MRS JUSTICE LAMBERT DBE - KEYNOTE ADDRESS

Mrs Justice Lambert DBE was instructed in clinical negligence and injury cases of the greatest complexity and value in her time at the Bar. She took Silk in 2009. She acted as Lead Counsel when Dame Janet Smith undertook a review of the relationship between the BBC and Jimmy Savile. In 2014 she was lead counsel in the Hillsborough Inquest where “During my questioning of the match commander, David Duckenfield, he admitted that he lied about fans forcing the exit gate to gain entry to the stadium: the court — packed with the relatives of those who died — fell completely silent.” In 2018 she was appointed to the High Court bench where she has tried a number of notorious murder cases as well as civil injury and abuse actions. She sits in the Court of Appeal (Criminal Division) from time to time.

PROFESSOR DOMINIC REGAN - MASTER OF CEREMONIES

Dominic is Director of Knowledge at Frenkel Topping. His specialty is Civil Litigation Procedure. He is a columnist at the ‘New Law Journal’, writes a column for every edition of ‘Litigation Funding’ and is Special Adviser to the Association of Costs Lawyers.

KAMAL BEDI

Kamal joined NHS Resolution in 2014, having previously worked as a defendant clinical negligence solicitor since 2002 for specialist national law firms, acting for a range of clients on advisory and litigation matters. At NHS Resolution Kamal has had experience of operational and technical claims management, including development and leadership of NHS Resolution’s innovative Early Notification work prior to moving into the Deputy Director of Claims role in 2019.

CHLOE DAVIES

Having read Law at the University of Leeds, Chloe completed her LPC at the Oxford Institute of Legal Practice. From there, she trained at RadcliffesLeBrasseur, London, where she developed her interest for Defendant Clinical Negligence work. After a brief hiatus on qualification, working at Eversheds LLP, she moved to Hempsons (Harrogate) and then DAC Beachcroft (Leeds), before commencing her current role as a Legal Director at Clyde and Co (Manchester). Chloe’s practice focuses predominantly on the highest value, most complex clinical negligence claims. She is also the lead for cases involving fundamental dishonesty and committal proceedings, with significant experience in this area. Chloe is currently involved in a very high-profile group action. Chloe regularly delivers training and seminars on all aspects of clinical negligence cases and is responsible for training and developing junior members of the team.

FRANCESCA O’NEILL

Francesca is highly ranked by both major legal directories across her practice areas. They say she “is an absolute pleasure to work with”… “a fierce and meticulous advocate with technical and procedural expertise at her fingertips” known for ”powerful and clever advocacy, capable of blowing other advocates out of the water”. She has particular expertise at trial and contested hearings and her practice is chiefly focussed on the negligence liability of professionals and public authorities. These include the most complex clinical negligence cases, multi-million pound claims in respect of lawyers, architects and surveyors, social services claims and high profile cases examining the extent of public authorities’ duties, see eg. Osborne & Anor v Cambridgeshire County Council [2022] EWHC 1982), and linked injury-related claims (particularly Inquests, EL/ PL and difficult cases at the juncture of private and public law). Francesca is the author of Thomson Reuter’s Practice Note on lawyer’s scope of duty and has a particular interest in the nature and extent of the duty of care. In 2020, Francesca was appointed to the Attorney-General’s Panel of Counsel and is instructed by the Government in a range of cases – particularly those that involve vexatious litigants and that require civil restraint orders (see eg. Soeb v Secretary of State for the Home Office [2021] EWHC 3403 (QB), Morrell v Health & Safety Executive [2022] 6 WLUK 142). In 2023, she was appointed a part-time Judge of the First-tier Tribunal, sitting in the Health and Social Care Chamber.

MR JAYKAR PANCHMATIA

Mr Panchmatia is a highly motivated and organised Consultant Orthopaedic Spine Surgeon at Guy’s and St. Thomas’ Hospitals, London. He trained at Level 1 UK trauma centres as an orthopaedic surgeon and a neurosurgeon. Mr Panchmatia completed his fellowship at Johns Hopkins Hospital, USA. He has degrees from Harvard University, where he was a Fulbright Scholar, and Cambridge University. He has 70+ academic publications and presentations, and has excellent written and verbal communication skills. Mr Panchmatia is an established expert witness and has a mature medico-legal practice. His practice spans all spinal conditions. He is a specialist in serious/ complex high value injuries. Mr Panchmatia is registered with APIL, AvMA, National Crime Agency (NCA) and the UK Register of Expert Witnesses. Mr Panchmatia was awarded Best Spinal Surgery Expert Witness in Acquisition UK’s 2024 Expert Witness Awards. He offers nationwide consultations, including home and prison visits.

BETHAN PARRY

Bethan is a healthcare Partner based in Manchester. She specialises in clinical negligence litigation and healthcare law. Having originally worked as a Claimant solicitor in a niche clinical negligence practice, Bethan moved across to undertake Defendant work in 2021. She has over 15 years of expertise and supports medical defence organisations, insurers and NHS providing clear and pragmatic advice to primary healthcare individuals, hospital clinicians and privately indemnified medical professionals.

ANDREW PEMBERTON

Andrew set up the Major Trauma Signposting Partnership (MTSP) with St George’s Hospital in 2015. Since then the service has become the leading provider of bedside advice and support for trauma patients working in 12 Major Trauma Centres. Many of the patients supported go on to make personal injury claims and the MTSP has developed a list of trauma experts for lawyers to use when seeking medico legal or rehabilitation input.

DR JEREMY PLATT

Jeremy Platt read Physiological Sciences at Magdalen College, Oxford, and qualified in medicine from the University of Edinburgh. He trained in hospital medicine and haematology in and around Edinburgh and Glasgow before training to be a General Practitioner in Glasgow. He has worked full time as a GP partner at Binfield Surgery, Bracknell, Berkshire for 25 years. Jeremy has been supplying evidence to Claimant and Defendant solicitors about allegations of General Practitioner Breach of Duty for 10 years and in that time has written around 500 reports. He has attended many conferences with lawyers and expert witness meetings. He has given advice to the General Medical Council to assist in their investigation of over 80 allegations of poor practice. Jeremy has had a special interest in prescribing, and he has sat on various committees charged with delivering policies for the local NHS bodies in this field for 18 years. He has advised and contributed to the development of policies in all clinical fields and has given advice and support to colleagues whose prescribing data suggested that this was necessary. Jeremy enjoys travel outside work and is a mad keen golfer.

PROFESSOR GRAEME POSTON

Graeme Poston was a consultant General Surgeon at Liverpool University Hospitals Trust from 1991 until he retired from full-time NHS clinical practice in 2018. However, he continues to work part time for the NHS in an administrative capacity and revalidated again on the GMC Specialist Register for a further 5 years in 2024. He was appointed Professor of Surgery by the University of Liverpool in 2011. He has maintained an active medico legal practice for the last 30 years taking both clinical negligence and personal injury instructions. He has provided in excess of 3,000 reports to the Courts in the UK, Ireland, Hong Kong, St Helena, the Cayman Islands and the USA, roughly 70% claimant instructed.

PROFESSOR PAT PRICE

Professor Pat Price has been working to redefine cancer treatment for 35 years. She trained in general medicine in Cambridge and in oncology at the Royal Marsden Hospital. She undertook her research degree at the Institute of Cancer Research and was awarded the Cambridge University medal for best laboratory-based MD in 1991.

MR NIKHIL SHAH

Mr Nikhil Shah is a fellowship-trained orthopaedic consultant with special interest in trauma, hip and knee replacements. He is part of the tertiary regional pelvic-acetabular and periprosthetic fracture service. He has won several prestigious awards including the Rothman Ranawat American Hip Society Travelling Fellowship, the Walter Mercer medal and the Edward Burton Memorial Prize. He is well-published in his areas of interest and regularly writes articles in medico-legal and expert witness journals. Mr Shah teaches on many trauma and joint replacement courses, and medico-legal courses. He provides personal injury and clinical negligence reports in his areas of interest.

CLARE STAPLETON

Clare Stapleton is a Medicolegal Consultant at the London Office of Medical Protection. Before joining MPS she was a Consultant in Anaesthesia and Intensive Care at Wexham Park Hospital, Frimley Health for 16 years. She was the patient safety lead clinician and also led the mortality review process and set up the Medical Examiner service at Frimley Health. At Medical Protection she assists members by providing medicolegal advice and supports and advises doctors who are involved in serious incidents, inquests, disciplinary and regulatory investigations.
