TherehavebeenmanypresentationsofFrenchadministrativelawtoan English-speakingaudiencesinceDiceywrotemorethan 135 yearsago.The mostcomprehensivecoveragewaslastwrittenmorethantwentyyearsago. Oneoftheco-authorswasanauthorofthateditionofBrownandBell, French AdministrativeLaw (5thedition).Alothaschangedinthattime,notleastthe importanceoftheEuropeandimensioninFrenchlaw(anditsdeclinein Englishlaw).ItseemedbesttobothofthepresentauthorstostartacontemporarypresentationofFrenchadministrativelawfromacleanslate.
Asweexplainin Chapter 1,theimportanceofFrenchconstitutionallaw, EuropeanUnionlawandtheEuropeanConventiononHumanRightshas reshapedFrenchadministrativelawinthepastfiftyyears.Intheirturn,French administrativelawyershavealsocontributedtoshapingtheseinfluential sourcesoflaw.Frenchadministrativelawislessaself-standingbranchof lawthanitoncewas.
TheaimofthisworkistoprovideanintroductiontoFrenchadministrative law,soitisnecessarilylimitedinlength.Although Legifrance andtheConseil d’Etatwebsitesprovidesometranslationsoflegislationandcaselaw,theyare limited.Inordertogofurther,thereaderreallydoeshavetomakeuseof French-languagesources,manyofwhichareavailableelectronically.
Wehaveworkedtogetheronthedifferentchapters.Ouraimhasbeento blendFrenchrigour,systemandprinciplewithEnglishattentiontocasesand empiricism.Wehopewehavetakenthebestofbothpedagogicaltraditions andmadethemintoacoherentwhole.Wealsohopethatthiscollaboration willencouragesimilarcollaborationsbetweencolleaguesfromdifferentjurisdictionsinthefuture.
