Crisis Averted for Solar in Arizona. But We’re Not Out of the Woods yet.

In late August, Arizona’s clean-energy community gasped and breathed a sigh of relief in quick succession A top official in the industry’s regulator proposed and then, in the face of public outrage, backed off from an extreme and abrupt cut to the solar export rate, which compensates owners of solar systems for the power they supply to the grid.

At an official hearing of the Arizona Corporation Commission on Aug. 24, Commissioner Nick Myers withdrew his proposal to cut the solar-energy purchase rate by 37 percent, which he had filed a mere 48 hours before to the shock and dismay of green-energy supporters.

The measure, which would have suddenly overturned a deal struck in 2017 to limit yearly reductions of the export rate to 10 percent, would have been a devastating blow to rooftop solar power in Arizona.

Arizona’s rooftop solar industry was sweating buckets. But it was only a respite; the commission only tabled the issue, leaving it to be discussed further on October 3.

Since harmful changes to the export rate still loom on the horizon, we thought it would be a good use of this space to clear up the confusion and misinformation around green energy. Then we’ll talk about the tricky situation these new developments leave us in as solarenergy investors and suppliers.

Myers bases his proposal on the common but misconceived notion that the export rate constitutes a “subsidy” of some kind to owners of rooftop solar. But as solar advocates have pointed out, what APS is paid retail and what it pays on a wholesale basis to other power suppliers (which mainly pump out greenhouse gases in addition to electricity) regularly exceeds the amount paid to owners of rooftop systems for their power, sometimes by a factor greater than ten.

“An APS customer installing rooftop solar today gets $76 [per megawatt-hour] for excess via the [buyback rate] while paying to APS $107 [per megawatt-hour] off-peak and $290 [per megawatt-hour] on peak,” wrote Court Rich on X (formerly Twitter), an attorney who advocates for solar companies. “Yet in July, APS regularly purchased wholesale power during day at $200 and even up to $900/ MWh. The RCP is a good deal, not a subsidy!”

The consistent use of the term “subsidy” reflects an ingrained misunderstanding on the part of commissioners

about not just the financial math but about the nature of the relationship between utilities and solar-sysetm owners, said Val Berechet, CEO of SunSolar Solutions.

As Berechet has argued, solar customers have invested their own wealth into their systems, just like a power-plant owner, and seek to recoup that risky investment by selling it to the power distributor at a not-so-generous price, just like a power-plant owner. Therefore, the money they earn should be understood similarly to how we understand the money paid to a power plant: as a fair (actually quite minimal) payment on a good supplied and as a return on a risky investment, not as a “subsidy.”

Some perspective on subsidies is in order. We all have to pay subsidies to the established energy industries in America—that is, the ones that have been spewing climate-destabilizing gases into the atmosphere for the past few centuries, making clean energy necessary in the first place.

Myers said at the August meeting that the solar industry is no longer an infant industry and should “stand on its own two feet.” He should tell that to the shareholders of the oil, gas, and coal corporations that continue to collect lavish public subsidies in the form of century-old tax breaks, to the tune of about $20 billion a year, with a fifth of that going to coal and 80 percent going to natural gas and crude oil, according to the Environmental and Energy Study Institute.

In fact, he might do well to remind himself once in a while about his own stated opposition to public subsidies for mature energy industries. In January, he voted for an “extension line allowance” for Southwest Gas, which imposes increased fees on existing customers to pay for a new natural-gas line, according to a report by 12 News. He justified that decision by pointing to the status quo, calling the deal “similar to line extension agreements virtually all utilities have.”

You may be wondering what that has to do with his principled opposition to subsidizing mature industries, which should “stand on [their] own two feet.” If so, we can’t help you there. Elected officials are expected to change the status quo to align it with their stated principles, not surrender to it with a shrug.

Let’s turn back to the issue at hand, the upcoming meeting. There is essentially zero chance that the commission will immediately act on Myers’ idea and cut the buyback rate by more than 10 percent on Oct.

11, in contravention of the 2017 agreement. But we have to acknowledge that by reopening the discussion that was supposedly resolved in 2017, the commission is embarking on a path that could take Arizona backwards, not forwards, in the state’s journey toward clean energy.

Berechet sees the potential for changes affecting not just prospective new investors in solar but also current system owners, ones who “locked in” their export rates by going solar before one of the commission’s yearly deadlines.

“There’s a slight chance that the deal in place for current system owners could be taken away,” Berechet said. “The whole thing could be wiped clean with a new program. The precedent could be overturned and their investments could completely go down the drain.”

The newly aggressive stance by the state’s anti-solar forces, as signaled by Myers’ proposal, raises tricky questions of strategy for green-energy advocates. If prosolar Arizonans try to counter the solar-suppression strategy with a mirror image, going on the offense by arguing that compensation for exported solar should be higher, it could be taken as support for renegotiating the prior deal, possibly assuring a process that could end up squelching future development of solar energy in Arizona. Potentially at stake is not only changing the rules for homeowners who want to add solar to homes going forward, but also for the over 100,000 Arizona homeowners who have already installed solar and were promised to be grandfathered in under certain rules.

“The jury’s out at this point about what we should do,” Berechet said. “Last meeting, we thought we would go there and would fight dropping the full ten percent. Essentially, Myers flipped it on us, and then we were begging for the ten percent.”

“It feels as if they changed the rules, as if they’ve moved the goal posts,” he added.

For solar-system owners, prospective owners, and supporters of the green-energy transition, the best approach is perhaps more simple and straightforward. “I think they should show up, and they should speak out about their investment in solar and what the actual value of solar is,” Berechet said.

CITY OF PHOENIX INDIGENOUS PEOPLES’ DAY HOLIDAY NOTICE

City of Phoenix offices will be closed Monday, Oct. 9, in observance of the Indigenous Peoples' Day holiday. Here's how some city services are affected:

Solid Waste Collection: Curbside trash and recycling schedules remain unchanged on Monday, Oct. 9, with no schedule changes on the days following the holiday, either. Collection will happen as regularly scheduled, even on Indigenous Peoples' Day itself.

Library: 16 of Phoenix Public Library's 17 locations will be closed Monday, Oct. 9, in observance of Indigenous Peoples' Day holiday; South Mountain Community Library will remain open. All Phoenix Public Library book drops and digital/eresources are available 24/7. Visit phoenixpubliclibrary.org for more details.

Parking Meters: All parking meters are enforced 8 a.m. to 10 p.m. daily, including weekends and holidays.

ANTHEM'S GO GREEN EVENT: A COMPREHENSIVE RECYCLING INITIATIVE FOR RESIDENTS

On Saturday, Oct. 21, from 8 a.m. to 11 a.m., Anthem Community Park’s lower parking lot at 41703 N. Gavilan Peak Pkwy. is set to transform into a hub for eco-conscious residents. The Anthem Community Council, in collaboration with Republic Services, ProShred, MCSO, and other partners, is organizing the Go Green event, offering locals a chance to responsibly dispose of a vast array of items.

To participate, residents need to be in the queue by 10:45 a.m. and should access the lot exclusively from Freedom Way to Whitman Drive. The event caters only to Anthem’s residential community, and participants should bring proof of residency. No commercial vehicles, U-Hauls, oversized vehicles, or RVs are allowed.

The comprehensive recycling stations include:

• MCSO for medication disposals, excluding medical sharps.

• St. Vincent de Paul for donations like non-perishable foods, clothing, toys, and school supplies.

• Republic Services for large household items and appliances.

• Westech Recyclers for a wide range of electronics.

• Safety Kleen for paint and household hazardous waste.

• Lighting Resources LLC for lighting elements and batteries.

• Republic Services for cardboard recycling.

• ProShred for secure document shredding, limited to five banker-sized boxes per car.

However, some items won't be accepted, including tires, medical sharps, and items containing Freon.

ANIMAL CRUELTY CODE BANS CHAINS AND REQUIRES ADEQUATE SHELTER

The Phoenix City Council recently passed an update to the city’s Animal Cruelty Ordinance. This update is the result of a review by city staff of the ordinance with input from animal welfare organizations, and several city departments.

Of the changes made, two are important to note. Updates were made to the definition of adequate shelter and the types of restraints a dog owner can use.

Chains have been outlawed as an option for tethering a dog.

The first major change to the Animal Cruelty Ordinance was to change the definition of adequate shelter. The exact verbiage of Ordinance 8-3.K.8 now reads: Adequate shelter means any natural or artificial cover accessible to an animal throughout the year, which is structurally sound, maintained in good repair to protect the animal from injury, and of sufficient size to permit the animal to enter, stand, turn around and lie down in a natural manner. Adequate shelter must protect the animal from extreme weather conditions, have adequate ventilation and drainage, and maintained in a manner which minimizes the risk of disease, infestations, or parasites.

The second major change to the Animal Cruelty Ordinance was to ban animal owners from using chains to tether their animals. Owners who do use chains can now be cited under Unlawful Restraint of Dog 8-3.08.A.5. The exact verbiage of the new ordinance reads: Restraint means a rope, tether, leash, cable, or other device other than a chain that attaches a dog to a stationary object or trolley system.

Arizona’s Motorcycle Safety Gets a Boost

THE SAFETY AND TRAINING OF ARIZONA’S MOTORCYCLISTS JUST GOT A SIGNIFICANT LIFT. The Arizona Motorcycle Safety and Awareness Foundation (AMSAF) recently celebrated the acquisition of a $100,000 grant from the Arizona Governor’s Office of Highway Safety (AZGOHS). This grant accentuates AZGOHS’s commitment to AMSAF’s objective: to elevate motorcycle awareness and consequently reduce rider fatalities and injuries.

According to Mick Degn, AMSAF’s executive director, the emphasis is on continuity. “Our enthusiasm about awarding scholarships for educating both new and ongoing riders remains steadfast,” he notes. Degn also takes a moment to acknowledge AZGOHS director Jesse Torrez, expressing gratitude for his unwavering support in this shared vision of motorbike safety in the state.

To paint a broader picture, this scholarship initiative isn’t AMSAF’s maiden voyage. They’ve been at this for a while, having provided an impressive tally of over 5,000 scholarships in Arizona geared toward rider education. But they’re not resting on their laurels. The grant will facilitate:

• Investigations pinpointing perilous intersections and road patches notorious for motorcycle mishaps.

It’s about making rider education accessible. An elementary rider course in Arizona can burden an individual with up to a staggering $350. But with the AMSAF scholarship, only a modest $100 nonrefundable co-pay is required. Gravity got you down? Explore ways to overcome it by building and testing an anti-gravity device. Earth’s gravity is what keeps us on the ground and what causes objects to fall. Inertia, or Newton’s First Law of Motion, states that objects at rest tend to

stay at rest and objects in motion tend to stay in motion (unless acted on by an outside force). Centripetal forces are any forces (gravitational, electrical/atomic, or tension) that move inward, toward the fixed center of the circular motion. In this activity, the string attached to the cup creates a centripetal force and

when the circular motion of the cup moves faster than the horizontal motion (inertia) of the water/objects. As a result, the water/objects stay in the cup.

SUPPLIES

• A 9 oz. paper or plastic cup

• One (1) sharpened pencil

• One to five (1-5) pennies or marbles

• Water

• Two 2-ft. long pieces of string

HOW TO

1. Using the pencil, punch one hole in the cup ½ inch below the rim.

2. Punch a second hole on the opposite side of the cup ½ inch below the rim.

3. Thread one piece of string through each hole and tie them off.

4. Place pennies, marbles, or water in the cup.

5. Investigate how you can prevent the materials from falling out of the cup when upside down.

Repeat steps four through five with pennies, marbles, and water.

GUIDING QUESTIONS

1. What direction does gravity point?

2. What is inertia?

3. What things resist the force of gravity by moving in the opposite direction?

4. How can you prevent gravity from making the water spill out of the cup when it is turned upside down without placing your hand over the top of the cup?

“Gifted instructional strategies benefit most learners,” says Las Brisas Elementary School Principal Mara Kurasch. “Las Brisas brings those instructional practices into classrooms for all students to benefit.”

The only school in the Deer Valley Unified School District that offers a full continuum of gifted and talented services, all students can access various services, including math acceleration, pull-out enrichment, and gifted homeroom placement. They also have access to STEAM, PE, music, and art through special-area rotations.

The Gifted Academy begins with the Las Brisas Bright Beginnings Program, serving gifted students from preschool through second grade. Second graders are re-assessed at the end of the year to determine what gifted programming they qualify for in third grade and beyond.

Third through sixth-grade students who qualify can enroll in the Renaissance Highly Gifted and Global Studies Program. Global cultures and languages are the focus of this self-contained program. “Gifted education is so much more than just making students teacher aides or giving them extra work,” says Jeneil Killman, gifted specialist at Las Brisas. “We need a place for these students to grow, learn, engage, and be encouraged to reach their potential no matter the setting.”

DVUSD’s Language Immersion Programs

In the District’s Language Immersion Programs, students receive instruction for half their day in English and the other half in Mandarin or Spanish, depending in which program they’re enrolled. Three DVUSD K-8 schools offer this model. Gavilan Peak and Desert Sage provide Mandarin, beginning in kindergarten and first grade, and Union Park offers Spanish. Gavilan Peak is Arizona's oldest and longest continually running Mandarin immersion program. These schools also have traditional kindergarten pathways.

Hillcrest Middle School has Mandarin instruction for up to 50% of students' school day. Boulder Creek and Sandra Day O'Connor High School students can take advanced modern world language courses, of which Mandarin is one.

“Bilingualism is a powerful skill that enhances cognitive abilities and opens doors to numerous career opportunities in today's globalized world,” says Juliet Ma, Kindergarten Mandarin immersion teacher at Gavilan Peak.

Students in these programs recently won state and national language competitions, including first place, third place, and honorable mention in the national Chinese speech contest. In a statewide speech competition, students won first, second, and third place in the high school division. In the elementary division, students won second and third place.

“It gives me great pride to witness the growth of my kindergarten students preparing and participating in Mandarin speech contests,” says Ma.

Like the Mandarin immersion program, the Spanish immersion program at DVUSD’s Union Park School gives students a half day in English for reading, writing, and social studies and the other half in Spanish language arts, math, and science.

“My favorite part of teaching Spanish to our youngest students is the opportunity to provide the introduction and connection to other parts of our world,” says Jennifer Olson, kindergarten Spanish immersion teacher at Union Park.

Whether students are in the Mandarin or Spanish immersion program, the teachers meet their unique way of learning and capabilities.

“Our kindergarten vision on both sides of the program incorporates a variety of teaching strategies to accommodate different learning styles and abilities,” says Laura Tapp, kindergarten English teacher at Galivan Peak.

Aspire, Deer Valley’s Online Academy

At Deer Valley's fully accredited online school for kindergarten through 12th-grade students, launched at the beginning of the 2021-22 school year, kids can access an e-learning environment. Since 2007, DVUSD has offered online support to high school students.

“Online education provides students with an opportunity to engage in a flexible learning

environment that meets the needs of their family,” says DVUSD’s Director for Online and Virtual Learning Juliet Amara.

Aspire offers full- and part-time high school students advanced placement courses, dual enrollment, career and technical education internships, and clubs.

“We continue to grow as a school by offering highrigor, post-secondary opportunities such as dualcredit courses in collaboration with Rio Salado,” says Amara.

Kindergarten through sixth-grade students participate in teacher-led, virtual instruction in real time. Seventh and eighth graders learn using a combination of teacher-led instruction and districtaligned curriculum. Ninth through 12th-grade students learn through a district-aligned curriculum, with open lab access to teachers during virtual and in-person office hours.

Besides traditional course offerings, the school offers elementary students music, art, physical education, and technology. Middle schoolers benefit from a variety of electives and exploratory classes.

Beware of Bites Understanding dog liability in North Phoenix.

In the North Phoenix area many folks have dogs. I see many different types of dogs as people are out for walks in my neighborhood. During the summer, the number of people walking their dogs goes down some due to the heat.

As we move closer to the cooler months, we will all likely see many people back outside enjoying the nice weather and that also means more people out walking their dogs. Most dog owners are responsible but sometimes it is someone else who can cause you problems despite how responsible you are.

In Arizona, dog bites are dealt with on a strict scrutiny basis. Strict liability is applied if your dog bites someone or someone else’s dog. According to the law, there is no question as to whose fault it may have been. To put it more plainly, if your dog bites someone, you will be on the hook for any damages that result from that dog bite.

So, when you stop to let that stranger pet your dog, just know that if your dog decides it doesn’t like that stranger’s hand, you may end up getting to know that stranger a whole lot more than you may have ever wanted. In the event there are medical bills or missed work, you will be on the hook. If the person plays guitar for a living and can no longer play due to torn tendons or a deformed hand, then you may be on the hook for a lifetime of income.

Arizona Revised Statute § 11-1020 states, “Injury to any person or damage to any property by a dog while at large shall be the full responsibility of the dog owner or person or persons responsible for the dog when such damages were inflicted.” It stands to reason that if you allow your dog to run around unattended or without a leash and it bites someone then you are going to be responsible as that dog’s owner.

Arizona goes further to address dogs not at large in A.R.S. § 11-1025, “The owner of a dog that bites a person when the person is in or on a public place or lawfully in or on a private place, including the

property of the owner of the dog, is liable for damages suffered by the person bitten.”

Some states have a “one free bite” rule. The idea behind “one free bite” is that the owner had no notice that his/ her dog was a dog that would bite someone, so the first time they bite, the owner is then on notice. Arizona has “no free bites.” In Arizona, if your dog bites, then you are liable.

Dog bites can cause a great deal of damage and in some cases death. If you have been bitten by a dog, you should likely seek treatment right away. Then you will want to contact an experienced attorney to make sure that you are compensated for damages resulting from that bite.

Charity Valley Businesses Unite for the 14th Annual Bikers for Boobies AZ Motorcycle Event Against Breast Cancer

Bikers for Boobies AZ, the renowned Arizona-based charity, has revved up its engines for the 14th year in a row to combat breast cancer. Teaming up with prominent local businesses and bands, the charity invites community members to be part of this exceptional cause.

The 14th Annual motorcycle event, scheduled for Saturday, Oct. 14, is backed by Arizona Bike Week, J&P Cycles Scottsdale, Chuck Franklin Law, and over 20 Valley businesses.

“It is hard to believe that we have been doing this for 14 years,” says Bikers for Boobies AZ President Shelley Brorsen “It’s a great feeling knowing that together, we are raising awareness and fighting all types of cancer with the emphasis on breast

cancer. We’re hoping to raise more funding and awareness through this event.”

Kicking off at J&P Cycles, 8606 E. Shea Blvd., in Scottsdale, the day's journey will conclude with a grand parking lot party at the Dirty Dogg Saloon, 10409 N. Scottsdale Rd. Attendees can look forward to live performances from local musical talents, an array of raffle prizes, a silent auction, and delectable bites from the popular Pizza Butcher food truck.

Bikers for Boobies AZ's commendable legacy since its inception in 2009 includes providing over 1,000 women with free mammograms. Through its grants program, the charity has also distributed more than $200,000 for survival and medical grants. Furthermore, the charity has generously donated between $1,000 to $10,000 to various organizations aiding families and individuals grappling with

cancer. “We are so grateful,” says Treasurer Laura Rasmussen.

In the past, Bikers for Boobies has contributed over $250,000 to charities such as The Singletons, Casting for Recovery, Don’t be a Chump–Check for a Lump, Forth & Bubble, The Joy Bus, and many others. This year, with renewed vigor and a broader partnership with local

resources, the charity is poised to make an even bigger impact.

TURF PARADISE RACETRACK IN NORTH PHOENIX TO CLOSE AFTER NEARLY SEVEN DECADES

Phoenix’s iconic Turf Paradise horse racetrack, which has been in operation for close to 70 years, is preparing to shut down. Via its Facebook page on September 18, the track made the announcement of halting live racing and simulcasting beginning October 1.

Jerry Simms, the present owner who’s managed the track for 23 years, revealed his decision to retire and spend more quality time with his kin.

Additionally, Turf Paradise operates 37 off-track betting locations across Arizona, which broadcast live and simulcast races for wagering purposes. However, given the discontinuation of live races and the impending end of their contract with the Arizona Horsemen Benevolent and Protective Association on September 30, these off-track sites are also slated to cease operations on October 1.

Greenlight Communities has sold its Cabana Happy Valley apartment complex in Phoenix to Ideal Capital Group for a deal valued at $79.2 million. The per-unit price was approximately $271,404.

Constructed in 2023 and spanning nine acres, the community houses 292 apartments. Each unit is equipped with features like eight-foothigh keyless entrances, European-inspired wood cabinetry, advanced thermostats, and standard washers and dryers. For residents, the property offers a range of amenities, including a two-story clubhouse, a modern fitness center, a comfortable lounge, shared coworking spaces, a pool, vehicle charging stations, and bike storage. Scottsdale’s Harvard Investments Inc. has finalized the sale of its FirstStreet Happy Valley rental community in north Phoenix. The 212-unit property was acquired by Omaha-based Spruce Capital Group for a sum of $87.85 million, averaging out to $414,000 per unit. The property is situated at 1717 W. Happy Valley Rd.

Though Harvard has a history of developing vast communities, it ventured into the build-to-rent sector three years back, birthing the brand FirstStreet. The Happy Valley community, set across 18 acres, was their debut in this category, finished two years prior. The community, boasting an impressive 94% leasing rate, offers rental units with an average size of 1,904 square feet. Residents enjoy a mix of attached and detached garages, and a select set of units even provide soundproofed garage-top residences.

Among the community’s features are a dogfriendly park and wash zone, a luxurious pool, a spa, a state-of-the-art fitness center, and a clubhouse. Its location offers the added advantage of being a short stroll away from the Shops at Norterra.

The superb cast sells it all, from leads Rachel Sennott and Ayo Edebiri to even the minor background characters. Emma Seligman's direction is simpler compared to her debut, "Shiva Baby," but it complements the tone of the film. The visuals and tropes of a typical comedy (paired with a familiar soundtrack) contrast sharply with the Mad Max-esque actions on screen. It's a truly unique and entertaining piece.
