Seneca treasurer supports withholding casino revenues pending review

BY JIM ECKSTROM SALAMANCA — Seneca Nation Treasurer Rickey Armstrong Sr. said Friday that he supports withholding $800 million in an ongoing casino revenue-sharing dispute until a final determination is handed down by the federal government.

“I support the recent action by the Nation’s Council to hold all payments to the state pending the outcome of the review by the National Indian Gaming Commission,” Armstrong said in a statement. “The NIGC must clarify the question on the legality of the payments.”

He said Seneca leaders are “urging the commission to conduct an expeditious review and issue a final determination to bring this matter to a close.”

Armstrong also acknowledged the Mothers of the Seneca Nation for stepping forward and submitting their concerns to the Council and Nation executives. The group called for a delay “Community input, notably from the Mothers of the Seneca Nation, contributed to the Nation’s amended resolution requiring final federal determination of the revenue share payments,” Armstrong stated.

“The Seneca people should be assured that in my capacity as the Nation’s treasurer, I will not authorize the release of any of the disputed funds until all lawful federal remedies have been exhausted.”

Armstrong noted that for 400 years the Seneca people have been “targeted

by New York for their lands, resources and national wealth.” He said he took a strong stance in 2019 as president to fight the

provisions of the compact and illegal payments that she says Pagels buried in the agreement. She said the additional costs have consistently been disputed and denied by the Seneca Gaming Authority and several Seneca Nation presidents for nearly a decade.

The proposed settlement agreement with the state would have ended the gaming compact dispute, pledging to release the approximately $540 million of disputed payments held in escrow and another projected $265 million through 2023.

Cattaraugus County reported 3 C0VID deaths, 41 new cases Monday The Cattaraugus County Health Department reported three new COVID-19 deaths and 41 new cases on Monday.

The deaths reported Monday date back to last week. They include two men ages 62 and 68, respectively, and a 70-year-old woman.

The county has now recorded 242 deaths from the coronavirus since April 23, 2020.

The 41 new cases reported on Monday bring the total since March 2020 to 17,713 county residents. February’s toll was 1,136 and there have been 5,875 new cases diagnosed since Jan. 1.

Under new guidelines from the Centers for Disease Control and Prevention, Cattaraugus and Allegany counties are counties of low transmission based on the number of hospital beds being used, hospital admissions and the number of new cases.

The county’s positivity over the past seven days, according to the CDC’s COVID Tracker has averaged 4.9%.

There have been 96 cases over the past seven days for a rate of 126.1 per 100,000.

There have been no new hospital admissions over the past seven days.

Monday’s positive tests included 10 residents who have been fully

vaccinated and 31 who were unvaccinated.

Of the new cases, 19 were reported via at-home testing. There have now been 1,353 cases identified with an at-home test kit.

The southeast part of the county reported 462 cases in February for a total of 8,1790 cases. This part of the county has reported more than 46% of the cases.

The 258 cases in February in the southwest where there have been 3,514 cases, 221 cases in the northeast where there have been 3,512 cases and 195 cases in the northwest where there have been 2,517 cases.

There were 636 women who tested positive in February and 500 men.

Since the beginning of the pandemic, 9,277 women and 8,436 men have tested positive.

“I think we are still on a downward trend,” Dr. Kevin D. Watkins, public health director said, noting Cattaraugus County is now in a low transmission community area.

The state dropped most indoor mask mandates except in schools, where they will be dropped on Wednesday.

“I don’t see it as a concern,” Watkins said of dropping the school mask requirements. “We will continue to be vigilant, especially in schools.”

Residents should wear masks if they are symptomatic or test positive (until they isolate), or are exposed to someone who has tested positive, Watkins said.

Those who are immunocompromised may want to consider wearing masks in public as well.

“Over 55% of residents are vaccinated and 65% have at least one dose of the vaccine,” Watkins said.

County legislators approve Economic Development Strategic Plan

BY RICK MILLER LITTLE VALLEY — Cattaraugus County lawmakers adopted an Economic Development Strategic Plan designed to help the county take advantage of future opportunities.

Crystal Abers, director of the Department of Economic Development, Planning and Tourism said the 180-page document is a blueprint for moving the county forward by looking at opportunities five and 10 years in the future.

“It’s an opportunity to help keep our younger population here,” Abers said.

“We do have jobs available.It seems like we are educating our kids to leave.”

Abers said she thinks the new Economic Development Strategic Plan will allow for earlier contact with high schools and BOCES for training for local jobs.

The need for nursing jobs will be met by Jamestown Community College and St. Bonaventure University’s new medical program, she said.

“These are building blocks,” Abers said. The study that went into developing the plan found that housing is a big issue. There are a large percentage of vacant houses, many of which are vacation homes, she said.

“We are starting to be more proactive in looking at

these opportunities,” Abers said.

There was no discussion on the Legislature floor on the plan. It passed unanimously.

Legislators also authorized a payment of $791,512 to New York state in order to receive a $1.64 million Supplemental Medicaid Payment for the county’s Pines Healthcare and Rehabilitation Centers.

The payments are part of $110 million in Medicaid payments to public nursing homes in the state. The Olean Pines will receive $853,271 and the Pines in Machias will get $791,512.

Legislators also approved a resolution asking the State

Legislature to pass Senate Bill S.7283 and Assembly Bill A.8218 to transfer county reforestation land in Perrysburg to New York State.

The property is variously known as Perrysburg Pond, Crocker’s Pond and Bob’s Pond.

A resolution was approved urging passage of bills in the Senate and Assembly that would double the rate for assigned counsel in misdemeanor and felony cases.

The increases in the rates of $60 per hour for misdemeanor offenses and $75 for felonies that have not changed since 2004 would be paid for by the state.

Funds sought for table top review of watersheds’ flood structures

BY RICK MILLER LITTLE VALLEY — The Ischua Creek and Conewango Creek watersheds protect thousands of residents and many thousands of acres of property from flooding.

Six dams on Ischua Creek and five on Conewango Creek in Ca araugus County make up the watershed protection structures.

A resolution to hire Bergmann Architects, Engineers, Planners of Rochester to conduct two Emergency Action Plan tabletop exercises with fi rst responders will be reviewed by the County Legislature’s Public Works and Finance commi ees on Wednesday.

The cost will be up to $6,500.

“It’s a requirement by the state Department of Environmental Conservation to update the table top exercise for the watershed emergency action plans every five years,” said Public Works Commissioner Kathleen M. Ellis.

The Emergency Action Plans will be overseen by the Ca araugus County Soil and Water Conservation District, Ellis said.

The Soil and Water Conservation District regularly inspects the 11 dams in the two watersheds, looking for problems, Ellis said.

the Soil and Water District staff cannot remedy it, they call the Public Works Department.

“They’ll do a visual and if they see any erosion they’ll fi x or or call us,” Ellis said In a high water event when Soil and Water staff recognize a threat to a dam, there is a process of notifying fi rst responders and others — including any residents who could be cut off or otherwise affected by the failure of a dam.

“There’s a process of who calls who when there’s a problem with one of the dams,” Ellis said.

Bergmann’s table top exercises will be staged at the Soil and Water Conservation District offices in Ellico ville.

The Conewango Watershed Protection District crosses the Ca araugus-Chautauqua border and includes several dams in Chautauqua County.

The resolution was referred to the Public Works Commi ee, which meets at 5:15 p.m.

It may be early in the year and cold, but county lawmakers are being asked to accept a bid for aerial mosquito spraying by Duflo Spray Chemical Inc., Lowville, for both larvicide and insecticide if necessary.

wetland areas is $54,306 for spraying 4,249 acres and $50,888 for insecticide over 11,590 acres.

Last year, discovery of a horse in Conewango with Eastern equine encephalitis and West Nile virus triggered insecticide spraying over much of the Conewango and Randolph areas. Areas along the Allegheny River Valley from Salamanca to Portville, nuisance mosquitoes from a wet summer drew numerous complaints to legislators and the health department.

A resolution to approve contracts with three towns and one village for plowing snow are also on the prefi le agenda. The town of Allegany will receive $9,466 for snow and ice control on two miles of county roads Mansfield will get $3,407 for 0.72 miles, and Salamanca and the Village of Ca araugus will get $4,259 each for plowing 0.90 miles of county road.

resolution to award the bid for construction of Mansfield Bridge 50 on Hinman Hollow Road to Hunt Valley Construction, Cheektowaga for $389,686.

Shake up Lenten dinners with variety It’s customary for people participating in Lenten fasting to skip meat and poultry dinners on Fridays between Ash Wednesday and Easter Sunday. It is a sacrifice symbolic of the sacrifices of Jesus Christ. However, opting for vegetables and fish in lieu of meats doesn’t have to mean sacrificing flavor.

“Seafood Pancakes” from “Judy Joo’s Korean Soul Food” (White Lion Publishing) are a popular Korean appetizer. Any shellfish can be substituted, but the ingredients listed help keep the pancakes crispy. Enjoy this dish as a light lunch or in addition to other offerings for a tasty dinner.

Seafood Pancakes Makes 4 to 5 pancakes 2 ounces mussels, cleaned and debearded 2 ounces clams, cleaned 31⁄4 ounces rice flour 2 tablespoons cornflour 21⁄2 ounces self-rising flour 2 tablespoons dwengjang (Korean soy bean paste) 1⁄4 teaspoon ground black pepper 3 large pinches of sea salt 31⁄2 ounces brown shrimp 5 spring onions,

julienned teaspoon garlic, grated or finely chopped 2 red chillies, thinly sliced at an angle Vegetable oil for frying In a large saucepan, add enough water so that it’s three-quarters full and bring to a boil. Add the mussels and clams and cook until the shells open. Remove the shellfish and set aside to cool.

Retain 3⁄4 ounces of the cooking liquor then strain it to remove the meat from the shells of the mussels and 1

clams and set aside.

In a large bowl, gently whisk together the rice flour, cornflour, self-rising flour, dwengjang, pepper, salt and 8 ounces of cold water and liquor from the cooked shellfish until smooth. Add the brown shrimp, mussels, clams, spring onions, garlic and red chillies (keeping the seeds, if you like more heat) and stir ba er until thoroughly combined.

In a large nonstick frying pan, heat a generous drizzle of oil over a medium-high

heat. Spoon in the ba er and spread it evenly to form a pancake about 5 inches wide.

Fry until golden brown and crispy on the base, about 3 to 4 minutes.

Carefully flip and cook for a further 3 to 4 minutes until the other side is golden.

Transfer to a kitchen paperlined plate to drain. Repeat with the remaining ba er, adding more oil to the frying pan as needed.

Serve immediately with a favorite dipping sauce.

Every day, over 300 children in the U.S. are treated in emergency departments as a result of accidental poisoning, according to the CDC. The National Capital Poison Center reports that cosmetics and personal care products are the most common substances implicated in poison exposures in children younger than 6 years, followed by cleaning substances and pain medications. Medication is the leading cause of poisoning in children in Canada, according to injury prevention organization Parachute Canada.

“The Invisible Threat” Carbon monoxide is invisible, odorless and deadly. In fact, carbon monoxide (CO) is the leading cause of fatal poisonings in North America, according to the Canada Safety Council. Carbon monoxide can be released by gas furnaces, hot water heaters, cars, fireplaces, wood stoves and kerosene heaters. According to the Centers for Disease Control and Prevention (CDC), CO poisoning symptoms are often described as “flu-like” and include headache, dizziness, weakness, upset stomach, vomiting, chest pain and confusion. Here are a few steps you can take to safeguard yourself and your loved ones against CO poisoning: 1. Install a carbon monoxide detector, and check the batteries monthly.

2. Have your chimney, furnace and gas-fired appliances professionally inspected each year.

3. If your CO alarm sounds, exit your home immediately and call 911 from a safe place.

“Families First is an important legislative change that provides more support to families in the least restrictive way. If the time comes when a more intensive intervention is required, such as out of home placement, we want to provide a quality treatment program that will best meet the needs of the youth and their families,” said Julie Tomasi, COO, Child Welfare Programs.

“To provide this level of programming we applied to become a Qualified Residential Treatment Program (QRTP). We believe this designation will allow us to best serve youth and families.”

QRTP designation means that New Directions residences are accredited by the Council on Accreditation, implement a trauma-informed treatment model, provide around-the-clock access to nursing and clinical services, and plan a family-centered shortened length of stay. The designation comes as part of Families First Prevention Services Act, which was enacted by Congress in 2018.

New York state’s implementation began on Sept. 29, 2021.

“We are pleased to be able

to provide a quality treatment program where we can deliver enhanced services for youth while paying a wage that supports this level of professionalism, treatment, and compensates staff for their extremely important work and dedication,” said James W. Coder, CEO. As a result of the QRTP designation, New Directions must hire additional staff to reach the goal of a 2:1 youth-to-staff ratio. The designation includes New Directions’ Wyndham Lawn Home for Children, Lockport and Lancaster residence. BY GINNA HENSEL ELLICOTTVILLE,NY — Embrace your inner penguin and slide for a good cause Saturday at the annual Penguin Paddle, hosted by the Lounsbury Adaptive Ski Program, at the Holiday Valley Resort.

Join Lounsbury Adaptive Ski Program (LASP) volunteers at the base of Yodeler ski lift for a food tent serving lunch for a donation of $5, a silent auction, a raffle and an opportunity to slide down the hill like a penguin for their annual fundraiser.

This year’s raffle prizes include a Holiday Valley season pass, a pair of skis and a gift certificate.“The Penguin Paddle is the sole fundraiser for the LASP,” said Bill Bredenberg, director of LASP. “This is our only source of funding for training, scholarships and equipment.”Making a comeback in person after a virtual event last year due

to COVID, in accordance with the Holiday Valley resort guidelines, masks will not be required as the event will take place in an outdoor venue. Vaccination status is not required for any guest.“We missed seeing so many of our friends, family members and supporters in person last year. It is always better to interact with people on a personal level,” said Sue Whistler, assistant director and lesson coordinator of the program.The main event is the penguin paddle slide, where participants ages 3 to 99 can register to get a black garbage bag for a donation of $1 with

holes cut in for their arms and heads. Participating penguins can then slide down a sectioned off area of Yodeler on their stomachs like a penguin.“We are back in full force this year, and it is a terrific year for the program,” Bredenberg said. “We are excited to welcome back old friends, and make new ones.”The silent auction is made up of different items and gift baskets donated to LASP. DEC: Safest season yet regarding hunting-related shooting incidents

BY JIM ECKSTROM ALBANY — The state Department of Environmental Conservation reported Feb. 22 that the 2021 hunting seasons were the safest ever in New York, with the lowest number of hunting-related shooting incidents since record-keeping began in 1949.

DEC environmental conservation police officers investigated nine hunting-related shooting incidents in 2021, with one fatality.

Seven of the nine shooting incidents involved two people, while two incidents were self-inflicted. The DEC noted that all identified shooters were experienced hunters with an average of 40 years of hunting experience, emphasizing the need for all hunters to remain vigilant when heading afield.

All incidents could have been prevented if those involved followed hunting safety rules, the DEC said.

DEC Commissioner Basil Seggos said he’s proud of the state’s Hunter Education Program and its educators and volunteer instructors, who work to ensure licensed hunters experience a safe hunting season.

“Every hunting fatality is preventable when New Yorkers hunt safely and responsibly,” he said in a press release.

A new hunting regulation that took effect in 2021 extended legal shooting hours for big game to 30 minutes before sunrise to 30 minutes after sunset.

None of the deer hunting incidents last year took place during the new extended hours — the four incidents involving deer hunters occurred between 10:30 a.m. and 2 p.m.

Another new regulation change effective last year requires all persons hunting deer or bear with a firearm,

or anyone accompanying these hunters, to wear a solid or patterned fluorescent orange or fluorescent pink hat, vest or jacket, visible from all directions.

The DEC noted that the single hunting fatality in 2021 involved a deer hunter not wearing fluorescent orange or pink. A 28-year-old hunter in Ontario County was trailing a deer he had shot when another hunter, 61, in a tree stand saw

movement and fired, killing the man on the ground.

The incident occurred on Thanksgiving Day. At least two huntingrelated shooting incidents in 2021 occurred in or near Cattaraugus County.

On Oct. 28, a pheasant hunter was hit with shotgun pellets fired by another hunter in the Zoar Valley Multiple Use Area on the Erie County side of Cattaraugus Creek. The

hunter’s injuries were not life-threatening, ECOs reported.

Also this past fall, a Salamanca-area man suffered a severe injury to his neck after he was struck by a crossbow bolt loosed in his direction by a hunter.

Also new in 2021, 52 Upstate counties — including Cattaraugus and Allegany — passed local laws allowing 12- and 13-year-old licensed hunters to hunt

deer with a firearm or crossbow while under the supervision of an experienced, licensed, adult hunter. None of the nine shooting incidents investigated in 2021 involved a 12- or 13-year-old hunter.

All first-time hunters, bowhunters and trappers must successfully complete a hunter, bowhunter or trapper education safety course before being eligible to purchase a hunting or

trapping license or bowhunting privilege in New York State. DEC-trained and -certified volunteer instructors have taught hunters and trappers to be safe, responsible, and ethical since 1949.

The first things to come to mind when many people ponder vehicle maintenance are oil changes and routine tune-ups.

Though each of those things are vital components of automotive maintenance, it’s important that drivers recognize the value of a thorough car wash as well.

Drivers may see a car wash as a way to make their car look good, and that’s not untrue. An effective car wash can give a car a look that mirrors how the vehicle appeared the moment it was driven off the lot. But an effective wash is more than just cosmetic. According to Consumer Reports, a thorough car wash removes grit and residue, thus protecting the car’s paint job and reducing the likelihood of corrosion. Though late model vehicles aren’t as susceptible to rust, fading and peeling as cars made decades ago, they still need a thorough and routine wash to remove dirt, grime and bird droppings that, over time, can adversely affect the paint job and, if left unchecked, eat away at the metal.

Another benefit to routine car washes is they can prevent damage related to seasonal issues. For example, individuals who live in regions where winter snowfall is common may routinely drive on roads that have been salted. Winter may not be a time many drivers visit the car wash, but it’s important to do so after snow has melted and salt on the roadways has been washed away by rain. Most car washes now offer highpressure undercarriage treatments that can wash off salt and prevent corrosion and the formation of rust.

But it’s not just the exterior of the car that can benefit from routine washing. When taking their cars to get washed, many motorists pay a little extra to have their vehicle interiors cleaned. Sometimes referred to as “interior detailing,” cleaning the cabin of the car helps to maintain the interior so it looks new longer. Routine interior cleaning also can remove dust and other particles that can serve as irritants if allowed to build up over time.

Resale and trade-in value is another factor to consider. The automotive experts at Edmunds note that the average transaction price for a used vehicle in the second quarter of 2021 was $25,410, which marks a 21 percent increase over the year prior. Much has been made of the microchip issues that have compromised auto manufacturers’ ability to produce new automobiles, and that led many motorists to the preowned vehicle market. Dealerships also offered incentives to drivers willing

to trade in their late model cars. By taking care of a vehicle’s interior, drivers are putting themselves in position to capitalize on the increased reliance on the preowned market. Prospective buyers, whether they’re private citizens or dealerships, will see more value in a vehicle with a well-maintained interior than one with a cabin that’s seen much better days.

Car washes may be seen as a purely cosmetic form of vehicle maintenance. But the benefits of routine and thorough car washes extend far beyond aesthetic appeal.
