COUNTY EXECUTIVE ARMOND Budish scampered to the offices of Cleveland.com last Thursday, accompanied by high-powered attorney Fred Nance and county law director Robert Triozzi.

The trio’s mission: Assure the reporters and editors that the selection of Nance as negotiator and of his firm, Squire Patton Boggs, as bond counsel in the Q renovation deal was totally above-board and sensible, despite the absence of a formal bidding process.

County councilman Jack Schron, during deliberations on the deal two weeks ago, noted the “awkwardness” of the arrangement. An amended version of the renovation resolution

included a no-bid clause. And to Schron, it seemed odd that Nance’s firm should get the $325,000 bond contract without a bid after Nance had negotiated on the county’s behalf in the first place. (The chipper Nance was pleased as punch to admit that he’d negotiated on behalf of the Cavs and Destination Cleveland as well.)

“There are efficiencies that can be achieved with this deal,” Nance told Schron at the meeting, in defense of his firm. “It is not a cookie cutter deal.

There are complexities and layers to it because of the Cavs’ participation and the Cavs’ standing behind some of the public revenues. All of which is why the decision was made that we would

be primarily consideration to do this work” [sic].

At Cleveland.com on Thursday, Nance, Budish and Triozzi elaborated: The county had interviewed six alternative firms, they claimed, before deciding on Squire Patton Boggs. The firm had sold more bonds last year than any other firm in Cleveland and seemed especially qualified. As for Nance, who will be paid $25,000 for his work: He was tapped, basically, because he’s buddies with the sports execs.

“Fred had good personal contacts with the parties in the deal, and he understood sports facilities,” Budish told Cleveland.com.

Nance called himself the “obvious negotiator choice” because of his contacts in Cleveland and the sports industry and due to his experience negotiating contracts for Cleveland’s football stadium and the medical mart.

He said his negotiating approach is “to look for the win-win instead of bludgeoning the other side into submission.”

(It should be noted here that the Q transformation deal as it stands is essentially the same version proposed by the Cavs two years ago. If Budish and hound-dog negotiator Nance managed to do naught but rubber stamp a conceptual framework as proffered by the team, are taxpayers

Two weeks after that, Squire Patton Boggs PAC gave $2,500 to Budish’s campaign, via county financial reports. That donation wasn’t out of the ordinary. The firm had donated $3,000 to Budish’s campaign in 2013 and $2,000 in 2014 (both as Squire Sanders LLC). In addition, the firm had made in-kind contributions of $701 and $654 in 2013 and 2014: “beverages, appetizers, tip, parking.”

Other major players in the Q deal negotiations have contributed to Armond Budish as well, which should heighten observers’ concern about the county executive’s obstreperous fearmongering on the Cavs’ behalf.

Len Komoroski, the president of the Cavs and Quicken Loans Arena and a board member at Destination Cleveland, donated a cool $2,000 to Armond Budish’s campaign in October, 2014, campaign finance records show.

Komoroski was later tapped to serve on Budish’s “transition team.”

Also serving on the transition team was attorney Helen Forbes-Fields, who donated $200 to Budish’s campaign.

(Forbes Fields & Associates will work alongside Squire Patton Boggs to “structure the transaction” related to the sale of bonds.)

PITTSBURGH, FOR ONE, STANDS UP TO STADIUM UPGRADES And since we’re on the stadium beat: Just last week, Pittsburgh’s Sports and Exhibition Authority rejected the idea of public financing for enhancements at Heinz Field, home of the Steelers.

The enhancements, which would have included Wi-Fi access across the stadium, a new Jumbotron and 2,000 additional seats, were being positioned as a linchpin in a bid for an upcoming Super Bowl. But the city’s mayor and its Sports and Exhibition Authority said no.

“What they’re asking for is tens of millions of dollars in public money, out of a fund that doesn’t have nearly enough,” Pittsburgh mayor Bill Peduto said. “They want to have a state-ofthe-art Wi-Fi system for eight games a year. I want state-of-the-art Wi-Fi in every one of my schools for 180 days a year. I want to have the ability to reinvest in neighborhoods, not just reinvest in a Jumbotron.”

As the Field of Schemes watchdog blog noted, that’s not a perfect equivalence: The fund in question is reserved for capital improvements at Pittsburgh stadiums. (So it couldn’t be used for schools.) But if the fund runs dry — if it’s exhausted on a particularly expensive upgrade, for example — monies would then be siphoned from the city’s general fund, so leaders have reason to be cautious.

Back home, recall, Cuyahoga County councilman Dale Miller made a similar observation during county council’s most recent deliberations on the Q renovation plan. He suggested it was imprudent to create a reserve fund that would be used exclusively for debt service on the arena renovation when “we can’t even pay for basic maintenance.” (County financial adviser Tim Offtermatt had suggested earlier that the county sin tax, which was renewed in 2014, would likely be insufficient to cover maintenance costs at the three Cleveland stadiums in the future.)

As in Cleveland, which has been promised an All-Star game if the Q is renovated, Pittsburgh had been attempting to lure the 2023 Super

Bowl with the Heinz Field upgrade.

Those attempts have halted for now.

Said Mayor Peduto: “I would like [the Super Bowl], but it’s not that important to me. I’d rather have quality schools, I’d rather have adequate stafďŹ ng of police. I’d rather have safe streets.â€?

Steelers ofďŹ cials have naturally expressed frustration in their comments. They said there was a “lack of cooperationâ€? and called their relationship with their landlord (the Sports and Exhibition Authority) “no longer functionalâ€?; but there has been no threat that the team will abandon the city if the upgrades aren’t publicly ďŹ nanced. In fact, in 2013, after more than a year of litigation, Peduto and the SEA got the Steelers to pay an additional $2.1 million in annual rent to fund an earlier stadium expansion.

AFTER COMPLAINTS, CLEVELAND ESTABLISHES PROGRAMS TO ASSIST NONENGLISH SPEAKING RESIDENTS Last week, mayor Frank Jackson joined Global Cleveland president Joe Cimperman in announcing a sweeping update to the city’s language accessibility program, largely noting to the public that one now exists.

Thanks to at least a year of planning and work, documents and city news and phone communications will be available across a spectrum of languages, including Spanish, which is spoken by 7.4 percent of the population (approximately 28,000 residents).

The “Language Access Planâ€? began in earnest last spring, following a series of misďŹ res with Cleveland’s English-only communications. For instance, about two years ago, a Spanish-speaking couple in Ohio City had received a postcard about how the city’s trash and recycling pickup was changing. If you put your trash and recycling out on the wrong day, you’re assessed a ďŹ ne. The couple was assessed a ďŹ ne, and they weren’t sure why.

The Legal Aid Society stepped in, and found that the city had made no attempt to communicate the news in any language other than English. “That caused us to look into what’s going on at the city in terms of language access,� says Melanie Shakarian, director of development

and communications at the Legal Aid Society of Cleveland. “At the time there wasn’t too much.� Legal Aid got the ball rolling.

She and her organization began reaching out to Jackson and council president Kevin Kelley. Legal Aid outlined the impact on the nonEnglish-speaking population, which is not insubstantial. Jackson and the city dug in, and began surveying each department at City Hall to determine the spectrum of language needs at play. (“The city was really wonderful for us to work with,� Shakarian tells Scene.)

Cleveland, of course, is a city with a long track record of welcoming immigrants. This new plan gets City Hall in line with that history. “It’s so important to put a ag in the moon, right? And just say we’re here, we’re surviving, we’re thriving,â€?

Cimperman tells Scene. “It’s true: There’s a lot of anxiety right now in the international community. People who are worried about [whether] they’re going to check their papers at the airport, people who are being questioned — not in Cleveland, but around the country. We’ve been trying to do whatever we can to convey to the international community that we’re here for you.�

As the Language Access Plan states: “Title VI of the Civil Rights Act of 1964 is a federal law requiring meaningful access to services for those with limited English proďŹ ciency.â€? In the event that a Spanish-speaking Cleveland resident needs to, say, pick up a copy of a birth certiďŹ cate at City Hall, the city must make communication and access to materials available in that language.

It’s a civil right, and a public entity that does not comply would be violating federal law. (See the Cleveland Metropolitan School District resolution agreement signed in 2011.)

Central to the plan was the city identifying 74 “vitalâ€? documents (like birth certiďŹ cates) to be translated into other languages, along with other areas of need (like phone interpretation services). By last fall, the phone and web and written services were quietly updated, brought into compliance with Title VI. This week, the city announced its completion of the plan. Outreach and advertisements are occurring now.

A city spokesperson noted that the plan “will continue to evolve.�

At a press conference last week, Jackson said, “What we wanted to let them know is that this is Cleveland.

Our personality, our culture, our character is not in line with the hate.�

On the subject of naming Cleveland a “sanctuary city,� Jackson demurred. (“We just do what we do,� he said.)

With the backing of the Northeast Ohio Coalition for the Homeless and the ACLU of Ohio, local disabled veteran John Mancini ďŹ led a federal lawsuit against the city of Cleveland over its anti-panhandling laws.

At issue are two Cleveland ordinances that restrict solicitation on sidewalks and roadways. â&#x20AC;&#x153;Solicitationâ&#x20AC;? is deďŹ ned as speech that â&#x20AC;&#x153;request[s] an immediate donation of money or other thing of value from another person, regardless of the solicitorâ&#x20AC;&#x2122;s purpose or intended use of the money or other thing of value. The solicitation may be, without limitation, by the spoken, written, or printed word, by gesture or by other means of communication.â&#x20AC;?

Mancini states that in December 2016 and January 2017, he â&#x20AC;&#x153;was ticketed four times and convicted once for violating Clevelandâ&#x20AC;&#x2122;s AntiPanhandling Ordinances. During this time, and since, he has also been repeatedly told to leave areas where he has panhandled, and threatened with arrest ... . Since his tickets, the police threats and harassment against [him] have escalated, and he is now too afraid to panhandle in downtown Cleveland.â&#x20AC;?

Recently, according to the lawsuit, Mancini has posted up on Euclid Avenue near East 14th Street, with a sign that reads: â&#x20AC;&#x153;wartime vet; can you please help a vet trying to get by; your help appreciated.â&#x20AC;?

According to NEOCH and Mancini, the Cleveland Police Department issued more than 5,800 tickets for violations of the Anti-Panhandling Ordinances between 2007 and 2015. Currently, violation of the ordinance comes with a $55 ďŹ ne. Ballparking the hypothetical impact of those violations â&#x20AC;&#x201D; assuming the tickets werenâ&#x20AC;&#x2122;t nulliďŹ ed in court or not paid â&#x20AC;&#x201D; thatâ&#x20AC;&#x2122;s more than $319,000 in revenue off the backs of Clevelandâ&#x20AC;&#x2122;s homeless population in that time span.

On top of ďŹ nes, there are court costs, which tend to grow as quickly as criminal dockets in Cleveland Municipal Court. NEOCH points out that homeless men and women often donâ&#x20AC;&#x2122;t have reliable transportation and,

in all honesty, canâ&#x20AC;&#x2122;t even afford the ďŹ ne in the ďŹ rst place; many people tend not to show up to court hearings. At that point, Cleveland police identify and jail the no-show defendants. â&#x20AC;&#x153;In addition to being unconstitutional, anti-panhandling ordinances are bad public policy,â&#x20AC;?

Mike Brickner, senior policy director at the ACLU of Ohio, said in a public statement today. â&#x20AC;&#x153;Homelessness and poverty are distressing issues, and being confronted with them can make us feel uncomfortable. But criminalizing poverty â&#x20AC;&#x201D; especially by ticketing or jailing individuals in violation of the First Amendment â&#x20AC;&#x201D; is not a solution.â&#x20AC;?

IN THE FIGHT TO OUTLAW MARITAL RAPE EXEMPTIONS, OHIO REPUBLICANS GO SILENT Despite marital rape being illegal in most cases across most of the U.S., the Ohio Revised Code allows for several gaps where a spouse may not be charged with rape in the event of what otherwise seems exactly like rape. In Ohio, there must be some â&#x20AC;&#x153;force or threat of forceâ&#x20AC;? in order to warrant prosecution. The codiďŹ ed exemptions remain a legal problem for those ďŹ ghting against domestic and sexual abuse.

For example, a man may drug his wife and rape her â&#x20AC;&#x201D; and there is no state law through which to press charges (unless they live apart).

Now, two state legislators are mounting a challenge. Reps. Greta Johnson (Akron) and Kristin Boggs (Columbus) introduced HB 97 in late February, which would put an end to those exemptions. No Republican representative has signed on as a co-sponsor. â&#x20AC;&#x153;We must modernize Ohioâ&#x20AC;&#x2122;s laws and eradicate unacceptable policy that allows someone to commit violence against their spouse,â&#x20AC;?

Boggs said in a public statement. â&#x20AC;&#x153;Women and men experiencing sexual violence at the hands of their spouses should not be denied the right to seek justice just because they happen to be married to the offender.â&#x20AC;?

This is an extremely archaic framing of law, of course: English common law maintained for centuries that it was impossible for a husband to rape his wife. The concept, back then, was a legal nonissue. Still, such exemptions persist in large swaths of the U.S. In 2015, the Cleveland-Marshall College of Law published a report on the injustices behind Ohio’s marital rape exemption.

“Undoubtedly, the government could have prosecuted the husband with a crime other than a sexual offense, such as assault, felonious assault, or corrupting another with drugs,” the report states, illustrating how rape exemptions could be alternatively prosecuted in Ohio. “However, these offenses do not vindicate the same social harms as the sexual offenses, most importantly a person’s sexual autonomy — the right to choose whether to engage in sexual conduct or contact with another person.”

It’s a point that Johnson and Boggs may help vet in future

hearings on their bill. But even that — the conversation — is a long shot; Ohio Republicans have a history of stonewalling this sort of legislation.

In 2015, Johnson introduced a similar bill, which languished on committee agendas before dying quietly. (Only Rep. Teresa Fedor, D-Toledo, signed on as a co-sponsor that time.) As the Akron Beacon Journal’s Doug Livingston points out, that bill also sought a repeal of the statute of limitations on rape and sexual assault cases. Republican lawmakers pushed back, and ultimately Johnson dropped that provision from the new bill.

“I am appalled that there is not a larger discussion in our state about this issue,” Johnson said. “I am deeply disappointed that none of my Republican colleagues signed on as co-sponsors to this bill — protecting victims of sexual assault and rape should have nothing to do with partisan affiliation.”

The CSU report sticks its landing: “Ohio’s partially abolished marital exemption cannot be justified under any coherent theory of justice, appears to survive merely due to inertia, and certainly does not serve the best interests of Ohio residents.”

EUCLID JAIL SUPERVISOR UNDER INVESTIGATION FOR MISUSE OF POLICE DATABASE, ARRESTED FOR STALKING INCIDENTS Steven Key, previously a supervisor at the Euclid jail, which is run by the Cuyahoga County Sheriff’s Department, was arrested

by Euclid police on a warrant for menacing by stalking last week.

The arrest is tied to the investigations currently underway or wrapped up by the Euclid jail and Cuyahoga County into alleged misuse of the LEADS law enforcement database by Key and Quincy Jimson, previously an officer at the jail. (Both have since been reassigned from the Euclid jail to the county jail downtown.)

Police reports from Euclid detail not only the repeated interactions with Key’s now ex-wife and her new boyfriend that led to the arrest, but also the discovery that Key and Jimson used LEADS to track him down. (LEADS is the Ohio Law Enforcement Automated Data System, which is maintained by the Highway Patrol. It’s an essential and useful tool that’ll pull up everything from addresses to phone numbers,

criminal records to Social Security numbers. It’s also confidential and regulated by very specific rules on who can access information and for what reasons. Misuse can result in a felony charge in Ohio.)

The narrative goes like this: Key had repeatedly visited the house he used to share with his ex-wife, against her wishes. She contacted police and noted that Key had driven by multiple times a day and on at least one occasion visited the house and confronted her new boyfriend in the driveway. The first complaints occurred in December, while Key and the woman were in the midst of their divorce, and the police reports note they continued in the early weeks of February after the divorce was finalized.

In the midst of the investigation, the boyfriend informed police that he believed Key had also visited his residence and that he had suspicions that Key had used his access to the police database to find the address.

Euclid police looked into that claim and quickly found a mountain of evidence.

The video also showed Key leaving the facility, while on the clock, for about 30 minutes moments later.

During an interview with detectives, Key said he knew misusing LEADS was illegal but that he believed this wasnâ&#x20AC;&#x2122;t a misuse of the system; he also stated that Jimson had, by his own volition, looked up the plate. He did, meanwhile, conďŹ rm that he had visited the address during the 30 minutes he had left the jail A subsequent interview with Jimson told a different story. After nervously hemming and hawing, Jimson said that Key had speciďŹ cally requested that he run the plates.

Asked if a supervisor had ever before asked him to use LEADS to look up a license plate, Jimson admitted this was the ďŹ rst and only time in his 22year career.

DONALD TRUMP WANTS TO CUT GREAT LAKES FEDERAL FUNDING BY 97 PERCENT Early reports of President Donald Trumpâ&#x20AC;&#x2122;s U.S. EPA budgetary plan show that the Great Lakes Restoration Initiative annual funding could be slashed from $300 million to around $10 million. Thatâ&#x20AC;&#x2122;s a 97-percent decrease in federal funding for resources for the worldâ&#x20AC;&#x2122;s largest group of freshwater lakes.

Rob Davis at The Oregonian has been reporting on the Presidentâ&#x20AC;&#x2122;s apparent plan to cut some 3,000 employees from the U.S. EPA â&#x20AC;&#x201D; and $2 billion from its budget. The cuts would also dramatically impact the Puget Sound, the Chesapeake Bay, diesel emissions standards, beach water quality testing and a spectrum of environmental education programs for children, that last category being slashed from $8.7 million annually to $555,000.

Great Lakes scientists are already bracing for the absolute havoc that would come with a federal EPA budget positioned like so. Just last month, at an international Great

Lakes gathering, Jeff Reutter, special adviser for the Ohio Sea Grant program, said, â&#x20AC;&#x153;If we lose the EPA, we lose Lake Erie.â&#x20AC;?

In question, too, is the very existence of the U.S. EPA. HR 861, introduced by three Republican representatives from the South, seeks to eliminate the agency altogether.

Based on the tenor of recent Senate conďŹ rmation hearings and the Presidentâ&#x20AC;&#x2122;s general approach to environmental regulations and oversight, itâ&#x20AC;&#x2122;s not outside the realm of possibility that this resolution is approved. The pollution of Lake Erie (and the Cuyahoga River) led to an increased social awareness of environmental decline and our human impact, which in turn led to things like the creation of the U.S. EPA and the Clean Water Act of 1972.

The health of Lake Erie is, obviously, of critical importance to the city of Cleveland and all of northern Ohio. Last year, U.S. EPA senior adviser Cameron Davis outlined the speciďŹ c impact of Great Lakes Restoration Initiative funding on our little corner of the region.

awarded $500,000 to purchase 290 acres of easements in the Chagrin River watershed, and will add another $1.2 million in donated easement value and staff time to establish a 1,350-acre corridor of protected lands in the Lake Erie basin. The easement includes stream bank stabilization and protection, which will eliminate about 38,000 pounds of sediment deposition to Lake Erie annually,” (emphasis ours.)

And: “Winrock International Institute for Agricultural Development was awarded $500,000 to work with farmers to reduce the discharge of nutrients and sediments to Lake Erie by increasing their participation in pay-forperformance conservation. This project is expected to reduce 3,700 pounds of total phosphorus; 1,850 pounds of dissolved phosphorus; 4,400,000 pounds of sediment; and 100,000 pounds of nitrogen to Lake Erie annually, helping alleviate the complex harmful algal bloom problem.”

Remember that the algal bloom problem directly led to the city of Toledo shutting down its water supply — affecting some half a million residents — for three days in 2014.

for programs that combat phosphorus runoff in Ohio and elsewhere, the presidential administration is teeing up a repeat of Toledo’s experiences in any number of municipalities around the region. There’s no other way to argue the merits of Trump’s EPA budget proposal.

Read up the Great Lakes Restoration Initiative, before the U.S. EPA website is deleted entirely.

In short, the initiative has intended

“to strategically target the biggest threats to the Great Lakes ecosystem and to accelerate progress toward long term goals.”

In championing that progress, Davis offered what now reads like a long-lost proclamation from another era in our country’s history: “With support from a strong alliance of bipartisan senators, representatives, states, tribes, municipalities, conservation organizations and

businesses, the Great Lakes Restoration Initiative will keep making strong investments to resuscitate the Lakes.”

Trump’s EPA plan isn’t approved yet; EPA administrator Scott Pruitt has said that he will likely offer his own changes to the budget. — Sandy

BUSES ARRIVE ON PUBLIC SQUARE But what’s the deal with ugly new safety features?

By Sam Allard BRIGHT AND EARLY MONDAY morning, RTA buses began traveling through Public Square for the first time in two years. After months of negotiations between the City of Cleveland, the Greater Cleveland Regional Transit Authority (RTA) and the Federal Transit Administration (FTA), Mayor Frank Jackson relented at last and agreed to open Superior Avenue through the Square with a few modifications.

Superior was supposed to have opened to buses Aug. 1, 2016, but never did. After weeks of private deliberations, Mayor Jackson and RTA CEO and general manager Joe Calabrese announced Nov. 15 that the Square would be closed to buses permanently. That announcement rankled many of those who depend on public transit, those concerned about the forsaken $50-million James Corner design and members of City Council, who had been as deprived of information as every other citizen.

Mounting public pressure and a looming FTA debt forced Frank Jackson’s hand. After the completion of both a traffic and safety study last month and extensive testing last week, the Square was deemed suitable and safe for buses.

To expedite matters, if the Square did not open by Tuesday, the FTA would have demanded the repayment of a $12 million debt caused by Superior’s closure. The FTA had granted RTA two extensions, but said that March 7 would be its final deadline.

Monday, the four bus routes that were originally designed to serve

stops on Superior began to do so: the No. 3, No. 26, No. 38, and No. 81.

Additionally, the No. 22, No. 45, No. 51, No. 55, No. 79, and the suburban Parkand-Rides No. 246, No. 251 and No. 263 ran through the Square without making stops. The only difference from the original plan was that the E-line Trolley continued to go around the Square instead of through it.

Clevelanders for Public Transit, the organizing coalition that mobilized in the wake of the decision to keep Public Square closed, announced its excitement at the long-awaited decision in a press release.

“We remain optimistic that the new configuration will be improved and optimized for GCRTA riders and operators, pedestrians, individuals with disabilities, as well as cyclists,” the group wrote. “Reopening Superior through Public Square increases safety in a pedestrian-heavy area ... . Most of all, we want to thank riders for their patience.”

Clevelanders for Public Transit handed out 216 doughnuts at 5 p.m.

Monday to signify the 216 days since Aug. 1 when Superior was originally to have opened. (216, incidentally, is also Cleveland’s area code.)

THE CHANGES Superior is now the site of some very ugly new features, added ostensibly for the purposes of safety. Concrete jersey barriers (the same sort that you see on highway construction projects) now funnel pedestrians from the two original crosswalks to a new brightly

striped crosswalk. Yellow ramps have been added to help those with disabilities or limited mobility get from the curb to the crosswalk.

The striping was completed by RTA. The barriers were installed by the city. And though they’re thought to be temporary — the hope, according to one RTA staff member working at the Square on Monday, is that the city will install bollards eventually — some observers are convinced Mayor Jackson wanted to make the Square unsightly on purpose, as an act of revenge.

“These do nothing,” said Ken Prendergast, executive director of the transit advocacy group All Aboard Ohio, when asked about the barricades.

“They’re there for the city to prove that they were right all along, and that any kind of solution to bring buses to the Square will be completely ugly. It’s ugly by design, so that people will say let’s go back to how it was.”

Prendergast argued that the Square remained accessible from the north and south sides, and that the city’s safety concerns — Jackson has been preoccupied with the threat of lone-wolf terrorists using Superior to barrel into gathered pedestrians —are specious, given the other points of entry.

“I know that terrorists aren’t the most brilliant people in the world,” Prendergast said, “but any terrorist with two eyes and a pea for a brain could see that there are other ways to drive onto the Square. Yet these transitonly lanes are supposedly the weak, vulnerable spot that will be exploited by the terrorists of the world. Thank god the city’s there to save us!”

Prendergast scoffed at the yellow ramps and called the entire setup on Superior the “most bizarre thing [he’d] ever seen.”

“The city either has no idea what they want to do long term, or they’re doing this expressly because it’s ugly,” Prendergast said. “It’s either expedient or it’s tactical. But either way, it’s mindblowing.”

In addition, bike markings on Superior have been removed. RTA deferred all questions on that subject to the city, which handles bike lanes.

But the city did not respond to Scene’s requests for comment.

The Plain Dealer reported that Robert Mavec, the city’s traffic engineering commissioner, wrote an email to Bike Cleveland’s executive director Jacob VanSickle stating that the removal of the bike markings were necessary, but not permanent.

“This is a temporary condition as we work through a final design concept that will incorporate all users and satisfy the safety concerns,” Mavec wrote in that email.

CITY COUNCIL Councilman Kerry McCormack, in whose ward Public Square resides, told Scene that through the entire process, he has had people from both sides of the issue calling and emailing him at a furious pace. It’s been a hot topic since virtually the moment he assumed the Ward 3 council seat last year.

“It wasn’t overwhelming in either direction,” he said, “and I think that’s important to establish. But with the | clevescene.com | March 8 - 14, 2017 19

McCormack said he wants to see the city invest in “getting people around in different ways,” and says that how to stretch available transportation dollars in creative ways will be an important conversation “as we think about the future of our city.”

Council, of course, played a more or less invisible role in the Public Square debate. Many councilpeople — as Scene and Cleveland Magazine most recently have reported — weren’t even aware of the Public Square closure until the Nov. 15 press conference.

They weren’t party to the negotiations and they seemed to have no say in the matter at all. They hosted one angry hearing on the subject, at which council members took turns berating Joe Calabrese and the mayor’s chief of staff, Ken Silliman, while decrying their lack of involvement and ridiculing the city’s safety concerns.

The idea of terrorism on Public Square, for example, was “laughable,” according to westside councilman Brian Kazy.

Despite their frustrations, council contends that their hands have been legislatively tied.

“Our attorneys on council advised us that this was an administrative decision,” McCormack told Scene.

“Even with the transit zone, council authorized the administration to enter into the agreement; opening or closing a street is an administrative action.

We couldn’t have passed an ordinance opening the street.”

This is indeed the opinion of council attorney Rachel Scalish. On Feb. 7, she sent an email with precisely the same ideas to council.

“Council, as the legislative body, authorized via legislation the administration to enter into the Euclid Corridor Project with the RTA,” Scalish wrote. “The signatories on that agreement are the City of Cleveland through its administration and the RTA. Council is not a party to that agreement and therefore has no rights or obligations under the agreement.

“Closing a city street is an administrative function (not legislative)

and falls under the general duties of the Mayor’s Office of Capital Projects, Section 123.03 of the Codified Ordinances. The Council does not have any authority over street closures.”

The above are two separate issues.

Council did indeed authorize the administration to enter into the Euclid Corridor Project. That was through Ordinance 893.03. But Article 11 of the very same ordinance says that the “provisions of this Agreement may be modified or amended only after receipt of legislative authorization of Cleveland City Council and the GCRTA Board of Trustees.”

That’s why Clevelanders for Public Transit had been clamoring for council to “assert its legislative authority.”

When Scene asked council president Kevin Kelley about the issue, he said he’d have to do more research on it.

Council spokespeople have yet to clarify whether the administrative function of closing a city street (codified in 123.03) supersedes the interagency agreement established in Ordinance 893.03.

LOOKING AHEAD The ramifications of the Public Square debacle will persist for years to come, though Frank Jackson is unlikely to bring that up at his State of the City address on Thursday.

Joe Calabrese has mentioned that he worried about jeopardizing RTA’s relationship with the federal government, which provides millions of dollars to RTA every year. Brian Cummins expressed the same fear at their council hearing.

Ken Prendergast felt the same way.

He’s been tracking the $600 million RTA needs in state of good repair investments — including an updated rail fleet — and can’t muster much confidence.

“Ultimately, the feds are investors,” Prendergast told Scene. “And from now on, any application with Cleveland as a return address is going to be looked at as a risky investment.”

Violins of Hope Encore Concert For the past two decades, Amnon Weinstein has restored violins that survived the Holocaust. In 2015, seven local cultural arts organizations worked together to

bring the instruments to Cleveland with an array of public events. A Violins of Hope exhibition at the Maltz Museum of Jewish Heritage featuring the violins and their individual stories resulted from the community-wide collaboration, and the Cleveland Orchestra played the instruments at a special concert.

The orchestra will revisit the collaboration today with a noon concert at the Milton and Tamar Maltz Performing Arts Center at the Temple-Tifereth Israel, on the campus of Case Western Reserve University. Conducted by the Cleveland Orchestra’s associate conductor, Brett Mitchell, the concerts will feature Cleveland Orchestra first associate concertmaster Peter Otto and assistant principal cellist Charles Bernard. Two Openings at BAYarts With two special exhibitions opening simultaneously, tonight is sure to be a big night at BAYarts. This year’s Annual Juried Exhibition is selected by jurors Daniel Levin and Kristen Cliffel.

In addition to being the co-founder and executive director of Zygote Press, Maugans is an accomplished printmaker. She earned her BFA in printmaking and painting at Kent State University, before receiving her MFA in printmaking at Cranbrook Academy of Art in Bloomfield, Michigan. Her latest exhibition at BAYarts features candid drawings of people she encounters in her daily life, specifically in church and at the city pool. Through additional text, Maugans adds her own insightful, often humorous, commentary on what each subject is thinking. Artful unveils new artist studios in Cleveland Heights

By Josh Usmani AFTER TWO YEARS OF PLANNING and six months of construction, the contracts have been signed, artists are moving in and Artful is finally ready to unveil its new artist studios in Cleveland Heights. In conjunction with the organization’s two-year anniversary, Artful invites the public to tour the new space during its free grand opening event from 5 to 9 p.m. this Saturday, March 11.

The Heights area — consisting of Cleveland, Shaker and University Heights — is home to the highest concentration of artists in Northeast Ohio. Despite its high creative population, the area offers little to no studio space. Seeing an opportunity, Artful Ohio Inc. formed about two years ago in an effort to bring affordable artist studio space to the area. The nonprofit organization is a diverse collective of citizens, including artists, educators, local business owners and attorneys.

“It’s been amazing to see Artful grow from an idea to reality,” says founding board member David King.

“I always knew the Heights area was artsy, but I was surprised by just how many artists call this area home. It’s exciting to be able to offer support and affordable studio space to artists in my own community.

And I believe Artful strengthens Cleveland Heights’ tag line, ‘Home of the Arts.’”

Artful’s founding committee consists of executive director Shannon Morris, board president Brady Dindia, board treasurer Kevin Khayat, board secretary Rachel Williams, and board members Sarah Curry, David King, Louise Khayat, Hillary Lyon and Eric Mundson.

Hoping to extend their impact beyond the walls of the studios, Artful has already begun to develop relationships with the community and fellow local organizations.

“Being involved in this project has brought so much to my own life, which I never could have predicted.

It’s strengthened friendships, led to new ones, brought to light wonderful partnerships throughout our area, and these are all the qualities we hope Artful will provide our area artists,” says Dindia, the board president. “Strong people, strong friendships, strong partnerships make strong communities.”

Artful is on the second floor of the Coventry School building at 2843 Washington Blvd. in Cleveland Heights, just steps from Coventry.

The building is also home to several other organizations, such as Lake Erie Ink and Ensemble Theatre.

Following six months of renovations, overseen by John Williams and Process Creative Studios, Inc., Artful’s new home includes 17 individual studios. Although most

studios have already been leased, Artful is still accepting applications from local artists.

The new resident artists represent a variety of media, including painting, printmaking, jewelry and more. Resident artists include Judith Barr (mixed media), Adam Brumma (3-D printing), Beverly Carter (jewelry and painting), Dick Dawson (painting), Angela DobbinsRivera (soaps, candles and skincare), Mandem (mixed media painting), Satu Papanek (sculpture and mixed media), Susan Prendergast (jewelry), LaSaundra Robinson (painting) and Laura Stack (painting). One studio has been set aside as a space for current college students and recent graduates. Three local students or graduates will be selected to share a studio at a discounted rate.

In addition to individual studios, the space includes a flex space, which will function as a classroom, lounge and gallery. One of the space’s most unique architecture features is the interlocking Trusscore PVC walls used to separate the studios. A material used most typically in car washes and slaughterhouses, the plastic walls are brighter and lighter than original drywall, and the material features a semi-reflective quality that is accentuated on sunny days by the building’s skylights. To help keep

costs and rent low, volunteers — mostly Artful’s founders — installed these walls themselves.

Currently in the midst of a three-phase plan, Artful’s grand opening is surely just the beginning.

Organizers hope Saturday’s event will be an opportunity for the public to tour the space and offer important feedback to help the organization serve its community in the most useful ways possible. Guests will have opportunities to vote on potential types of classes and events, as well as the best days and times for the programming. “Now that we are up and running, I am looking forward to learning and creating together,” says executive director Morris.

STAGE WINNER OF THE SWEEPS Lowly movie theater employees with brooms create their own magic in the aisles in The Flick at Dobama Theatre IF YOU’VE EVER WONDERED what goes on in the movie theater after you’ve left — and after you’ve spilled your popcorn, Goobers and Mountain Dew all over the floor — then you should attend to The Flick, now at Dobama Theatre. In this quietly wonderful piece by Annie Baker, we encounter three movie theater employees in the Boston area who are measuring out their lives with brooms and dustpans.

Even though it’s almost as long as the movie Titanic, at three hours with intermission, the rock solid Dobama cast and director Nathan Motta manage to keep your attention riveted throughout.

It’s a bit startling to enter the theater, sit down and be facing another bank of theater seats, with a projection room ensconced in the rear wall of the stage. But that is where all the action takes place, as veteran Sam shows rookie employee Avery the ropes. At the beginning, Avery is wracked with nervousness and we think it might be because he’s the only black worker on the premises. But soon we realize that this young man, although unfailingly polite, has a raft of other issues.

As for Sam, he knows his way through the rows of seats as he sweeps and mops, but the other pathways of life seem a bit more challenging. And these two are soon joined by a third worker, Rose, who runs the projection booth.

It is absolutely intriguing to see how the playwright slowly unfolds each character through clever, character-specific dialogue that never seems forced or plastic. And as they talk, we learn various facts about them as individuals and as a group.

Avery has a particular revulsion for seeing other people’s bodily excretions, which is not too handy for a person who has to clean bathrooms for a living. And he also has a facility for recalling actors in virtually every movie he’s ever seen, which is amusingly shown when challenged to play a free-form version of “Six Degrees of Kevin Bacon” with Sam. Sam reveals that he has a “retarded” brother, to whose wedding he is heading on an upcoming

weekend. Plus, Sam has a secret yearning for Rose, a desire that is battling his jealousy since she copped the plum projectionist job at the theater even though he had five months seniority. And Rose tries to enlist Avery in the “dinner money” scam they’re running, stealing money from the box office till so they can each pocket about an extra $15 each day.

This is a hermetically sealed universe they have created for themselves, and Baker’s words keep us entranced as we watch these flawed but essentially good-spirited people try to negotiate their lives, and loves.

But it wouldn’t work nearly as

as he is in those moments, there are other times when Hinchen doesn’t quite master his longer speeches, including a phone conversation when he discusses a dream with a friend.

But Hinchen has such an innate sweetness, and a love for celluloid as opposed to the digital movie technology, that you just want to hug him. And that serves the play well since the other two main characters are more of a mixed bag. For example, Paige Klopfenstein fashions Rose as a brutally frank chick with greentinted hair and some show-stopping, nasty-ass dance moves she uses to lure Avery.

well as it does without the right cast. And this cast, while not quite perfect, is damn good. As Avery, Gordon Hinchen manages to clench his whole body when he suffers from nervousness. This is particularly funny when, during an after-hours encounter, Rose makes a play for him as they screen a movie. As good

deploys a Boston accent and a slyly oblique attack on his character, which turns what could have been a cliche into a fresh take on a guy with a deadend job. As he talks trash (literally and figuratively) with his co-workers, Bohan reveals aspects of Sam’s personality, often with just a wellplaced glance or an extended pause.

Sam knows he’s not going anywhere, in the cosmic sense, so Bohan’s in no rush to let us in on what’s going on in his head. And that’s fine. The only false notes Bohan strikes are when he can’t resist using his well-honed actor chops to spout a couple British impersonations. They’re funny, but Sam would do a much less polished English accent.

Nate Miller also plays two small roles that help round out the story, especially at the conclusion when the theater changes ownership.

This long play is chock full of tender, poignant and laugh-out-loud moments that all feel well-earned.

And the ultimate take-away is that we see what is required to live a life that includes some actual love, caring and friendship. In this evocative play, the sound of the swishing brooms and mops orchestrates a soundtrack of quiet aspiration. It is a remarkable achievement and well worth a trip to this theater-within-a-theater. And try not to spill your popcorn: Somebody has to clean up that mess.

MOVIES WRATH OF KONG Latest King Kong iteration is standard heart-pounding fun

By Sam Allard JORDAN VOGT-ROBERTS IS A Funny or Die alum who’d only directed one full-length feature film, the 2013 Cleveland-shot indie comedy Kings of Summer, before he was called upon to helm the bigbudget action spectacle Kong: Skull Island, out on Friday.

Vogt-Roberts joins a class of “up and coming” directors — Colin Trevorrow, Taika Waititi, Ryan Coogler, to name a few — who have been handed the reins or granted the rights to a major movie (or major franchise) despite limited credentials. Trevorrow, for instance, wrote and directed the 2015 smash hit Jurassic World on the strength of the 2012 indie Safety Not Guaranteed. He’s now writing and directing 2019’s Star Wars: Episode IX. One reason for this trend may be that studios, concerned about a perceived emptiness or soullessness in their specialeffects-driven blockbusters, want the humor and personality of young, spirited fi lmmakers. (But why are they almost exclusively male?) Many directors today — the Russo brothers, for instance — acknowledge that the elaborate technical work that goes into making a VFX-heavy action movie is handled by the studios and their enormous staffing infrastructures.

The director’s job is to work with actors and to bring a sensibility

to a movie. Kong’s sensibility is a recognizable one. It’s certainly quicker and more jokey than its immediate predecessor, King Kong (2005), the majestic colossus directed by Peter Jackson, fresh off Return of the King, that was as much an ode to fi lmmaking’s history as it was to King Kong’s.

This iteration bears a greater resemblance to today’s run-ofthe-mill action movies: competent special effects, breakneck pace, lots of jokes. Gotta keep those teenage boys engaged.

The ’05 King Kong took place in the 1930s, a nod to the original film which debuted in 1933. Skull Island takes place in the early ’70s for reasons that seem mostly to do with wardrobe and tech (unless of course it’s a subtler nod to the 1976 King Kong remake starring Jeff Bridges and Jessica Lange).

Like previous versions, it features a large ensemble cast, but this one fails to cohere as a unit. The characters feel like pieces and parts cobbled together from earlier drafts.

In the final analysis, Skull Island’s effects are as good as you’d anticipate, with two striking encounters — one between Kong and a fleet of helicopters; one between Kong and another giant creature — that deliver on the high-octane promise of the trailer.

The cast is hit or miss, with John

C. Reilly delivering the film’s best punchlines. Brie Larson is the token female. There’s one other woman on the expedition (The Great Wall’s Tian Jing), but she has perhaps three lines of dialogue and fails to register as a presence onscreen.

It’s a survey crew, not a film crew, venturing to Skull Island this time around. Samuel L. Jackson plays Preston Packard, a Vietnam War captain, called upon to escort the geographical team.

Explorer-geologist Bill Randa (John Goodman) swears the island is home to ancient creatures of enormous size. As the helicopters lift off from an aircraft carrier toward the tropical-storm-protected island, Packard tells his crew to “hold on to [their] butts,” a callback to Jurassic Park. Once inside the tropical storm, Packard delivers a monologue through his radio headset about Icarus and American steel — a pretty cool moment — to which you can draw a line from his iconic Pulp Fiction scene, “and you will know my name is the Lord ...” Unlike in Kongs past, the goal of Randa’s team is not to bring

the beast back to civilization. (That would be impossible. This thing is huge.) Instead, Randa wants to bring visual proof of Kong’s existence back — Larson plays a war photographer, constantly snapping away — so that “the cavalry” may return to destroy him.

Packard, the hardened military man, views himself as the cavalry and grows obsessed with the idea of bringing Kong down on his own.

One of the most startling and wonderful elements of Peter Jackson’s King Kong was the deep, tender connection between Kong (Andy Serkis) and Naomi Watts.

Kong was a character. Remember him spinning around on his butt on the ice in Central Park? Here, Kong is played by Toby Kebell, who, like Serkis, also plays a liveaction role in the film and has similar credits under his belt: Koba in Dawn of the Planet of the Apes; Durotan in Warcraft. But as the protector of Skull Island, Kebbell’s bipedal Kong is more Transformer than man.

light on context and history; there’s one interview that briefly explains where the cats came from but, other than that, the film doesn’t offer much about Istanbul’s current social climate or discuss what kinds of challenges the cats will face in a changing world.

A lot of the film’s commentary is pretty Zen, and presents cats in a reverent, nearly religious way. Many of the interviews ruminate on cats as symbols of life, death, love and happiness, explaining how caring for cats can teach someone how to be a better person. Sometimes the

meditations on the felines can be overly sentimental but, occasionally, there is a line or two that rings true.

If you’re a fan of cats, there’s enough wonderful photography in this film to keep you engaged and entertained. If you’re not a cat person, you may find this documentary a little lacking in substance.

It can be fun to watch the cats treat Istanbul like a playground. But after a while, some viewers might find themselves preferring a deeper treatment of the film’s subjects. — Johnny Cook

SPOTLIGHT: KEDI STRAY CATS HAVE LIVED IN Istanbul for thousands of years, nearly as long as the city has been standing. The new documentary Kedi, opening Friday at the Cedar Lee, offers a gallery-style view of the cats inhabiting Istanbul while citizens offer their thoughts and feelings about the animals in their respective communities.

The film shows how the cats live on a day-to-day basis and posits that, despite their stray nature, they have essentially become citizens of Istanbul. It

doesn’t have one dominant story to tell, making Kedi closer to an observational nature documentary than a standard narrative documentary.

The film is at its best when it allows the audience to focus on a particular cat for a length of time, like the hardened fish thief called “Psychopath” or the rough-and-tumble cafe cat named “Carefree.” Allowing the personalities of the cats to shine pushes the film into more than just animal photography. For a documentary, though, Kedi is pretty

EAT PIE HIGH Masthead delivers pizza and beer, and there’s just no better combination

IF IT’S TRUE (PLEASE LET IT BE true) that man can survive on a diet of just pizza and beer, then Masthead Brewing Co. has all the requirements necessary to sustain life. But more than that, this two-month-old brewery has injected a much-needed jolt of life into an area of downtown Cleveland that desperately needed it. Recently rebranded as the NineTwelve District, this dry patch of the city center is better known for stuffed shirts by day and empty sidewalks after dark than for bars, restaurants and nightlife.

That’s likely why Masthead skirted the present-day trend of taprooms, ditching the kitchen in favor of a stack of take-out menus from nearby restaurants: There aren’t any. The closest signs of life to the Superior Avenue brewery sit a few blocks over on Chester where, coincidentally, another brewery activated a formerly sleepy quarter of downtown.

While the food menu may not be exceedingly long nor exceptionally creative, it is agreeably priced and more than fulfills its duty to provide the sustenance needed to work one’s way through the brewery’s stock in trade. All the comestibles fit neatly onto one side of the paper menu, the other side of which is devoted to items that are poured into a glass.

on the far side of the yawning interior. His principle piece of cooking equipment is a gorgeous red-tiled Marra Forni Neapolitanstyle pizza oven. The combination of wood and gas combines the highheat benefits of burning real wood with the temperature consistency of set-it-and-forget-it gas controls.

On the menu, the 12-inch pies are broken into broad categories of red and white. There are 15 options in all, each bearing the characteristically thin, chewy and flavorful crust. The soppressata ($12) is polka-dotted with large wheels of thinly sliced Italian salami, puddles of melted fresh mozzarella and a base of provolone. The addition of crunchy, tangy and spicy giardinere adds just the right kick. On the

your typical chopped salad, the Chopped ($7) consists of a mix of (decidedly un-chopped) greens paired with shaved Parmesan, olives, cubed salami and pepperoncini in a red wine vinaigrette. Like those salads, the small plates are conventional but well made, with items like nicely roasted Brussels sprouts ($7) flavored with shallots and pancetta, or dates ($7) stuffed with goat cheese, drizzled with honey and garnished with nuts.

A just-launched lunch service runs off pretty much the same menu except that the small plates are swapped out for a trio of sandwiches like the muffuletta ($12), housebaked bread stuffed with ham, soppressata, mortadella, provolone and tapenade. Others are built

mortadella ($12), the sliced meats are hidden beneath a bed of pistachio pesto, nicely toasted from the heat of the oven. The pie is finished with a dusting of grated Parmesan.

To accompany those fine pies, diners can tack on one or more of the four offered salads. The roasted beet salad ($7) has more than a mild whiff of smokiness thanks to the addition of smoked blue cheese.

Large roasted beets are tossed with baby kale and candied pecans. Not

around roasted veggies ($10) and roast turkey ($11).

Food items are ordered at the bar along with drinks. Diners are given a small pager and instructed to head over to the kitchen to retrieve their bounty when it goes off.

There’s no shortage of options when it comes to seating. The cavernous 16,000-square-foot warehouse can accommodate around 250 guests at gorgeous wood picnic tables, at hightops or anywhere along the 110-foot

wraparound bar.

Immediately behind that bar is the shiny 20-barrel brewhouse, with its colonnade of fermentation tanks and glycol-chilled bright tanks, which feed directly into the bar’s tap system. Brewer Mike Pelechaty, who came by way of Black Box Brewing, is turning out some mighty fine ale.

On tap is a crisp, hoppy IPA, a pitchperfect coffee stout and an eminently drinkable pils. Guest drafts come from breweries in Cleveland and around Ohio. Most beers are $5 per pint. Cocktail drinkers are not overlooked, but wine drinkers will have to make do with a single selection of white, red and sparkling varieties.

Come spring — or, fingers crossed, St. Patrick’s Day — Masthead will be the place to be thanks to 120 feet of garage doors along Superior that will open up the facade almost completely. That frontage was one of the qualities that attracted owners Frank Luther, Matt Slife and Pelechaty to the 100-yearold Bryant Building in the first place.

“We looked a lot in California and other West Coast spots,” Luther explains. “We were looking for the right property and Cleveland has an industrial background that gives you these kinds of buildings.”

PEACEFUL FRUITS (330-3568515, peacefulfruits.com) founder Evan Delahanty conceptualized his healthy snack line in order to make a positive, sustainable impact by selling fruit leather created with acai berries indigenous to the Amazon rainforest throughout his hometown of Akron. Now, thanks to an appearance on ABCâ&#x20AC;&#x2122;s reality TV show Shark Tank, his product has a vast national following that he could only have dreamed about a few short months ago.

Despite not winning an investorâ&#x20AC;&#x2122;s stake in the company, the American hero themed episode has helped Delahanty raise awareness and more than double production over the past three weeks. â&#x20AC;&#x153;There were a thousand orders within the ďŹ rst ďŹ ve minutes of the show airing,â&#x20AC;? he estimates. â&#x20AC;&#x153;It was just incredible.â&#x20AC;? Itâ&#x20AC;&#x2122;s a huge leap for a company that started out two and a half years ago, in his parentâ&#x20AC;&#x2122;s kitchen, producing just 150 snacks a week.

While the USDA-organic superfood snacks are desirable for their antioxidant-rich and ďŹ&#x201A;avorful qualities, those arenâ&#x20AC;&#x2122;t the only things that sparked consumersâ&#x20AC;&#x2122; interest in the acai-pineapple and acai-apple products. Peaceful Fruits doubles as a social enterprise, paying families in the Amazon a living wage to pick the wild berries found in their own backyards, sustaining their way of life and creating a resource speciďŹ c to the region. â&#x20AC;&#x153;I didnâ&#x20AC;&#x2122;t set out to start a food business,â&#x20AC;? says Delahanty, who began as a Peace Corps economic development specialist in Suriname, South America. â&#x20AC;&#x153;We looked at a lot of different things, but ultimately what I really liked about acai is that itâ&#x20AC;&#x2122;s already a trend. There is such a huge movement towards food that is organic, local, simple, healthy and still convenient. I really wanted Peaceful Fruits to embrace that. Letâ&#x20AC;&#x2122;s make it taste good, make it easy for everyone along the way to make the right decision for themselves and their community.â&#x20AC;?

Delahanty spent six months

testing the ďŹ nal product with the help of Cleveland Culinary Launch Kitchen and his alma mater, the Cornell University Food & Brand Lab. He has adapted a simple pasteurization process using heat, air and time to dehydrate, making the strips shelf-stable without adding anything except fruit to the mix. Originally selling to families at suburban farmers markets, he quickly began ďŹ lling orders online and placing his product into Mustard Seed Markets, Natureâ&#x20AC;&#x2122;s Oasis, Alesciâ&#x20AC;&#x2122;s, and other regional grocery stores.

The company has invested $25,000 into a partnership with Hattie Larlham Food Hub and the Blick Center for equipment and full-wage employment of people with developmental disabilities. Peaceful Fruits is ramping up to make a big difference as fast as they can. â&#x20AC;&#x153;These people, like the people in the Amazon, need economic opportunity.

They need a way to earn a living, and opportunity that meets them halfway. It just seemed like such a good ďŹ t with our mission of respectful and responsible economic empowerment,â&#x20AC;? Delahanty says.

New ďŹ&#x201A;avors will soon be introduced as back orders from the Shark Tank surge are completed.

Shoppers can expect to see mango, more fruit blends incorporating pineapple, strawberry, and blueberry, as well as strips drizzled with acai.

They are also working on an â&#x20AC;&#x153;AcaiGranola Crunch,â&#x20AC;? a piece of fruit leather with granola added on top.

Even more exciting than the boom in business for Delahanty has been the validation he received from Shark Tank judges, he says. â&#x20AC;&#x153;It was incredible to hear Mark Cuban say on national television that Iâ&#x20AC;&#x2122;m spot on, that social enterprise is the future of business. It made it feel like a win to be a part of pushing that conversation forward in front of the nation.â&#x20AC;?

COMING IN HOT Ruth’s Chris Steak House to open in 200 Public Square Building on March 13

By Douglas Trattner THE WAIT IS ALMOST OVER for fans of Ruth’s Chris Steak House and its signature 500-degree sizzling plates. The company announced its plans to take over the former Frank & Pauly’s space on the lower level of the 200 Public Square Building way back in the summer of 2015.

Diners can now look forward to a March 13 opening (200 Public Sq., 216-539-8404).

The Winter Park, Floridabased chain operates about 150 restaurants, but none in the immediate area. A Cleveland location at Eton Chagrin Boulevard closed its doors in 2006 after nine years.

Ruth’s Chris will fill a prime downtown spot that has been vacant since 2006, when Wayne Koury closed Frank & Pauly’s. The 300seat eatery has undergone a multimillion dollar renovation.

Diners can expect a menu filled with chophouse starters like shrimp cocktail, crab cakes and chilled seafood towers. USDA Prime steaks and chops join seafood items like sea bass and barbecue shrimp.

Sides run the gamut from roasted Brussels sprouts and lobster mac and cheese to potatoes au gratin and shoestring fries.

Ruth’s Chris joins a crowded and growing market when it comes to downtown steakhouses. In addition to Red, Urban Farmer, Hyde Park, XO and Morton’s, the Marble

Room will open in the coming weeks inside the historic bank lobby of the Garfield Building at East Sixth and Euclid Avenue.

NEW SOUTHERN-STYLE BBQ JOINT HEADING TO OHIO CITY A barbecue joint will soon join the quickly burgeoning bar, restaurant and entertainment scene along Lorain Avenue in Ohio City. Next up for the strip that includes Platform Beer, The Grocery OHC, Herb’n Twine, the Plum, Jack Flaps, Ohio City Provisions, and the forthcoming Forest City Shuffleboard and Xinji Noodle Bar, is Ohio City BBQ. Owner Nav Singh is on track to open Ohio City BBQ (3829 Lorain Ave.) in the former Ohio City Tattoo spot by late April, he says.

“I bought the building to open a Marco’s Pizza, we did the training with Marco’s, I went to Pizza University in Toledo … . We were all set to go but then I tried Ronnie’s barbecue,” says Singh, referring to his pitmaster partner, operator of the barbecue food truck Cofield’s.

“I’m from Toronto, Canada, and we really don’t have American-style barbecue there. Once I tried her food I was like, ‘Wow, you can really taste the wood and meat and smoke.’ She really knows what she’s doing.”

Singh describes the spot as a “Memphis-themed restaurant with a ’60s decor.”

Out back will be the custom-built 12-foot barrel smoker that sits beneath a corrugated roof and chimney. â&#x20AC;&#x153;Weâ&#x20AC;&#x2122;ll be doing real smoked Southern-style barbecue like ribs, brisket and sides like coleslaw and mac and cheese,â&#x20AC;? Singh notes.

POPULAR SEAFOOD-IN-A-BAG CONCEPT COMING TO COVENTRY ROAD Ever since Winking Lizard closed its doors on Coventry last summer after nearly 20 years, there has been a ďŹ&#x201A;urry of activity inside the space.

But all of it has been concealed by craft paper, leaving passersby few clues as to what would replace the wing-and-beer joint. The name â&#x20AC;&#x201D; Seafood Shake â&#x20AC;&#x201D; conjured images of liqueďŹ ed sea life served up by the glass.

Of course, those familiar with the increasingly popular seafood-in-a-bag concept knew better. â&#x20AC;&#x153;A lot of these are popping up across the U.S.,â&#x20AC;? says owner Hangchun Zheng. â&#x20AC;&#x153;I think they started in the South and out West.

They are for the true seafood lover.â&#x20AC;?

Like Boiling Seafood on Lee Road and the soon-to-open Boiler in Gordon Square, Seafood Shake (1852 Coventry Rd.) is indeed modeled after those festive seafood concepts.

Various types of seafood are boiled in a ďŹ&#x201A;avorful broth, tossed in an aggressively seasoned spice mixture (hence the â&#x20AC;&#x153;shakeâ&#x20AC;? moniker), and delivered to the table in clear plastic bags. Diners can pour the contents out onto paper-topped tables or eat straight out of the sack. This is messy, delicious fun. â&#x20AC;&#x153;Where I come from you eat the seafood by hand,â&#x20AC;? adds Zheng. â&#x20AC;&#x153;How else are you going to eat it?â&#x20AC;?

Since taking possession, the owner has completely gutted the 3,000-square-foot space. Built-in booths are covered with awnings to lend a casual â&#x20AC;&#x153;outdoor picnic feelâ&#x20AC;? to the interior.

A 12-foot-long, three-level ďŹ sh tank will be ďŹ lled with live seafood like lobster, Dungeness crabs, and other ďŹ sh. In-season specials like live king crab and crawďŹ sh will join the usual lineup of oysters and shrimp. All of it will be sold by the piece or pound and prepared in one of a couple ways. â&#x20AC;&#x153;The customer has a choice of getting it Cajun-style in the bag or fried in our special breading,â&#x20AC;? says Zheng.

Whole lobsters will be cut into pieces, lightly breaded and fried in the shell, similar to Chinese-style salt-and-pepper baked shrimp or lobster. The crust is very thin and very crispy.

The restaurant will seat about 110 guests throughout the space. While the bar in the middle space has been removed, there will be a bar near the original one in the ďŹ rst room.

Zheng grew up in Cleveland and went to Ohio State University. He operates three HC Way Asian Bistros in Columbus.

NEW â&#x20AC;&#x2DC;CLEVELAND EATSâ&#x20AC;&#x2122; CULINARY FESTIVAL TO TAKE PLACE DOWNTOWN THIS FALL Come fall, Cleveland will have a new food-themed fest to call its own.

The two-day Cleveland Eats Culinary Festival, organized by the Hospitality Management Center of Excellence at Cuyahoga Community College, will take place Friday and Saturday, Sept. 15 and 16, on Mall B above the Huntington Convention Center of Cleveland.

Plans for the new event came together this week at a gathering of some of the cityâ&#x20AC;&#x2122;s top chefs. The regionâ&#x20AC;&#x2122;s food culture, chef-driven restaurants, craft beer scene and local farms will be the main focus of the event, say organizers. â&#x20AC;&#x153;The table is being set for an amazing experience in the heart of the city,â&#x20AC;? reports Michael Huff, TriCâ&#x20AC;&#x2122;s dean of hospitality management. â&#x20AC;&#x153;Some of the ďŹ nest food in the nation comes out of Clevelandâ&#x20AC;&#x2122;s kitchens. We want to give people a taste of whatâ&#x20AC;&#x2122;s here.â&#x20AC;?

A Culinary Council has been established to help steer and plan the festival. On that board are local food pros like Ben Bebenroth, Jonathan Bennett, Brandt Evans, Heather Haviland, Douglas Katz, Jonathon Sawyer and Karen Small.

The family-friendly festival will include culinary competitions and classes, food from the regionâ&#x20AC;&#x2122;s top restaurants, craft beer tastings and live entertainment.

A gala preceding the festival will raise scholarship money for Tri-C culinary students and the cityâ&#x20AC;&#x2122;s next generation of chefs. The Cuyahoga Community College Foundation will host that event at Tri-Câ&#x20AC;&#x2122;s Hospitality Management Center and Pura Vida restaurant on Public Square.

THE ‘LITTLE ORCHESTRA’ THAT COULD Pink Martini’s Thomas Lauderdale talks about the tracks on the group’s latest album

By Jeff Niesel PINK MARTINI BANDLEADER Thomas Lauderdale originally thought he’d enter politics and run for mayor of his hometown, Portland, Oregon.

As he started going to fundraisers, he realized that the music most politicians played at their events was so bad that he could easily come up with something better.

He then put together a selfdescribed “little orchestra” he dubbed Pink Martini. Nearly 25 years on, the group has evolved into an international sensation that plays a unique mix of lounge music, jazz and classical.

Throughout the ’90s and ’00s, the band continually recorded and toured, collaborating with a wide range of artists that ranged from jazz/pop singers such as Jimmy Scott and Rufus Wainwright to filmmaker Gus Van Sant and the original cast of Sesame Street.

Along the way, Pink Martini performed with numerous worldclass orchestras, including the one here in Cleveland, which Lauderdale

has praised as the best in the country.

On tour in support of its new album, Je dis oui!, the band returns to town this week to perform at the Masonic Auditorium. Lauderdale recently spoke to us via phone from his Portland home and broke down the tracks on the album.

“Joli Garçon” In the last couple of years, we wrote three songs for the French actress Isabelle Huppert to sing in a film called Souvenir, the fictional tale about a woman who lost to Abba in the European singing competition and faded into obscurity and is working in the meat packing industry. One day, a young boxer comes to work there, and they fall in love, and she goes for a comeback.

We wrote three songs for her to sing, and this is her comeback song. On the record, China Forbes sings but Isabelle sings it in the film.

“The Butterfly Song” I wrote this with Alex Marashian, who I went to college with. It’s a

swing-y song and flitty song, just like a butterfly.

“Kaj Kolah Khan” It’s sort of a pioneering feminist anthem from Tehran in the early ’70s by a singer named Googoosh.

There’s a short window in time when the women in the country enjoyed incredible freedom, and the country was the most Western in that part of the world. Googoosh, like many others, fled when the Ayatollah Khomeini came to power.

She lives in Los Angeles now, and we’re hoping to work with her in the coming years. I don’t know how I originally heard it. I think I found it when I was working on [the 2013 album] Get Happy, and we covered another song in Farsi from 1965, and I had seen an old clip of Dinah Shore singing “Omide Zendegani” in 1965 and that song was originally by Googoosh. After that, I listened to as much of her music as I could. She has hundreds of songs. As it turns out, for those living in Iran in the early ’70s, they all love it. It was a huge hit. Outside

“Ov Sirun Sirun” It’s our first song in Armenian.

I found a recording of Armen Darbinyan singing it in the ’60s.

We’re really popular in Turkey, so we have spent time in Turkey, and it’s one of our favorite places to travel to as well as Greece. In the course of our travels, we have had Armenians tell us that they want us to do a song in their language.

Since it’s the anniversary of the Armenian genocide, this seemed like a good time to do a song in Armenian.

“Love for Sale” That’s part of an album project I’m working on with my friend Kathleen Saadat. I worked under her in city hall. We worked on a civil rights ordinance in 1991. She has a great voice, and we’ve played together and rehearsed together. We did this song together, and it turned out so well that I wanted to include it on the album. | clevescene.com | March 8 - 14, 2017 41

“Solidão” It’s a song in Portuguese from Amalia Rodrigues. She’s the queen of fado in Portugal. Of all the songs she ever sung, this is my favorite of hers.

“Al Bint Al Shalabiya” This is originally performed

by Fairuz, the great diva from Lebanon, who’s still alive. [Fashion icon] Ikram Goldman, who I met eight years ago in Paris during Fashion Week, is from Lebanon but grew up in Israel. She told me about this song, and when we decided to cover it for this record, I flew her out to perform in the backup chorus. She ended up becoming the lead vocalist. It’s the first time she had ever been in a recording studio. She’s in the world of fashion and is credited for Michelle Obama’s interest in fashion.

“Segundo” We ran out of time in terms of writing lyrics for it, but maybe that will be for a future album. I cowrote it with Johnny Dynell, who’s a DJ from New York.

“Blue Moon” I don’t think he (Rufus Wainwright) had sung it before. He’s so tremendous. I think he’s such a genius. We did 10 takes and on the last take, he paused on the word “gold” for a long time and it took all of us by surprise. I think it’s just absolutely exquisite. He’s such an amazing artist and performer.

“Fini la Musique” It’s one of the three songs from Souvenir.

“Souvenir” It’s one of the three songs we wrote for Isabelle Huppert. It has a moody, mid-’70s sounds.

“Askim Bahardı” It’s our second Turkish song we’ve recorded. It was first sung by Belkıs Özener in the late ’60s, and I’ve always loved it. We spend a lot of time in Turkey, and it made sense to do another song in Turkish for this album.

“Finnisma Di” It’s a rewriting. On our first album there is a song called

“Pata Pata” It’s with Miriam Makeba, and it’s our first attempt to work with music from South Africa in particular.

I had been listening to this song whenever I threw parties, so it made a lot of sense to record it. The language

“Soledad” with Pepe Raphael. This has new lyrics in Arabic that were written by Iyad Qasem. I met him on a flight from Paris to New York and he was a big fan of the band and recognized me. We started talking and started talking about working on a Middle Eastern album. This is the first iteration of that, and it’s sung by Ari Shapiro from NPR. I think it’s significant that it’s a song with Arabic lyrics sung by an American Jew. It was originally in Spanish. I was able to

is really tough. I don’t know if we quite pulled it off, but it’s beautiful.

“Serenade” It’s a song that my partner Hunter Noack, who’s also a pianist, was working on for his classical album. It’s so beautiful that I wanted to conclude with it. It’s a nice lullaby that finishes the album.

MUSIC A LASTING LEGACY Indie rockers Dinosaur Jr. still possess a sense of purpose

By Bethany Kaufman AMHERST, MASSACHUSETTSbased indie rockers Dinosaur Jr. have managed to survive not by succumbing to adaptive evolution but by creating a lush musical habitat all their own, playing a primal yet genre-defining combination of brash hardcore and moody, emotion-driven ballad rock.

Grunge’s evolutionary tree includes close relatives Nirvana, Sonic Youth and the Pixies. While these other acts enjoyed more prominent roles in the 1990s than Dinosaur Jr. would in the ’80s, ’90s and 2000s combined, none could match Dinosaur Jr.’s longevity and stamina.

Some fans regard Joseph “J” Mascis Jr., the band’s singer, songwriter and guitarist, as the “godfather of alt rock,” a title he earned by maintaining Dinosaur Jr.’s place at the top of the independent music food chain well into the 21st century.

In the mid-’80s when the band first formed, mainstream music was stuck in a classic-rock rut, with commercial radio milking dry the prior two decades’ hits instead of tapping anything new.

“You have to realize, the radio stations were only playing classic rock, there was no Green Day, there was no Nirvana on the radio, none of that stuff,” says drummer Murph Murphy in a recent phone interview.

“All of that was really underground.

People didn’t really know it, they didn’t really like it, so we were kind of pioneers, I guess. Not many people we knew were into that kind of music, we’ll put it that way.”

Dinosaur Jr.’s rock was anything but classic: Mascis completely repurposed the rock-god guitar solos and heavy riffage of the ’70s, incorporating these elements into vicious punk rock, giving the genre known for three-chord simplicity a new sense of sophistication. Mascis became enamored of special effects pedals early in the band’s career, and phasing and distortion have their footprints all over his work.

Much like the band’s reptilian namesake, Dinosaur Jr.’s saga is easily divided into three distinct

periods, the beginnings and endings of which are marked by the incremental disappearances of the act’s primary characters, one after another. Mascis, Murph and bassist Lou Barlow met as teens. Mascis and Barlow played together in a shortlived hardcore band called Deep Wound. When that band bled out, Mascis recruited Barlow and Murph for a new project he called Dinosaur (later rechristened Dinosaur Jr. after a lost lawsuit).

Most of the boys’ meager musical goals were reached during their first three years in existence. After their 1985 self-titled debut, an effort Mascis once described as “earbleeding country,” SST Records, the label founded by Black Flag’s Greg Ginn, signed the group. SST released 1987’s You’re Living All Over Me and gave the band the support it needed to tour.

After album No. 3, 1988’s Bug, territorial tensions between Mascis and Barlow mounted, leading Mascis to eliminate Barlow from the band by staging a false breakup. The very next day, Mascis reformed Dinosaur Jr. without Barlow (who would go on to form Sebadoh). For the next few years, Dinosaur Jr. would run parallel to (but never intersect with) the grunge scene of the 1990s.

“J has the idea and everything, but then when Lou and I actually start playing the song, it becomes like a Dinosaur Jr. song, you know?”

Murph explains.

After Barlow’s departure from the band in 1989, Murph hung on as Dinosaur Jr.’s drummer until the mid-’90s; he would later go on to drum for the Lemonheads.

Without Barlow and Murph, the band became little more than a platform for Mascis’ solo musings. Dinosaur Jr.’s remains were finally laid to rest when Mascis formed J Mascis + the Fog in 2000. In 2005, Mascis agreed to a brief tour following Merge Records’ re-release of the first three albums. But the reunion proved much more fruitful than a scripted marketing effort, and the band has

and guitar parts but also dressing those bones with nearly-complete instrumental orchestrations before the other band members even hear the tracks.

“J plays like every instrument; he’s gifted. He’s able to literally play bass, drums, guitar, and sing and record a whole record by himself, so he writes more as like a composer does for an orchestra,” Murph explains.

been together ever since.

Their continued effort proves that the band members still possess a sense of purpose in the work that they do.

While many bands would consider Dinosaur Jr.’s pre-millennial stint to be a monumental success in itself, Murph thinks there’s still room for growth.

In fact, the band’s most recent release, 2016’s Give a Glimpse of What Yer Not, happens to be Murph’s favorite album of the band’s 11 releases.

“I’m personally experiencing this kind of resurgence as a drummer, like I’m just really into drumming,

almost more than I’ve ever been,” he says. “It’s just really exciting, so I was super focused on the record.

And also J, [Lou and J both] but J particularly, is really starting to get into songwriting, and he’s really starting to produce some really great material and it shows. It’s really great to play on stuff where you’re like, ‘Wow. This is a really great song.’ It’s inspiring.”

More than 30 years after Dinosaur Jr. formed and more than 10 years into its reunion, the band is almost as renowned for its current work as it for its original material.

Having successfully weathered a breakup and reformation, as well as the challenging process of learning to communicate again after years of hard feelings, it seems it would take a meteorite to kill their desire to create music together.

“We were like these three angsty, kind of disgruntled, angry teens that got together and we clashed, we really had different viewpoints, but somehow we played music well together,” says Murph. “But there was this friction and tension that was created, but in that it’s turned out to be this endless well of ideas and creativity. So it’s kind of funny, it’s like this endless stream that we can tap into, and I think we’ll keep tapping into it until it dries up.

If it dries up tomorrow, we would stop tomorrow. But if it dries up when we’re 80, then we’ll just keep playing ’til we’re 80. We have no idea how deep the well is. But we just keep drinking from it.”

MUSIC TAPPING POTENTIAL Contemporary Youth Orchestra music director inspires young musicians

By Jeff Niesel THE FOUNDING MUSIC DIRECTOR of the Contemporary Youth Orchestra and the tour conductor for the rock group Styx, Liza Grossman got a heavy dose of all things orchestral while growing up in Detroit, where her parents regularly threw fundraising parties to try to keep the Motor City’s orchestra alive.

Grossman, who’ll lead CYO as it plays the music to Pee-wee’s Big Holiday at 7 p.m. on Saturday, March 11, at Cleveland State University’s Waetjen Auditorium, got her first taste of conducting when she was in second grade.

The symphony had come to her elementary school and asked for a volunteer who wanted give conducting a try. Grossman raised her hand the highest.

“None of us even knew what [conducting] was,” says Grossman one recent afternoon over coffee at the Heinen’s in downtown Cleveland.

“I was chosen. I got up there and didn’t know what it was, and the conductor handed me his baton. I don’t remember the piece. I lifted my arms up, and there was this wall of sound. I went home and told my parents I wanted to play the violin.”

Grossman would eventually study with members of the Detroit Symphony Orchestra and attend high school at Interlochen Arts Academy boarding school. She came to Cleveland to study with Erich Eichhorn, a Cleveland Orchestra violinist who taught at Cleveland State University. After graduating in 1992, she hung around town, teaching at Rainey Institute and the Music Settlement. When Bernard Rands, a contemporary musician and Pulitzer Prize-winning composer, gave her some of his compositions for a youth chamber orchestra featuring middle and high school students, she realized she finally found her calling.

“When I received the score from him, it was written in notation that I hadn’t seen before, and he sat down with me and explained it to me,” she says. “We went back and forth, so I could learn from him as

well,” she says. “When it came time for the performance at Cleveland State, he suggested I run part of the performance and conduct a portion of it. Being naïve, I said I would do it, and I did. [At a reception afterward], he said, ‘You have an ability to hear and teach this music, and I think you should start an orchestra.’ I thought that was crazy.”

She describes the experience with Rands as “impactful” and “life altering.”

She recruited her father, a lawyer, to help her draft some bylaws, and she formed the Contemporary Youth Orchestra as a nonprofit organization.

When asked about the first season, she simply laughs and says, “We played anything I could get my hands on.” She says she searched high and low to find pieces that contemporary composers had written for middle and high school orchestras.

“I supported CYO out of my pocket for the first four years and begged students to be in three concerts a year,” she says.

The group had a major breakthrough when Doors keyboardist Ray Manzarek performed with it in 2001 at the Rock Hall.

“I had heard a recording of Nigel Kennedy and the London Symphony doing a Doors concerto,” she says. “Santina Protopapa, who was the education manager for the Rock Hall at the time, contacted Ray [Manzarek] and invited him to come in to perform it with us. I thought my blinders were off before, but now I felt like barn doors were flipped backwards and no longer in existence.”

Since then, acts such as Styx, Graham Nash, Pat Benatar, Twenty One Pilots, Jon Anderson, Panic!

At the Disco, Fall Out Boy, Coolio, Machine Gun Kelly, Bootsy Collins, Jefferson Starship and Weezer have performed with the group. The upcoming Pee-wee’s Big Holiday concert functions as the continuation of a Music & Its Industries series that Grossman started in 2006.

to introduce my students to all the potential professions they could have,” she says. “We’ve done cartoons and films and brought in Emmy Award-winning cartoon composers from L.A. who ran workshops. It’s turned into such a cool series, and it’s so much fun to explore these different avenues and dig in deep. It’s not just a concert because we’re also learning about media and marketing and entertainment law and lighting and rehearsal etiquette. It’s a full experience the students get.”

The Pee-wee concert came to fruition after a former student of Grossman’s, the Museum of Contemporary Art’s curator of public programming Deidre McPherson, wanted to get CYO involved with a recent exhibit featuring the work of Devo’s Mark Mothersbaugh.

Logistics didn’t work out but Grossman, who knew Mothersbaugh from a previous collaboration, still wanted to pursue a performance of his music for the Pee-wee film.

“These young musicians are the future ones who will do the recordings and engineer them and produce them,” she says. “What’s really cool is that these musicians are looking at the same scores and cues that the orchestra in L.A. used when they originally recorded the

music for Pee-wee’s Big Holiday.

It’s a completely different type of experience for us because the orchestra just recorded the cues but never played it all the way through.”

Later this year, CYO will team up with rocker Melissa Etheridge and perform with her on June 7 at Severance Hall.

“Things just keep happening,” says Grossman. “I do have big plans and, for the first time in 22 years, we have an executive director who is not me. There’s four of us now on staff, which is amazing to me.

It’s this huge working board. It’s such an incredible team. We’ve had the same lighting director for the whole run who’s grown with us and understands what we want.

It’s incredible to have this family.

It’s mind boggling to think about it. The future looks great, and there’s really no stopping us. We can do whatever we want. There’s no kind of music that we can’t play.

It’s an open plate, and we can fill it with whatever we want. I see us expanding educationally and growing into something bigger than just an orchestra.”

AN ORGANIC APPROACH Rock singer Patti Smith revisits her seminal first album, Horses

By Jeff Niesel CULTURAL CRITIC ANTONIO Gramsci uses the term “organic intellectual” to describe people who “direct the ideas and aspirations of their class even though they hold no formal status or employment as ‘intellectuals.’”

Rock singer Patti Smith embodies this notion.

Smith arrived on the rock scene with a bang; her 1975 debut Horses established her as a forerunner of the punk generation and helped introduce the world to the New York underground scene that centered on the East Village club CBGB. Forty years on, Horses still resonates. In November 2015, the band played the album in its entirety

at Electric Lady Studios in New York, where it was recorded. Since then, Smith, a Rock Hall inductee, has toured in support of its anniversary, playing Horses in its entirety with original band members Jay Dee Daugherty (drums) and Lenny Kaye (guitar) by her side.

She took a hiatus from touring in 2016 when Daugherty was treated for cancer. Since he’s fully recovered, she’s decided to bring the tour to the Midwest for the first time.

“Cleveland was one of our big cities,” she explain via phone from her New York office. “Our first single, ‘Gloria,’ has a [cover of] ‘My Generation’ that was recorded live in Cleveland.

concerts. It was really raucous. Each city has a special meaning because I have a specific memory of the city at that time. At the Cleveland show, [Velvet Underground’s] John Cale was playing with us and it was really, really quite a raucous night. I think it’s the night where I said, ‘We created it; let’s take it over.’ It became our mantra. It’s the idea that rock was created as a revolutionary expression.”

As Smith explains, Horses distills many of her influences ranging from Jimi Hendrix to Janis Joplin and the art punk band Television. Album opener, a cover of Them’s “Gloria,” features Smith’s howling vocals, turning it into a visceral expression of unbridled desire.

“When we started working in the early ’70s, we didn’t want rock to be some corporate thing devoid of revolution,” she explains. “I was born in 1946 and was privileged to watch rock ’n’ roll completely evolve.

It evolved more and more poetically and politically. In the late ’60s and early ’70s so many things happened.

Jimi Hendrix died. Janis Joplin died.

Brian Jones died. Bob Dylan had a motorcycle accident. The political landscape was changing. Yes, there were people speaking out like Neil Young, but we lost a lot of people like Jim Morrison. There was a shift in who our chief spokespersons were. It was a cultural vocabulary that was being built by these people and then many of them died. Stadium rock and disco and various things — and I’m not putting those things down — were happening. My people were trying to forge a new bridge between the people we had lost and the future.”

Smith says she hasn’t performed Horses in the wake of a Presidential election that put members of the far right in positions of power.

She says she’s not sure what to expect from the concerts but admits that “our concerts always resonate some political concern whether it is Standing Rock or the election itself or our environment.

“We do the album intact exactly as it’s sequenced on the record, but because of the way it was structured, there is room for improvisation in [the

election Horses performances, so I don’t know. We’ll have to see what happens. I’m looking forward to it.”

Smith, who describes herself as a “natural performer” who works on intuition, admits the album’s cover art, a photo taken by the late Robert Mapplethorpe, helped establish her as a punk poet of some stature.

“You know, when you first begin, everything, at least for us, was very innocent,” she says. “I recorded Horses for I thought a very marginalized group of people because of their gender or sexual identity or politics. I was hoping it would communicate to a certain number of people. I felt like they didn’t have a whole lot of people speaking to them. In terms of the cover, Robert [Mapplethorpe] was the artist of my life. I wanted him to shoot it. He had his aesthetic, and I left it up to him.

In terms of how I was dressed, that’s how I dressed. I wasn’t in costume.

That’s what I wore on the street and on the stage. I wanted, in terms of how I presented myself, a mixture of the writer and poet — Baudelaire would wear black ribbons and white shirts. I was trying to encompass rock ’n’ roll and also poetry.”

She says she didn’t know how the photo would play to the general public.

She did know her record label didn’t approve.

“The record company hated the picture,” she says. “They hated that my hair was messy and that my shirt was ripped, but I had creative control.

They let me have the picture, but it wasn’t well received. Robert took it beautifully. It drew a lot of people to that album. [R.E.M. singer] Michael Stipe saw the record and was drawn to the record, and he bought it. He was a teenager. He listened to it over and over, and he said it moved him to want to have a band. The picture taken as an artistic expression between Robert and I resonated with people and drew people to the album.”

She says she still recognizes herself in that photo.

“My daughter looks at pictures of me and says, ‘Mommy, you’re the same person,’” she says. “I’m gray.

On the single “Louder Than a Lion,” lead singer Sherri Dupree-Bemis combines her low register with a pulsing electronic break beat, giving off a more sinister vibe than the band has previously had. MEET THE BAND: Vince Gillman (vocals), Nate Milstein (guitar, vocals), Matt Devonshire (bass), Matt Bryson (drums) POST-GRADUATE WORK: The band started in 2013 when the members moved back to Cleveland from college and began writing songs together. “We started writing things really quickly and put out a CD quickly after forming,” says Milstein. “Matt Bryson is one of my best friends, and we’ve been writing music together for a long time. Matt [Devonshire] and Vince [Gillman] added their own twist to it and added value to what we were writing.”

A SERIES OF EPS: In 2015, the band released its debut, Oceanus, which it cut locally with producer Steve Perrino. “Steve was great to work with and we’ve met a lot of people through him,” says Milstein. “He helped us build a cool network.

He’s a good guitarist and a terrific engineer.” The band followed Oceanus with another EP, last year’s Vulcan. For its new EP, Atlas, the group recruited locally based Jim Wirt (Incubus, Hoobastank and Live). Milstein says Wirt has worked with some of his favorite acts, and he and his bandmates tried to “pick his brain” about producing some of those acts.

WHY YOU SHOULD HEAR THEM: “Control by Fire,” the opening track on Atlas, features snarling guitars and vocals that regularly escalate

into hoarse screams. Incubus-like tunes such as “Parts of Me” and “Say Goodbye” include intricate guitar work that suggests the band’s high level of musicianship.

“Our first EP had more metaloriented stuff, and when we sat down to work on our second CD, we had more of a radio friendly sound. With the new EP, we wanted to split the difference and capture the heavier metal sound as well as catchy chord progressions.”

Milstein says the band’s next goal is to cut a full-length, and it might remaster some of the old songs in the process. The band has been writing new material too and Milstein says it continues to blend metal and rock. “We’ve played with a lot of metal bands in Cleveland and a lot of rock bands,” he says.

“We don’t want to be pigeonholed in one style and have a bigger audience as a result.” For the CD release show at the Foundry, the band will play with several up-andcoming local acts who also have new albums in the works.

C-NOTES FEELS LIKE THE FIRST TIME The Ohio Weather Band wins contest to open for Bon Jovi EARLIER THIS YEAR, CLASSIC rockers Bon Jovi announced an opening act contest designed to give bands the chance to open for them when they play at the Q on March 19.

Thousands of bands uploaded audition videos.

To pick the winner for each tour date, the folks at Live Nation chose 10 finalists, and Bon Jovi management selected the contest winner from the shortlist.

Last week, Live Nation announced that the local rock group the Ohio Weather Band won the contest and will get to play the Q for the very first time.

“The Quicken Loans Arena is a far cry from the garage, where we started,” says the band in a press release. “We’ve traveled to a lot of venues and played with a lot of bands, but this is certainly the biggest opportunity to come our way. Thanks to Bon Jovi, his team and Live Nation for giving us a chance to perform at a legendary venue with a legendary band.”

LOCALS ONLY Akron-based radio station the Summit 91.3 FM regularly puts local bands into rotation and features a streaming channel solely devoted to local music. So it makes sense the station would show its support for the local scene with the new sampler, The 330 Volume 2.

The 21-song disc features tracks from several acts with local roots, including the Pretenders, Mark Mothersbaugh, Michael Stanley, Anne E. DeChant, Welshly Arms, Cloud Nothings, Lindsay Cardy, Ledges and Austin Wolfe.

“The Summit has long been a champion for our rich local music scene,” says Summit general manager Tommy Bruno in a press release.

“Now, with our newest channel the330.net — and this second installment of the 330 sampler — we’re so proud to shine an even brighter spotlight on our region’s impressive, wide-ranging artists.”

The 330 Volume 2 also features late Summit staff member Jim Chenot, who delivers a live, spoken word performance of the Shel Silverstein/ Johnny Cash classic “A Boy Named

Produced by local singersongwriter Ryan Humbert and mastered locally at Cauliflower Audio in Cleveland, the disc will be available during the Summit’s spring membership drive that takes place from March 20 to 25. During that time, every new or renewing member of the nonprofit, public radio station will receive a copy of the CD.

A BLAST FROM THE PAST Last week, Rock and Roll Hall of Famers Daryl Hall & John Oates announced that they’ll partner with ’80s rockers Tears For Fears for a 29-city North American tour. The summer arena tour will also feature a special acoustic performance by opening act Allen Stone. The jaunt includes a May 20 stop at Quicken Loans Arena.

“I am very excited to be touring with Tears for Fears. Their music has a timeless quality that complements what we do. I think everyone is going to love this show!” says Daryl Hall in a press release announcing the tour.

A RICH MAN A fixture on the local music scene for more than 20 years, bassist/ guitarist Adam Rich has just issued his latest studio effort, Sunshine & Puppies.

The album features nearly 20 local guest musicians including members of Beau Coup, First Light, I-Tal, Outlaws I & I, 1000 Hours, Open Range Torch Songs, Xtra Crispy and more.

The songs range from “Superfan,” a tune Rich wrote about his college band State of Green, to “Too Many Tacos (an Ode to Mi Pueblo),” a track about the eastside Mexican restaurant Mi Pueblo that closed in 2014. Several songs deal with the death of Rich’s parents in 2013 and 2014, and he wrote “Move My Soul” about discovering local bands the Janglers and First Light in 1992. The Janglers played at his high school senior prom, and he heard First Light at a party.

Rich released the album, which was mixed and mastered locally at Mann Wolf Studios, on his own Love Muffin

Records.

In addition, Rich plans to turn his basement into a recording studio open to local acts.

“This is sort of the final piece in what I’m really trying to make Love Muffin into,” he says. “I want it to be something that offers recording, graphic design/album design services, radio/press promotion and the yearly LoveMuffinPalooza [benefit] concert. The only things I can’t do professionally are mixing/mastering and duplication.”

In addition, Rich has reissued a 20th anniversary special reprint of his 1997 cassette, Flavor Savor. The original cassette was recorded between 1995 and 1997 at home and college. It’s mostly instrumental, though Rich does sing on two songs.

“I thought it would be cool to release two albums at once,” he says, “sort of a ‘here’s what I sounded like when I was finding myself’ and ‘here’s what I sound like now’ thing.”

The albums will be for sale in Cleveland exclusively at Heights Music Shop on Lee Road. They will also be available online physically and digitally at CDBaby.
