“I’ve Had Back Pain Since Pregnancy, It Just Never Went Away, Is That Normal??” - By Leading USA Back Pain Expert, Dr. Tom Padilla Have you had back pain since being pregnant, or shortly after childbirth that seemed to just stick around? You’re not alone, in fact this is one of the first things that many of my clients tell me. They tell me things like “At first I thought it was normal, and that it would go away, but here we are 5 years later.” It’s really frustrating for a lot of moms, because as their kids get older, they start to feel like they’re missing out on the full experience of being a mom. They can’t shoot hoops, run after them, lift them in the air, all because they’re constantly worried about their back. What if I told you that this is not normal, but it is very common? And that it’s very likely that there is a solution, you just haven’t found it yet? Some of the most common things that women try to help with this are: yoga, pilates, stretching, massage, foam rolling, chiropractic care, and exercising. They commonly report that while these things feel good at the time, they feel like they constantly have to keep moving to avoid getting stiff, tight, and uncomfortable. If that sounds like you, the most important thing to know is that these symptoms can be completely reversed, and you can get back to those things you want to do, we see it all the time. When our client Katherine first came to us in 2018, she had been struggling with back pain for 5 years. Before having kids, she doesn’t remember ever having back pain. Her back pain was especially worrisome, because in her words when her back went out “it was debilitating, like I could hardly walk at all let alone pick things up off of the ground. I felt like I couldn’t help my husband with the kids, and I felt guilty for that.” In addition to back pain, she had shooting pain down her legs. Before this she had been active, and in fairly good shape. She ate well and took care of herself, so she couldn’t understand why against all odds, she was the one with severe back pain. She had tried everything, but it just wasn’t in her to give up so she kept seeking help. As luck would have it she was referred to me. We were able to quickly identify what had happened, and why nothing she tried seemed to last. Within a couple of weeks she was no longer having shooting pain in her legs, and a little more down the line she was free of her back pain. The real breakthrough though, is that it’s been nearly 3 years, and she hasn’t had an episode of severe back pain since. Every once in a while her back feels a little stiff, but now she has the tools to address it on her own. And usually if it’s stiff, it’s because she’s been hitting it hard at a new fitness class. She’s finally free of having to worry if her back will flare up. She can say yes with confidence to playing with her kids, and doing things with her friends.
What To Avoid That’s Making It Worse Here are 3 things that can make your back pain worse. Stopping Exercise: Completely stopping all exercise is a mistake. It can definitely be frustrating to find something that doesn’t flare it up, but it’s important to keep moving. Crossing Your Legs: When you cross your legs, it puts pressure on your spine, causing it to twist, which puts more pressure on the joints that are already inflamed. Ignoring It: If this strategy hasn’t worked for you up until now, you’re not likely to be getting close to a breakthrough There’s no prize for persistence in this category!

Scottsdale Memorial For the Fallen Taking Shape By Kelly Corsette RESIDENTS OF SCOTTSDALE AND THE NEARBY NATIVE AMERICAN COMMUNITIES HAVE SERVED WITH DISTINCTION IN THE UNITED STATES MILITARY FOR MORE THAN A CENTURY. On a number of occasions, these service members paid the ultimate price for our freedom. While their loss was certainly felt and shared by their families and friends, there has been no permanent public acknowledgement of their individual sacrifices - a new memorial will change that. Scottsdale was not incorporated until June 1951, and Scottsdale’s corporate boundaries have been modified several times. However, the desire of Scottsdale residents to serve our country in the military has never waned. A group of Scottsdale residents, in partnership with the city of Scottsdale, believe it is now time to honor our fallen military residents (the Fallen). On June 30, 2014, a group of Scottsdale residents formed the City of Scottsdale Memorial Action Committee (COSMAC). This committee discussed the possibility of designing and building a permanent and personal memorial to commemorate Scottsdale area residents who were lost during military service to the nation. and United States Marine, has led the effort from its inception. The committee’s initial focus included research to identify the individuals to include on the memorial and fundraising to build it. COSMAC selected a design team that completed conceptual design and then began working on final design of the memorial. The City of Scottsdale has committed to providing a site for the memorial adjacent to the Chaplain monument on the grounds of Scottsdale City Hall. To date, 66 individuals have been identified for the memorial. Military accomplishments of those on the current list include: one Distinguished Service Cross, one Silver Star, three Distinguished Flying Crosses, eleven Bronze Stars, five Air Medals, and two POW Medals. In 2017, the COSMAC received State Corporation status and approval from the IRS as a Section 501(c) (3) charitable organization. The legal name of this corporation is Scottsdale Memorial for the Fallen, Inc. (SMFTF). The SMFTF board consists of five volunteers and is self-administered. SMFTF’s current work consists solely of fundraising at this time and its experience is limited in this area, according to the group. SMFTF is debt free for all of the design work completed
to date and is seeking funds for the permitting and construction with the goal of a formal dedication before or on Memorial Day 2022. The design drawings are nearing completion and City of Scottsdale approval is forthcoming. Although the formal construction bid process has not yet been initiated, a target fundraising goal has been set at $200,000. To date SMFTF has raised nearly $150,000. Scottsdale Residents and Businesses Will Not Be Affected by Anticipated Colorado River Cuts By Valerie Schneider THE CENTRAL ARIZONA PROJECT (CAP) AND ARIZONA DEPARTMENT OF WATER RESOURCES RECENTLY ANNOUNCED AN ANTICIPATED DECLARATION OF THE FIRST-EVER “TIER 1 SHORTAGE” REGARDING THE SUPPLY OF COLORADO RIVER WATER TO ARIZONA STAKEHOLDERS, INCLUDING SCOTTSDALE. While the shortage will result in cuts to Arizona’s share of the river, Scottsdale residents and businesses will not see any restrictions or changes to their supply. Here’s what to know, according to the city of Scottsdale: • Scottsdale is prepared for a Colorado River shortage. • Stakeholders across the state work collaboratively to share responsibility in drought mitigation efforts under the Drought Contingency Plan.
• Water supplies to tribes and municipalities will not be affected in “Tier 1.” • Agriculture pools in Arizona will be reduced to offset water supply restrictions. • While supplies won’t change for Scottsdale residents or businesses, everyone is urged to continue drought conservation efforts. Scottsdale Water has made significant investments to prevent shortages of its supply by updating systems and facilities, implementing innovative water management strategies and prioritizing conservation, according to the city. In April, Scottsdale City Council approved an updated Drought Management Plan, which outlines the management of water-supply and water-use during an episode of reduced supply. f a person close to you has been diagnosed with Alzheimer’s disease, it may be time to address some serious financial questions. Due to the debilitating nature of Alzheimer’s and related forms of dementia on your loved one’s ability to make sound financial decisions, the sooner you can get financial matters in order the better. Here are four important steps to take:

LOOK FOR SIGNS OF UNUSUAL FINANCIAL ACTIVITY Discrepancies involving money can often be among the early signs of cognitive challenges for an individual. Red flags may include difficulty paying a proper amount for an item, leaving bills unpaid or making out-of-theordinary purchases. If you observe signs of a loss in judgment related to financial matters, additional action may be required.

IDENTIFY AND DESIGNATE A POWER OF ATTORNEY Many people are reluctant to hand control over of their personal finances. It’s important to have an honest discussion with your loved one and help them appreciate the importance of having somebody in a position to look out for their interests. Most important is to identify somebody who can be considered a trusted surrogate to help manage day-to-day money matters when that becomes necessary. An individual should be designated as financial power-of-attorney, authorized to sign checks, pay bills and help keep an eye on the affected person’s finances. The person designated with power-of-attorney can ease into the role, only assuming full control when it becomes absolutely necessary as the person receiving the diagnosis loses capacity to make rational decisions.
trusts and other estate planning documents. This should include an advanced health care directive that will indicate the levels of care that should be followed if health deteriorates. Also check beneficiary designations on any retirement and financial accounts as well as life insurance policies. With all relevant documentation, be sure the information and named beneficiaries are up-todate and that proper processes are followed. Check with an estate planning attorney for help.

ASSESS COSTS OF CARE AND HOW IT WILL BE COVERED A top priority is to determine a strategy for how your loved one will be cared for, particularly if their cognitive abilities should deteriorate over time. Will specialized care be required, either in the home or in a nursing or assisted living facility? If so, are there resources or long-term care insurance policies in place to help deal with those costs? This will greatly affect any decisions on a care strategy. Talk to an elder law attorney about trusts that can be established to provide for care for the disabled individual while still protecting the family’s assets. BE PROACTIVE IN YOUR APPROACH Waiting too long to address financial considerations after an Alzheimer’s diagnosis can compound an already stressful and emotional time. Take steps to get on top of the situation as soon as you are aware that it could be a problem. Even establishing a plan for addressing these issues before a form of dementia is firmly diagnosed makes sense. Consult with your financial advisor for guidance on how to manage these challenging times.

West Keur will use the award money to further her education, as she is currently a doctoral student at Arizona State University (ASU). “In addition to my role as a middle school gifted specialist teaching in the DLC program at Sunrise Middle School, I am also an adjunct professor with Maricopa Community Colleges and an Academic Associate with ASU, teaching in their Master’s of Education in Gifted Curriculum and Instruction program under Dr. Dina Brulles,” she shares.

Real Estate Days on Market: Does it Matter?

M
any home buyers focus on how long a home has been for sale, also known as Days on Market (DOM). The reasoning is that the longer a property goes unsold, the
more overpriced it is and the lower an offer should be. This is often not the case and can lead to unfairly stigmatizing a property. There are many cases of sellers taking their homes off the market for three to six months hoping to escape this unfair judgment.
There can be, and often is, a good reason for a higher DOM, such as an uncooperative tenant, a long (but unsuccessful negotiation), or days lost to an extensive repair like a new roof. Conversely, a home may have a lower DOM even though it has been extensively marketed offline or through a ‘Coming Soon’ status on the Multiple Listing Service (MLS).
So why calculate Days on Market anyway? Actually, a large number of MLS systems across the nation do not include this calculation at all. They reason that DOM creates more confusion than certainty, so they simply exclude it. In Arizona, however, we have the DOM calculated on every listing.

Another approach is to ask the seller, or the listing agent, for an explanation if the DOM seems high. Their answer or explanation may give you more guidance as you try to determine an offer or price the seller would accept. Just bear in mind that Days on Market is simply a tool, not a rule. ith the advent of a new administration usually comes change. President Biden’s tax plan may affect your estate planning adversely. Here are a few key points of the plan.
ESTATE AND GIFT TAXES MAY INCREASE. Arizona has no estate taxes. On the federal level, each person has an estate and gift tax exemption – the amount you can give away during life and at death before being taxed – that is currently $11.7 million. Biden’s plan would reduce the federal exemption to $3.5 million for estate taxes at death, and $1 million for gifts made during your lifetime. The plan also proposes to increase the tax rate on estates and gifts over the exemption from 40% to 45%. For estates that are or may be taxable under Biden’s plan, there are strategies to maximize your tax exemptions as well as ways to take advantage of the higher exemption while it still exists. Currently, married couples have portability of the exemption between spouses, allowing a surviving spouse to inherit their deceased spouse’s unused federal estate tax exemption. This portability for spouses is expected to continue under Biden’s plan. THE STEPPED-UP BASIS TO REDUCE CAPITAL GAINS AT DEATH MAY BE ELIMINATED. The IRS levies capital gains taxes on profits from selling an investment. Profits are calculated on the cost basis – what you paid for the asset. When the asset is sold, taxes are paid on the sales price less the cost basis. Currently your heirs’ inherited assets get a step-up in the
cost basis to the value as of your date of death. Thus, when the asset is sold, the tax is levied on the difference between the value at your death and the sales price. This significantly reduces capital gains for inherited assets. Biden’s plan would eliminate the step-up in basis for gains over $1 million. This change can greatly affect estate planning strategies designed to minimize taxes paid by the beneficiaries after the owner’s death. STRATEGIES. This article is too short to address the various strategies to minimize taxes. These strategies include gifting, use of irrevocable trusts, and charitable giving strategies that benefit your family and your charity of choice. What strategies will work for your estate varies based on many factors. We would be happy to discuss those with you. ESTATE PLANNING IS ABOUT MORE THAN TAXES. It is important to remember that estate planning is not just about avoiding or minimizing taxes. That can be an important element of a plan, but estate planning is also about saving time, money and grief for your family and beneficiaries. Having a plan in place that provides for your incapacity and death, avoids court proceedings, minimizes attorney’s fees, and provides a smoother transition of assets to your beneficiaries is every bit as important as planning for tax avoidance. For many who do not have taxable estates, even under Biden’s plan, this is more important than anything else. A good estate plan provides incredible peace of mind. Health New Legislation Dramatically Expands Telehealth Across Arizona
G
overnor Doug Ducey recently signed legislation to dramatically expand telemedicine in Arizona and provide greater opportunities for accessible medical services. “Ensuring Arizonans have access to safe and reliable medical services is a top priority,” says Governor Ducey. “Telehealth expands access to medical services for lowincome families and those living in rural areas, protects vulnerable populations, and allows snowbirds visiting our state to receive telemedicine from their home state. Patients and medical professionals know what’s best for their needs, and we’re working to make sure they have access to those services. I’m grateful to Representative Regina Cobb for sponsoring House Bill 2454, and to the legislators and medical professionals who supported it.” House Bill 2454 puts Arizona at the national forefront of telemedicine. It expands access to telemedicine for patients, ensures doctors receive equal compensation from insurance companies for telemedicine services, and allows out-of-state health care professionals to provide telemedicine in Arizona. Under the bill, medical examinations in the worker’s compensation space can also be conducted via telehealth if all parties consent. It also prohibits healthcare boards from enforcing any rule that requires a patient to visit in-person before being prescribed most medications. “HB 2454 is a win for physicians and patients alike,” says Arizona Medical Association President Dr. Miriam Anand. “Every patient deserves access to the appropriate care needed to treat their medical

conditions. HB 2454 will break down unnecessary barriers to telehealth and help facilitate the delivery of high-quality care to patients across Arizona.” HB 2454 will make telemedicine services provided to Arizonans through the Governor’s Executive Order last March permanent.
