NY demands casino payments while Seneca compact under review

BY KELLEN M. QUIGLEY IRVING — The Seneca Nation is calling upon New York state to allow the National Indian Gaming Commission (NIGC) the time required to complete its ongoing review of the Nation’s gaming compact, while also rejecting the state’s threat to circumvent that review.

New York state is demanding two casino cash payments totaling $540 million to be made by Wednesday.

If the payment is not made, the letter indicates the state will seek to seize the funds. The letter comes while the NIGC has yet to complete its review of the compact payments and issue an official report on the matter.

The Seneca Nation Council passed a resolution Feb. 12 requiring a review and final determination by the National Indian Gaming Commission on whether additional revenue-sharing payments to New York state are lawful under the Indian Gaming Regulatory Act. That decision follows a settlement agreement signed by Seneca Nation President Matthew Pagels and Gov. Kathy Hochul on Jan. 12 to end the five-year Class III gaming compact payment dispute.

“The NIGC’s review, and the time needed to complete that review, is not a matter that the Seneca Nation can control,” Pages said Friday.

“We have pressed, and continue to press, the agency for an update. We hope that an official report from NIGC will come soon.

“Rather than threatening aggressive action,” he continued, “the state should permit the federal agency responsible for overseeing Indian gaming issues the time it needs to complete its work.”

The Seneca Nation notified the state in March 2017 that it had made its final payment under the gaming compact negotiated in 2002.

An arbitration panel later sided with the state and directed the Senecas to remit $225 million to New York.

The Senecas challenged the decision in federal court and asked for a review by the U.S. Department of the Interior.

In February 2021, a spokesman for then-Gov. Andrew Cuomo said the Senecas’ obligation had grown to $435 million, $150 million of which was owed to municipalities in the region. According to an attorney with Lippes Mathias Wexler Friedman, LLP, representing New York state, those payments now total nearly $540 million.

The Mothers of the Nation, a group of Seneca women organized under the Seneca Constitution, commended the Council for passing the Feb. 12 resolution.

This came less than five days after the Mothers

organized a petition drive Feb. 8 and gathered signatures of Seneca women who deem the settlement agreement invalid. The petition was submitted to the Department of the Interior.

This was one of two actions against the gaming compact agreement that week. On Feb. 10, Marie E. Williams, former executive director of the Seneca Gaming Authority, filed a challenge of the legality of the agreement in Seneca Nation Courts.

Then on Feb. 25, Seneca Nation Treasurer Rickey Armstrong Sr. expressed his support withholding $800 million in an ongoing casino revenue-sharing dispute until a final determination is handed down by the federal government.

He said Seneca leaders are “urging the commission to conduct an expeditious review and issue a final determination to bring this matter to a close.”

WHILE THE Nation awaits NIGC’s report, Pagels said the Nation is preparing for every circumstance, including further legal action should the state seek to take the funds by court order.

“Now is not the time for the state to revert to bullying and greed. We thought that chapter had hopefully

ended and that a new day had dawned in Albany. We hope we are not wrong,” he said. “We have seen what happens when New York acts like a government intent on eroding, ignoring and obliterating relationships with Native nations and Native people.”

In the meantime, Pagels is calling on the state to begin discussions on an amended gaming compact with the Seneca Nation, citing continual changes, developments and threats to the gaming market.

Pagels said the gaming market has changed dramatically in the last 20 years, in terms of what is available to people and where, adding the compact needs to reflect these changing market dynamics.

“The state is required by federal law to negotiate with the Seneca Nation, and I am calling on the state to begin discussions,” he said. “Unlike the NIGC review, that dialogue, which could produce meaningful and needed changes for our gaming business in Western New York and the thousands of people we employ, is completely in the control of the Nation and the state. We need to get started.”

Road in Ashford plans to use a former concrete plant to separate and store recyclable materials before transporting it to another authorized facility.A 3-year-old local law requires approval by the county legislature and the governing body of the town of any proposed solid waste facility. The company is relocating from a smaller location it had outgrown.Legislators set a public hearing on adding more than 500 acres in four towns to the county’s unified agriculture district.

The towns are Conewango, Randolph, Napoli and Little Valley. The hearing will be March 23 at 5:01 p.m. in the legislative chambers on the third floor of the County Center in Little Valley.

Agriculture districts in New York provide safeguards to farmers aimed at keeping agricultural lands in production.Legislators were unanimous in their support for an application to the Federal Emergency Management Agency for nearly $900,000 for four hazard mitigation projects in the county:• $125,000 for an Ashford slope stability study.• $410,000 for New Albion Lake culverts.•

$52,500 for invasive species mitigation.• $300,000 for New Albion culvert 27 on New Albion-Leon Road in New Albion.A three-year lease with the Cattaraugus-Little Valley Central School District for nearly 12,000 square feet of space in the former elementary school in Little Valley for $91,750 for the first year was also approved.It continues leases for space for the Board of Elections, Health Department, Youth Board and Real Property Tax Services through 2024 with increases of 2% each year.A contract extension was authorized with Barton & Loguidice, Tonawanda, which provided consultant services to assist in the development of the County Strategic Economic Development Plan. The contract was extended through March 31 in order to complete the plan.

Legislators also approved the low bid for printing 120,000 copies of the 56page 2022-23 Cattaraugus County Activities Guide for $57,790 from The Offset House of Essex, Vt. The cost of the guide is 50% state reimbursable.A contract with Duflo Spray Chemical Co., Lowville for mosquito control services was also approved. The company will charge $54,306 to spray larvicide over 4,249 acres or $50,880 to spray adulticide over 11,590 acres.

Legislature Vice Chairman Andrew Burr, R-Gowanda, made a motion to adjourn in solidarity with the people of Ukraine, which was approved unanimously.

Price goes up after this weekend for Chili Crawl OLEAN — Get those Chili Crawl tickets purchased by Friday at $35 by calling the Greater Olean Area Chamber of Commerce — price increases to $45 next Monday.

The Olean Sports and Social Club and the GOACC are teaming up to present the Crawl, organized to help raise funds for not one but two service dogs through the WNY Heroes/Pawsitive for Heroes.

This is the third crawl in the past year the organizations have held following the taco crawl in June and chicken wing crawl in November.

Join area chili enthusiasts March 26 as they crawl the restaurants of the area searching for the answer to the question of who has the best chili at eight participating locations. Votes will be tallied at the end of the crawl with the Best Chili named.

One lucky participant will take away $500 in Shop Olean gift certificates.

The Crawl is banking on the success of the two previous events, as the Taco Crawl saw 144 participants and the Wing Crawl had 200-plus crawlers. Since ticket sales are slower, the price increase will go up a week later than anticipated.

“The locations will get a ticket count on Friday for ordering/planning purposes and we want to give them the best number – so we figured that we’d get ticket calls of people that will purchase them at the lower rate,” Yanetsko added.

The Western New York Heroes program, Pawsitive for Heroes, pays for servicedog training. The dogs and their owners go through various courses together, properly preparing the dogs to serve those who’ve served.

The Crawl will be from noon to 5 p.m. on March 26, which is a Saturday. The fee for the crawl includes eight

chili vouchers, a judging card and a chili eating vessel.

Confirmed locations include Napoli Pizza, HammerBack Bar & Grill, Randy’s Up the River, Talty’s Irish Pub, Four Mile Brewing Co., Union Whiskey and Village Green. Restaurants will be paying a vendor fee to cover costs.

Judging of the chili will be based on presentation, aroma, flavor and overall quality.

Great Valley’s Brown new chairman of Supervisors Assn.

BY RICK MILLER The Cattaraugus County Supervisors Association has elected Dan Brown of Great Valley as its new chairman.

For the past 12 years former Mansfield Supervisor Robert C. Keis Sr., headed the association of 32 town supervisors. He did not seek re-election in November.

Ellicottville Supervisor Matthew McAndrew nominated Brown for the president’s post. Brown agreed to head the group, but said he would serve as chairman. McAndrew will serve as vice chairman. Lena Ruper, the longtime Napoli supervisor, was named secretary.Brown said he’d like to have the meetings every other month in a different section of the county. They have been held the first Thursday of the month at the County Center in Little Valley.

The April meeting will be at the County Center, but after that they will be held at a town hall or American Legion or VFW post, Brown said.Prior to the meeting, Brown sent an email to the other supervisors to see if there was anything they wanted to raise at the meeting.Olean Supervisor Annette Parker asked if county legislators couldn’t provide towns with some of their COVID-19 funding to enable towns to complete

projects they couldn’t otherwise afford. She described a program the Essex County Legislature had initiated and funded.County Legislature Chairman Howard Van Rensselaer and Minority Leader David Koch, who are legislative representative to the association, will raise the issue with other county officials.

Brown said the association meetings are a place where supervisors can share problems and solutions.“That’s

the key to everything,” he explained. “I want to move the meetings around and get more supervisors involved.”

There are a lot of shared services the towns can take advantage of and contribute to, Brown added.At the April meeting, Brown plans to invite County Planner Marie Shearing to explain what services are available to towns through the county Planning Board.

Olean Theater Workshop performing ‘Do Not Go Gentle’ March 24-27

BY BILL PEGLOWSKI GOWANDA — After two years of COVID-19 restrictions, the Historic Hollywood Theater is getting back to being an active entertainment venue.

Due to capital project work at Gowanda High School repurposing their auditorium to temporary classroom space, both high school and middle school musicals were performed at the Hollywood.

A final Gowanda High School event will be at the theater at 7 p.m. March 31 when the annual Cabaret Concert takes the stage.

This unique musical event presents a selection of high school vocalists and groups in a cabaret setting. In past years, the concert has included some tables and chairs set up on stage for some of the audience giving the concert the intimate club feel.

Coming April 1, the theater presents the third installment of their silent movie series. Beginning at 7 p.m., three comedies will be screened. Organ accompaniment for the movies will be provided

by Dennis James, a major player in the global revival of interest in silent films.

The screening promises a historical experience with movies from the 1920s presented as originally screened in a theater accurate to the period. To further the experience, James also gives some historical background about the actors and films being screened allowing the audience to fully put themselves back into the mindset of the original audiences.

April 30 brings Jake Swanson back to the theater for a concert of classical music. Together with Sarah Marchitelli, Swanson founded the Decho Ensemble in 2011. The group performs throughout North America and Europe during the Summer months while Swanson serves as the band director at Gowanda High School during the school year.

The 2 p.m. Gowanda concert will also include additional performers whose names are yet to be announced. Past performances have included musicians from SUNY Fredonia and other regional universities.

Then on May 7 at 3 p.m., a “Chopsicks to Chopin” dueling pianos concert in scheduled.

The theater will be holding their annual “Music & Me” music camp for preschoolers June 27 to July 1.

July will bring the future vision of Hollywood

Theater as a Regional Performing Arts Center to a reality when musical comedy “The Addams Family” will be staged July 1-3. The show is a production of the Springville Center for the Arts with Don Wesley as director and Doris Jones as musical director, both previously Gowanda teachers.

Coming out of the severe isolation of two years of COVID, the presentation is particularly timely. One of the great takeaways from this musical is the importance of seeing the things that bring us together over those that push us apart.

Auditions for the show are coming up April 2 and 3. Full details about auditioning can be found at springvillearts.org.

Moving further into the summer, Nashville comes to Gowanda on July 23 for “Opry Night at the Hollywood.”

During the first five days in August, the Hollywood Theater will again present

the annual Hollywood Theater Drama Camp. The program brings former Gowanda teacher Cindy Ripley back each Summer.

Ripley began the Broadway Junior initiative that adapts Broadway musicals for younger performers. She travels extensively around the country promoting early high school theater, which includes all of the Gowanda Middle School musicals for several years.

August 27 will bring Strictly Hip back to the Hollywood Theater. The Tragically Hip cover band previously performed at the theater Feb. 20, 2020.

Over the coming months there will likely be additions to the schedule as Gowanda’s Hollywood Theater continues to move forward toward a bright future. The most current information and any updates to the schedule can always be found at gowandahollywoodtheater. com.

OLEAN — “Do Not Go Gentle” Will be presented at Olean Theater Workshop’s Washington Street Theater March 24-27.

Lillian Boedecker Barron is 84 years old, vibrant, funny, wise, and recently deceased. During her lifetime, Lillian shared a special, long-distance bond with her granddaughter, Kelly, and suffered an estrangement from her son Windsor, a colonel in the Air Force, as he moved his family from base to base all over the world. After her death, Lillian discovers that she cannot “move on” until the rifts are somehow mended. Windsor and Kelly come from overseas to settle Lillian’s affairs and are aghast to discover that the walls of her house

have been painted with wild, sometimes humorous, sometimes horrific murals and drawings. As they unravel secrets of the paintings, the two make astonishing discoveries about themselves and a special relationship between Lillian and a neighborhood child.

This powerful, poignant play explores the wonder of words and the transformative power of art as it offers humor and hope to anyone who is, or has ever been, a grandparent, parent, or a child.

CRCF Community Fund grant applications due April 21 OLEAN — Applications for grant funding from the Cattaraugus Region Community Foundation’s Community Fund are due April 21.

The Community Fund makes possible two rounds of responsive, unrestricted grantmaking in May and November of every year that aim to support new projects and initiatives that respond to the changing needs of those living in Cattaraugus County.

Applicants must be 501(c) (3) tax-exempt organizations or a government entity or

school district.

CRCF’s board reviews applications based on the applying organization’s stability, the impact its work has on the community, the feasibility of the project proposed in the grant application and the role a grant from the Community Fund would play in the overall project, according to CRCF Executive Director Karen Niemic Buchheit.

“Since 2000, the CRCF board of directors has approved and issued over $161,000 in grants to area nonprofits and charitable causes that support the

health, wellbeing and happiness of Cattaraugus County residents,” Buchheit said.

The online grant application is available at cattfoundation.org/g rant-seekers/ grant-opportunities/. Grant requests should not exceed $2,500. Applicants will be able to complete the grant application entirely online through the Foundation’s online grant application system.

Drivers likely need no reminder that the cost of fuel is high.

In November 2021, data from the U.S. Energy Information Administration indicated the average price per gallon of fuel was $3.39. That marked a seven-year high and an increase of $1.29 in just 12 months.

The good news for motorists is the EIA anticipated that fuel prices would drop considerably in 2022, with estimates suggesting a gallon of fuel will cost an average of $2.88 in the early months of the year. Drivers will no doubt welcome that decline with open arms, but filling up with less costly fuel is not the only way they can save money. Learning how to be a more efficient driver is a great way to improve gas mileage and take some of the sting out of filling up. · Take it easy behind the wheel. The Office of Energy Efficiency & Renewable Energy reports that aggressive driving can lower gas mileage by as much as 30 percent when driving at highway speeds and 40 percent when driving in stop-and-go traffic. Avoid speeding and rapid acceleration and braking. · Utilize in-vehicle energy feedback. A recent study from researchers at the Institute of Transportation Studies found

that drivers who used driver feedback devices in their vehicles in an effort to save fuel improved their gas mileage by about 10 percent. Many modern vehicles are equipped with such devices, and drivers can learn to use them and reap the rewards with less frequent trips to the filling station. · Keep cargo off the roof. Rooftop cargo boxes can be convenient when traveling on vacations. However, researchers at the Oak Ridge National Laboratory report that such boxes can reduce fuel economy by a significant percentage depending on where drivers are driving. City drivers with rooftop cargo boxes may experience a 2 to 8 percent decline in fuel economy, while vacationers traveling at interstate speeds may notice a decline as high as 25 percent. Cargo boxes are convenient, but they’re not very aerodynamic, so it’s best to remove them after returning home from vacation. · Avoid idling. Idling was once advised to warm up vehicles so they did not stall once they leave the driveway and hit the open road. However, that stalling occurred when cold carburetors could not get the appropriate mix of air and fuel in the engine. But carburetors have long since been replaced by electronic fuel injection systems, negating the need to warm

up a vehicle to avoid stalling. The Environmental Protection Agency and the U.S. Department of Energy note that modern engines will warm up by being driven and urge drivers to avoid warming up their cars for more than 30 seconds.

High fuel costs make it advantageous for drivers to embrace efficient driving, which can save a substantial amount of money at the gas pump.
