NSW Police this morning issued a statement saying that an officer had been charged over the incident and would appear in court on 2 December. The teenager was arrested by four officers in the early hours of 11 February last year in Lateen Lane.

The laying of the charge follows an investigation into the incident by the Law Enforcement Conduct Commission, which referred the matter to the NSW Director of Public Prosecutions (NSWDPP) for advice about whether charges could be laid against the officer. The Commission found that the officer engaged in serious misconduct by applying 19 baton strikes to the young person. It made no adverse findings against the other officers involved in the young

person’s apprehension. On Wednesday the officer was issued with a Future Court Attendance Notice, and he will now appear in Byron Local Court on 2 December. NSW Police has previously indicated that the officer is no longer serving in the Byron region. ‘He is now performing duties at another command,’ a NSW Police spokesperson said. The extended delay in deciding whether or not to lay charges in

relation to the incident has drawn widespread criticism of the NSW DPP, and the system more broadly. ‘The young person… and the community are entitled to know, in a timely manner, where the accountability lies in relation to this incident… and whether the officer involved will be prosecuted,’ the secretary of the NSW Council for Civil Liberties (NSWCCL) Therese Cochrane said. The NSWCCL described the delay as ‘unacceptable’ earlier this year.

As the dry conditions continue and the climate emergency news keeps rolling in, people are looking for ways to understand what is taking place and how to respond. ‘The Sixth Assessment Report by the Intergovernmental Panel on Climate Change (IPCC), released on 25 September, presents a disturbing assessment of the effects of climate change on the world’s coasts and oceans,’ said Barry Sammels, the Chair of the Australian Coastal Councils Association (ACCA). Risks for local government areas (LGA) across Australia have been categorised in the report Climate Change Risk to Australia’s Built Environment with analysis provided by Climate Risk Engines. The Byron Shire has been identified as, ‘Highly vulnerable to both forest fire and coastal inundation’ ranking 13th nationally for fire and 11th for inundation risk. In a detailed story by the ABC (https://ab.co/2pkv6Ji) the content from the report has been used to create an interface that identifies the number of potentially uninsurable addresses, based on the risk that each suburb faces. They predict that there will be increasing insurance costs that will see ‘nearly 720,000 – or one in 20’ uninsurable addresses in Australia by the turn of the century.
