It’s been almost two months since Arizona’s utility regulator kicked off what’s sure to be a long and contentious fight over how much homeowners with rooftop solar deserve to be paid for the electricity they share with their neighbors.

We’ve commented on the Arizona Corporation Commission’s head-slapper of a decision to reopen an already thoroughly litigated issue, so now we will try to anticipate some of the anti-solar rhetoric that’s likely to pop up in the ensuing discussions. One of the most pernicious falsehoods about solar is that it’s unreliable—and, conversely, that its Earth-heating legacy competitors are a firm rock we can stand on.

The state’s largest provider of electric power has cited its abundant stock of fossil-fuel infrastructure as reason to dismiss any concerns over the state’s energy security. Such reassurance might satisfy those who have listened to comments from public officials—many of whom are closely associated with fossil-fuel interests—who have derided solar, wind, and other renewable energy sources as fickle and unreliable in comparison to coal and natural gas.

But people who have paid attention to recent developments in the planet’s changing climate are more likely to have some skeptical questions.

Even as officials seek to roll back Arizona’s gains in solar-enabled energy independence, recent events are proving that solar power will be crucial to Arizonans’ energy security and access to scarce resources.

Rosy predictions about the resilience of Arizona’s energy infrastructure in its current, heavily fossildependent state are far from reliable given some stark realities. Researchers at ASU found that the risk of cascading grid failures increases by a factor of 30 with each increase of a degree celsius in average annual temperatures.

What’s more, the financial viability of fossil fuels

as a cheap, dependable energy source is doubtful given that the EPA, under President Biden’s direction, is currently preparing regulations that would dramatically increase the cost of such fuels to account for the damage they cause to our planet.

All in all, fossil fuels could soon turn out to be as unreliable as they are dirty. By contrast, renewable energy, especially solar, is proving its value as a critical component of a resilient, dependable grid.

Solar power and battery storage helped prevent power outages in Texas during the heat wave that struck the southern half of the United States this past summer, according to Inside Climate News.

When energy demand shot up along with the mercury, solar power helped stabilize the grid with badly needed electricity, preventing grid failures.

That likely saved lives.

Meanwhile, events proved more embarrassing for fossil-fuel energy, which we’ve heard touted as the only energy source we can count on, apart from nuclear. One of two plant failures mentioned in ICN’s article was a coal plant. The other was a nuclear plant.

Whether we can rely on our electrical infrastructure determines whether we can rely on our taken-for-granted access to vital resources, especially water.

Global warming simultaneously increases the need for fresh water (as a coolant for the power plants needed for air conditioning) and decreases its availability in the form of precipitation. Reduced rain and snowfall, in turn, threaten to idle the state’s sources of hydropower, increasing our reliance on water-sucking power plants.

As we observed in our previous article, the interconnected nature of our resource challenges means there is virtually no aspect of civilization that is left untouched by the climate crisis. We should be looking for solutions that are correspondingly wideranging in their effects.

Solar power is one such solution.

Solar panels require no water to cool them down, unlike Arizona’s thirsty coal and nuclear plants.

What’s more, they eliminate the need to burn a corresponding amount of coal or natural gas to serve a given household, slowing the accumulation of greenhouse gases that is depriving us of water.

Speaking of reliability, it’s worthwhile to reflect on who we can rely on to foster the clean, abundant energy sources that we need.

It doesn’t seem to be public officials, who are often eager to stymie the country’s clean-energy transition with imaginative interpretations of facts. You may recall that pro-fossil-fuel politicians and pundits blamed renewable energy for Texas’s deadly winter power outages in 2021, contributing to the anti-solar misinformation that makes going green such a steep climb. This is especially ironic given that renewables helped save Texas’s hide this past summer.

That spontaneous disinformation campaign was just one data point in a trend line that is fairly easy to read. Public officials are as liable to inhibit as to encourage the growth of America’s green-energy economy, especially in states with deeply established profit centers in the form of fossil-fuel infrastructure.

That’s why people who benefit from a reliable energy grid and a healthy environment—which is to say, everyone—has a civic duty to stay engaged in public discussions over whether to foster or stymie the growth of clean energy. (We know we will, and once the Corporation Commission schedules another public meeting in its rate case, we’ll be sure to let you know.)

As it turns out, we are the ones we have to rely on to secure our energy future.

The annual license fee is $250 per property; funds received cover costs associated with licensing vacation and short-term rentals. This license is in addition to the county and state requirements. “Fifteen years ago, I began working on a few big estate fights – fights over money when there is no will or no valid estate plan,” Libby explains.

“I saw families fall apart when the fight escalated, saw the hard-earned money of the deceased being eaten up by court proceedings and lawyers’ fees. Family is very important to me, and seeing families fall apart in these situations motivated me to begin working on the preventative side, looking to avoid those fights. For the past 11 years, I’ve focused exclusively on estate planning, probate, and trust administration.”

Libby says that estate planning is needed at any age or life situation. “You need to consider your current financial and life situation as you plan,” she says.

Estate planning is about selecting someone to make sure your estate is managed properly, first for you if you are not able to manage your own affairs, and then to be sure your assets are distributed the way you wish when you are gone. The goal is to create a plan and keep it updated so it grows with you. Your plan when you are married with no children differs from the plan when you have small children and grows into another plan when your children now have children of their own. A sound estate plan helps you to protect your loved ones and makes sure that your wishes are respected.

What are some downsides to failing to do a plan? Many, Libby shares, and with consequences you may be unaware of or are unforeseen.

“The state of Arizona has a plan for you – it’s written in the law,” Libby reveals. “Often, it is not what you would want to have happen.”

She says a classic example is the blended family, where husband and wife have come together in a second marriage and have children from their previous relationships.

State law says that assets held by a married person in his or her own name are divided between their spouse and their children from a previous marriage when they pass. “If the house is just in the husband’s name, on passing, the wife only owns half the home. Her husband’s children own the other half. If that isn’t what they want, they need to be sure that their plan avoids this.” While holding assets in joint tenancy is one solution, Libby admits, it doesn’t solve all the issues. “If the house is held jointly and the husband passes away, the wife inherits it by operation of law. But if she doesn’t myhyperlocalnews.com

have a plan in place, who inherits when she’s gone? Her children. Her husband’s children are left out completely. A good plan could make sure that the surviving spouse has use of the assets for his or her lifetime, and that the assets go to both of the couple’s children when the survivor passes away.”

Libby mentions that she has built a great team to assist clients with wills, trusts, and powers of attorney, including Travis Meyers, a lawyer who joined the team two years ago. “The team is also ready to help if your loved one passes away without a proper plan. If your loved one left no will, or if they only drafted a will, the family must file a probate court proceeding, and the team can do that for you and guide you through the steps to wrap up the estate.”

“We are happy to assist with probate matters, as long as there is no contest or fighting among the family members,” says Travis, Libby’s attorney in charge of probate and trust administration. “But your family will have a much easier and smoother time wrapping up your estate if you have a trust.” The team is also available to assist with the administration of a well-planned trust upon a loved one’s passing.

Both Libby and Travis caution that do-ityourself estate planning may be unwise. Like all important, vital tasks, it’s best to leave something this crucial to a professional.

“If you don’t do the job right and you don’t know you’ve made a mistake, it may well be too late before you – or more likely, your family – finds out and then they may end up in court,” she explains.

Redevelopment of the CrackerJax site – The Parque – moves forward

A

fter a lengthy review process, the Scottsdale City Council approved an ambitious mixed-use redevelopment project called The Parque on a 32-acre site that was once home to the CrackerJax amusement park on north Scottsdale Road.

The project will harvest and repurpose rainwater and air conditioning condensation, reducing the need for external water sources for landscape irrigation.

Innovative methods like capturing rainwater through special pavements and storing it underground for future use are also part of the plan, and the parking facility will include a green roof and solar energy generation.

Plans call for a variety of buildings that encompass a 2-acre “Central Park” green space that will be open to the community. Structures will feature a diversity of architectural styles for uses that include more than 250,000 square feet of commercial space, a hotel, and residential, with up to 1,322 residential units and hotel rooms combined.

“The Parque will be another Scottsdale landmark, a reflection of our city’s sustainable development ideals,” says Mayor David D. Ortega. “This project brings a best-in-class cyber security employer and other national security affiliates - a huge win for Scottsdale.”

Development plans place a strong emphasis on sustainable practices, with a special focus on conserving water, mirroring Scottsdale’s commitment to eco-friendly urban development.

WHAT’S NEXT? The November city council approval was preceded by a unanimous recommendation by the Scottsdale Planning Commission. The zoning approvals are the

first step in redevelopment of the property since a 2012 General Plan Amendment that added the option for residential mixed use on the site. As stipulated in the city council approval, future development of the site will conform with the development plan and development agreement.

It is anticipated that the project will be built in multiple phases. The next step in the process will be submission of a Development Review Board (DRB) application for the first phase.

Through the DRB application, the city will receive the first detailed design plans for the project. Once the DRB determines that the design is consistent with the city council approval, building construction plans can be submitted and permits issued. The development review and construction permitting process typically takes from eight to twelve months per phase.

A Historical Journey Through 30-Year Fixed Mortgage Rates

T

he 30-year fixed mortgage rate, always a subject of speculation, guarantees only one thing: change.

Since Freddie Mac began tracking these rates in 1971, they have experienced significant fluctuations. The peak rate was 18.63% in October 1981, and the lowest point reached 2.65% in January 2021.

The journey begins in the 1970s. Rates started at 7.5% in 1971, escalated to 10.03% in 1974, receded back into the 8% range, and then climbed to 12.9% by 1979.

The 1980s were marked by economic challenges: a recession, an oil embargo, and a savings and loan crisis. Interest rates initially peaked and then gradually decreased to 10.13% by 1988.

However, following the increase in the federal bank rate, mortgage rates also rose. In the last 16 months, they have exceeded 8%, with a recent decrease below this level.

What will 2024 bring? Experts anticipate a decrease of 1 to 1.5%. Only time will reveal the accuracy of these predictions.

By 2003, the 30-year rate had declined to the high 5% range. The following recession pushed it down further to 5.04% in 2009.

As the economy recovered, with stringent borrowing guidelines in place, rates continued to decrease, moving into the 4% range, then into the 3%, and finally hitting a historic low of 2.65% at the onset of the COVID pandemic’s second year. These rates hovered near 3% until May 2022.

Phoenix Suns Gorilla Delights Hospice Patient

t was a slam dunk surprise for a senior community when the Phoenix Suns Gorilla popped in for a visit.

The team mascot wanted to thank a hospice patient for being a devoted fan for over 50 years. He bounded into Scottsdale’s ClearWater Pinnacle Peak with arms full of team swag for 88-year-old Lee Kragenbring.

“It’s moments like this when it’s hard to tell who receives more joy,” Adams adds. “The patient or those of us who love and care for him?”

When Hospice of the Valley reached out to see if a visit might be possible, Phoenix Suns Charity Manager Josh McCann didn’t monkey around — he

The visit astounded the season ticket holder who has attended more games than he can count. Though he no longer speaks, Kragenbring was grinning ear to ear as the Gorilla entertained the crowd of 50 residents with backflips and dance moves.

Cheers broke out as he walked across the room on his hands.

The last time Kragenbring went to a game was right after he’d been diagnosed with Parkinson’s disease.

“I just wanted to give him one last experience before he couldn’t go anymore,” says Kragenbring’s daughter, Kim Kulpins. “When Renee approached me about making this happen, I thought, ‘No way — not during the basketball season!’ This is so touching and incredible. I’m grateful that the Suns care about my dad.”

Home Title Theft and Trust Planning

he news is often filled with stories about fraud.

One of the areas of current concern I often hear about is title theft. What is title theft? It can range from someone fraudulently refinancing your home and pocketing the money, accessing the equity with a home equity line of credit, forging a deed, and selling your property to an unsuspecting buyer, or providing fake wiring instructions so the payment for your new home goes to a fake title company.

How can we protect against this type of title fraud?

Recently the Maricopa County Recorder has set up a program to alert you if a document is being recorded that might affect your title. You can sign up to be notified by email with Title Alert. You can sign up to get an alert regarding your name (it is not specific to your property) at https://recorder.maricopa.gov/MaricopaTitleAlert/.

I highly recommend this to keep on top of what might be happening with your title. Pinal County has a similar alert, but our other counties have not yet put in place an alert system.

So, what about a house held in trust? Could having your house in a trust help prevent fraud? Likewise, is a rental property in an LLC better protected from title fraud than one held by an individual?

For most fraudsters, the easier it is to defraud you, the better for them. The more complications in their way, the harder it is to defraud you, and the greater the risk of getting caught.

When you title your home to your trust there are

many additional complications. It takes a high level of sophistication to commit fraud regarding that property.

When the title is in an individual’s name, the criminal only needs to sign the name to forge a deed or loan document. If the home is in a trust, they must provide proof that the trustee has the authority to take out the loan or transfer the property. Sometimes the title company or lender will ask for the entire trust document. Faced with these additional requirements, a fraudster would quickly decide to pursue a home offering fewer difficulties and move on.

Likewise, a fraudster stealing or financing a property in an LLC must again show that they are authorized to act. The lender should be checking the State records to determine who owns the LLC, who is the manager, and asking for documents showing the authority of each person to act. The criminal is likely to move on if you have an LLC as a stumbling block.

The narrative takes an excessive amount of time to progress beyond its initial setup, resulting in a sluggish first act. The remainder of the film seems to experiment with various elements—such as dream sequences, playful encounters with animatronics, and a murder mystery—but these aspects feel underdeveloped. The actors, despite their capabilities, are constrained by the film’s uneven direction and lackluster script. Furthermore, the cameos, although potentially exciting, come across as overly indulgent. Why You Still Have Sciatica Pain Shooting Into Your Hips, Back, and Leg (And How To Get Rid Of It For Good)

s doing everyday things from standing up straight to finding comfortable sleeping positions and even just walking difficult because of sciatica pain?

You may find it hard to focus on enjoying those around you because you’re distracted by your pain.

You may have already tried chiropractic, massage, stretching, and exercise, but the difficulty is knowing which things will help and which won’t. This can be frustrating because it seems unpredictable.

Some sciatica is caused by muscular weakness and restriction, while others can be caused by stiff joints.

Ultimately, certain exercises may help some sciatica, but make other types worse. To best help you, I’ve compiled a list of tips that will help anyone with sciatica regardless of the type to reduce daily pain.

Most people with sciatica just want to know if there’s a solution that actually lasts. Solutions that used to work, don’t work any longer. Eventually you find yourself in a rabbit hole, searching high and low for solutions that hopefully help you avoid surgery.

One of my patients, Marian, had tried everything above on top of back surgery, unspecialized physical therapy, pain management, spinal injections, spinal electrostimulation, acupuncture, and dietary analysis.

Marian told me, “When you go through this, you learn how many things you can no longer do if you can’t stand or walk.”

You Don’t Have to Choose Between Surgery and Giving Up the Activities that You Love.

Sciatica is so common because many of the solutions out there just take one area into consideration. The muscles, the joints, nerves, strength, weakness, etcetera. The simple truth is that sciatica is a complex condition with many contributing factors.

The core issue, which has been proven time and again in the best research, is that the body has developed compensation patterns in order to protect itself. These patterns are hardwired into the brain, and will continue to persist unless they are fixed.

This pattern is what CAUSES the tight muscles, and the stiff joints. These tight muscles and stiff joints eventually pinch the nerve, causing sciatica.

Therefore, correcting the pattern is the true root cause. No matter how long you’ve suffered, you can still get your life back. No surgery. No pills.

6 Reasons Why Your Sciatica May Be Lasting Longer than it Should: 1. You tried looking up exercises to do on your own for your sciatica. But with many “causes,” it’s difficult to figure out which exercises are right for you. This is why some exercises can seem to make it better, but some make it much worse.

2. You tried a few relaxing massages and it felt good for a few days but then it came back.

3. You tried chiropractic care and it eased a bit, but the nagging sensation is still there.

4. You tried waiting for it to go away on its own.

The issue with a lot of these methods is that they focus on addressing the symptoms, not the root cause of your sciatica.

What to Avoid Here are 3 things that can make your sciatica pain worse.

Stretching: If you’ve been stretching to fix your sciatica and it hasn’t worked yet, it likely won’t. More often than not, sciatica has come up because of tight muscles. Stretching is for short muscles. Tight muscles are tight because they’re compensating for a weak muscle nearby.

Stretching will relieve them for a little bit, but it will come back unless the weakness is resolved.

Crossing Your Legs: Avoid crossing your legs at all costs. This can cause stretching in the back of your hip which compresses the sciatic nerve. It also causes twisting in your hips and pelvis which can put stress on the nerves in your back.

Resting: Certain activities right now might make your sciatica worse, but that doesn’t mean you should restrict all of your movements. If certain things are painful, like walking, lifting, sitting, it’s important to find the root cause so you can start moving properly and stay active.

How to Fix Sciatica for the Long Term So many of the “solutions” we try only provide temporary relief because they’re not targeting the root cause. And without getting to the source of the problem, sciatica pain will continue to return because the cause was never addressed.

Marian learned this the hard way, and unfortunately a lot of people do. After addressing the root cause, Marian says, “I’m back to walking 3-4 miles a day; I can lift and hold my grandbabies; I can go to parties without having to sit in a corner; I can go shopping again.” The only thing she’d change? Finding a specialist to help her address the root cause sooner. “I could have avoided a lot of doctors’ appointments and needless and expensive treatments, not to mention losing a couple of years to my other attempts.”
