Sale Season Is Upon Us Tyler Humphrey-Director of Marketing and Performance Programs
I
t is hard to believe that I am sitting here writing my third “August Issue Article”. Time flies when you’re having fun! The August issue is a sure sign that the fall sale season is upon us and it is time to get going with preparations to market your cattle. Every year I field a variety of questions regarding which method is best to sell cattle. The answer is there is no right answer. Times have changed and there are now multiple ways to effectively sell your cattle. I will run down several of the popular methods and briefly outline how to prepare. Production Sale This is a great option if you have 40+ head to sell. A production sale involves print advertising in several publications to notify the buying public that you will be having a sale as well as a catalog that must be printed and mailed. With most of the buyers today being “tech savvy” I would also suggest an e-blast to tie this all together. The task of hosting a production sale is a large one, so if you’re not comfortable with all of the marketing it may be in your best interest to hire a sale management firm. Consignment Sale This type of sale is nice for the smaller producer that just has a couple of head to market. All of
the same marketing strategies of production sales apply, but it is handled by the hosting parties and all of the responsibility does not fall on your shoulders. A great example of a consignment sale would be the Chianina National Sale in Louisville or the Hybrid Advantage Sale in Denver. Both of these events are hosted by the ACA and are a great outlet to get your product in front of large crowds. Online Sale This method of selling cattle has probably grown the most rapidly in the last five years. If you are looking to sell 10-30 head this is a nice option. Commission rates are somewhat lower than a live auction and the deadlines for pictures and info are a lot more flexible. A proper marketing strategy for an online sale would include print advertising and e-blasts. Just because the sale is listed online doesn’t mean advertising isn’t important. There are many great online sale companies out there, so if you’re in the market to have an online sale do your homework and see which one best fits you. Private Treaty/Pasture Bid Off This is one of the simpler ways to market your cattle. As always, we recommend running an ad or two to let everyone know when you will be bidding off your cattle. Have the
calves available for viewing a couple of weeks before the bid off date and make sure there are plenty of data sheets available for potential buyers that include pedigree, birthdate and other important info. This is a little more time consuming than an online sale but can be just as effective. It was great to see everyone in Grand Island at such a well ran event. I would like to personally thank all of the folks that were in charge of the show as it was a first class event. I hope to see all of you at the various state fairs I will be attending across the Midwest. Remember the upcoming deadline to enter cattle for the NAILE is Sept. 20. A Word From Our Board Ed Miller – ACA Board of Directors, Chairman
C
ongratulations to all involved in hosting the 2013 National Junior Heifer Show in Nebraska. All I can say is WOW, what an event hosted in by far and away the very best facility in the country. Furthermore, congratulations to all of the exhibitors. It may not seem like much now, but the memories you made and new friends are what makes these events so satisfying. Although you compete for awards in a competitive manner, the friends you make will provide years of memories that will outlast the ribbons and trophies. Thank you to all of the American Junior Chianina Association (AJCA) board members for your hard work and professionalism during this event. I know it was a long hard week and your efforts were greatly appreciated. The American Chianina Association (ACA) board of directors has nothing but praise and respect for you to pull off such a great event. A big congrats to Malina Lindstrom, Nebraska, on your all-around win. It takes a lot of work and dedication to achieve such an award. It will be a lasting memory that you should cherish. Since its inception, the ACA has had the opportunity to work with the most unique breed of cattle in the world. Even better, the ACA has allowed its breeders to match their genetics to their environment and marketing plan by allowing for different levels of Chianina blood in their cattle. In turn, this has allowed breeders to create some of the very best performance,

carcass and show cattle in the beef industry. It doesn’t matter if it’s on the rail or in the showring, the Chianina influenced genetics are unbeatable. From the numerous wins in carcass contests by the Danner family to the Willow Oak Chiangus cattle being some of the most profitable feeding cattle in the country and countless wins in junior steer competitions nationwide, these genetics work in all facets of the industry. The old sayings that they are the black gold of the industry or the best kept secret and now hybrid before hybrid was cool all hit home. What hits home the most is that we have failed to take the best genetics in the world to the forefront of the industry. It is kind of like having the fastest car in the race but running mid pack because of not having your alignment correct. Although many routes of marketing have been taken, maybe it’s time for a new alignment at the ACA. Maybe it is time for a sound business approach to lead the ACA into the future. Maybe it’s time for every member to look at their program and start to think of new ways to market theses genetics. Although there have been changes at the ACA, the ACA board is committed to its members and their programs. I urge every one of you to step forward and share new ideas that can be incorporated into the success of these genetics. Expect many changes and a new look to the ACA in the near future. The beef industry has a bright future, as does the ACA. ©ACA

A letter from the board...
I
t never seems to fail, after Junior Nationals you better not blink because you just might miss the rest of summer. With that being said I hope you all are enjoying what little is left of your summer! I hope everyone was able to enjoy themselves at the Junior National Heifer Show in Grand Island. Personally getting to see all those familiar faces and spending a week with people from across the country who all share a common interest in cattle is the highlight of my summer and is an experience that I think goes unmatched. But putting on such a great show isn’t possible without the help from many people behind the scenes. So on behalf of the Junior Board of Directors I would like send out a sincere and heartfelt “thankyou” to each and every one of you. Also to anyone involved from the state of Nebraska we cannot thank you enough for allowing us to use your phenomenal facilities and going above and beyond to make such a demanding event run successfully and smoothly. Your efforts were not overlooked and will certainly be remembered. Unfortunately with the closing of the week we gained some unpleasant news, our junior advisor Jaclyn Upperman would be moving on without us. If you didn’t get the pleasure of meeting Jaclyn during her time with the Chi Association it is truly a shame. Without her

guidance over the past year many of the accomplishments we have made would not have been possible. T
echnology…how far has it come? I wasn’t able to be in Grand Island, but with the help of technology, I felt like I was there every day. Facebook was a big factor in being able to see pictures from day to day, with friends and the ACA posting pictures throughout the week. Focus Marketing Group and Legacy Livestock Imaging helped capture the moments from opening ceremonies to show day. Come show day, I was able to watch both shows on liveauctions.tv. Even though I wasn’t physically there, I was able to capture all of the moments through the help of technology. I hope everyone had a safe trip home from Grand Island. The Nebraska crew did a tremendous job! Another successful Junior National can be marked down in the books. Juniors, please remember to thank everyone who helped you get to Grand Island. It is great friends and family who make it all possible. Congratulations to our new queen, Jessica Harsh from Ohio. I am sure she will represent our breed well. Congratulations to our scholarship winners Morgan Tomson from Indiana and Allison McGlothlin from Oklahoma. I wish you all the best of luck. Now that Junior Nationals are over, local county fairs and state fairs begin. Before we know it, Louisville will be here. I hope all of the Ladies are planning on attending the “Come As You Are” luncheon which
will be held on Tuesday, November 19 at 11:30 a.m. This will be our annual meeting and membership drive, along with elections. We need new and fresh ideas, so if you know of anyone, please invite them to our luncheon. You won’t want to miss out on the OH SO FAMOUS “Kentucky Silk Pie” We won’t be long, so please plan to attend for a fun time had by all!!! Please remember to bring a small gift for our gift exchange. Don’t forget about our Silent Auction!! This is our only fundraiser during the year, so dig deep for those unique items. Last year was outstanding with generous items donated. The proceeds go towards funding our queen and other activities throughout the year. Also, in this issue are the guidelines for Chi Lady of the Year. We wanted to give more women the opportunity to be nominated even if they cannot make it to Louisville. The Chi Lady of the Year is a lady who has been active in Chi Cattle, works with the youth and is involved in her community. Please remember whoever is nominated does not have to be present at Louisville. Good luck to everyone at State Fair and I will see you all in a few months in Louisville.

Board Meeting Minutes: June 2012 ACA Board of Directors Meeting Minutes The ACA board of directors met on Friday, April 13, 2013, at the ACA Headquarters, Platte City, MO. The meeting was called to order by President Miller at 9:27 a.m. CDT. ACA board members present included, Culp, Esch, Higgins. Johnson, Michel, Miller, Pittman, Sheets, Shields and Stoppel. Each board member gave an update on calving, weather, field and pasture conditions and cattle sale results in his location. Schaefer and Holt were absent. Officer Reports:Secretary’s Report: Culp presented printed copies of the minutes from the Fall Board meeting held in Platte City on October 27 & 28, 2012, the Board of Directors meeting held at the NAILE on November 13, 2012, and the Annual Membership meeting, held at the NAILE on November 13, 2012. Shields moved to accept all three sets of minutes as printed, seconded by Stoppel. Motion carried. Treasurer’s Report: Esch presented the financial statement. The 201213 fiscal year is showing a year-todate net profit of $4,780. Culp moved to accept the Treasurer’s Report, seconded by Pittman. Motion carried.
ACA Foundation Report: The Foundation Board has met twice; at the 2012 NJHS and at the 2012 NAILE. Comer presented the ACF Financial Report, which was prepared by Karlin & Long, LLC, CPA. Current assets in the Platte Valley Bank total $45,091.29 excluding the Italian Fullblood semen that was sold in the recent fundraiser. A question regarding the amount of financial support that the Foundation was going to contribute in support of the National Junior Heifer Show. The pertinent section of the Foundation meeting minutes from November 13, 2012 read as follows: “The board decided to give an allotted amount for the facilities at the NJHS. Steve Melroe moved that the Foundation allows up to $10,000 with documentation of facility expenses for the 2013 NJHS, seconded by Ken Culp, III. Motion carried unanimously.” Culp made the point that the ACA has traditionally earmarked the first $12,500 or half of the total amount of the national fundraiser, whichever is greater, in support of the following year’s Junior National. Culp asked the question: “Since the Foundation is contributing $10,000 for the 2013 Junior National, where is the

additional $2,500 going to come from?” After considerable discussion, Miller suggested that this topic be tabled until new businesss. Johnson moved to accept the financial report of the Foundation, seconded by Pittman. Motion carried. The meeting was recessed at 10:10 a.m. for the Performance and Genetic Abnormality Committee to convene a conference call with Dr. Weaber. The meeting reconvened at 10:58 a.m. Committee Reports: Performance & Genetic Abnormality: Miller recapped the meeting with Dr. Weaber. Dr. Weaber reported that the weaning window had been modified to a span of 120 to 255 days; however, the range for each contemporary group is a 60-day window. Concern was expressed that data is being submitted directly to the ASA. The CEO and Performance Committee and Dr. Weaber will follow up. Budget Committee: The yearto-date budget was distributed. The fiscal year, which ends April 30, 2013, is projected to be closed “in the black.” The staff was directed to create a non-interest bearing custodial sales account to be used for managing sales. A second sale operating account (to be used for sale expenses) must also be created. A third non-interest bearing custodial sales account must be created for genetic lots. Sale income cannot be co-mingled with funds in the general fund. Michel moved that the ACA immediately create three necessary sale accounts with two staff
members having signatory authority. Seconded by Culp. Motion carried unanimously. Building & Grounds: Esch reported that the building is in good shape. There is still a little bit of movement (settling) which is normal. Two new furnaces and one air conditioning unit have been replaced. The windows will need to be resealed in the next two or three years. The new office suite must be rented. Youth Programs: Pittman will be the new chairman. The big concern of the Nebraska committee hosting the 2013 Junior National committee is the funding level from the ACA. Alan Miller, Scott Greiner, and Barry Nowatsky were submitted by the AHA as junior show judges for the NAILE. Jaclyn Upperman joined the meeting and gave an update for the 2013 Junior National Heifer Show. The show will be held June 15 – 21 in Grand Island, NE. The cost for the facility is $8,000. Entry forms have been mailed and are also posted on the AJCA and the ACA websites. The entry deadline is May 1 for $45; entries made May 2 – 15 are $55. Ten meals, plus the banquet, will be provided. Eight meal sponsors are still be solicited. The all-around winner will receive a one year lease on a 20’ stock trailer from Cimarron Trailers, a $1000 scholarship and a Mini i-Pad. Sullivans and Weavers are each giving $5000. SureChamp and Showmaster are also major sponsors. Dr. Clint Rusk is judging. The showmanship judge is confirmed.
The meeting recessed at 12:00 noon for lunch. The meeting reconvened at 1:16 p.m. Promotion, Benefits & Marketing: Culp presented the proposal for the “ACA Cooperative Advertising Guidelines” as well as the proposal for the “Chiangus Select Trait Leader Designation;” both of which had been previously presented. The Cooperative Advertising Guidelines proposal had been referred to the ACA Foundation Board of Directors and the Chiangus Select Trait Leader Designation to the Performance and Genetic Abnormality Committee. General discussion followed on the Trait Leader Designation regarding the minimum percentage, how many generations to include and whether or not to include all composites. Miller will run a search of the database and report back on Saturday in order to provide additional information prior to making a decision. Higgins moved that the ACA Cooperative Advertising Guidelines Proposal be addressed at a joint meeting of the ACA and ACF Boards at the 2013 Junior National. Seconded by Michel. Motion carried. Recognition Committee: All recommendations for breeder of the year as well as nominations for nominees for awards should be made by the June meeting. Jennifer ran a membership list and determined that there are nine current members who joined during 1972. These 40th Anniversary members include: Ned Ellis, Circle E

A discussion was held regarding the All-American designation. What should designate an All-American Point Show? The consensus was to leave the guidelines alone. The meeting recessed at 2:02 p.m. The meeting reconvened at 2:19 p.m. Old Business: New AJCA Logo and Website: Upperman shared the new AJCA logo and website by passing around Higgins’ i-Pad. Comer distributed a variety of logo prototypes that EDJE developed for our use. The decision was made to create an ACA logo contest. Culp moved that Upperman and Humphrey develop and distribute an ACA logo contest, with entries due by June 14, 2013, with results presented at the June Board meeting. Seconded by Stoppel. Motion carried. MARC Data Update: Comer reported that MARC had requested a list of Top 50 bulls (according to registration numbers) along with their EPDs. MARC will select 20 to 25 for use on the next round of matings. 2014 is MARC’s anniversary and the Center has invited all breed associations to
hold a meeting there and tour the Center. The Board is very interested in accepting this invitation. Comer will follow up with MARC and determine whether the spring or fall board meeting would be the most conducive to a visit. Enhanced Chiangus Program: The “blueprint” for the program is still being developed by Comer and Dr. Weaber. New Business: NJHS 2013 and 2014: Upperman rejoined the meeting to discuss junior national locations. We have an invitation to participate in a joint Junior National from the Shorthorns and Maine Anjou Association in Kentucky. The dates are June 21 – 27, 2014. Estimated facility cost is $11,000 ($15/head) which includes bulk bedding in the barn. Higgins moved that the 2014 Junior National be held in Louisville on June 21 – 27, 2014. Seconded by Michel. Motion carried unanimously. Comer offered an internship to Jessica Beard, from Indiana, a student at Redlands College, from May 15 through June 30. NWSS Junior Heifer Show: Miller reported that Erin Dorsey from the NWSS had contacted him regarding hosting a junior heifer show. ACA will have to provide the premiums for three years, the show would be held on Monday following the Sunday Chi Sale in the Yards, dual registered cattle could show in multiple shows, arrival would be on Friday, dismissal Monday following the show. This could be a two

division show. Entry fee would be $30 to the NWSS; most associations charge an additional $30 per head to cover premiums. Fifty (50) entries are required but they would be willing to be flexible the first year. The Show & Sale Committee supports the creation of this show. Michel moved that an ACAsponsored Junior Chianina Heifer Show be held, and directs the staff to establish the entry fee structure and show parameters. Seconded by Pittman. Motion carried unanimously. Michel reported that the Show and Sale Committee requests that Jaclyn attend a variety of junior shows such as the Illinois, Indiana, Iowa, Kentucky, Ohio and Virginia Beef Expos, and the Nebraska Cattlemen’s Classic. The Board appreciates her energy and enthusiasm and hopes to capitalize upon her experience and grow the junior program. Miller shared that Upperman had suggested that each production sale might be asked to offer one lot or item that would be sold to benefit the upcoming junior national. The board is supportive of this suggestion. Chianina Connection: The fall issue targets commercial producers in the southeast region; the spring issue targets the western region. Humphrey suggested that rather than printing two Chianina Connections, we add a “Commercial Section” to a spring and fall issue of the ACJ and mail those issues to the commercial mailing list. Multiple options were suggested, including:
ACA updAtes Board Meeting Minutes continued. • Printing one Chianina Connection per year • Combining the information in the Chianina Connection with two issues of the ACJ. • Offering an electronic journal Pittman moved that the staff explore options for delivering the information currently printed in the Chianina Connection and report back at the June meeting. Seconded by Culp. Motion carried unanimously. Fullblood Promotion: Miller reported that an Iowa has five fullbloods to enter in the National Show and one will be consigned to the national sale. He wants to know if a fullblood division could be offered. Pittman moved that due to North American guidelines, fullbloods continue to show with the Chianina division at the NAILE. Seconded by Stoppel. Motion carried 8 to 1. Produce of Dam/Get of Sire Class: A respected and highly regarded breeder wrote a letter to the Board of Directors inquiring as to why foundation animals were ineligible for the Produce of Dam and Get of Sire classes. The Board acknowledges that the rules for these classes were not printed in the NAILE Premium Book. The rules will be written as follows: Cattle shown in the Produce of Dam class is open to progeny of Chianina dams; cattle shown in the Get of Sire class is open to progeny of Chianina sires. Seconded by Pittman. Motion carried.
The Cow-Calf class was clarified regarding the 6.25% rule. Cows born prior to January 1, 2012 are exempt from the 6.25% rule. The consensus of the board is that the bull and heifer calves must meet the 6.25% Chi blood requirement. Pittman moved that Cow-Calf Pairs become a separate division and not be eligible for the Grand Champion Female Division. Motion died for lack of a second. The meeting recessed at 4:25 p.m. The meeting reconvened at 4:36 p.m. ACA Judge’s List: No names were removed. Additions included: Shane Bedwell, CSU Cody Lauderman, Macomb, IL Jared Boyert, Blackhawk East Alan Miller, Gridley, IL Scott Bush, Britton, SD Stoppel moved that these five names be added to the ACA approved judge’s list. Seconded by Higgins. Motion carried. Higgins moved to add Chris Sankey, Bob May, Wayne Ohlrichs and Barb Ohlrichs. Seconded by Pittman. Motion carried. The board has selected judges for the upcoming major shows and are awaiting their responses. Sheets moved that the board go into executive session, seconded by Culp, motion carried. Executive session was convened at 5:14 p.m. Executive session adjourned at 6:52 p.m. The board meeting resumed at 8:43 a.m. on Saturday, April 13.
New Business: Select Trait Leader Designation: Culp presented the revised Select Trait Leader Designation. Proposal: Select Trait Leader Designation for each Composite Criteria: 2CA/CM,CH, CF or PCA, PCM, PCH or PCF designation • Minimum of 5 progeny with recorded weights (Minimum Accuracy = .70) • Top 20% of Active Sires for any specific trait o BW o CED o WW o YW o Milk o REA o % RP • Top 33% of Active Sires for WW and YW = Growth • Top 33% of Active Sires for BW and Milk = Maternal • Top 33% of Active Sires for REA and % RP = Carcass Chiangus/Chianina/Chimaine/ Chiford Select Trait Leader for the following traits; Birth Weight, Calving Ease, Weaning Weight, Yearling Weight, Milk, Rib Eye Area, Percent Retail Products, Growth, Maternal and Carcass. Additional traits may be added as they become available. Motion by Shields to accept the proposal, seconded by Higgins. Motion carried unanimously. These designations will be run twice each year; after the spring and fall data.

Funding for 2013 Jr. National: $12,500 will be given to the Nebraska group in support of the NJHS. The Chianina Foundation has already committed $10,000. The ACA Board will meet jointly with the ACF at the June meeting and request that the Foundation contribute an additional $2,500. If the Foundation is unwilling to do so, then the ACA Board will contribute the shortfall from its general fund.
National Junior Heifer Show Fundraiser: The proceeds from the fundraiser held in conjunction with the Jr. National will be ear-marked entirely for the 2014 Jr. National Heifer Show in Louisville and will be designated as the “Junior National Fundraiser.” Stan is directed to create a second account within the Foundation, specifically for Jr. National funding. Jaclyn’s energy, enthusiasm, expertise and rapport with youth should be utilized more widely by
the ACA. The board requests that Jaclyn represent the ACA at major beef expos with a youth show. Stoppel moved that the board go into executive session at 9:37 a.m. Seconded by Esch. Shields moved that executive session conclude at 9:57 a.m. Seconded by Johnson. Motion carried. Sheets moved to adjourn the meeting at 9:57 a.m. Seconded by Pittman. Motion carried.

Jessica HarsH, 19 of oHio Parents: David and Michele Harsh future Plans?: Right now, I am currently a Sophomore at Purdue University with a double major in Agriculture Economics Sales & Marketing and Agriculture Communications. After graduation, I plan on attending grad school and eventually starting my own livestock promotions business. What made you want to run for aJca Queen? I wanted to run for AJCA Queen because, as I round out serving on the junior board for my first term, I really enjoyed being able to interact with the youth. Now being the AJCA Queen, it gives me the opportunity to interact with them and their families from a different perspective.
Which national show is your favorite? Louisville is by far my favorite! What aspect of being queen are you looking forward to most? By having the title “AJCA Queen” most would think wearing the tiara would be at the top of my list. But for me it’s not quite number one. While it gives a new aspect to my wardrobe (and I won’t mind wearing it), the number one item at the top of my list is being able to work with the youth from a different leadership role both in and out of the ring. My goal as the 2013 queen, is to be a positive role model for all the showman within the breed and someone they feel they can talk to on a regular basis. Also, I want to be an advocate for our breed and promote it to others to add the “Hybrid-Advantage” to their herds at home.

What advice would you give to younger junior members just getting started in the aJca? Not getting involved at the national level until I was 15 made my path through the AJCA a little different than most. With that said, the best advice I can to ANY junior member is get started early!! Since my first junior nationals in 2010 at Springfield, IL, I have enjoyed every single experience with the Chianina Association. Along with getting involved early and being active, the next thing I want to stress to all the junior members is meet all the people you can, even if it is just a “hi!” to stranger, because these people you meet in the barns or waiting to give a speech or participate in showmanship are the ones that will help you so much in the future. Who knows your best friends may end up living 8 hours away like mine do!

2013 All-Around Winner: Malina Lindstrom Age: 13 State: Nebraska Parents: Nathan & Jeanette Lindstrom Future Plans: I plan to keep working hard to finish school and then pursue an ag degree in college. I also want to continue to show cattle, grow my own herd, and help on our family farming/ranching operation. what does it mean to you to be named the 2013 All-Around Champion? Winning the AllAround is the coolest thing that’s ever happened to me! It’s a huge honor, especially when I think of all the great kids I got to compete with during the week. I am really thankful to the sponsors for the incredible prizes.
which national show is your favorite? I love Denver, but the NJHS is probably my favorite because of all the contests and activities. how many years have you attended the AJCA National Junior heifer Shows? 3 years what are your favorite aspects of being a part of the AJCA and attending various NJhS? I’ve met so many great people and look forward to spending the week with our “show family.” It’s also a chance for me to learn more about the cattle industry and our breed and practice my skills in and out of the ring.
what is the key to excelling at Junior Nationals and be able to compete for the All-Around Champion title? Of course it’s important to do your homework in getting your calves ready; but then, once you’re there, get involved in everything. Try all the contests and just do your best and have fun. It seems to get a little bit easier each time, and I learn something new every year.

I would encourage younger junior members to get involved in contests. That’s where you meet so many people from all over the nation and build relationshiops with them. Protect Your Brand: Trademarks for Beef Cattle Operations Cari Rincker, Esq.
B
rand recognition can be a valuable asset for beef cattle operations. Obtaining a registered trademark gives the owner enforcement rights against others who use confusingly similar marks in a particular class of goods or services. Cattlemen and women should consider taking this step towards protecting its intellectual property, which can oftentimes be an invaluable asset to a livestock operation. Overview Put simply, a trademark is the identifying mark of a beef cattle operation for consumers or other members of the agriculture community in connection with particular goods (e.g., beef, show cattle supplies) or services (e.g., consulting services, cattle photography). A trademark can take place in many forms including words (i.e., a standard character or stylized wordmark) (“Rincker Beef ”) or a symbol/logo (i.e., a design mark). A trademark can only be registered with the U.S. Patent and Trademark Office (“USPTO”) if the goods or services are used in interstate commerce (i.e., across state lines). If the livestock good or service is only used with intrastate commerce (i.e., within a state boundary) then a trademark may be sought for at the
state level. For example, if you an Illinois cattle producer and out-ofstate buyers have purchased calves at your annual production sale, then your beef operation has entered interstate commerce. Alternatively, if you are a beef blogger in Nebraska and sell advertisements on your blog to vendors throughout the country, then you are doing business in interstate commerce. If a beef cattle operation is not currently using the mark in interstate commerce but plans to use it in the future, then an “intent to use” trademark application can be filed. Distinctiveness Additionally, a trademark must be distinctive in order to be registered. The best trademarks are arbitrary or fanciful – such as Kraft® cheese, Aunt Jemima® or Nike® -- and don’t have a separate meaning other than the brand of goods it represents. Suggestive marks include language regarding the goods or services provides, such as Agvance®, eSaleBarn®, or Breed Lautner®. Marks that are considered “merely descriptive” are not typically registered unless distinctiveness can be gained over time (e.g., AgChat because it is used as a popular hashtag on Twitter among the agriculture community). Last names (surnames) are also considered descriptive. Descriptive
brands (“Rincker Cattle Co.”) can be put on the USPTO’s secondary registery until the necessary distinctiveness is achieved; then, the mark will be put on the USPTO’s principal registry so long as the mark has been used exclusively, and continuously for 5 years. In such cases, the applicant can still use the ® mark and have certain trademark enforcement rights. Generic marks can never be trademarked (“Farm” or “agriculture”). However, if a brand name or logo contains a generic term then a disclaimer can be used stating that no exclusive claim is 3 made to that term (e.g., Software Solutions Integrated, LLC® with no exclusive claim to “Software Solutions” or “LLC”).

News Enforcement Rights Importantly, a trademark or servicemark offers protection against “confusingly similar” marks within a certain class of goods or services. For example, if a cattle farm or ranch obtained a servicemark for “the breeding and sale of seedstock cattle” it would not have trademark protection if someone decided to use the mark for an agricultural magazine or a t-shirt. That said, each trademark class of goods and services has a separate filing fee. Beef cattle operations should choose the number of classes that properly cover the goods and services offered to the public. Symbols Although registration is not essential to trademark protection in the United States, if eligible, trademark registration with the USPTO greatly enhances legal protections to the trademark owner within a class of services or goods. Before registering a mark with the USPTO, a beef cattle operation can usually use the small (servicemark) or ™ (trademark) symbol to help protect the brand. registered trademark, it can use the ® symbol by the mark. What Next Once trademark registration is obtained, the work is not over. The farmer or rancher must renew the mark at 6 years, 10 years, and every decade thereafter showing the USPTO that the owner is still actively using the mark in interstate commerce. If these deadlines are not timely met, the applicant will need to reapply for the trademark. A good trademark lawyer will help calendar these deadlines to ensure that the client does not miss these important renewals; however, cattlemen and women should also pay attention to these deadlines. To help manage deadlines for multiple trademarks, livestock operations are encouraged to work with their lawyer and maintain a trademark spreadsheet to help organize important information relating to the trademarks, including renewal deadlines. Once a farm has obtained a trademark on the principal registry, it may license use of the trademark to other persons for a monthly or annual fee. For example, Farmer Jane may come up with a great slogan or logo for agri-tourism and wish to license it out to those farms who
wish to use that mark. The owner of the trademark may also sell or assign its trademark rights to another owner. A trademark assignment is an important (and sometimes forgotten step) with the sale of an agribusiness. Beware of Trademark Infrigement Finally, before starting a business, it is prudent to run a search on the USPTO’s website to ensure that another person or entity has not already registered a confusingly similar mark. In certain cases, it is wise to hire a professional searcher to give a thorough report of similar trademarks filed at the state and federal level and other public records. Even if someone has not filed a trademark does not mean that they do not have trademark rights to protect their brand. Trademark registration 4 gives the owner a rebuttable presumption in court that they were “first in time, first in right” to the use of the mark. Before filing a trademark with the USPTO, beef cattle operations are advised to consult an agriculture attorney licensed in any U.S. jurisdiction. To file a trademark at the state level, a farm or ranch should work with an attorney licensed in that state. ©ACA
