How to Pass a Bill in New Mexico Each legislature lasts two years and has two constitutionallymandated sessions. The first session lasts for 60 calendar days and occurs in odd-numbered years, convening in January. The second session is for 30 calendar days and occurs in even-numbered years. Bills in the second session are limited to fiscal matters, items specified by the governor and bills passed in the previous session that were vetoed by the governor. The governor can call a special session, as can the legislature with a three-fifths vote of both the Senate and House of Representatives. Members of the Senate are elected to four-year terms without term limits. Members of the House of Representatives are elected to two-year limits without term limits.

Bill Introduction

Regardless of how the legislature is convened, all bills follow the same path through the legislature. Any bill can be introduced in the Senate or House of Representatives– unlike the United States Congress, where only the House can introduce tax bills. The bill is assigned a number, read twice, printed, and referred to the proper committee.

Committee Reviews

To the Governor’s Desk

Bills that pass both the Senate and House of Representatives go to the governor to be signed or vetoed. They are formally prepared by either the Senate or House of Representatives where they originated, signed by the speaker of the house and the president pro tempore of the senate, and forwarded to the governor. The governor can sign the bill, making it law, veto it, or line-item veto it, if the bill contains an appropriation.

If the governor doesn’t sign or veto a bill within three days—and if the legislature is still in session—it becomes law. If the legislature has adjourned, the governor has 20 days to sign bills. Unsigned bills are pocket vetoes.

The legislature can override the governor’s veto with a twothirds vote by the Senate or House of Representatives.

When a Signed Bill becomes Law

Signed bills typically become law 90 days after the legislature adjourns. However, the legislature can specify an emergency, which makes the bill effective when the governor signs it, or at a later date for the law to go into effect.

Each bill is reviewed by one or more committees in the Senate and House of Representatives. The committees can approve the bill, amend it, substitute it, forward it to the next committee with no recommendation, or kill the bill by tabling it. Committee hearings are open to the public.

If a bill passes its committee hearings, it will be considered by the Senate or House of Representatives where it was introduced. The bill is placed on their calendar, which means it is formally scheduled for its third reading, and a final vote.

The Final Vote

If it passes, the bill moves to either the Senate or House of Representatives and repeats the entire process. If approved in the same form, it goes to the governor to be signed or vetoed. If the Senate or House of Representatives passes a different bill, they form a conference committee to work on a compromise. If the committee agrees on a compromise, the bill goes back to the Senate or House of Representatives for a final vote.

New Mexico’s Rural Electric Cooperatives

ver 210,000 New Mexico families and businesses own their rural electric cooperatives. They control its bylaws, vote on any significant changes in its operations and elect trustees to direct its activities. Their cooperatives serve 80 percent of the land mass in New Mexico, from Chama in the north to the oil fields of the Permian Basin in the southeast; from the northeastern grasslands to the bootheel desert.

There are 16 rural electric distribution cooperatives in New Mexico (see back page for listing). They have invested over $1.2 billion to provide reliable electric service to their members. They employ over 800 New Mexicans as linemen, customer service representatives, engineers, warehouse operators, and other positions. Because their members live in sparsely populated areas, that investment includes over 46,000 miles

of power lines. New Mexico’s co-ops serve an average of 4.6 consumers per mile of power line.

There are also three distribution cooperatives that are associate members of the New Mexico Rural Electric Cooperative Association. They are Duncan Valley Electric, Duncan, Arizona; Navopache Electric, Lakeside, Arizona; and Rio Grande Electric, Brackettville, Texas. Twelve of the 16 New Mexico distribution cooperatives receive wholesale power from Tri-State Generation and Transmission Association, headquartered in Westminster, Colorado. The remaining four receive power from Western Farmers Electric Cooperative, headquartered in Anadarko, Oklahoma.

New Mexico’s rural electric cooperatives protect the interests of their consumer-members through their statewide association, the New Mexico Rural Electric Cooperative Association, headquartered in Santa Fe.

Cooperative Annual Meetings

Energy Efficiency Programs

• Members conduct the business of the cooperative at their meeting, electing trustees and voting on bylaws and other major changes to their co-op’s governance • Co-ops are governed by seven principles, including requirements for voluntary and open membership and for democratic control by their members.

• Voting is central to their governance.

As consumer-owned businesses, rural electric cooperatives are accountable to the people they serve, who exercise that control through the ballot box.

To meet up to 5 percent of their co-op requirements for the renewable portfolio standard, rural electric cooperatives provide financial rebates to encourage consumermembers to be more energy efficient.

• Rebates are provided to eligible consumer-members who purchase energy efficient appliances, such as electric water heaters, refrigerators and geothermal ground source heat pumps.

• Rural electric cooperatives also provide financial rebates toward new construction, and to consumer-members who retrofit their existing homes or businesses with energy efficient items, such as geothermal ground source heat pumps, high R-value insulation, and heating and cooling systems.

• The cooperatives consistently encourage consumer-members to practice energy efficiency and conservation: from weather stripping doors and windows, to turning off the lights when leaving a room.

• The cooperatives offer free energy audits to consumer-members to identify ways to make their homes or businesses more energy efficient.

• Rural electric cooperatives also offer a green power program to consumermembers who have the opportunity to purchase renewable energy.

Cooperatives and Communities The rural electric cooperatives strongly support their communities. For example: • Scholarships: They collectively operate one of the largest non-governmental scholarship programs in New Mexico.

Over 470 New Mexico scholars receive over $817,000 per year from non-profit foundations founded and funded by the state’s electric cooperatives.

• Government-in-Action Youth Tour: New Mexico’s rural electric cooperatives participate in the annual tour, joining 1,500 high school students from across America in Washington, D.C., to learn about our federal government and rural electric cooperatives.

The students compete for this honor at their cooperatives, which sponsor the winners.

Renewable Energy The rural electric cooperatives are active in promoting and providing renewable energy resources to their co-op members.

In an effort to meet renewable energy initiatives, the rural electric cooperatives are complying with the renewable portfolio standard (RPS) requirement of 5 percent since 2015; and are continuously working to comply with the requirement of 10 percent by 2020. Some examples include: • Kit Carson Electric Cooperative in Taos has a solar photovoltaic project at the University of New Mexico-Taos campus which deploys 1 megawatt (MW) of distributed solar photovoltaic power to the area.

• The Cimarron Solar Facility, located within the service area of Springer Electric Cooperative, one of Tri-State Generation and Transmission’s member cooperatives, a 30-MW, 500,000 solarpanel solar photovoltaic power plant on a 250-acre site. It provides enough energy to serve the equivalent of 9,000 homes.

• The LCEC Generation, LLC plant near Lea County Electric Cooperative, headquartered in Lovington, utilizes five Wärtsilä engines, each with 9.3 MW output capabilities. When all engines operate at full capacity, the plant can produce just over 46 MW of electricity.

The cooperative also gets about 27.3 MW of clean wind generated energy from a nearby wind farm that was constructed in 2012. LCEC Generation is the first plant to pair a generation plant utilizing Wärtsilä generation sets with wind energy.

• Otero County Electric Cooperative, headquartered in Cloudcroft, has a small solar array of 76 kilowatts for renewable self-generation.

• The Alta Luna Solar Project, a 25 MW solar farm consisting of a single-axis tracking array of over 108,000 photovoltaic solar panels located on a 220-acre site in Luna County, about 25 miles northeast of Deming, will go online December 2016 and will receive electric service from Columbus Electric Cooperative, a Tri-State Generation and Transmission member system.
