Notice Of Annual School Budget Meeting Budget Referendum And Election
NOTICE IS HEREBY GIVEN that the Annual School Budget Meeting (Public Hearing) for qualified district residents will be held in the Lake Shore High School Library Media Center, 959 Beach Road, Angola, New York on Tuesday, May 2, 2023 at 7:00 p.m.
FURTHER NOTICE IS HEREBY GIVEN that the Annual School Budget Referendum and Election for (1) approval of the Annual School District Budget for the 2023-24 School Year; (2) voting on a proposition regarding the purchase of replacement vehicles; (3) voting on a proposition regarding a Capital Improvement Project; (4) the Election of two qualified district residents to the office of Member of the Board of Education; and (5) for the transaction of such other business as is authorized by law, will be held on Tuesday, May 16, 2023, between the hours of 9:00 a.m. and 9:00 p.m., in the Lobby located outside the District Office/Gymnasium of the Lake Shore High School located at 959 Beach Road, Angola, New York 14006.
TAKE FURTHER NOTICE that a copy of the statement of the amount of money which will be required for the 2023-24 fiscal year for school purposes, exclusive of public monies, may be obtained by any District resident beginning May 2, 2023 through and including May 16, 2023, excluding weekends and holidays, at the District Office, 959 Beach Road, Angola, New York or in each school building between the hours of 8:00 a.m. and 3:00 p.m.
TAKE FURTHER NOTICE that all candidates for the office of Member of the Board of Education shall be nominated by petition. Each nominating petition shall be directed to the District Clerk, shall be signed by at least twenty-five (25) qualified voters of the District, and shall state the residence of each signer, and shall state the name and residence of the candidate. Petitions shall be filed in the District Clerk’s Office located at 959 Beach Road, Angola, New York between the hours of 8:00 a.m. and 3:00 p.m., Monday through Friday except Holidays. Each petition must be filed in the District Clerk’s Office by no later than 5:00 p.m. on Monday, April 17, 2023. The two candidates who receive the highest number of votes at the Annual Meeting will fill the expired terms of the two incumbents. The candidate who receives the highest number of votes will be elected to serve a term which will commence immediately after the election (upon filing the oath of office) and continue until June 30, 2026. The candidate who receives the second highest number of votes will be elected to a three-year term commencing on July 1, 2023 and continuing until June 30, 2026.
TAKE FURTHER NOTICE that voting will consist of voting on the budget and on the following propositions, as well as other such matters as may be lawfully presented at the meeting:
PROPOSITION NO. 1
Shall the following resolution be adopted:
RESOLVED, that the budget for the Evans-Brant (Lake Shore) Central School District for the fiscal year commencing July 1, 2023, and ending June 30, 2024, as presented by the Board of Education is hereby approved and adopted and the required funds therefore are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the District to be levied and collected as required by law.
PROPOSITION
NO. 2
Shall the following resolution be adopted:
RESOLVED, that the Board of Education of the Evans-Brant (Lake Shore) Central School District (the “District”) is hereby authorized to purchase the following replacement vehicles for use by the District in the transportation of students and general use by the District: one (1) full size battery electric powered 71-passenger school bus at an estimated maximum cost of $440,259.32; and one (1) 30-passenger gasoline-powered school bus at an estimated cost of $105,650.80; for a total aggregate maximum cost of $545,910.12; with such aggregate cost to be raised by a tax upon the taxable property of the District to be levied and collected in annual installments as provided in Section 416 of the Education Law, with such tax to be partially offset by State aid available therefore, and, in anticipation of such tax, by the issuance of debt obligations of the District as may be necessary, not to exceed such maximum aggregate cost. No tax levy increase is anticipated for Proposition No. 2.
PROPOSITION NO. 3
Shall the following resolution be adopted, to wit:
RESOLVED, that the Board of Education (the “Board”) of the Evans-Brant (Lake Shore) Central School District, Erie County, New York (the “District”) is hereby authorized to undertake a capital improvement project consisting of (i) the construction of alterations, renovations and improvements to the District’s school building and associated facilities, including improvements to recreation and athletic facilities, (ii) site work improvement for various school purposes and (iii) other appurtenant and related improvements, and the acquisition and installation in and around the foregoing improvements of original furnishings, equipment, machinery, apparatus and technology improvements, and other services incidental thereto; all at a total estimated maximum cost not to exceed $59,500,000, with such cost being raised by the expenditure of $10,000,000 from the District’s existing “Capital Reserve Fund, 2021” (said fund being established pursuant to a proposition approved by the qualified voters of the District on May 18, 2021), and with the balance thereof, not to exceed $49,500,000, being raised by a tax upon the taxable property within said District to be levied and collected in annual installments in such years and in such amounts as may be determined by the Board as provided in Section 416 of the Education Law, with such tax to be partially offset by State aid available therefor, and in anticipation of the collection of such tax, by the issuance of debt obligations of the District as may be necessary.
TAKE FURTHER NOTICE that applications for absentee ballots may be obtained Monday through Friday, except holidays, between the hours of 8:00 a.m. and 3:00 p.m. in the District Clerk’s Office located at 959 Beach Road, Angola, New York. Completed applications must be received by the District Clerk or her designee at least seven (7) days before the annual meeting and election (May 9, 2023) if the ballot is to be mailed to the voter or by the day before the election (May 15, 2023) if the ballot is to be issued to the voter in person. Completed absentee ballots must be received by the office of the District Clerk no later than 5:00 p.m. on May 16, 2023.
TAKE FURTHER NOTICE that military voters who are qualified voters of the school district may apply for a military ballot. Applications for military ballots may be obtained from the District Clerk’s Office and the military voter may designate a preference to receive the application and/or the military ballot by mail, fax or email. Completed applications for military ballots must be received by the District Clerk or her designee by no later than 5:00 p.m. on April 21, 2023.
TAKE FURTHER NOTICE that a list of all persons to whom absentee voter ballots are issued will be available for public inspection between the hours of 8:00 a.m. and 3:00 p.m. in the office of the District Clerk on the five days prior to the annual meeting and election, except Sundays, and such list will be available at the polling place during the annual meeting and election. Any qualified voter may, upon examination of such list, file a written challenge of the qualifications as a voter of any person whose name appears on such list, stating the reasons for such challenge. Such written challenge shall be transmitted to the District Clerk before the close of the polls.

Lee Daniel LeRoy
We’re saddened to announce that on April 6th at 9:00 a.m., Lee Daniel Leroy, Seneca Nation, Wolf Clan passed away at the age of 87. Dan passed away surrounded by loved ones. Born May 2nd, 1935 Dan was the son of Lee Daniel Leroy Sr. and Dorothea Ann (Burr) Leroy predeceased by his siblings Leah, Sid, Hope, Tyrone, Joan, Kenny, Jane and Ben. Survived by his beloved spouse Sharon Porter and dog Geo; and also survived by his sisters Irene (Leroy) Jimerson and Sharon Leroy. Also, survived by many nieces, nephews, great and great-great nieces and nephews. Dan was a longtime dedicated Fireman for the Cattaraugus Volunteer Fire Department. He was an avid golfer and bowler. Dan was a big supporter of our youth and was often seen on the sidelines of many games in our community. He was a dedicated Conservation Officer for the Seneca Nation and cared very much for our environment; so much that he started Po Dan’s garbage business on the Cattaraugus Territory. Many of his financial earnings went towards the community, sports programs, benefits, foundations, individual causes and his favorite charity the SPCA. He was called “Uncle Dan” by many and “Po Dan” by others. He lived a blessed life and will be deeply missed. Friends called at the Wentland Funeral Home 10634 Main St. (Rt. 62) North Collins, NY where funeral services were also held.
