BELMONT — Justice Steven Presutti may be retiring at the end of this month, but he’s not going away. After 41 years on the bench as Amity Town judge and 38 serving as Belmont Village judge, Presutti will be limiting his time to presiding over Misdemeanor Drug Court, which he has presided over for 16 years, and acting also as an associate village justice. “I’m going to stay on as village judge so I’ll just be here to kind of help out,” Prescutti said. “If Judge (Dennis) Stack needs some advice or some help with stuff, I’ll help him and that will allow me to stay and do drug court. That court gives a little more freedom (in scheduling) because Judge Brown and I work pretty good together.” Presutti credits his longevity to his clerk, Linda Healy, who has been with the judge for 35 years and is also retiring. “She said ‘You go, I go,” Presutti said. “She’s been invaluable and made the job a lot easier. I probably wouldn’t have lasted this long without her.” “He’s been here since he was a kid,” said Richard Hoshal, village clerk and treasurer who himself has 27 years in office. “He’s a big part of the community.” That sense of community accounts for a long history

of public service in the Presutti family. His father Leonard was mayor for a time and a member of the town board, as well as a judge, what used to be called “police justices.” His uncle Joe was a court clerk and deputy county clerk for a total of 55 years. A brother was a town supervisor and another a fire chief. That knowledge of the community and his longevity have enabled Presutti to know the county judges, police officers, attorneys and probation officers that he’s worked with. He’s known former Judge Euken since Euken was a district attorney and was a mentor for Presutti

when he first started out. He’s worked with Thomas P. Brown and Terrence M. Parker, county court judges and has known Allegany County District Attorney Keith A. Slep “since he was an intern.” “That’s the one thing I’ll miss is those people,” he said. “The staff here, the judges, the lawyers, the probation department.” Prescutti has spent his lifetime in the area, graduating from Belmont Central School in 1973 and receiving his associate degree at Genesee Community College. After leaving his position of real property tax director for Allegany County, he also served as an abstractor and

mapper for the county. He’s been both a coach for several sports and has officiated high school basketball. Prescutti has also served as a school board member for Belmont and Genesee Valley Central Schools. It does seem to him like he knows everybody and he ran into a lot of those people in his most memorable day in court following the arrest of over 50 local residents following an early Bump the Dump protest in the 80s. “We were lucky,” Prescutti said of the case. “Gary Fowler was the public defender that handled my court at that

time and he was tripping because, just handling those people in the situation. It was volatile. It could have been much more volatile. When asked if it was difficult to pass judgement people that he knows, Prescutti shook his head. “I know most of the people that come see me. Now I see kids, grandkids of people I first saw, when I was 22 or so,” Presutti said. “I take every case individually. I just try to let people state their case and have their day in court. I listen to what they say and just explain what I could do and what I couldn’t do. I try to be fair ... that’s just what I’ve done for 40 years.” “I know how hard it is to come up with money. Like even now, the mandatory surcharges used to be 10 dollars, now they’re 93 dollars,” he continued. “That’s a lot of money to a lot of people,” on top what the court fines may be. I try to be fair.” Presutti, and his wife Pat, a retired schoolteacher, have two sons and two grandchildren, with another due in April. They’ll be traveling around the country visiting their sons and Pat’s mother. “We’re just going to go … that’s the one thing about our traveling before, I always had to be home by Wednesday (for court) so she’s kind of excited to not have work around that. She’ll see them a little bit more for a little bit longer.”

was awarded this month to the Allegany County Department of Social Services in support of its annual Foster Care Christmas Party. The event brings together children in foster care, their parents and siblings and foster parents. Held Dec. 9 in Cuba, the party saw a record number of children, parents, foster parents, relative caregivers and DSS staff attend, according to Jennifer Bigelow, a DSS homefinder caseworker and party organizer. Approximately 70 children

received a gift from Santa Claus. Also on hand to help were more than a dozen officers from the Allegany County Sheriff’s Office, the Cuba and Wellsville police departments and Amitybased state police troopers. “We were excited to have law enforcement attend and donate their time,” Bigelow said. “They frosted cookies with children and families, helped Santa hand out gifts and served approximately 150 people a hot meal and dessert.”

Did you know? New Year’s resolutions may not have much staying power, but the tradition of making them is an enduring one that dates back thousands of years. According to History. com, ancient Babylonians are credited with being the first people to make New Year’s resolutions. During Akitu, a 12-day religious festival, the Babylonians would make promises to their gods, and these promises typically focused on being a better person in the coming year. Celebrants of the festival, which was held when crops were planted, a time that marked the beginning of a new year to individuals in certain ancient societies, would promise the gods that they would repay their debts and return any items

they had borrowed in the previous year. While these promises might have been the forerunners to modern New Year’s resolutions, there is one distinct difference that separates ancient Babylonians from people in modern times. Babylonians believed keeping their word to the gods would curry favor for them in the coming year, while failure to keep their promises would do the opposite. People who make resolutions today typically do so to better themselves and do not fear reprisal from their creator if they fail to live up to their pledges. That’s likely a good thing, as various reports suggest that as much as 80 percent of New Year’s resolutions are abandoned by the second week of February.

Each December 31st, people anxiously await and count down to the arrival of the new year. January 1 often is a time for reflection and for making future plans. It also is a holiday full of tradition. Notable New Year’s traditions include toasting champagne beneath skies lit up by fireworks, kissing one’s sweetheart at midnight and making resolutions to better oneself in the year ahead. New Year’s Eve and New Year’s Day traditions vary across the globe. The following is a look at the unique ways people ring in the new year throughout the world. • Filipinos embrace round fruits for the new year. The custom includes gathering 12 different round fruits for each month of the year. The round shape symbolizes wealth and prosperity. • Around Stonehaven, Scotland, people wield large fireballs for the Hogmanay festival on New Year’s Eve. The idea is to ward off evil spirits by swinging balls of fires over the heads of trained professionals and then tossing them into the sea. The

New Year’s Eve is one of the most festive nights of the year. Counting down to a new year while simultaneously saying goodbye to the current year provides grounds for celebration for millions of people across the globe. New Year’s celebrations vary depending on where the partying is taking place, but it’s common for people to check their inhibitions at the door on December 31. That can make for a fun evening, but also puts celebrants in jeopardy of making bad decisions or confronting the consequences of others’ poor decisions. Adhering to three simple safety strategies can increase the chances that this New Year’s Eve is memorable for all the right reasons.

1. Travel in packs. Most people who are out and about on New Year’s Eve are focused solely on having fun. However, some criminals see New Year’s Eve as an opportunity to prey on unsuspecting men and women who may not be as alert to danger as they are on other nights of the year. For example, a recent report from Australia’s Bureau of Crime Statistics and Research found that the number of violent offenses between 9 p.m. and 3 a.m. on New Year’s Eve is nine times higher than it is on other nights of the year. By hitting the town with

friends and staying with those friends throughout the night, New Year’s Eve revelers can make themselves less vulnerable to criminals. 2. Don’t overindulge in alcohol. The National Highway Traffic Safety Administration notes that people who consume alcohol begin experiencing a loss of judgment when their blood alcohol concentration, or BAC, reaches .02. That means it only takes a relatively small amount of alcohol before people’s judgment begins to falter, and judgment only suffers further with each additional drink. The pressure to overindulge in alcohol on New Year’s Eve can be considerable, but revelers should avoid situations where they might be tempted to drink too much. Such overindulgence only makes people vulnerable to bad decisions and even criminals looking to prey on inebriated

Allegany County’s two opioid overdose deaths part of reported state decline in 2018

BELMONT — Preliminary data from a New York State Department of Health annual report on opioid overdose deaths showed Allegany County deaths at two in 2018, the latest compiled numbers available. That number of deaths is down from six recorded deaths in 2015, five of those from heroin overdoses. The 2018 deaths were opioid overdoses or those involving prescription pain relievers that may include other substances such as fentanyl. Allegany County experienced three such deaths in 2017. Gov. Andrew M. Cuomo recently announced that opioid overdose deaths in New York state counties (excluding New York City) dropped for the first time in a decade. For 2018, the state reported 1,824 opioid deaths, nearly 16 percent lower than 2017 figures, which showed 2,170 recorded deaths. Cuomo called the reduction “an important milestone” that he said demonstrates progress in battling addictions in the state. “In comparison to previous reports from New York state, there has been a decline in the number

of deaths,” noted Lori Ballengee, public health director with the Allegany County Department of Health, in a statement through the department’s public information officer and supervising public health educator, Theresa K. Moore. “Allegany County’s numbers remain small in comparison to other counties in Western New York,” Ballengee added. In the first quarter of 2019, covering January through March, preliminary data show no recorded opioid overdose deaths for the county. Hospitalization figures for the county’s opioid overdoses were suppressed for confidentiality purposes due to fewer than six discharges, the report noted; however, the state report showed 29 outpatient emergency department visits for such overdoses in 2017 and a drop to 15 for 2018. Ten heroin overdoses were reported for 2018, cut in half from 2016, when there were 20 heroin-related outpatient/ER visits. State figures also show numbers for those seeking treatment for chemical dependence. In 2017 there were 192 individuals seeking treatment, with 111 of those being for heroin addiction. Preliminary figures show a rise to 218 with 114 being for heroin

Two-vehicle accident in Friendship results in death of driver FRIENDSHIP — New York State Police provided an update Friday on an ongoing investigation of a tractor trailer-cargo van accident in the town of Friendship. The accident occurred at 8:29 a.m. Wednesday on Interstate 86 eastbound in the town of Friendship. Investigation revealed that a 2007 Ford Econoline was traveling eastbound in the driving lane when it veered into the passing lane. The cargo van struck the front bumper of a 2000

Peterbilt tractor trailer which was hauling 32 cows. Both vehicles left the road, struck a ditch and proceeded to hit a tree. Troopers announced that the operator of the cargo van was John R. Shaw, 32, of Newfane, who was ejected and declared deceased. Nine cows were deceased at the scene. NYSP Collision Reconstruction Unit and NYSP Commercial Reconstruction Unit assisted in this investigation.

The county Department of Health refers to the Allegany County Council on Alcoholism and Substance Abuse (ACASA) as one of the most active agencies helping to counter addiction in the area. ACASA collaborates with agencies associated with the Allegany County Heroin and Opioid Committee, which has been working on a plan for 2018-21 according to a written statement from the health department. This committee, through ACASA, was previously an Allegany County Legislature ad hoc committee. Comment on the opioid report from ACASA Executive Director William Penman was not available by press time. In an online description, Wellsville-based ACASA, Inc. started in the 1970s and was established “to meet the growing needs in our county to understand, prevent, and treat persons who have alcohol and substance abuse problems.” The Council offers a wide range of alcohol and substance abuse services including outpatient, clinical services and prevention education, among others. In an online report about opioid abuse in

Allegany County, 2009 statistics gathered by Partners for Prevention of Allegany County (PPAC) showed rising usage of drugs by youths and the group formed a coalition to implement prevention projects. The Allegany County Sheriff’s Office also assists through such programs as helping to dispose of prescription drugs in a safe manner with drop boxes to help prevent misuse. The 2018 report also shows increased use of Naloxone (Narcan) is also likely helping in the fight against opioid overdoses. For Allegany County, Naloxone was administered by EMS 45 times in 2016, and 26 times in 2018. Naloxone was administered by Allegany County Law Enforcement four times in 2017 and three in 2018. New life for old rifle cartridges

By WADE ROBERTSON Today the hunting and shooting worlds are filled with new, exciting cartridges. Modern technology, the AR platform and objective looks at existing calibers have brought about more efficient case design, faster velocities and increased performance. AR case length is fixed, but stubbier, larger capacity/caliber cases are constantly being developed, outperforming the .223 in many ways. The .264 cartridges

were largely ignored in the U.S. for generations, though widely used in Europe. Inexplicably, hunters and shooters in North America shied away from arguably the best bullet diameter existing. Today however, the 6.5 Creedmoor, using .264 diameter bullets, has finally been recognized for the truly outstanding blend it possesses of bullet weight, ballistic coefficient, low recoil, flat trajectory and excellent killing power. takes advantage of the .264’s potential with awesome ballistics. Why we here in the Americas took so long to catch on is puzzling. But, today’s article examines how new bullet technology invigorates our older calibers, some of which may be a favorite of yours, Dad’s or Grandad’s. They’ve sat in the gun cabinet far too long; let’s reload and take them hunting. Reloading is a fascinating hobby and allows you to build customized loads for any caliber you own, especially those a little long in the tooth, such as the .257 Roberts, 7x57 Mauser, 300 Savage or a host of older cartridges from those long-distant days of yore. They worked back then and now, but you can safely increase their velocities with today’s revolutionary new bullets, notably the all-copper Hornady GMX or Barnes TTSX bullets. My favorite powders all deliver good accuracy with 100-grain bullets. The Hornady manual shows 39.2 grains of IMR 4064 delivers 3,000 fps, as do 43.6 of IMR 4350 and 48.3 grains of IMR 4831. Start lower than maximum loads, of course, and work your way up. I have not tried the 80-grain TTSX, which can be loaded up to 3,300 fps (Wow!) in the .257, but you can bet the farm that copper bullet will not break up on a shoulder and, most likely, exit the far side of a deer hit in the rib cage. That’s not the tame rifle from the 1930s by any stretch of the imagination. Feeling the urge to handload? Another favorite caliber is the 7x57 Mauser, developed in 1895. The older rifles have soft-steel actions, but modern-actioned 7x57s can be loaded substantially higher. In either case dropping a bullet weight will give you more zip. In my rifle with a modern action and 22-inch barrel a 140-grain Nosler partition at a modest 2,650 fps took a literal pile of deer over the years, many one-shot kills. Today, I’d load the 120-grain coppers with around 42 grains of IMR 4064 and expect 2,800 fps with less recoil. The 7mm-08 is just a 7x57 reborn in a short

Hunters quickly discovered the short barrel didn’t allow 140-grain bullets to gain enough velocity to reliably open up on deer. Here, reloading the 120-grain coppers are a big plus or even a 100-grain if you place a perfect shot in neck or rib cage. Use a fasterburning powder in short barrels — RL-15 or Winchester 760 work well. The 300 Savage was very popular, but most sit home nowadays. A 150-grain bullet at 2,700 fps was a good round and killed countless deer, but today it’s an antique. The TTSX 110-grain can be pushed to 3,000 fps with IMR 3031 or 4320, a devastating round for sure. Your older rifle, of any caliber, may have found the fountain of youth in modern bullet technology and handloading can rejuvenate them once again. If you don’t handload, start, it’s a fascinating hobby with real purpose, as you can easily see. Also, Christmas is almost upon us. If the husband, son, daughter or other significant other already handloads ammunition, a box of these new bullets under the tree or in the stocking will certainly catch and awaken their imagination. If they’re considering beginning handloading as a hobby get online and look for the many complete handloading packages available. New Year’s resolutions are made every January, and many people use this tradition as a chance to declare their intention to change jobs in the year ahead. The reasons why people change jobs vary, but the most popular reason to do so might surprise you. According to a LinkedIn survey of more than 10,000 people who recently changed jobs, 45 percent of respondents indicated they changed jobs due to a lack of opportunities for advancement with their previous employers. The next most popular reason to switch jobs was dissatisfaction with the leadership of senior management. Employers may be surprised to learn that dissatisfaction with compensation was relatively low on the list of why people changed jobs, as just 34 percent of respondents listed that among the top reasons why they left their old jobs. While that may encourage employers to find ways other than pay increases to keep their employees happy, it’s also important to note that the LinkedIn survey found that money was the second most popular reason job switchers, 74 percent of whom received higher salaries at their new jobs, chose their new positions.
