BUYERS GUIDE Mallorca is one of the most beautiful islands in the Mediterranean with a stunning coastline, spectacular countryside and an array of exciting leisure activities which make it a perfect location for buying a holiday home or a property for more permanent residence. Our real estate professionals know the Island well and would be happy to advise prospective buyers on the best areas and type of properties that would suit their specific needs.

What are the buying costs?

Buying costs in the Balearic Islands vary depending on the purchase price and whether the property you are buying is new or a resale. The following information outlines the fees and taxes that you can expect to pay in addition to the purchase price, although if you are buying with a mortgage you should allow an additional 2%.

What is the buying procedure?

Buying property on Mallorca is very straightforward and when you buy with Mallorca Sotheby´s International Realty you can rest assured your purchase is handled professionally and correctly. Our experienced team deal with both buyer and seller when handling negotiations and help with any other questions. There are three basic stages of the purchase:

1. Transfer tax • For resale property this is in price bands. The first €300.000 of any purchase is taxed at 7%, the next €200,000 ie. up to a purchase price of €500,000 is at 8%, the next €200,000 is at 9% and any payment in excess of €700,000 is taxed at 10%.

• There is no Transfer Tax for new homes which instead are subject to 4% VAT (IVA) reduced from 8% for 2012, plus 1% stamp duty.

• For plots, commercial premises or garages the VAT (IVA) is 18%.

1. Reservation Agreement & Deposit Buyer and Seller sign a simple reservation agreement and the buyer pays a modest reservation deposit as a gesture of good faith. This confirms the agreement of buyer and seller, subject to the property searches and takes the property off the market, keeping it reserved by the seller for the buyer for an agreed period during which the lawyers will have prepared a Private or Option Contract.

2. Private or Option Contract When lawyers have confirmed that the legal position of the property is in order, the Private or Option contract is drawn up and signed by both buyer and seller. If any irregularities have been discovered, the buyer can withdraw and the reservation deposit returned. If all is well it is usual for 10% of the agreed purchase price to be paid by the buyer. This contract is binding on both parties and if the buyer withdraws he forfeits the deposit.

3. Completion Completion of the purchase takes place at a notary where the deed of conveyance “Escritura Pública” is signed by both parties, the balance of the purchase price is paid and the buyer takes vacant possession of the unencumbered property. Your lawyer will then lodge the deed at the property registry to assure legal title.

2. Notary and land registry fees Fixed by law on a sliding scale, around 1% to 1.5%.

3. Lawyers fees Around 1% of the purchase price.

4. Mortgage fees An arrangement fee of around 1% of the advance is typical. In addition mortgages are taxed, at around 1.5% of the advance.

On-going support After the purchase, Mallorca Sotheby´s International Realty will always be available for clients to offer any help we can. Usually your lawyer will arrange to change the utilities into your name together with the Town Hall taxes, such as the I.B.I (local community taxes) and the Basura (rubbish collection). Equally, if the property is within a community, there will be community fees to pay that vary according to each community. For advice on insurance, tax, banks, finance or indeed any aspect of living on this wonderful island we can introduce you to the best people who will be able to help and guide you.

WIE IST DIE KAUFABWICKLUNG? Das Kaufverfahren von Immobilien auf Mallorca ist sehr geradlinig und wenn Sie mit Mallorca Sotheby‘s International Realty kaufen, können Sie sicher sein, dass Ihr Kauf professionell und korrekt betreut wird. Unser Team ist sehr erfahren und steht dem Käufer sowie dem Verkäufer bei der Abwicklung zur Seite. Es gibt drei grundlegende Phasen des Kaufs:

1. Grunderwerbsteuer • Bei einem Wiederverkauf ist diese gestaffelt. Für die ersten 300.000€ zahlen Sie 7% Steuer. Für die nächsten 200.000€ (z.B. bei einem Kaufpreis von bis zu 500.000€) sind 8% Steuren zu zahlen, für die nächsten 200.000€, 9%, und für alles über 700.000€, 10%.

• Bei Neubau wird keine Grunderwerbsteuer gezahlt, stattdessen sind aber 4% MwSt (IVA) (nur im Jahr 2012, ansonsten sind es 8% MwSt) plus eine Stempelgebühr von 1% fällig.

• Für Grundstücke, Gewerbeflächen und Garagen zahlen Sie 18% MwSt (IVA)

1. Reservierungskaution Käufer und Verkäufer unterzeichnen eine simple Reservierungsvereinbarung und der Käufer hinterlegt eine moderate Kaution als Zeichen des guten Willens. Dies besiegelt die Vereinbarung zwischen Käufer und Verkäufer, und ist nur verbindlich nach positiver Verifizierung der Papiere der Immobilie. Die Immobilie wird vom Markt genommen und über einen vereinbarten Zeitraum für den Käufer reserviert, bis die Anwälte den privaten Vertrag vorbereitet haben.

2. Privat-oder Optionsvertrag Sobald die Anwälte bestätigen das die Rechtslage der Immobilie in Ordnung ist, wird der Privat-oder Optionskontrakt erstellt, und von Käufer und Verkäufer unterschrieben. In dem Fall, dass irgendwelche Unregelmäßigkeiten entdeckt werden, kann der Käufer zurücktreten und die Anzahlung wird zurückgegeben. Wenn alles gut geht, macht der Käufer eine Anzahlung von, in der Regel 10% des vereinbarten Kaufpreises. Dieser Vertrag ist für beide Parteien verbindlich. Wenn der Käufer sich zurückzieht, verliert er die Anzahlung.

3. Abschluss Der Kaufabschluss muss bei einem spanischen Notar durchgeführt werden, wo die notarielle Kaufurkunde “Escritura Pública” von beiden Parteien unterzeichnet und die Differenz des Kaufpreises gezahlt wird. Der Käufer wird dann zum Besitzer der unbelasteten Immobilie.

WIE HOCH SIND DIE KAUFNEBENKOSTEN? Die Kaufnebenkosten für all die zu zahlenden Gebühren und Steuern hängen von dem vereinbarten Kaufpreis ab. Zusätzlich müssen Sie 2% berrechnen wenn Sie eine Hypothek aufnehmen. Die Kosten sind:

2. Notar und grundbuchamt gebühren: Gesetzlicher Staffelpreis, zwischen 1% und 1,5%.

3. Anwaltskosten: Rund 1% des Kaufpreises.

BETREUUNG NACH DEM ERWERB EINER IMMOBILIE Nach dem abgeschlossenen Kauf, steht Mallorca Sotheby‘s International Realty für den Kunden weiterhin gerne zur Verfügung und wir helfen wo wir können. Normalerweise wird Ihr Anwalt veranlassen das Strom, Wasser, IBI (Grundsteuer) und Basura (Müllgebühr) auf Sie umgeschrieben werden. Ebenso, wenn die Immobilie innerhalb einer Gemeinschaftswohnanlage ist, gibt es Gebühren zu zahlen, die je nach jeder Gemeinde unterschiedlich ausfallen. GUÍA DEL COMPRADOR Mallorca es una de las islas más bonitas del Mediterráneo, con costas impresionantes, un paisaje espectacular y una serie de actividades de ocio emocionantes, lo que la convierte en el lugar perfecto para adquirir una propiedad vacacional o de residencia habitual. Comprar un bien inmueble en Mallorca es un proceso claro y conciso y, comprando a través de Mallorca Sotheby´s, puede estar seguro de que su compra se llevará a cabo profesional y correctamente.

Hay tres etapas básicas en la compra: 1. Depósito de Reserva Comprador y vendedor firman un simple acuerdo de reserva y el comprador paga una modesta señal de reserva como acto de buena fe. Esto confirma el acuerdo entre cobrador y vendedor, sujeto a las investigaciones sobre la propiedad, quitándola del mercado y manteniéndola reservada para el comprador durante un periodo acordado durante el cual los abogados habrán preparado un contrato privado u opción.

2. Este contrato compromete a ambas partes y si el comprador se retira pierde el depósito.

3. Cierre El cierre de la compra tiene lugar en una notaría donde se firma la Escritura Pública por ambas partes, se paga la diferencia del precio de compra y el comprador toma posesión de la propiedad desocupada y libre de cargas. Su abogado presentará la Escritura en el Registro Público para asumir título legal.

¿Cuáles son los gastos de compra?

Los gastos de compra para cubrir todas las tasas e impuestos dependen del precio de venta acordado, más un 2% adicional si va a solicitar una hipoteca. Los gastos generalmente son: 1. Impuesto sobre transmisiones patrimoniales (ITP) • En el caso de una reventa éste es de carácter progresivo. Los primeros 300.000€ de cualquier compra serán tributados al 7%. Los siguientes 200.000€, por ejemplo si se trata de una propiedad de hasta 500.000€, tributarán al 8%, los próximos 200.000€ al 9% y todo lo que exceda los 700.000€ tributará al 10%.

• Para viviendas de obra nueva se paga, en vez del ITP, un 4% de IVA (rebajado del 8% habitual durante el año 2012) más un 1% de timbre.

• Para terrenos, superficies comerciales y garajes se paga un 18% de IVA. 2. Impuesto de registro y honorarios de notario Por ley, según una escala móvil, entre el 1% y el 1.5%

3. Honorarios de abogados Sobre el 1% del precio de compra.

4. Gastos de hipoteca Una tasa acordada, de 1% aproximadamente según valor, más un impuesto de 1.5% del anticipo.

APOYO POSTVENTA Tras la compra, Mallorca Sotheby´s International Realty siempre quedará a disposición de sus clientes, ofreciendo nuestro apoyo en todo lo posible. Normalmente su abogado cambiará la titularidad de suministros así como de impuestos o contribuciones municipales como IBI y basura. Asimismo, si la propiedad forma parte de una comunidad, habrá que pagar gastos que variarán según la comunidad.
