Friends and Advocates, Equality California and Silver State Equality are delighted to present the 2022 Federal Scorecard, an in-depth analysis of the congressional term’s latter half, emphasizing the need to further bolster the pillars of equality and justice in our society. Despite pro-equality majorities in the House and Senate during the 117th Congress, the path towards equality faced stiff winds as narrow partisan majorities impeded the progression of several critical legislative priorities. Our scorecard reflects this journey, encompassing essential bills such as the Equality Act, the ‘For The People’ Act, and the George Floyd Act, which despite their inherent significance, faced roadblocks this term. However, these setbacks do not denote an end; instead, they mark a rallying point for renewed vigor and commitment in the upcoming 118th Congress. In the midst of these challenges, the 117th Congress witnessed a beacon of hope and progress: the passage of the Respect for Marriage Act. Following the unsettling remarks in Justice Clarence Thomas’ concurring opinion in the Dobbs ruling in June 2022, Senator Dianne Feinstein spearheaded the initiative to safeguard marriage equality. This monumental Act, which repeals the archaic Defense of Marriage Act, garnered extensive bipartisan support and was signed into law by President Biden on December 12th, standing as a testament to the possible harmonization and cooperation towards a more inclusive future. As we look forward to the 118th Congress, commencing in January 2023 under Republican leadership, Equality California and Silver State Equality are gearing up to champion a spectrum of crucial bills, including but not limited to the Every Child Deserves a Family Act and the LGBTQ Data Inclusion Act. These unscored yet significant bills resonate with our enduring pledge to foster and promote equality. The evolving political landscape in California and Nevada, reflected in the congressional delegations, only reinforces our determination to build bridges and collaborate extensively to advance pro-equality protections. While California will represent with a delegation of 52 Members, with a 42-11 partisan breakdown, Nevada retains its stronghold with a steadfast Democratic representation. In these dynamic times, the DC office of Equality California and Silver State Equality stand united in the endeavor to work tirelessly with the members of the California and Nevada Congressional delegations. Together, we aim to carve a path that champions support and expansion of pro-equality protections, echoing the true spirit of equality and inclusivity. As we gear up for another term, we extend our deepest gratitude to our community of supporters, allies, and advocates. SCORED FEDERAL LEGISLATION Equality California and Silver State Equality’s 2022 federal scorecard includes ten House floor votes on priority bills. The Senate scorecard reflects two Senate floor votes (the Respect for Marriage Act and the anti-Asian violence COVID 19 Hate Crimes Act), as well as co-sponsorship of 10 other priority bills. SPONSORED BILLS Equality Act H.R. 5 by Rep. David Cicilline [D-RI] and S. 393 by Sen. Jeff Merkeley [D-OR] The Equality Act would amend existing federal civil rights laws to prohibit discrimination on the basis of sexual orientation and gender identity in public spaces and services and federally funded programs. Passed the House 224-206 with only 3 Republicans voting yes. The bill was not voted on in the Senate. Respect for Marriage Act H.R. 8404 by Rep. Jerold Nadler [D-NY] and S. 4556 by Sen. Dianne Feinstein [D-CA] The Respect for Marriage Act repeals the Defense of Marriage Act and would accord federal recognition of married couple’s legal rights, benefits, even if they live in a state that later outlaws same-sex marriage, establishes a private right of action for violations. Passed the House 258 – 169 – 1, the Senate by 61-36, and signed into law by President Biden on Dec 12.

For the People Act H.R.1 by Rep. John Sarbanes [D-MD] and S. 1 by Sens. Chuck Schumer [D-NY) The rewritten ‘For the People Act,’ is an amalgam of 60 pieces of legislation, which would change congressional campaign funding, set standards for voting, and establish new ethical standards for lobbyists, lawmakers, federal officials and Supreme Court justices. Passed the House 220-210. The bill was not voted on in the Senate. American Dream and Promise Act H.R. 6 by Rep. Lucille Roybal-Allard [D-CA] This immigration bill would enable Dreamers to earn lawful permanent residence and American citizenship. It also extends protections and provides a path to citizenship for people with Temporary Protected Status (TPS) and Deferred Enforced Departure (DED) status. Passed the House 228-197. The bill was not voted on in the Senate. National Origin-Based Anti-Discrimination for Nonimmigrants Act (NO BAN) Act H.R. 1333 by Rep. Judy Chu [D-CA] and S. 1891 by Sen. Chris Coons [D-DE] The NO BAN Act seeks to limit presidential power and increase accountability under the Immigration and Nationality Act by prohibiting discrimination on the basis of religion and national origin whenever a president suspends the entry of individuals into the U.S. Passed the House 218-208. The bill was not voted on in the Senate. Women’s Health Protection Act H.R. 3755 by Rep Judy Chu [D-CA] and S. 1975 by Sen. Richard Blumenthal [D-CT] WHPA writes the right to abortion into federal law and provides clear guidance to states and courts about the rights of medical providers’ ability to deliver abortion services free from medically unnecessary and onerous restrictions, such as needless waiting periods, burdensome admitting privilege requirements for providers, or unnecessary medical procedures, like ultrasounds. Violence Against Women Reauthorization Act H.R. 1620 by Rep. Sheila Jackson Lee [D-TX] VAWA provides states with funding to prosecute sexual and domestic violence offenders and provide critical services to victims of disproportionately-targeted groups, including Native Americans, immigrants and LGBTQ people, and reauthorizes the Trafficking Victims Protection Act. Passed the House 244–172. The bill was not voted on in the Senate. George Floyd Justice in Policing Act H.R. 1280 by Rep. Karen Bass [D-CA] This police misconduct and abuse bill would make it easier to hold officers accountable through criminal charges and civil penalties, require the use of de-escalation techniques and deadly force only as a last result, ban chokeholds and no-knock warrants in drug-related cases; require federal uniformed police officers to wear body cameras and marked federal police vehicles to have dashboard cameras. Passed the House 220-212. The bill was not voted on in the Senate.

COVID-19 Hate Crimes H.R. 1843 by Rep. Grace Meng [D-NY] and S. 937 by Sen. Mazie Hirono [D-HI] This coronavirus-related anti-Asian violence bill which requires the Justice Department to expedite the review of COVID-19-related hate crimes was combined with the Jabara-Heyer NO HATE (National Opposition to Hate, Assault, and Threats to Equality) Act, introduced by Representative Judy Chu [D-CA], which modernizes crime reporting, supports state-run hate crime hotlines, and improves hate crime data collection. Passed the Senate 94-1 and House 364-62. Signed into law by President Biden. Anti-LGBTQ+ Amendments to FY2022 Appropriations Bill (H. Amdt. 83 to H.R. 4502). Virulently anti-LGBTQ+ Representatives Debbie Lesko (R-AZ), Virginia Foxx (R-NC), and Russ Fulcher (R-ID) offered amendments to an FY2022 appropriations package that would have allowed child welfare organizations to discriminate and gut nondiscrimination protections for federal contractors. The House defeated the amendment 192-232.

LEGISLATION SUPPORTED, BUT NOT SCORED In addition to our scored legislation in 2022, we supported a number of important pieces of legislation that did not receive votes in the full House or Senate but that we believe would significantly improve the lives of LGBTQ+ people and the diverse communities to which we belong. We selected these nine pieces of legislation because they show the breadth of issues we engage on in Washington, D.C., and we indicated which members of the California and Nevada delegations co-sponsored these critical bills in the 117th Congress. The John Lewis Every Child Deserves a Family Act H.R. 3488/ S. 1848 by Representatives Danny Davis [D-IL], Angie Craig [D-MN], and Jenniffer González-Colón [R-PR] and Senator Kirsten Gillibrand [D-NY]. The Every Child Deserves a Family Act would prohibit federally funded child welfare service providers from discriminating on the basis of sexual orientation, gender identity, marital status and religion, ban conversion therapy for foster youth, require data collection on LGBTQ foster youth and parents, and require federally funded foster staff to be trained in affirming the complex social identities of children in foster care, as currently required for runaway and homeless youth. Neither the House nor the Senate voted on this bill. Do No Harm Act H.R. 1378 / S. 2752 by Representative Bobby Scott [D-VA] and Senator Cory Booker [D-NJ] The Do No Harm Act would clarify that the original intent of the 1993 Religious Freedom Restoration Act (RFRA) was to protect religious exercise and cannot be used to violate civil rights by using the justification of religious exemptions. Neither house voted on this bill. U.S. Citizenship Act H.R. 1177/ S. 348 by Representative Linda Sanchez [D-CA] and Senator Bob Menendez [D-NJ] This comprehensive immigration reform bill would provide an earned path to citizenship, address the root causes of migration, better manage the southern border, reform the visa system, and end discrimination against LGTBQ families. Neither house voted on this bill.

Equal Access to Abortion Coverage in Health Insurance (EACH) Act H.R. 2234/ S. 1021 by Representative Barbara Lee [D-CA] and Senator Tammy Duckworth [D-IL] The EACH Act would repeal the Hyde Amendment and thereby restore abortion coverage for people who receive health care or insurance through the federal government and prohibit state or local governments from restricting abortion coverage by private health insurance plans. Neither house voted on this bill. REPEAL (Repeal Existing Policies that Encourage and Allow Legal) HIV Discrimination Act H.R. 6111 by Representative Barbara Lee [D-CA] This bill would require federal and state laws that target those who test positive for HIV for unique and unwarranted punishment, including the Uniform Code of Military Justice. It would create incentives for states to reform their existing criminal laws for behavior that is otherwise legal (such as consensual sex between adults) or that poses no measurable risk of HIV transmission. Neither house voted on this bill. PrEP Assistance Program Act H.R. 5605 – by Representatives Bonnie Watson Coleman (D-NJ), Barbara Lee (D-CA), Adam Schiff (D-CA) and Mondaire Jones (D-NY) This bill would make the preventative HIV drug PrEP more affordable and accessible to underserved and high-risk populations. It would also provide grants to cover medication costs, clinic and testing fees, physician visits and community outreach programs. Neither house voted on this bill. Greater Leadership Overseas for the Benefit of Equality (GLOBE) Act H.R. 3800/ S. 1996 by Representative Dina Titus [D-NV] and Senator Ed Markey [D-MA] The GLOBE Act would promote LGBTQI rights around the world by using existing sanctions to punish countries that abuse LGBTQI people, ensure U.S. foreign assistance and global health programs include LGBTQI people, decriminalize LGBTQI status in rule-of-law programs, ensure fair access to asylum and refugee programs for LGBTQI people who face persecution, and clarify that children born abroad by assisted reproductive technology, including surrogacy, to US citizen couples who are legally married. Neither house voted on this bill. LGBTQ Data Inclusion Act H.R. 4176/ S. 2287 by Representative Raul Grijalva [D-AZ] and Senator Tammy Baldwin [D-WI] This proposal would require all federal population surveys to collect voluntary, self-disclosed information on sexual orientation and gender identity. Neither the House nor the Senate voted on this bill. Safe School Improvement Act [SUPPORT] H.R. 4402/ S. 2410 by Representative Linda Sanchez [D-CA] and Senator Bob Casey [D-PA] SSIA would require school districts to implement comprehensive anti-bullying and harassment policies that ensure the safety and well-being of their students, including youth who are bullied or harassed on the basis of actual or perceived sexual orientation or gender identity. Neither the House nor the Senate voted on this bill. Therapeutic Fraud Prevention Act [SUPPORT] H.R. 4146/ S. 2242 by Representative Ted Lieu [D-CA] and Senator Patty Murray [D-WA] This bill would protect LGBTQ minors by directing the Federal Trade Commission to treat the advertising of socalled “conversion” or “reparative” therapy as a fraudulent medical practice because sexual orientation and gender identity are immutable. Neither the House nor the Senate voted on this bill.

Co-sponsoring or voting for pro-equality legislation are indicated by “1” while failing to co-sponsor or vote for pro-equality legislation are indicated by “0”. The overall score reflects officials’ votes for, or co-sponsorship of, legislation scored by Equality California and Silver State Equality (highlighted in RED) as of December 31, 2022. Highlighted in ORANGE is co-sponsorship of priority legislation NOT factored into this year’s scoring, but it may in the future.
