> Earlier this month, Centro San Antonio, a nonprofit cheerleader for “downtown revitalization and development” run by a former top official in the city manager’s office, threw a flashy party on Houston Street between Navarro and Presa, all to celebrate the “rebranding” of downtown San Antonio.

Part of that “rebranding” effort, which Centro CEO Pat DiGiovanni told us was part of the not-at-all vague goal of “building belief in downtown,” was a minute-long Nike ad-style promo video featuring, among Downtown's other things, flyby shots of people doing new "brand" yoga on the Hays Street Bridge and local graffiti artists Shek Vega and Nik Soupe turning a white wall into a stylized version of downtown’s new “logo” – a simple, serpentine-like knot-looking thing.

And how better to celebrate San Antonio talent than with live screenprinting by Cruz Ortiz, the kind of artist Absolut Vodka picks when they want designs for a new Texas-inspired spirit? Throughout the night, Ortiz printed posters one after the other sporting a sharp, clean geometric design showcasing downtown’s new “logo.”

It didn’t really look like Cruz’s work. Because it wasn’t. Because Centro tapped an ad agency from Lincoln, Nebraska to sell San Antonio to itself.

According to Eddie Romero, Centro’s director of marketing and events, the organization pulled together a “marketing steering committee” led by folks with the local convention and visitors bureau, Spurs, Alamobowl, Argo Group, and Southwest School of Art, among others. Romero says Centro then put out a request for proposals from companies “with place branding expertise.” Centro eventually settled on Lincoln-based Archrival, which has, according to the company’s website, worked on ad campaigns for companies like Red Bull, Adidas, and Anheuser-Busch. Archrival, according to its website, also considers itself a leader in understanding “youth culture.” The company’s portfolio includes one other city “rebranding” effort: Lincoln, Nebraska.

Romero told us that Centro reached out to more than 20 San Antoniobased ad and marketing firms but only one submitted a proposal for the project. When we asked who the local companies were, and why the sole local submission was denied, this was Romero’s response, via email: “Archrival’s work was the best – that’s it. That’s what our city deserves.”

When we asked how much Centro paid both Archrival and the local groups that helped throw the downtown “rebranding” party, Romero didn’t respond.

Sure, out-of-town companies can and should be brought in to do business in San Antonio. But if Centro really can’t find a local firm capable of selling San Antonio to itself, it does beg the question of whether the local talent simply doesn’t exist or if it just isn’t being adequately tapped.

Whatever the case, if you were out at Centro’s party last week, that means you got a really cool, Cruz Ortiz-printed keepsake – not one that showcases Ortiz’s signature style, but rather one cooked up by a marketing committee, filtered through a Nebraska ad agency, and then touted as downtown San Antonio’s new “brand.”

> Fetal remains of any abortion or miscarriage in Texas may soon be handed over to volunteers with dubious medical credentials to be buried in an undefined location, according to the state health department.

The Department of State Health Services included this questionable ruling in the newest draft of a proposed anti-abortion law— one that would make all abortion providers responsible for cremating or burying an aborted or miscarried fetus. The second draft comes nearly two months after some 90 people testified at a heated DSHS hearing on the original proposal, where many demanded clarity on the contested rule.

The new draft, however, adds few changes to the original draft—except for the section on financial logistics.

DSHS affirms, in the updated draft, that this fetal burial rule will not have a financial impact on any medical providers involved, for two reasons.

First, the cost of cremation will allegedly be equal to the amount of money abortion clinics already pay to incinerate medical waste. The state offers no other explanation or analysis to back up this finding. The second reason is even more mysterious: “The department notes that... private parties have offered to bury fetal remains without charge.”

In essence, the state will rely on anonymous volunteers—people that may not have any medical accreditation or background—to pick up medical waste and bury it somewhere. For free.

“The idea that compliance with a state health regulation should hinge on the illusory, non-binding promise from unknown persons is unheard of,” said Blake Rocap, legislative counsel for NARAL Pro-Choice Texas.

“That’s not how medicine is practiced in a first world country.”

The updated text does not mention the Texas law that requires an individual to obtain a specific license to dispose of medical waste.

The state also has yet to identify who has offered to bury the remains, and DSHS officials have yet to return our request for comment.

But Joe Pojman, director of the anti-abortion group Texas Alliance for Life, identified one organization that seemed interested in this task. Pojman said that while following the new regulation will likely cost more than clinics’ current method of disposing abortion remains,

the financial difference could easily be covered

by Our Lady of the Rosary, an Austin cemetery.

Thousands of Texas pregnancies end in miscarriage or abortion every year. When we asked Pojman who would cover the cost of every burial, he pointed directly to Our Lady of the Rosary.

“They already offer to bury babies that die from miscarriage or abortion,” he said. “They have offered to take these remains, too.”

This is news to staff at Our Lady of the Rosary.

“We can’t handle the entire state,” said Jimmy Shields, director of family services at the cemetery. “We’d probably just work within the Austin area. Maybe we could work with other cemeteries in the state, but I don’t know. There are a lot of details that still need to be worked out.”

Details that the state may never disclose.

DSHS will publish the updated rule in the Texas Register on Friday, giving the public another opportunity to submit public comment. But based on how few changes were made after the first round of public feedback in August, it’s hard to see the state budging in the future. NARAL plans on submitting another letter, demanding the state clarify why this is an issue of public health—since current disposal methods of abortion and miscarriage remains easily meet medical standards. Rocap isn’t expecting much in reply.

“Leaving the rule so vague, like it is now, makes it easier for the state to defend itself in the future,” he said. “Unclear regulations puts an additional burden on abortion providers.”

It’s a familiar tactic found in anti-abortion laws, Rocap added, allowing lawmakers and anti-abortion advocates to bend vague wording to their benefit.

Some abortion advocates see this specific rule as a direct response to the Supreme Court’s June ruling to block HB 2, the Texas law that would have forced the majority of state abortion clinics to close. The fetal cremation and burial rule was released just four days after the Supreme Court decision.

“The main thing here though, is simple,” Rocap said. “This rule is not based in how modern medicine is practiced. The reasoning completely falls on its face.”

“The city believed that if it builds one shelter, they will come. It’s not that easy,” she said. “We need diners for the homeless all over town, we need housing options, we need to allow churches to do what they’ve always done.”

Until then, she said, the city’s in dangerous waters.

“The council needs to tread very carefully. The whole country is watching San Antonio.”

WHOSE BRIDGE? Legal wrangling continues around the Hays Street Bridge

The City of San Antonio and a group of neighborhood activists that spearheaded the effort to save the Hays Street Bridge were back in court last week in a lawsuit that could dictate what the area around the iconic east side structure looks like in the coming years.

City lawyers and the Hays Street Restoration Group presented oral arguments last Tuesday before the state’s Fourth Court of Appeals as the city fights a lower court ruling that, depending on how you read it, could block further plans for private development around the bridge. At issue is a Cherry Street lot that lines the bridge’s northeast side. The community group, which led the fight to restore the bridge, argues that the city has sold public land to a private developer that they’d promised to turn into park space.

In some ways, the legal wrangling over the future of the Hays Street Bridge is emblematic of the kind of spats we might see more of as long-neglected pockets of the city, particularly near the urban center, see renewed interest from developers. Built in 1910, the bridge was an important connector between downtown and the east side. But in the 1980s, after years of neglect, the city called the bridge dangerous and barricaded it. The bridge sat deteriorating for

decades until neighborhood activists and historic preservationists, who saw its potential as a neardowntown landmark and vibrant public gathering space way before anyone else did, spearheaded efforts to save it.

In its lawsuit against the city, the restoration group pointed to a memorandum of understanding it had with the city around the time the Cherry Street property was donated as part of the effort to rehabilitate the bridge and the surrounding area, a memo that stipulates the Cherry Street property be part of the larger Hays Street Bridge restoration project. Gary Houston, a member of the group that helped raise money to revive the bridge, told us the plan was always to have a park near the bridge, in part to anchor it as a public gathering place.

Instead, the city sold the land to Alamo Beer Co. owner Eugene Simor. When the city and restoration group first reached an impasse over the Cherry Street lot, Simor just tweaked his initial plans and built his brewery across the lot on property he already owned south of the bridge. Ultimately, the restoration group filed a lawsuit to stop development on the Cherry Street lot. Both the city and restoration group claimed victory after a brain-twisting trial verdict that’s still

being ironed out on appeal.

In its appeal up before the Fourth Court Monday morning, the city basically argues that it’s immune from such a lawsuit. City lawyers also continue to argue that the original agreement with the restoration group over the land next to the bridge wasn’t a legal contract and is therefore unenforceable.

Amy Kastely, a lawyer for the bridge restoration group, insists the group is fighting to keep the bridge a public space. The city’s already sold the Cherry Street lot to Alamo Beer Co’s Simor (money from the sale went to a special city account for maintenance of the Hays Street Bridge, which the city says fulfills its obligations to the restoration group). Simor told us via email that Alamo Beer “is developing plans to build a restaurant on the site that will complement the existing beer hall and beer garden.” In the past, he’s floated ideas of mixed-use development around the bridge.

Simor’s plan would also include a partial takeover of the bridge deck, something that’s long irked the group that fought to save the bridge in the first place. Simor told us via email he plans to put tables and chairs for his patrons on an 11-by-100 foot section of the deck that’s “less than half the width of the bridge and would allow plenty of room for pedestrians and cyclist [ sic ].”

It’s a busy Saturday at the Lowe’s Home Improvement that hugs the northbound Interstate 35 access road, and do-it-yourselfers jostle for aisle position while wheeling carts stuffed with power tools, mulch, touch-up paint, leaf blowers, bathroom vanities, dimensional lumber and more.

Similar scenes play out inside of the Lowe’s on Goliad Road on the southwest side, the Wilshire Terrace location and the other seven Lowe’s superstores in town.

Each year, Lowe’s, just like every other San Antonio area commercial and residential property, is assessed a market value by the Bexar County Appraisal District for which a property-tax figure is calculated. For the past three tax years, the average value of Lowe’s ten San Antonio area stores came out to $82 per square foot, according to BCAD records.

Eighty-two dollars sounded far too high to Lowe’s. They countered, during a BCAD review board hearing, that the value should be more like $20 a square foot, as if the bigbox buildings sat empty.

In other words, Lowe’s wanted BCAD to pretend like all of its local stores are permanently defunct, and then come up with a much lower value, even though none of the stores are closed for business.

BCAD decreased Lowe’s value a bit, but not all the way down to $20 a square foot. As a result, a dissatisfied Lowe’s countered by suing BCAD based on a tax dodge known as the “dark-store theory.”

When contesting its appraised value, a big-box corporation can assert that its oversized building is worth as much as a similarly sized structure that has ceased operations (thus, the term “dark”). Because if they were to move out of their warehouses, the property, due to tricky deed restrictions, would sit empty for only-god-knowshow-long. As a result, retailers claim that their buildings are actually worth much less than what local tax assessors have historically determined.

As crazy as it sounds, the maneuver, which is brand new to Texas, is totally legal. Texas – and most other states – doesn’t boast protections in the tax code against the dark-store strategy, according to Texas State Sen. Paul Bettencourt (R-Houston).

The dark-store theory has helped Lowe’s and other bigbox retailers sidestep millions of property-tax payments that would normally help fund city and county services such as fire protection, medical care and public-school education.

A convincing dark-store argument for Lowe’s in Marquette, Michigan has been cited as a reason why a local library there stopped opening on Sundays.

Depending on the result of the Lowe’s vs. Bexar County Appraisal District non-binding arbitration hearing, scheduled for October 17 at a Bexar County Civil District Court, an already decimated property-tax base could be devastated even further. If the retail chain prevails, San Antonio homeowners might also be saddled with higher property tax payments in the coming years.

says Mary Kieke, BCAD deputy chief appraiser. “If Lowe’s value goes down, why would Home Depot, Costco, H-E-B or anybody else pay their fair share of property taxes?”

In a prepared statement that didn’t specifically address the San Antonio Current’s questions, the Mooresville, North Carolina-based, Fortune 500 retailer defends the company’s practice.

“Lowe’s goes through a process every year to review property tax values for all its properties across the country,” writes Karen Cobb, a spokesperson in Lowe’s corporate public relations department. “Stores generate jobs, pay state and local income tax, sales tax and property tax. Just like homeowners, we want to be taxed fairly on the value of our buildings and land.”

CRITICS SAY THAT THE DARK-STORE ARGUMENT doesn’t make any sense, and that the legal tactic, which has worked for big-box chain stores in Michigan, Alabama, Florida and Indiana, is a blatant, callous attempt by corporations like Target and Home Depot to avoid millions of dollars in property taxes.

“It’s a distortion of the appraisal process,” says Kieke of BCAD. “You’re looking at more than $300 million worth of value [for the Lowe’s stores in Bexar County].”

The phenomenon of powerful business proprietors outsmarting tax law isn’t new. In Texas, out-of-state corporations, owners of skyscrapers and oil conglomerates have taken advantage of what appraisal district officials, state lawmakers and real-estate professionals say is a broken property tax collection system. The dark-store theory, critics attest, is simply another exploitation.

The unrest boils down to the uniform-and-equal law that was inked into the Texas Constitution in 1997 and expanded in 2003 to the advantage of commercial and industrial property owners. The ambiguous statute, often called the equity provision, forces a civil court to side with a property owner if the owner feels like his specialty property – whether it’s a big-box store, office tower or refinery – has been unfairly appraised due to a lack of comparables in the immediate area.

In Texas, it’s often impossible for an appraisal district to find a comparable property because the state doesn’t require the disclosure of sales prices. Because real-estate sales numbers are essentially secret, appraisal districts must rely on erratic and incomplete private databases to try and procure hard numbers.

Cash-strapped appraisal districts say that they’re forced to settle disputes because cash-flush corporations drag out and drive up the costs of litigation. “The effect is to simply run up our lawyer and expert costs,” says Kieke, who adds that BCAD has sunk $1.2 million in legal costs to fight Lowe’s over the stores’ 2014, 2015 and 2016 appraised values.

For years, BCAD has faced off against and lost big to Valero and the JW Marriott Hill Country Resort and Spa. The oil giant, whose corporate headquarters is located in San Antonio, sues BCAD annually over the value of its campus, the data center, the servers in the data center, all 150 convenience stores and even their corporate jets, says Kieke.

Meanwhile, the sprawling Marriott resort has been able to lower its value by more than $150 million since 2009.

Last year, coupled with the other commercial and industrial litigation that BCAD settled, a record $19 billion of taxable value was erased from the tax base. As a result, millions of dollars for school districts and basic services, such as roads and city libraries, went poof from the tax rolls. Meanwhile, BCAD has raised the values of all property, resulting in a 25.5 percent increase in property-tax expenses for Bexar County homeowners since 2014.

Homeowners could get some relief in 2017 because last month, the Bexar County Commissioners Court, as part of the 2016-2017 budget, approved a lower overall tax rate.

However, the potential cost savings could be rendered moot if the dark-store strategy continues to spread.

WHEN THE CURRENT ASKED LOWE’S SPECIFIC QUESTIONS about the dark-store strategy in Bexar County, corporate spokesperson Cobb sent us an answer by email. The explanation is exactly the same as a statement Lowe’s provided to the Dallas Morning-News in a September 12 piece about the dark-store theory.

“Determining market value can be a complicated process, but in general, we look at information about comparable property in the area to help determine an appropriate value.

In many cases, independent appraisers help us determine an appropriate market value for our buildings and land,” reads the word-for-word statement that also appeared in the DFW paper.

“We are happy to talk with tax assessors to better understand how they determined the assessed value and to try and find a way to arrive at a fair assessment,” the statement concludes. After the Current pointed out the verbatim similarities and asked for an original comment, Lowe’s stopped communicating with us.

The Current’s questions to Lowe’s about their stances on the dark-store theory and the pending court case with the Bexar County Appraisal District were never answered. The Current also received a white-noise response to this inquiry: had they ever fi led suit on an appraisal district with knowledge that that appraisal district might not have the fi nancial resources to challenge Lowe’s in court; thus, resulting in a decision by an appraisal district to settle out of court?

The dark-store argument first worked in 2013 in Michigan, according to The Mining Journal, when a Lowe’s store – one that was actually empty – successfully argued that the

value of the property isn’t about the sticks and the bricks, but rather the business that takes place inside.

Big-box stores in other states took advantage. In 2014, according to governing.com, the Midwest supermarket chain Meijer used the dark-store theory to slash its assessment from $83 per square foot to $30 per square foot in Marion County, Indiana. Not stopping there, the lawyer representing Meijer was able to get the decision applied retroactively, resulting in a $2.4 million repayment of nine years worth of back taxes.

As the dark-store strategy has gained wider acceptance, lawmakers have scrambled to try and reverse the trend, with little to no success.

Indiana legislators rushed to get dark-store defense on the books, but two laws that were passed in 2015 were repealed due to a violation of the state’s uniformity clause, a constitutional requirement, similar to Texas’ uniformand-equal statute, which says that similar properties must be valued in a equitable fashion. Michigan lawmakers are furiously attempting to push through legislation that would install protections for appraisal districts when faced with the dark-store argument; at press time, a bill that passed the House was awaiting Senate consideration.

Currently, Texas’ tax code can’t protect against the dark-store power play. State lawmakers are scheduled to convene at the Texas State Capitol for the 85th Legislature on January 8; however, property-tax reform short during Texas’ with any bite has fallen woefully recent legislative sessions.

Texas Sen. Bettencourt compares the dark-store arguments to a 2013 Galveston County jury ruling, which determined that the Galveston County Appraisal District had overvalued Valero’s Texas City refinery by $189 million.

The court ordered the Texas City Independent School District to repay the energy corporation $5 million; however, GCAD challenged the lower court’s decision to the 14th Court of Appeals, and now the dispute will be heard at the Texas Supreme Court.

“You get these concepts that come up that have to be litigated because it’s something that’s not in the law,” Bettencourt tells the Current Current.. Bettencourt says that he’s currently collecting information from chief appraisers around the state before deciding what types of bills, if any, to craft for the 2017 Legislature. Along with the Bexar County case, Lowe’s has also filed suit against the Harris County Appraisal District in Houston.

Lowe’s greatest concentration of stores – more than 140 – are located in Texas. If Lowe’s dark-store arguments in Bexar and Harris counties turn out in the retailer’s favor, BCAD’s Kieke shudders to think what could happen next.

“I always think there’s a breaking point and then over time I realize there isn’t,” says Kieke. “It’s kind of like the frog that’s in room temperature water, and then somebody turns up the heat. He doesn’t notice until he’s boiled that he has been cooked.”

A completely legal “dark store” tax dodge comes to Texas. Look out, homeowners, for even higher property taxes.

A fixture of Victorian penny dreadful novels, the Demon Barber of Fleet Street and his partner in crime’s dubious pies first appeared well over 100 years ago. However, Sweeney Todd didn’t become more than a run-of-the-mill murderer until the story was adapted for the stage in the 1970s, when he was given a motivation behind his madness – a quest for revenge against a corrupt local judge. By weaving love, betrayal, rage and music into the story, the lurid tale was made weightier while maintaining the heightened atmosphere of its melodramatic origins. of feminism within Latina culture, by turning this once-derogatory term into a positive word of empowerment. The band agreed that by calling yourself chingona, a woman is destroying social expectations of what is “ladylike” and, in doing so, is taking down the patriarchy.

But it’s more than that — it’s also about celebrating the matriarch. At least, this was the case for Cristina Martinez.

Growing up, Martinez’s mom often referred to her as a chingona, using the word as praise or a way to recognize hard work. She says she never knew the word had a negative connotation until she was older and people started questioning her work — stickers, tiles and jewelry that proudly display sayings like “Chingona como mi madre.”

But it was clear to me that for Martinez, chingona is not just about her mom’s recognition, it’s about the community.

Throughout our conversation, she referenced at least a dozen other women, all of which she considers chingonas that are reclaiming this word through art, poetry, music and community awareness.

When asked about the other organizers behind San Antonio’s first Chingona Fest, “they had my back like a lawn chair,” she says. “It’s so important to support your local chingonas.” And no pair illustrated this support to me better than the girls behind St. Sucia, a local zine that is now taught in college classrooms and sold internationally.

I thought I had a definition figured out by the time I met with Isabel Ann Castro, St. Sucia’s art director, and Natasha Hernandez, editor of the zine, but each woman added something new to the conversation. For Hernandez, anyone who finds power in the word has the right to call themselves chingona. If not, then what are words of empowerment for? She recalls times she used the word to get through the day, because by calling herself chingona, she was saying, “I’m a boss-ass bitch and I’m gonna get shit done.” In her opinion, chingona is for

everybody, and nobody should be denied the ability to use the word to recognize and appreciate one’s self.

For Castro, however, chingona is the holy of holies. The only woman she calls chingona is Frida Kahlo, and instead of looking in the mirror and giving herself a daily reminder of how badass she is, she thinks the word is something you strive to be. She’s an accomplished artist with an array of talents, however, she says she’s far from calling herself chingona. When asked how Latinas are reclaiming this word, she says it wouldn’t be possible without the internet and the way we communicate today.

“In the digital community,” she says,

“connections are built and that equals visibility.” Which is something that professor Barrera’s generation didn’t have.

“We’ve got all those mirrors today,” Barrera says, referring to society’s current fixation with selfies, Facebook, Instagram, etc. Growing up in Laredo, she heard the word chingona, but never in the fashion that we see it today.

“It’s been appropriated by a younger generation,” she says, “as a way of rebellion.”

Barrera emphasized that this shift in meaning is only possible when you have a community that supports each other, one that can collectively stand up and say, “Fuck you, we’re taking it back.”

If you look up “chingona” online, the first definition you’ll find is this: “word used in Mexico for ‘a really fuckin cool girl.’” And while that is, for the most part, true, it hardly scratches the surface of what it really means to be chingona, where the word comes from and how it’s being used today.

That limited definition fails to acknowledge an entire movement associated with the slang term, including its ability to build communities and its power to elevate women of Latina background. Nowadays, to be called chingona is to be regarded with the utmost respect and is considered an honor, but that wasn’t always the case.

Growing up in a household where Spanish was sparse I heard chingona used in two ways: 1. to describe a woman who thought she was a badass, or 2. to describe a woman who got into trouble. Never was it used as a way for a woman to describe herself. So when I saw postings for La Botánica’s celebration of Chingona Fest and local band Lloronas’ Night of the Living Chingona pop up in my newsfeed, I’ll admit that I was taken aback. So, to get a better understanding of the word, I talked with the members of Lloronas, Amanda Vega, Amanda Correa, Honora Sanchez and Jassiel Gomez; Cristina Martinez, the mujer behind VeryThat and co-organizer of the San Antonio Chingona Fest; Isabel Ann Castro and Natasha Hernandez, creators of St. Sucia and Night of the Living Chingona participants; and Cordelia Barrera, Latino/a literature professor at Texas Tech University. “[The word chingona] was used against women who couldn’t be controlled,” says Honora Sanchez, bassist for Lloronas. In her understanding, chingona was previously used to shame women who might have come off as hard-headed or difficult, but now, she says the term is breaking stereotypes. After selecting the current trio of female artists for Artpace’s fall 2016 International Artist-in-Residence program, Massachusetts Museum of Contemporary Art (MASS MoCA) curator Denise Markonish once again lends a curatorial hand in this fall’s Hudson Showroom exhibition. Titled “Objectives,” the exhibition brings together three distinct Texas artists, each with a focus on found objects.

While many of the selections here have overlapping themes, perhaps most stunning is each artist’s apparent connection to nature and science. Inspired in part by the work of her husband, a molecular biologist, Galveston-based artist Kamila Szczesna presents a series of sculptures made from tennis balls.

Covered in resin and flocking and perched atop display stands, the brightly colored constructions recall microscopic specimens.

Encompassing paintings, drawings and personal belongings, artist and educator Jessica Halonen (who lives and works between San Antonio and Austin) ruminates on Prussian blue and the pigment’s accidental discovery around the year 1704. In contrast to Halonen, whose work admittedly holds a high sentimental value, Dallas artist Ryder Richards de-emphasizes the value of his materials by focusing instead on ubiquitous items such as tires

and construction supplies. Expanding on commercial displays and utilitarian arrangements he’s seen installed in front of shops or at boat docks, Ryder’s tire sculptures speak to throwaway culture and its negative effects on the environment.

Easily the most conceptual work in this show is Richards’ Redaction of Labor III, which, as of opening night was nothing more than a stack of sheetrock and lumber placed in front of one of the gallery’s white walls. Over the coming months, the artist plans to use the materials to construct a wall that will cover an existing wall, essentially becoming part of — and disappearing into — the gallery. Here, in a sort of mocking manner, Richards redirects our attention to the often unseen labor invested in artwork and the often fl eeting nature of its end results.

In a media preview, Richards explained his fascination with buying his art supplies at Home Depot so that “nothing is precious.”

“This is not valuable material, it’s all just stuff,” he said. “I’m kind of interested in that cycle of how we produce, and then it gets consumed, and it goes away.

Even this show, in a couple years, maybe someone will remember it ... but maybe in two months no one will remember.”

Actor Jackie Earle Haley hopes The Birth of a Nation helps us heal

Oscar-nominated actor and San Antonio resident Jackie Earle Haley ( Little Children ) wants his new drama, The Birth of a Nation, to make an emotional impact on audiences and show them how much more healing the United States needs to do as a country. In the film, Haley, 55, plays Raymond Cobb, a member of a slave patrol who enforced discipline on black slaves in the antebellum South. The Birth of a Nation tells the story of Nat Turner (Nate Parker), a slave who led a rebellion in Virginia in 1831. Haley spoke to the Current last week about the film.

The Birth of a Nation opens nationwide Oct. 7. > What did you see in the script and your role that made you want be a part of this project?

[Director/writer/producer/star] Nate [Parker] sent over the script and I thought it was full of beauty and horror. It contained a lot of humanity but also incredible inhumanness. Racism is a subject I’m really interested in. I feel we live in a country where our Constitution says we’re all created equal, but we’re not living up to that promise. The character I play is definitely one of the most unpleasant aspects in telling the story. It’s a very emotional and difficult subject to deal with. > Do you think a film like this speaks to some of the injustices we are witnessing today in any regard? I think we can all look back 180 years and recognize the inhumanity that is part of our history.

When we look back to that time and see with such clarity how wrong it was to oppress a certain group of

people, I would like to think that could shed some light in our hearts in this day and age. More of us need to recognize the oppression that is taking place today in our poor neighborhoods like in Ferguson. Things like the war on drugs and privatized prisons have created such systemic racism. There is a lot of crime in these communities, but that’s a symptom. In order to cure that symptom, we need to look at the real problem, which is the lack of opportunity.

> With the record rate black men are incarcerated in the U.S. prison system today, do you feel this is the new form of slavery in this country? Absolutely. Look at some of the other countries like Switzerland and Norway where it’s all about rehabilitation. Our prison system is cruel. The Constitution says no cruel or unusual punishment, but all we’ve managed to do is make cruel usual. It’s absolutely horrible we allow all of this to take place.

> I’ve always been the type of person who can separate the art from the artist. If Mel Gibson or Woody Allen or Roman Polanski make a good film, I’m going to say it. With the controversy surrounding Nate over the last few weeks (a 1999 rape allegation recently resurfaced), do you think it’s fair if people decide they don’t want to support the film? I think people should go check out the film. I think people should also recognize the controversy has been made into a press frenzy. The timing is really questionable, so I think people should think about that as well. I would certainly hope that people go see this film.

> Did you worry playing this type of antagonist— someone with no redeeming qualities—would forever attach you to such a hateful character?

I mean, you did earn an Oscar nomination for your role as a registered sex offender in Little Children, but at least that character loved his mother. Well, I play a lot of bad guys. But bad guys don’t know they’re bad guys. In The Birth of a Nation, I was playing a bad guy who felt he was justified in everything he was doing. He is a product of that time and of that thought process. [In Lincoln ], I played the vice president of the Confederacy. He was convinced

> How do you view Nat Turner’s legacy? I think [the revolt] was heroic. It ended horribly for everyone involved, but the bottom line is that he was fighting for humanity and for people everywhere who were oppressed. I think it was an incredibly brave thing to do. He decided he was not going to live like that anymore and did something about it.

> Your next project is the highly-anticipated film The Dark Tower, adapted from the Stephen King series. What can we expect? I think these guys are doing a pretty good adaptation of the books.

I haven’t read all of them, but I have defi nitely poked around. I really like what they’re doing with it visually.

To say that San Antonio is caffeinated is a bit of an understatement. Since last year’s coffee issue in August, our fair metropolis has seen more roasters and more coffee shops pop up in droves. That means more baristas practicing their tulip-making skills. And what better way to nail latte art than with a monthly competition hosted by one of their own?

Last October, Merit Roasting Co. hosted the first Thursday Night Throwdown (TNT) where upwards of 250 souls filled the small roasting space. Coffee enthusiasts, local baristas, shop owners, and competitors out of Austin and Houston milled about the shop, watching baristas try their luck at creating perfect hearts, tulips and rosettas and going head-to-head in a sudden death-style bracket.

Lauren Deal, assistant manager for Local Coffee at Pearl who also heads donations and community outreach for the company, knew there was a need for the TNTs. She consulted Lorenzo Perkins, co-owner of Austin’s Fleet Coffee Co. who has organized the city’s TNT for the past seven years.

“This is a not a new thing by any means, but he said it was hard for him to get it off the ground, so his previous company hosted the throwdowns for almost a year straight,” Deal said.

That hasn’t been the case in SA where coffee shops often jump at the chance to host the competitions each

month. This August, teensy boutique roasters Estate Coffee Co. hosted 60 people for their TNT with food for purchase by Pinch Crawfish.

“For someone like me who didn’t come from coffee, I got to meet several people,” Ben Annotti, partner with Estate, said over the phone, “It makes it so that we’re working together versus competing with each other.”

Rosella Coffee Co. manager Selina Gonzales, who will host November’s throwdown, echoed the sentiments.

“Is it bad to say I think the TNTs are so cute? It’s just friendly competition and a way to network with people from Austin and Houston,” Gonzales said.

Deal sets up the location and gives the reins over to the shop. To date, TNTs have taken place at Rosella, Halcyon, Press, two Locals, Fairview, Theory Coffee, Paramour, 5 Points Local, Estate and Bakery Lorraine.

“I have a 45-minute meeting with the shop’s representative a month before the throwdown. At that meeting I give them rules, FAQ, common mistakes, roles for staff and ideas for sponsors,” she said.

The trio of judges is often made up of shop regulars, coffee enthusiasts or professionals and the previous month’s winner. The trophy, designed by Grace Barbettini, is a steampunk-esque statue complete with metal milk pitcher perched atop. First place usually includes the buy-in pot ($5 per barista).

And yes, this is still a competition.

“It’s just like any craft,” Deal said. “You draw hundreds of lattes and see so much success at work and then you have one chance to get it right, where you might shake at the wrong time or have bad light. You have to calm your nerves.”

Anything can happen behind a bar filled with unfamiliar equipment. Marco Cardel, September’s champ and owner of Mila Coffee, competed in six TNTs before being crowned victor.

“It’s like driving a new car,” Cardel said while pointing at his custom La Marzocco espresso machine, “I drive this thing every day.”

There are plenty of YouTube tutorials that teach baristas how to pour the perfect amount of leafs on a tulip, or how to craft the cutest heart, but the rush of competition can derail the most artistic of pros.

“You really can’t practice for this,” Rosella Coffee’s Meagan Anderson, a relative newcomer to the coffee game, said while pouring out another latte during a busy Friday morning at the shop.

For its one-year anniversary, TNT returns to Merit Roasting Co. off Presa Street on October 13 from 6 to 9 p.m. Donations are requested from spectators with proceeds going to the Big Brothers Big Sisters of South Texas. ▶ Frida Kahlo-inspired Restaurant Opens in Southtown

> I hate when things sneak by me, but that’s neither here nor there.

All you have to know is there’s a new Mexican eatery in Southtown that pays respects to painter and overall badass Frida Kahlo. Open as of three weeks ago by former Pre-K teacher Andrea Garcia, Casa Azul is an ode to Kahlo’s longtime home, La Casa Azul, where the artist was born, created her art, lived with husband Diego Rivera and eventually died in Coyoacan in Mexico City.

The Southtown Casa Azul is at 1036 S. Alamo St. and its 1,300 square-feet are filled with wooden tables, bright-colored walls and Frida art by local artist available for purchase.

The restaurant, complete with sprawling patio, serves apps (street corn and mole fries), a slew of tortas and mini tacos. The brunch menu, available 11 a.m. to 4 p.m. also molletes, a barbacoa torta, chorizo and egg torta, a chilaquiles torta and a chori-papa torta with chorizo and potato.

Casa Azul is open 11 a.m. to 8 p.m. TuesdayWednesday, 11 a.m. to 9 p.m. Thursday, 11 a.m. to 10 p.m. Friday and Saturday and 11 a.m. to 4 p.m. for Sunday brunch.

Hello, Lowcountry

> A concept that chef Drew Morros and kitchen partner/ best friend Roberta Marques have been kicking around for more than a year is getting close to being realized.

Lowcountry, which Morros and Marques operated as a dinner pop-up or two in early 2015, has found a home at 318 Martinez St. Along with partners Danny Delgado and Andrea Vince of St. Mary’s Strip fame, Morros and Marques are hoping to open Lowcountry later this fall.

Fans of Faust Tavern are already familiar with Morros, a Charleston, South Carolina native who cranks out Southern faves like fried okra, luxurious mac n’ cheese, tasty chicken sammiches and actually delicious vegan alternatives until 2 a.m. at Crossroads Kitchen.

For Lowcountry, eaters familiar with Crossroads Kitchen will get more of the same with a lean toward “Southern flea market food” like boiled peanuts and pork cracklins, and great whiskeys. Add in moody blues and

you’re halfway there.

Get a preview of Lowcountry on October 19 at 9 p.m. with music by Margaret Garrett, the guitar and vocal half of Mr. Airplane Man.

▲ Southtown Pizzeria Opens > Pizza. We devoted an entire issue to it, and spent way too many days eating pies. Yet we can’t seem to stop writing about pizza, especially now with the opening of Southtown Pizzeria, which joins Il Forno and Francis Bogside/Brigid in providing awesome pies to the neighborhood.

Opened by Julie Vrana, a food scientist whose resume includes H-E-B, a stint as a personal chef and helping relocate Adams Extract and Spice, the restaurant sits inside the former El Sol Bakery. Vrana and her partners took over the spot last August, but they have essentially gutted out the existing space in place for a quaint dining

room filled with wooden tables, benches and stools that scream Italian country home with touches of local art provided by Franco Mondini-Ruiz.

All breads are made in-house including two types of doughs, a thin-crust and a hand-tossed. The menu will include soups, sandwiches, pastas and pizzas. For now, lunch specials hovered at around $8.99. The handtossed pizza had an excellent crust, while my dining partner’s spaghetti bolognese was light and fragrant.

Hours during the first week will run 11 a.m. to 2 p.m. and 5 to 9 p.m. Sunday through Thursday and 11 a.m. to 2 p.m. and 5 to 9:20 p.m. Friday and Saturday.

“This Texas Wine Region Has Been Dubbed ‘The New Napa,’” proclaimed an article in the Huffington Post. Claims that the Texas Hill Country is “the second-most visited wine tasting region in North America” abound elsewhere as well. October is Texas Wine Month — it’s a good excuse to get out and see for yourself. If you haven’t travelled Wine Road 290 between Fredericksburg and Johnson City lately, you’re in for a surprise.

At least a modest one. It’s not as though all the peach orchards and pastures have suddenly been given over to vines and tasting rooms. But where a dozen years ago you might have been able to number the wineries on this stretch of road on the fingers of one hand, today there are at least 17 and counting (a new one by the Yates family of Spicewood Vineyards should just have opened between Hye and Johnson City) — and this is without considering tasting rooms in Fredericksburg itself. The Texas Hill Country Wineries group boasts 51 members, and you can visit all of them during the 31 days that make up Texas Wine Month. (texaswinetrail.com) We’re going to stick to an edited few along and close to 290, east out of Fredericksburg. Check individual websites for hours of operation and tasting fees (an inevitable part of the Napa-ization process).

ARMADILLO’S LEAP One of the first wineries you’ll come to is the Armadillo’s Leap. (The name is a cheeky play on pricey wineries such as Napa’s Stag’s Leap.)

The setting, the historic Rocky Hill Compound, is a mini textbook of rustic Hill Country architectural styles; the wines are equally modest, meant for everyday drinking, but worth investigation nonetheless. They include Texas pinot grigio, mourvedre, muscat, viognier and blends such as the appealing Wine Wednesday white.

WEDDING OAK This winery’s main facility is in San Saba, but such is the draw of 290 that they have established a tasting room at equally visit-worthy Wildseed Farms. Wedding Oak’s lineup of 18 wines includes several Texas-grown varietals whose ancestral homes are in Spain, Italy and Southern France. Look for a rosé of sangiovese, whites that blend Verdelho, viognier and vermentino, and reds that pay homage to Rioja — the very grapes that many feel to be the future of Texas viticulture. 100 Legacy Drive, (830) 997-2510 weddingoakwinery.com.

MESSINA HOF HILL COUNTRY A pioneer in the Texas wine industry, Messina Hof, with its roots in Bryan and Grapevine, is also an early-adopter, having seen the promise of 290 in 2011. The original winery produces over 50 wines that run toward the traditional and include cabernet, cabernet franc, chardonnay, gewürztraminer, primitivo and the popular Angel sweet riesling. Look for sherries and sparkling wines as well.

INWOOD ESTATES WINERY & BISTRO Dan Gatlin, 35-year Texas wine veteran, is a pioneer of planting Spanish tempranillo and palomino and also emphasizes Bordeaux-style wines; tempranillo-cabernet blends are a current focus as is another maverick combo — chardonnay-palomino. “Expect the Hill country’s most extensive educational experience,” claims Inwood of its tastings. The property’s bistro grill offers Texas barbecue, several salads, and meat and cheese boards. Taste with the Winemaker sessions take place

4.0 CELLARS If you can’t beat ‘em, join ‘em — and also join together seems to be the philosophy of 4.0, a tasting room collaboration among three Texas wineries with locations elsewhere in the state. Brennan Vineyards, Lost Oak Winery and McPherson Cellars banded together in 2012 to open 4.0; together they also form a fourth winery. 4.0 is to be congratulated for not trying to evoke Tuscany in Texas; the facility’s design is robust, contemporary and welcoming. GRAPE CREEK VINEYARDS If you want to taste the wines of Grape Creek, you’ll pretty much have to belong to the wine club or do so at the winery — or at its Fredericksburg tasting room. BECKER VINEYARDS Becker, now producing more than 100,000 cases of wine per year, began as a search by owners Richard and Bunny Becker for a log cabin weekend getaway. First plantings were made in here 1992; two other vineyards, in Balinger and Mason, also contribute grapes to wines such as the reserve viognier and rousanne, a dry riesling, a reserve malbec and tempranillo.

The facility has expanded over the years to include a spacious, wood- and stone-lined tasting room and covered outdoor verandas and pavilions overlooking vineyards and lavender fields. Of all the ways in which Upper Deck is different than a traditional sports bar, the most noticeable is its location. Near the convergence of 1604 and I-35, in the Live Oak area, there is a massive indoor soccer arena called Soccer Zone. The 30,000-square-foot warehouse has a full-size indoor field, training field, workout facility, concession stand, bleachers, several party rooms and an inflatable bounce house, just for good measure. On the second floor of that arena is Upper Deck Sports Bar, a tiny watering hole run by Marilyn Elder, herself a regular at the facility.

The operation is a compact one, though Elder knows what she’s doing and has a committed clientele. Every night the indoor field hosts a game pretty much every hour, meaning there is plenty of waiting before and after competitions.

Teams of athletic men and their young families often find their way to the outpost after their games, lounging and shooting the shit as they watch the next matchup from the convenient crow’s nest. As the night wears on and more games finish, the crowd grows louder and larger and drinks begin flowing.

The offerings are designed to appeal to groups: Beer buckets of six range from $10 for domestics to $18 for imports, while beer towers offer 100 ounces of anything on tap, starting at $20 for Miller Lite and climbing to $32

for Dos Equis. The selection of cans is standard, though Elder has expressed interest in sourcing more local beers, something her Busted Sandal, Branchline, Freetail and Karbach cans attest to. For a tiny bar run from the second floor of an indoor soccer field, Elder has high expectations for her drink program.

Though the lounge does not have a liquor license, it does serve a host of mixed drinks made with Tekeen, a wine cocktail. Though sporting the modest ABV of wine, the Dripping Springsmade faux-liquor allows Upper Deck to serve cocktails that mirror the real thing in everything but potency. The Manuel Antonio ($7), a refreshing cucumber lime concoction made with mojito mix, was tart and spicy, providing a refreshing foil to the stale air of the arena. The Puerto Limon, a drink made from passion fruit Tekeen and a house passion fruit puree, is one of their most popular drinks, and like all the cocktails, can be made into a pitcher for $15.

Though untraditional, Upper Deck is a lot of fun. The atmosphere is buzzing with adrenaline, yells, toasts, high fives, smiles and laughter. If you’re in the area, or if you are in the mood for some cheap entertainment (admission is free), Upper Deck is the perfect place to get a cheap buzz on surrounded by a welcoming, rowdy crowd of friends.

> Third Root is the best regional amalgamation of the spirit of Latin America’s Nueva Canción movement and the fiercest, most militant type of hip-hop à la Public Enemy. “Yanga’s Theme,” the third single off Third Root’s third album Libertad (Spanish for “Liberty,” out October 11 on Bandcamp), has Easy Lee spitting lines like “Tell me how Prince dead, Donald Trump still living” and Mexican Stepgrandfather (Marco Cervantes) nominating himself with “breaking out the settlement, Mex Step for president.” The song is based on Nas’ 2004 “Thief’s Theme” (off Street’s Disciple).

“We poured our soul into [ Libertad ], [and] current events fueled much of the music and lyrics,” Easy Lee told the Current. Third Root plans an album release party in San Antonio sometime in November (venue and details TBA, and I don’t mean the N. St. Mary’s strip bar) and another special SA appearance during MLK weekend in 2017.

The album was produced by Adrián Quesada (formerly of Austin-based, Grammy-winning Grupo Fantasma and still part of its mostly instrumental alter ego Brownout), who played most of the instruments and is using Third Root’s music as part of his own private celebration: the first 18 months of his Level One Sound studio.

“As a celebration of our first year and a half of being an Austin, TX-based production house/recording studio, Level One Sound will be releasing a slew of singles by bands and artists who have graced the studio since its opening Winter of 2015,” Quesada wrote in a statement.

Third Roots’ contribution is “Yanga’s Theme.”

Among the artists covered by Quesada and his artists: Mazzy Star, Marty Robbins, Prince, Bobby Fuller Four, Mulatu Astake, Mickey and the Soul Generation, and “not one, but TWO songs by Nas (because, well, NAS!) and many more!”

The songs will be released for free stream/download within the next couple of months, according to Quesada. “We know you’ll dig them,” he said. “There’s something for everybody.”

Judging by the work he did with Third Root, that’s a compilation I want to hear. Libertad is a funky, soulful collection of dynamite tracks that include somber memories of Malcolm X (“Bullets for the Truth,” complete with a sample of Denzel Washington in Spike Lee’s 1992 biopic), and the bilingual “Flags & Body Bags” (featuring Sofy Encanto of Elastic Bond) and other guests like our own Vocab and two guys you may have heard of: Mellow Man Ace (“Libertad”) and Fiend. Libertad is a lethal weapon against the anti-immigration, anti-Black and anti-Latino b.s. that more and more seem to be the normal state of things.

“A mix of social justice and jam session,” they said in a press release. “Each song [is] designed to raise questions, incite discussion, and promote healing, growth, and liberation.”

Schoolboy Q Quincy Matthew Hanley, the South Centralborn rapper better known as Schoolboy Q, almost quit music due to the fame frenzy that accompanied his widely-acclaimed 2014 debut Oxymoron, telling Rolling Stone that when he returned to the studio, at first all that came out was what Q called “depressed rap.” Which might explain why his eventual followup with Blank Face LP, which dropped in July, rides that line between swagger and a darkhumored introspection. For the album, which touches on drug-slinging, urban poverty and depression, Q brought in a range of featured artists to round out the unique sound and accentuate the disparate parts of his own complicated psyche – from the outsize hubris of Kanye West to the southern lean of 2 Chainz to the socially-conscious overtones of labelmate Kendrick Lamar.
