INTRODUCTION

EauClaireParks,Recreation,andForestry(ECPRF)facilitiesarehometomanydifferentathletic organizationsinthecommunity. Theyarereservableforusebygroupswithexistinguseagreementsas wellastootherorganizationswithoutuseagreements,includingthegeneralpublic. Thismanualdetails policiesandproceduresforallECPRFathleticfacilities. Greatcarehasbeentakentoensurethismanual explainstheoperationofeachfacilityindetail. Pleasereviewittoanswerquestionsregardingyour organization’suseofthefacilitiesofferedthroughECPRF.

Existinguseagreementsmayhavetermsandconditionswhichsupersedeportionsofthismanual. By reservingECPRFfacilities,anygroupororganizationreservinganECPRFfacilitywhichdoesnothave anexistinguseagreementacknowledgesandagreestothegeneralfacilityuseagreementattachedin appendixBattheendofthismanual.

Aswegearupfortheballfieldseasonthissummer,ourcollectiveeffortsplayacrucialrolein maintainingthefieldsandensuringanenjoyableexperienceforallusers.Herearesome essential guidelinestohelpusachievethatgoal.

RainwaterManagement:

Whenitrains,pleaseavoidpushingwaterfromtheinfieldintothegrass.Weunderstandthe eagernesstoresumeplay,butdoingsocreatesunsafelipsforfuturegamesandposeschallenges formaintenance.Instead,considergentlyshiftingpuddleswithintheinfieldtoexpeditedrying.If youuseafielddryingagent,applyitsparinglytothemoundandhomeplateareas.Overusecan leadtolong-termissues.

MindfulRaking:

Duringbreaksbetweengamesorinnings,refrainfromrakingballfieldmaterialintothegrass. Suchpracticeswearouttheedges,createunsafelips,andmakeremovalfromthegrassdifficult. It’sbesttosteerclearofallfieldedgesineverysituation.

Post-GameCleanup:

Attheendofthenight,storethebasesawayandreplacebaseplugsintheir sleeves.Noneedto worryaboutrakingorfillingholes—we’llhandlethatinthemorning.Saveyourselftheconcern; we’vegotitcovered.

DugoutResponsibility:

Encouragethekidstopitchinbykeepingthedugoutsclean.Aftereachgame,ensurethatall garbageispickedupandproperlydisposedof.Atidydugoutbenefitseveryonethroughoutthe summer.

 April15th istheearliestplannedavailabilityofanyECPRFathleticfields. Weatherandturfconditionpermitting,earlierfieldavailabilitymaybepossible. Ingeneral,reservationsarenot permittedpriortothisdate. EachspringECPRFwillcommunicateasfieldsbecomeavailablefor play.

ECPRFSYSTEM-WIDEWATERSERVICEAVAILABILITY–MAY15th

 May15th istheyearlyplanneddateforavailabilityofwaterserviceatECPRFfacilities. Weather permitting,waterservicemaybeavailableearlierthanthisdate. Portabletoiletsareprovidedat facilitieswithbathroomsuntilwaterserviceisturnedoneachspring. ECPRFwillcommunicate aswaterservicebecomesavailableateachfacility.

RESPONSIBILITIES&CODEOFCONDUCT

RESPONSIBILITIESOFGROUPSANDORGANIZATIONS

TheUserisresponsibleforallmembersofitsgroupandassuringthatallmembersareabidingbyallrules andregulationsregardingtheuseofCityofEauClaireathleticfacilities.

 TheUseranditsmembersshallprovideanyandallsupervisionnecessaryofitsactivitiesatCity ofEauClaireathleticfacilities.Thiswillincludesupervisingactivitybothonthefieldandin relatedfacilitiessuchasbleachers,concessionstands,restrooms,lockerrooms,and/orothercity facilitiesthathavebeenreserved.

 TheUsershallberesponsibleforanyandalldamagecausedbyitsmembersandshallpayforall repairorreplacementcosts.

 TheUsermaynotperformanymaintenanceoncityownedproperty,includingparks,athletic fieldsandplayingsurfaces,lockerrooms,concessionstands,orrestroomswithoutthewritten consentoftheDirectorofCommunityServices.

 AnyUserrequiringkeysforathleticfacilitiesmustcompleteasecuritykeyagreementbefore keyswillbeissued.Keysmaynotbeduplicated.Therewillbeachargeforanylostbuildingkey.

 OrganizationsmustcompleteaSpecialEventapplicationwhenchargingfeesorselling concessionsatCityofEauClaireathleticfacilities.

CODEOFCONDUCT

Itisourgoaltoprovidesafeandinclusiveactivitiesandfacilitiesatalltimes. Improperconduct includingbutnotlimitedtoinappropriatelanguage,inappropriatephysicalcontact,abuseofstafforother patrons,theft,vandalism,oranyotherillegalactivitiesarenottolerated. Inconsiderationofthesafety andsecurityofourstaffandpatrons,ECPRFreservestherighttoremoveanyonefromcurrentorfuture participationinorattendanceatECPRFactivitiesorfacilitiesintheeventofimproperconduct,including involvingECPDifnecessary.

PROCEDURES

 UserisresponsibleforcommunicatingconductpoliciesforalleventsatECPRFfacilities.

 BehaviorsnotconsistentwithECPRFmission,vision,andexpectationswillresultinejection fromtheeventfacilityandmayresultincontactinglawenforcementwhennecessary.

 Officialsareconsideredprimarygamemanagersandhavetheauthoritytosuspendplay,issue warnings,andadministerejectionstoensuretheenvironmentpromotessportsmanship,respect, andsafety.

 Anyoneresponsiblefordamagetoequipmentorfacilitieswillbeheldaccountableforall replacementandrepaircosts.

PROGRAMDIRECTORS

 Establishapositiveenvironment. Promoteandenforcecodesofconduct.

 Emphasizeplayerdevelopmentandprovidecodeofconducttocoaches,players,spectators,and officials.

 Evaluatecoachandstaffperformancesontheprincipalsofsportsmanship.

PARTICIPANTS

 Treatopponentswithrespectandexerciseself-controlinheatedmoments.

 Displaymodestyinvictoryandgraciousnessindefeat.

 Acceptthejudgementoftheofficialswithoutcomplaintorunnecessarygestures.

 Congratulatetheopponentsinasinceremannerfollowingvictoryordefeat.

 Accepttheresponsibilityandprivilegeofrepresentingyourcommunity.

COACHES

 Instructplayersontheirresponsibilitiesofsportsmanship.

PAYMENTPOLICY

 GroupswillbeinvoicedbymonthfortheiruseofECPRFfacilities.

o Paymentisdueaccordingtotheduedateontheinvoice

o Groupswithoutstandingbalancesof60dayspastdueormorewillnotbepermittedto continueuseofECPRFfacilitiesandwillnotbeabletomakeadditionalreservations untiloutstandingpastduebalancesarepaid.

 ECPRFreservestherighttodeterminealternativepaymentplantermsforfacilityuserswithout useagreementsasnecessary,includingrequiringdepositsatthediscretionofECPRF.

CANCELLATIONSANDRESERVATIONCHANGES

 Foroutdoorathleticfacilities,72hours’noticepriortothescheduledreservationtimeisrequired fornon-weathercancellationsorreschedules.

 Non-weathercancellationsandreschedulesmadewithlessthan72hours’noticewillincurthe fullchargefortheparticularreservation.

WEATHER/FIELDPLAYABILITYPOLICY–BALLFIELDS&FIELDPREPARATION

 Fieldprepsarecompletedfirstthinginthemorningonscheduledgamedates.

 Ondayswhenthereisrainoccurringorforecasted,staffwillprepfieldsaslongasthereisno standingwaterontheinfielddirtandaslongaslightningdoesnotpreventworkfromoccurring.

 Ballfieldsaredeclaredunplayableifthereisstandingwaterontheinfielddirtat12pmonany givenday. ECPRFstaffwillcheckconditionsoffieldsandcommunicateplayabilityasneeded ondayswhenweatherisinthearea.

 Groupsareadvisedtocancelorreschedulegamesthedaybeforeifinclementweatherlaterinthe dayisaconcernforaparticulargamedate.

 Forweathercancellations,groupswillnotbechargedifgamesarecancelledorifECPRF declaresfieldsunplayableBEFOREfieldprepworkhasbeencompleted. Iffieldshavebeen preppedandweathermovesinlaterintheday,chargeswillstillapplybecausetheworkhas alreadybeenperformed.

 Pleasehelptoensurethehighqualityoftheballfieldsbystayingoffthefieldswheneverthereis standingwaterintheinfielddirtoranywhereontheturfareasinfairandfoulterritory.

OUTDOORATHLETICFACILITYINFORMATION

GENERALPROCEDURES

 ECPRFreservestherighttomakefinaldecisionsregardingfacilityassignmentsandmaymake changesasdeemednecessaryinthebestinterestofthefacility.

 Scheduling,maintenance,andfieldprepforCityownedfacilitieswillbeperformedbyCitystaff.

 PetsarenotpermittedonECPRFathleticfields. PetsmustinCityparksmustbeleashedatall times. IdentifiedserviceanimalsarewelcomeatCityfacilities.

RESERVINGOUTDOORATHLETICFIELDS

 ReservationsforCityownedandmanagedfacilitiesarecoordinatedthroughtheRecreation DivisionOffice/

 OutdoorAthleticfacilitiesareavailablebeginningApril15th .

 Tournamentrequestsmaybesubmittedoneyearinadvance.Tournamentschedulesforreserved tournamentsmustbesubmittedtwoweekspriortotheevent.Latesubmissionsmayincur additionalfees.

 FieldreservationswillbeacceptedbeginningOctober1st ofeachyearforallfacilitiesforthe upcomingoutdoorathleticseasons(ApriltoNovember),andmustbereceivedbyJanuary1st of eachyearforpriorityschedulingpreference.

 Reservationrequestssubmittedlessthantwoweeksinadvanceoftheeventdatemayincur additionalfees.

 Oncereservationschedulesaresentouttoorganizations,theyareconsideredfinalconfirmation.

 Practicesarenotscheduledatballfields.

o Whenoutdoorathleticfieldsarelined,thisindicatesthefieldhasbeenreservedandfees paidbyanotheruser.Whenthishappens,pleaserefrainfromuseandfindanalternate location.

o Softballandbaseballfieldsthathavebeenfreshlyprepped/linedforgamesarenot playableforpracticesorotheruse.

PROCEDURESFORORGANIZATIONSWITHPRIORITY

All outdoor athletic fields will be reserved in the following priority, unless specifically noted otherwise:

1. Anygroupororganizationthathasacurrent,council-approvedagreementwiththeCityofEau Claireforuseofthatfacilitystatingtheirrightforpriorityreservation

2. Regularevents,tournaments,competitionswithanagreement

3. ParksandRecreationPrograms&Activities

4. PlayoffGames–NationalCollegiateAthleticAssociation

5. PlayoffGames–WisconsinInterscholasticAthleticAssociation

6. VarsityConferenceGames–UniversityofWisconsinEauClaire

7. VarsityConferenceGames–EauClairePublicSchools

8. VarsityConferenceGames–EauClairePrivateSchools

Ifthereservationschedulemustbechanged duetoanunforeseenschedulingconflict,ECPRFwill attempttomediateasolutionwithanyandallpartiesaffectedbytheconflict. Ifthepartiesaffected cannotresolvetheproblemcollectively,theCityreservestherighttounilaterallychangethe reservationschedule.

PRIORITYRESERVATION-LARGESCALESPECIALEVENTS&MAJORCOMMUNITY EVENTS

Outdoorathleticfieldreservationsforlarge-scalespecialeventsand/ormajorcommunityeventswillbe acceptedfromthesponsoringorganizationbeginningSeptemberoftheyearpriortotheevent.ECPRF willcoordinatereservationofcityfacilitiesforthespecialeventandwillserveastheliaisonbetweenthe specialeventandthepriorityreservationgroup.Theeventwillbeconsideredconfirmedwhenanyuser grouphavingpriorityreservationforthefacilitiesrequestedhasagreed,inwriting,towaivetheirrightto facilityuseduringthetime(s)anddate(s)requested.

LIGHTNINGPOLICY

Criteriaforsuspensionandresumptionofanevent,athleticcontest,swimmingatFairfaxPoolorany otheractivitybeinghostedbyECPRF:

 Whenthunderisheard,orlightningisseen,thethunderstormiscloseenoughtostrikeyour locationwithlightning.Suspendplay,activity,oreventandtakeshelterimmediately.This includesplayers,officials,fans,patronsandCityemployees.

 Thirty-minuterule.Onceplay,activity,oreventhasbeensuspended,waitatleast30minutes afterthelastthunderisheardorflashoflightningiswitnessedpriortoresumingplayoractivity.

 Anysubsequentthunderorlightningafterthebeginningofthe30-minutecount,resettheclock andanother30-minutecountshouldbegin.

 ECPRFstaffarerequiredtofollowthelightningpolicyandwillnotaltertheiroperationsto accommodateearlyresumptionofplayorcompletionofmaintenancework.

 ThesearethesamecriteriaasrecommendedbytheWisconsinInterscholasticAthleticAssociation.

BollingerFieldsComplexwasbuiltasjointpartnershipbetweentheCityofEauClaireandtheUniversity ofWisconsin-EauClaire. TheUniversityusesthefieldbetweenAugust15andMay15ofeachyearfor UniversityRecreationandAthletics,andtheCityusesthefieldbetweenMay15andAugust15for summerrecreationprograms. Useandoperatingcostsaresharedbythetwoorganizations.

PROCEDURES

 RequestsforreservationsbetweenAugust15th andMay15th shouldbedirectedtotheUniversity ofWisconsin-EauClaire. Contact:715-836-2546

 ACityofEauClaireSpecialEventformmustbecompletedfortournamentsand/orspecial eventsheldattheBollingerAthleticFieldComplexbetweenMay15th andAugust15th .

 PriorityreservationforthisfacilitywillbedifferentthanstatedingeneralpoliciesfromApril1 throughtheendofthespringHighSchoolseason:

3. ECPRFPrograms&Activities

4. CommunityEvents

 ECPRFprogramswillhaveschedulingpriorityafterthehighschoolseasononallfields.

 TeamsnotassociatedwithECPRFmaypracticeonthefieldsonafirstcomebasis.Practiceswill notbescheduled. Basesandlightswillnotbeavailableforpracticesandunscheduledevents.

 Basesandlightswillnotbeavailableforindividualsandgroupswithoutawrittenagreement.

 FieldsmaybereservedforgamesbyorganizedgroupsaftertheECPRFscheduleiscomplete. Groupswithuseagreementswillbeinvoicedforreservationcharges.

 Chargesmustbepaidatthetimeofreservationforgroupswithoutauseagreement.

BATHROOMS/LIGHTS/KEYS/WATER/ALCOHOL

 WaterserviceiscontrolledbyUWECandistypicallyavailablebyMay15th ofeachyear.

 Groupsareresponsibleforturningfieldlightsonandoffandforopeningandclosingbathrooms foruseduringtheirreservedactivities,withkeysprovidedviacheckout.

 ThebathroomsonthecornerofHamiltonandSteinareavailableforusewithakey.

MAINTENANCE

 ECPRFwillprovidefieldpreparationandgeneralfacilitymaintenanceforCarsonBaseball Stadium.

 EauClaireBaseball,L.L.C.(ECExpress)willoperatethestadiumforgamesandevents, includingopeningthestadium,operatingconcessions,andprovidinganyadditionalfieldand stadiummaintenanceforeventsscheduledatCarsonParkBaseballField.

 NoothergroupororganizationisallowedtoperformmaintenanceattheCarsonParkBaseball Stadium,includingfieldmaintenance.

SCHEDULING&USE

 ReservationsfortheBaseballStadiumwillbecoordinatedthroughtheRecreationAdministrative Office. Allreservationsmustbesubmittedbyanauthorizedrepresentative,inwriting,including theday,date,gamestarttime,andifthegameisasinglegameordoubleheader.

 CarsonParkBaseballStadiumwillbereservedforgamesonly. Practiceswillnotbescheduledat thefacility.

 Nomorethan3gameswillbescheduledatCarsonBaseballFieldonanygivenday. Requeststo playmorethan3gamesmustbeapprovedbytheECPRF.

 Teamsarepermittedintothebaseballstadiumtwohoursbeforetheirscheduledgametime. Battingpracticemusttakeplaceinthecagesalongthe1stbaseline.

 Eachteamispermitted15minutesofwarmupontheinfieldbeforetheirscheduledgametime.

 PriortoJune1st,priorityschedulingwillbeasstatedintheProceduresforOrganizationswith Prioritysection,givingfirstpreferencetopublicHighSchools,thenUWEC,thenprivateHigh Schools. AfterJune1st,EauClaireBaseballL.L.C.haspriorityschedulingfortheirleague scheduleandtournaments. Othergroupsandorganizationswillbegivenpriorityasfollows:

 GamesandeventsattheCarsonParkBaseballStadiumwillbescheduledsothatthepatronsofsuch gamesandeventsareanticipatedtobeoutoftheStadiumatleastthreehourspriortothestartofany EauClaireBaseballL.L.C.(Express)scheduledgame.Anyextra-inninggamesmustconcludewithin thistimeframe.

GAMES&PERSONNEL

 Expresswillopen,close,andoperateconcessions.

 AllpersonnelnecessarytosuperviseactivitiesattheBaseballStadiumwillbetheresponsibility oftheusergroup,includingactivitiesonthefield,lockerrooms,bleachers,groundsarea,andrest rooms.

 Restroomsarenotavailableuntilthewateristurnedon,usuallybyMay15th. Portabletoilets willbeavailableinAprilandMay. ECPRFwillprovideandmaintaintheportabletoilets.

 FieldprepbetweengamesforscheduledDoubleHeadersofthesameorganizationwillbethe responsibilityofthehostorganization(exceptExpress/UWECgames).Toolswillbeavailablefor use,butnoproduct.PrepwillbeprovidedbytheCitywhentherearebacktobackgames scheduledwithdifferentorganizations(Cavaliers/Express,UWEC/ECASD,etc)

 Theusergroupwillberesponsibleforprovidingtheirowngameannouncerandscoreboard operator.

 Accessintotheoldpressboxisavailabletoallteams.Teamsrequestingaccessintothenewpress boxwillneedEauClaireExpressapproval.

 Eachschoolusingthestadiumwillberesponsibleforcontrollingthenumberofpeopleallowedin thepressbox. Accessshouldbelimitedtoradiopersonnel,scouting,scoreboardandannouncer, statistician,andcoaches.Childrenarenotallowedinthepressbox.

 Ifused,thescoreboardmustbeshutoffattheconclusionofthegamethecontrollermustalsobe unpluggedandplacedinitscase.

 ThemessageboardinsidethestadiumismanagedandoperatedbytheEauClaireExpress.

LOCKERROOMS

 Lockerroomsarenotavailableuntilwaterserviceisrestoredfortheseason.ECPRFwillnotify thestadiumuserswhenlockerroomsareavailable.

 Anydamagestothefacilitywillbetheresponsibilityofthescheduledorganization.

 TheEauClaireExpresswillhaveexclusiveuseofthelockerroomonthefirstbasesideofthe stadium.TeamswantingtousethisfacilitymayrequestapprovalfromtheExpress.

 AllotherstadiumusersandtheteamopposingtheExpresswillutilizethelockerroomonthe thirdbasesideofthestadium. Thehometeamdeterminestheuseofthisfacility.

BATTINGCAGES&DUGOUTS

 On-fieldbattingpracticeisnotavailableatCarsonBaseballStadium. Battingcagesareprovided alongthefirstbaselineforpregamebattingpractice.

 Asasafetyprecaution,allteampersonnel,players,coaches,trainers,andbatboysnotplayingon thefieldarestronglyencouragedtostaywithinthedugouts. Anyteamsandteampersonnel outsidethedugoutsacceptallrisksassociatedwithbeingoutsideofthedugoutsduringplay.

 Softtossisnotpermittedonthechainlinkfences.

PARKING

 AllparticipantswillbeexpectedtoparkinthemainparkinglotinCarsonPark. Vehiclesneeded forloading/unloadingmaybebroughtintothestadiumareaforunloading;howevertheywill needtobemovedtothemainparkinglotpriortothegamestart.

HobbsIceArenareservationsforlarge-scalespecialeventsand/ormajorcommunityeventswillbe acceptedfromthesponsoringorganizationuptotwoyearspriortotheevent. ECPRFwillcoordinate reservationofcityfacilitiesforthespecialeventandwillserveastheliaisonbetweenthespecialevent andthepriorityreservationgroup. Theeventwillbeconsideredconfirmedwhenanyusergrouphaving priorityreservationforthefacilitiesrequestedhasagreed, inwriting,towaivetheirrighttofacilityuse duringthetime(s)anddate(s)requested.

CONCESSIONSOPERATIONS

POLICY

TheCityofEauClaireownsandoperatesfourconcessionstandsincluding;CarsonFootball/Softball, FairfaxPool,HobbsIceCenter,andSoccerPark.TheCitywillmanagethefacilityandoperationsatall locationswithoutanexclusiveconcessionsprovideragreement.

PROCEDURESFORTHESALEOFFOOD&BEVERAGES

 Netprofitsfromtheoperationofthestandduringspecificeventsmaybesharedwithusergroups providedtheysupplytherequirednumberofvolunteerworkers.  Wheneverpossible,compostableorrecyclableproductswillbeusedintheconcessionstandsfor thepurposeofservingfood.

ECPRFGENERALRESPONSIBILITIES

 ConcessionstandoperationswillbesupervisedbyECPRFwithassistancefromtheRecreation ProgramSupervisorwhoisthedesignatedsupervisorinchargeofconcessionsoperations.

 CitywillhireandpayoneConcessionOperationsSpecialistwhoisresponsibleforconcession operationsandsafefoodhandlingpractices.

 TheCitywillretain100%ofnetrevenuesforallnewevents.Approvedusersmayprovide volunteerstopreparefood,clean,andrestockfor100%netrevenues.TheCityreservestheright tochargeanadministrativefeetorecovercoststooperatethestands.

 Netrevenuesforallapprovedgamesandeventswillbepaiddirectlytotheusergroupasagreed upon.Netrevenuesarecalculatedasgrossprofitlessproduct,staffing,andotherexpenses.Ifthe

usergroupdoesnotprovidevolunteersattherequestedlevel,andtheCityneedstostaffthe stand,theCitywillretainallrevenues.Theremaybeanadditionalchargeifvolunteersarelate.

 Citywillopenconcessionsandretainallrevenuesforalllowerlevelgames,and othereventsscheduledonthefootballfieldandsoftballfields.Lowerlevelgamesandother eventsmayhavealimitedmenuandminimalstaffinglevel.

 Citywillprovideallconcessionsequipmentandproductrequiredtooperatethestands.

 Citywilldeterminemenuitemsandsetpricing.

 TheCityofEauClairemayhaveanexclusivepouringrightscontractwithabeveragevendor. OnlybeveragesincludedintheagreementmaybesoldatCityofEauClaireathleticfacilitiesas notedaboveincludingCarsonBaseballStadium.

 TheCitywillprovideanAEDandspillkitforcleaningbloodandinfectiouswaste,locatedinthe grandstandlockerroomhallwayofthefootballstadium.Thespillkitincludesdirectionsfor clean-upanddisposalofwastematerials.

 TheECPRFon-siteleadwillmonitorthestandoperationsasdescribedbelow.

ECPRFON-SITELEADRESPONSIBILITIES

 TheECPRFon-siteleadisresponsiblefororderingproduct,hiringandtrainingcashregister operators,inventory,wastecontrol,opening/closing,maintainingvalidlicensing,followingsafe foodhandlingguidelines,workingwithschool/organizationeventcoordinators,cashhandling procedures,validatingregisterreceiptsattheendofeachgame,andpaymenttoorganizations.

 TheECPRFon-siteleadwillmonitorconcessionmenu:

o Pre-packagedgoods,suchascandybars,chips,icecreammaybesold

o Hotdrinkssuchascoffeeorcocoawillbesold

o Foodpreparedonsitecanbesold,suchashotdogs,popcorn,nachos,pretzels

o Meatssuchashotdogs,bratsandhamburgerscanbecookedonanoutdoorgrill.Precookedmeatscanbepreparedusingarollergrill.Hamburgersmustbebought"grill ready"inhamburgerpatties.

o Pizzamaybesold.Ifsoldbytheslicefoodwarmersatpropertemperaturesmustbeused tomaintainfoodsafety.Foodwarmersarenotnecessaryifpizzaissoldasawholepie.

o Concessionitemscannotbemadeathomeandbroughttothestandforsale(suchaschili, barbeque,etc.).

 TheECPRFon-siteleadwillmonitorsafefoodhandlingpractices

o Fooditemsmaynotbehandleddirectlyunlessitisapre-packageditemlikecandybars. Plasticglovesortongsarerequiredwhenservingitemslikehotdogsornachos.Hands shouldnotcomeindirectcontactwithanyfoodproduct.

Thecoordinatorwillbenamedbytheschool/leagueofficialorAthleticDirector.Thecoordinator isresponsibleforschedulingandassigningvolunteers,followingsafefoodhandlingguidelines, andvalidatingregisterreceiptsattheendofeachgame.*

 UsergroupsprovidevolunteersasrequestedbytheRecreationProgramSupervisorforeach varsity/semiprolevelgameorapprovedevent.

 Usergroupsmayrequestonesatelliteconcessionstandwithinthestadiumareawithprior approvalfromtheRecreationProgramSupervisor.Usersareresponsibleforsatellitestand staffingandsetup/clean-up,andhandwashingstation.

 Storagespacesarenotavailableforon-sitestorageofusergroupspecificmaterialsorsupplies.

 Donateditemswillnotbeacceptedforcityoperatedconcessionsales.

 Foodsalesoutsideofthestadiumareaareconsideredspecialeventsandarerequiredtofollowthe specialeventprocess.AllspecialeventsmustbeapprovedadministrativelybytheSpecialEvents CommitteeorbyEauClaireCityCouncil.Allowapproximately60daysforthereviewand approvalprocess.

 Complimentaryitemsandproductgivenfreetoanyone,includingofficials,mustberecordedand willbechargedtotheusergroup.

 Wastewillberecordedattheendoftheeventandchargedtotheusergroup.Theusergroupis responsibleformonitoringtheamountofproductmadeandisencouragedtoworkwiththe managerondutytodetermineprepamounts.Afterwasteisrecorded,theusergroupmaytakethe unusedproduct.

PARKING

 Allstaffandvolunteersshouldparkinthefacilityparkinglots.Parkingisnotavailablewithin anyeventarea.AtCarson,vehiclesneededforloading/unloadingmaybebroughtintothe stadiumareaforunloading.However,theywillbeneededtobemovedtothemainparkinglot priortothegamestart.Vehiclesparkedwithintheeventareawillbetowedattheowner’s expense.

CONCEALEDWEAPONS

 ConcealedweaponsarenotpermittedinsideanyfacilityorStadiumarea.

ReceptaclesforwastewillbeprovidedbyECPRF.

RECYCLING

 BoththeCityandtheuserareresponsibleforrecyclingateachfacility.

ECO-FRIENDLYPRODUCTS

 TheCityiscommittedtopromotingahealthyenvironmentandwillpurchaseeco-friendly “green”productsintheconcessionstandwhenpossible.

GeneralFacilityUseAgreement

ACKNOWLEDGEMENT OF FACILITY USE AGREEMENT

By reserving use of City of Eau Claire athletic facilities, the reserving party or group (User) acknowledges and agrees to all of the following information. Reservation of City of Eau Claire athleticfacilitiesisnotpermittedwithoutacceptanceofthisfacilityuseagreement.

WHEREAS, City owns the reserved facility or facilities, which are managed by the City of Eau Claire’s Parks, Recreation and Forestry divisions, located at 915 Menomonie Street, Eau Claire, WI54703and910ForestSt,EauClaire,WI54703;and

WHEREAS,Userdesirestousethefacility,

NOW,THEREFORE,BEITMUTUALLYAGREED asfollows:

1)USEOFPREMISES: TheCitydoesherebyagreetoallowUserthenon-exclusiveuseofthe facility,uponthefollowingtermsandconditions:

2)TERM:Termsofthisagreementshallbeforhourly,game,ordailytermsasdetailedinthe attachedfacilityreservationschedule/permit. TheCityofEauClaireallowsvaryingusesofthe facilityaccordingtotheattachedfacilityreservationschedule/permit.

3)FEES:FeesforusearedetailedintheCityofEauClaire’sscheduleoffeesandlicenses locatedonlineatwww.eauclairewi.gov/athleticfacilities andasdetailedintheattachedfacility reservationschedule/permit. Feesarepayableuponreceiptofinvoiceandwillbeinvoiced monthlyforeachmonth ofreservedfacilityuse. One-timereservationsrequirepaymentatthe timeofreservation.

4)CONCESSIONSOPERATIONS: ConcessionsareoperatedatCITYfacilitiesaccordingto theAthleticFacilitiesPolicies&Procedurespolicymanuallocatedonlineat: www.eauclairewi.gov/athleticfacilities.

5)EXCLUSIVEPOURINGRIGHTSAGREEMENTS: Usermusthonoranyproduct exclusiverightscontractsthatCITY entersintoforanyCITYfacilities.

6)FACILITYACCESSPOLICIES,RULES,ANDSCHEDULINGPROCEDURES: User agreestofollowallpoliciesandproceduresregardingfacilityaccess,keys,maintenance procedures,etc.asdetailedintheAthleticFacilitiesPolicies&Procedurespolicymanuallocated onlineatwww.eauclairewi.gov/athleticfacilities.

7)CONDUCTPOLICY: Itisourgoaltoprovidesafe andinclusiveactivitiesandfacilitiesat alltimes. Improperconductincludingbutnotlimitedtoinappropriatelanguage,inappropriate physicalcontact,abuseofstafforotherpatrons,theft,vandalism,oranyotherillegalactivities arenottolerated. Inconsiderationofthesafetyandsecurityofourstaffandpatrons,ECPRF reservestherighttoremoveanyonefromcurrentorfutureparticipationinorattendanceat ECPRFactivitiesorfacilitiesintheeventofimproperconductincludinginvolvingECPDif necessary.

8) INSURANCE: User shall take out and maintain during the term of this agreement, general liability insurance to protect against claims for damages from bodily injury, including accidental death, as well as from claims for property damage which may arise from operations of this use agreement. The amount of the insurance policy shall be at minimum, one million dollars ($1,000,000) per individual and two million dollars ($2,000,000) per occurrence with the City named as an Additional Insured of said policy AND Certificate Holder. User shall file a certificate of insurance naming the City of Eau Claire as an additional insured in conformance with these terms and shall maintain a current certificate of insurance on file with the City throughoutthetermofthisAgreement.

The City requires certificates of insurance on file at least a month prior to your first scheduled date. Organizationsthatdonotcomply willhavedates removedfrom the schedule and will not bepermittedtouseCityfacilitiesuntilacertificateofinsuranceisprovided.

9)SCHEDULINGCONFLICTRESOLUTION

Ifthefacilityrentalschedulemustbechangedduetoanunforeseenschedulingconflict,Eau ClaireParks,Recreation,andForestrywillcontactbothpartiesaffectedbytheconflicttoattempt toresolvetheschedulingproblemcollectively.Ifthepartiesaffectedcannotresolvetheproblem collectively,theCityreservestherighttounilaterallychangethefacilityrentalschedule.

10)ASSIGNMENT:Usershallnotassignalloranypartofthepremisesbeingreserved.

11) DEFAULT: The failure or refusal of User to observe each and every term and condition in the Agreement shall be deemed a breach and present use of the facility shall be terminated, future use of the facility may be denied, and User shall be responsible for all damages caused to theCitybysuchbreach.

12) INDEMNITY,

HOLD HARMLESS

: The User agrees, to hold harmless, indemnify and defend,theCityofEauClaire,itsemployees,agentsandrepresentativesfromanyandallclaims, demands, suits, losses, costs, expenses (including attorney fees), or any other type of damages, thatresultfromtheUser’suseandOccupancyofCityofEauClaireathleticfacilities.

TheCityanditsagentsoremployeesshallnotberesponsibleforanypropertydamageorloss sufferedbytheUser,itsmembers,visitors,orguestsfromwhatevercause priorto,duringor subsequenttothetermofthisagreementwhichoccursinthelockerroomsoranyotherarea propertyisstored,keptorheldbytheUser,itsmembers,visitors,orguests,andtheUserdoes promisetoholdfullyharmlessandindemnifytheCityfromanyclaimsmadeoractionsbrought whichariseoutofsuchdamageorinjury,includingthereasonablecostofattorneyfees.
