Resolution of Mitigation Lands Issue Homebuilders in South Florida were required as a condition of home construction to allocate so called mitigation lands (land to be preserved in a natural state) to offset the environmental impact of Housing development. The land did not have to be located on the develAtlantic, the predecessor of GL Homes, set aside 660 acres located off of Okeechobee Road as mitigation land and signed a conservation easement, as required, under the management of SFWMD. The land and the easement passed to GL Homes when they bought the property. Some time ago, a representative of the SFWMD contacted Sunset Lakes Homeowners’ Association Manager, Nestor Hermida, to request that the Association post a No Trespassing sign on this property to prevent ATV riders from entering the property and causing damage. Searching through documents provided by the developer at Turnover in September 2004, no record of any property transfer could be found. Since the signs without admitting responsibility, which could not be properly assigned at the time. In addition, the SFWMD representative indicated that the area concerned seemed to be overgrown with invasive plants that would have to be removed at the Association’s cost and imposed a deadline to submit a plan for remediation. On the advice of counsel, the Board hired a noted land use attorney, John Voigt, to research the matter. Mr. Voigt conducted an extensive records search on Broward County Property records and discovered that GL Homes continued to be the owner of record of the land in question. He contacted SFWMD with this information and was informed that their records indicated that the land had been turned over to Sunset Lakes Association. Mr. Voigt contacted GL Homes with the information and found that the corporation had been receiving tax bills (0 dollar) since turnover. He brought to their attention that SFWMD had determined that action on the conservation easement was required and that the Association had 1) no authority to expend money on property not owned by the Association and 2) could not even enter the property without trespassing. Acting on the Association’s behalf, Attorney Voigt successfully negotiated an agreement under which GL Homes acknowledged that the property in question is owned by GL Homes and that GL Homes would undertake to bring the property into compliance and work with SFWMD to relieve the Association of any responsibility for future maintenance of the mitigation lands. The Board considers this issue to be successfully resolved.

Tennis Update! A Message from your Tennis Director, Rob Nickels

Thank you for being a part of our wonderful tennis community. It is my pleasure to provide you with our current update regarding our beautiful facility at Sunset Lakes. See you very soon!

The Tennis Facility We hope you are enjoying the first-class condition of our clay and hard courts. My fantastic maintenance team are working very hard each and every day to ensure that the courts are always in perfect condition for your tennis enjoyment. After-School Classes We are very proud of our Junior Tennis program and we are happy to say that we are continuing to welcome more and more children (and their See our junior schedule online at: parents) into our program. On behalf of my team of tennis professionals, I would like to say a big thank you to all of you who have recommended our junior program to your friends and family. Referrals are really appreciated, and it is extremely encouraging to hear the positive comments from parents and from the children too and we promise to continue to work hard to continue to make the junior program one that our community is very proud of.

Tennis Tip: Early Backswing

One of the most common groundstroke errors that we observe is starting the backswing too late. By the time your opponent’s shot has travelled a foot or two from his or her racquet, you know if your next shot will be a forehand or a backhand. This is the time you should start your backswing. But many players are still in the ready position when the ball bounces on their side of the court. In most areas of life, people make mistakes if they are rushed. Tennis is no exception. Start taking the racquet back earlier and you will be surprised at how much more time you will have to stroke the ball.
