A MESSAGE
FROM STATE DIRECTOR ANDRÉ C. WADE
Dear Silver State Equality Supporters, It is safe to say that many of us started 2021 with high hopes that our biggest challenges were behind us. Unfortunately, we soon learned that the COVID-19 pandemic would continue devastating our society, and that our nation’s democracy was under attack following the insurrection at the U.S. Capitol on January 6. Despite these threats, Silver State Equality held steadfast in 2021 to our mission to bring the voices of LGBTQ+ people to the State Capitol in Carson City. We wanted to create a world that is healthy, just and equal, and we did that by sponsoring three bills and working with the Nevada Equality Coalition to pass innovative and historic pro-equality legislation. Silver State Equality’s successful legislative package reformed our outdated, ineffective laws that criminalized people living with HIV; allowed families with three or more adults to legally care for a child; and required state and local government to collect data of the people they serve based on sexual orientation and gender identity and expression. In addition, Silver State Equality supported 18 other proequality bills, including ones requiring: LGBTQ+inclusive curriculum be taught in public schools; the state extended special recognition to businesses owned by LGBTQ+ people and people of color; and the creation of more single-occupant, public restrooms.

While 2 of the 19 bills did not pass — one requiring health insurance companies to cover gender-affirming care for transgender and nonbinary people and another that would have better protected transgender people who are incarcerated — Silver State Equality and the Nevada Equal Rights coalition are committed to passing this critical legislation in future sessions. No matter the scale of the challenges that we confronted in 2021, we are confident that the work we accomplished on behalf of LGBTQ+ Nevadans will improve our everyday lives. We know that when we continue to work in coalition with progressive organizations, pro-equality legislators and diverse advocates and community members (through an intersectional lens), we will make Nevada stronger and more equal. THANK YOU, LGBTQ+ LEGISLATORS The Nevada Legislature proudly includes five openly LGBTQ+ members: Senators Dallas Harris (D-Las Vegas), Melanie Scheible (D-Las Vegas) and Pat Spearman (D-Las Vegas); and Assemblymembers Sarah Peters (D-Reno) and Cecilia González (D-Las Vegas). Our state and community is much stronger because of their presence in the capitol, and we greatly appreciate their leadership advancing bills to create a healthier and more equal life for all LGBTQ+ Nevadans. Their success rate of getting LGBTQ+ bills signed into law shows just how compelling and persuasive they are in building a coalition, and securing the votes of their legislative peers.

PRIORITY SCORED LEGISLATION
Silver State Equality’s legislative package addressed disparities in the criminal justice system, inequities amplified by the COVID-19 pandemic, and the need to strengthen protections for families formed through adoption. Of our three priority bills, all of them were signed into law by Governor Steve Sisolak; including 18 other bills we worked on in partnership with the Nevada Equality Coalition - that addressed hate crimes, education, equality access to public accommodations, and HIV prevention. SPONSORED BILLS Multi-Parent Adoption AB 115 by Assemblymember Rochelle Nguyen (D-Las Vegas) AB 115 allows more than two adults to be formally and legally recognized as parents when adopting. Families of diverse backgrounds often have more than two adults who are actively engaged in parental duties and responsibilities, and these families will be afforded certain legal rights and options in order to provide stability for their families. Data Collection SB 109 by Senator Pat Spearman (D-Las Vegas) Senate Bill 109 requires government agencies in Nevada to request information related to sexual orientation and gender identity from the individuals it serves, and report the data to the Legislative Counsel Bureau each year. Ultimately, the accurate and efficient collection of this information will improve Nevada’s ability to provide public services. Status: Signed by Governor Sisolak.
HIV Modernization SB 275 by Senator Dallas Harris (D-Las Vegas) Senate Bill 257 creates a framework for recognizing HIV as a public health issue, rather than a criminal one. SB 275 encourages increased HIV testing, treatment and the use of other preventative options that will help to reduce the spread of HIV, and ends the criminalizing of those who are living with HIV. Status: Signed by Governor Sisolak.
BILLS SCORED BUT NOT SPONSORED Inclusive Curriculum AB 261 by Assemblywoman Natha Anderson (D-Sparks) AB 261 requires instruction be provided to public school students enrolled in grades K-12 about historically underrepresented groups, including Native Americans, LGBTQ+ persons or gender and sexual minorities, immigrants, refugees, Asian American Pacific Island community, Black community, Hispanic community, etc. Status: Signed by Governor Sisolak.

Single Occupant Restrooms AB 280 by Assemblywoman Sarah Peters (D-Reno), et al AB 280 requires places of public accommodation, public buildings, and facilities that are owned by a public body to provide single-occupant restrooms accessible to a person of any gender identity or expression. Status: Signed by Governor Sisolak.
Continuing Education for Mental Health Professionals AB 327 by Assemblywoman Selena Torres (D-Las Vegas), et al AB 327 requires certain mental health professionals to complete continuing education related to cultural competency and diversity, equity, and inclusion. Status: Signed by Governor Sisolak.
Race-based Bullying and Cyberbullying AB 371 by Assemblywoman Brittney Miller (D-Las Vegas), et al AB 371 establishes provisions related to discrimination based on race in schools. This includes bullying and cyberbullying. Status: Signed by Governor Sisolak.
Implicit Bias Training for Juvenile Justice Staff SB 108 by Senate Judiciary Committee This bill requires the Division of Child and Family Services of the Department of Health and Human Services to adopt implicit bias training for their staff that comes in contact with juveniles who are involved in the juvenile justice system in Nevada. Status: Signed by Governor Sisolak.
Testing for HIV and Sexually Transmitted Infections SB 211 by Senators Dallas Harris (D-Las Vegas) and Joseph Hardy (R-Boulder City) This bill requires providers of emergency medical services in a hospital or primary care facility to consult with patients as to whether they would like to be tested for sexually transmitted infections. Status: Signed by Governor Sisolak.
Creating Diversity, Equity, Inclusion Liaisons SB 222 by Senator Melanie Scheible (D-Las Vegas) This bill requires certain state agencies to designated a diversity and inclusion liaison and requires the Office of Minority Health and Equity of the Department of Health and Human Services, Nevada Commission on Minority Affairs of the Department of Business and Industry and the Office for New Americans in the Office of the Governor to facilitate an annual meeting between diversity and inclusion liaisons and minority groups. Status: Signed by Governor Sisolak.
Promoting LGBTQ+ Owned Businesses SB 237 by Senators Melanie Scheible (D-Las Vegas) and Dallas Harris (D-Las Vegas) SB 237 requires programs intended to encourage and promote certain business enterprises specifically includes businesses owned by LGBTQ+ people. Status: Signed by Governor Sisolak.

Equal Rights Amendment SJR 8 by Senator Nicole Cannizzaro (D-Las Vegas), et al This bill would amend the Nevada Constitution to guarantee equal rights and prohibitions against disrimination on the basis of sex and other characteristics such as sexual orientaiton and gender identiy, which must be presented to voters through a ballot measure for passage. Status: Will appear on the statewide 2022 ballot.
HIV Medication and Pharmacists SB 325 by Senator James Settelmeyer (R-Minden) This bill requires the State Board of Pharmacy to prescribe a protocol authorizing a pharmacist to prescribe, dispense and administer drugs to prevent the transmission of HIV. Status: Signed by Governor Sisolak.

SILVER STATE EQUALITY STATE LEGISLATIVE SCORECARD
2021 Methodology In the scorecard that follows, the analysis of votes is based primarily on the final floor votes cast on the measures. “Yes” votes on scored legislation are represented by “1” and “no” votes are represented by “0.“ Legislators who are present but not voting are denoted by an “A” for “abstaining,” which is scored as equivalent to a “no” vote on sponsored or supported legislation. Passage of legislation typically requires a “yes” vote by the majority of all legislators, so failing to cast a vote has the same effect as a “no” vote. Legislators who were officially absent for a vote had their absence factored into the score, but explained and denoted on the scorecard with an “E” for “excused.” Missed votes on scored legislation may be excused if the legislator was a cosponsor, voted to support the legislation at a previous floor vote or in committee, or was absent from the floor on official business. The overall score reflects legislators’ votes on Silver State Equality’s three priority bills marked with an asterisk “*” and bills prioritized by the Nevada Equality Coalition.

SILVER STATE EQUALITY GOVERNOR SISOLAK SCORECARD
2021 Thank you, Governor Sisolak! Governor Steve Sisolak proved in 2021 to be a strong advocate for the LGBTQ+ community and people living with HIV. He signed all three of Silver State Equality’s priority bills into law, and signed 18 of the bills we supported in coalition with the Nevada Equality Coalition.
