Anti-Solar Thinking Threatens to Steer Arizona Off Course.

Arizona’s Solar Community Wants to Keep Going Forward.

We have good news and bad news.

We’ll share the bad news first: Arizona’s utility regulators voted 3-2 last month to reopen their investigation into how best to strike a sustainable economic balance between electric companies and customers with rooftop solar, whose unused energy those companies buy and resell elsewhere on the grid. That investigation had ended in 2017 after three years of painstaking deliberation, resulting in a deal whereby the state’s utilities would pay homeowners a government-set rate for the energy they export to the grid.

Crucially, that rate would decrease by 10 percent each year, however it would be locked in for 10 years, for new customers.

The commission emphasized that any forthcoming revisions would alter payment rates only for new customers, leaving existing customers and customers who go solar prior to any changes “grandfathered in” to the payment plans they signed up for. That’s a precedent that the commission has previously established and intends to respect.

Commissioner Nick Myers, who pushed for the vote, has insisted that a more drastic decrease in payments to solar homeowners is warranted in light of the solar industry’s increased size and strength since 2017. He has cast his stance against the current payment model (in industry jargon: the “resource comparison proxy export rate,” or the “RCP rate”) as a fiscally conservative opposition to what he creatively refers to as a “subsidy.”

His stance has been echoed by other conservative commissioners, including the chairman, Jim O’Connor.

“We are not back in 2014 looking to help an emerging industry gain a foothold,” O’Connor said.

Never mind footholds. The reality is that the solar industry is—and has been—hanging on by its fingertips.

The good news concerns the publiccomments section of the meeting, during which supporters of the state’s most economically and environmentally promising industry pushed back against the wrongheaded thinking that threatens to keep Arizonans stuck in the past.

The Arizonans who took the lectern—and there were many of them—conveyed the dangers posed by this backwards trend more eloquently and persuasively than we could, which is why we wanted to devote this column to reproducing those comments mostly verbatim.

Many commenters addressed what is most directly threatened by a potential overhaul of the state’s solar economics: regulatory certainty, an intangible but vital asset for any business community.

“How is anyone [...] supposed to know what decisions to rely on if they’re going to be scrapped every few years?” asked Autumn Johnson, executive director of the Arizona chapter of the Solar Energy Industries Association. “We have a different commission every two years. No one—the utilities, the ratepayers, or ancillary industries like solar— will know what to do if you can’t make up your minds.”

Robert Bulechek, an energy-efficiency consultant who advises companies on solar energy, testified from personal experience to the destructive effect of capricious regulation.

In Tucson, there have been long wait times for installations because of low staffing levels, and business owners have attributed their lack of hiring to fears that the regulatory environment will change, he said. And the ACC’s decision to reinvestigate pricing for distributed solar power is an example of government actions that cause such apprehension, he added.

“What solar company is going to hire new crews when they’re not sure if the Corporation Commission is going to severely damage the solar industry?” Bulechek asked the commissioners.

As many commenters pointed out, the effects of a potential alteration to the solar industry’s ground rules are unlikely to stay neatly isolated to their intended targets.

Sam Friedberg, a solar consultant, solar-system owner, and customer of APS, explained why commissioners should not complacently trust their own ability to contain the consequences of the rule changes they’re about to contemplate.

“We all know that a proposal that enables a lower RCP rate abruptly and unpredictably

would be devastating for future solar adoption,” Friedberg said. “The whole industry here seems to be aware of that,” referring to his fellow business owners’ grim prognoses.

Since the continuing viability of existing solar businesses depends on the attractiveness of rooftop solar to future customers, a variety of existing business models and contractual relationships are at stake in the commission’s deliberations regarding terms for future customers.

“Mr. Chairman, you said earlier that contracts signed will be honored,” Friedberg said. “There are contracts that have been signed by businesses for leases, for employee training, other costs and investments that simply wouldn’t be honored if this changes this business model.”

A Tucson business owner shared his own experiences with adverse and unpredictable regulation.

Louis Woofenden, owner of Net Zero Solar, attributes his success as an independent solar entrepreneur partly to a stable business environment and “staggering technological advances,” which were fostered by good policy at the federal and state levels. Other policies, however, have created headwinds, he said.

“I would say we persevered despite efforts by utilities to make the deal tougher,” Woofenden said.

He urged the commissioners to consider how their decisions could affect Arizona’s ability to live up to its pro-business ideals.

“I think that’s the best of what entrepreneurship and the free market can be,” he said. “You’re building a team of likeminded people, and you’re building something people want, and you’re offering it out in this little piece of marketplace that the commission has created over the years—this little sandbox inside the monopoly system that you regulate.”

Friedberg did not mince words about what was ultimately at stake in a future discussion over rate changes.

“It is a business killer; It is a job killer,” Friedberg said. “And even if that’s not the primary focus here—focusing on businesses and jobs—you can’t willfully ignore it and still claim to be looking out for the public interest.”

The erroneous idea that solar is “subsidized”

(which we dismantled in our last column) was also a subject of impassioned criticism.

Arizonans who spoke to the commission incisively exposed the absurdity of this notion, especially in light of the surrounding economic context.

Commissioners who support revising the payment model for exported solar power consistently describe that model as a “subsidy” to homeowners who have invested in a rooftop solar system.

Court Rich, an attorney who represents solar entrepreneurs in Arizona, stressed the incongruity of that description and the financial reality.

APS’s own data shows that the utility pays solar homeowners less for their surplus energy than it pays for energy from other sources.

“That’s not a subsidy,” Rich said. “That’s a great deal for ratepayers.”

Johnson (the Arizona SEIA chief ) later elaborated on the theme.

“If I sell Commissioner Myers an apple for a dollar, and he sells it to commissioner Marquez Peterson for two dollars, that’s not a subsidy,” she said.

Burechek highlighted the crucial context missing from this discussion: the subsidies enjoyed by the energy industry’s entrenched interests.

“The utilities are already being subsidized by not having to pay the cost of the health and climate harm that their pollution causes,” Burechek said. “That’s a cost on the entire population. Solar, and renewables in general, don’t have those health and climate costs. That should be recognized: that, essentially, the export rates are already not representing the true benefits of the solar industry.”

Arizona’s solar community might be in for a windy and bumpy road with these commissioners driving us toward an uncertain future. Thankfully, members of this community have shown up to serve them notice that their constituents will be there to keep them from driving into a ditch.

Coordinated by the nonprofit Sonoran Arts League, this year’s free, self-guided tour features 164 artists at 41 studios throughout Cave Creek, Carefree, and North Scottsdale.

Peoria resident and wood sculptor Matt Werner is looking forward to his fourth year in the tour. Werner sculpts people in a realistic style, with each sculpture telling a story. Whether he’s sculpting people in action, sitting quietly, reflecting, or in other everyday moments, his ultimate goal is for the viewer to find their own story in the piece.

“I’m a positive-minded, non-cynical person. I see people as engaging, amusing, beautiful, joyous, and noble characters in life’s panoply. People are simply the most interesting part of the show,” Werner says.

A native of Philadelphia, Werner was a teenager when he discovered an appreciation for art.

“I often visited the Philadelphia Museum of Art, and one day, I found Auguste Rodin’s “Burghers of Calais” installed on the parkway adjacent to the museum.

I had never seen anything so powerful.

After that experience, I had a wholly different perspective on what art could be,” he says.

After earning degrees from Franklin & Marshall College (BA, Geology) and Pennsylvania State University (PhD, Geology), he pursued career work in geology consulting. In 2004, he started a

gradual transition to a second career as a sculptor. In June of 2012, he finally was able to step out of his previous career in science and become a full-time sculptor.

Werner works exclusively with hard woods, such as maple, oak, walnut, mesquite, and alligator juniper, and he prefers to use dyes to enhance his stories with color.

“I prefer hard woods because they are durable. I use dyes to help bring out the grain in the wood,” he says.

He enjoys seeing how people react to his work, especially when they feel a personal connection to a piece.

“When folks see my sculptures, they see snapshots of people—like themselves— who are doing things that they have done—singing, dancing, sleeping, striving, running, praying—people living. It’s as if

they see movements and moments from the show of life,” he says.

Werner has been trained in classical figure sculpture by Ben Hammond, Hal Stewart, Lincoln Fox, Vala Ola, and Rick Casali. He is also influenced by renowned artists.

“I admire the sculptor Bernini for his sense of movement and composition. I admire Rodin for his impressionistic abbreviations of human forms, and I favor the illustrator Rockwell for his loyalty to the nobility of common women and men,” he says.

A past-president of the Arizona Artists Guild (AAG) and past-chairperson of the AAG Sculptor’s Group, Werner will exhibit his work at Sylvia Fugmann Brongo’s Studio No. 35 in Cave Creek during the artist studio tour.

enevilla, a distinguished nonprofit that has impacted the lives of Valley residents for over four decades, recently added a significant accolade to its list of achievements. At the 2023 Surprise Area Interfaith & Golden Rule Community Breakfast, the organization proudly received the inaugural City of Surprise Community Legend Award, sealing its reputation as a stalwart in community service.

Surprise, designated a Golden Rule Community since 2018, launched this award program through its Veterans, Disability & Human Services Commission to celebrate individuals and groups making a marked difference in the community.

The award, representing the globally recognized moral principle of treating others as one wishes to be treated, stands

testament to Benevilla’s commitment to fairness, kindness, and respect.

Community Painting Preserves Cherished Memory

M

ary Alice Warsco could no longer remember how to dress herself, make coffee, or even what she ate for lunch. Dementia made day-to-day tasks too confusing. But when reminiscing about her childhood farm in Michigan, the 92-year-old had perfect clarity.

During a recent visit with her Hospice of the Valley nurse, Emily Irvine, she shared in vivid detail a family hardship from long ago. One summer when she was just a young girl, her father and brother were seriously injured in a car accident and unable to harvest their fields of ripened crops. Suddenly, Warsco and her mother heard a distant rumble, growing ever louder. They raced to the front porch to discover a long line of tractors slowly making their way toward them. “I had never seen so many tractors in my whole life,” Warsco recalls.

The small town had banded together to do the harvesting. Warsco and her father were so overcome with gratitude that they sat on the porch and wept as the kind neighbors worked their fields. In a matter of hours, they finished the job and returned to their own farms.

“I instantly pictured in my head what this memory might have looked like for her,” says Irvine. “And I thought — a painting! So, I reached out to our volunteer department, and they found an amazing Hospice of the Valley volunteer to preserve this special memory on canvas.”

The eager artist was Mandy Richards, a Scottsdale resident who loves volunteering her time to visit patients and families. “I was so excited and couldn’t wait to get started!” she exclaims. “One of my favorite things about art is how it evokes a feeling. I was honored to create a way for Mary to visualize this touching memory.”

The artwork was framed with a descriptive label on the back so future generations would know the story behind it. When Emily and Mandy went to Mary’s Peoria home to present the painting, they saw her eyes light up… and then shine with tears of remembrance.

To everyone’s delight, she immediately began telling the story again, this time holding Richards' precious painting tightly in her arms.

I

n the North Valley, a young boy named Carter Cunnius is turning his past challenges into a mission of joy for other kids. This 8-year-old, with twinkling eyes and an unstoppable spirit, is the mastermind behind a heartwarming toy drive that is making waves in the community and brightening the days of children at Phoenix Children’s Hospital.

Carter’s journey began in a way none of us would want.

When he was only 4 years old, his doctors shared the news that he had a type of cancer known as leukemia.

His days became filled with hospital visits, treatments, and many moments that required extraordinary bravery.

After a challenging battle of two and a half years, Carter triumphantly emerged, being declared cancer-free one year ago.

Carter, now a third grader at Deer Valley Unified School District’s (DVUSD) Norterra Canyon School, is inspiring not just adults, but his classmates too.

Together, they’ve been gathering toys by the hundreds, establishing a tower that symbolizes hope, kindness, and youthful solidarity. This year marks the third of Carter’s initiative, and it’s not just about collecting toys, but also about remembering and honoring friends made along the way. Last year’s drive paid tribute to a young friend, Junior, who sadly lost his fight with cancer.

In Carter’s words, the best part about organizing the toy drive each year is “knowing kids will feel loved and it will take their mind off of what they’re going through.” And his top pick for a universal toy? LEGOs, as he believes “everyone loves LEGOs!”

However, his experience in the hospital wasn’t forgotten.

During one particularly tough week, when an infection kept him bedridden, Carter experienced the boredom and sadness that can come with long hospital stays. A small box of LEGOs, which became a source of creativity and escape, sparked an idea in his thoughtful mind.

His mom, Marie Cunnius, stands proudly by his side, her perspective on life profoundly altered by their journey.

She emphasizes the importance of valuing what truly matters in life and encourages others to always accept help when it is genuinely offered. Marie believes that no family should navigate the challenging journey of childhood cancer alone.

“My mom and I built it and took it apart so many times. I was so sad, and my mom kept making up games for us to play. I still had a lot of unopened gifts at home and told my mom that I wanted to donate them so no kid would feel the way I did during that week,” says Carter.

2. Mixing Time: In the mixing bowl, combine the cornstarch and pumpkin puree.

3. Stir: Mix the two ingredients together until well combined. You're looking for a mixture that's hard when you tap on it but turns liquid when you let it rest.

4. Optional Add-ins: For a more festive feel, add a few drops of fallthemed food coloring and stir well.

If you want your oobleck to have a delightful scent, sprinkle in a bit of cinnamon and mix.

5. Play and Explore: Let kids touch and play with the pumpkin oobleck.

City officials have initiated the pre-application site plan process in collaboration with American Leadership Academy, the proposed school’s developer. The two parties are ironing out the finer details, including a land purchase agreement for the school’s location within the expansive 320-acre Five North at Vistancia’s commercial core.

“No One Will Save You” A young woman's home is invaded by extraterrestrials.

When a genre film addresses trauma while staying true to its genre elements, it's a treat, and “No One Will Save You” accomplishes this. For 90 minutes, it lives up to the phrase "all killer, no filler" with an active series of escalating set pieces and tension. In a movie with almost no dialogue, Kaitlyn Denver and director/ writer Brian Duffield do an impressive job of letting the actions speak for themselves while depicting the isolation our character feels. The big reveal is slightly half-baked and causes an odd ending, but not in a way that ruins the movie.

Combine this with some stellar creature effects, and you have a solid, exciting, and even scary creature feature.

IN THEATERS “The Creator” A soldier in the near future becomes the unintentional protector of a robot girl who is more powerful than it seems.

“The Creator” is unfortunately a victim of bad timing given the current debate around AI, and it risks having its message being misinterpreted. Fundamentally, Gareth Edwards uses it as a metaphor for U.S. militarization in events such as the Vietnam War, and how it executes that will be up to the beholder, though I found it enthralling. Much of that is thanks to Edwards' direction, which brings a combination of technology and natural beauty to its world, and the lead performances of John David Washington (with his dry charisma bringing heart to the character of Joshua) and newcomer Madeline Yuna Voyles (incredibly gifted at delivering a balance between emotional and robotic). I also greatly appreciate the tone of the film.

It manages to stay true to its general message and idea without falling apart, though at times the imagery can risk coming off as exploitative or empty. It also mostly underuses its supporting cast, aside from Ken Watanabe's stellar work. Ultimately, “The Creator” still comes through as a breath of fresh air in the modern blockbuster sphere that shows what director Edwards is capable of.

two, with more emphasis on gratuitous gore. However, the newest installment is just dull without any real shocking nature to it. None of the five shorts have anything to say about the 1980s or the sort of fetishization the decade has received in recent years. Nothing about the shorts makes them particularly '80s, aside from the aesthetic choices in the overarching story. This movie could be set in any decade, and it would change little. As stated before, this isn't exactly a scary movie but instead just bores, which is the worst thing you can do in this genre. Not one of the ideas is given the time to explore; it just shows up and then is done with. By the end of the movie, you just feel like you wasted time.

It's one last gift from a master of filmmaking.

“Frank’s team puts family and caring into real estate” My family and I had an amazing experience with the Frank May Team. I don’t use the term amazing loosely, My husband and and I had a business opportunity on the east coast. But we needed to jump immediately. We have a family of 4. Mom, Dad and twin 9 year old boys. My husband and I had used the same agent for the purchase of our first house, the sale of that house and then the purchase of our current house. 10 years later we found ourselves in a predicament. We need to sell quickly, but for as much as we can because we have this business that we want to buy back east. My best friend had just had the Frank May Team sell her house within her timeline and for what she wanted so she recommended him. Then she called him and gave him my info and he called me within a few minutes. We went through the timeline, I answered a few questions and we made an appointment for that Friday. My husband had made appointments for Thursday with other companies. I wasn’t there for the walk through but when I got home they were still there. I looked through their paperwork and asked a bunch of questions and wasn’t thrilled. When Frank came, he came prepared with actual realistic comps of the area, how he could/would show our home’s potential and how he and his team would follow through.. It really gives you an idea of what your house could be sold for. Within 2 weeks he had an open house for us.

We had Ring cameras so we saw all of the traffic and were thrilled at the outcome! After that first open weekend we got 3 offers.

Although they were all really good. 1 was exactly what we wanted. I called my friend and said, “do you remember how you said that Frank sold your home for what you asked and he sold it quickly? He’s 2/2. He just did the same”! My friend laughed and said, “I wouldn’t expect anything less!”

I share this story, as long as it is, because I feel like Franks team puts family and caring into real estate. He and his team work fluidly and effortlessly.
