiration for the Boy. Turns out, the original Peter really was a “lost boy,” so stick that up your cock-adoodle-doo, Peter Pan. Indeed, the book of this show glosses over most of the interesting, if not so palatable, parts of those lives and spoon-feeds us happy talk in songs titled “Believe” and “We’re All Made of Stars.”

That said, the production is dazzling and the performers, while not exactly memorable or charismatic, handle

their tasks professionally. As Barrie, Kevin Kern is sort of a song-writing dork who stumbles on a very cool idea. Kern delivers his songs with polish, as does Christine Dwyer as Sylvia. Echoing the casting of the iconic Peter Pan musical, in which the performer who plays Mr. Darling doubles as Captain Hook, the actor playing Frohman also plays Hook.

And in those roles, Tom Hewitt finds different ways to bluster and kvetch, often amusingly so.

The six young actors playing the boys — Jordan Cole, Finn Faulconer, Tyler Patrick Hennessy, Ben Krieger, Eli Tokash and Mitchell Wray — will often rotate through different roles in the Llewelyn Davies brood during the run. But they all do a fine job and often are called upon to carry much of the weight of the show in their scenes. And there are standouts in the supporting cast, including Dwelvan David who takes on multiple roles including a particularly egocentric actor called upon to play the babysitter Nana in a dog costume.

As for the show, it’s not a dog itself, but it is so much less than it might have been, with a bit more boldness on the part of the creators.

MOVIES A LITTLE WOMEN OF THE ORIENT Lovely Our Little Sister has more endings than Return of the King

By Sam Allard IT TURNS OUT DULLNESS CAN ransack even the loveliest and gentlest of stories. Take, say, Our Little Sister, which plays at the Cleveland Institute of Art Cinematheque this weekend. It’s a small-scale domestic drama from director Hirokazu Koreeda that captures, in its quotidian way, the beauties and pleasures and hurdles and horrors of life for three sisters and their adopted half-sister in Japan.

It is elegant and oh-so serene, rather akin to the lapping waves on the beach where the Koda sisters are wont to stroll and reminisce.

Yes, to watch Our Little Sister is to experience the recurring delight of little lapping waves, waves that might not have the gale-force velocity or awesome altitude of the foam-crested suckers of tsunami season (a metaphor for the bigbudget franchise onslaught during summer’s dog days), but which are pleasing and meditative in their cumulative effect.

At least for the first 85 minutes or so. After that, to extend the analogy, the little burps and splats of all these lapping waves become maddening.

Your feet in the sand become pruny and cold. It begins to rain, and the

waves’ interminable advance is now a sick sort of torture, a literal water torture from which there appears to be no escape or end.

Like Return of the King before it, Our Little Sister is distinguished, among other things, by the quantity of its endings. With a running time of two hours and eight minutes (but which feels more like eight hours and two minutes), the film conspires to tie a bow on the storylines of every character and minor conflict lately introduced.

Egalitarian to a fault, the movie roves among the freighted relationships of each of the three Koda sisters — Sachi (Haruka Ayase), Yoshino (Masami Nagasawa) and Chika (Kaho) — and their warm individual sisterly/motherly stewardships of young Suzo (Suzo Hirose), whom they invite to live with them after the funeral that opens the film.

Within all of these relationships are moments of absolute serenity, total gentleness and everyday

beauty: the family’s yearly ritual of making plum wine; the late-night coming together for sparklers after a city-wide celebration; Suzo’s delight as she tries a new dish at the local diner; Suzo’s ecstasy as she bicycles through the cherry blossoms, etc.

It’s all very sweet — in fact, more than once you’ll no doubt aww and murmur appreciatively, “That is so sweet!” — but it’s all, to an almost unendurable degree, low key.

If Little Women was suffused with melodrama, Our Little Sister is pretty much sucked of it. There is sadness to be sure, somberness aplenty, but little of it arrives with the narrative benefit of dramatic tension. That’s part of the reason why everything feels like an ending in the movie’s second half. It’s all been so serenely humdrum that you’re not aware of the story’s natural arc.

Our Little Sister’s ultimate dullness, then, emerges not in spite of its loveliness; it is generated by its loveliness. But make no mistake.

Before the dullness and the fury set in (and maybe even after), you’ll find sweetness and serenity galore.

SPOTLIGHT: MOONLIGHT MUCH LIKE 2014’S BOYHOOD, MOONLIGHT, the new drama from writer-director Barry Jenkins, traces the life of a boy, starting with his grade-school days and concluding with adulthood. While Jenkins doesn’t go to the same lengths that writer-director Richard Linklater did with Boyhood, which he filmed over the course of 12 years, he does aim high as he tries to capture the complexity of a young gay black man’s life. Terrific acting distinguishes the movie. It opens on Friday at the Cedar Lee Theatre.

Divided into three parts, the film begins with a segment about Chiron (Alex Hibbert), a shy young boy who hides in an abandoned apartment one afternoon to avoid some bullies from school. When the local crack dealer Juan (Mahershala Ali) finds him hiding out, he takes him to his girlfriend Teresa (Janelle Monáe) and

the two become his surrogate parents, providing him with a place to go when his drug addict mother (Naomie Harris) gets strung out.

Kevin (Jaden Piner), his one friend during this time, tries to get him to toughen up and warns him that if he doesn’t stand up to the school’s bullies, he’ll constantly be harassed.

Flash forward to high school, and the school bullies still pick on Chiron (now played

by Ashton Sanders). While he and Kevin (now played by Jharrel Jerome) remain friends, Chiron still has problems with his abusive mother and regularly seeks refuge with Teresa, who’s now a widow. It’s not giving anything away to say that the bullying and teasing push Chiron to the brink, and he snaps one day.

In the film’s final act, Chiron (now played by Trevante Rhodes) bears a striking resemblance to Juan and has followed in his

footsteps. After doing hard time, he stopped taking the abuse from others and became a hardened drug dealer who even drives the same car that Juan drove. The movie’s final act includes a scene in which he visits Kevin (now played by André Holland), who works as a server and cook at a diner. While Kevin and Chiron had an intimate moment when they were young, Kevin has married and had a child while Chiron continues to question just what his sexual orientation might be.

The film’s true strength lies in the acting.

The actors who portray both Kevin and Chiron at the various stages of their lives maintain a real consistency in their portrayals of the characters and make this movie seem more like a compelling documentary than a fictional tale as it chronicles a particularly difficult comingof-age. — Jeff Niesel | clevescene.com | November 9 - 15, 2016

A NEW WORLD DOWN THE STREET Astoria Market’s move to Gordon Square is almost complete and comes with new offerings

By Douglas Trattner WHEN I VISIT THE FORTHCOMING Astoria Market and Cafe (5417 Detroit Ave.), a cadre of plumbers, electricians and fire-suppression technicians are wrapping up their work. Though this piece of property in the Gordon Square Arts District of Detroit Shoreway was purchased three years ago, it is only now approaching the finish line.

“We’re almost there,” says owner Steven Daniels.

Daniels and his partner George Kantzios are the proprietors of Agora Foods International, a direct importer of Mediterranean specialty items from Greece, Italy, France, Spain and other countries. Their products land on the shelves of places like Gallucci’s, Heinen’s and the Mediterranean Foods store at the

West Side Market, which was opened in 1969 by a member of Kantzios’ family. The 8-year-old import business originally was in Ohio City, but the owners were in search of a new home. That’s when they landed in Gordon Square.

“We saw this building and we saw the potential,” says Daniels. “We wanted to stay in Cleveland.”

In the back section of the 25,000-square-foot complex, originally home to a Chevrolet dealership, there are multiple walkin coolers filled to the ceilings with literally thousands of individual gourmet food products. Olives, olive oil, fine European cheeses, garbanzo beans, roasted red peppers, anchovies, salumi ... you name it, they got it. Many of those items will

wind up in both the retail section of Astoria as well as on the menu of the cafe.

“When we were on Clinton Avenue [in Ohio City], people would come in and say, ‘Hey, can I come through and go shopping?’” Daniels says.

“No” was always the answer. But come the middle of November, that answer will change to “yes.”

The 3,500-square-foot front portion of the building, now illuminated by a fresh facade of expansive windows, will be divided into zones for market and cafe. The retail section will have a cooler filled with grab-and-go salads and sandwiches and a freezer stocked with frozen heat-and-eat foods. Large deli cases will offer bulk olives, cheeses and charcuterie, which

will be cut to order on a jet black, whisper-quiet Berkel slicer. Also available on the ready will be hot soups and house-baked breads and pastries. Beer, wine and soft drinks will line the shelves of additional coolers and temperature-controlled bins.

The opposite side of the space is dedicated to the cafe, which features an expansive quartz bar, open kitchen and seating for approximately 75 guests. Originally, Tom and Joy Harlor of Le Petite Triangle Cafe were to manage the restaurant portion of the operation, but they are no longer attached to the project. Italian/Cajun eatery in Peninsula.

“He’s like the grandchild of Emeril, since his boss trained under Emeril,” Daniels says of Kobrinski and his mentor David Russo.

At the young chef’s disposal is a spacious new kitchen equipped with a double-decker pizza oven, char broiler, grill and combi oven.

But what he’s most excited about is the massive Mediterranean foods warehouse just steps from the line.

“It’s like a playground for me,” Kobrinski says. “I can go back there and pick and choose whatever I want. The sky’s the limit.”

Coming from Russo’s, a restaurant adored for lively dishes like chicken etouffee and New Orleans-style barbecue shrimp, the chef says the goal will be to take what he’s learned in Peninsula and reshape it.

“It’s a big project to take on, but I’ve had some good training from some great chefs,” he says. “I’ll take my technique and style from the Cajun-Creole background and fuse it with Mediterranean cuisine.

expand, gain knowledge and grow as a chef; to go outside what I’m comfortable with and make a name for myself.”

Diners can look forward to tapas-style plates of charcuterie and cheese, lamb meatballs, specialty pizzas featuring cured meats and seafood rich main courses. In the morning, neighbors can pair their espresso or cappuccino with

housemade scones and muffins. At night, craft beer and wine will flow until 10 or 11 p.m. Sunday brunch will run from midmorning until late afternoon. A 45-car parking lot, a rarity for the neighborhood, is just across West 55th Street.

For owner Steven Daniels, Astoria is an opportunity to jump back into the full-service restaurant game.

Though he’s been in the wholesale

foods business for years now, his family ran the original Flaming Gyro shop downtown in the 1980s and he did most of the cooking years later at a family joint in New Jersey.

Look for Astoria to open before the end of November.

EAT CHEESY GOODNESS New additions showcase tradition at Le Bistro du Beaujolais

by Rachel Hunt THERE’S MUCH TO BE THANKFUL for as the holidays approach for Georges and Claudie d’Arras, owners of Le Bistro du Beaujolais (8134 Columbia Rd., 440-235-8883, lebistrodubeaujolais.com), including 11 years in business, customers from around the country, and the addition of a granddaughter to their family. During the last week of October, they also began a brand new tradition based on a classic dish.

Every Wednesday night, Le Bistro du Beaujolais will be offering two shared tables of six the chance to dine on raclette, with a reservation at $40 a seat.

“The patrons are just starting to come,” says Georges. “So far, every Wednesday we had more customers for it.”

The idea for the evening originated during a Facebook interaction with customers, who became increasingly interested in the dish after a discussion on a similar dish from southern France.

“We used to do once or twice a year a raclette on Sunday with friends at home or at the restaurant,” Georges explains.

“When I spoke about it to my wife, Chef Claudie, she said, ‘Yes, why not?’”

Raclette is a cheese primarily used for melting, and also refers to the French dish derived from heating the cheese and then scraping the melting cheese onto a plate. The warm cheese is paired with various accoutrements.

D’Arras refers to raclette as an Alpine specialty because of its Swiss origins.

He acts as a charming liaison to French wine, food and culture at the bistro where his wife Claudie is head chef. She earned a degree from Chambéry Culinary School, located within the region known for raclette.

The dining experience here is as authentic as can be had on this side of the Atlantic, with many customers coming in not only for the menu and ambiance, but to brush up on their conversational French as well. The name for the bistro came to the couple, both purveyors of art, during a trip to an art market in Lyon. After getting separated from one another and reuniting, they both had a painting they wanted the other to see.

“It was the exact same painting representing the front of an old French bistro from Lyon called Le Bistro du Beajolais,” Georges recalls. “But what was really special about this painting was written just under the name of the restaurant: ‘Les caves de l’ami Georges,’ which means, ‘The wine cellar of our friend Georges.’”

Each anniversary is celebrated by hosting a Beaujolais Nouveau party at the restaurant, housed in an historic 1830s colonial in Olmsted Falls. The party is planned around the annual release of the fruity, young red wine produced in a region north of Lyon known for its Gamay grape varietal. After the wine is fermented, it is released for sale on the third Thursday of November.

On Thursday, Nov. 17, attendees at the party not only will get their first sip of this year’s Beaujolais Nouveau, but also a French buffetstyle dinner including a spread of soup, salad, quiche, charcuterie, entrees, dessert and cheese. There are a limited number of seats for the popular event.

ARCADIAN IS CLOSED, STAFF LOCKED OUT OF BUILDING

By Douglas Trattner “I WAS AWAKENED THIS morning by a text saying that the investor changed the locks on the restaurant,” Arcadian GM David Hridel told Scene last Wednesday.

“I flew down to the restaurant to see what was going on.”

It’s a shocking state of affairs, to say the least, for the fourmonth-old restaurant. That investor, named for the first time

by Hridel as Tim Kopp, owner of Ohio Valley Supply, told his partners that “he was done.” He had a locksmith change the locks on the building, effectively locking out all staffers, including chef partners Cory and Rebecca Hess.

“My number-one concern is that I have servers’ and bussers’ and bartenders’ tips sitting in a drawer I can’t get into,” Hridel says.

Hridel says that he and the entire staff were blindsided, and that the numbers were right where they needed to be for a young restaurant.

“In my opinion the place was successful, we were building momentum,” he says. “We were paying the bills, the staff was always paid, there was always money in the account. I think [Kopp] expected downtown East Fourth numbers. I’m actually shocked for the first time in a while that this has gone the way

that it has.”

Chefs Cory and Rebecca Hess, who have been working and waiting for the restaurant to open for more than three years, are naturally crushed, says Hridel, who is speaking on their behalf.

“They took it really hard,” he says. “It’s still very fresh.”

Calls to Kopp at Ohio Valley Supply went unanswered. The most likely scenario in this case would be that the main investor would either sell the building to another operator or lease the space, though it’s too early to know what will happen next.

DIRTIER THAN THE DIRT NOFX’s dark past comes to light in its memoir and on its new album

SINGER-BASSIST FAT MIKE SAYS that when the guys in the band that would become the pop-punk act NOFX first brought him to an audition, it was simply because he played bass.

“It was weird showing up not knowing anyone,” he told us in an interview we did with him three years ago. “I went to see [the punk band] Code of Honor later that night.

I didn’t even think we’d actually play a show. But me and [guitarist] Eric Melvin started hanging out right away. We wouldn’t practice, but just skateboard.”

The band wrote two songs during that initial session. Not bad for guys who barely knew how to play their instruments. Initially, however, the band didn’t play the kind of melodic hardcore for which it’s now known.

The group, which plays House of Blues on Nov. 14 in support of its latest album, First Ditch Effort, its most introspective collection of tunes to date, originally modeled itself after New York hardcore bands, even though it was based in

Los Angeles at the time.

“When we first started out, we were terrible,” says Fat Mike via phone from Cincinnati where he was workshopping his rock musical Home Street Home. “We were a hardcore band, and I had no idea how to write a melody. When I got Bad Religion’s Suffer in 1988, that’s when I remembered the punk rock group that I grew up on. Instead of sounding like a New York hardcore band, we thought we should sound like a L.A. melodic band. We’re still a hardcore band, but our music is just melodic. Why’d we do it? Just because we can. Songs are better that way. Melody makes songs better — not every song — but you can’t argue against that. The most memorable music has melody. If you want to be memorable, you have to put melody in your songs.”

From the start, the band took a DIY approach that has endeared it to punk purists. It formed its own label, Fat Wreck Chords, back in 1990. Since then, the imprint has released all of its albums.

“I always thought it was a smart way to do it,” says Fat Mike when asked about the band’s independentminded approach. “I knew that we weren’t a band that was going to be a commercially viable radio band.

That’s just not who we are. Once we figured out that we would sell this many records and only draw so many people, why share the money with anybody else? A lot of bands want to see how big they can get. We wanted to see how happy we could be. That’s what we accomplished. We fucking did it right, but only for us.

Green Day did it right for them, but we did it right for us.”

Fat Mike says he remembers being impressed that the hardcore group Verbal Assault sold 10,000 records and that Bad Religion sold 12,000 copies of Suffer the year it came out. But he admits that simply meant you “make no money and maybe draw 500 people at shows and sell out CBGBs.” He says the first few years were difficult ones for NOFX. “We don’t know how we got

through those first six to eight years when no one liked us and we weren’t making any money and there was no future in punk rock,” he says.

“Once we got into 1991, I remember one year we made eight grand, and I thought we could live off that. Then, we got bigger and bigger each year.”

First Ditch Effort finds the band in particularly good form. As it’s put in a press release announcing the album’s release, the group explores “issues of self-loathing and mortality.” The approach Fat Mike took on NOFX: The Hepatitis Bathtub And Other Stories, the band’s memoir, influenced his approach on the album. Fat Mike says the Motley Crue biography The Dirt, and Please Kill Me, a book about punk rock in New York, inspired First Ditch Effort. “[After reading those books,] I thought we had a different story,” he says. “I told the band that if we tell all our stories, we would have a real interesting book on our hands. MUSIC weeks. The reviews have been really good so we’re pretty happy about it.”

The group worked with the director who filmed the documentary series Backstage Passport. He interviewed the group and then he put the book together, and the band edited it.

“It’s all our stories,” says Fat Mike. “We modeled it after The Dirt, but anyone who reads it will think it’s dirtier than The Dirt. Motley Crue told the stuff you expect.

The stuff we talk about is really dark. There’s murder, rape and molestation and lots of heroin and drug dealing and things you don’t think of when you think of NOFX. People think we’re a fun band, but in the ’80s we used to sell acid on tour.

Our drummer was a junkie for six years. We had one guitar player who would rob people’s houses when we were on tour, unbeknownst to us.

There’s a lot of dark shit in there.”

To record the album, the group teamed up with Cameron Webb (Motörhead, Alkaline Trio) instead of its usual go-to guy, Bill Stevenson, who only had a few weeks available to work on the songs.

“I didn’t want to rush it,” says Fat Mike. “Cameron wanted to spend the next two months on it, so we could think about it. I was strung out on drugs at the time, and I wanted to take my time too. It worked out well.

was like, ‘Oh, man.’ I would get up and snort a line of Percocet and coke, and I didn’t like myself. I never hit big bottom like people hit rock bottom and quit drugs. It became a daily routine, and I was like ‘Fuck this.’ I didn’t want to be that person.

It’s not like I really fucked up in my life. I still made this record and wrote a musical and did a book and did a book tour. I was a functional drug addict. I never did that much drugs either. I did enough to where it kept me happy but not to the point when I was all fucked. It’s hard when you have lots of money.

Towards the end, I hired this guy who came on tour with us and held the drugs in a safe. He’d only give me a certain amount. It’s pretty smart.”

He says it wasn’t all that difficult to break his drug habit.

“It was six or eight days that were pretty lame,” he says. “During a lot of that time, I was hiking and surfing and exhausting myself and that helps. If you had to lie in bed for eight days and just feel how bad you felt, that would suck. I was like, let’s walk for 10 miles. You stop thinking about it after a while. It’s like that. It’s more like having the flu. You feel like shit but you wanna go do something anyway.”

While many punk bands implode after only a few months, Fat Mike says he and his bandmates continue to push forward because they have so much fun touring and recording.

“Why would you quit doing this when you have the best job in the world?” he asks. “Punk rock is the

The song “Ditch Effort,” a song distinguished by snotty vocals and snarling guitars, was the result of the band jamming, a rarity.

“We never jam,” says Fat Mike. “I teach the band songs, and we record them. With that song, I came with a riff, and we were in the same room and played it and it was cool. We used those drums from the demo and not from the studio recording.”

Call-and-response vocals give “I Don’t Like Me Anymore” a Bad Religion feel. “That jerk looks like me,” Fat Mike sneers in the selfreflexive tune.

“That’s about me, but it’s not about how I feel myself,” he says.

“When I was using drugs and waking up in the morning and looking at myself in the mirror, it

best job in the world. You play five nights a week for an hour and 15 minutes. You don’t have to practice very much. If you fuck up, nobody cares, and it’s actually kind of charming. You don’t have to answer to anybody. Being a musician is cool, but being in a punk rock band is even better because you don’t have to be perfect. We haven’t practiced yet for the tour. We don’t practice before a tour. For this tour, we have no practice. We have one sound check.

It’s up to each band member to learn the songs. We won’t play them great for a while, but we will play them.”

The Avett Brothers bring their tour to Akron next week.

BEING HERE The Avett Brothers revel in the ecstasy of True Sadness

By Eric Sandy WITH THE TWO-DECADE MARK looming for the Avett Brothers, one of American indie rock’s prized gems, it would be fair enough to assume that they’ve hit the resting-on-laurels point in their career. Once an album like 2009’s I And Love And You gets placed on the wall, what else is there to do besides relax and roll the hits?

And, yes, to a certain extent the albums that followed — The Carpenter in 2012, and Magpie and the Dandelion in 2013 — leaned heavily on the snoozefest descriptor.

They weren’t particularly great albums and, indeed, the shadows of the band’s earlier work ran long and thick. How could they not?

This year, however, the band turned inward, toward the musicians’ roots, and mustered up a proper addition to their history. True Sadness saw the Avett Brothers return to honest form, to a sense of songwriting and recording that was at once quintessentially Avett — their voice, their passions — and also kept an eye directed toward new sonic pastures. Check it out: Under the guidance of longtime producer Rick Rubin, the band began cutting quick demos in the studio, and then remixing and tweaking them into new, more fully evolved versions of the stuff that these guys have been crafting for years.

“We’ve always been interested in all genres and all kinds of sounds,” Scott Avett says in a gentle Carolina drawl. He fronts the band with his brother, Seth Avett, bassist Bob Crawford and cellist Joe Kwon. He adds that the running motif in the band’s work over years has been simplicity in their message — “to make space to make sure what we’re

saying is defined.” Still, these are creative musicians whose interests and influences can’t help but expand.

“That said, we also have been moving — since we began — we’ve been moving and exploring,” Avett says. “I think it comes out in a slow change for us over a career or over a life, although I think it may be burning in a very drastic change within us. We might be thinking in terms of an extreme EDM record that we’re going to make, and then it comes out with just slight EDM nuances. I think that’s what happened with True Sadness. We were thinking of really turning it upside-down with that album, by using the computer and keyboards and some samples and whatnot, but the lyrics kept pulling us back to make sure that whatever message was in the song was heard.

The simple nature of our country sensibility is still there, and we don’t do that consciously.”

In fact, there are versions of all of these latest tunes that are performed entirely by computer-programmed instruments (save for the vocal

creative releases that True Sadness seems to have done for the Avetts.

And it’s not for nothing that this album came when it did.

“Since we had released the last records, a lot has happened in our lives,” Avett says. “From scary and tragic things like illnesses to divorces to exciting and happy things like births and children and even new relationships — all over the map, really, emotionally.”

The band took stock of those swings and, as Avett says, wanted to “get on record” the courses that they’ve charted in the past few years.

With that introspection came an opportunity to see things as they stand in the grand scope of life — to mark the good and the bad against a few decades of experience on this planet. Whereas the guys zoomed in on the minutiae of personal relationships and internal struggles in the past, here they stretched their philosophical legs a bit and accounted for the whole of the human universe.

“The themes at their core are extremely intimate,” Avett says, “but they may get masked with a

work). It’s an “extreme” contrast to the band’s canon, Avett notes, but it’s emblematic of how maturing musicians gather the world around them and then pare down their newfound technique to reflect their own voice. Avett mentioned as an aside that he’s been digging the new Bon Iver record, which accomplished for Justin Vernon many of the same

broadness at times. For example, divorce overall in the broad scope is something that a lot of people experience, where each one is specifically painful in its own different way. My point is: We really just wanted to continue that exploitation of our lives. That’s what we do.”

Two songs worth pointing to,

briefly, are “Smithsonian” and the album’s title track. The former is as jaunty and upbeat a song as the band has ever written, even as the Avetts break down middle-aged revelations on the impermanence of life and love. (“Call the Smithsonian I made a discovery/ Life ain’t forever and lunch isn’t free/ Loved ones will break your heart with or without you / Turns out we don’t get to know everything.”) And on “True Sadness,” the snappy electronic snare alluded to by the band’s newfound remix leanings introduce a song that revels in the warmth of sadness — that old unavoidable friend in this rollercoaster life we lead.

The Avett Brothers have always been an honest band, and that’s because they’re paying attention in an age of distractions and mimicry.

“In time, I think, you return to songs that you had written, maybe, in an aspiration to believe something you were writing or aspiring to — to see in life or to do a certain thing,” Avett says. “I use an example of a song from years ago, ‘Salvation Song,’ which was a song written as young men — relatively bold and aspiring.

Complete aspiration. But you revisit it as an older person than you were when you wrote it, feeling a new conviction for the songs.”

Surely, True Sadness will marinate and refocus the perceptions of its listeners and, indeed, its creators.

For now, it’s a worthy meditation on the tapestry of life in an otherwise unsettled year of American culture.

MUSIC A HONKYTONK HERO Country singer Mark Chesnutt strives to keep traditional country alive

By Jeff Niesel THE MORE COUNTRY MUSIC changes, the more singer-guitarist Mark Chesnutt, a Beaumont, Texas, native, stays the same.

Chesnutt delivered his first hit back in 1990 with “Too Cold At Home.” Major label deals followed.

But when country went pop, Chesnutt and the majors parted ways because he didn’t intend to alter his sound.

Produced by longtime friend and collaborator Jimmy Ritchey, Chesnutt’s new album, Tradition Lives, serves as a statement. It sounds like a throwback to the country music of the ’80s, a time when icons such as George Jones, Merle Haggard and Waylon Jennings could still receive airplay on commercial radio.

“I’ve never changed my direction,” explains Chesnutt via phone from his Texas home. “I stayed on the traditional side. That led to me leaving MCA and then Sony. The reason I left the major labels was because I wouldn’t conform and do the type of music they wanted me to do. I wanted to stick with country — traditional country. I ended up on my own doing independent stuff.”

When Ritchey approached him about cutting an album for his record label, Chesnutt seized the opportunity.

“We had the opportunity to make a new album after a lot of years, and we wanted it to be the best album we’d ever done,” he says.

“We didn’t know for sure if I’d get a chance to record again. I wasn’t trying to get on radio. We knew our chances for that were slim to none. We wanted to make an album for my fans who had been asking for new music for a long time.

That was the whole purpose of this album. We found some great songs, and it got a lot of attention when it was released. A whole lot of people

took notice. It made more noise than we intended to.”

Rolling Stone and other publications that Chesnutt says “never really cared about anything I’ve done since my major days” praised the album.

The disc kicks off with a slide guitar-driven rendition of “I’ve Got Another Quarter in My Pocket,” a song that was a hit for country singer Gary Allan.

“The guy who wrote that song [Jake Kelly] played guitar with Gary back in the ’90s,” says Chesnutt. “Jake told me he wanted me to cut that song. He said he wrote that song with me in mind.

I told him that one of these days I would. Gary’s version isn’t a Texas shuffle all the way through. I got

country was leaning more toward a pop sound,” he says. “It wasn’t the first time. Country did the same thing in the ’80s. It got real slick and polished. We saw these people running the labels and working as consultants for the radio stations. They don’t know that this lifestyle still exists real strong all over the country.

With the song “They’ve Never Been to Texas,” Chesnutt takes a shot at fair-weather country music fans.

“This was a song that was written way back in the ’90s when

Some of those people never get out of Nashville or New York or Los Angeles. Some have never been to small-town Texas and seen honkytonks are still going like they always have been. We weren’t trying to knock anybody. We were just picking at them. We were just poking fun.”

Chesnutt says he passed on the bluesy “Hot” years ago because the

hokey song had no hope of getting radio airplay.

“This time, I didn’t shoot for airplay,” he says. “I wanted to make a good album for my fans. That’s why I did songs like that. I knew ‘Hot’ would never get played. I had creative freedom and nobody was telling me what not to do. We had a great time recording it. I had more fun doing this album than I ever have in my life on any other album.”

Chesnutt says he has about 20 songs ready to go for the next album. He admits that given the state of the music business, he might just have to release it himself.

“Wherever we land, I’m sure I’ll be in the studio again or doing it myself,” he says. “I have several live albums and greatest hits things that I have done myself on my own label, so that’s certainly a possibility.”

Cabinet/Horseshoes & Hand Grenades: Here at Scene, we relish a good bluegrass band that knows how to utilize percussion. Cabinet is one of those bands, and we’re always happy to see how often they grace Northeast Ohio with their presence. On their last album, 2015’s Celebration, the band takes the theme of opening cut “Old Time Songs” to heart; this is music that harkens back to simpler times, often eschewing the “newgrass” label that so often sticks to bluegrass bands these days. Now, that’s not to say that these guys can’t get down: Cabinet is known for high-energy live shows and a dose, now and then, of hearty improvisation.

She was on the TV show Gossip Girl for many years and she played the role of Cindy Lou in Dr. Seuss’ How the Grinch Stole Christmas. But she’s always loved rock ’n’ roll too. She formed the hard-rocking Pretty Reckless in 2009; a year later, the band released its full length debut Light Me Up, an album that yielded hits such as “Make Me Wanna Die.” The group has been going strong ever since. The Wood Brothers/Dylan LeBlanc: Delicate, soulful and funky: The Wood Brothers blend a nice variety of American musical traditions into their stuff, and they tend to bring a charming and profound presence to the stage. We loved their show at the Kent Stage a few years back, dotted with older tunes and newer cuts from Paradise, which had only recently come out at that point. They’ll get you dancing and thinking, and we certainly condone that. With Oliver Wood’s masterful vocal work and Chris Wood’s topof-the-game bass playing — along with the multi-instrumentalist curiosities of Jano Rix — the band twists the traditions of folk music into a complex and inviting web.

EX-ASTRONAUT

By Jeff Niesel MEET THE BAND: Pat Gang (bass), Christoper Hoke (vocals, guitar, Christopher Kochera (drums) and Pete Jennings (guitar) THE NAME GAME: Even though indie rockers Ex-Astronaut only came into existence last January, the band has existed under a different name, albeit with a different lineup, since August of 2009 when it was known as Field Trip. The band had started to record and mix its latest album, No More Dreams, when other bands with the name Field Trip came to the group’s attention. One was in New York and one was in Minneapolis. The Minneapolis group toured through Cleveland and the venue was confused about which band was playing, the Minneapolis one or the Cleveland one.

“It became a pretty big problem and we had a good opportunity to change the name,” says Jennings. “We wanted to make the change and start fresh.

We played stuff that was more of a fuzzed out indie rock kind of sound.”

In February of 2010, Chris Hoke came in as singer and guitarist. The group added Kochera and Gang on drums and bass in 2013. “With the current lineup, we have shifted away from the fuzzed out Dino Jr. stuff and started playing the shoe-gazer stuff we play now,” says Jennings. “We want the guitars to not sound like guitars.”

A TWO-YEAR PROCESS: Engineered and mixed by John Delzoppo at his locally based Negative Space studio, No More Dreams was mastered by Ryan Morey at Ryan Morey Audio Mastering in Montreal. “It was a twoyear process of recording, playing shows to raise money, mixing, playing more shows to raise money, changing the band’s name due to some very odd circumstances, mastering and playing even more shows to raise money for

pressing,” says Jennings. “We try to save as much money as we can from playing shows to finance our recordings.” A grant from the Panza Foundation, a local institution that helps fund projects by local bands, made the recording possible. “That helped us finish the record,” says Jennings.

WHY YOU SHOULD HEAR THEM: Songs such as “Falling Apart” feature woozy vocals and trippy guitar riffs that escalate into bursts of noise. Jennings and Hoke split songwriting duties.

“He’ll have a riff that we jam on or he’ll record at home and text us the sound files,” says Jennings. “I do the same thing and send things out to the guys and we come together at practice to arrange the songs. Chris handles all the vocal duties. With this album, we wanted to expand our sound and try new things. It’s certainly fun writing Dino Jr.-inspired guitar rock but you can only do that so much. For all of us, bands like My Bloody Valentine, Ride and Slowdive and older altrock act like Nirvana or Smashing Pumpkins speak to us.” The album will be released digitally and on vinyl.

One special colored vinyl version from locally based Wax Mage Records will be raffled at the release show.

SAVAGE LOVE AARON THE SIDE

by Dan Savage Dear Dan, I am a bi man in my late 20s in a poly relationship. My primary partner’s name is Erin. One of the rules she mandated is that I cannot date anyone else named Aaron or Erin. She thinks it would be confusing and awkward.

Since those are fairly common names, I have had to reject other Aarons/Erins several times over the last couple of years. Overall, it seems like a superficial reason to reject someone. Is there any sort of compromise here? We haven’t been able to think of any work-arounds.

— Not Allowed Multiple Erins I can’t count the number of gay couples I’ve met over the years where both men or both women had the same first name. Okay, okay, it’s not a parallel circumstance, I realize. But having a hard-and-fast/deal-breaky rule about names strikes me as silly and reductive.

We are not our names, and our names are not ours. (I am not the only Dan Savage out there, nor am I the only Dan Savage capable of giving decent sex advice, as my substitute Dan Savages ably demonstrated this summer.) So here’s my suggested work-around, NAME: Your primary partner stops being a ridiculous control queen.

But just in case you want a second opinion …

“This poor woman wants to make sure that when her lover cries out her name, he really means her,” said Dossie Easton, coauthor of The Ethical Slut: A Practical Guide to Polyamory, Open Relationships & Other Adventures. “I can understand this, but I’m wondering if there could be a work-around with nicknames — actually, that could get kind of sexy. ‘Hey, Bear! Gimme a hug.’

‘Ooh, Tiger, you are so fierce tonight!’ In all seriousness, many lovers have very personal nicknames for each other, and perhaps that would make the ‘Aaron/ Erin’ problem manageable.”

Would you like a third opinion?

“It sounds like Erin has that most common of polyamorous fears: the fear of being lost in the crowd,” said Franklin Veaux, coauthor of More Than Two: A Practical Guide to Ethical Polyamory. “Some folks deal with this by passing rules against taking a date to a favorite restaurant or forbidding certain pet names. It sounds like Erin is dealing with her fear by saying, ‘Don’t date any more Erins.’ The problem is that names don’t make you unique. Erin isn’t special in NAME’s eyes because

of her name. But sometimes putting words on a fear is the first step toward eliminating it. She says dating another Erin would be ‘confusing and awkward.’

What does that mean? What are Erin’s concerns? If it’s only feeling awkward, well, being an adult means feeling awkward sometimes!”

To recap: Your primary partner needs to get over it (Dan’s advice), your primary partner might be mollified if you swore to use only pet names for other Aarons/Erins (Dossie’s advice), keep talking and maybe your primary partner will get over it (Franklin’s advice). All in all, our expert panel doesn’t have a lot of sympathy for your primary partner’s position. So in the interest of fairness, I’m going to offer a defense of Erin’s position.

It’s not uncommon for people in open relationships to insist on a rule that seems arbitrary, even capricious, to their partners. I call these rules “Brown M&Ms,” a reference to 1980s hair rock band Van Halen. The band’s touring contract stipulated that bowls of M&Ms be set out backstage with all the brown M&Ms removed. To see if their contract had been followed to the letter — a contract that included a lot of technical requirements for their elaborate and potentially dangerous stage shows — all the band had to do was glance at those bowls of M&Ms. If a local promoter couldn’t be trusted to get something simple and seemingly arbitrary right, they couldn’t be trusted to get the bigger stuff right. And if the promoter didn’t get the big stuff right, it wasn’t safe for the band to perform.

Arbitrary rules in open relationships are like Van Halen’s brown M&Ms: a quick way to check if you’re safe. If your partner can’t be trusted to not sleep with someone else in your bed, not take someone else to a favorite restaurant, not use your favorite/special/ beloved sex toys with someone else, etc., perhaps they can’t be trusted to get the big things right — like ensuring your physical and emotional safety and/or primacy. So, NAME, if obeying a rule that seems silly and arbitrary makes your partner feel safe to “perform,” i.e., secure enough to be in an open/poly relationship with you, then obeying their seemingly silly rule is the price of admission.
